MINUTES OF THE REGULAR MEETING AND PUBLIC HEARING
OF LA PORTE CITY COUNCIL
SEPTEMBER 23, 1991
1. The meeting was called to order by Mayor Malone at 6:05 P.M.
Members of City Council Present: ,May Norman Malone,

2. The invocation was given by City Attorney Knox Askins.
3. Council considered approving the minutes of the Regular
Meeting and Public Hearing held on September 9, 1991.
Motion was made by Councilperson Skelton to auprove the
September 9th minutes as presented. Second by Councilperson
Clarke. The motion carried, 9 ayes and 0 nays.
Ayes: Councilpersons Sutherland, Cooper, Thrower,
McLaughlin, Porter, Gay, Skelton, Clarke and Mayor

4. Special presentation to the Finance Department by City Manager
Bob Herrera.
City Manager Bob Herrera asked Finance Director Jeff
Litchfield, Finance Officer Linda Stubbs and Accounting
Supervisor Kathy Hutton to come forward to receive the
"Certificate of Performance" Award. This certificate is the
highest achievement a municipality can receive for the
financial reporting system of the Government Finance Officers
Association of the United States and Canada. Mr. Litchfield

and his staff received admiration and praise from the council
and audience for their accomplishment.
Mr. Litchfield addressed Council and explained the process
used and stated the incorporation of Visions '89 and other
public input as a means to achieve this goal. He thanked his
staff for their dedication and hard work.
5. Mayor Malone called the Public Hearing on the budget for
fiscal year 1991-92, to order. City Manager Bob Herrera
stated that he was very proud to have worked hand in hand with
the City Council to prepare a budget with no tax or utility
rate increases. Finance Director Jeff Litchfield reviewed the
proposed city budget.
Mayor Malone asked for public input, questions or concerns.
There was no public input and the Mayor asked Council if they
had any questions. There being no questions, the Mayor closed
the public hearing.
6. Mr. Nazar Momin, Port Auto Truck Stop, addressed Council to
express his concern regarding a permit to sell wine and beer
for consumption on premises at his location at 904 W.
Barbour's Cut Boulevard, La Porte, Texas.
Mr. Charlie Young addressed Council regarding the Agenda item
referencing to trap, hunt, or shoot or attempt to shoot or
molest in any manner, any animals.
7. Council considered an ordinance adopting Budget for Fiscal
Year 1991-92.
The City Attorney read: ORDINANCE 1781 - AN ORDINANCE
APPROVING AND ADOPTING THE BUDGET FOR THE CITY OF LA PORTE,
TEXAS, FOR THE PERIOD OF OCTOBER 1, 1991 THROUGH SEPTEMBER 30,
1992; FINDING THAT ALL THINGS REQUISITE AND NECESSARY HAVE
BEEN DONE IN PREPARATION AND PRESENTMENT OF SAID BUDGET;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson McLaughlin to adopt Ordinance
1781 as read by the City Attorney. Second by Councilperson
Sutherland. The motion carried, 9 ayes and 0 nays.

Councilperson Gay asked Finance Director Jeff Litchfield for
clarification regarding the Rodeo project. Discussion
followed. No action was necessary.
8. Council considered resolution adopting 1991 appraisal roll of
Harris County Appraisal District.
The City Attorney read: RESOLUTION 91-11 - A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, ADOPTING THE
1991 APPRAISAL ROLL OF THE HARRIS COUNTY APPRAISAL DISTRICT.
Resolution 91-11 as read by the City Attornev. Second by
Councilperson Cooper. The motion carried, 9 ayes and 0 nays.

McLaughlin, Porter, Gay, Skelton, Clarke and Mayor

9. Council considered an ordinance levying taxes upon taxable
property located within and subject to taxation in the City
of La Porte.
The City Attorney read: ORDINANCE 1782 - AN ORDINANCE LEVYING
TAXES UPON TAXABLE PROPERTY LOCATED WITHIN AND SUBJECT TO
TAXATION IN THE CITY OF LA PORTE; MAKING APPROPRIATIONS FOR
SUPPORT, MAINTENANCE, AND IMPROVEMENT OF THE CITY GOVERNMENT
OF SAID CITY OF LA PORTE; FINDING THAT ALL REQUIRED NOTICES
HAVE BEEN PUBLISHED AND ALL REQUIRED HEARINGS HELD; CONTAINING
A REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Skelton to adopt Ordinance
for about eleven years. Second by Councilperson Porter. The
motion carried, 9 ayes and 0 nays.

10. Council considered ordinance amending rates at the Bay Forest
Golf Course.
The City Attorney read: ORDINANCE NO. 1587-C, AN ORDINANCE
AMENDING ORDINANCE 1587, AN ORDINANCE ESTABLISHING USER FEES
AND RULES AND REGULATIONS FOR THE CITY OF LA PORTE BAY FOREST
GOLF COURSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW;
AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Cooper to adopt Ordinance
1587-C as read by the City Attorney. Second by Councilperson
McLaughlin. The motion carried, 9 ayes and 0 nays.

