Members of City Council Present: Mayor Norman Malone, Councilpersons Betty Waters, Mike Cooper, Ed Matuszak, Bob McLaughlin, Alton Porter, Deotis Gay (arrived 6:30 P.M.), B. The invocation was given by Councilperson Skelton. 3. Council considered approving the minutes of the special meeting of Council held February 5, 1990. Motion was made by Councilperson Porter to approve the February 5 minutes as presented. Second by Councilperson Skelton. The motion carried, 8 ayes and 0 nays (Councilperson Gay had not yet arrived). Ayes: Councilpersons Waters, Cooper, Matuszak, McLaughlin, Porter, Skelton, Clarke and Mayor Malone Nays: None 4. Council considered approving the minutes of the Regular Meeting of Council held February 12, 1990. Motion was made by Councilperson Cooper to approve the February 12 minutes as presented. Second by Councilperson Waters. The motion carried, 8 ayes and 0 nays (Councilperson Gay had not yet arrived). The Mayor proclaimed March 5 through 9, 1990, as Texas Public Schools Week. Members of the La Porte ISD were present to accept the proclamation. 6. Nine Lomax Elementary School students addressed Council regarding their environmental concerns. Council was very impressed with their presentation. 7. Council considered an ordinance authorizing sale and coveyance of a certain parcel of real property by the City of La Porte. The City Attorney read: ORDINANCE 1678 - AN ORDINANCE AUTHORIZING THE SALE AND CONVEYANCE OF A CERTAIN PARCEL OF REAL PROPERTY OWNED BY THE CITY OF LA PORTE; MAKING CERTAIN FINDINGS OF FACT; AUTHORIZING NOTICE TO THE GENERAL PUBLIC OF THE OFFER OF THE LAND FOR SALE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF Motion was made by Councilperson Porter to adopt Ordinance 1678 as read by the City Attorney. Second by Councilperson McLaughlin. The motion carried, 8 ayes and 0 nays (Councilperson Gay had not yet arrived). Council considered ordinances granting pipeline permits to Big Three Industrial Gas, Inc. The City Attorney read: ORDINANCE 915-DD - AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-A-3 OF ORDINANCE NO. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED NOVEMBER 25, 1975, TO CONSTRUCT A SIX INCH PIPE LINE FOR THE TRANSPORTATION OF HYDROGEN; AND PROVIDING AN EFFECTIVE DATE HEREOF; and ORDINANCE 915-EE - AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-A-3 OF ORDINANCE NO. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED NOVEMBER 25, 1975, TO CONSTRAUCT A TWELVE INCH PIPE LINE FOR THE TRANSPORTATION OF NITRAOGEN; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Matuszak to adopt Ordinances 915-DD and 915-EE as read by the City Attorney. Second by Councilperson Cooper. The motion carried, 9 ayes and 0 nays. Council considered a resolution approving participation in a grant through H-GAC for a Computer Aided Dispatch system. The City Attorney read: RESOLUTION 90-2 - A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, AUTHORIZING THE SUBMISSION OF A GRANT REQUEST TO THE GOVERNOR'S CRIMINAL JUSTICE DIVISION FOR FUNDING TO THE CITY OF LA PORTE, TEXAS, FOR A PROGRAM KNOWN AS INFORMATION SYSTEMS/COMPUTER AIDED DISPATCH. Motion was made by Councilperson Skelton to adopt Resolution 90-2 as read by the City Attorney. Second by Councilperson Porter. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Waters, Cooper, Matuszak, McLaughlin, Porter, Gay, Skelton, Clarke and Mayor Malone Nays: None 10. Council considered approving renewal of contract with Hugh L. Landrum & Associates, Inc., for appraisal of industrial plants. The Mayor requested that this item be taken to executive session. After returning to the Council table motion was made by Councilperson Matuszak to table this item. Second by Councilperson McLaughlin. The motion failed, 2 ayes and 7 nays. Ayes: Councilpersons Matuszak and McLaughlin Nays: Councilpersons Waters, Cooper, Porter, Gay, Skelton, Clarke and Mayor Malone Motion was made by Councilperson Clarke to renew the contract with Hugh L. Landrum & Associates, Inc. Second by Councilperson Gay. The motion carried, 7 ayes, 1 nay, 1 abstain. Ayes: Councilpersons Waters, Cooper, Porter, Gay, Skelton, Clarke and Mayor Malone Nays: Councilperson Matuszak Abstain: Councilperson McLaughlin 11. Council considered a professional services agreement with Winstead, McGuire, Sechrest and Minick to represent the City in opposing Houston Chemical Services, Inc., permit application. ~ ~ Minutes, Regular Meeting, La Porte City Council February 26, 1990, Page 4 This item was taken to executive session. When Council returned to the table, motion was made by Councilperson Waters to approve the professional services agreement with Winstead, McGuire. Sechrest and Minick. Second by Councilperson Cooper. The motion carried, 8 ayes and 1 nay. Ayes: Councilpersons Waters, Cooper, Matuszak, McLaughlin, Porter, Skelton, Clarke and Mayor Malone Nays: Councilperson Gay 12. Council considered awarding a bid for construction of an fl- inch water line on Fairmont Parkway bridge at Little Cedar Bayou. Motion was made by Councilperson Skelton to award .the bid for construction of an 8-inch water line on Fairmont Parkway bridge at Little Cedar Bavou to McKev_Constructon___Companv~_ in the amount of $16,814.60. Second by Councilperson Gay. