MINUTES OF THE REGULAR MEETING OF THE
LA PORTE CITY COUNCIL
JANUARY 22, 1990
1. The meeting was called to order by Mayor Malone at 6:00 P.M.
Members of City Council Present: Mayor Norman Malone,
Councilpersons Betty Waters, Mike Cooper, Bob McLaughlin,
Alton Porter, Deotis Gay (arrived at 7:40 P.M.), B. Don
Skelton, Jerry Clarke
Members of City Council Absent: Councilperson Ed Matuszak
Members of City Staff Present: City Manager Bob Herrera, City
Attorney Knox Askins, City Secretary Cherie Black, Assistant
City Manager John Joerns, Assistant to the City Manager Janie

2. The invocation was given by Councilperson Waters.
3. Council considered approving the minutes of the Public Hearing
and Regular Meeting of Council held January 8, 1990.
Motion was made by Councilperson Clarke to approve the January
8 minutes as presented. Second by Councilperson Waters. The
motion carried, 7 ayes and 0 nays.
Ayes: Councilpersons Waters, Cooper, McLaughlin, Porter,
Skelton, Clarke and Mayor Malone
Nays: None
4. The Mayor presented the Employee of the Quarter Award for
September, October and November, 1989, to Carlos Vega. Mr.
Vega's supervisor, Orville Burgess, presented Mr. Vega with
a plaque.
5. At this time, the Mayor called Mr. Sid Durbin to the front.
Mr. Durbin owns and operates Travtech 2000, and has generously
offered to donate 10 percent of his receipts for leisure
travel arrangements from La Porte residents, to the senior
citizens and handicapped residents of La Porte. The Mayor
thanked Mr. Durbin on behalf of the Council.

Ms. Lou Large addressed Council regarding the smoking
ordinance. She is in favor of a smoking ordinance because of
the detrimental effects smoking has on both smokers and non-
smokers.
6. Council considered an ordinance relating to taxation of
telecommunications services and repealing the application of
the exemption provided for in Chapter 321, 321.210, VATC.
The City Attorney read: ORDINANCE 1674 - AN ORDINANCE
RELATING TO TAXATION OF THE EXEMPTION PROVIDED FOR IN CHAPTER
321, 321.210, VATC; PROVIDING FOR NOTIFICATION TO THE
COMPTROLLER OF THE STATE OF TEXAS; PROVIDING THAT NO SUCH TAX
PROVIDED FOR HEREUNDER SHALL SERVE AS AN OFFSET TO OR TO
REDUCE ANY AMOUNT PAYABLE BY ANY PROVIDER OF
TELECOMMUNICATIONS SERVICE PURSUANT TO ANY FRANCHISE, STREET
USE ORDINANCE, CHARTER PROVISION, STATUTE OR ANY OTHER
IMPOSITION OF THE CITY OF LA PORTE, MAKING THIS ORDINANCE
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING FOR
AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Cooper to deny Ordinance 1654
as read by the City Attorney Second by Councilpersons Waters
and Skelton. Councilperson Skelton wished it to be public
record that he was not in favor of this ordinance, but felt
it should be brought to Council's attention so that it could
be voted upon rather than let the State make the decision for
us. The motion to deny the ordinance carried, 7 ayes and 0
nays.

Skelton, Clarke and Mayor Malone
Nays: None
7. Council considered an ordinance prohibiting smoking in public
places except in designated smoking areas.
The City Attorney read: ORDINANCE 1674 - AN ORDINANCE
PROHIBITING SMOKING IN PUBLIC PLACES EXCEPT IN DESIGNATED
SMOKING AREAS; MAKING FINDINGS OF FACT; DECLARING SMOKING TO
BE A PUBLIC NUISANCE; DECLARING THAT A PERSON COMMITS AN
OFFENSE OF THE PERSON SMOKES AT A PUBLIC MEETING OR ANY PUBLIC
PLACE AND THE PERSON IS NOT IN A DESIGNATED SMOKING AREA, AND
PROVIDING THAT SUCH OFFENSE IS A MISDEMEANOR, AND ANY PERSON
CONVICTED OF UNLAWFULLY SMOKING SHALL BE DEEMED GUILTY OF A
MISDEMEANOR, AND SHALL, UPON CONVICTION, BE PUNISHED BY A FINE
NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00); PROVIDING A
REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
THAT ANY PERSON VIOLATING ANY OTHER PROVISION OF THIS
ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON

CONVICTION SHALL BE PUNISHED BY A FINE OF NOT MORE THAN TWO
HUNDRED DOLLARS ($200.00); PROVIDING FOR THE PUBLICATION OF
THE CAPTION OF THIS ORDINANCE; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Skelton to table this
ordinance for one month in order to receive input from
citizens and business owners. Second by Councilperson Porter.
The motion carried, 7 ayes and 0 nays.

