MINUTES OF THE REGULAR MEETING OF LA PORTE CITY COUNCIL
JANUARY 28, 1991
1. The meeting was called to order by Mayor Malone at 6:00 P.M.
Members of City Council Present: Mayor Norman Malone,
Councilpersons Guy Sutherland, Mike Cooper, Bob McLaughlin,
Alton Porter, Deotis Gay, B. Don Skelton, Jerry Clarke
Members of City Council Absent: Councilperson Ed Matuszak
Members of Citv Staff Present: City Manager Bob Herrera, City
Attorney Knox Askins, City Secretary Cherie Black, Assistant
City Manager John Joerns, Director of Public Works Steve
Gillett, Police Chief Bobby Powell, Director of Community
Development Joel Albrecht, City Engineer Bill Manning

2. The invocation was given by Councilperson Clarke.
3. Council considered approving the minutes of the called regular
meeting held January 10, 1991.
Motion was made by Councilperson Cooper to approve the minutes
of January 10 as presented. Second by Councilperson
Sutherland. The motion carried, 7 ayes and 0 nays
(Councilperson Gay was away from the table).

Porter, Skelton, Clarke and Mayor Malone
Nays: None
4. Council considered approving the minutes of the regular
meeting held January 14, 1991.
Motion was made by Councilperson Skelton to approve the
minutes of January 14 as presented. Second by Councilperson
Clarke. The motion carried, 7 ayes and 0 nays (Councilperson
Gay was away from the table).
Ayes: Councilpersons Sutherland, Cooper, McLaughlin,
Porter, Skelton, Clarke and Mayor Malone
Nays: None
5. The Mayor proclaimed the month of February as American History
Month, and proclaimed February 25 as "La Porte Night at
Houston Livestock Show and Rodeo." Ten members of the La
Porte/Harris County Go Texan Committee were in attendance to
accept the La Porte Night proclamation.

6. Mr. Mike Hammond, 4921 Meadowcrest, addressed Council to ask
that they consider an ordinance to prohibit dirt bikes and
ATVs to operate within 1000 feet of a residence. This is for
the safety of the children riding these vehicles and also for
the nuisance level of the noise generated by these vehicles.
7. Council considered an ordinance calling the regular annual
election of the City of La Porte.
The City Attorney read: ORDINANCE 1744 - AN ORDINANCE CALLING
THE REGULAR ANNUAL ELECTION OF THE CITY OF LA PORTE; CALLING
A RUN-OFF ELECTION, IF NECESSARY; DESIGNATING ELECTION
PRECINCTS AND POLLING PLACES; PROVIDING FOR THE USE OF VOTING
MACHINES; APPOINTING ELECTION OFFICIALS; PROVIDING FOR METHOD
AND DATES OF ABSENTEE VOTING; PROVIDING FOR AN ABSENTEE BALLOT
BOARD; PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID
ELECTION; PROVIDING FOR NOTICE; PROVIDING FOR FILING DEADLINE
AND FILING FEES FOR CANDIDATES; PROVIDING A SAVINGS CLAUSE;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Gay to adopt Ordinance 1744
as read by the City Attorney. Second by Councilperson
McLaughlin. The motion carried, 8 ayes and 0 nays.

8. Council considered an ordinance approving and authorizing a
letter of agreement between the City of La Porte and Hugh
Landrum & Associates.
The City Attorney read: ORDINANCE 1745 - AN ORDINANCE
APPROVING AND AUTHORIZING A LETTER OF AGREEMENT BY AND BETWEEN
THE CITY OF LA PORTE AND HUGH L. LANDRUM AND ASSOCIATES, INC.,
FOR INDUSTRIAL DISTRICT CONSULTANT SERVICES; MAKING VARIOUS
FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Skelton to adopt Ordinance
1745 as read by the City Attornev. Second by Councilperson
Cooper. The motion carried, 8 ayes and 0 nays.

