APRIL 8, 1991
1. The meeting was called to order by Mayor Malone at 6:00 P.M.
Members of City Council Present: Mayor Norman Malone,
Councilpersons Guy Sutherland, Ed Matuszak (arrived at 6:05
P.M.), Bob McLaughlin, Alton Porter, Deotis Gay (arrived at
7:10 P.M.), B. Don Skelton, Jerry Clarke
Members of City Council Absent: Councilperson Mike Cooper
Members of City Staff Present: City Manager Bob Herrera, City
Attorney Knox Askins, City Secretary Cherie Black, Assistant

2. The invocation was given by Councilperson Clarke.
3. Council considered approving the minutes of the regular
meeting of Council held March 25, 1991.
Motion was made by Councilperson Skelton to approve the March
25 minutes as presented. Second by Councilperson Sutherland.
The motion carried, 6 ayes and 0 nays (Councilpersons Matuszak
and Gay had not yet arrived).

Skelton, Clarke and Mayor Malone

4. The Mayor and City Manager Bob Herrera presented an engraved
gold watch to recent retiree Pablo Soto Alvarez. Mr. Alvarez
expressed his appreciation.
5. The following citizens addressed Council: Lindsay Pfeiffer,
regarding problems with the East E Street paving and the fact
that the storm sewer interceptors will leave the ditches along
the feeder streets wider and deeper, and will really look bad.
He asked for help in resolving this.

Ms. Frances Weiss and Ms. Charlcya Wheeler, representing the
San Jacinto Day Foundation, presented Council with strawberry
pies and VIP letters of entry to the annual Strawberry
Festival.
6. Council considered approving proposed changes to Ordinance
1644-A concerning fees, hours of operation, rentals, and proof
of residency for general admission at Little Cedar Bayou wave
pool; and fees and hours of operation at Fairmont Park pool.
Stan Sherwood, Director of Parks and Recreation, reviewed the
proposed changes for Council's benefit. Questions from
Council were answered by Mr. Sherwood. Councilperson Clarke
recommended that, since the Desert Storm personnel will be
here through August to oversee return of equipment, that a
special discount be given to these servicepeople for use of
the wave pool while they are here. Captain Mike Chrisler was
introduced and gave a brief summary of the personnel that
might be expected to be here from now until August.
Motion was made b~ Councilperson Skelton to adopt Ordinance
1644-B and have staff look into the possibility of reduced
rates for Desert Storm servicepeople in our city and brinct it
back to the next Council meetintt. Second by Councilperson
Matuszak.
Motion was made b~ Councilperson Porter to amend the ordinance
to offer the same discount to the militarv as is offered to
senior citizens. Second by Councilperson Sutherland.
Motion was made by Councilperson Matuszak to amend the
amendment and reduce the rate for the militarv to 51.00.
Second by Councilperson Clarke.
The vote was taken on the second amendment and the motion
passed, 4 ayes and 3 nays.

Before the original motion was voted, more questions from
Council were answered. Councilperson Sutherland indicated he
would like to see the wording regarding children 4 years of
age and younger changed to "4 years and under accompanied by
an adult."
Motion was made by Councilperson McLaughlin to table this
ordinance until everyone really knew what they were talking
about. The motion died for lack of a second.
The original motion was voted, and the Ordinance was adopted
as amended, 4 ayes and 3 nays.

7. Council considered an ordinance closing a 16-foot alley in
Block 1141, Town of La Porte.
The City Attorney read: ORDINANCE 1752 - AN ORDINANCE
VACATING, ABANDONING AND CLOSING THE 16-FOOT ALLEY IN BLOCK
1141, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Sutherland to adopt Ordinance
1752 as read by the City Attorney. Second by Councilperson
McLaughlin. The motion carried, 7 ayes and 0 nays.

Porter, Skelton, Clarke and Mayor Malone

8. Council considered a resolution approving participation in the
Telephone Franchise Steering Committee.
The City Attorney read: RESOLUTION NO. 91-7 - A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, APPROVING
PARTICIPATION IN THE TELEPHONE FRANCHISE STEERING COMMITTEE;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Skelton to approve Resolution
91-7. Second by Councilperson Clarke. The motion carried,
7 ayes and 0 nays.

9. Council considered awarding a bid for removal of ACM from
City-owned building at 1322 South Broadway.
Motion was made by Councilperson McLaughlin to award the bid
for asbestos removal to Abatement, Inc., in the amount of
512,352.00, with a contingency account of 5750.00. Second by
Councilperson Clarke. The motion carried, 7 ayes and 0 nays.

