Council considered an ordinance setting rates for use of Municipal Recreation and Fitness Center. councilperson Gay had a concern with what he felt was "double paying" by citizens, that is, tax money is being used to build the facility and then the citizens are going to be charged to use it. He also had concern with senior citizens being charged. Stan Sherwood explained that all seniors who were part of the Senior citizens program do not have to pay to use the facility for Senior citizen-related activities. If they use the facility after the Senior citizen program is over for the day, then they would pay one-half price. David Hyde reviewed the proposed fee structure. Stan Sherwood answered questions from Council. Discussion was held regarding not allowing 16-year olds to use the facility unless they are accompanied by their guardian or other adult. It was explained that this is not in the ordinance, but appears in the policy manual for the use of the facility. Motion was made by Councilperson Gay that since this should probably be a Dart of the ordinance. to table the ordinance until the next meetinq. Second by councilperson Skelton. There was discussion regarding fees for senior citizens and also use of the facilities by the general public during times that classes for the seniors are in session. councilperson Skelton expressed concern that senior citizens would be charged too much, even at half price. Dan Kennedy, e e Minutes, Regular Meeting, La Porte City Council March 23, 1992, Page 5 who was in the audience, addressed this issue. In his opinion, seniors want to pay their fair share, and he sees nothing wrong with paying half price. Council is now asked to consider ordinances condemning and ordering the demolition of twelve of these structures. A separate ordinance has been prepared for each of the buildings being considered. Staff will provide a final update regarding the status of each structure during the April 23rd meeting. Recommendation: Pass ordinances condemning and ordering the demolition of all twelve buildings under consideration. Action Required by Council: Consider passage of condemnation ordinances. ----------------------------------------------------------------- ----------------------------------------------------------------- Availability of Funds: Not applicable to this phase of project. In the past, problems have arisen when individuals were granted a period of time in which to demolish their structures and for one reason or another, the demolition was not completed. It delayed the City in completing the demolition for periods of up to one (1) year. In order to avoid such problems in the future and at the same time allow the owner a period of time to demolish, the staff proposes the following: · AlI,properties listed on the agenda will have the Condemnation Ordinance completed. The owner will be granted a period of time, not to exceed ninety (90) days to complete the demolition. The clock would begin upon passage of the demolition ordinance. All property owners desiring to demolish their own structure must sign the "Consent to Destruction" agreement with an effective date ninety (90) days from passage of the Condemnation Ordinance. This agreement would be signed at the time of permitting for the demolition. The staff feels that this proposal will allow the City to complete the demolition of all condemned structures within a reasonable period of time and it will avoid any problems experienced in the past. McGEE (Ord. 1822) e e REQUEST FOR CITY COUNCIL AGENDA ITEM AGENDA DATE REQUESTED March 9. 1992 REQUESTED BY Jeff Litchfield DEPARTMENT Director of Finance REPORT RESOLUTION xx ORDINANCE EXHIBITS: Memorandum to John Joerns, Assistant City Manager Ordinance SUMMARY AND RECOMMENDATION Throughout its existence, the City of La Porte has been asked by property owners to sell them unimproved street and/or alley rights-of-ways that are adjacent to their property. When the City, and appropriate utility companies have no foreseeable uses for the property, the property is normally "sold" to the property owner. The method of calculating the value of the property being "sold" to the property owner was changed in 1987. Prior to 1987, the process required that an appraisal be obtained by an independent fee appraiser. This process was determined to be time consuming and costly. In some instances, the cost of the appraisal exceeded the value of the property being sold. In May of 1987, the City Council changed the method by which the property values were obtainpd. The method included the obtainment of a base "prime" square foot rate from the Harris County Appraisal District (HCAD) and multiplying this rate by 150% to arrive at the "selling" square foot rate. Because of apparent discrepancies between the "prime" rates obtained from HCAD and the City's inability to receive this information on a timely basis, I reviewed the process and have concluded that we can meet the objectives of the ordinance in an easier and more understandable manner. Staff recommends that, in lieu of the "prime" square foot rate at a factor