The invocation was given by Councilperson Clarke. 3 . Council considered approving the minutes of the regular meeting of Council held August 12, 1991. Motion was made bv Councilperson Coooer to aoprove the minutes of the Auqust 12 meetinq as oresented. Second by Councilperson Thrower. Councilperson Gay stated that the minutes did not reflect what happened at the Council meeting. He stated the following: "The minutes are not correct in the reflection of what happened at the Council meeting, and there needs several corrections made, because I feel that the minutes here will be transferred to the Justice Department and it doesn't reflect the various things that was said at the meeting, which was the motions that was made concerning the re-districting - that is not entered into the meeting - the minutes - at all. Where the proposal was that Mr. Cooper made a motion to amend the minutes - to amend the minutes - to amend of the minutes to reflect a change in the re-districting, and that I made a motion to have a change in the meeting - in the minutes also. So that doesn't reflect at all in the minutes. It doesn't reflect the way that the vote was carried out or any of this nature. So the minutes are not right." e e Minutes, Regular Meeting, La Porte City Council August 26, 1991, Page 2 Councilperson Skelton and others pointed out to Councilperson Gay that pages 7, 8 and 9 of the minutes reflect that all those items were addressed and voted on. The vote was taken, and the motion to adopt the minutes as presented carried, 7 ayes and 1 nay. Nays: Councilpersons Sutherland, Cooper, Thrower, Porter, Skelton, Clarke and Mayor Malone Councilperson Gay Ayes: 4. There were no citizens wishing to address Council. 5. Rick Steward presented the Employee of the Quarter Award for April-June, 1991, to Ronald White. Mr. White was presented with a plaque and appreciation for a job well done. 6. Council considered an ordinance appointing a member of the Board of Directors, Position 3, of the La Porte Area Water Authority, for a term to expire September 1, 1993. Second by Councilperson Porter. The City Attorney read: ORDINANCE 1776 - AN ORDINANCE APPOINTING A DIRECTOR, POSITION 3, OF THE LA PORTE AREA WATER AUTHORITY, FOR A TERM TO EXPI~E SEPTEMBER 1, 1993; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council considered an ordinance authorizing the City to enter into an agreement with the State of Texas for the relocation of utility lines within the Spencer Highway PASS Project and establishing a payment schedule. Second by Councilperson Cooper. Councilperson Porter stated that he would like to go on record as being disappointed in the disparity of what we were told when we signed the Minute Order initially, and what we ended up with. The vote was taken, and the motion carried, 8 ayes and 0 nays. Nays: Councilpersons sutherland, Cooper, Thrower, Porter, Gay, Skelton, Clarke and Mayor Malone None Ayes: 8. Council considered an ordinance authorizing the City to enter into an agreement to contribute funds for the relocation of pipeline crossing Spencer Highway. The City Attorney read: ORDINANCE 1778 - AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE TEXAS DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION AND THE CITY OF LA PORTE, FOR ADJUSTMENT. OF THE CHEVRON AND MOBIL OIL CORPORATION PIPELINES FOR THE SPENCER HIGHWAY PASS PROJECT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. The City Attorney read: ORDINANCE 915-FF - AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-a-J OF ORDINANCE NO. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED NOVEMBER 25, 1975, TO CONSTRUCT. AN 8-INCH PIPE LINE FOR THE TRANSPORTATION OF PROPYLENE; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilgerson Sutherland to adopt Ordinance 915-FF as read by the city Attorney. Council considered an ordinance authorizing the City to enter into a contract with Walsh Engineering Company to provide professional engineering services for the design of utility casings crossing State Highway 225. Thee City Attorney read: ORDINANCE 1779 - AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN WALSH ENGINEERING, INC. AND THE CITY OF LA PORTE, FOR SURVEYING AND ENGINEERING OF WATER AND SEWER LINE EXTENSIONS TO NORTH SIDE OF STATE HIGHWAY 225; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council was to consider an ordinance adopting the 1991 edition of the Standard Building Code package, but the item was requested to be removed from the agenda and placed on the next agenda. 12. Council considered awarding a contract for the demolition of substandard structures. Director of community Development Joel Albrecht announced three changes to the list of buildings to be demolished: 112 North Holmes, 217 South Carroll and 310 North First Street were removed from the list; the first two addresses had been issued demolition permits and the third address had already been demolished. Council is asked to approve awarding the bid to the low bidder, and authorize appropriation of $3500 from the general fund contingency to fund demolition of the remaining buildings. Motion was made by Counciloerson Sutherland to demolish all the houses as listed except items 2. 