9. Council considered an ordinance granting a wine and beer on
premise permit for Longhorn Lounge.
The City Attorney read: ORDINANCE 1000-AA - AN ORDINANCE
AMENDING ORDINANCE NO. 1000 OF THE CITY OF LA PORTE, TEXAS,
DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON THE
PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE;
PROVIDING FOR HOURS OF OPENING AND CLOSING; PROVIDING SALE OF
BEER FOR CONSUMPTION OFF PREMISES SHALL NOT BE AFFECTED;
DEFINING SOURCE OF AUTHORITY; PROVIDING A SAVINGS CLAUSE;
PROVIDING THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR THE AREA
HEREIN DESIGNATED; FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Cooper to adopt Ordinance
1000-AA as read by the City Attorney. Second by Councilperson
Clarke.
After discussion of whether or not the establishment met the
criteria set forth in Ordinance 1000 regarding the sale of
food in conjunction with on premise sale of wine and beer,
motion was made by Councilperson McLaughlin to table this
Ordinance for further clarification. Second by Councilperson
Skelton. The motion carried, 5 ayes and 3 nays.

and Mayor Malone
Nays: Councilpersons Cooper, Gay and Sutherland
The Mayor asked that this item be taken to executive session.
It was the City Attorney's opinion that there was no proper
subject to do so. The Mayor then stated that since there was
a workshop scheduled for February 4, to take it to workshop.
10. Council considered approving a proposal from Don Graesser to
provide design, construction, and inspection phase services
for repainting of Bayshore elevated water storage tank, and
inspection phase services for painting new Northwest elevated
water storage tank.
Motion was made by Councilperson Skelton to approve the
proposal from Don Graesser. Second by Councilperson Cooper.
The motion carried, 7 ayes and 1 nay.

11. Council considered authorizing an increase in contract price
with Insituform Gulf South in the amount of $8,150 for
rehabilitation of Roseberry trunk sewer.
Motion was made by Councilperson Skelton to authorize a
contract price increase with Insituform in the amount of
ca-150, bringing the total contract price to 580,120. Second
by Councilperson McLaughlin. The motion carried, 8 ayes and
0 nays.

Porter, Gay, Skelton, Clarke and Mayor Malone

12. Council considered rejecting a bid for design and construction
of Bay Forest Golf Course irrigation pump building.
Motion was made by Councilperson Clarke to reject the bid for
the irrigation pump buildinq and that the project be rebid.
Second by Councilperson Cooper. The motion carried, 8 ayes
and 0 nays.

Porter, Gay, Skelton, Clarke and Mayor Malone

13. Administrative Reports
A. An appreciation plaque from Operation Desert Shield
personnel has been presented to the City. It was passed
for Council to look at.
B. Public Works has received a "Good Housekeeping" award
from Gulf Area Utilities Association. They won a first
place and a second place award.
C. There will be a rally in support of Operation Desert
Storm on February 5 at the Fairmont Plaza shopping
center.
D. The first meeting of the Re-Districting committee will
be held from 7 to 9 P.M. on February 5.
14. Council Action - Councilpersons Clarke, Skelton, Gay, Porter,
McLaughlin, Cooper, Sutherland and Mayor Malone brought items
to Council's attention.

The Mayor inquired of the City Attorney if item 9 could be
taken to executive session for legal advice under Article
6252-17, Section 2(E). The City Attorney agreed that it
could, but only for advice of a legal nature.
15. Council adjourned into executive session at 7:12 P.M. to
discuss the following: (A) Section 2(R) - Conference to
receive a report from the City Manager regarding Green Oaks
Apartments; and (B) Section 2(E) - Legal to receive advice
from the City Attorney regarding a wine and beer on premise
permit. Council returned to the Council table at 7:45 P.M.
No action was taken on either item.
The Mayor announced a meeting on January 31 with the Deer Park
City Council.
16. There being no further business to come before the Council,
the meeting was adjourned at 7:55 P.M.

Section 1. An election shall be held within the corporate
limits of the City .of La Porte,- Texas, on the 4th. day of May, 1991,
such day being the first Saturday in May, 1991, between seven
o'clock (7:00) A.M. and seven o'clock (7:00) P.M., for the purpose
of electing the following City officials:
Mayor for a 3 year term
Councilperson--District 2, for a 3 year term
Councilperson--District 3, for a 3 year term
A run-off election, if necessary, shall be held on May 18,
1991, between the same hours.
Section 2. Said election shall be held at each of the
following voting places within said City, and the following named
persons are hereby appointed as officers of said election, to-wit:

Section 3. Voting at said election, including absentee voting,
shall be by the use of voting machines, and the ballots of said
election shall conform to the Texas Election Code, as amended.
Section 4. An Absentee Ballot Board is hereby created to
process Absentee Voting results for the election and the runoff
election, if necessary. Charlotte Boudreaux is appointed
Presiding Judge of the Absentee Ballot Board. At least two (2)
other members of the Absentee Ballot Board shall be appointed by the
Presiding Judge, in the same manner as the precinct election clerks.
Absentee voting by personal appearance shall begin on the 20th
day and shall continue through the 4th day preceding the day of
election. Except as authorized herein, the clerk shall not permit
anyone to vote absentee by personal appearance on any day which is
not a regular working day for the clerk's office, and under no
circumstances shall he permit anyone to vote absentee by personal
appearance at any time when his office is not open to the public.
Absentee voting by mail shall begin on the 20th day preceding
the date of the election and shall continue until ten o'clock
(10:00) A.M. on the second day preceding election day.
Absentee voting shall be conducted by a clerk for absentee
voting, namely, Paula Rizzuto , and the place at which
the absentee voting shall be conducted is designated as the La Porte
City Hall, 604 West Fairmont Parkway, La Porte, Texas, to which
address ballot applications and ballots voted by mail may be mailed.
Said clerk shall keep said office open for absentee voting during
his regular working hours and in any event for at least eight (8)

hours on each day which is not a Saturday, a Sunday, or an official
State holiday.
Section 5. The Council Conference Room of the La Porte City
Hall is hereby designated as the Central Counting Station to receive
all ballots cast at said election, and Cherie Black is hereby
appointed the Presiding Judge for said Central Counting Station.
Said Judge shall appoint any clerks necessary to assist in receiving
ballots and other records and in performing the other duties of said
Judge in this regard. The City Manager is hereby authorized and
directed to obtain, or cause to be obtained, the necessary
electronic tabulating equipment, to arrange for the testing thereof
as provided by law and to employ a duly qualified manager and a duly
qualified tabulation supervisor to perform the duties respectively
imposed on them by law with respect to the processing and tabulation
of ballots at the Central Counting Station.
Section 6. That all election materials including notice of the
election, ballots, instruction cards, affidavits and other forms
which voters may be required to sign and all absentee voting
materials shall be printed in both English and Spanish, or Spanish
translations thereof shall be made available in the circumstances
permitted and in the manner required by law.
Section 7. The City Secretary of the City of La Porte shall
forthwith issue Notice of said election by causing a substantial
copy of this Ordinance to be published one time in the BAYSHORE SUN,
which is hereby found and declared to be a newspaper of general
circulation in said City, not less than ten (10) days nor more than
thirty (30) days prior to the date of the said election.
Section 8. Upon a candidate tendering his application on the
form prescribed, the City Secretary shall furnish to such candidate
all information relative to the qualifications for the office being
sought; the method of placing the candidate's name on the ballot;
the amount of the required filing fee; and any other pertinent
information concerning said election.

Section 9. Each candidate for the office of Mayor or
Councilperson must be a resident elector of the City. Each
candidate for the office of District Councilperson must also be a
resident of the district for which he files.
Section 10. The deadline for a candidate to make application
to have his. name appear upon the ballot for such elect-ion, is hereby
designated and established as 5:00 o'clock P.M., Wednesday March 20,
1991. No application shall be accepted for filing prior to February
18, 1991. The filing fee for each candidate for the office of
Councilperson is hereby established as Fifty Dollars ($50.00). The
filing fee for each candidate fo the office of Mayor is hereby
established as One Hundred Dollasrs ($100.00). The filing fees
shall be used to defray the cost of the election, and said fees
shall be prorated and any surplus shall be refunded to said
candidates. As an alternative to paying a filing fee, a candidate
may obtain a place on the ballot by filing a petition as provided
for in City of La Porte Home Rule Charter, Article 2.04 c.3.
Section ll. Said election shall be held in accordance with the
provisions of the City Charter of the City of La Porte, and the
general election laws of the State of Texas governing general and
municipal elections, so far as same may be applicable thereto.
Section 12. Immediately after said election, the officers
holding the same shall make and deliver the returns of the results
thereof and the accompanying records for use in the official canvass
to the City Council of the City of La Porte, and the City Council
shall canvass said returns at the earliest practicable time, and
shall, immediately after canvassing the returns, declare the results
of the election. The Mayor shall immediately thereafter deliver to
the candidate for whom the majority of votes has been polled for
each respective office, a certificate of election. Such elected
officials shall assume their duties within ten (10) days thereafter,
Sundays, excluded, upon their taking the oath of office.
Section 13. Each and every provision, paragraph, sentence and
clause of this Ordinance has been separately considered and passed