of 150%, the City use the square foot rate that is on the most recent certified tax roll and apply a factor of 175%. This change will provide a "selling" price that is easier to obtain and more understandable for the parties involved, without any apparent financial impact on the City. In addition, because of the sporadic nature of the closings, the revenue stream that is provided varies greatly from year to year. The sales of these types of property are a loss of a City asset. They are not properties that the City has purchased and held for resale. I believe that the loss of a City asset of this type should be reinvested into another asset and not be used in ordinary maintenance and operation. To use these funds for maintenance and operation expenses could greatly upset continuity between the City's revenue and expense streams. Staff recommends that the proceeds received from the sale of streets and/or alleys be deposited into the General Capital Improvement Fund for use in general capital improvements. ACTION REQUIRED BY COUNCIL: Approve or deny the passage of the Ordinance which changes the method of valuation and provides instructions on the deposit of the proceeds. AVAILABILITY OF FUNDS: GENERAL FUND UTILITY FUND OTHER ACCOUNT NUMBER: N/A FUNDS AVAILABLE: YES NO APPROVED FOR CITY COUNCIL AGENDA QMT~ ROBERT T HERRERA CITY MANAGER 8...~...~"1/ DATE e e CITY OF LA PORTE INTER-OFFICE MEMORANDUM TO: John Joerns, Assistant City Manager FRO~ff Litchfield, Director of Finance DAT~- February 25, 1992 SUBJECT: Review of Street and Alley Closing Sales Price I have completed a review of the current process we use in determining the sales price of public rights-of-way that the City owns when an adjoining property owner requests closure of the property. We currently utilize the method of obtaining the "prime" rate for adjoining property from the Harris County Appraisal District (HCAD) and authorize sale of the property at 150% times the "prime" rate. If either the City or the purchaser disagrees with the sales price, they may, at purchaser's expense, request an appraisal by an independent appraiser. Because of apparent discrepancies between "prime" rates for similar properties and the inadequate response time from HCAD, I was asked to review the process. I contacted Linda Gutierrez, Jurisdiction Support, with HCAD. I was told the following: HCAD does not have a "prime" rate for all properties. They do have a series of different rates that they use to appraise certain, but not all properties. One of the rates does relate to the properties access to major thoroughfares and another relates to "back forty" type of property. She never named the first rate but I assume that is what we call the "prime" rate. The above mentioned rate does not exist for every piece of property in the City, therefore, they sometimes have to create the rate for property when we request a rate. In calculating the "prime" rate for property that we need the rate for, they take into consideration the use or potential use of the property. She specifically mentioned that if the property is surrounded by property owned by one individual, it has a very small market value because the only individual that could feasibly use it would be that one property owner. My observations after talking to Linda were that we have been asking them to perform a service that is outside the scope of our relationship and for which they do not have standard procedures to follow. When asked, she indicated that we are the only entity that requests such service from them. . e With this in mind, I went back to the primary reason for the process. It is my understanding that the purpose of using the "prime" rate was to speed up the process of determining a sales value and to provide an escape for small properties where potentially the cost of the appraisal would be greater than the value of the property. The other concern is the time it takes to get a rate from HCAD. Recently, I had five properties to get rates for. I faxed them to HCAD on January 16, 1992. After several calls of inquiry, I finally received the values on February 6, 1992, which was three weeks later. If one of the objects of using HCAD to provide a "prime" rate for the property is to render an accurate mechanism of determining the value of the property without having the proposed buyer obtain a property value appraisal, I suggest that we utilize values that are on the published tax rolls. Using the published values on the tax rolls has several merits, including, the values are available to the general public and do not appear to come out of the air as some of the prime rates do, the values are easily obtainable by staff and would greatly enhance our project turn around time, and the values are supposed to represent some sort of market value. For the same five properties that it took HCAD three weeks to calculate, I calculated in less than one hour. The process I followed for each property was to look up all surrounding properties that touch the property being requested to be sold. I obtained a weighted average of the properties on a square footage basis. This is what I found. Total value of properties being sold at the prime sq. ft. rate $39,859.33 Total prime sq. ft. rate times the 150% factor. 