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Waters, Cooper, Matuszak, McLaughlin, Porter, Gay, Skelton, Clarke and Mayor Malone Nays: None 13. Council considered awarding a bid for repair to wave pool at Little Cedar Bayou Park. Motion was made by Councilperson McLauahlin_to award the bid for repair to the wave pool at Little Cedar Bayou Park to T & C Construction Co, Inc., deleting items 13 and 15, adding alternate 19 for waterproofing, providing a construction contingency of $3,800, and authorize funding for the Little Cedar Bayou Park Construction Account in the amount of $19,169 and the Fund 011 Continaencv Account in the amount of $22,820. Second by Councilperson Gay. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Waters, Cooper, Matuszak, McLaughlin, Porter, Gay, Skelton, Clarke and Mayor Malone Nays: None 14. Administrative Reports: The City Attorney clarified the reason for the date of the runoff election, and explained the difference between self- executing charter changes and actual charter changes which would require voter approval. Minutes, Regular Meeting, La Porte City Council February 26, 1990, Page 5 City Manager Bob Herrera extended a sincere thank you to Council for attending the retreat, and felt it had gone very well. 15. Council Action: Councilpersons Waters, Cooper, Matuszak, McLaughlin, Porter, Gay, Skelton, Clarke and Mayor Malone brought items to Council's attention. Councilperson Matuszak requested that staff research motor bike regulations. Councilperson McLaughlin requested that the Charter be looked into for a general clean-up. Councilperson Skelton requested a workshop on the smoking ordinance. 16. Council adjourned into executive session at 7:39 P.M. to address the following: Article 6252-17, Section 2(E) (Legal) - Discuss contract with Winstead, McGuire, Sechrest and Minick; Article 6252-17, Section 2(E) (Legal) - Meet with Attorney(s) regarding Southern Ionics, Inc./Houston Chemical Services, Inc.; Article 6252-17, Section 2(R) (Conference) - Receive report from City Manager regarding sale of City property; Article 6252-17, Section 2(E) (Legal) (requested by Mayor) - Discuss renewal of contract with Hugh L. Landrum & Associates, Inc. Council returned to the table at 9:53. The Mayor announced that the attorney had not arrived for the Southern Ionics/Houston Chemical Services item; the report from the City Manager was not held since this item was acted upon during regular session. The other two items were acted upon as reflected in items 10 and 11 in these minutes. 17. There being no further business to come before the Council, the meeting was duly adjourned at 10:03 P.M. The invocation was given by Councilperson Cooper. 3. Council considered approving the minutes of the regular meeting of Council held January 22, 1990. Motion was made by Councilperson Skelton to approve the minutes of January 22 as presented. Second by Councilperson Porter. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Waters, Cooper, Matuszak, McLaughlin, Porter, Gay, Skelton, Clarke and Mayor Malone Nays: None 4. The Mayor gave special recognition and commendation to Officers Jerome McKown and Ed Swenson, who saved the life of a heart attack victim by performing CPR while the EMS was en route. Also recognized was the EMS team who made the call. EMS attendant Pat Underwood spoke to express the EMS' thanks not only to the Police Department, but to the Fire Department as well. She stated that they are always there when needed, and go beyond the call of duty to be helpful to the EMS. 5. A representative from the Fraternal Order of Eagles presented the Senior Citizens Program with a check for $600.00, and ~ ~ Minutes, Regular Meeting, La Porte City Council February 12, 1990, Page 2 announced that they will give the Program $200.00 per month to aid in the Seniors' programs. At this time, Fire Chief Joe Sease introduced Chris Osten, new EMS Chief. 6. The Mayor proclaimed Heart Month,; Black History Month, American History Month, and La Porte Night at the Houston Livestock Show and Rodeo. 