MINUTES OF THE PUBLIC HEARING AND REGULAR MEETING
LA PORTE CITY COUNCIL
SEPTEMBER 24, 1990
1. The meeting was called to order by Mayor Malone at 6:00 P.M.

2. The invocation was given by Councilperson Porter.
3. Council considered approving the minutes of the public hearing
and regular meeting of Council held September 10, 1990.
Motion was made bv Councilperson Skelton to approve the
September 10 minutes as presented. Second by Councilperson
Clarke. The motion carried, 7 ayes and 0 nays (Councilperson
Gay had not yet arrived).

4. The Mayor proclaimed Retired Senior Volunteer Program
Recogni tion Day. J. R. Ensminger and Ms. Marie Coffman
accepted the proclamation on behalf of the volunteers.
At this time, the Mayor deviated from the agenda and announced
that, due to the large crowd and where their interest was, items
6, 12 and 12A would be addressed next.
6. The following citizens addressed Council: Col. James Carlin,
reporting on "Operation Desert Shield - Texas Style", which
will take place the week of Oct. 1-6; Ms. Frances Carr,

reporting on more details of "Operation Desert Shield"; Ms.
Catherine Mahlstedt, addressing "Operation Desert Shield";
Jo Davis, representing citizens for a Quality Environment,
spoke regarding the "message" sent by the Texas Water
Commission in approving the permit application of HCS. She
thanked Council for their efforts in opposing the permit
application of HCS and urged them to vote unanimously for the
agenda item authorizing continued opposition.
Mrs. Barbara sitzman addressed Council to thank them for
allowing a stop sign to be placed on Myrtle Creek. She also
urged support of continued opposition to the HCS permit. Also
speaking in support of continued opposition to the HCS permit
were Elisa Yates, Douglas Graham, J. A. Hoopen, Paul FeIgner,
Charlie Young, and Jerry Patterson.
12. Council considered a resolution authorizing appeal of Texas
Water Commission decision on pending application of Houston
Chemical Services, Inc., for hazardous waste facility permit;
and authorizing City Manager to execute agreement with law
firm to represent city of La Porte.
The City Attorney read: RESOLUTION 90-8 - A RESOLUTION
AUTHORIZING APPEAL OF THE TEXAS WATER COMMISSION DECISION ON
THE PENDING APPLICATION OF HOUSTON CHEMICAL SERVICES, INC.,
FOR A HAZARDOUS WASTE FACILITY PERMIT; AUTHORIZING THE CITY
MANAGER TO EXECUTE AN AGREEMENT WITH THE LAW FIRM OF WINSTEAD,
SECHREST & MINICK TO REPRESENT THE CITY OF LA PORTE IN SUCH
MATTERS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made bY Councilperson Cooper to approve Resolution
90-8 as read by the city Attorney. Second by Councilperson
Matuszak. The motion carried, 7 ayes, 0 nays, 1 abstain.
Ayes: Councilpersons Sutherland, Cooper, Matuszak, Porter,
Skelton, Clarke and Mayor Malone

Abstain: Councilperson Gay
12A. The Mayor read the Emergency Addendum that had been added to
the agenda for at least four hours before the meeting was
convened or call to order, which was a resolution concerning
the Texas Water Commission action on Houston Chemical
Services, Inc., hazardous waste incinerator permit
application.
The City Attorney read Ordinance 90-9 in its entirety.

90-9 as read by the city Attorney. Second by Councilperson
Sutherland. The motion carried, 8 ayes and 0 nays.

The Mayor announced that it had been requested to go into executive
session at this time to address item 16 A, under V.A.T.S. - Article
6252-17, section 2 (E) (Legal) - to meet with attorney(s) to
discuss Houston Chemical Services, Inc. jSouthern Ionics, Inc.
Council retired into executive session at 6:55 P.M. and returned
to the Council table at 7:57 P.M. The Mayor announced that no
action had been taken during the executive session.
5. The Mayor called to order the Public Hearing - Review of
Proposed Changes to City of La Porte Zoning Ordinance as
recommended by the City's Planning and Zoning Commission.
Director of Community Development Joel Albrecht reviewed the
proposed changes for Council. Council asked questions for
clarification during the review. Most questions and comments
addressed the bed and breakfast portion of the proposed
changes and the agricultural production section.
Motion was made bY Councilperson Skelton that. in order to qet
the issue off dead center. that it be sent back to Planning
& Zoninq to clarify it for proiects for the school children
and also to look at the bed and breakfast for Zone 3 only.
Second by Councilperson Clarke. Since this was done during
the public hearing portion, a formal vote could not be taken,
but Council indicated that four were in favor of sending it
back to Planning and Zoning, two were against, and two
abstained.
After conclusion of the review, former chairperson Janet
Graves addressed Council regarding the bed and breakfast
portion of the proposed changes. She suggested that it would
be much better to have bed and breakfast regulations in place
before there was ever a need for them.
The Mayor asked for public input. Charlie Young asked a
question regarding having to cut down a tree in order to
build. This was addressed in the proposed changes.
Procedural questions were asked by Mrs. Barbara Sitzman, and
answered. There being no further input, the Mayor then
declared the Public Hearing closed.