59,788.50 Total value of properties being sold at published sq. ft. rate 35,910.72 If the City were to utilize the published tax roll rate, for the above five properties, the markup factor needed to obtain the same revenues as provided by the current method of prime rate times 150% would be 167%. I would recommend that the City use a factor of 175%. The City or the proposed purchaser would still be able to obtain a private appraisal (at purchasers cost) if they so desired. While the ordinance is open, there are two additional areas that need to be addressed. A statement should be entered that would order the deposit of the funds into the General Capital Improvement Fund. These sales of property are a loss of a City asset. They are not properties that are held by the City for resale at a gain. A loss of a City asset should be reinvested into the City in another Capital Asset and not be used in ordinary maintenance and operations. e e And finally, the current ordinance requires that a plot plan, drawn by a licensed Texas public surveyor, be included with the application. For many of the properties requested to be closed, there exist a recorded plat that contains all the information that the plot would provide. It would be beneficial to allow someone from the city, preferably the City Engineer, to waive the requirement of the plot plan if sufficient information is contained on the recorded plat. Recommendation The City should change the method of obtain values of public rights-of-ways that are sold to an adjoining property owner. Ordinance 1550 should be changed to reflect that the City of La Porte will utilize the published tax value on the most recent tax roll to determine the square foot value and apply a factor or markup of 175% to this value to obtain the sales price. The change to the ordinance that would accomplish this would occur in the paragraph that begins "Upon agreement" and would be to delete the words "Prime Rate" and to change the factor to 1.75. In addition, the ordinance should be amended to state that, unless otherwise directed by City Council, all proceeds from the sale of these types of properties should be deposited into the General Capital Improvement Fund for future reinvestment in the City. This would help prevent the dilution of City assets while still providing Council the means of diverting these funds as they see fit. Finally, the ordinance should be amended to provide the City Engineer, or his designee, the latitude to waive the requirement for the plot plan when the recorded plat contain the information that would be gathered by the plot plan. . e ORDINANCE NO. Attached to the enclosed ordinance is a "Financial Management Policy" that addresses these practices. The policy puts on paper the majority of the financial issues that we currently operate under. Staff believes that it would be in the city's best interest to have these policies adopted by the City Council. An excerpt from the policy cover page states: "The City of La Porte Financial Management Policies provide a basic framework for the overall fiscal management of the City. The policies represent a foundation to address changing circumstances and conditions, and assist in the decision making process. The financial policies represent guidelines for evaluating both current activities and proposals for future programs. The Financial Management Policies reflect long-standing principles and practices which have enabled the City to maintain its financial stability. It is intended that the policies be reviewed annually so that the guidelines represent a realistic, current framework for public policy decisions. Policy statements are included for the following areas: Operating Budget Revenue Reserve Debt Capital Budget Accounting Investment" The City will benefit in two ways from the adoption of these policies. First, we will have a reference guide to refer to when dealing with financial issues, and second, credit agencies such as Moody's and Standard and poor's, will see evidence of the city's ability to properly manage its operations. Balanced budget The operating budget shall be balanced. For each fund, ongoing costs shall not exceed ongoing revenues plus available working capital balances in accordance with the Reserve Policies listed in Section 3. , Borrowing for operating expenditures (expenses) The City shall not use debt or bond financing to fund current operating expenditures (expenses). Performance evaluation Performance measurement and productivity indicators shall be integrated into the annual budgeting process. All departments shall be reviewed annually by the City Manager for such performance criteria as program initiatives, compliance with policy direction, program effectiveness and cost efficiency. Budgetary controls The City shall maintain a budgetary control system to ensure adherence to the adopted budget and associated appropriations. Regular reports shall be provided comparing actual revenues and expenditures (expenses) to budgeted amounts. Self-supporting enterprises All enterprise activities of the City shall be self-supporting to the greatest extent possible. Service planning All departments shall share in the responsibility of meeting policy goals and ensuring long-term financial viability. Future service plans and program initiatives shall be developed reflecting policy directives, projected resources and future service requirements. 