PAVILION; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW;
CONTAINING A SEVERABILITY CLAUSE; CONTAINING A REPEALING
CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Clarke to adopt Ordinance
1783 as read by the City Attorney. Second by Councilperson
Gay. The motion carried, 9 ayes and 0 nays.

12. Council considered an ordinance declaring that it shall be
unlawful for any person to trap, hunt, shoot or attempt to
shoot or molest in any manner, any animal; providing that any
person violating the terms of this ordinance shall be deemed
guilty of a misdemeanor and upon conviction shall be fined in
a sum not to exceed two hundred dollars ($200.00).
Motion was made by Councilperson Skelton to table Ordinance
1784. Second by Councilperson Gay. The motion carried, 9
ayes and 0 nays.

13. Council considered resolution concerning permit for retailers
selling beer and wine for consumption on premises, at gasoline
service stations and grocery stores, or a combination thereof.
The City Attorney read: RESOLUTION NO. 91-12 - A RESOLUTION
CONCERNING PERMITS FOR RETAILERS SELLING BEER AND WINE FOR
CONSUMPTION ON PREMISES, AT GASOLINE SERVICE STATIONS AND
GROCERY STORES, OR A COMBINATION THEREOF; FINDING COMPLIANCE
WITH THE OPEN MEETING LAW; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
Motion was made by Councilperson Skelton to adopt Resolution
91-12 as read by the City Attorney. Second by Councilperson
McLaughlin. The motion carried, 7 ayes and 2 nays.

14. Consider an ordinance amending Ordinance 1000, designating the
areas where beer for consumption on premises may be sold and
prohibiting the sale elsewhere.
The City Attorney stated that Council should table item 14,
Ordinance 1000-CC.
Motion was made by Councilperson Skelton to table Ordinance
1000-CC. Second by Councilperson Clarke. The motion carried,
9 ayes, 0 nays.
Ayes: Councilpersons Sutherland, Cooper, Thrower,
McLaughlin, Porter, Gay, Skelton, Clarke and Mayor
Malone.

15. Council considered authorizing the City Manager to purchase
property located at 1302 South Broadway for the City's SPORT
Program.
City Manager Bob Herrera requested this item be taken to
executive session. Council was in agreement.

16. Council considered a consent agenda as follows: (A) Consider
awarding a bid for aggregate for surface treatment; (B)
Consider awarding a bid for reinforced concrete pipe; (C)
Consider awarding a bid for Police Department forms.
Council discussed item (A) bid for aggregate for surface
treatment. Discussion was led by Assistant Public Works
Director Buddy Jacobs.
Motion was made by Councilperson Sutherland to adopt the
consent agenda as presented. Second by Councilperson Cooper.
The motion carried, 9 ayes and 0 nays.

17. Administrative Reports - Mr. Herrera stated Mr. Louis Rigby
expressed a need for another meeting with the Audit Committee
working on the personnel policy manual. He also reminded
Council of the Salute to Industry to be held on Thursday,
October 3rd and indicated this is a good function for the City
to participate in. Mr. Herrera stated Mrs. Lenes will be
getting in touch with each Councilperson to make their
reservation for them and their spouse.
18. Council Action - Councilpersons Skelton, Clarke, Sutherland,
Cooper, Thrower, McLaughlin, Porter, Gay and Mayor Malone
brought items to Council's attention.
19. Council adjourned into executive session at 7:27 P.M. under
V.A.T.S. - Article 6252-17, (A) Section 2 (E) - (Legal);
discussion with City Attorney regarding East "E" Street
contract; (B) Section 2 (G) - (Personnel) receive report from
City Manager on personnel; (C) Section 2 (F) - (Land
Acquisition) receive report from City Manager on the joint
purchase of building located at 1302 South Broadway with
Harris County Community Development Agency; (D) Section 2 (R)
- (Conference) receive report from City Manager on Enterprise
Fund; (E) Section 2 (E) (Legal) meet with special counsel
regarding Houston Chemical Services, Inc./Southern Ionics,
Inc. Council returned to the table at 9:33 P.M.

Item A - no action was taken; Item B - no action was taken;
Item C (Agenda Item 15) Consider authorizing the City Manager
to Purchase Property Located 'at 1302 South Broadway For the
City's Sport Program.
Motion was made by Councilperson Thrower to authorize the City
Manaaer to purchase property located at 1302 South Broadway.
Second by Councilperson Cooper. Motion carried 8 ayes and 0
nays (Councilperson Gay was absent from the Council table).