7. Council considered a resolution adopting the 1990 appraisal
roll of Harris County Appraisal District.
The City Attorney read: RESOLUTION 90-7 - A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, ADOPTING THE 1990
APPRAISAL ROLL OF THE HARRIS COUNTY APPRAISAL DISTRICT.
Motion was made by Councilperson Clarke to approve Resolution
90-7 as read by the city Attorney. Second by Councilperson
Porter. The motion carried, 6 ayes and 0 nays (Councilperson
Gay had left at 8:SS to go to work; Councilperson Skelton was
away from the table).

8. Council considered an ordinance levying taxes upon taxable
property located within and subject to taxation in the City
of La Porte.
The City Attorney read: ORDINANCE 1721 - AN ORDINANCE LEVYING
TAXES UPON TAXABLE PROPERTY LOCATED WITHIN AND SUBJECT TO
TAXATION IN THE CITY OF LA PORTE, TEXAS; MAKING APPROPRIATIONS
FOR SUPPORT, MAINTENANCE, AND IMPROVEMENT OF THE CITY
GOVERNMENT OF SAID CITY OF LA PORTE; FINDING THAT ALL REQUIRED
NOTICES HAVE BEEN PUBLISHED AND ALL REQUIRED HEARINGS HELD;
CONTAINING A REPEALING CLAUSE; CONTAINING A SEVERABILITY
CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made bY councilperson Sutherland to adopt Ordinance
1721 as read by the City Attorney. Second by Councilperson
Porter. The motion carried, 7 ayes and 0 nays.

SUM OF NOT MORE THAN ONE THOUSAND DOLLARS $1,000.00) FOR EACH
VIOLATION; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE HEREOF.
Motion was made bY Councilperson Porter to adopt Ordinance
1501-L but restrict bed and breakfast to R-3 only. Second by
Councilperson Skelton. The motion carried,S ayes and 2 nays.

10. Council deferred this item to executive session.
11. Council considered awarding a bid for seal coat, crack sealer
and striping on City Hall and Fairmont Park recreational area
parking lots.
The City Attorney read: ORDINANCE 1726 - AN ORDINANCE
APPROVING AND AUTHORIZING A CONTRACT BY AND BETWEEN THE CITY
OF LA PORTE AND EDWARDS PARKING LOT & MAINTENANCE, FOR
APPLICATION OF SEAL COAT, CRACK SEALER, AND STRIPING, TO
PARKING LOTS AT CITY HALL AND FAIRMONT PARK RECREATION AREA,
FOR ESTIMATED CONTRACT AMOUNT OF $13,262.40; MAKING VARIOUS
FINDS AND PROVISIONS RELATING TO THE SUBJECT; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Matuszak to adopt Ordinance
1726 as read by the City Attorney. Second by Councilperson
Cooper. The motion carried, 7 ayes and 0 nays.

12. Council had considered item 12 earlier in the meeting.
13. Consent Agenda was considered as follows: (A) Consider
awarding a bid for aggregate for surface treatment; (B)
Consider awarding a bid for sign materials; (C) Consider
awarding a bid for reinforced concrete pipe; and (D) Consider
awarding a bid for a used vehicle.

Motion was made bv Councilperson Skelton to aDProve the
consent agenda as presented. Second by Councilperson
Sutherland. The motion carried, 7 ayes and 0 nays.

14. Administrative Reports: city Manager Bob Herrera reemphasized
that the meeting with the TWC scheduled for September 26 has
been moved to October 3. If the October 3 date changes, he
will advise Council. Also, he stressed the need for a quorum
of Council to attend the called meeting on September 27 to
sell bonds. He announced that the bond rating from Standard
& Poors is A+ for general obligation bonds and revenue bonds
went from BBB to A-. This is the first increase in rating for
La Porte from Standard & Poors since 1980.
Councilperson Matuszak at this time moved that item 10.
scheduled to be addressed in executive session. be postponed
until another meetinq. due to the lateness of the hour.
Second by councilperson Skelton. The motion carried, 7 ayes
and 0 nays.

Ayes:
Director of Public Works Steve Gillett reported on the status
of the Southeast Purification Plant. The plant has started
up and has operated successfully for one week. After testing
by LPAWA, evaluation will be made as to whether additional
disinfecting is necessary. The control system start-up is
scheduled for October 29. Final completion should be by mid-
November.
15. Council Action: Councilpersons Sutherland, Cooper, Matuszak,
Porter, Skelton, Clarke. and Mayor Malone brought items to
Council's attention.
16. Executive Session had already been addressed.

