MINUTES OF THE REGULAR MEETING OF LA PORTE CITY COUNCIL

1. The meeting was called to order by Mayor Pro Tern Bob
McLaughlin at 6:03 P.M.

2. The invocation was given by Councilperson Clarke.
3. Council considered approving the minutes of the regular
meeting held June 10, 1991.
Motion was made by Councilperson Skelton to approve the June
10 minutes as presented. Second by Councilperson Thrower.

Mayor Pro Tern McLaughlin announced that items 5 through 9 had

10. Council considered an ordinance approving a letter of
agreement between State Department of Highways & Public
Transportation and the City of La Porte for Landscape
Materials.

THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, APPROVING
CONTINUED PARTICIPATION IN THE TELEPHONE FRANCHISE STEERING
COMMITTEE AND APPROVING A ONE-TIME PAYMENT OF ONE CENT PER
CAPITA (.01) OR TWO HUNDRED SEVENTY-NINE DOLLARS AND TEN CENTS
($279.10); FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Skelton to approve Resolution
91-10 as read by the city Attorney. Second by Councilperson
Thrower. The motion carried, 6 ayes and 0 nays (councilperson
Cooper had left the Council table in order to deliver a copy
of Resolution 91-09 to the office of Jim Fonteno).

14. Council considered authorization to proceed on dangerous
buildings.
A video presentation was made by Inspector Mark Lewis, showing
17 buildings that had been deemed dangerous by the Inspection
Committee.
Motion was made by Councilperson Porter to authorize the
Inspection Department to proceed on danqerous buildinqs and
to' call a public hearinq on July 22 in this reqard. Second
by Councilperson Thrower. The motion carried, 6 ayes and 0
nays.

15. The item to consider approving a contract for engineering
services from Bill Manning was removed from the agenda pending
further clarification.
16. Council considered awarding a contract for reconstruction of
curbs and sidewalks and construction of wheelchair ramps on
Main Street between Broadway and Second Street.

Motion was made by Councilperson Skelton to accept the bid
from Royalty Construction in the amount of $29.690 and a
continqency fund in the amount of $3.000 for improvements to
Main Street. Second by councilperson Clarke. The motion
carried, 6 ayes and 0 nays.

17. Council considered awarding a bid for repair of damaged patrol
car.
Motion was made by Councilperson Porter to award the bid for
repair to damaged patrol car to Joe Camp Ford in the amount
of $6.975.43. Second by Councilperson Sutherland. The motion
carried, 6 ayes and 0 nays.

Section 2(G) (Personnel) - Discuss approving assignment for

and Commissions; and Section 2 (R) (Conference) - Receive
report from City Manager regarding contractual matters
relating to East E Street improvements. Council returned to
the table at 8: 10 P.M., no action being taken during the
executive session, and addressed the following agenda items:

SUMMARY & RECOMMENDATION
We have again been ask to cooperate with the Harris County Organized Crime
And Narcotic Task Force by supplying them a Supervisor. This Officer will
be a Sergeant of our Special Operation Division.
The grant for this position will begin June 1, 1991. This unit has been
funded by The Texas Narcotics Control Program in the amount of 2.35 million
dollars.
We will receive funding to replace the sergeant when he is loaned to Task
Force on this grant. The Task Force will pay up to 75\ of full salary and
benefits for a Sergeant.. The officer replacing him will begin at entry
level. For Example:

The sergeant will supervise seven narcotic officers that will be assigned
to work the East end of Harris County. This will be to our benefit as he
already knows of our drug problem areas. Participation in this unit has
given us the necessary resources to continue the fight against drugs on our
streets and drug dealers. The Organized Crime & Narcotics Task Force major
concentration on drug operations will give us a broader range of narcotic
powers in other areas.
Continued participation in this project will be extremely beneficial to the
City of La Porte. We agreed that all monies confiscated was to go back
into the Harris County Organized Crime & Narcotics Task Force. This will
be for operating expenditures until they have made up to the amount
originally funded. They would then start sharing money with the cities
participating in the program. We received over $14,000 last year from
participation in one seizure, even though we have agreed not to expect any
money.
The grant applied for to cover the sergeant position is funded for one
year. However, the Organized Crime Unit has been in operations for over
ten years, funded by Grants from the State of Texas. They are now funded
by a Federal Grant under the name of Harris County Organized Crime &
Narcotics Task Force. This grant is for a year, but if the funding is not
approved for fiscal year 1992-93, they have enough funds from seizures to
operate for two years. However, this Task Force is the largest in the
State of Texas and has the highest arrest and seizures. They will continue
building funds from seizures, therefore, they can continue to operate into
the future.
The City Council must pass an Ordinance authorizing an adjustment to the
budget for an additional person. This ordinance will be sent to Harris
County Organized Crime & Narcotics Task Force alone with the contract
proper paper work for approval. We are requesting this Ordinance be placed
on the council agenda for the June 24, 1991 Council meeting.
ACTION REQUIRED BY COUNCIL:
Request Council approve this request for an ordinance assigning a
supervisor to the Harris County Organized Crime & Narcotics Task Force.

