~ ~ MINUTES OF THE REGULAR MEETING OF LA PORTE CITY COUNCIL FEBRUARY 10, 1992 1. 2. 3. The meeting was called to order by Mayor Malone at 6:00 P.M. Members of City Council Present: Mayor Norman Malone, Councilpersons Guy Sutherland, Mike Cooper, Bob Thrower, Bob McLaughlin, Deotis Gay, B. Council considered approving the minutes of the public hearing and regular meeting of Council held January 27, 1992. Motion was made by Councilperson Skelton to approve the January 27 minutes as presented. Second by Councilperson Sutherland. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Gay, Skelton, Clarke and Mayor Malone Nays: None 4.~ Police Officer Charles Lunsford was honored as Employee of the Quarter for October, November and December, 1991. He was presented a plaque of appreciation. 5. Retiree Sam Knowles was recognized and lauded for his faithful service to the City as Warehouse Supervisor. He was presented with a gold wristwatch in appreciation of his service. 6. Certificates of Appreciation, as part of an ongoing Centennial project, were presented to Mary Gay, Royce Hovey, Roy Johnson, and Leo Rizzuto. Due to Mr. Rizzuto's illness, the certificate was accepted by his daughter, Paula Rizzuto. 7. George Paulissen, Morgan's Point resident, was acknowledged as the official chairman of Morgan's Point's beard growing • Minutes, Regular Meeting, La Porte City Council February 10, 1992, Page 2 contest. Mr. Paulissen challenged surrounding communities to show their support of La Porte's Centennial by entering into the beard growing contest. 8. Mrs. Betty Waters addressed Council regarding a hearing she had attended at Commissioners Court. The hearing was regarding whether or not to renew a Wine and Beer Retailer on Premise for Lomax Food and Grocery. There have been numerous complaints on this establishment, and a petition had been presented to Commissioners Court asking that the permit not be approved. Thanks to Council's help and interest, the permit was not approved. 9. Council considered an ordinance calling the Regular Annual Election. The City Attorney read: ORDINANCE 1808 - AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE CITY OF LA PORTE; CALLING A RUN-OFF ELECTION, IF NECESSARY; DESIGNATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING FOR THE USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS; PROVIDING FOR METHOD AND DATES OF EARLY VOTING; PROVIDING FOR AN EARLY VOTING BALLOT BOARD; PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION; PROVIDING FOR NOTICE; PROVIDING FOR FILING DEADLINE AND FILING FEES FOR CANDIDATES; PROVIDING A SAVINGS CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Skelton to adopt Ordinance 1808 as read by the City Attorney. Second by Councilperson McLaughlin. The motion carried, 8 ayes and 0 nays. Council considered an ordinance naming a member to fill an unexpired term on the La Porte Zoning Board of Adjustment. The Mayor announced that this item would be taken to executive session under V.A.T.S. - Article 6252-17, Section 2(G) (Personnel). il. Council considered an ordinance reappointing Patricia Muston as City of La Porte representative for the Southeast Texas Housing Finance Corporation. • • Minutes, Regular Meeting, La Porte City Council February 10, 1992, Page 3 The City Attorney read: ORDINANCE 1810 - AN ORDINANCE APPOINTING A MEMBER TO THE SOUTHEAST TEXAS HOUSING FINANCE CORPORATION BOARD OF DIRECTORS; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Skelton to adopt Ordinance 1810 as read by the City Attornev. Second by Councilperson Clarke. The motion carried, 8 ayes and 0 nays. Council considered an ordinance authorizing execution by the City of La Porte of an Industrial District Agreement with Chusei (U.S.A.), Inc., within the Bayport Industrial District. The City Attorney read: ORDINANCE 1811 - AN ORDINANCE AUTHORIZING THE EXECUTION BY THE CITY OF LA PORTE OF AN INDUSTRIAL DISTRICT AGREEMENT WITH CHUSEI (U.S.A.) INC., WITHIN THE BAYPORT INDUSTRIAL DISTRICT FOR THE TERM COMMENCING JANUARY 1, 1987, AND ENDING DECEMBER 31, 1993. Motion was made by Councilperson Clarke to adopt Ordinance 1811 as read by the City Attornev. Second by Councilperson Thrower. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Gay, Skelton, Clarke and Mayor Malone Nays: None 13. Council considered an ordinance closing the alley in Block 654, Lots 17-32, Town of La Porte. This is a request from Anthony Crane. Several provisions need to be met before a certified copy of the ordinance is delivered: (1) Applicant must furnish to the City a hold harmless letter by an official of Anthony Crane Rental of Texas, Inc.; (2) Evidence of title from adjacent owners which have given consent to the closure; (3) Evidence of title from Anthony Crane Rental of Texas, Inc., showing ownership of Lots 17 through 32, Block 654, Town of La Porte; (4) A cashier's check for $9,000.00 payable to the City of La Porte. Council considered an ordinance to update City of La Porte Fire Code. The City Attorney read: ORDINANCE 1388-B - AN ORDINANCE AMENDING ORDINANCE 1388, AN ORDINANCE ADOPTING A FIRE CODE FOR THE CITY OF LA PORTE; CONTAINING A SAVING AND REPEALING CLAUSE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson McLaughlin to adopt Ordinance 1388-B as read by the City Attornev. Second by Councilperson Thrower. The motion carried, 8 ayes and 0 nays. Council considered authorizing a date for public hearing on dangerous building condemnation. Building Inspector Mark Lewis presented a video of 13 houses proposed to be condemned, and asked that Council consider a public hearing date of March 9. Motion was made by Counci~erson Skelton to set a public hearing date of March 9 1992 for dangerous building condemnation. Second by Councilperson Thrower. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Gay, Skelton, Clarke and Mayor Malone Nays: None 16. Council considered approving the request of H. McElveen for a Special Conditional Use Permit. This item had been tabled at the meeting of January 23 by Councilperson Porter. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Gay, Skelton, Clarke and Mayor Malone Nays: None An amended plan had been submitted and was reviewed by Council. Motion was made by Counciherson Clarke to__approve the Special Conditional Use Permit as it was amended, which specifies compliance with the provisions of Zoning Ordinance Section 6.600 B and allowing boat and R.V. storage only in the area indicated on the applicant's amended site plan. Second by Councilperson Gay. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Gay, Skelton, Clarke and Mayor Malone Nays: None 17. Council considered waiving the bid process and award a bid for tables to Bryan Equipment Company, as sole source vendor. Motion was made by Councilperson Gay to waive bid process and award a bid for tables to Bryan Equipment Company, as sole source vendor, in the amount of 56,080.00. Second by Councilperson Thrower. The motion carried, 7 ayes and 1 nay. Ayes: Councilpersons Cooper, Thrower, McLaughlin, Gay, Skelton, Clarke and Mayor Malone Nays: Councilperson Sutherland 18. Administrative reports A. City Manager Bob Herrera reminded Council of the February it public hearing regarding State Highway Department improvements. This hearing will be held in our Council Chambers, and Council and staff members are urged to attend. B. Director of Public Works Steve Gillett reported on problems at Lift Station 30 and what will be done to correct them. • • Minutes, Regular Meeting, La Porte City Council February 10, 1992, Page 6 C. The City Manager informed Council that approval for a State Historical Marker for the City of La Porte has been received. As soon as funds to cover the cost are received by the Texas Historical Commission, work will begin on the wording to be used on the marker. 19. Council Action: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Gay, Skelton, Clarke and Mayor Malone brought items to Council's attention. 20. Council adjourned into executive session at 7:26 P.M. to discuss the following under V.A.T.S. - Article 6252-17, Section 2(G) - (Personnel): Discuss appointments to boards and commissions. Council returned to the table at 7:53 P.M., with no action being taken in executive session. Item 10 was then addressed. The Council did not see fit at this time to fill the' unexpired term on the Board of Adjustment, and instructed the City Secretary that the alternates were to be notified for each meeting of the Board in order to insure a quorum. 21. There being no further business to come before the Council, the meeting adjourned at 7:55. Malone ~Ma orr Y EMPLOYEE OF THE QUARTER OCTOBER, NOVEMBER, DECEMBER, 1991 Officer Charles Lunsford begin work with the City in October 1990. He displays great concern for the City, the Police Department, the citizens he works for and the employees he works with. He takes pride in his personal appearance, maintains his equipment in good condition, is courteous with the public, and treats citizens with interest and concern. Since Officer Lunsford's employment, he has conducted numerous felony and misdemeanor arrests. He has arrested burglary of residence suspects, auto theft suspects, and numerous suspects wanted by other police agencies from local areas and out-of-state areas for felony and misdemeanor offenses. This has enabled thousands of dollars of property to be recovered and returned to the owners. He has also revived a prisoner who was attempting suicide in his jail cell; investigated auto thefts and arrested the suspect, who was convicted and sent to prison; put his life on the line while investigating a DWI and the person pulled a pistol and pointed the gun at Officer Lunsford; arrested suspicious males committing a burglary; and has conducted numerous misdemeanor arrests for various causes. Officer Lunsford is a professional Police Office, and performs his duties in an excellent manner. He is a credit to the City of La Porte, the Police Department and to the citizens of this community. Therefore, it is with great pride that Officer Charles Lunsford is named Employee of the Quarter for October, November and December, 1991. ........._. . • Sam Loved Knowles began working for the City of La Porte on September 30, 1981. He was hired as the first ever Warehouse Supervisor and held that position until retirement on January 31, 1992. He came to us from the City of Baytown where he held a similar position for about 7 1/2 years. During his stay with the City of La Porte, Sam made many friends and the warehouse will hardly be the same without him. Voting at said election, including early voting, shall be by the use of voting machines, and the ballots of said election shall conform to the Texas Election Code, as amended. Section 4. An Early Voting Ballot Board is hereby created to process Early Voting results for the election and the runoff