7. The following citizens addressed Council: Emerson Willis, speaking in favor of a smoking ordinance; Jimmie Ray Spradling, speaking in favor of a smoking ordinance; Ann Trask, addressing a problem with dirt bikes using the Exxon pipeline corridor along Old Hickory; Lou Lawler, asking that another "Clean Up-Green Up" be held; Gladys Roth, addressing the smoking ordinance and asking that Council meet with the Chamber of Commerce Board of Directors for their input. 8. Dale Conger, representative of Espey Huston, addressed Council and presented a preliminary engineering report regarding the East La Porte relief sewer project. 9. Council considered an ordinance calling the regular annual election and calling a charter amendment election. The City Attorney read: ORDINANCE 1676 - AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE CITY OF LA PORTE; CALLING A RUN-OFF ELECTION, IF NECESSARY; CALLING A CHARTER AMENDMENT ELECTION; DESIGNATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING FOR THE USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS; PROVIDING FOR METHOD AND DATES OF ABSENTEE VOTING; PROVIDING FOR AN ABSENTEE BALLOT BOARD; PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION; PROVIDING FOR NOTICE; PROVIDING FOR FILING DEADLINE AND FILING FEES FOR CANDIDATES; PROVIDING A SAVINGS CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council considered a resolution authorizing the City Attorney to represent the City in acquisition of property. Motion was made by Councilperson Clarke to adopt Resolution 90-1, authorizing the City Attorney to represent the City in acquisition of property. Second by Councilperson McLaughlin. Council considered approving a letter of agreement between the City of La Porte and Hazelwood Enterprises, amending the current disposal contract to allow State disposal fee pass- through. Motion was made by Councilperson Skelton to approve the letter of agreement between La Porte and Hazelwood Enterprises. Second by Councilperson Gay. The motion carried, 9 ayes and 0 nays. Council considered authorizing a public hearing for condemnation of dangerous buildings and setting a public hearing date. Mark Lewis, Inspector, gave a slide presentation on 13 buildings in the City that the Board of Inspections deemed dangerous. Council considered declaring an emergency and approve construction proposal of McKey Construction for relocation of a 12-inch water line. Motion was made by Councilperson Porter to declare and emergency and approve McKey Construction for relocation of a 12-inch water line, cost not to exceed $12,219.21, with the expenditure to be funded from the Utility Fund contingency account. Second by Councilperson Gay. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Waters, Cooper, Matuszak, McLaughlin, Porter, Gay, Skelton, Clarke and Mayor Malone Nays: None 15. Council considered authorizing the City Manager and the City Attorney to obtain studies and negotiate for purchase of the former bowling alley building on South Broadway Street. Motion was made by Councilperson Skelton to authorize the Cit Manager and the City Attorney to proceed with studies and negotiations for purchase of the former bowling alley building. Second by Councilperson Porter. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Waters, Cooper, Matuszak, McLaughlin, Porter, Gay, Skelton, Clarke and Mayor Malone Nays: None 16. Council considered rejecting the bid for a pool cover and authorize rebidding. Motion was made by Councilperson Waters to reiect the pool cover bid and approve rebidding. Second by Councilperson Cooper. The motion carried, 9 ayes and 0 nays. Council considered a consent agenda, as follows: (A) Consider awarding a bid for police vehicles; (B) Consider awarding a bid for chemicals and fertilizers; (C) Consider awarding a contract for janitorial maintenance service for City Hall, Public Works and Sylvan Beach Pavilion; (D) Consider awarding bid for industrial tractor loader/backhoe. Councilperson Skelton requested removal of item A; Councilperson McLaughlin requested removal of item C. Motion was made by Councilperson Gay to approve items B and D of the consent agenda. Second by Councilperson Porter. The motion carried, 9 ayes and 0 nays. The pipeline continues north to the intersection of Exxon's Houston Ship Channel West Corridor, turns west and continues across Miller Cut-Off Road to Dow Road. The pipeline then turns south and parallels the east side of Dow Road until terminating at the northeast corner of Dow Chemical's LaPorte plant. Big Three plans to parallel the six inch hydrogen pipeline with a twelve inch nitrogen pipeline beginning approximately 430 feet south of North "H" Street and following the above described routing of the six inch hydrogen