Members of City Council Present: Mayor Norman Malone, Councilpersons Guy Sutherland, Bob Thrower, Bob McLaughlin, Alton Porter, Deotis Gay, Jerry Clarke Members of City Council Absent: Councilpersons Mike Cooper and B. Don Skelton Members of City Staff Present: City Manager Bob Herrera, City Attorney Knox Askins, City Secretary Cherie Black, Assistant City Manager John Joerns, Director of Public Works Steve Gillett, Human Resources Manager/Purchasing Manager Louis Rigby, Finance Director Jeff Litchfield, Director of Parks and Recreation Stan Sherwood, Acting Police Chief Tom Neely, Director of Community Development Joel Albrecht, Fire Chief Joe Sease, Recreation Superintendent Others Present: Arthur Story, Executive Director of Harris County Flood Control District; Rich Lewellyn, Project Manager; Greg Dicicio; Howard Sampson, staff member to Jim Fontenot former Councilperson Ed Matuszak and wife Barbara; John Black, Bayshore Sun; 38 citizens 2. The invocation was given by Mayor Malone. 3. Council considered approving the minutes of the called regular meeting held May 6, 1991. Motion was made by Councilperson McLaughlin to approve the May 6 meeting as presented. Second by Councilperson Sutherland. The motion carried, 7 ayes and 0 nays. Ayes: Councilpersons Sutherland, Thrower, McLaughlin, Porter, Gay, Clarke and Mayor Malone Nays: None Councilperson Clarke recommended that the minutes reflect that the Councilperson who won the District 3 position is not an incumbent. The minutes will be modified accordingly. 4. A proclamation honoring former Councilperson Ed Matuszak, and signed by all members of Council, was read by the Mayor. A plaque of appreciation was presented to Mr. Matuszak, as well as various other "mementos" of his nine years service to the city. Mr. Matuszak expressed his thanks and voiced his appreciation of the objectives accomplished during his tenure. • Minutes, Called Regular Meeting La Porte City Council May 20, 1991, Page 2 5. Ms. Gail Davis, Assistant Recreation Therapist, was named as Employee of the Quarter for January, February and March, 1991. Mayor Malone presented Ms. Davis a plaque. 6. Mr. Arthur Story, Executive Director of the Harris County Flood Control District, along with several members of his staff, addressed Council regarding the plans of the District for this area. 7. The following citizens addressed Council regarding flooding problems in the Lomax area: Bobby Blackwell, Mike Knott, Robert Pickering, Sidney Grant, Betty Waters. Rev. Tom Walls was scheduled to speak, but was not present. Ed Feith addressed Council regarding the Bay Day celebration, and thanked staff for their help with the event. 8. Council considered an ordinance closing "M" Street between Broadway and South First Street. 9. Council considered an ordinance closing the alley in Block 1432 between "M" and "N" Streets. The above two items were requested to be brought to executive session and then be considered for action. 10. Council considered awarding a bid for 1991 Bayshore elevated water storage tank painting project. Ayes: Councilpersons Sutherland, Thrower, McLaughlin, Porter, Gay, Clarke and Mayor Malone Nays: None 11. Council considered a consent agenda, as follows: (A) Consider awarding a bid for gasoline and diesel fuel; (B) Consider awarding a bid for personal alert safety systems devices. Motion was made by Councilperson Porter to approve the consent agenda as presented. Second by Councilperson McLaughlin. The motion carried, 7 ayes and 0 nays. the construction contingency of the Northwest La Porte Water Project. Second by Councilperson Gay. Administrative Reports The City Manager announced that the City's recycling center would open on June 1, from 8:00 A.M. until 4:00 P.M., at the Public Works Service Center. The facility will be open on the first and third Saturday each month. 13. Councilpersons Sutherland, McLaughlin, Porter, Gay, Clarke and Mayor Malone brought items to Council's attention. 14. Council adjourned into executive session at 7:37 P.M. to discuss agenda items 8 and 9 under V.A.T.S. - Article 6252- 17, Section 2(E) and 2(F) (Legal and Land Acquisition). Council returned to the table at 8:57 P.M. Agenda items 8 and 9 were addressed. Motion was made by Councilperson Porter to table items 8 and 9 until the .next regular meeting. Second by Councilperson Thrower. The motion carried, 6 ayes and 1 nay. Ayes: Councilpersons Sutherland, Thrower, Porter, McLaughlin, Gay and Mayor Malone Nays: Councilperson Clarke 15. There being no further business to come before the Council, the meeting was duly adjourned at 8:58 P.M. During her time of employment, Gail has shown consistent creativity and enthusiasm, and well as total professionalism. While the Recreation Therapist was out on maternity leave, Gail coordinated the administrative duties of the division, as well as supervising the daily recreation program. This included Special Olympics sports training, Very Special