NOTICE OF PUBLIC HEARING
In accordance with the prov1s1ons of Ordinance 1501, the City
of La Porte Zoning Ordinance, notice is hereby given that the La
Porte City Council will conduct a public hearing at 6:00 P.M. on
the 24th day of September, 1990, in the Council Chambers of the
ci ty Hall, 604 West Fairmont Parkway, La Porte, Texas. The purpose
of the public hearing is to conduct the annual review of the City
of La Porte Zoning Ordinance. Items to be reviewed include:
An updating of references to State law;
Inclusion of new interpretation and enforcement language;
A new definition for Bed & Breakfast Inns;
New listings in Residential Use Table A regarding Bed &
Breakfast Inns and Manufactured Housing;
New residential special Use Performance Standard regarding Bed
& Breakfast Inns;
Amendment to Commercial Use Table A regarding SIC listing
#7699, outdoor sales and SIC listing 2752;
Amendment to Commercial special Use Performance Standards
regarding compatibility with surrounding area, outdoor sales
and service, and landscape buffers;
Amendment to section 10-300 regarding setbacks for accessory
buildings of over 1000 square feet and animal specialties;
Amendment to section 10-605 regarding design standards for
parking spaces, maneuvering aisles and landscape buffers;
Amendment to Section 10-603 regarding a clarification of the
method for calculating required parking;
Amendment to section 10-609 regarding parking for Bed &
Breakfast Inns;
Amendment to Section 11-304 regarding issuance of zoning
permits for non-conforming uses;
Amendment to section 10-900 regarding tree preservation;
Amendment to section 11-507 regarding clarification of the
method determining the validity of protests to recommendations
of the Planning and Zoning Commission;
Amendment to section 11-601 regarding appointing alternate
members to the Zoning Board of Adjustments and other Zoning
Ordinance related items which may be brought to the Council's
attention during the course of the public hearing.
A regular meeting will be held following the public hearing
for the purpose of acting upon the public hearing item and conduct
other matters pertaining to the city Council.

Public Hearing will be required to sign in before the meeting is
convened.

SUMMARY AND RECOMMENDATION
On September 6, 1990, the City of La Porte received the Certified Appraisal
Roll from the Harris County Appraisal District.
Section 26.04 of the State Property Tax Code requires the submission of the
Appraisal Roll to the Governing Body.
The 1990 Certified Tax Roll for the City of La Porte shows a total appraised
value of $1,045,544,660 and a taxable value of $968,393,330.
ACTION REQUIRED BY COUNCIL:
Approve Resolution 90-07 for acceptance of the appraisal roll.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE,TEXAS, ADOPTING THE 1990
APPRAISAL ROLL OF THE HARRIS COUNTY APPRAISAL DISTRICT.
WHEREAS, the City/s Assessor and Collector of Taxes submitted to the City Council
for approval the 1990 tax appraisal roll; and
WHEREAS, the City Council is of the opinion that the 1990 appraisal roll with the
amounts shown therein should be adopted;
WHEREAS, The City/s Assessor and Collector of Taxes has reported to the City
Council that there was situated in the City of La Porte, as of January 1, 1990,
property with a total appraised value of $1,045,544,660 and a total taxable value of
$968,393,330;
WHEREAS, new personal property added to the appraisal roll had a total taxable
value of $5,753,620 as of January 1, 1990;
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF LA PORTE, THAT:

declares that a sufficient written notice of the date, hour, place and subject of

Annotated; and that this meeting has been open to the public as required by law at
all times during which this resolution and the subject matter thereof has been
discussed, considered and formally acted upon. The City Council further ratifies,
approves and confirms such written notice and the contents and posting thereof.

SUMMARY AND RECOMMENDATION
On September 10, 1990, the City Council approved the fiscal year 1990-91
Budget. The budget was built around a tax rate of .71 cents per hundred
dollar valuation.
A breakdown of the tax rate is as follows:
General Fund
.5048 per hundred dollar valuation
Debt Service
.2052 per hundred dollar valuation
The effective tax rate for the new year is .7318 cents per hundred dollar
valuation. The proposed rate for the new year of .71 cents per hundred dollar
valuation represents a decrease from the effective rate of 3.1%.