4. and 9. and to aoorove aoorooriation of $3500 from the aeneral fund continaency. This would protect the City from being involved in any litigation. The vote was taken and carried, 8 ayes and 0 nays. Administrative Reports - Mr. Herrera reminded Council of a memorandum he had sent which reported that staff has completed the review of the proposed personnel policies and it was ready for Council's review, and recommended the appointment of the audit committee to review the pOlicies. He had spoken with Mayor Pro Tem McLaughlin regarding this while the Mayor was out of the city, but had not touched base with him recently. He asked that the review be done as soon as possible so that the policies could be implemented by the first of the year. The Bayshore water tower refurbishing is complete. Council adjourned into executive session at 7:16 P.M. under Section 2(R) (Conference) of V.A.T.S. Article 6252-17 to receive a report on proposed airport improvements. Council returned to the table at 8:20 P.M. 17. There being no further business to come before the Council, the meeting was duly adjourned at 8:21 P.M. He has been employed with the City of La Porte for three years. rtonald's duties consist of performing preventative main- tenance on city vehicles, identifying problems before they become major and making repairs as necessary. An effective PM program requ:res someone that has a good overall knowledge of all city vehicles and can provide the at~ent:on to de:ai~ that results in early detection of potential problems. Rona:d is well suited to this position and has proven himself a valuable asset to this division. Although it is difficult to quantify the savings realized it is safe to say that thousands are saved each year as a result of his performance. The professionalism demonstrated by Ronald i= reflected in every aspect of his duty performance. He is very personable and enjoys an excellent rapport with everyone. His "can do" attitude has earned him the respect of co-workers as well as supervisors. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte hereby appoints Rodney J. Etchberger as Director, position 3, of the La Porte Area Water Authority, for the term expiring September 1, 1993, and until his successor shall have been duly appointed and qualified. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 3. DESCRIPTION OF WORK: (1) From September 1978 to May 1981, I worked in Construction procurement and augmented Small Purchases. As a trainee, I was responsible for ensuring the full cycle of Government procurement and contract administration procedures were incorporated and followed when transferring "need" requirements into executed construction and architect engineering (A-E) contracts. My responsibilities included: 1) reviewing the statement of work, contract drawings and specifications, 2) preparation of IFB's, RFP's, RFQ's, and NDPR's; 3) participation in the evaluation of proposals and bids; 4) development of prenegotiation position memorandums for the A-E contracts and the follow-on to the CPAFcontract for Construction Services; 5) preparation of the final contract document; 6) administered the contracts to insure the complete adherence to the contract terms and conditions as well as compliance with the applicable labor laws and the Davis Bacon wage determinations; 7) served as the section's primary representative on the A-E Selection Board and the Performance Evaluation Committee; 8) participated in unique activities uncommon to normal Government construction developments such as an emergency fix to a sensitive project, invoking a contract provision concerning design responsibil- ity, and a negotiated construction contract; and 9) was assigned to the Television Services Source Board. The work required an extensive knowledge of contracting principles, Government procurement regulations, NASA and JSC procurement policies, and legal requirements. During this period, I advanced from entry level to a competent contract specialist. (2) After leaving JSC in May, 1981 to May, 1984, I accepted a position with the Metropolitan Transit Authority as a Sr. Contract Administrator and was responsible for the u.s. j3oy't .. . e e acquisition and contract administration of all professional, personal, non-professional, A-E construction activities leases, and all state Department of Highways and Public Transportation construction services which used METRO federal funding. Ensured compliance with all METRO contractual re- quirements, and applicable federal, state, and local laws and regulations. Developed and implemented control procedure standards for effective administration of service contracts and standard document formats. Reviewed technical scope and cost estimates and provided project managers, financial, and managerial personnel the training and guidance necessary to effectively manage a project. Chaired the Source Evaluation Committee on all negotiated procurements in excees of $25,000 