pipeline to the northeast corner of Dow Chemical's LaPorte plant. The attached copy of a quad map indicates the beginning points, ending points and routing of the six inch hydrogen and twelve inch nitrogen pipelines. In the past, this vital function has been performed by Hugh L. Landrum & Associates, Inc. The total appraised value for the plants located in the Industrial District for the current fiscal year total $1,189,137,540 which translates to more than 2.5 million dollars of revenue to the City. The current contract for this service expired December 31, 1989. Attached is a draft of a replacement contract with Hugh L. Landrum & Associates, Inc. with a three year term. The charge for this service has been $32,000 each year for the past 6 years. Council held a workshop to discuss this item in January, 1990. It is staffs recommendation that this contract be renewed with an annual cost of $33,600 which is a five percent increase in the contract amount. Staff has based the recommendation of the increase on the increased activity in the Districts. There have been eight new industries added to the Districts in the last five years. Landrum & Associates, Inc. has been appraising the Industrial District properties for the City of La Porte under Contract since 1968, the latest Contract to expire at the end of 1989, and WHEREAS, Hugh L. Landrum, President of the firm of Hugh L. Landrum & Associates, Inc. has proposed to the City of La Porte that another Contract be entered into between his firm and the City of La Porte, and WHEREAS, the Mayor and City Council find, adjudicate and determine that the firm of Hugh L. Landrum & Associates, Inc., of Houston, Texas, is skilled in such matters and has scientific and technical knowledge in respect to appraisals and valuation of such properties and has performed the services called for in prior Contracts in a completely satisfactory manner, and have adequately demonstrated their skills and expertise in the matter of making appraisals and handling Industrial District Contracts, and the -1- firm's President, Hugh L. Landrum is completely familiar with the taxable property in the City of La Porte and the Industrial District contracts, and is certified by the State of Texas both as a Registered Professional Engineer and a Registered Professional Appraiser; now IT IS THEREFORE AGREED by and between the City of La Porte, Texas, acting herein by its duly authorized Mayor and City Council, FIRST PARTY, and Hugh L. Landrum & Associates, Inc., of Houston, Harris County, SECOND PARTY, as follows: I. SECOND PARTY agrees to compile a complete list of appraised values for all properties covered by Industrial District Agreements and subject to Industrial District payments to the City of La Porte, Texas, said appraised values to be as of January 1, 1990, January 1, 1991, and January 1, 1992, and it is hereby understood by both parties that the appraisals will be available by July 31, for each of the years covered by this Contract. II. SECOND PARTY FURTHER AGREES to work with the Harris County Appraisal District to apprise them of_ the area of each industrial plant that has been annexed by the City of La Porte and, therefore, subject to their assessment and a City ad valorem tax. This will apply to newly annexed areas of the City as well. III. SECOND PARTY also agrees to prepare a summary report for the City Tax Assessor-Collector each year: said report to show each industry's final total value for land, improvements, and personal property, the amount subject to the ad valorem tax and the amount of the taxes and the value subject to "in-lieu of taxes" payment and the amount of the "in-lieu of taxes" payment. IV. SECOND PARTY further agrees to cooperate with the City Administration and the City Tax Assessor-Collector in any other area where his expertise may be beneficial to them in fulfilling the responsibilities of their jobs. -2- V. IT IS ALSO FURTHER AGREED BY SECOND PARTY that in the event SECOND PARTY's proposed values are protested by the owners or representatives of the property, SECOND PARTY will at his own expense furnish expert testimony in the District Court of Harris County, Texas to defend his proposed values. VI. SECOND PARTY agrees that the City of La Porte, will in no way be obligated or indebted to said SECOND PARTY, or his agents, servants, or employees, for salaries, expenses, materials, or other charges except only as herein specifically otherwise provided. VII. IT IS FURTHER DISTINCTLY UNDERSTOOD AND AGREED by both parties hereto, that if any word, phrase, sentence, paragraph, or provision of this Contract shall be for any reason declared or adjudicated to be invalid, such declaration or