SUMMARY & RECOMMENDATION
,
We are proposing an amendment to the budget for the fiscal year
1990-91, by adding a certain police personnel position.
This change will assist the orderly, efficient operation of the
Police Department by replacing the two officers who are assigned
to the Harris County Organized Crime and Narcotics Task Force
under a Federal Grant. This position is funded through salary
reimbursements from the Task Force, and should this Unit not be
funded in future years, these positions will be abolished.
ACTION REQUIRED BY COUNCIL:
Approve and adopt Ordinance.
ALTERNATIVE:
Leave situation as is and we will operate under unfavorable
conditions. We will have to pull the officer out of the Task
Force and loose the Grant Funding.

AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF LA PORTE, TEXAS, FOR
THE FISCAL YEAR BEGINNING OCTOBER 1, 1990, AND ENDING SEPTEMBER 30,
1991, BY ADDING A CERTAIN POLICE PERSONNEL POSITION.
WHEREAS, the Chief of Police has recommended to City Council
that one position classified as Police Patrol Officer be added; and
WHEREAS, this recommended change would assist the orderly,
efficient oper~tion of the Police Department by replacing the two
officers who were assigned to the Harris County Organized Crime and
Narcotics Task Force under a Federal Grant; and
WHEREAS, this position is funded through salary reimbursements
from the Harris County Organized Crime and Narcotics Task Force, and
should this Unit not be funded in future years, these positions
would be abolished.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE:
Section 1. That the budget of the City of La Porte, Texas, for
the fiscal year October 1, 1990, to September 30, 1991, as adopted
by Ordinance No. 1715, is hereby amended as follows:
Add to Account No. 001-502-506-101:
One Police Patrol Officer, salary range $28,642.00, and
One Police Sergeant, salary range $36,338.00.
Section 2.
This ordinance shall take effect immediately from
and after its passage and approval.

Letter of agreement from the State Department of Highways
SUMMARY & RECOMMENDATION
The City has applied for a grant (State Highway Department) for the beautification
of Main Street. The City will be required to adhere to a criteria that the State
has established for such grants. The grant is in the amount of $13,575.00 with
50% being provided by the State and 50% being provided by the City. The State's
obligation will consist of $6,787.50 of landscape materials and the City's obligation
will consist of $6,787.50 non-cash contribution (labor to install the landscape
materials on Main Street).
Action Required by Council:
Approval of the letter of agreement between the State Department of Highways and
Public Transportation and the City of La Porte.

We have reviewed your proposal for work under the Landscape Cost
Sharing Program and feel the project would be acceptable for
execution under Program Regulations relating to Pedestrian pro-
jects. Accordingly, we have prepared a draft Agreement based
upon your proposal which will govern work on this project if
~p-proval is granted by our State Highway and Public Trans-
~ortation commission.
As you will note, the Agreement reflects the specific respon-
sibilities of each party, and includes required contract
provisions which must be included within each Cost Sharing
Program Agreement.
We must have your concurrence in writinq that the Agreement is

THE STATE OF TEXAS

THIS AGREEMENT is made by and between the State of Texas,
~.cting by and through the State Department of Highways and Public
~ransportation, hereinafter called the "State", and the City of
La Porte, acting through its duly authorized officials, as
evidenced by Resolution or Ordinance Number , dated
, hereinafter called the "City".

WHEREAS, the State owns and maintains a system of highways,
including State Loop 401, in Harris countY, Texas, for public use
and benefit;-and
WHEREAS, the City has requested State participation in a
1991-1992 Landscape Cost Sharinq Program project along State LOop
401, from State Highway 146 to Broadway Street, hereinafter
called the "Project", and as shown on the attached EXHIBIT A: and
WHEREAS, the State has determined that the Project falls
under the Landscape Cost Sharing Program category of "Pedestrian"
landscape projects, and that in accordance with established
program policy the maintenance, of the Project shall be the
responsibility of the City in perpetuity; and
WHEREAS, the City has committed to cooperating with the
State by providing a total non-cash contribution of $6,787.50
toward the completion of the Project, which sum represents the
agreed, fair-market value for labor and equipment to fully
install all construction materials including plant materials; and
WHEREAS, state Highway and Public Transportation commission
Minute Order , dated , attached hereto and
labeled EXHIBIT B authorizes the state to cooperate with the City
in the development of the Project by providing state funds which
will be used to purchase landscape and construction materials in
accordance with the Project Design Plan;
NOW THEREFORE, in consideration of the premises and of the
mutual covenants and agreements of the parties hereto be by them
respectively kept and performed as hereinafter set forth, the
State and the City do mutually agree as follows:

A G R E E MEN T
ARTICLE 1. Term of Agreement.
This Agreement becomes effective when finally executed
(signed) by the state and shall terminate upon satisfactory
completion of the work as called for in the Project Design Plan
and as stipulated within this Agreement, unless otherwise
terminated as provided hereinafter.
ARTICLE 2. Project Design Plan.
The City shall prepare and furnish the Project Design Plan.
The Project Design Plan shall contain plans and specifications,
as may be required by the state to purchase the materials for the
Project. The Project Design Plan shall be incorporated into this
Agreement by reference.
ARTICLE 3. Project Funding.
The total estimated cost of the Project is $13,575.00, and
shall be funded jointly by the state and the City. state funds
in an amount estimated not to exceed $6,787.50 will be utilized
to purchase plant material and treated wooden material for tree
grates. The City's total non-cash contribution is $6,787.50 and
represents the agreed, fair-market, non-cash values of preparing
the tree locations by saw cutting and removing existing concrete
sidewalk. constructing the wooden tree grates, and installing the
plant material.
ARTICLE 4. Responsibility of the Parties.
A. The City agrees to:
1. Indemnify and save harmless the state, its agents
and employees, from all suits, actions or claims
and from all liability and damages for any and all
injuries or damages sustained by any person, or by
any abutting, adjoining or other property in
consequence of any neglect in the performance, or
failure of performance of the city, its agents and
employees under this Agreement, to the extent
allowed by state Law.

2. Indemnify, defend and hold the state harmless from
any and all claims and lawsuits by third parties
arising from, or incident to the performance, or
failure of performance of the City, its officers,
employees or agents under this Agreement to the
extent allowed by State Law. The City shall
defend all suits brought upon all such claims and
lawsuits and pay all costs and expenses incidental
thereto, but the state shall have the right, at
it's option and expense, to participate in the
defense of any suit, without relieving the City of
any obligation hereunder.
3. Provide the Project Design Plan and details.
4. Furnish all labor and materials required to fully
install the construction materials and plant
material furnished by the State. This shall
include but not be limited to saw cutting
equipment for removal of concrete 5'x5' squares in
existing walks, removal of any base material and
replacement with topsoil, soil amendments, and
fertilizers or root stimulator.
5. Not erect any benches in association with the tree
grates installed on this project.
6. Assume all maintenance activities for the Project
following installation, including pruning, regular
watering, and inspection of plant material for
pests and the proper treatment thereof. Also, the
maintenance shall include repair and/or
replacement as necessary of the wooden tree
grates.
7. FurniSh, erect and maintain any barricades, signs
and traffic handling devices, in accordance with
the latest Manual of Uniform Traffic control
Devices, and to the satisfaction of the state, as
may be required to protect the safety of the
travelling public while performing any work on the
project under this agreement.

B. The state agrees to:
1. Obligate State funds in the amount of $6,787.50
which will be utilized to purchase materials
including wolmanized pine raw lumber for the tree
grates and plant material including 57 each Live
Oak trees of two and one-half inch caliper and
3 each Sabol Palm trees of 8 foot trunk height.
2. Prepare and submit requisitions for construction
and plant material in accordance with existing
statutes relating to the purchase of material with
State funds.
3. Furnish material, after receipt, to the city.
4. Cooperate with the City to determine requirements
for barricades, signs and traffic handling devices
to be used by the City during the installation and
maintenance of the Project.
ARTICLE 5. Overruns/Underruns.
The State will make recommendation of award for the bid or
bids received for required landscape material as follows:
1. If, after receiving bids for required landscape
material, the cumulative total of the lowest bid or
bids exceeds $6.787.50. the State, in order to insure
that available State funds are not exceeded, and at its
sole option, may reject any or all bids, revise the
quantity of landscape material to be furnished and
resubmit the bids.
2. If, after receiving bids for required landscape
material, the cumulative total of the lOwest bid or
bids does not exceed $6.787.50. the State will
recommend award of the bid or bids. Unless, in the
sole opinion of the State, it is determined that the
furnishing of additional landscape material with any
remaining State funds is in the best interest of the
Project, the State will not purchase landscape material
in excess of the quantity requested by the City in the
City's proposal and as shown in the Project Design Plan
as would be necessary to insure the full amount of
State funds obligated for this Project is expended.
ARTICLE 6. Disputes.
Should disputes arise as to the party's obligations under
this Agreement, the State's decision shall be final and binding.