McLaughlin, Porter, Skelton, Clarke and Mayor Malone
Nays: None
Item D - no action was taken; Item E - no action was taken
City Attorney Knox Askins was away from the council table.
Councilperson Skelton asked that Council bring item 12 back
to the Council table and amend the ordinance to read -
ORDINANCE 1784 - AN ORDINANCE DECLARING THAT IT SHALL BE
UNLAWFUL FOR ANY PERSON TO TRAP, HUNT, SHOOT OR ATTEMPT TO
SHOOT OR MOLEST IN ANY MANNER, ANY dAME ANIMAL; PROVIDING THAT
ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE
DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE
FINED IN A SUM NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00);
PROVIDING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Councilperson Skelton also stated an addition to Section 1.
It shall be unlawful for any person to trap, hunt, shoot or
attempt to shoot or molest in any manner, any QAME animal, AS
DEFINED BY TEBAS PARRS & WILDLIFE.
Motion was made by Councilperson Skelton to pass Ordinance
1784 as amended. Second by Councilperson Porter. The motion
carried, 8 ayes, 0 nays. Councilperson Gay was away from the
Council table.

AN ORDINANCE APPROVING AND ADOPTING THE BUDGET FOR TILE CITY OF LA PORTE, TEXAS, FOR
TILE PERIOD OF OCTOBER 1, 1991 THROUGH SEPTEMBER 30, 1992; FINDING THAT ALL THINGS
REQUISITE AND NECESSARY HAVE BEEN DONE IN PREPARATION AND PRESENTMENT OF SAID
BUDGET; FINDING COMPLIANCE WITH TILE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF.
WHEREAS, the. Charter of the City of La Porte, Texas, and the Statutes of the
State of Texas, require that an annual budget be prepared and presented to the City
Council of the City of La Porte, Texas, prior Y.o the beginning of the fiscal year of
said City, and that a public hearing be held prior to the adoption of said Budget;
and
WHEREAS, the Budget for the fiscal year October 1, 1991, through September 30,
1992, has heretofore been presented to the City Council and due deliberation had
thereon, was filed in the office of the City Secretary on August 14, 1991, and a
public hearing scheduled for September 23, 1991 was duly advertised and held.
NOW THEREFORE, BE IT ORDAINED BY TIIE CITY COUNCIL OF TILE CITY OF LA PORTE:
SECTION 1: That the Budget for the City of La Porte, Texas, now before the said
City Council for consideration, a complete copy of which is on file with the City
Secretary and attached hereto by reference as Exhibit "A", is hereby adopted as the
Budget for the said City of La Porte, Texas, for the period of October 1, 1991,
through September 30, 1992.
SECTION 2: Be it FURTHER ORDAINED, that the said City Council finds that all
things requisite and necessary to the adoption of said Budget have been performed as
required by charter or statute.

SECTION 3: The City Council officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this
meeting of the City Council was posted at a place convenient to the public at the
City Mall of the City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes
Annotated; and that this meeting has been open to the public as required by law at
all times during which this Ordinance and the sub~ect matter thereof has been
discussed, considered and formally acted upon. The City Council further ratifies,
approves and confirms such written notice and the contents and posting thereof.
SECTION 4: This Ordinance shall be in effect from and after its passage
and approval.

SUMMARY AND RECOMMENDATION
On September 5, 1991, the City of La Porte received the Certified Appraisal
Roll from the Harris County Appraisal District.
Section 26.04 of the State Property Tax Code requires the submission of the
Appraisal Roll to the Governing Body.
The 1991 Certified Tax Roll for the City of La Porte shows a total appraised
value of $ $1,021,726,050 and a total taxable value of $935,652,310.
ACTION REQUIRED BY COUNCIL:
Approve Resolution 90- for acceptance of the appraisal roll.

APPRAISAL ROLL OF Tl1E HARRIS COUNTY APPRAISAL DISTRICT.
WHEREAS, the City's Assessor and Collector of Taxes submitted to the City Council
for approval the 1991 tax appraisal roll; and
WHEREAS, the City Council is of the opinion that the 1991 appraisal roll with tl~e
amounts shown therein should be adopted;
WHEREAS, The City's Assessor and Collector of Taxes has reported to the City
Council that there was situated in the City of La Porte, as of January 1, 1991,
property with a total appraised value of $1,021,726,050 and a total taxable value of
$935,652,310;
WHEREAS, new personal property added to the appraisal roll had a total taxable
value of $1,242,400 as of January 1, 1991;
BE IT RESOLVED BY TILE CITY COUNCIL
OF THE CITY OF LA FORTE, THAT:
Section 1. THAT, the 1991 taxable roll in the amount of $935,652,310 is hereby
adopted;
Section 2. That the City Council officially finds, determines, recites and
declares that a sufficient written notice of the date, hour, place and subject of
this meeting of the City Council was posted at a place convenient to the public at
the offices of City of La Porte for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes
Annotated; and that this meeting has been open to the public as required by law at
all times during which this resolution and the subject matter thereof has been
discussed, considered and formally acted upon. The City Council further ratifies,
approves and confirms such writL-en notice and the contents and posting thereof.