election, if necessary. Charlotte Boudreaux is appointed Presiding Judge of the Early Voting Ballot Board. At least two (2) other members of the Early Voting Ballot Board shall be appointed by the Presiding Judge, in the same manner as the precinct election clerks. Early Voting by personal appearance shall begin on the 20th day and shall continue through the 4th day preceding the day of election. No application shall be accepted for filing prior to February 17, 1992. The filing fee for each candidate for the office of Councilperson is hereby established as Fifty Dollars ($50.00). The filing fees shall be used to defray the cost of the election, and said fees shall be prorated and any surplus shall be refunded to said candidates. As an alternative to paying a filing fee, a candidate may obtain a place on the ballot by filing a petition as provided for in City of La Porte Home Rule Charter, Article 2.04 c.3. Section 11. The corporation has purchased and rehabilitated declining apartment projects as part of the low in- come housing program. Under the terms of the Texas Property Tax Code (S.B. 621, Acts of the 65th Texas Legislature, Regular Session, 1979, as amended), • • Industrial District Agreement - 4 the appraised value for tax purposes of the annexed portion of land, improvements, and tangible personal property shall be determined by the Harris County Appraisal District. The parties hereto recognize that said District has no authority to appraise the land, improvements, and tangible personal property in the unannexed area for the purpose of computing the "in lieu" payments hereunder. Therefore, the parties agree that the appraisal of the land, improvements, and tangible personal property in the unannexed area shall be conducted by City, at City's expense, by an independent appraiser of City's selection. The parties recognize that in making such appraisal for "in lieu" payment purposes, such appraiser must of necessity appraise the entire (annexed and unannexed) land, improvements, and tangible personal property. Company agrees to render and pay full City ad valorem taxes on such annexed land, improvements, and tangible personal pro- perty. Company also agrees to render to City and pay an amount "in lieu of taxes" on company's land, improvements, and tangible personal property in the unannexed area equal to the sum of: (1) Fifty percent (50~) of the amount of ad valorem taxes which would be payable to City if all of the hereinabove described property which existed on January 1, 1986, had been within the corporate limits of City and appraised each year by City's independent appraiser; and (2) Thirty percent (30$) of the amount of ad valorem taxes which would be payable to City on any increase in value of the hereinabove described property, in excess of the appraised value of same on January 1, 1986, resulting from new construction and new acquisitions of tangible personal property, (exclusive of Construction in Progress, which shall be exempt from taxation), if all of said new construction and acquisitions had been within the corporate limits of City and appraised by City's independent • • Industrial District Agreement - 5 appraiser; with the sum of (1) and (2) reduced by the amount of City's ad valorem taxes on the annexed portion thereof as determined by appraisal by the Harris County Appraisal District. Nothing herein contained shall ever be construed as in derogation of the authority of the Harris County Appraisal District to establish the appraised value of land, improvements, and tangible personal property in the annexed portion, for ad valorem tax purposes. III. This Agreement shall extend for a period beginning on the 1st day of January, 1987, and continue thereafter until December 31, 1993, unless extended for an additional period or periods of time upon mutual consent of Company and City as provided by the Municipal Annexation Act; provided, however, that in the event this Agreement is not so extended for an additional period or periods of time on or before August 31, 1993, the agreement of City not to annex property of Company within the District shall terminate. In that event, City shall have the right to commence immediate annexation proceedings as to all of Company's property covered by this Agreement, notwithstanding any of the terms and provisions of this agrement, and in such event Company agrees that if the Texas Municipal Act, Article 970a (V.A.T.S.), as amended after January 1, 1980, or any new legislation is thereafter enacted. by the Legislature of the State of Texas which imposes greater restrictions on the right of City to annex land belonging to Company or imposes further obligations on City in connection therewith after the annexation of such land, Company will waive the right to require City to comply with any such additional restrictions or obligations and the rights of the parties shall be then determined in accordance with the provisions of said Texas Municipal Annexation Act as the same existed January 1, 1980. • • Industrial District Agreement - 6 IV . This Agreement may be extended for an additional period or periods by agreement between City and Company and/or its assigns even though it is not extended by agreement between City and all of the owners of all land within the District of which it is a part. In this connection, City hereby expresses its belief that industrial district agreements of the kind made herein are conducive