ARTICLE 7. Amendments.
Changes in time frame, character, cost or obligations herein
shall be enacted by written amendment. All amendments to this
Agreement must be executed by both parties within th~ contract
period specified in Article 1.
ARTICLE 8. Successors and Assigns.
The State and the City shall not assign or otherwise
transfer its rights and obligations under this Agreement except
with prior written consent of the other party, and any prohibited
assignment or transfer shall be null and void.
ARTICLE 9. Remedies.
violation or breach of contract terms by the City shall be
grounds for termination of the Agreement, and any increased cost
arising from the City's default, breach of contract or violation
of terms shall be paid by the City. This Agreement shall not be
considered as specifying the exclusive remedy for any default,
but all remedies existing at law and in equity may be availed of
by either party and shall be cumulative.
ARTICLE 10. Insurance.
At the time of execution (signature) of the Agreement by the
City, the City shall attach required insurance documentation to
each Agreement counterpart.
If the City is a self-insured entity and performs any work
on the Project with City Forces, the City shall extend the
protection of its self-insurance to the State for any and all
damages and injuries arising from the City's performance under
this Agreement.
If the City is not a self-insured entity and performs any
work on the Project with City Forces, the City shall furnish the
state with a completed Certificate of Insurance (SDHPT Form
20.102), and label such documentation EXHIBIT C.
J If the City performs any work on the Project through a
ontractor or contractors selected through the City's low-bid
procedure, the City shall require its contractor or contractors
to furnish the State with a completed certificate of Insurance,
(SDHPT Form 20.102), and shall insure the contractor or
contractors maintain such insurance during the term of the
Agreement.

ARTICLE 11. Gratuities.
state Department of Highways and Public Transportation
Commission policy mandates that employees of the Department shall
not accept any benefits, gifts or favors from any person doing
business or who reasonably speaking may do business with the
State under this contract. The only exceptions allowed are
ordinary business lunches and items that have received advanced
written approval of the State Department of Highways and Public
Transportation Engineer-Director. Any person doing business with
or who may reasonably speaking do business with the state under
this contract may not make any offer of benefits, gifts or favors
to Departmental employees, except as mentioned hereabove.
Failure on the part of the City to adhere to this policy may
result in the termination of this contract.
ARTICLE 12. Termination.
This Agreement may be terminated by any of the following
conditions:
A. By mutual agreement and consent of both parties.
B. By either party upon thirty days written notice to the
other party.
C. By either party, upon the failure of the other party to
fulfill its obligations as set forth in this Agreement.
D. By satisfactory completion of all services and
obligations described herein.
Should the City terminate this Agreement, as prescribed
hereabove, the City shall, at the option of the State, reimburse
any reasonable costs incurred by the State.

SUMMARY & RECOMMENDATION
staff has completed its review of HL&P request to secure an
easement from the City for a 138kv electrical transmission line
along the south edge of Blocks 475 and 474.
In an effort to work with HL&P the City has reached an agreement
that for this transaction to take place certain conditions for
future growth should be considered by HL&P. I'm happy to report
that HL&P and the City have reached an understanding.
The attached documents describe our partnership to move forward.
HL&P has agreed to pay the City of La Porte $36,650 for the value
of the easement as well as pay $29,000 for their portion of the
cost associated with the de-commissioning of blocks 475 and 474 as
park land.
Action Required by council:
Approve Ordinance NO.1,764 contingent upon obtaining $36,650
from HL&P for payment of the easement needed for their
transmission facility, plus receiving $29,000 check for their
portion of the City's efforts towards the de-commissioning of
blocks 475 and 474. In exchange, the City will deliver a
signed easement and certified copy of Ordinance No. 1764
approving same.