and reported the findings of such activities to senior man- agement and the appropriate subcommitees of the Board of Dir- ectors for selection. (3) In October 1983 I was appointed as the North Transitway Project Manager wherein my responsibility was to manage and administer a $52 million project for converting the Contraflow Lane to a barrier-protected Authorized Vehicle Lane (AVL). In addition, I continued my procurement responsibilities by administering all METROjSDHPT contracts for AVL environmental impact analysis, study, and design for the Gulf and Katy Freeway AVL's. In each instance, agreements with state agencies were negotiated for use of personnel to serve as Resident Engineers when state right-of-way was involved and METRO was funding the projects. (4) In May 1984, I rejoined NASAjJSC procurement as a contract specialist and continued performing the complete procurement function from the initial stage of procurement planning through the development of the Request for Proposals, the evaluation of 'proposals, negotiation, and the administration of contracts and grants to final closeout. The duties include an extensive range of supply, service, study. facility, and complex R&D procurements. These procurements are usually unique, lack direct precedent, involve dif- ficulty in defining the work to be performed, and require extensive coordination within the Center and agency to meet budget, program, and procurement requirements. During this period, I advanced to a journeyman contract specialist and I was appointed to the Science Payloads Development, Engineering, and operations Source Board as the senior procurement representative. I was promoted to Contracting Officer in July, 1986 and in January, 1989 was selected as the Senior Procurement Ana- lysist assigned to the Procurement Operations Branch. My functions include the comprehensive review of all major pro- curements prior to final approval by the Director of Procure- U.S. Gov'l . . ; e e ment, Center Director, or the Assistant Administrator for Procurement at NASA Headquarters. The reconstruction project extends from Highway 146 to 200' east of willow Springs Bayou. The attached agreement covers the relocation of the sanitary sewer and water lines within the Spencer Highway Right of Way at an estimated cost of $520,526.54 including contingencies and construction engineering. The payment schedule is as follows: $173,508.85 $173,508.85 $173,508.84 upon execution in 90 days in 180 days The total estimated cost for the utility adjustments is reduced by $41,700.00 because the State accepted the City's request to utilize PVC pipe for the sixteen inch (16") water line instead of ductile iron pipe. The application has been reviewed and meets all requirements of Ordinance 915. Staff also reviewed the request in relation to the Comprehensive Plan. The proposed pipeline crosses under several right of ways belonging to Harris County, the state of Texas, Harris County Flood Control and the City of La Porte where future improvements will be made. Applications for permitting these crossings have been discussed with the appropriate agency and as of this date none have been granted. Attached is a list of the crossings where permits are required. Based on past experience, staff would recommend approval to the request of Diamond Shamrock Refining and Marketing Company subject to any future relocation of the proposed pipeline within the City, state or County ROW, be at the total expense of Diamond Shamrock. Diamond Shamrock also would need to provide the City copies of the required permits prior to beginning construction of the pipe line. Action Required by Council: Approve application from Diamond Shamrock Refining and Marketing Company for the construction of an 8 5/8 inch pipeline for the transportation of Propylene subject to any relocation of the pipe line within the City, State or Harris County ROW be at Diamond Shamrock's expense. Section 8-16 of the Code of Ordinances of the City of La Porte is hereby amended, to hereafter read as follows, to-wit: "Section 8-16. Standard Buildinq Code Standard Building Code, heretofore adopted Council of the City of La Porte, be, and the amended to read as follows, to-wit: Amended. Every newly constructed dwelling, and every newly constructed dwelling unit within an apartment house, condominium, townhouse, and every guest room in a hotel or motel, and every basement or cellar within such dwellings, shall be provided with an Underwriters Laboratories, Inc., approved smoke detector, which may be either 120- volt A. C., or battery operated. e e Ordinance No. , Page 3 Detector shall be mounted on the ceiling or wall at a point centrally located in the corridor or area giving access to rooms used for sleeping purposes. In an efficiency dwelling unit, the detector shall be centrally located on the ceiling of the main room. Where sleeping rooms are of an upper level, the detector shall be placed in the center of the ceiling directly above the stairway. All detectors shall be located within twelve (12) inches of the ceiling. Care