by the City Council of the City of La Porte, Texas, and each said
provision would have been separately passed without any other
provision, and if any provision hereof shall be ineffective, invalid
or unconstitutional, for any cause, it shall not impair or affect
the remaining portion, or any part thereof, but the valid portion
shall be in force just as if it had been passed alone.
Section 14. This Ordinance shall be in effect immediately upon
its passage and approval.
Section 15. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Aall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally-acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.

Dear Mr. Herrera:
This letter of agreement between the City of La Porte and
Hugh L. Landrum and Associates, Inc. is intended to supersede
the Contract between the parties dated February 26, 1990 and
effective January 1, 1990 since that Contract no longer
applies to the duties intended under this letter of
agreement.
The City of La Porte under this letter of Agreement, will
retain the firm of Hugh L. Landrum and Associates, Inc. as a
consultant for non-appraisal functions relating to the
administration, negotiation, and re-negotiation of the City's
Industrial District Agreement. The City will specifically
request these services from time to time. Payment for these
services will be on an hourly basis in the amounts shown on
Exhibit "A" attached, with payment due no later than 30 days
after the date of invoice. It is understood by both parties
that because of professional ethics, consultant cannot review
or revise any work done by other Professional Engineers
without the express consent of that Engineer.
This agreement will be in effect for Calendar years 1991,
1992, and 1993, unless changed in writing by the mutual
consent of both parties hereto.

SUBJECT: Wine & Beer On Premise Permit - Longhorn Lounge
I have received a request from Mr. Dan Conover for the above
referenced permit. The establishment is located at 9406 Spencer
Highway, which is in the area annexed by the City of La Porte in
1983.
The building has been in existence for approximately 25 years, and
has operated as the same type establishment as it is presently.
Mr. Conover has leased the building, obtained his needed permits
from the Code Enforcement Division, and has remodeled the building
and brought it up to City codes. His concern is regarding the
section of Ordinance 1000 that requires food prepared on the
premises to be served in conjunction with beer and wine, and to the
65/35 percent ratio, which was passed in 1983 (Section 1(3) and
Section 1(1) of Ordinance 1000-P).
Since the building was being used as a lounge when it was annexed
into the City, and there are several-like establishments in that
area of Spencer Highway, I am asking that the ordinance attached
be passed to allow a wine and beer on premise permit for Longhorn
Lounge without the requirement that food prepared on the premises
be served. I feel that Mr. Conover would be willing to remove the
word "Lounge" from the name of the business if Council so desires,
and I believe he does plan to sell pre-prepared sandwiches, etc.
I am attaching a copy of Ordinance 1000 and also Ordinance 1000-P
which first addresses the serving of food prepared on the premises
in conjunction with sale of beer or wine. Also attached is a copy
of Ordinance 1000-L, issued to "Tooney's" and passed in 1980, which
is not a restaurant but states that the sale of beer at that
location shall be permitted only in connection with the sale of
food. Ordinance 1000-L does not define "food".