Dear Bob:
At your request, I have examined proposed easement from the City of
La Porte to Houston Lighting & Power Company, for a 138KV electrical
transmission line, being a 50 foot wide electrical transmission
right-of-way along the south edge of Blocks 475 and 474, Town of La
Porte, Harris County, Texas, for Houston Lighting & Power Company to
serve Tenneco.
The terms of the easement are set out in letters dated April 4, 1991
and April 5, 1991, from Houston Lighting & Power Company to the City
of La Porte. I have spoken with Mr. Clayton L. Williamson, Land
Agent for Houston Lighting & Power Company, about the proposed
easement. Although there have been extensive discussions between
the City of La Porte, Houston Lighting & Power Company, and Southern
Pacific, concerning the alignment of the Houston Lighting & Power
Company easement, and Southern Pacific spurs across the easement
arla, the Houston Lighting & Power Company proposed easement is in
st ndard form, and does not show, on the map attached thereto, the
po itioning of the Houston Lighting & Power Company poles and
equipment, nor does the easement language confine Houston Lighting &
Power Company in any way as to pole location. The easement does
provide that the City reserves the right to "extend railroad spur
tracks, roads or streets and fences across, but not along the
easement...conveyed." City or railroad facilities cannot be closer
than 12 feet to any of Houston Lighting & Power Company's "then
existing structures." Further, the easement document provides that
the City would have to first seek Houston Lighting & Power Company
approval of plans and specifications for proposed crossing and the
location thereof.
There is easement language to the effect that the spurs must cross
the easement, and not parallel the easement. In conversation with
Mr. Williamson to obtain clarification of this language, he said
this language was intended to prevent streets or railroad tracks to
parallel the easement, within the 50 foot easement strip. I see no
objection to this requirement. In other words, the proposed
railroad spur which would go west on "H" Street, could be
constructed in the remaining former right-of-way of "H" Street,
without impeding the easement.

In summary, the easement is in typical form, and I have no objection
to the basic easement language. My preference would have been to
have an easement where Houston Lighting & Power Company exactly
delineates the location of its proposed facilities, and,
simultaneously with the execution of the easement, have Houston
Lighting & Power Company approve the plans and specifications for
the exact planned Southern Pacific spur crossings. However, in
conversation with Mr. Williamson, Houston Lighting & Power Company
is willing to do neither. Therefore, other than the quoted language
from the easement, allowing Southern Pacific spurs to cross, with
approval of Houston Lighting & Power Company, there is no written
agreement between the City and Houston Lighting & Power Company, on

facilities within its easement, and also future placement.
Iihave enclosed proposed form of ordinance for your use in placing
tis easement on a City Council agenda for consideration and
aproval by City Council. The recent letter from Texas Parks &
Wildlife to your office, indicates conditional approval to the City
to enter into the easement agreement with Houston Lighting & Power
Company at this time. The City should obtain the checks for the
payment of the value of the easement, $36,650.00, as well as the
$29,000.00 check for acquisition of substitute parkland, in exchange
for delivery of the signed easement and certified copy of ordinance
approving same.

Enclosed please find a letter from the Texas Parks & wildlife
Department to the city of La Porte dated June 4, 1991.
The correspondence speaks favorably to our request to release a
grant commitment from the Texas Parks and Wildlife Department and
has given us conditional approval from the commission so we can
work with Houston Lighting and Power Company's need to develop a
138 kv transmission line.
As you are aware, any time a public agency requests to de-
commission a park site that was enhanced with federal funds, the
public agency must meet and fulfill some very complex legislation.
It's refreshing to know that the Texas Parks & Wildlife Department
is supporting our request which we made on your behalf, and the
development of property located within our northeast quadrant. As
we have discussed and reached agreement on, we can only complete
this transaction by replacing the property de-commissioned (6.0
acres mini-bike park) with substituted land of like recreational
value.
The associated cost to complete this land conversion is estimated
to be $87,000. This amount includes property acquisition, surveys,
land appraisals (2) and some attorney fees.
Verbally on June 3, 1991, you committed that HL&P would participate
in the conversion cost up to an amount of $29,000 which is 1/3 of
the estimated project. The City agrees to match an additional 1/3,
and we are currently completing negotiations with the property
owner to the south of the mini-bike park for a 1/3 contribution.
Please keep in mind this conversion process and de-commission
element is separate and above the proposal submitted by HL&P to
the City on April 4, 1991, to secure a 50' easement that would run
east to west across the southern edge of the mini-bike park.

release the grant commitment to the Mini Bike Park project site.
We have reviewed your substitution proposal and concur that it
results in a greater recreation benefit to your citizens than the
Mini Bike Park site. Other administrative requirements must be met
to complete the conversion and substitution process, but in the
interest of expediency of allowing the use of the Mini Bike site for
the transmission line, we are granting conditional approval for the
conversion.
The staff of our Grants-In-Aid Branch will be contacting you to
request further information to complete the substitution. Approval
of the conversion is conditioned upon La Porte meeting all
requirements of the enclosed Guidelines for Conversion. This may
mean the requirement to prove equivalence of appraised value for the
substitution site when compared with the converted park. Approval
is also cont i ngent upon acceptance of the subst itut i on by the
National Park Service.

