MINUTES OF THE SPECIAL CALLED MEETING OF LA PORTE CITY COUNCIL
AND JOINT WORKSHOP MEETING OF THE LA PORTE CITY COUNCIL
AND THE LA PORTE FIRE CODE REVIEW COMMITTEE
JULY 15, 1991
1. The meeting was called to order by Mayor Malone at 6:00 P.M.

2. Council considered an ordinance authorizing agreement between
the State Department of Highways and Public Transportation and
the City of La Porte for construction, operation, and
maintenance of traffic signals.
Assistant City Manager John Joerns reviewed the ordinance for
Council.
Motion was made by Councilperson Skelton to adopt Ordinance
1765 with the amendment that the Mayor be authorized to
execute the document rather than the City Manager as named in
the ordinance. The motion died for lack of a second.
The Mayor read the ordinance caption, as follows: ORDINANCE

Mgt' ~ ^*+ was made by Councilperson Skelton to adopt Ordinance
1765 as read by the Mayor with the amendment that the Mavor
hp authorized to execute the document rather than the City
Manager as stated in the ordinance. Second by Councilperson
Cooper. The motion carried, 7 ayes and 0 nays.
Ayes: Councilpersons Sutherland, Cooper, Thrower,
McLaughlin, Skelton, Clarke and Mayor Malone
Nays: None
3. The special called meeting was adjourned and the joint
workshop was called to order.
4. Fire Marshal Paul Hickenbottom introduced members of the Fire
Code Review Committee who were present. He then reviewed the
proposed amendments to the La Porte Fire Code, including
showing slides and videos of various aboveground fuel storage
tank systems.
At the conclusion of Mr. Hickenbottom's presentation, Chairman
of the Fire Code Review Committee Delbert Walker addressed
Council to recommend that Council approve these proposed Fire
Code changes and to place the item on the next agenda for
action.
During the presentation, Mayor Malone left at 7:17 P.M. to
attend another meeting; he turned the meeting over to Mayor
Pro Tem Bob McLaughlin.
Mayor Pro Tem McLaughlin asked if placing the item on the July
22 agenda was amenable to the Council. They indicated that
it was, and Mayor Pro Tem McLaughlin stated that we will work
on getting it on the next agenda.
5. There being no further business, the meeting adjourned at 7:32
P.M.

SUMMARY & RECOMMENDATION
The State Department of Highways and Public Transportation (SDHPT) delivered
the Project Title Sheet for the Spencer Highway Reconstruction (SDHPT/PASS
Program) Project and an Agreement for Construction, Operation, and
Maintenance of Traffic Signals. The SDHPT requests La Porte's signature on
the Project Title Sheet, indicating concurrence with .the project plans, and
execution of the Traffic Signal Agreement.
The Agreement for Construction, Operation and Maintenance of Traffic Signals
replaces existing arrangements for traffic light ownership and maintenance.
Per the agreement, the SDHPT will install and own and the City will operate
and maintain the following traffic signals:
Signalized Intersections
1. Spencer Highway at Myrtle Creek Street
2. Spencer Highway at Valley Brook Street
3. Spencer Highway at Sens Road
4. Spencer Highway at 16th Street
School Zone Flashers
1. Spencer Highway at 879 feet West of Myrtle Creek Street
(Southside)
2. Spencer Highway at 173 feet East of Myrtle Creek Street
(Northside)
3. Spencer Highway at 323 feet West of Farrington Street
(Southside)
4. Spencer Highway at 572 feet East of Farrington Street
(Northside)
5. Spencer Highway at 717 feet West of 16th Street (Southside)
Staff reviewed the agreement and found that it does not substantially alter
existing conditions. The City currently maintains these same signals.
Action Required by Council:
Approve Ordinance No. 1765 authorizing an agreement between the SDHPT and the
City for Construction, Operation and Maintenance of Traffic Signals.

AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE
STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION AND THE CITY
OF LA PORTE, FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF
TRAFFIC SIGNALS (1988-92 PASS PROGRAM); MAKING VARIOUS FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes the
contract, agreement or other undertaking described in the title of
this ordinance, in substantially the form as shown in the document
which is attached hereto and incorporated herein by this reference.
The City Manager is hereby authorized to execute such document and
all related documents on behalf of the City of La Porte. The City
Secretary is hereby authorized to attest to all such signatures and
to affix the seal of the City to all such documents.
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

Dear Mr. Joerns:
This follows your discussion with Mr. Stephen Gbur, P.E. on June 20, 1991 and
July 1, 1991. we are transmitting the original project title sheet which
requires signature by the City of La Porte for concurrence with the proposed
project plans. A copy of the plans,. specifications, and estimate has
previously been furnished.
The signature on the title sheet will also consent to the construction of the
highway traffic signal installations being part of "Agreement (Traffic
Signal-City)". The four attached original signal agreement forms for the
signal installations to be maintained by the City of La Porte must also be
executed. The four executed agreements must be returned for execution on
behalf of the State.
Also, accompanying this transmittal is a copy of the latest project agreement
estimate. The estimate shows that the City of La Porte's participation is
$562,226.58. An escrow agreement is currently being prepared by our
headquarters in Austin and will be forwarded for signature when available.
The escrow agreement is for the cost of the City of La Porte's water line and
sanitary sewer line adjustments for this project. The agreement w nt as

previously discussed. The first will be due upon execution of the escrow
agreement, the second will be due 90 days after execution of the agreement, and
the final payment will be due 180 days after execution of the agreement. The
escrow agreement will soon be forwarded for execution•by the City of La Porte.

THIS AGREEMENT, is made by and between the State of Texas, acting
by and through the State Department of Highways and Public
Transportation, hereinafter called the "STATE", and the City of
LaPorte, Harris County, Texas acting by and through its duly
authorized officers under an Ordinance, passed the day
of , 19_, hereinafter called the "CITY".
W I T N E S S E T H
WHEREAS, the CITY has authorized the installation of traffic
signals by Ordinance, passed on the day of
19 , at the location(s) shown on EXHIBIT 1,
attached hereto and made apart hereof; and
WHEREAS, on the 28th day of June 1988, the State Highway and
Public Transportation Commission passed Commission Minute Order
No. 87495 adopting the 1988-1992 Urban System/Principal Arterial
Street System Program (Major Urbanized Areas) authorizing the
STATE to install highway ,traffic signals in metropolitan areas
with a population of 200,000 or more and in cities with a
population under 200,000 (Non-Major Urbanized Areas); and
WHEREAS, the STATE wishes to cooperate with the CITY in the
installation of the traffic signal(s) at the location(s) shown on
EXHIBIT 1;
A G R E E M E N T
NOW, therefore, in consideration of the premises and of the
mutual covenants and agreements of the parties hereto to be by
them respectively kept and performed, as hereinafter set forth,
it is agreed as follows:
1. This agreement shall apply to all highway traffic signal
installation(s) at the location(s) identified in EXHIBIT 1
approved by both the State and the CITY. The CITY will indicate
its approval by having the signature of the MAYOR on the plan
title sheet for such installation. Highway traffic signal
installation(s) made part of this agreement shall contain on the
title sheet the following statement:

9. This agreement shall bind, and shall be for the sole and
exclusive benefit of the respective parties and their legal
successors. The CITY shall not assign or transfer its interest
in this agreement without written consent of the STATE.
10. To the extent permitted by law, the CITY shall indemnify and
save harmless the STATE, its employees, agents and officers, from
all claims and liability due to activities of itself, its agents,
contractors, officials or employees, performed under this
agreement and which result from an error omission, or negligent
act of the CITY, its agents, contractors, officials or employees.
The CITY shall also save harmless the STATE, its employees,
agents, contractors or officials from any and all expenses,
including attorney fees which might be incurred by the STATE in
litigation or otherwise resisting said claim or liabilities which
might be imposed on the STATE as the result of such activities by
the CITY, its agents, contractors, officials or employees.
11. All notices to either party by the other required under this
agreement shall be delivered personally or sent by certified or
registered U. S. Mail, postage prepaid, addressed to such party
at the following respective addresses:

the parties hereto and supersedes any prior understandings or
written or oral agreement between the parties respecting the
within subject matter.
13. This agreement shall become effective upon the
execution by the STATE and shall terminate upon the

SECTION 2. The fact that the improvements contemplated under the
above mentioned agreement are needed, creates and emergency which for
the immediate preservation of the public peace, health, safety, and
general welfare requires that this Ordinance take effect immediately
from and after its passage, and it is accordingly so ordained.

voted to make the seven attached proposed changes.
NOTE: The Committee meeting notes for June 20, 1991,
and July 1, 1991 are attached.
The Committee respectfully requests a meeting with the
City Council so that the seven proposed changes can k~e discussed.
If after discussion and review, the Counci]. agroes to the Code
changes, the Committee requests that the Code changes be adopted
at the next scheduled regular Council meeting.