SUMMARY AND RECOMMENDATION
The Fiscal Year 1991-92 Budget was built around a tax rate of .71 cents per
hundred dollar valuation.
A breakdown of the tax rate is as follows:
General Fund .505 per hundred dollar valuation
Debt Service .205 per hundred dollar valuation
The effective tax rate for the new year is .7587 cents per hundred dollar
valuation. The proposed rate for the new year of .71 cents per hundred dollar
valuation represents a decrease from the effective rate of 6.16. This is the
second year in a row that the City has been able to adopt a tax rate that is
below the effective rate.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE
Section 1. That there is hereby levied for the current fiscal year
beginning October 1, 1991, and ending September 30, 1992, on all real
property situated and all personal property owned within the taxable
limits of the said City of La Porte, on the first day of January, 1991,
except so much as may be exempt under the constitution and laws of the
United States, this State, and the City of La Porte, the following taxes:
(1) An Ad Valorem Tax of and at the rate of five zero point five cents
(.505) on the one hundred dollars ($100.00) cash value thereof,
estimated in lawful currency of the United States for the current
expenses for the support, maintenance, and improvement of the City
Government of said City of La Porte;. and
(2) An Ad Valorem Tax of and at the rate of two zero point five cents
($.205) on the one hundred dollars ($100.00) cash value thereof,
estimated in lawful currency of the United States, to pay current
interest on and provide one year's sinking fund and to pay all of
the Principal and interest accruing on all outstanding general
obligation bonds and certificates of obligation lawfully issued by
the City of La Porte.
That this provides the sum of total Ad Valorem tax at the rate of
seventy-one cents ($.71) on the one hundred dollars ($100.00) cash value
thereof, estimated in lawful currency of the United States.
Section 2L All property upon which a rate of taxation is hereinabove
levied shall be assessed on a ratio of one hundred percent (100$) of the
estimated market value thereof.

Section 3. That the sums hereinafter accruing and collected from the
hereinabove taxes so levied be and the same are hereby appropriated for
the support, maintenance, and improvement of the City Government of the
City of La Porte.
Section 4. The City Council officially finds, determines, recites and
declares that all notices required by law have been published, and that a
public hearing as required by law was duly called and held, and that all
matters prerequisite to the establishment and levy of an ad valorem tax
have been accomplished, all as required by the laws of the State of Texas,
and the ltome Rule Charter of the City of La Porte.
Section 5. If any section, sentence, phrase, clause, or any part of
any section, sentence, phrase, or clause, of this Ordinance shall, for any
reason, be held invalid, such invalidity shall not affect the remaining
portions of this Ordinance, and it is hereby declared to be the intention
of this City Council to have passed each section, sentence, phrase, or
clause, or part thereof, irrespective of the fact that any other section,
sentence, phrase, or clause, or part thereof, may be declared invalid.
Section 6. All ordinances or parts of ordinances in conflict herewith
are hereby repealed to the extent of such conflict only.
Section 7. The City Council officially finds, determines, recites and
declares that a sufficient written notice of the date, hour, place, and
subject of this meeting of the City Council was posted at a place conven-
ient to the public at the City Nall of the City for the time required by
law preceding this meeting, as required by the Open Meetings Law, Article
6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has

The charge for security has been established at $12.50 per hour per security

In addition, a sentence has been added which allows the use of the facility by
non-profit entities with principal offices in the City of La Porte to use the
facility on Wednesdays for the rental rate of $150.00.
The final change calls for a Reservation and Damage Deposit of $200.00 that
will be collected from the lessee upon their making a reservation for the use
of the Pavilion. If the function is held without any problems (no damage to
the building and the event ended when it was supposed to) the deposit will be
returned to the lessee.

Section 1. The City Council of the City of La Porte, by this Ordinance,
establishes rental fee policy and schedule for Sylvan Beach Pavilion, formerly
known as Sylvan Beach Convention Center.
City Council has sought to establish rental fees which will cover the
operating costs of the facility, with higher fees for days of high usage
demand, and lower fees for days of low usage demand, to increase use and
access to the facility by all community groups.
City Council hereby establishes its firm policy, in fairness to all
users, that no waiver of rental fees, discounts from rental fees, or
deviations from this published schedule of rental fees, shall be allowed by
City Council nor by City Administrative Staff.
City Council will review the income and expenses of Sylvan Beach
Pavilion, and will make appropriate adjustments to the rental fee schedule as
conditions warrant.
Section 2. Sylvan Beach Pavilion shall be available for rental, Monday
through Sunday, from 8:00 a.n-. until 1:00 a.m.
Section 3. The rental rates for Sylvan Beach Pavilion shall be based on
the day of the week, as follows, to-wit:

Any non-profit organization which has its principal office in the City
of La Porte, that wishes to rent the Pavilion on a Wednesday, other than when
it falls on New Year's Eve, will be charged $150.00 upon presentation of proof
of their non-profit status.
In addition, the Lessee will be obligated to pay an additional $100.00
per hour after 1:00 a.m. No function s1~a11 be allowed to continue after 1:00
a.m., unless prior written approval is obtained from the Director of Parks and
Recreation or his designee.
Lessees requiring additional time for move-iti, move-out, or rehearsal
prior to or immediately following an event, extending to an additional day or
days, will be charged one-half (1/2) of the applicable full time rate.
Section 4. It shall be the responsibility of the Director of Parks and
Recreation, or his designee, to determine the number of security officers
required for each event, and to arrange for such security service. The charge
for security service will be $12.50 per hour per security officer and will be
in addition to tt-e rental rate; provided, however, the charge for security
service on holidays will be $18.75 per Hour per security officer, and will be
in addition to the rental rate.
Section S. Reservations for use of Sylvan Beach Pavilion may be made
either by phone or in person at Sylvan Beach Pavilion or any other place that