to the development of existing and future industry and are to .the best interest of all citizens of City and encourage future City Councils to enter into future industrial district agreements and to extend for additional periods permitted by law this Industrial District Agreement upon request of Company or its assigns; provided, however, that nothing herein contained shall be deemed to obligate either party hereto to agree to an extension of this Agrement. V. Company agrees to pay all ad valorem taxes, and all "in lieu of taxes" payments hereunder, to City on or before December 31 of each year during the term hereof. It is agreed that presently the ratio of ad valorem tax assessment used by City is one hundred percent (100$) of the fair market value of property. Any change in such ratio used by City shall be reflected in any subsequent computations hereunder. This Agreement shall be subject to all provisions of law relating to determination of value of land, improvements, and tangible personal property, for tax purposes (e.g., rendition, assessment, Harris County Appraisal District review and appeal procedures, court appeals, etc.) for purposes of fixing and determining the amount of ad valorem tax payments, and the amount of "in lieu of tax" payments hereunder, except as otherwise provided in Articles II and VI hereof. VI. (A) In the event Company elects to protest the valuation for tax purposes set on its said properties by City or by the Harris • • Industrial District Agreement - 7 County Appraisal District for any year or years during the terms hereof, nothing in this Agreement shall preclude such protest and Company shall have the right to take all legal steps desired by it to reduce the same. Nothwithstanding such protest by Company, Company agrees to pay to City on or before the date therefor hereinabove provided, at least the total of (a) the total amount of ad valorem taxes on the annexed portions, plus (b) the total amount of the "in lieu of taxes" on the unannexed portions of Company's hereinabove-described property which would be due by Company to City in accordance with the foregoing . ,.., provisions of this Agrement on the basis of renditions which shall be filed by Company on or before March 31 of each year during the term of this Agreement, with both the City and the Harris County Appraisal District (as the case may be) for that year. When the City or Harris County Appraisal District (as the case may be) valuation on said property of Company has been so finally determined, either as the result of final judgment of a court of competent jurisdiction or as the result of other final conclusion of the controversy, then within thirty (30) days thereafter Company shall make payment to City of any additional payment due hereunder based on such final valuation, together with applicable penalties, interests, and costs. (B) Should Company disagree with any appraisal made by the independent apppraiser selected by City pursuant to Article II above (which shall be given in writing to Company), Company shall, within twenty (20) days of receiving such copy, give written notice to the City of such disagreement. In the event Company does not give such written notice of disagreement within such time period, the appraisal made by said independent appraiser shall be final and controlling for purposes of the determination of "in lieu of taxes" payments to be made under this Agreement. Should Company give such notice of disagreement, Company shall • Industrial District Agreement - 8 also submit to the City with such notice a written statement setting forth what Company believes to be the market value of Company's hereinabove described property. Both parties agree to thereupon enter into good faith negotiations in an attempt to reach an agreement as to the market value of Company's property for "in lieu" purposes hereunder. If, after the expiration of thirty (30) days from the date the notice of disagreement was received by City, the parties have not reached agreement as to such market value, the parties agree to submit the dispute to final arbitration as provided in subparagraph (1) of this Article VI(B). Notwithstanding any such disagreement by Company, Company agrees to pay to City on or before December 31 of each year during the term hereof, at least the total of (a) the ad valorem taxes on the annexed portions, plus (b) the total amount of the "in lieu" payments which would be due ]zereunder on the basis of Company's valuations rendered and/or submitted to City by Company hereunder, or the total assessment and "in lieu of taxes" thereon for the last preceding year, whichever is higher. (1) A Board of Arbitrators shall be created composed of one person named by Company, one by City, and a third to be named by those two. In case of no agreement on this arbitrator in 10 days, the parties will join in a written request that the Chief Judge of the U.S. District Court for the Southern District of Texas appoint the third arbitrator who, (as the "Impartial Arbitrator") shall preside over the arbitration proceeding. The sole issue to be determined in the arbitration shall be resolution of the difference between the parties as to the fair market value of Company's property for calculation of the "in lieu" payment and total payment hereunder for the year in question. The Board shall hear and consider all relevant and material evidence on that issue including expert