Dear Paul:
The La Porte Municipal Airport Advisory Board, at the May 8, 1991
meeting, directed me to request the La Porte Cire Code Review
Committee to consider amending the Cire Cocle to allow 1-.he
installation of above-ground storage of aircraft fuel. The
upcoming deadlines for underground fuel tanks, and the cost of
retrofitting or replacement o.f these fac.i.l i_i:ies, as well as
environmental concerns could directly impact airport operations.
I will be happy to attend any meetings of the Committee to present
the Advisory Board's position on this rnatter, as well as assist in
any way I can. If I can answer arty questions, please give me a.
call.

storage facilities at La Porte Airport are under an EPA mandate to
remove and inspect their tanlls for leakage by October 26, 1991.
Currently, the La Porte fire code allows for the storage of
aviation fuel at the airport in underground facilities only. This
leaves FBO's with only two choices:
1. Replace their tanks following the EPA guidelines
or
L. Close their- doors and move to an airport that allows
above ground storage (such as Ellington Field).
The cost associated with the first option world be so great as to
be prohibitive. This leaves the second option, which is not a good
one for La Porte or- these operators.
"therefore, the Airport Advisory Board world like the Fire Code
Review Committee to consider- a third option:
The storage of aviation gas and jet f!rel in above ground
facilities at the airport.
We recommend that the La Porte fire code be changed to follow the
National Fire Code which establishes minimum guidelines for the use
o-f above ground storage fiacilities at airports. As an additional
safeguard, the Federal Aviation Administration m~_rst approve the
physical location of the tanks on the airport as v~ell as approving
the tanks construction.
6Je feel the use of above ground tanks are safe, and allooving their
use is vital to the future development and use of the airport.
If this committee finds it desirable, we can arrange to have a
representative from EXXON explain their system to you at a future
date.

This letter is in regards to I.3.F.I.'s request, (SEE ATTACHED
LETTER DATED MAY -22, 1991), to be allowed to temporarily install
aboveground, (without the required fire protection system), One
(1) ten thousand gallon, (diesel fuel), storage tank, at your
facility, located at 1700 North "E" Street in La Porte.
Upon recei"pt of this :latter, B.F.T. is hereby granted
permission to temporarily, (not to exceed 180 calendar days), to
install aboveground, one (1) ten thousand gallon, (diesel fuel)
storage tank,(without the required fire protection system), at
your facility in La Porte.
This approval is sub~ec~t to review by the Fire Code Review
Committee, depending on the decisions made by this committee in
its upcoming review of the complete fuel storage issue and how it
relates to the currei~~ Fire Code requirements.
Other than the fire protection system, the complete i:~uel
storage system must meet the La Porte Fire Code Article 16 anc'/or
N.F.P.A. $30 requirements, which ever is more stringent.

accessible in case of fire or physical damage to any dispensing
unit, shall be provided to shut off power to dispensing units.
(c) Flammable and combustible liquids shall be dispensed
or transferred from tanks by means of approved pumping de~~.:es
so designed and equipped as to allow control of Che flow end to pre-
vent leakage or accidental discharge. A control shall bc: provided
that will permit the pump to operate only when a dispensing nozzel
is removed from its bracket on the dispensing unit, and tine switch
on this dispensing unit is manually activated. This control
shall stop the pump when all nozzles have been returned to their
brackets. Where viscosity of the liquid prohibits use c` pumps,
gravity flow may be used provided suitable additional Safety controls
are installed in accordance with recognized standards and approved
by the fire marshal or his designated representative.
(d) An approved safety device shall be installed at i.:~e base
of each flammable liquid dispenser to adequately control flow of
such liquids in event of accidental displacement of any dispensing,
equipment and such safety device shall be maintained in proper
working condition at all Cimes.
In suction-type systems, the safety device may consist c,f
an approved shear section or equivalent in the supply line.
(e) Emergency power cut-off. A clearly identified and
easily accessible swir~h(es) or a circuit breaker(s) shall he
provided at a location remote from dispensing devices to shut
off the power to all dispensing devices in the event of an
emergency.
DIVISION 5: BULK PLANTS
Sec. 16.26 Prohibited in Fire Zone 1,2, and 3.
No bulk plant shall be constructed within Che limits
established by law as Fire Zones 1,2, and 3.
Sec. 16.27 Storage of flammable or combustible liquids.
(a) Storage of flammable or combustible liquids in t~~~lk
plants outside of Fire Zones 1,2, and 3 shall, in addition to com-