Skelton, Clarke and Mayor Malone
Nays: None
8. Council considered an ordinance governing retention and
disposition of public city records.
The City Attorney read: ORDINANCE 1675 - AN ORDINANCE
GOVERNING RETENTION AND DISPOSITION OF PUBLIC CITY RECORDS;
PROVIDING FOR THE MICROPHOTOGRAPHY, DESTRUCTION AND OTHER
DISPOSITION OF PUBLIC RECORDS; PROVIDING A SEVERABILITY
CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson McLaughlin to adopt Ordinance
1675 as read by the City Attorney. Second by Councilperson
Waters. The motion carried, 7 ayes and 0 nays.

Skelton, Clarke and Mayor Malone

9. Council considered an ordinance approving a pipeline permit
for Enterprise Products.
The City Attorney read: ORDINANCE 915-CC - AN ORDINANCE
GRANTING A PERMIT UNDER SECTION 18-a-3 OF ORDINANCE NO. 915,
"PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED NOVEMBER 25,
1975, TO CONSTRUCT A SIX INCH PIPE LINE FOR THE TRANSPORTATION
OF BUTANE/PROPANE MIXTURE; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
Motion was made by Councilperson Waters to adopt Ordinance
915-CC as read by the City Attorney. Second by Councilperson
Clarke. The motion carried, 7 ayes and 0 nays.

Skelton, Clarke and Mayor Malone

10. Council considered approving agreement for operations and
maintenance of the La Porte Area Water Authority's surface
water transmission and distribution system by the City of La
Porte.

system. Second by Councilperson Cooper. The motion carried,
7 ayes and 0 nays.

11. Council considered awarding a bid for batteries.
Motion was made by Councilperson Clarke to award the bid for
batteries to Exide Battery Sales. Second by Councilperson
Cooper. The motion carried, 7 ayes and 0 nays.

Skelton, Clarke and Mayor Malone
Nays: None
12. Council considered awarding a bid for a humane truck.
Motion was made by Councilperson Skelton to award the bid for
a humane truck to Les Marks Chevrolet. Second by
Councilperson Cooper. The motion carried, 7 ayes and 0 nays.
Ayes: Councilpersons Waters, Cooper, McLaughlin, Porter,
Skelton, Clarke and Mayor Malone
Nays: None
13. Administrative Reports: City Manager Bob Herrera announced
a Council retreat to be held February 23, 24 and 25, 1990.
14. Council Action: Councilpersons Waters, Cooper, McLaughlin,
Porter, Skelton, Clarke and Mayor Malone brought items to
Council's attention.
15. Council adjourned into executive session at 6:45 P.M. to
discuss the following: (A) Legal - Meet with attorney
regarding Southern Ionics, Inc./Houston Chemical Services,
Inc.; (B) Legal - Meet with attorney to discuss BayMUD mobile
home litigation. Council returned to the table at 8:04 P.M.

16. There being no further business to come before the Council,
the meeting was duly adjourned at 8:05 P.M.

SUBJECT: NOMINATION OF CARLOS VEGA
Carlos Vega is an Equipment Operator I on our Drainage
Reconstruction crew. He has always been one of our most
dependable employees and always accepted any assignment without
hesitation or complaint. Never has this been more evident than
during his past evaluation period.
Carlos was given the added responsibility of setting up the work
site for his crew each day. This includes taking all necessary
safety precautions for the crew and routing traffic through the
work zone. More importantly, he accepted the most critical
aspect of the drainage reconstruction work. This is taking the
drainage profiles and design sheets provided by the Engineering
Department and insuring that our laser is set on the recommended
grades for maximum efficiency. Carlos has no trouble making
decisions in the field when his supervisor is unavailable. This
entails changing recommended grades and resetting pipe when
actual field conditions differ from the expected in house design.
This results in elimination of down time and insures projects are
completed on a timely basis. Carlos always informs his
supervisor of his decisions and they have all proven to be sound
and cost effective. Carlos then makes notations of the changes
he made to turn into Engineering for their files.
In addition, Carlos is a very capable welder who is in big demand
from other departments due to the absence of a funded welder
position. He can weld and fabricate anything and does an
excellent job on this as well. Carlos is the type of employee
who takes pride in any assignment and never complains, the type
who makes my job easier and the type we all try to recruit. It
is with great pride I recommend Carlos Vega for your
consideration as "EMPLOYEE OF THE QUARTER."