Arts planning and programs, and some special events. All were done with expertise and dedication. Gail is an asset to the City of La Porte, and I am proud to name Gail Davis as Employee of the Quarter for January, February and March, 1991. • REQUEST FOR CITY COUNCIL AGENDA ITEM Agenda Date Requested: Ma 20 9 Requested By: a brec artment: Community Development Report Resolution X Ordinance Exhibits: 1) Letters from Franchise Utility Companies 2) Memo from Steve Gillett, Public Works Director 3) Release of Reversionary Rights ____________________=====5=====________________________________-_ SUMMARY & RECOMMENDATION The City of La Porte is developing a Senior Citizen/Wellness Facility at 1322 South Broadway. Staff is requesting Council to consider the closing of "M" Street, and an alley in Block 1432 between "M" and "N" Streets, which will be converted into additional parking for the facility. To close "M" Street and develop a parking lot on the property several things must occur. They are as follows: (1) Retain an easement for Entex on the northernmost 16 ft. of the existing "M" Street right-of-way from the west right-of-way line of Broadway to the east right-of-way of South First Street. (2) Authorize HL&P to reroute the existing facilities located in "M" Street to South "L" Street and then southeast on So. First Street. HL&P estimates the cost to the City .for the rerouting to be $10,947.00. Mr. Hal Lawler, the adjacent property owner, has consented to the closing of "M" Street and will not exercise his option to purchase the 50~ portion of the street right-of-way, which totals 7,680 sq.ft. Mr. Lawler, however, has asked that in return for his consent on the "M" Street closing that the alley containing 6,400 sq.ft. in the adjacent block between "M" and "N" Streets be closed to him at no cost. Mr. Lawler and his lending institution have signed a release of reversionary rights on the two parcels being considered. The alley in Block 1432 has approximately 150 ft. of sanitary sewer line located in it that will be converted to a private line and maintained by the property owner. There are no other utilities in the alley. All utility companies concur with staff's request for closure. • Action Required by Council: Close both the alley in Block 1432, between "M" and "N" Streets and "M" Street between South Broadway and South First Streets. Authorize HL&P to reroute the electrical facilities located in "M" Street and retain an easement for Entex on the northernmost 16' of "M" Street from the west right-of-way line of Broadway to the east right-of-way of So. First Street. Herrera Date City Manager • • ORDINANCE N0. 1756 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF "M" STREET, IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of La Porte has been requested by record owner of all of the property abutting the hereinafter described portion of "M" Street, in the Town of La Porte, Harris County, Texas, to vacate, abandon, and permanently close that portion of "M" Street; and WHEREAS, the City Council of the City of La Porte has determined and does hereby find, determine and declare that the hereinafter described portion of "M" Street, Town of La Porte, Harris County, Texas, is not suitable, needed, or beneficial to the public as a public road, street and alley, and that the closing of the hereinafter described portion of "M" Street, Town of La Porte, Harris County, Texas, is for the protection of the public and for the public interest and benefit, and that the hereinafter described portion of said "M" Street, should be vacated, abandoned, and permanently closed. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Under and by virtue of the power granted to the City of La Porte under its Home Rule Charter and Chapter 13, Title 28, Article 1175, of the Revised Civil Statutes of the State of Texas, 1925, the hereinafter described portion of "M" Street, Town of La Porte, Harris County, Texas, is hereby permanently vacated, abandoned and closed by the City of La Porte, to-wit: Being that portion of the right-of-way of "M" Street, between Block 1158 and Block 1432, Town of La Porte, Harris County, Texas, and between the east right-of-way line of South 1st Street and the west right-of-way line of Old State Highway 146, as established by deeds to the State of Texas, recorded in Volume 1005, Page 530; Volume 1000, Page 124; and Volume 995, Page 601 of the Deed Records of Harris County, Texas. SAVE AND EXCEPT the City of La Porte retains an easement across the northernmost 16 feet of existing "M" Street right-of-way, from the west right-of-way line of Old State Highway 146, to the east right-of-way line of South 1st Street, for the use and benefit of Entex Corporation, for a natural gas line. Section 2. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was • ORDINANCE NO. 1756 PAGE 2 posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. An eight inch (8") gravity sanitary sewer main and a six inch (6") force main are currently in use in this portion. The 8 inch sanitary sewer main should be relocated to the south ROW line of South M Street and the 6 inch force main may be abandoned in place. The Public Works Department will relocate the gravity main provided materials are furnished by the Parks and Recreation Department. With the above referenced actions, the Public Works Department has no objections to the requested closure. Should there be any questions or further information is desired, please contact me. This is contingent upon the City of La Porte granting an easement to Entex for any maintenance that may become necessary in the future. A 16' easement with both lines in the approximate center will be sufficient. His inspection revealed that the interior coating of the tank was in poor condition, and in need of refinishing within two years. The exterior portion was also deteriorated, and it was recommended that the entire tank be repainted. Bids were prepared to repaint the tower, with the inclusion of a curtaining system, on a lump sum basis. With the recent changes in the Texas Air Control Board Regulations, and the close proximity of adjacent structures, including a large apartment complex, curtaining is a necessity. Two bids were received on March 4, 1991, with low bid in the amount of $92,000. Budgeted amount for the construction phase of this project was $70,040. Council rejected all bids on March 11, 1991, and authorized bidding the project again, with the bid broken into five basic parts. This was to allow the City to evaluate individual components of the project, and possibly delete or modify portions of the project. Additionally, it was felt that more bids could be solicited, increasing competition. Bids were again opened on May 2, 1991, with four bids received. Low bid, from A-Way Tank Service, was in the amount of $89,860. It is apparent that the original estimate was too low, and the additional cost is a result of the unforseen expense of protecting adjacent structures. It is possible to delete the dry inside portion of the project, for a savings of $14,275. However, if deleted, the City will face bidding this portion in the next two years, with increased costs due to the additional mobilization costs in addition to construction costs. The 1984 Water Master Plan indicates the need for a future elevated water storage tank in the southern area of the City. The Plan did not account for the existing 200,000 gallon tank in the former Bay MUD area. Removal of the current tower, to be replaced at a later date as demand dictates, is a possibility. However, removal costs, especially with adjacent structures, would equal repainting costs. With these considerations, it is recommended that the Bayshore Elevated Water Storage Tower be repainted. With similar costs for repainting and demolition, it is desirable to retain the additional storage for future use. If population growth during the planning period indicates the need for additional storage, the existing tower can be removed, and a new tower constructed in a more desirable location. The new coating system can be expected to last 15 to 20 years, which coincides with the planning period used to determine elevated storage requirements. Basically, the city, by painting the existing tank, will gain this additional time to adequately plan for future storage needs. I recommend that the City award the 1991 Bayshore Elevated Water Storage Tank Painting Project to A-Way Tank Service in the amount of $89,860, and the additional $19,820 needed be appropriated from the construction contingency of the Northwest La Porte Water Project. • DOPIALD C. In checF:inq the location of the tower on Humphreyville off Bayside iirive, we find that the tower is located in a very congested area surrounded in close proximity by apartments and homes. In tact, at one place the apartments are within 3~7 feet of the tower. In addition to the apartments. the complex has a swimming pool that is less than it)~~ feet from the tower. Cither living facilities are approximately 10t- to 15~- #eet away. Though the tower is not considered to be a red lead removal, the proximity to housing would place this tower into the category where abrasive blasting would provide dust that would fall under the Texas Air Control board General pule=_, Chapter iUi, paragraph 1::-1.4, Nuisance. This paragraph states that "No person shall discharge from any source whaLSaever one or more air contaminants or cambinatians thereof. in such concentration and of such duration as are or may tend to be injurious to or to adversely affect human health or welfare, animal life, vegetation, or property, or as to interfere with the normal use and en.jvyment of animal life, vegetation, ar property." The Texas Air Control Board has in recent months closed dawn .jobs in San Antonia and Texas City and each case the Contractor was threatened with a ~1ir,~:-i:-i'- dal"I y fine.