Approve Ordinance 1721 establishing the tax rate for Fiscal Year 1990-91 at

AN ORDINANCE LEVYING TAXES UPON TAXABLE PROPERTY LOCATED WITHIN AND SUBJECT TO
TAXATION IN THE CITY OF LA PORTE, TEXAS; MAKING APPROPRIATIONS FOR SUPPORT,
MAINTENANCE, AND IMPROVEMENT OF THE CITY GOVERNMENT OF SAID CITY OF LA PORTE;
FINDING THAT ALL REQUIRED NOTICES HAVE BEEN PUBLISHED AND ALL REQUIRED HEARINGS
HELD; CONTAINING A REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE
Section 1. That there is hereby levied for the current fiscal year
beginning October 1, 1990, and ending September 30, 1991, on all real
property situated and all personal property owned within the taxable
limits of the said City of La Porte, on the first day of January, 1990,
except so much as may be exempt under the constitution and laws of the
United States, this State, and the City of La Porte, the following taxes:
(1) An Ad Valorem Tax of and at the rate of five zero point four eight
cents (.5048) on the one hundred dollars ($100.00) cash value
thereof, estimated in lawful currency of the United States for the
current expenses for the support, maintenance, and improvement of
the City Government of said City of La Porte; and
(2) An Ad Valorem Tax of and at the rate of two zero point five two
cents ($.2052) on the one hundred dollars ($100.00) cash value
thereof, estimated in lawful currency of the United States, .to pay
current interest on and provide one year's sinking fund and to pay
all of the Principal and interest accruing on all outstanding
general obligation bonds and certificates of obligation lawfully
issued by the City of La Porte.
That this provides the sum of total Ad Valorem tax at the rate of
seventy-one cents ($.71) on the one hundred dollars ($100.00) cash value
thereof, estimated in lawful currency of the United States.
Section 2. All property upon which a rate of taxation is hereinabove
levied shall be assessed on a ratio of one hundred percent (100%) of the
estimated market value thereof.

Section 3. That the sums hereinafter accruing and collected from the
hereinabove taxes so levied be and the same are hereby appropriated for
the support, maintenance, and improvement of the City Government of the
City of La Porte.
Section 4. The City Council officially finds, determines, recites and
declares that all notices required by law have been published, and that a
public hearing as required by law was duly called and held, and that all
matters prerequisite to the establishment and levy of an ad valorem tax
have been accomplished, all as required by the laws of the State of Texas,
and the Home Rule Charter of the City of La Porte.
Section 5. If any section, sentence, phrase, clause, or any part of
any section, sentence, phrase, or clause, of this Ordinance shall, for any
reason, be held invalid, such invalidity shall not affect the remaining
portions of this Ordinance, and it is hereby declared to be the intention
of this City Council to have passed each section, sentence, phrase, or
clause, or part thereof, irrespective of the fact that any other section,
sentence, phrase, or clause, or part thereof, may be declared invalid.
Section 6. All ordinances or parts of ordinances in conflict herewith
are hereby repealed to the extent of such conflict only.
Section 7. The City Council officially finds, determines, recites and
declares that a sufficient written notice of the date, hour, place, and
subject of this meeting of the City Council was posted at a place conven-
ient to the public at the City Hall of the City for the time required by
law preceding this meeting, as required by the Open Meetings Law, Article
6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has
been open to the public as required.

SUMMARY & RECOMMENDATION
Summary:
The Zoning Ordinance Review items, which will be considered in
this Public Hearing were originally presented and discussed
during City Council's July 16, 1990, workshop meeting. The
purpose of this meeting is to present the same items and
recommendations in a Public Hearing Format for the purpose of
securing citizen input. At the close of Public Hearing, Council
will be asked to vote on approval or denial of these
recommendations. If approved, the Planning and Zoning
Commission's recommendations will be adopted as amendments to the
Zoning Ordinance.
Options: I. Approve all or part of the recommendations as
presented.
II. Deny all or part of the recommendations as
presented.
III. Table action on all or part of the
recommendations for further consideration at
a future date.
IV. Return all or part of the recommendations to
Planning and Zoning Commission for further
consideration.
Recommendation:
The Planning and Zoning Commission has recommended adoption of
all items under consideration at this Public Hearing.
Action Required by Council:
I. Hold Public Hearing.
II. At close of Public Hearing, call for vote to approve, deny,
table, or return to Planning and Zoning recommendations

before the Planning and zoning Commission of the City of La Porte,
Texas, pursuant to due notice, to consider the question of the
possible amendment of the Zoning Ordinance as herein described.

incorporated by reference herein and made a part hereof for all
purposes, the publisher's affidavit of publication of notice of
said hearing.
Section 2. Subsequent to such public hearing, the City of La
Porte Planning and Zoning Commission met in regular session on
December 7, 1989 at 7:00 p.m., to consider the Ordinance amendments
which were the subject of such public hearing. The City Council of
the City of La Porte is in receipt of the written recommendations
of the City of La Porte Planning and Zoning Commission, by letter
dated July 3, 1990, a true copy of which letter is attached hereto
as Exhibit "B", and incorporated by reference herein, and made part
hereof for all purposes.
Section 3.
The City Council of the City of La Porte hereby
finds, determines and declares that on the 24th day of September,
1990,a public hearing was held before the City Council of the City
of La Porte, Texas, pursuant to due notice, to consider the
recommendation of the City of La Porte Planning and Zoning
Commission. There is attached to this Ordinance as Exhibit "C",
and incorporated by reference herein and made a part hereof for all