opinion, and shall render its written decision as promptly as practicable. That decision shall then be final and binding upon the parties, • Industrial District Agreement - 9 subject only to judicial review as may be available under the Texas General Arbitration Act (Articles 224-238, Vernon's Annot- ated Revised Civil Statutes of Texas). Costs of the arbitration shall be shared equally by the Company and the City, provided that each party shall bear its own attorneys fees. (C) Should the provisions of Article II of this Agreement become impossible of enforcement because of (1) the invalidity or unenforceability of the Texas Property Code (S.B. 621, Acts of the 65th Texas Legislature, Regular Session, 1979), or any relevant provision thereof, or (2) because of any material delay or failure to act~on the part of the Harris County Appraisal District, then and iri any of such events, all payments under this Agreement shall be governed by the provisions of Article II hereof; anything to the contrary in this Agreement notwithstanding. VII. City shall be entitled to a tax lien on Company's above-described property, all improvements thereon, and all tangible personal property thereon, in the event of default in payment of "in lieu of taxes" payments hereunder, which shall accrue penalty and interest in like manner as delinquent taxes, and which shall be collectible by City in the same manner as provided by law for delinquent taxes. VIII. Company agrees to provide to City at Company's expense, a survey plat and field note description of the land and improvements which Company petitions to be annexed in accordance with the provisions of Article II above. Such annexation tract shall be contiguous to a point on the existing corporate limits of La Porte. In the event of failure of Company to file either such petition, or such description, City shall have the right by notice in writing to Company to cancel and terminate this Agreement. • Industrial District Agreement - 10 IX. This Agreement shall inure to the benefit of and be binding upon City and Company, and upon Company's successors and assigns, affiliates and subsidiaries, and shall remain in force whether Company sells, assigns, or in any other manner disposes of, either voluntarily or by operation of law, all or any part of the property belonging to it within the territory hereinabove described, and the agreements herein contained shall be held to be covenants running with the land owned by Company situated within said territory, for so long as this Agreement or any extension thereof remains in force. X. If City enters into an Agreement with any other landowner with respect to an industrial district or enters into a renewal of any existing industrial district agreements after the effective date hereof and while this Agreement is in effect, which contains terms and provisions more favorable to the landowner than those in this Agreement, Company and its assigns shall have the right to amend this Agreement and City agrees to amend same to embrace the more favorable terms of such agreement or renewal agreement; provided, however, City reserves the right to enter into such agreements or renewal agreements with other landowners not covered by existing agreements, containing a percentage of ad valorem taxes more favorable to the landowner than that contained in Paragraph II, Subparagraph 3 (2) hereof, and Company and its assigns shall not have the right to amend this agreement to embrace the more favorable percentage of ad valorem taxes contained in such agreement or renewal thereof, than that contained in Paragraph II, Subparagraph 3 (2) hereof. City may extend more favorable terms to landowners covered by existing contracts only to the extent such favorable terms apply to any increase in value of the hereinabove described property, in excess of the appraised value of same on January 1, 1986, as described in Paragraph II,~ Sub- paragraph 3 (2) hereof. In the event any one or more words, phrases, clauses, sentences, paragraphs, sections, articles or other parts of this Agreement or the applieaton thereof to any person, firm, corporation or circum- stances shall be held by any court of competent jurisdiction to be invalid or unconstitutional for any reason, then the application, invalidity or unconstitutionality of such words, phrase, clause, sentence, paragraph, section, article or other part of the Agreement shall be deemed to be independent of and separable from the remainder of this Agreement and the validity of the remaining partes of this Agreement shall not be affected thereby. XII. Upon the commencement of the term of this Agreement, all other previously existing industrial district agreements with respect to said land shall terminate. The provisions of the preceding paragraph hereof shall remain in full force and effect during the term of this Industrial District Agreement; provided, however, at such time as Company commences improvements to Company's hereinabove described real property, Company shall be entitled to pay an amount "in lieu of taxes" on Company's land, improvements, and tangible personal property on the above described property, in accordance with Paragraph II of this Industrial District Agreement. 3. Company agrees that the real property of Company herein described shall not be used as a site for commercial hazardous waste incineration, i.e., incineration of hazardous wastes generated offsite; provided, however, City does not waive its rights reserved under Paragraph I of this agreement. 