Reservations must be accompanied by a
Reservations and Damage Deposit of $200.00. Tt~e Reservation and Damage
Deposit will reserve the facility for the Lessee until rental payments are
made and will provide protection to the Lessor for any damage to Sylvan Beach
Pavilion caused by Lessee. Failure of Lessee to vacate premises at the
designated dour will subject Lessee to additional fees for rental and security
and said additional fees will be deducted from the Reservation and Security
Deposit. The Reservation and Damage Deposit will be returned to the Lessee
within 15 (fifteen) days after the event.
Section 6. Payments of rental fees and security charges shall be made
according to the following terms and conditions.
1. At least 180 days prior to the rental date, 508 (fifty percent) on
the rental rate shall be due and payable.
2. At least 10 days prior to the rental date, the remaining amount of
the rental rate plus the total amount for security charges shall
be due and payable.
Section 7. Rental dates that are cancelled shall be subject to the
following terms and conditions. The Lessee shall provide written notice of
the cancellation to the Lessor. Tt~e amount of refund is dependent on the date
notice is received by the Lessor.

No refund will be given for cancellations received within thirty (30) days of
the rental date. For all cancellations prior to the date of the function, 508

Section 8, Rental of Sylvan Beacti Pavilion will be subject to
reasonable rules and regulations, which shall be promu~.gated by the Director
of Parks and Recreation or his designee, with the approval of the City
Manager. The City of La Porte reserves the right to refuse rental of Sylvan
Beach Pavilion to any person, firm, or group, for lewd or immoral purposes, or
where the activities of such group may reasonably be expected to result in a
breach of the peace, or cause a threat to public health or safety.
Section 9. The City of La Porte has entered into concession contracts
with vendors of food and beverages at Sylvan Beach Pavilion. The City of La
Porte reserves the right to include, in its rental agreements with Lessees of
the facility, requirements as to the purchase of food and beverages
exclusively from its duly authorized concessionaires, and prohibiting food and
beverages from being brought onto the premises by Lessees and their guests.
Section 10. Neither the City of La Porte, nor its Lessees, shall make
any charge for parking at Sylvan Beach Pavilion.
Section 11. If any section, sentence, phrase, clause or any part of any
section, sentence, phrase or clause, of this Ordinance shall for any reason,
be held invalid, such invalidity shall not affect the remaining portions of

Re: City Ordinance No. 1784
On September 23, 1991, you amended an
ordinance making it unlawful for any person to trap, hunt, shoot
or attempt to shoot or molest in any manner, any game animal, as
defined in the Texas Parks and Wildlife Code. The passage of this
ordinance has caused me a considerable financial loss. I
personally lease over 300 acres of undeveloped land on the
Southwest side of La Porte, for cattle grazing and deer hunting.
Eighteen years ago the City of La Porte promised the owners of
this tract of land that if they did not oppose annexation, that
the City would provide utilities to the tract, they have failed
to honor this commitment and have no plans to do so in the near
future. The owners of this property have paid over $ 400,000 in
taxes to the City and still have no drainage or utilities.
Therefore, the only use for the land in the foreseeable future,
is for cattle grazing and archery deer hunting.
I spoke to Councilman Porter about the impetus for the amendment
of the Ordinance, and he informed me that a concerned citizen was
worried about people trespassing and possibly being hurt on the
property. Speaking to this concern I can only say that I have the
property posted with no trespassing signs and if someone is
illegally trespassing, there is always the possiblity of them
being hurt, that's the risk a person takes when they break the
law.
A La Porte City Employee was quoted in the Houston Chronicle as
saying that the safety of citzens and their property would
clearly be endangered if hunting and other predatory activities
were allowed to continue". I challenge this narrow minded
thinking, archery is taught as a class at the La Porte High
School and students practice in their back yards in Fairmont Park
Subdivision and no citzens are endangered by this activity, why
is it then, that an archery deer hunter, hunting on 300 acres not
bordering any subdivision or other development is endangering the
safety of any citzen.
A fair number of deer are killed every year by cars on Highway
146, Fairmont Park and Bay Area Boulevard, I'm sure some of the
drivers of these cars would appreciate archery hunters keeping
the deer herd down. The deer population in this area is very
high and when natural predation is not present, deer tend to
over populate their given habitat. Over population, more than any
other factor, leads to disease, starvation and an over all un-
healthy herd. Coupling this with fact that deer ticks cause Lime
Disease, many citzens welcome the fact that archery hunters keep
the size of the deer herds in check.