Section 4. The City council of the City of La Porte hereby
finds, determines and declares that all prerequisites of law have

Ordinance of the City of La Porte, are desirable and in furtherance
of the goals and objectives stated in the City of La Porte's
comprehensive plan.
Section 5. Article II, Section 2-200 of the Zoning Ordinance
of the City of La Porte is hereby amended by adding and/or amending
the sections contained on page 3 of Exhibit "0", the "Planning and
Zoning Recommendations, 1989 Annual Review, Zoning Ordinance 1501
Items Considered", which is attached hereto and is fully
incorporated by reference herein, which additions and amendments
are highlighted by yellow translucent marks.
Section 6. Article III, Section 3-100 of the Zoning
Ordinance of the City of La Porte is hereby amended by adding
and/or amending the sections contained on page 6 of Exhibit "0",
which additions and amendments are highlighted by yellow
translucent marks.
Section 7. Article V, Sections 5-600, 5-601 and 5-800 of the
Zoning Ordinance of the City of La Porte is hereby amended by
adding and/or amending the sections contained on pages 27, 29, and

Section 12. Any person, as defined in Section 1.02(27) Texas
Penal Code, who shall violate any provision of this Ordinance,
shall be deemed guilty of a misdemeanor and upon conviction shall
be punished by a fine not to exceed One Thousand Dollars
($1,000.00). Each day a violation of this ordinance shall continue
shall constitute a separate violation.
Section 13. If any section, sentence, phrase, clause, or any
part of any section, sentence, phrase, or clause, of this Ordinance
shall, for any reason, be held invalid, such invalidity shall not
affect the remaining portions of this Ordinance, it is hereby
declared to be the intention of the City of Council to have passed
each section, sentence, phrase, or clause, or part thereof,
irrespective of the fact that any other section, sentence, phrase,

M~ ORDINANCE REPEALING THE ZONING ORDINANCE OF THE CITY OF LA PORTE,
TEXAS, ADOPTED FEBRUARY 6, 1968, AND ADOPTING A NEW ZONING ORDINANCE TO
REGULATE 'THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND; THE
HEIGHT, NU~BER OF STORIES, AND SIZE OF BUILDINGS AND OTHER STRUCTURES;
THE SIZE OF YARDS AND OTHER OPEN SPACES; THE DENSITY OF POPULATION; AND
FOR SAID PURPOSES TO DIVIDE THE l1UNICIPALITY INTO DISTRICTS OF SUCH
NUMBER AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE
REGULATIONS; PROVIDING THAT ANY PERSON OR CORPORATION VIOLATING ANY OF
THE PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A
MISDEMEANOR, AND UPON CONVICTION SHALL BE LIABLE TO A FINE NOT TO EXCEED
ONE THOUSAND ($l,OOO,OO) DOLLARS, WITH EACH DAY OF VIOLATION
CONSTITUTING A SEPARATE OFFENSE; AND PROVIDING AN EFFECTIVE DATE HEREOF,
i'ffiEREAS, the City Council of the City of La Porte deems i t.necessary in
order to lessen congestion on streets; to secure safety from fire,
panic, and other dangers; to promote health and the general welfare; to
provide adequate light and air; to prevent overcrowding of land; to
avoid undue concentration of population; to facilitate the adequate
provisions of transportation, water, sewage, schools, parks and other
public requirements; to conserve the value of property and encourage
the most appropriate use of land throughout the City, all in accordance
with a comprehensive plan.
WHEREAS, V.T.C.A., Local Government Code 211.001, 211.003, empowers the
City to enact a land use ordinance and to provide for its
administration, enforcement, and amendments; and
WHEREAS, the City Council, deems it necessary, for
promoting the health, safety, morals, and general
community to enact such an ordinance; and

WHEREAS, the Planning and Zoning commission has in all respects given
reasonable consideration to the character of the land use districts and
their peculiar suitability for particular uses, and with a view to
conserving the value of buildings and encouraging the most appropriate
use of land throughout the city; and
VlTfIEREAS, the Planning and Zoning Commission has made a preliminary
report, and after due notice, has held public hearings thereon; and
\'ffiEREAS, the Planning and Zoning commission had submitted its final
report to the city Council; and the said City Council has given due
notice of a public hearing relating to the land use districts,
regulations, and restrictions, and has held such public hearing; and
\iliEREAS, all requirements of V.T.C.A., Local Government Code 211.007,
with regard to the preparation of reports, public hearings, and notice,
have been met by. the Planning and Zoning COInl'nission and the Ci-cy
Council.
NOW THEREFORE, be it ordained by the city Council of the City of
La Porte, Texas:
Section 2 - 200 Changes in District Boundaries
If, in accordance with the provisions of this ordinance and Article
10ll(d) and 10ll(e), V,A,C,S" changes are made in the district
boundaries or other matter portrayed on the Official Zoning Maps, such
changes shall be entered on the Official Zoning Maps by the Community
Development Department of the City of La Porte, promptly after the
amendment has been approved by the City Council,