4. The Council considered the application at its meeting on January 27, 1992. The question raised by Council, as I understand it, involved the Planning and Zoning Commission's recommendation that the applicant be allowed to place screening of the storage yard on public right-of-way. The Zoning Ordinance, Section 6-600(B)(2) requires that outdoor storage be screened from public right-of-way in accordance with Section 6-600(A). The referenced Special Conditional Use Permit application involves outdoor storage that is subject to the above Ordinance requirements. The Zoning Ordinance is silent as to whether the screening required is to be placed on private property, as opposed to contiguous public right-of-way. However, the Zoning Ordinance does allow for landscaping to be on public right-of-way, provided the owner hold the public entity harmless from any adverse consequences due to the landscaping over public use of its right-of-way. See Section 10-504 and Section 10-508 for Zoning Ordinance landscaping requirements. In the Zoning Ordinance, landscaping is a concept loosely related to screening. The Planning and Zoning Commission was made aware of the fact that the screening in question was to be in the right-of-way, and was within its jurisdiction and Ordinance authority to recommend approval to-the City Council of SCU91-001 in its present form. Fairmont Parkway), visited staff after the Council meeting and has revised his plans for the requested boat and R. V. storage yard. In brief, the revisions are as follows.. (Please refer to attached Exhibit A): A. The existing fence is to be removed from the western face of the property. B. Enclosing walls are to be erected in the southern openings of the existing carwash stalls. This will meet the Zoning Ordinance test for screening of open storage. All open storage as defined by the Ordinance will take place within and behind the carwash stalls. C. The fence between the carwash area and mini warehouses will be removed. This will allow vehicle communication between the areas and allow the complex's existing main gate to be utilized for access. D. As originally proposed, landscape screening will be placed along the western face of the property. E. The paved area located between .Fairmont Parkway and the carwash stalls will remain unfenced and be utilized as a parking area, primarily for rental trucks. This activity is defined as outdoor sales and service which the Zoning Ordinance classifies as a Permitted Use. Outside sales and service does not require a Conditional Use Permit or special approval by Planning and Zoning Commission or City Council. Page 2 Mr. McElveen stated that his revised proposal will still allow him to operate a viable boat and R. V. storage facility while also alleviating a parking problem_tha.t ha_s -developed due to the increasing volume of his truck -and. trailer_ rental business. In essence, severe hydrogen sulfide corrosion of the suction piping and north wall of the wet well could result in structural failure. Lift Station 30 has a long history: It started as the headcaorks for the former Fairmont Trickling Filter Treatment Plant. When the former City of Lomax consolidated with La Porte in 1980, wastewater formerly pumped to Deer Park was diverted through the construction of a 16 inch force main, along Big Island Slough, to the headwcrks of the Fairmont Plant for treatment. In 1984, numerous complaints regarding odor from the plant resulted construction of a concrete cover over the open wet caell. In 1986, with the completion cf the Fairmont Parkway Trunk Sewer, the Plant was abandoned and demolished, and the headworks was converted to a lift station, discharging into the new trunk sewer for final treatment at the newly expanded Main Wastewater Treatment Plant. which is highly corrosive to metal pipe and concrete. Several issues have contributed to the recent problem. The force main from Lomax enters the wet well from the top through an open pipe, with the discharge falling 10 feet to normal wet well levels. The extreme drop causes hydrogen sulfide to be released from the influent in Large quantities. With the c4et well enclosed by the top installed in 1984, large concentrations of gas are present, Lift Station 30 is a strategic part of the collection system. Failure would isolate Fairmont Park, Glen Meadows, Creekmont and Lomax. The replacement is necessary due to damages from sewer repair, construction of the East La Porte Relief Sewer and deteriorating storm sewers.The budgeted amount included street replacement and storm sewer rehabilitation. A routine T.V. inspection of the existing sanitary sewer revealed advanced decay of the pipe material. Additionally, the line is located under the paved street section and is undersized. In fact, the existing 8" line carries sewer from twc intersecting S" lines. Grant of 1907 Lomax Drive be appointed to fill the existing vacancy on our Board of Adjustment. Sidney presently serves as an alternate on this Board and has a keen interest in land use matters. He served as Chairman of the Zoning Board for the City of Lomax and showed good judgement and strong leadership in that position. Sidney is in his early 60's and rose through the ranks of Shell Oil Company to become one of the top supervisors at their Deer Park refinery before he took early retirement.