shall be exercised to insure that the installation will not interfere with the operating characteristics of the detector. When activated, the detector shall provide an audible alarm." Section 9. A new section is hereby added to Chapter 8, Article 2, of the Code of Ordinances of the City of La Porte, said section being numbered 8-17, which is to hereafter read as follows, to-wit: "Section 706.6.1. Outside the Fire District, buildings three stories or less in height or 9,000 sq. feet (for allowable area increases, see 402.3, for horizontal separation modifications) in area located not less than 6 feet from the property line may be roofed with U. L. Listed Fire Retardant Treated wood shingles or shakes or No. 1 and No. 2 U. L. Listed Fire Retardant Treated Southern Yellow Pine taper saw or shakes. Section 10. Section 8-21 of the Code of Ordinances of the City of La Porte is hereby amended, to hereafter read as follows, to-wit: "Section 8-21. General and Building Contractors - Liability Insurance. No permit shall be issued for any general or building contracting work, as said work is defined within the Standard Building Code, 1991 Edition, until the general or building contractor or his employer shall have arranged to carry the following insurance: (a) Workers' Compensation insurance on each and every one of his employees as required and in accordance with the provisions of the Workers' Compensation Act of the State of Texas; (b) Public Liability $50,000.00 for anyone anyone person; and insurance to accident, and the extent of $100,000.00 for (c) Property damage insurance to the extent of $10,000.00 for anyone accident, and $100,000.00 in the aggregate. Such insurance shall be written by an accredited company under the supervision of the Board of Insurance Commissioners of the State of Texas. e e Ordinance No. , Page 4 Evidence of compliance with the above insurance requirements shall be considered as having been met when the policy, a copy thereof, or a Certificate of Insurance has been filed with and approved by the Chief Building Official of the City of La Porte. Such policy shall include an endorsement thereon that the Chief Building Official will be notified at least ten (10) days in advance in the event of the policy or policies being cancelled or expiring before the expiration date of the license." Section 11. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of the Ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section 13. Any person, as defined in Section 1. 02 (27), Texas Penal code, who shall violate any provision of this ordinance, shall be deemed guilty of a misdemeanor and up conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). Each day any violation of this ordinance shall continue shall constitute a separate violation. Section 14. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statues Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. Of the two contractors responding, the overall low bid, in the amount of $32,825.00, was submitted by Ark Wrecking Company. Ark Wrecking has not performed any previous jobs in the City. Staff therefore requested and received references. All information received to date, indicates that Ark Wrecking is a qualified and competent demolition contractor. Funds exist in account 001-902-902-600 to only demolish 7 of the 11 structures. Staff has prioritized the list and are recommending that items 3, 4, 5 and 9 on the bid list be eliminated from demolition this year. The contractor was contacted and has agreed to hold the bid prices for ~ days. This allows 7 structures to be demolished this fiscal year for $21,925.00. The remaining 4 structures would be demolished after October 1, 1991 for $10,900.00. The proposed budget for 1991-92 is $25,000.00 and after the 4 structures were removed a balance of $14,100.00 would remain for next year's demolition project. / Recommendation: to Ark Wrecking this fiscal year after October 1, Approve award of Building Demolition Contract Company allowing 7 structures to be demolished and the remaining 4 structures to be demolished 1991. Bid requests were mailed to five (5) contractors with two (2) returning bids. A bid of $14,999.00 with salvaged material belonging to the City was submitted by Proto Texas with an alternate bid of $11,675.00 with Proto retaining the salvaged material. The other bid was submitted by Proler International in an amount of $27,181.65 with proler retaining salvaged materials. Proler did not submit an alternate bid. Staff recommends award of the alternate bid of $11,675.00 and the salvage materials belonging to the contractor to Proto Texas. Salvage companies were contacted for prices on the salvaged materials to determine if a cost savings would be realized by the City salvaging the materials. Approximately $1,700.00 in revenue would be generated by the City salvaging the materials while Proto Texas is offering a deduct of $3,324.00 for their retaining salvaged materials. Adequate funds for the demolition of the tanks were budgeted in the 90/91 Operating Budget of the Water Production Division.