Dear Mr. Herrera:
As we have previously discussed, Houston Lighting & Power
Company is preparing to construct a l38KV electrical transmission
line in the LaPorte area. This line will enable a major industry
in the LaPorte area, Tenneco, to build a new manufacturing
facil i ty . Enclosed is a letter that explains the entire proj ect in
greater detail and summarizes its benefits to the LaPorte area.
In order to construct this project, it will be necessary for
Houston Lighting & Power Company to secure an easement from the
City of LaPorte. This easement will be 50-feet wide and would
contain 27,312 square feet of land. The easement would run east to
west across the southern edge of Blocks 475 and 474 within the city
limits of the City of Morgan's Point. Enclosed is the proposed
easement instrument for your review. This instrument contains
language that addresses the City of LaPorte's desire to be able to
cross the easement with improvements such as streets, rail, and
utilities.
This easement is off-set 15-feet north of the property line
for two reasons. First, it will keep the transmission line in a
straight pattern and eliminate the need of setting an additional
pole in street right-of-way just to the west of the City's
property. secondly, by allowing this strip to remain unencumbered,
the Southern Pacific Transportation Company will be able to work
wi th the City of LaPorte in extending a spur track across the
property and continue westerly into the city of LaPorte should rail
be necessary for any future industry locating in this vicinity.
Houston Lighting & Power Company has established through an
independent appraisal that the value of this 27,123 square foot
easement is 75 percent of the full market value of $1.35 per square
foot, which amounts to $27,653.40. It has further been determined

by the independent appraisal that the $1.35 per square foot full
value of the 15-foot wide strip of city property south of the
easement will be adversely impacted by 75 percent. Since this 15-
foot wide strip contains 8,879 square feet of land, a compensation
of $8,989.99 is the monetary figure applicable for this negative
impact. Therefore, Houston Lighting & Power company hereby offers
to pay the city of LaPorte the sum of $36,650.00 as full
compensation in this matter.
It is requested that the City of LaPorte review this proposal,
and if it is acceptable, we ask that the easement grant process be
initiated by the City as soon as possible.

facilities," located at, below and above ground level on, over, under, and
across the following described lands, to wit:
Lots 16 and 17 in Block 474 and Lots 16 and 17 in Block 475 of the
Nebraska Syndicate, a subdivision out of the Johnson Hunter League,
Abstract 35, Harris County, Texas, according to the map or plat
thereof recorded in Volume 83, Page 345 in the Deed Records of Harris
County, Texas, being that same property described in deeds to the City
of La Porte, recorded in Volume 851, Page 544, Volume 7515, Page 455
and Volume 7829, Page 263 in said Deed Records, and including that
portion of North "H" Street (closed), located southerly of and
adjoining said lots.
The easement herein granted is fifty (50) feet wide, the location of
which is shown by the crosshatched area on Sketch No. 90-043A, hereto

railroad spur tracks, roads or streets and fences across, but not along the
easement herein conveyed, also the right to extend public utilities on said

communication facilities and appurtenances"; (2) to remove all trees and shrubs
from said easement and to cut and trim all limbs of trees that aerially intrude

THAT LA PORTE REMAIN WHOLLY WITHIN HARRIS COUNTY COMMISSIONERS
PRECINCT TWO
WHEREAS, the city of La Porte and Harris County Precinct Two
have always maintained a good working relationship; and
WHEREAS, Harris County Precinct Two has always been responsive
to the needs of the city of La Porte; and
WHEREAS, Harris County Precinct Two has developed a very
successful program for Senior citizens which would be in jeopardy
if La Porte was divided between two or more Harris County
commissioner Precincts; and
WHEREAS, the City of La Porte is currently involved in joint
projects with Harris County Precinct Two, and are working together
on planning their futures; and
WHEREAS, economic development and bay development are two
important issues of joint cooperation between La Porte and Harris
county Precinct Two; and
WHEREAS, any plan that would remove the City of La Porte from
Harris County Precinct Two would be detrimental to the development
of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE:
section 1. THAT, for the above stated reasons, it would be
in the best interest of the city of La Porte to remain wholly
contained within Barris County Commissioner's Precinct Two.
section 2. THAT, the.City of La Porte hereby requests that
when Harris County commissioners' precincts are realigned, the city
of La Porte be allowed to remain wholly within Harris County
Commissioner's Precinct Two.