Section 2 - 300 Zonina MaD Chanqe Procedures
Approved zoning changes shall be entered on the Official Zoning Maps by
the Director of Community Development of the City of La Porte, or his
designated representative and each change shall be identified on the
Maps with the date and number of the ordinance making the change. No
amendment to this Ordinance which involves matter portrayed on the
Official Zoning Maps shall become effective until after such ordinance
has been finally approved by the City Council,
Section 2 - 400 Unauthorized MaD Chancres
No change of any nature shall be made on the Official Zoning Maps or
matter shown thereon except in conformity with the procedures set forth
in this Ordinance. Any unauthorized change of whatever kind by any
person or persons shall be considered a violation of this ordinance and
punishable hereunder,
Section 2 - 500 Location and Authoritv of Zoninq MaDs
Regardless of the existence of purported copies of the Official Zoning
Maps which may from tine to time be made publ ic or publ ished, the
Official Zoning Maps shall be the final authority as to the current
zoning status of land and water areas, buildings and other structures
in the City. The Official Zoning Maps shall be available to the public
at all hours when the City Hall is open to the public,

ARTICLE THREE: DEFINITIONS
Section 3 - 100 Definitions
For the purpose of this Ordinance, certain terms and words are hereby
defined; terms not defined herein shall be construed in accordance
with adopted building codes or their customary usage and meaning.
Abutting: Having property or district lines in common, or two (2)
objects in immediate contact.
Access: Means of approaching or entering a property, includes a right
of passage to and from an adjacent street.
Accessory Use or Buildinq: An "accessory use or building" is one
customarily a part thereof, which is clearly incidental and secondary
to permitted use and which does not change the character thereof,
including but not limited to garages, carports, bathhouses,
greenhouses, tool sheds, or swimming pools.
Accessory Structure: A detached, subordinate structure, the use of
which is clearly incidental and related to that of the principal
structure or use of the land, and which is located in the same lots as
that of the principal structure or use.
Alley: A public way which, when at least twenty feet (20') in width,
may be used for vehicular service access to the back or side of
properties otherwise abutting on a street or highway.
Aoartment: See dwelling - multi-family.
Bed & Breakfast Inn: A building, the primary use of which is a single
family residence, in which sleeping rooms are available for overnight
rental, subject to the following restrictions.
1. Bed & Breakfast Inns shall be operated by resident
homeowners.
2. No more than three (3) rental rooms shall be provided.
3. Rooms shall be let by reservation only.
4. Bed & Breakfast_ Inns shall conform to the requirements of
Section 5-800.
5. Parking shall be provided in accordance with the
requirements of Section 10-609.
Board of Adiustment: The Zoning Board of Adjustment of the City of La
Porte.

Open and outdoor storage as an accessory or principal use
provided that:

b. Up to fifty percent (50%) of the off-street parking facilities
required for any use specified under (d) below as primary
daytime uses may be supplied by the parking facilities
provided by the following nighttime or Sunday uses;
auditoriums incidental to all public or parochial schools,
churches, bowling alleys, dance halls, theaters, bars,
restaurants or similar uses as determined by the Planning
commission,
c, Up to eighty percent (80%) of the parking facilities required
by this section for a church or for an auditorium incidental
to a public or parochial school may be supplied by the
off-street parking facilities provided by uses specified under
(d) below as primary daytime uses as determined by the City
Planning Commission.
d. For the purpose of this section, the following uses are
considered as primary daytime uses: banks, business offices,
retail stores, personal service shops, household equipment or
furniture shops, clothing, shoe repair or service shops,
manufacturing, wholesale and similar uses as determined by the
Planning Commission.
e. Conditions required for joint use:
l) The building or use for which application is being made
to utilize the off-street parking facilities provided by
another building or use shall be located within three
hundred feet (300') of such parking facilities.
2) The applicant shall show that there is no substantial
conflict in the principle operating hours of the two (2)
buildings or uses for which j oint use of off-street
parking facilities is proposed,
3) A properly drawn legal instrument, executed by the
parties concerned for joint use of off-street parking
facilities, duly authorized as to form and manner of
execution by the City Attorney, shall be filed and
recorded_in the Harris County Deed Records,

l, All permitted uses in industrial zones must meet the following
minimum performance standards. If requested by the Enforcement
Officer, allapplications for building permits must include a
certification from a registered engineer that verifies compliance
with these performance standards. Where applicable, all
permitted uses in industrial zones must meet and be in compliance
with the appropriate federal, state, or local regulations.
A. Liqhtinq and Glare. Any lighting used shall be arranged so
as to deflect light away from any adjoining residential zone
or from public s~reets. Direct or sky-reflected glare,
where from floodlights or from high temperature processes
such as combustion or welding shall not be directed onto any