At this time the City Manager requested that Council consider
going into executive session, since the Special Counsel was
present. Council adjourned into executive session at 6:54
P.M. under V.A.T.S. - Article 6252-17, Section 2(E) - (Legal),
to confer with Attorney(s) regarding Houston Chemical
Services, Inc./Southern Ionics, Inc. Council reconvened at
7:25 P.M., with no action being taken.
Councilperson Gay had arrived at 7:10 P.M. and joined Council
in executive session.
10. Workshop Item: Review policies for water and sewer service
outside the City and consider pending requests.
Assistant City Manager John Joerns addressed Council on this
item, bringing to their attention that this subject had been
discussed at a Council retreat in 1990. At that time, Council
had directed staff to visit with each firm individually that
had requested service and bring their findings back to City
Council regarding the nature of the individual requests and
receive further policy direction at that time. The packet of
information reviewed by Mr. Joerns is attached for record.
Questions from Council were answered by Mr. Joerns, Mr. Ron
Dana, Mr. Chuck King, and Mr. Ben Jones regarding their
requests for water and sewer service.
Direction from Council was requested, and consensus was to
meet with the companies involved and explore possibilities,
including possible annexation.
The workshop was concluded at 8 : 3 0 P . M. , at which time the
regular agenda was continued.

12. Council Action
Councilpersons Sutherland, McLaughlin, Skelton and Mayor

SUMMARY & RECOMMENDATION
After analyzing attendance and operational practices employed at
the Wave Pool for the Fiscal Year 1989-1990, we are convinced that
a different approach is needed regarding operations.
Propose changes to the City Ordinance No. 1644 A concerning fees,
hours of operation, rentals,and proof of residency for general
admission. Add hours of operation and fees for the newly acquired
Fairmont Park swimming pool to this ordinance. Attached exhibits
support these changes.

Change hours of operation, fees, rental availability, and proof of
residency requirements for general admission at the wave pool
beginning with the 1991 summer season. Statistics/charts attached
show strong justification for the following revisions to the City
ordinance concerning wave pool operations.
1> Hours of operation:
Monday thru Thursday
Friday thru Sunday

11:00 a.m. - 8:00 p.m.
11:00 a.m. - 6:00 p.m.
(1990 attendance summary chart-statistics show little
activity after 6:00 p.m., especially Friday thru Sunday.)
2) Delete proof of residency requirements for general
admission. Statistics (resident/non-resident usage
chart) show non-residents make up only 15% of the total
attendance in all categories. Problems/delays associated
with checking proof of residency to determine admission
price is inconvenient for guests, costly, time-consuming,
and not feasible, considering 15% non-resident usage.
3) Fees:
Propose a single general admission fee of $3.00. This
is an increase of .50 over the 1990 season. Patron
convenience would be much improved. Cost/time associated
with tube rental is not justifiable. Tubes/floats will
be provided thru indirect/admission charge.
4) Rentals:
Emphasis for wave pool rental will be Friday thru Sunday
after 6:00 p.m. Pool will still be available at other
times for rental however, 1990 figures show only one
rental during the week (Thursday), during the entire
summer.
5) Propose Twilight Saver Fare:
Reduced admission ($1.50), after 4:00 p.m. Also, during
the week, special events such as "Dive-In Movies",
"Splash Dances", etc. should help improve attendance
during later hours.

AN ORDINANCE ESTABLISHING THE RATES FOR THE USE OF THE MUNICIPAL
~~ SWIMMING POOLS AND THE HOURS OF OPERATION FOR THE MUNICIPAL
SWIMMING POOLS.

Section I. Admission to the Municipal Swimming Pools may be
obtained by either purchase of a season pass or by paying a general
admission fee.

A. Season passes for San Jacinto, Northwest and Fairmont

BLOCK 1141, IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; ANA PROVIDING AN EFFECTIVE
DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has been
requested by record owner of all o.f the property abutting the
hereinafter described 16 foot alley in Block 1141, in the Town of La
Porte, Harris County, Texas, to vacate, abandon, and permanently
close the 16 foot alley in Block 1141; and
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine and declare that the
hereinafter described 16 foot alley in Block 1141, Town of La Porte,
Harris County, Texas, is not suitable, needed, or beneficial to the
public as a public road, street and alley, and that the closing of
the hereinafter described 16 foot alley in Block 1141, Town of La
Porte, Harris County, Texas, is for the protection of the public and
for the public_interest and benefit, and that the hereinafter
described said 16 foot alley in Block 1141, should be vacated,
abandoned, and permanently closed.