City's participation in the Telephone Franchise Steering Committee.
If you will recall, information was received from the Telephone Franchise
Steering Committee that indicated the phone company had recently approached
several cities with their version of a franchise agreement. As a result, the
Texas Municipal League felt the proposed agreement could be best reviewed,
section by section, by a Committee representing a large group of cities.
The resolution that was passed in April did not obligate the City to any
payment. It did state that it was anticipated that a pro-rata fee might be
assessed by the Telephone Franchise Steering Committee.
On May 22, 1991, we received the attached letter which asks for a pro-rata fee
of $.01 per capita or $279.10 for the City of La Porte. Payment of said fee
will not obligate the City to any further payments. Any further requests for
funds would be brought to Council's attention.
The Telephone Franchise currently provides $100,000 of revenue to the General
Fund. Staff believes that any changes in the franchise, whether it affects
our fee rate or our responsibilities, should be heavily evaluated.

MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, The City has a public responsibility to protect the public
rights-of-way and easements and to require the telephone company to assume
certain duties and responsibilities regarding such easements and rights-of-way
by means of responsible terms and conditions in a franchise ordinance; and
WHEREAS, a steering committee of Cities could share information, develop
a model ordinance, obtain special legal and auditing counsel and provide
further assistance to the member cities in the adoption of franchise
ordinances with the telephone utility company;
Whereas, the City has shown it's support of such a committee with a prior
resolution;

Section 1. That the continued participation by the City in the Telephone
Franchise Steering Committee is hereby approved.
Section 2. The City agrees to pay a one time assessment of one cent
(.01) per capita or two hundred seventy-nine dollars and ten cents ($279.10)
for use by the Telephone Franchise Steering Committee. Such funds shall be
used for the sole purposes stated above.
Section 3. The City Council officially finds, determines, recites and
declares that a sufficient written notice of the date, hour, place and subject
of this meeting of the City Council was posted at a place convenient to the
public at the City Hall of the City of La Porte, Texas for the time required
by law preceding this meeting, as required by the Open Meeting Law, Article
6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has
been open to the public as required by law at all times during which this
resolution and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
Section 4. This resolution shall be in effect from and after its passage
and approval.

Telephone Franchise Steering Committee
We have received your resolution, responding to our memo of March 18, indicating
an interest in the work of the Telephone Franchise Steering Committee. Nearly 200
cities responded with resolutions ltke yours.
A number of cities have recently received a packet of material from Southwestern
Bell Telephone Company (SWB) concermng what SWB proposes as a new
approach to municipal fees for use of public rights-of-way. Included in the packet is
SWB's proposed ordinance. Also, in April, SWB agreed with at least one Texas city
to enter into an agreement similar to the one in the packet which SWB has been
distributing to cities.
The Committee believes that as a first step, a section-by-section legal analysis of
SWB's proposed ordinance would be beneficial to all the cities that received the
packet and to those who will get them in the future. The Committee also believes
that a comparison of the terms of the proposed ordinance to the recent ordinances
already adopted by SWB would also be beneficial. The Committee has engaged the
law firm of Lloyd, Gosselink, Fowler, Blevins & Mathews, P.C. to perform the legal

The Committee believes that a sufficient fund for the legal analysis could be created
by an assessment of one cent ($.01) per capita from the interested cities, with a
minimum payment of $50.00. TML will act as a manager of the fund. TML will
establish an account for the money collected and will make disbursements as
requested by the Steering Committee.
If you wish to participate and receive the analysis, please send to TML an amount

SUMMARY & RECOMMENDATION
Summary:
The City's Dangerous Building Board of Inspection has
identified 17 buildings which under the terms of Ordinance 1145
appear to be dangerous and condemnable. Reports regarding these
buildings will be presented to City Council. Council will be
asked to authorize a public hearing to consider condemnation of
these buildings. The condemnation hearing will be held at a
later date. Prior to this hearing, public notice will be
published as well as being mailed to the owners of affected
structures.
Although funds have been budgeted for demolition of
structures, the cost of demolition is likely to exceed $23,500,
the amount currently budgeted. Staff's intent is to break
demolition into two phases with the second phase being funded
from the Fiscal Year 1992 Budget, if approved.
Recommendation:
Authorize a condemnation hearing to consider demolition
of all 17 of the targeted structures.
Action Required by Council:
1) Review reports on structures being considered.
2) Authorize a condemnation hearing for each of the
structures to be considered for demolition.

SUMMARY & RECOMMENDATION
On June 17, 1991, the City opened bids for the reconstruction of
curbs and sidewalks and the construction of wheelchair ramps on
Main street between Broadway and 2nd Street. Four contractors
picked up the plans and specifications for the project and one
contractor, Royalty Construction, submitted a bid in the amount of
$28,490. Royalty Construction also submitted alternate bid in the
amount of $1200 for the concrete coloring an pattern stamping of
the corners where the wheelchair ramps will be located.