Accessory buildings, uses and structures shall not exceed fifteen
feet (l5') in height, shall be three feet (3') or more from all
lot lines, shall be six feet (6') or more from any other building
or structure on the same lot, and shall not be located upon any
utility easement.
Private garage structures with vehicular access doors facing public
alleys, as defined in the Public Improvement Construction Policy
and Standards, shall be twenty feet (20') or more from the alley
right-of-way.
Detached garages located in rear yards of corner lots shall be set
back a minimum ten feet (lO') from the property line abutting the

In the event a public hearing shall be held by the City
Planning and Zoning Commission in regard to a change of the
La Porte Zoning Ordinance not involving particular property
but involving a change in the Ordinance generally, notice of
such hearing shall be given by publication once in a newspaper
of general circulation in the City of La Porte stating the
time and place of such hearing, which time shall not be
earlier than fifteen (l5) days from the day of such
publication.
4.
The City Planning and Zoning Commission shall forward its
written findings of fact and recommendations to City Council
within fifteen (l5) days of the close of the hearings.
5.
Public Hearinq before city Council
Upon receipt of the written recommendations from the Planning
and Zoning Commission, a public hearing shall be held by the
City Council before adopting any proposed amendment,
supplement, change, modification or repeal of the regulations,
restrictions, and boundaries herein established.
Notice of such hearing shall be given by publication once in
a newspaper of general circulation on the City of La Porte,
stating the time and place of such hearing, which time shall
not be earlier than fifteen (15) days from the day of such
publication.

7.
Protests
In case of a protest against any such amendment, supplement,
change, or repeal of the regulations, restrictions, and
boundaries herein established, a written protest filed with
the Enforcement Officer and signed by the owners of twenty
percent (20%) or more of either:
a. The area of lots or land covered by the proposed change;
or
b. The area of lots or land immediately adjoining the area
covered by the proposed change and extending two hundred
(200) feet from that area.
Such amendment, supplement, change, mod~fication, or repeal
shall not become effective except by the favorable vote of
three-fourths (3/4) of all the members of the City Council,
Streets and alleys shall be included when computing the ~rea
of land from which a protest may be filed,

acting chairman, may administer oaths and compel the attendance of
witnesses. All meetings of the Board of Adjustment shall be open
to the public. The Board of Adjustment shall keep minutes of its
proceedings, showing the vote of each member upon each question,
or if absent or failing to vote, indicating such fact, and shall
keep records of its examinations and other official actions, all
of which sha.1l be immediately filed in the office of the City
Secretary and shall be a public record.
II - 603 Powers and Duties
The Board of Adjustment shall have the following powers:

SUMMARY & RECOMMENDATION
On September 10, 1990 the City opened bids for the application of
a slurry seal on the city Hall and Fairmont Park recreational area
parking lots. The two parking lots have an estimated total of
llO,520 sq. ft. of surface area that needs a protective coating.
Invitations to bid were sent to six (6) firms. Five (5) of these
firms are from the Houston area, and the sixth is from Austin.
One bidder attended the pre-bid conference and explained to staff
that he would be bidding an alternate product called "seal coat"
in lieu of the slurry seal. The two products are similar in the
protection provided to the existing asphalt and both extend the
life of the asphalt an additional six (6) years.
One bid was received from Edwards Parking Lot Repair & Maintenance
in the amount of $O.l2 per sq. ft. The bid price includes crack
filling and the stripping of the two parking lots. The total
estimated cost for seal coat is estimated to be $l3,262.40. Funds
for project No. 90-2203 are available in Account No. 001-700-701-
829.
Action Required by Council:
Approval of Ordinance accepting bid of Edwards Parking Lot Repair
& Maintenance for the application of a seal coat, crack seller &
stripping to the City Hall and Fairmont Park recreational area
parking lots in the estimated amount of $l3,262.40.