SUMMARY & RECOMMENDATION
The City of La Porte will paint two (2) elevated water storage towers
during the coming months. One, the new 750,000 gallon tank in the Lomax
area, is currently under construction. The other, a 200,000 gallon tank in
the Bayshore area, is an existing tank that has been identified as
requiring a new coating system. Due to the specialized nature of the work,
and concerns with current Texas Air Control Board regulations, the city has
requested Don Graesser, P.E., to submit a proposal to prepare plans and
specification for the Bayshore tower to sandblast and paint, and to provide
inspectional services to blast and paint the Bayshore and Lomax area water
towers.
Mr. Graesser will furnish the following services as outlined in the
attached proposal:
Bayshore tank - Design Phase Services
Prepare specifications, contract and bid documents, working plans,
assist with publication, bid tabulation and contract execution.
Included is shrouding the tower to protect surrounding development,
and blasting and coating the interior and exterior.
Bayshore tank - Construction Phase Services
Three (3) site inspections to ensure compliance with specifications,
interpretation of plans and specifications, process monthly pay
estimates, and preparation of necessary change orders.
Bayshore tank - Inspection Services
Conduct approximately eleven (11) random site visits to ensure
compliance with plans and specifications. With the Lomax area tower
also under construction, some inspections will be concurrently
conducted with the Bayshore tower.
Lomax tank - Inspectional Services
Conduct approximately eleven (11) random site visits to ensure
compliance with plans and specifications, including welding inspection
and blast and coatings inspections. Some inspections will
concurrently conducted with the Bayshore tower.
The proposed cost is outlined below:
Design and Construction Phase - Bayshore tower $ 5,500.00 (lump sum)
Inspection Phase - Repaint Bayshore tower 4,560.00 (estimate)
Inspection Phase - New Lomax tower 4,560.00 (estimate)
Total $14,620.00
Funds for design, inspection and construction are available ($80,000) in
the Utility CIP Fund for the painting of the Bayshore tower. Estimated
construction cost is $70,000. Funds for inspection of the Lomax tower are
available in the 1990 Revenue Bond Fund.
Action Required by Council: Approve proposal from Don Graesser to provide
design, construction and inspection phase services for the repainting of
the Bayshore elevated water storage tank, and inspection phase services for
the painting of the new Lomax elevated water storage tank.

SUMMARY & RECOMMENDATION
The City Council, at the January 14, 1991 meeting, approved a contract with
Insituform Gulf South to line 1,135 feet of 15 inch concrete pipe using the
Insituform method, for a total cost of $72,070. Upon receipt of the notice
to proceed, Gulf South dispatched operations personnel to examine the site
and verify information on the job. It was discovered that the lower 433 feet
of pipe was 18 inch pipe rather than 15 inch pipe.
Due to the size difference, several cost factors have changed. The original
proposal was to perform the insertion in one operation, using one size. With
two sizes, two setups and inversions are now necessary. This fact, together
with the obvious size increase and the need to increase the liner thickness
due to structural considerations, have increases the price from $57.00/ft to
$72.00/ft for the 18 inch segment. Additional costs are incurred due to
longer periods of by-pass pumping, for a total increase in price from $72, 070
to $80,220, an increase of $8,150 over the original proposal..
Action Required by Council: Authorize an increase in the contract with
Insituform Gulf South by $8,150, for a new total authorization of $80,220
for the rehabilitation of 1,135 feet of 15 inch sewer.

Re: Cured-In-Place Pipe Installation in the Roseberry Drive Area
Dear Mr. Gillett:
Very recently it has come to our attention that the previous parameters for the
referenced task have been changed. In light of these alterations, Insituform Gulf
South, Inc. (IGS) is pleased to quote the following:
Item #1: ASTM F-1216 cured-in-place pipe installation.
15 - inch x approximately 702 l.f. $57.00/l.f.
18 - inch x approximately 4331.f. $72.00/l.f.
Item #2: Remote cutting of cured-in-place pipe at service connection.
Estimate of 10 each @ $575.00/ea.
Item #3: Bypass pumping.
Estimate 2 set up @ $812.00/per set up
Approximate 36-hour maintenance a $ 46.00/per hr.
IGS understands the following to be provided to IGS at no cost:
1. Water for completing the project.
2. A convenient approved dump site for all debris generated from the cleaning
portion of the project.
3. Obstruction removal via excavation, if necessary.
4. Access to manholes, rights-of-way and easements in the project area.

Prices are based on dry ground access, construction performance during fair weather
conditions and a manhole access location which will allow IGS to install the
Insitutube with two (2) inversions. We understand the urgent nature of this proJ'ect
and are prepared to respond immediately if authorization is given on or before
January 18, 1991.
After a thorough review of the project area, we are confident that the Insituform
process best serves the needs of the City by solving the evident pipe problems
quickly and with little disruption to nearby homeowners. We appreciate the
opportunity to demonstrate our commitment to excellence and look forward to
serving you soon. A signed copy of this amendment will serve as our authorization
to continue with this project.