plying with the provisions of this division, comply with the
applicable provisions of Divisions 2 and 3 of this article.
(b) Class I. Class i flammable liquids ~..".ull be stored in
underground storage tanks as per thie article.
(c) Class II and III. Class II and III liquids can be stored
in either aboveground or underground storage tanks as per this
article.
(d) Containers of Class I flammable liquids oI' any size --
shall be prohibited within the bulk plant yard or within buildin@:s,
aboveground.
(e) Containers of combustible liquids stored in buildings
when pled one upon the other shall be be separated tc provide
stability and to prevent excessive stress on co~~*ainer walls. The
height of piles shall be consistent with stability and stren€:th
of containers. In no case shall nominal fifty-five (55) gallon
drums be stored over three (3) tiers high.
Containers of combustible liquids stored in bulk plant yards
when piled one upon the other shall be separated to provide stability
and to prevent excessive Stress on container walls. The height
of ^iles shall be consistent with stability an;: strength of (j
containers. In no case shall nominal fifty-five (55) gallon drums
be stored over three (3) tiers high, with a tout of drums not
to exceed twenty-five (25) for any bulk plant yaro.
(f) The outside stora~~e of empty portable tanks and drums pre-
viously used for the storage of flar.!mable and combustible liquids
shall be in accordance with Section 16.60 and 15.61 of this code.
Sec. 16.?.8 Construction of buildings in'which combustible
liquids are stored.
(a) Buildings shall be constructed ~o that rooms in which
combusti~~le liquids are stored. comply with the requirements of
the building code. Class II or III combustible liquids
shall not be stored or handled within a building having a base-
ment or pit.
(b) Rooms storing combustible liquids shell have exit.:

~tJo permit shall be issued for the construction or operation
of a chemical plant, distillery, refinery or plan storing or
handlinp• crude petroleum until approval has been given for the
operation with respect to topography, nearness to places of assembly
residential or mercantile occupancy, and adequacy of water supply
for fire control.
(a) A minimum of ene hundred (100).feet separation sh~:ll
be maint?.ined from any builr?~ng not a part of such
refinery or chemical plant unless appro:a3 in writing
by the fire marshal.
(b) A minimum of three hundred (300) feet from any insti-
tution or place of assemblage.
(c) .4o building .;r apparatus in which flammable va5ors may
be accumulated or discharged shall be erected within
(1) One hundred (100) feet of any oil yell, tank,
boiler, o en flame or other permanent source of
ii;nition, except internal combustion engines used
in connection in~ith compressors, pumps or other
equipment necessary for process,
(2) Fifty ($O) feet of any public sC~~eet, alley,
or property line.
Sec. 16.81 Storae~e of flammable or combustible liquids to be
in either aboveground or under~.round tanks.
Flammable liquids shall be stored in tanks under;round in
accordance ~:~ith Division 3 of this article. Combustible liquids
shall be stored in tanks either aboveground or u~~derground in accord-
ance with Division 2 or 3 of this article.
Sec. 16.$2 Location of tanks.
Tanks for the storage of flammable or combustible liquids in
tank farms and in locations other than process areas shall be lo-
cated in accordance v:ith Division 2 of this article.

After review and discussion of the request, the committee
approved the following Faire Code change dealing with the

The storage of combustible liquids in aboveground tan)cs
shall be prohibited in Fire Zones 1 & 2.
RE-WRITE SUB-SECTION B TO READ:
The storage of combustible liquids in aboveground tanks
shall be as per N.1~'.P.A. #30 requirements, or other
Fire Code Review Conunittee approved storage systems.
The following provisions; of this section shall apply
except where conflicts exists, the more restrictive
shall apply.
The reasons for the above changes are as follows:
1. To make Sub-Section A/ A stand alone sub-section