The Bidder, in compliance with your invitation for bids for the construction of ~1ain
Street Sidewalk and Curb Replacement and Corner Wheelchair Access Ramps for the City
of La Porte having examined the plans and specifications with related documents and the
site of the proposed work, and being familiar with all of the conditions surrounding the

proposes to furnish all labor, materials and supplies and to construct the project in
accordance with the contract documents, within the time set forth therein, and at the prices
stated in the attached Bid Schedule. These prices are to cover all expenses incurred in

part.
Bidder hereby agrees to commence work under this contract on a date to be
specified in written "Notice to Proceed" of the Owner and to fully complete the project

On March 19, 1991, a City of La Porte police patrol car was
involved in an accident on 8th Street. A pick-up truck ran a
stop sign and the patrol car ran into the side of the truck.
The owner of the truck has refused to accept full responsibility,
thus causing the City to subrogate the claim.
In the interim, the Police Department is without a vehicle.
Three estimates were received to repair the vehicle with Joe Camp
Ford being low at $6,975.43.
Staff recommends having the vehicle repaired by the low

In trying to resolve the liability issue, I made numerous calls
to the local Hoechst Celanese plant (Bayport Works), their
headquarters in New Jersey, their claims office in Dallas, and
their adjuster in Houston. On May 24, the adjuster told me that,
according to witness statements they had, the driver of the pick
up truck was not entirely at fault and they would not pay any
claims at this time and that I should seek subrogation in the
matter.
I spoke with Richard Evans at TML and found that since the City
did not carry auto physical damage (APD) coverage, TML would not
be able to subrogate. They would, however, subrogate the
worker's compensation claim our officer had. I then called Knox
Askins who advised that after the repairs are made, the City can
seek subrogation on those costs.
Shortly after the accident, the City obtained three repair
estimates. Joe Camp Ford submitted the low estimate at
$6,975.43. Les Marks Chevrolet estimated damages at $7,653.31,
and Lindsey & Newsom (Hoechst Celanese's adjuster) estimated
$8,022.05. This expenditure must be approved by City Council and
I will take this item to the meeting scheduled on June 24.
Since the Police Department has been without this vehicle since
the accident, I have instructed the Equipment Services Division
to proceed with the repair through the low bidder to alleviate
any further delay. I also spoke with Jeff Litchfield about the
expenditure and he advised to charge this repair through vehicle
maintenance and any recovered funds would be placed back into the
account as revenue.

Gulf States Materials in the amount of $11.00 per ton delivered. Using
yearly quantities this contract would be worth $9,900.00.
Staff recommends award of bid for delivered cement stabilized sand to
Highlands Stabilize in the amount of $12.25 per ton. Staff further
recommends award of bid for 7% cement stabilized utility bedding to Gulf
States materials in the amount of $11.00 per ton delivered. After award, a
price for materials picked up by City employees and equipment will be
negotiated.
Action Required by Council:
Award bid for cement stabilized sand to Highlands stabilize for a delivered
price of $12.25 per ton and the bid for 7% cement stabilized utility
bedding to Gulf States Materials for a delivered price of $11.00 per ton.

Advertised, sealed bids #0431 for cement stabilized sand and
7% cement stabilized utility bedding were opened and read on June
17, 1991. Bid requests were mailed to seven area suppliers with
five returning bids.
Low bid was submitted by Highlands Stabilize for the cement
stabilized sand. Using yearly estimates, the total cost would be
$11,025.00. Gulf States Materials was low bid for the 7% cement
stabilized utility bedding. Using yearly estimates, the total cost
would be $9.900.00. The total cost of both contracts combined
would be $20~925.00.

SUMMARY & RECOMMENDATION
Advertised, sealed bids #0432 for the supply of concrete were opened and
read on June 17, 1991. Bid requests were mailed to eight (8) area
suppliers with four (4) returning bids.
Low bid meeting specifications was submitted by Dorsett Brothers Concrete
Supply, our present supplier, in the amount of: 5-sack = $46.00 per cubic
yard; 6-sack = $49.00 per cubic yard. Using estimated yearly quantities,
the total cost of the contract would be twenty-three thousand, seven
hundred, and fifty dollars ($23,750.00).
Staff recommends award of bid for the supply of concrete to Dorsett
Brothers Concrete Supply, low bidder meeting specifications. It is further
recommended a contingency contract for the supply of concrete be awarded to
Houston Shell and Concrete, second low bidder meeting specifications.
Action Required by Council:
Award bid for supply of concrete to Dorsett Brothers Concrete Supply, low
bidder meeting specifications with a contingency contract to Houston Shell
and Concrete, next low bidder meeting specifications.