Several years ago the City of La Porte passed a comprehensive
zoning plan for the City and this paticular tract was zoned
Planned Unit Development, yet there is no infrastructure in place
for development of any nature. The zoning designation PUD over
the entire portion of this tract has adversely affected the
marketability of the property ,due to the fact that the tract has
over 1 mile of rail frontage which is normally associated with
heavy industrial users. Many industrial users shy away from
attempting to fight the City of Laporte on Zoning issues.
Last year the owners of this tract, spent money surveying and
dedicating a 100 foot wide drainage easement on the south end of
this parcel and neither Harris County or the City of La Porte has
expressed any interest in assisting the landowners in getting the
drainage right of way functional, to facilitate development of
the area. The Texas Legislature has passed laws addressing the
specific obligations of Municipalities when annexing a tract of
land and one of obligations is to provide utilities to the
property within three years. The City of La Porte has had
eighteen years to provide utilities to this tract and has not
done so, my advice to these landowners is to ask the City to be
de-annexed since the City is not providing any services or
utilities for the City Taxes that are being paid on the property.
In years past I have had Game Wardens and La Porte Police
officers hunting on this lease which further insured against
anyone trespassing and now the City Council has made it illegal
for me to allow them to hunt anymore.
Since the ordinance only speaks to game animals as defined by
the Texas Parks and Wildlife Code ", does the City Council have
any objections to my stocking the property with Mouflon Rams and
Barbadoau Sheep?
The Texas Legislature several years ago struck down a law that
made it illegal to hunt in the City Limits as unconstitutional.
Deer hunting in Texas is Big Business and with the stroke of a
pen, La Porte's City Council took away a valuable source of
income for me, from this property. I am hereby humbly requesting
that the City Council Grandfather my hunting rights on this
property, since it poses no threat to Public Health or Safety and
there is no anticipated development of the property, until the
drainage and infrastructure problems are resolved.

Section 1. The City Commission of the City of La Porte, on
August 19, 1974, adopted City of La Porte Ordinance No. 1000,
designating the areas where beer and wine for consumption on
premises may be sold in the City of La Porte, and prohibiting the
sale elsewhere. Subsequent to the adoption of Ordinance No. 1000,
the City Council of the City of La Porte has issued permits for
retailers selling beer and wine for consumption on premises, only to
restaurants deriving at least 65$ of their gross income from the
sale of prepared food, and serving beer as a beverage only in
connection with the service of prepared food to a customer.
Section 2. By adoption of this Resolution, the City Council of
the City of La Porte confirms its existing policy. Without limiting
the generality of the foregoing, the City Council of the City of La
Porte establishes and reaffirms its policy under Ordinance No. 1000,
that City of La Porte permits for a retailer selling beer and wine
for consumption on premises, will not be issued to gasoline service
stations, grocery stores, or combination gasoline service station -
grocery store businesses.

AN ORDINANCE AMENDING ORDINANCE NO. 1000 OF THE CITY OF LA PORTS,
TEXAS, DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON PREMISES
MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE; PROVIDING FOR HOURS
OF OPENING AND CLOSING; DEFINING SOURCE OF AUTHORITY; PROVIDING A
SAVINGS CLAUSE; PROVIDING THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR
THE AREAS HEREIN DESIGNATED; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
WHEREAS, the City of La Porte desires to regulate the sale of
beer and prescribe the hours when it may be sold, for consumption on
premises in accord with provisions of Texas Codes Annotated,
Alcoholic Beverage Code, Chapter 105, Section 105.05 and Section
105.06; and in accord with the provisions of Texas Codes Annotated,
Alcoholic Beverage Code, Chapter 109, Subchapter C, Section 109.31
et seq;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LA PORTS:
Section 1. DEFINITIONS:
Restaurant: A building or portion of a building, not
operated as a dining room in connection with a hotel or
boarding hotel, where the primary business is the on-premises
sale of prepared food, with adequate kitchen facilities for the
preparation of the food to be sold, the adequacy of said
kitchen facilities to be based upon the seating capacity of the
restaurant and the type of menu offered, and where alcoholic
beverages may be sold under the following conditions:
(1) At least sixty-five percent (65$) of the gross income
shall be derived from the sale of prepared food.
(2) Any outside entrances, outside separate identification,
outside signs or other advertising shall not use any of
the words "bar," "tavern," "lounge," "ice house," or
"beer," or any word of like import, to identify the
business.
(3) Beer shall be served as a beverage only in connection with
the service of prepared food to a customer.
(4) Whenever the building official on the. basis of a sworn
complaint from any credible person determines that a
violation of this section exists, he may require any
person serving alcoholic beverages as an incidental use to
provide the City, within thirty (30) days of notification,
a verified audit for each of the preceding four (4)
calendar quarters, showing the gross income derived from
the sale of alcoholic beverages and the gross income
derived from the sale of food. Such verified audit shall
be supported by copies of licensee's invoices and.
cancelled checks to substantiate its beer and food
purchases. No more than two (2) audits per year shall be
required.
Section 2. In addition to the locations specified in Section 1
of Ordinance No. 1000 of the City of La Porte, passed and approved
by the City Commission of the City of La Porte on August 19, 1974,

the sale of beer and wine shall also be permitted during the hours
set by the general laws of the State of Texas, consistent with Texas
Codes Annotated, Alcoholic Beverage Code, Chapter 105, Sections
105.05 and 105.06, at the following location by a retailer selling
beer and wine for consumption on premises, to-wit:

Section 3. Except and to the extent amended hereby, Ordinance
No. 1000 shall remain in full force and effect.
Section 4. This ordinance shall constitute a permit for the
operation of a restaurant, as above defined, at the above location,
which permit shall be personal to the applicant, and nontransfer-
able, and shall be further conditioned that the permittee shall
comply with the provisions of the Texas Alcoholic Beverage Code, and
all other applicable federal, state, and local laws and ordinances,
including other provisions of this ordinance.
Section 5. It is expressly provided that this ordinance is not
an attempt to create a zoning district or comprehensive zoning as
authorized by Vernon's Texas Codes Annotated, Local Government Code,
State of Texas, but rather is to designate that area wherein beer
for consumption on premises may be sold in accordance with the
Authority granted by the Texas Codes Annotated, Alcoholic Beverage
Code, State of Texas.
Section 6. Hereafter no license for the sale of beer for
consumption on premises where sold shall be issued or approved, save
and except the areas designated in Ordinance No. 1000 of the City of
La Porte, Harris County, Texas, and amendments thereto.
Section 7. All rights or remedies of the City of La Porte,
Texas, are expressly saved as to any and all violations of Ordinance

No. 1000 or any amendments thereto, or any other ordinance, statute,
or code, that permits and regulates the subject matter of this
Ordinance, that have accrued at the time of the effective date of
this Ordinance; and as to such accrued violation, any court shall
have all the powers that existed prior to the effective date of this
Ordinance.
Section 8. If any section, subsection, sentence, clause or
phrase of this Ordinance is for any reason held to be invalid, such
decision shall not effect the validity of the remaining portions of
this Ordinance. ..
Section 9. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 10. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

Re: S.P.O.R.T. Recreation Center
We have received and reviewed your request of August 29, 1991 requesting permission to
purchase the 16,000 square foot metal building adjacent to the building at 1322 South
Broadway. You are hereby granted permission to make an offer to the owner for $165,000.
It is understood that one-half of the purchase price will be paid by the City of La Porte and
that one-half of the building will be renovated by the City for purposes unrelated to the
S.P.O.R.T. facility.
Your letter alluded to a need for additional funding for this project. Please be advised that
in light of the significant amount of CDBG funds currently allocated to the S.P.O.R.T.
facility, it is unlikely that more would be added to the original amount. If this presents a
significant problem that the City of La Porte cannot resolve with resources other than
CDBG, please let us know before an offer is made to the owner.

SUNIlKARY & RECOMMENDATION
Advertised, sealed bids #0446 for the annual supply of aggregate for
surface treatment was opened and read on September 9, 1991. Bid requests
were mailed to five (5) area suppliers with only one (1), Vulcan Materials
returning a bid.
During the past year, alternative materials to natural limestone rock
asphalt aggregate were allowed and used on a trial basis. Problems with
"bleed through" and pavement failures were encountered with the alternative
materials. Due to the poor performance of the alternative materials, bid
specifications were for natural limestone rock asphalt aggregate. Vulcan
Materials was the only supplier complying with the specifications.
Vulcan Materials submitted bids as follows:
1. PE 2 Material (Price per ton) $10.00
Rail Freight (per ton) $16.00
Truck Delivery (per ton) $15.95
2. PE 4 Material (Price per ton) $10.75
Rail Delivery (per ton) $16.00
Truck Delivery (per ton) $15.95
Truck delivery prices are firm for one year. Rail delivery prices are
subject to increase/decrease by regulatory action. Rail prices in effect
at time of the order will determine the type of delivery. Using estimated
yearly quantities of 1500 tons of each type of material, the cost of the
contract would be $38925.00 for PE 2 material and $40,050.00 for PE 4
material.
Staff recommends award of bid for the supply of Aggregate for Surface
Treatment to the low bidder meeting specifications, Vulcan Materials.
Funds for this purchase will be available in the FY 91/92 Operating Budget
of the Street Maintenance Division.

The Gity of La Porte {hereinafter called the "Owner") , invites
bids on the form attached hereto, all blanks of which must be
appropriately filled in. Bids wi 11 be received by the Owr_er,
at the office of Gity Secretary. Bids will be publicly opened
and read aloud in the Council Chambers. The envelopes
containing the bids must be sealed, addressed to: City
Secretary, POB 1115, La Porte, TX 77571 (physical address:
604 W Fairmont Parkway), and desigr_ated with bid number.
The Owner may consider informal any bid not prepared and