SUMMARY AND RECOMMENDATION
Current State law provides that telecommunications services are exempt from local
sales tax. State law also provides the means for a City to repeal the exemption
if it so desires.
I spoke with the State Comptroller's Office and found that the services that
would be taxed are primarily long-distance telecommunication services that
originate and end in Texas.
The City of La Porte has a 1% Local Option Sales Tax. If the City were to repeal
the exemption, its citizens would incur a 1% increase in their in-state long
distance service. This 1% tax would be collected by the State and then passed on
to the City.
A rough estimation of revenues the City of La Porte could expect to receive from
this new tax is X30,000 to X35,000 per year. The X30,000 to X35,000 per year in
revenue represents 1/4 percent of the General Fund Revenues.
To implement the telecommunications tax, the City of La Porte would need to pass
an ordinance repealing the telecommunication exemption.

I enclose for your consideration at the workshop meeting of January
15, 1990, a proposed smoking ordinance for the City of La Porte.
I would like to acknowledge the research assistance of Ms. Janie
Bais, Assistant to the City Manager. Ms. Bais obtained copies of
ordinances from Friendswood, Baytown, Houston, Deer Park, and San
Diego, as well as a model city nonsmoking ordinance from the Texas
Municipal League, which appears to have been largely based upon the
City of Austin ordinance. Also, ordinances were obtained from San
Antonio, Arlington, and Albuquerque, New Mexico. I have also
referred to materials from the National City Attorneys Association.
I would describe the draft ordinance as "middle of the road" in
comparison to the ordinances examined from the various other cities.
I also enclose a copy of Section 48.01 of the Texas Penal Code,
which was enacted in 1975. It has not been amended since that date.
You will note that Section 2 of the 1975 Act specifically states
that the Act does not preempt any ordinance adopted by a government
entity now or in the future relating to smoking of tobacco.
However, in order to be consistent with state law, I have indicated
in the draft ordinance that designated smoking areas may not be
established on public school property, elevators, theaters, movie
houses, libraries, museums, hospitals, as well as other public
places. Although the state law preemption clause would possibly
allow a more lenient treatment of these facilities in a city
ordinance, I would not recommend doing so.

SIIMMARY & RECOMMENDATION
Municipalities in Texas are mandated to have a Records Management
Program in place by September of 1990.
The City of La Porte has had a Records Management Program in place
for several years. However, it has not been formally adopted by
Council in order to comply with the State mandate. The attached
ordinance will bring the City in compliance.
The Ordinance presented is adapted from the Ordinance approved by
the State for the City of Seabrook.

SUMMARY & RECUMMENDA'PION
An agreement for the operations arrd maintenance of tY~e La Porte Area Water
Authority's surface water transmission and distribution system by the City
of La Porte was approved by the LPAWA Board of Directors on January 9,
1990. The term of this agreement would be from October 1, 1989 to
September 30, 1990.
Under the proposed agreement, the City of La Porte would agree to perform
all of the necessary daily routine operations and maintenance for the
supply of surface water from the Southeast Water Purification Plant to the
LPAWA customer entities of La Porte, Morgan's Point, and Shoreacres. For
the performance of. this cortract, the City of Ira Porte would receive a sum
of Tlrree Thousand `T'hree Hundred Thirty-Three Dollars and Thirty-Three Cents
($3,333.33) per month. Any repairs, operations, or adjustments outside the
sr_ope of this contract wil]. be bi.ller3 ai: actual. cost to t}ie LPAWA. Funds
for the supplies, rTlaterials, and services necessary to the operation of the
system will come from tt~e LPAWA 1989/90 Operational Budget.
Staff recommends approval of the contract between the City of La Porte and
the La Porte Area Water Authority for the operations and maintenance of the
Authority's surface water transmission and distribution system.
Action Required by Council:
Approve a contract between the City of La Porte and the La Porte Area Water
Authority for the operations and maintenance of the Authority's surface
water transmission and distribution system at a fee of $3,933.33 monthly.

- SUMMARY & RECOMMENDATION
Advertised, sealed bids #0355 for batteries were opened and read on
December 18, 1989. Bid requests were mailed to four (4) area suppliers
with only Exide Battery Sales returning a bid.
Based on yearly estimates the cost of the contract would be Five Thousand
Seven Hundred Eighty-Five Dollars and Eighty-Seven Cents ($5,785.87).
Staff recommends award of bid to Exide, sole bidder for our annual supply
of batteries.
Action Required by Council:
Award bid for annual supply of batteries to Exide Battery Sales, sole
bidder.