adjudication shall not affect the remaining portion thereof. VIII. FOR AND IN CONSIDERATION of the skilled services, technical knowledge, and experience of SECOND PARTY in performance of the obligations devolving upon such PARTY hereunder; and in consideration of the information given and assistance furnished by SECOND PARTY to the City Tax Assessor-Collector in her undertaking to calculate Industrial District Taxes and "in lieu of taxes" payments for calendar years 1990, 1991, and 1992; FIRST PARTY agrees and obligates itself to compensate SECOND PARTY by payment to SECOND PARTY the following sums, to-wit: a) for calendar year 1990, the sum of THIRTY-THREE THOUSAND SIX HUNDRED DOLLARS ($33,600.00). b) the fee for calendar year 1991 shall be subject to re-negotiation between the parties, such re-negotiations to be conducted in October, 1990. SECOND PARTY shall keep time records of the time expended by each of its personnel, in the performance of this agreement, and make such detailed records available to FIRST PARTY, as part of such fee negotiations. It is contemplated that the parties, as a result of such fee negotiations, shall either agree on a fixed fee for calendar year 1991, or agree on an hourly rate to be paid to SECOND PARTY, for the services of each of its personnel performing services under this agreement during calendar year 1991. -3- ~ Y • c) the fee to be paid by FIRST PARTY to SECOND PARTY for calendar year 1992, shall be re-negotiated in like manner during the month of July, 1991. IX. This agreement shall not be subject to cancellation by either party for calendar year 1990. SUMMARY & RECOMMENDATION Advertised, sealed bids for project #CLP-88-6106 for the replacement of the 8" water line crossing under Little Cedar Bayou with a crossing suspended from the Fairmont Parkway bridge were opened and read on February 20, 1990. Bid requests were mailed to seven (7) area construction firms with two (2), McKey Construction Company and Reliance Construction Company, returning bids. Bidders were requested to submit bids on three (3) separate items: Item 1. 8" schedule 40 welded steel pipe complete with hangars installed on bridge; Item 2. 8" ductile iron water line w/MJ fittings complete and in place; Item 3. Trench Safety System as required by OSHA. Low bid on items 1 and 2 was submitted by McKey Construction Co. in the amount of: Item 1 - $8,811.00 and Item 2 - $7,323.60. item 3, Trench Safety System, is applicable only to the successful bidder. The total cost of the contract would be Sixteen Thousand Eight Hundred Fourteen Dollars and Sixty Cents ($16,814.60). Reliance Construction Co. total bid was for Thirty-Eight Thousand Nine Hundred Sixty-Eight Dollars and Sixty-Eight Cents ($38,968.68). This replacement is necessary due to leaks in the current water line crossing under Little Cedar Bayou. From estimates for replacement of the line under the bayou, the decision was made to suspend the line from the bridge. This will allow any future repairs to be made without excavation of the bayou. Estimated cost of replacement of the line under the bayou was $25-30,000.00. Staff recommends award of bid to McKey Construction Company, low bidder meeting specifications, to install the 8" bridge crossing and associated underground piping in the amount of $16,814.60. Funds in the amount of $20,000.00 were budgeted in the 1989/90 Water/Wastewater Operating Budget for water line maintenance. Bid Tabulation SUMMARY & RECOMMENDATION Summary: On February 16, 1990, the City received bids for the repair to the Wave Pool at Little Cedar Bayou Park a The apparent low bidder was T & C Construction, Inc. in the amount of $48,489.00. The bid included an alternate for waterproofing the pump building which brings the total amount of the bid to $49,589.00. The work to be performed includes the completion of the punch list and the repair of warranty work. Our consultant, Stiver Engineering, recommends the elimination of Item #13, a dewatering system, at a cost reduction of $11,400.00 and accepting the alternate bid Item #19, for the waterproofing of the pump building at an increase of $1,100.00. In accepting-the alternate, Item #15 would be deleted. The bid would then be reduced to $38,189.00. Staff concurs with our consultants recommendation and would add 10% for construction contingencies. This amount is to be used for repair of minor unknown problems and for increased costs if investigation of the recirculation piping and subsequent foundation repairs exceed the amount estimated in the base bid. Some items in the proposal are grant eligible and there is a potiential for reimbursement in the amount of $14,380.11 from our Texas Parks and Wildlife grant.