SUMMARY & RECOMMENDATION
Texas Municipal League has requested that Texas cities join in
participation in a Telephone Franchise Steering Committee. The
present City of La Porte-Southwestern Bell Franchise was adopted
April 4, 1952, and has been renewed every five years since that
date. By its terms, it will expire January 1, 1992.
The attached letter from TML describes the purpose of the
Committee.
The City receives from Southwestern Bell approximately $88,000
dollars yearly in franchise fee payments. Staff believes we should
participate with the wishes of TML since our franchise agreement
with Southwestern Bell will expire January 1992.

SUBJECT: Telephone Franchise Fees
As you may be aware, a Telephone Franchise Steering Committee was recently
formed because a number of cities were faced with expiring telephone franchises.
Although several cities had already started negotiations with Southwestern Bell or
other telephone companies, it was felt they were having very little success.
Specifically, the goals the Committee has set for itself are to:
• Act as a clearinghouse for information;
• Serve as a central point of negotiation for cities;
• Develop a base franchise model for possible use by individual cities;
• Provide further assistance to cities in the adoption of franchise
ordinances.
During the last several months, the Committee has evaluated the Southwestern Bell
proposal and concluded that it falls short of properly addressing concerns of the
vanous cities. The Committee determined that it is imperative to retain both legal
and auditing services to respond to the proposal by Southwestern Bell.
It was concluded that legal services are needed due to Southwestern Bell's
contention that a franchise is not legally required from cities. Several city officials
feel that the proposal may in fact be an attempt to eventually have franchise fees
invalidated by a court. If this were to occur, the Committee is concerned it could
possibly have significant impact on other franchise fees received by cities.
It was also determined by the Committee that the services of a utility rate auditor
would also be needed.
You will find enclosed a sample resolution. The Committee asks that you consider
adoption of this resolution. If you adopt it, please return it to TML by April 30,
1991.

as a guide in determining the interest in forming a statewide committee. The
Commmttee will provide you another resolution, at a later date, which will call for a
financial commitment if you select at that time to become a member.

RESOLUTION NO. 91-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTS, TEXAS,
APPROVING PARTICIPATION IN THE TELEPHONE FRANCHISE STEERING
COMMITTEE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City has a public responsibility to protect the
public rights-of-way and easements and to require the telephone
company to assume certain duties and responsibilities regarding such
easements and rights-of-way by means of reasonable terms and
conditions in a franchise ordinance; and
WHEREAS, a steering committee of cities could share
information, develop a model ordinance, obtain special legal and
auditing counsel and provide further assistance to the member cities
in the adoption of franchise ordinances with the telephone utility
company;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF LA PORTS:
Section 1. That the participation by the City in the Telephone
Franchise Steering Committee is hereby approved and does not
obligate the City to any payment.
Section 2. It is anticipated that a pro-rata fee shall be
assessed by the Telephone Franchise Steering Committee at a later
date. Such financial obligation shall require the approval of a
separate resolution. Such fee shall be based upon expected costs
for the purposes stated above and be determined by the population of
the City.
Section 3. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City of La Porte, Texas for the time required by law preceding this

removal of Asbestos Containing Material (ACM) from the existing
building at 1322 South Broadway (the old bowling alley). This work
is an essential pre-construction project for the proposed Senior

for the project is Abatement, Inc. with a total cost for the work

SUMMARY & RECOMMENDATION
In August 1990, the City received a letter from Highway Pipeline Intermodal
Systems requesting water and sewer service for three separate businesses
outside La Porte city limits (but within our E.T.J.). Staff visited with
Council regarding the request. After much discussion, staff was instructed
to visit with each firm individually and return to Council for final policy
direction.
You may recall that the last Council retreat included a discussion of water
and sewer sales outside city limits. Information presented at the retreat
is included here for your review.
The key issue/objective for this workshop item is to provide administration
with direction in refining or revising the City's policy on furnishing water
and sewer service outside the City (but within the E.T.J.).

SUBJECT: Water and sewer policy outside city limits
Background
The current policy (dated January 1983) regarding water and sewer
service outside the City can best be described as a "good neighbor
policy". Upon Council review and approval, water and sewer service
for facilities outside the city limits could be provided.
Traditionally, Council has considered applications for providing
water and sewer for domestic/sanitary needs only. However, if
other uses are anticipated the policy does call for specific
Council approval. To date, the City has entered into two contracts
for provision of water for domestic needs. There have been no
contracts for provision of sanitary sewer services.
As reported to Council earlier, prevailing conditions and planning
assumptions have changed significantly since 1983. One of the most
significant changes is the conversion to surface water and the
LPAWA contract for a fixed supply of potable water. In addition,
the City has been receiving requests for levels of service that are
beyond domestic needs only.
Per Council's request I have visited with each firm requesting
service via the Highway Pipeline letter. We discussed the City's
current policy and the City's fixed capacity contract with LPAWA
for delivery of surface water.
The firms current situation/requests can be summarized as follows:
1. Highway Pipeline Trucking: Provides transportation services,
trucking, cleaning, storage, hydrostatic testing, repair,
refurbishing, etc. of containers used in intermodal
transportation. Presently, the cleaning of the
tanks/containers takes place off site through an agreement
with another firm. Their objective is to relocate this
operation to their site and become a full service, or one stop
operation, for their customers. They have indicated that
their facility will handle only Highway Pipeline accounts (not
a public facility) and will not handle sludge now or in the
future.