2. PREPARATION OF BID
Each bid must be submitted on the prescribed farm. All bla_~k

Each bid must be submitted in a sewed envelope bearing on
the outside the name of the bidder, his address, and the name
of the project for which the bid is submitted. If forwarded
by mail, the sealed envelope containing the bid must be
enclosed in another envelope addressed as specified. in the bid
form.
3. SUBCONTRACTS
The bidder is specifically advised that any person., firm, or
other party to whom it is proposed to award a subcontract
under this contract must be acceptable to the Owner.
4. TELEGRAPHIC MODIFICATIONS
Any bidder may modify his bid by telegraphic communication at
any time prior to the scheduled closing time for receigt of
bids, provided such telegraphic communication is received by

the Owr_er prior to the closing time, and. provided further, the
Owner is satisfied that a written confirmation of the
telegraphic modification over the signature of the bidder was
mailed prior to the closing time. The telegraphic
commur_ication should not reveal the bid price, but should
provide the addition or subtraction or other modification so
that the final prices or terms will not be known by the Owner
until the sealed bid is opened. If written. confirmation is
not received within two (2) days from the closing time, no
cor_sideration will be given to the telegraphic modification.

6. QUALIFICATIONS OF BIDDER
The Owr_er may make such investigations as he deems necessary
to determine the ability of the bidder to perform the work,
and the bidder shall furnish to the Owner all such information
and data for this purpose as the Owner may request. The Owner
reserves the right to reject any bid if the evidence
submitted by, or investigation of, such bidder fails to
satisfy the Owner that such bidder is properly qualified to
carry out the obligations of the contract and to complete the
work contemplated therein. Conditional bids will not be
accepted.
?. CONDITIONS OF WORK
Each bidder must inform himself fully of the conditions
relating to the construction of the project and the employment
of Iabor thereon. Failure to do so will not relieve a
successful bidder of .his obligation to furnish all ..material
and labor necessary to carry out the provisions of his
contract. Insofar, as possible contractor, in carrying out
his work, must employ such methods or means as will not cause
any interruptions of or interference with the .work of any

8. ADDENDA AND INTERPRETATIONS
No interpretation of the meaning of the plans, specifications
or other prebid documents will be made to any bidder orally.
Every request for such interpretation should be in writir_g
addressed to the City Secretary, POB 1115, La Porte, TX ?7571,
and be given cor_s i deration to be received at Least f ive ( 5 )
days prior to the date fixed for the opening of bids. Any ar_d
all such interpretations ar_d any supplemental instructions,
will be in the form of written addenda to the specifications
which, if issued, will be mailed by certified mail with
return receipt requested to all prosgective bidders (at the
respective addresses furnished for such purposes) r_ot later
than three (3) days prior to the date fixed for the opening
of bids. Failure of any bidder to receive ar_y such addendum
or ir_tergretation shall r_ot relieve such bidder from any
obligation under his bid as submitted. All addenda so issued
shall become part of the contract documents.
9. LAWS AND REGULATIONS
The bidder's attention is directed to the fact that all
applicable state Laws, municipal ordinances, and the rules ar_d
regulations of all authorities having jurisdiction over
construction of the project shall apply to the contract
throughout, and they will be deemed to be included in the
contract the same as though herein written out in full.
10. METHOD OF AWARD - LOWEST QUALIFIED BIDDER
If at the time this contract is to be awarded, the lowest base
bid submitted by a responsible bidder does not exceed the
amount of funds then estimated by the Owner as available to
finance the contract, the contract will be awarded on the base

GENERAL: Shall meet all requirements of Item 304 - Texas State
Department of Highways.
DESCRIPTION: The natural limestone rock asphalt aggregate, when
furnished, shall have an average bitumen content from 4 to 8
percent by weight of naturally impregnated asphalt, as
determined by Test Method Tex-215-F, and shall cor_tain not
more than 2 percent by weight of ar_y one of or combination of
iron pyrites, or other objectionable matter, as determined by
Test Method Tex-217-F, Part I.
WEAR: The percent of wear on natural limestone rock asphalt
aggregate as determined by Test Method Tex-410-A shall be mace
on that portion of the material retained or_ the No. 4 sieve,
having a naturally impregnated asphalt cor_tent of Less tha^_
1 pFarCent.
TYPE: Shall be Type PE - precoated aggregate consisting of nat~~ral
limestone rock asphalt.
GRADES: Shall be grades PE 2 ar_d PE 4.
PREGOAT: The precoating material and!or fluxing material shall
meet the requirements specified in Item 300 - Asphalts, Oils,
and Emulsions.
DELIVERY: All prices shall be quoted F.0_B_ City of La Porte, 29E3
N. 23rd Street, La Porte, Texas, 77571. Material shall be
shipped rail freight for 1000 tons or more. Quantities less

were ogened and read on September 9, 1991. Bid requests were
mailed to six suppliers with five returning bids.
Bay Concrete Pige Products submitted the lowest bid or_ Item
1, RCP. South Houston Concrete Pipe was low on Items 2-4, inlet
saddles, catch basins and grates.
Using estimated yearly quantities, the cost of the cor_tract
to Bay Concrete Pige Products would be $29,800.00 and to South
Houston Concrete Pipe $5,114.90. Total cost would be $34,914.90.
This is a 3~ increase over last year's price.