SECHREST & MINICK TO REPRESENT THE CITY OF LA PORTE IN SUCH MATTERS~
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW~ AND PROVIDING AN
EFFECTIVE DATE HEREOF.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. That the City Council of the City of La Porte
hereby authorizes the filing and pursuit, on behalf of the City of
La Porte, of any and all motions for rehearing and other pleadings
at the Texas Water Commission regarding, complaining of and/or
seeking reconsideration by the Commission of any decision or order
approving in whole or in part the pending application of Houston
Chemical Services, Inc. for a hazardous waste facility permit~ and
further hereby authorizes the filing and pursuit, on behalf of the
City of La Porte, of any and all petitions and other pleadings in
state district court regarding, appealing, complaining of and/or
challenging any such decision or order of the Texas Water
Commission.
Section 2. The City Manager is hereby authorized and directed
to execute, on behalf of the City of La Porte, an addendum to the
February 26, 1990, Fee Agreement between the City of La Porte' and
the law firm of Winstead, McGuire, Sechrest & Minick, which addendum
shall provide for said law firm to represent the City of La Porte in
connection with the matters specified herein.
Section 3. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City of La porte, Texas for the time required by law preceding this
meeting, as required by the Open Meetings Law, Article 6252-17,
Texas Revised Civil Statutes Annotated~ and that this meeting has
been open to the public as required by law at all times during which
this resolution and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the contents
and posting thereof.

SUMMARY & RECOMMENDATION
Advertised, sealed bids '0397 for the annual supply of aggregate surface
treatment were opened and read on September 10, 1990. Bid requests were
mailed to five (5) area supplfers with only Parker LaFarge returning bids.
Parker LaFarge (formerly Parker Brothers) submitted an alternate bid for
surface treatment consisting of precoated crushed limestone.
Staff recommends award of bid to Parker LaFarge for the annual supply of
aggregate surface treatment. Using yearly quantities, the contract would
be worth two hundred seventy-eight thousand, nine hundred and sixty dollars
($278,960.00).
Action Required by Council:
Award bid for the annual supply of aggregate for surface treatment to
Parker LaFarge.

submitted by Mid-Ohio Markings. Low bid meeting specifications for section
II-b and for the items no bid by Mid-Ohio was submitted by Vulcan Signs.
Staff recommends award of bid for sections I and II-a to Mid-Ohio Markings,

Advertised, sealed bids 10399 for sign materials were opened on
September 10, 1990. Bid requests were mailed to thirteen
suppliers with five returning bids.
Although Mid-Ohio Markings did not bid all items (two items in
Section I and four items in Section II -a), the price variances
would indicate that the City would benefit from awarding all of
Section I and Section II - a, to Mid-Ohio. Low bid on Section II
- b is Vulcan Signs. The items not bid by Mid-Ohio can be bought
from Vulcan.
Using yearly estimates, total cost of sign materials would be
$33,487.47.
Please submit your recommendation with an agenda request form by

SUMMARY & RECOMMENDATION
Advertised, sealed bids 10398 for reinforced concrete pipe were opened and
read on September 10, 1990. Bid requests were mailed to four (4) suppliers
with three (3) returning bids.
Low bid meeting specifications on item 1 - Reinforced Concrete Pipe was
submitted by Bay Concrete Pipe Products. Low bid meeting specifications
for item 4 - Inlet Saddles, item 5 - Catch Basins, and item 6 - grates was
submitted by Jerry McKinley Concrete Pipe. Low bid meeting specifications
on item 3 - Mastic was submitted by Gifford Hill.
staff recommends award of bid for item 1 - RCP to Bay Concrete Pipe
Products, low bidder meeting specifications. Staff further recommends
award of bids for items 4, 5, and 6 to Jerry McKinley Concrete Pipe, low
bidder meeting specifications. It is recommended that item 3 - Mastic be
awarded to Jerry McKinley Concrete Pipe, second low bidder meeting
specifications, for ease of ordering. Using estimated annual quantities,
the contract to Bay Concrete Pipe Products would be forty-one thousand,
four hundred, and ninety-five dollars ($4l,495.00) and the contract to
Jerry McKinley Concrete Pipe would be four thousand, two hundred, and five
dollars ($4,205.00).
Action Required by Council: Award bid for supply of RCP to Bay Concrete
Pipe Products; for inlet saddles, catch basins, mastic, and for grates to

ordering, it is recommended that Item 3 be awarded to Jerry
McKinley,
Using estimated yearly quantities, the cost of the contract
to Jerry McKinley would be $4,206 and to Bay Concrete $41,495,00.
Total cost would be $45,701,00,

ranging in price from $7,8000 to $14,500. Avis bid a single car
at $11,899.
The vehicles bid by Hertz, that are within the budgeted amount,
are smaller than the car specified in the bid. After making an on
site visit to both Hertz and Avis, a CID representative and Louis
Rigby concurred on the purchase of a 1990 Lumina from Avis for
$9,299. Maintenance records indicate that the car has had no
major malfunctions and is in good running order.
It is my recommendation is to purchase the 1990 Lumina from Avis
for $9,299.