Currently their water needs are met with a well and as
mentioned above, the containers are cleaned off site. Note
that DANA Tank Container, Inc. is considering the purchase of
Highway Pipeline. Included in your package is a letter from
DANA outlining the anticipated business operations and utility
demands. The letter further states that the sale of DANA is
dependent on the City of La Porte providing the requested
water and sewer services.

2. I. Heller Construction Company: Heller operates a warehousing
facility and is requesting water and sewer services for
domestic needs only. In earlier discussions with Heller the
staff had indicated the possibility of providing water for
domestic purposes with an estimated delivery of 1,500 gpd.
Heller indicated that the estimated capital costs associated
with installation of lines was not a prudent fiscal decision
for the amount of service received. Heller is still
interested in the possibility of obtaining water and sewer for
domestic services.

3. Ohmstede: The situation for Ohmstede has changed
significantly since August. At that time they were
investigating options for treatment of their wastes. Since
that time Ohmstede has installed their own wastewater
treatment facility. If available they would still be
interested in the delivery of water for domestic uses.

As discussed at the Council Retreat there is (based on the City's
contract with the LPAWA) a fixed amount of surface water available
which can be supplemented by our well field. The estimated
capacity of potable water available and sewer treatment capacity
vs. the actual usage and projected growth is included for your
review.
Related Planning Issues
You may also recall two recent projects which when completed would
promote (but not complete) the availability of water and sewer to
the incorporated area north of SH 225. The two projects are:
1. The construction of 750 thousand gallon elevated water
tower and associated water mains. (95$ complete)
2. The installation of casings under SH 225 to provide for
future water and sewer service to the incorporated area
North of SH 225 (proposed this fiscal year).

These projects especially the proposed casings are mentioned
because each firm has mentioned the possibility of sharing costs
depending on the policy decision made by Council.
In preparation for this workshop each department was asked to
submit comments regarding the provisions of water and sewer service
outside the city limits (beyond current policy guidelines). A
partial list of these comments/concerns is attached in the form of
a matrix which may be of some value when reviewing the policy with
Council.
It appears that SH 225 is becoming a service orientated corridor
and in the future may no longer be the effective fence or barrier
between City and large industry concerns. It is likely that
similar service requests will follow. Over time the Council may
want to entertain some long range planning for the SH 225 corridor
(north side).

Referencing our meeting in your office on February 6, 1991,
with Mr. Ben Jones and Dave Clark about the City of La Porte
providing water and sewer services to the property which is
owned by Highway Pipeline Intermodal Services.
1. The type of business to be operated at this location would
be ISO tank containers and domestic tank trailers.
A. Repairs and preparation of the two types of tanks
listed above.
2. The number of employees at present numbers nineteen (19)
to an estimated increase in total employees wouldroximatel
approximately twenty-four (24) for a total of app Y
forty-three (43).
3. Projections on water and sewer services would be approxi-
mately twenty (20) gallons per day which is a gallon per
day per employee, and industrial useage here would be
approximately twenty-five thousand (25,000) gallons per
day, five (5) days per week.
4. The ultimate estimated sewer and water requirement could
increase from ten (10) to fifteen (15) percent.
5. The industrial waste treatment would be designed and in-
stalled to meet the set requirements as now outlined by
the Sewer District of the City of La Porte.

3. Where required by the City of La Porte (mandatory for all process-type
plants) a reduced pressure zone backflow preventor must be installed
to protect the City from any possible cross-connections
4. When recommended by the City of La Porte, a meter bypass will be
installed
5. All plumbing shall meet applicable State and City of La Porte code
requirements. City of La Porte shall have the right to inspect any
and all work related to the furnishing of potable water to the user
- 6. The proposed user shall be charged the customary front foot fees on
the area developed and improved, including off-street parking areas
but not including areas intended for future development (Ordinance
759-E)
7. The user shall pay 150% of the water rates currently in effect for