1 . e Contingencies The City shall budget a contingency in each of its operating and capital improvement funds. The contingency amount shall be used at the discretion of the City Manager for items that were unexpected or unforseen during the formal budget process. GFOA DistinQuished Budget Presentation Award The City shall annually submit necessary documentation to obtain the Distinguished Budget Presentation Award as awarded by the Governmental Finance Officers Association of the United States and Canada. , 2. Revenue Policies The objectives of the revenue policies is to ensure that funding for public programs is derived from a fair. equitable and adequate resource base, while minimizing tax differential burdens. Revenue structure The City shall attempt to obtain a diversified and stable revenue system to shelter programs from short-term fluctuations in any single revenue source. Potential revenue sources will be evaluated and, if feasible. initiated. Revenue collection The City shall follow an aggressive, but humane, policy of collecting revenues. Sources of services financing Services which have a city-wide benefit shall be financed with revenue sources which are generated from a broad base. such as property and other taxes. Services where the customer determines the use shall be financed with user fees, charges and assessments directly related to the level of service provided. Tax base capacity The objective of the City is to ensure that local general tax resources are not increased faster than the tax base capacity of the community. 2 e e ~' User fees The City shall maximize the utilization of user charges in lieu of general revenue sources for services that can be individually identified and where costs are directly related to the level of service. Cost of service - The City shall establish user charges and fees at a level which reflects the costs of providing the service, to the extent legally allowable. Operating, direct, indirect and capital costs shall be considered in the charges. Full cost charges shall be imposed unless it is determined that policy and market factors require lower fees. An example of this type of an exception is the residential solidwaste service, which will be funded equally with user fees and property tax revenues. Policy and market considerations - The City shall also consider policy objectives and market rates and charges levied by other public and private organizations for similar services when fees and charges are established. Bi-annual review - The City Manager shall direct a bi-annual review of fees and charges for services and will make appropriate modifications to ensure that charges grow at a rate which keeps pace with the cost of efficiently providing the service and to assure that one group of users are not subsidized by the general populace. Non-resident charges - Where practical, user fees and other appropriate charges shall be levied for activities or facilities in which non-residents participate in order to relieve the burden on City residents. Non-resident fees shall be structured at market levels so that resident users are subsidized to the greatest extent possible. Water and sewer rates - User charge fees for water and sewer shall be sufficient to finance all operating, capital and debt service costs for these utilities. Rates will be set such that these enterprise funds are never in a cash deficit position during the year. Additionally, where feasible, rates will be established where each portion of the service will cover the cost of the service provided. Internal service fees - When interdepartmental charges are used to finance internal enterprise functions, charges shall reflect full costs, including all indirect expenses. Donated revenues - All private money donated or contributed to the City for operations, maintenance, purchase of equipment, supplies, land or capital facilities shall be subject to current budget policies. The donated or contributed funds shall be deposited as miscellaneous revenues into the appropriate fund and the expenditure (expense) shall be budgeted (through a formal budget amendment, if required). 3 e e Administrative Transfers The City shall recover from selected enterprise operations an administrative fee. The fee shall be considered a payment for certain administrative functions (oversight management, accounting, human resource assistance, etc) and for payments in-lieu of taxes (Le. if the operation was operated by someone other than the City, the City would receive property tax revenues). Flat Fee Transfers - Transfers from the Utility and La Porte Area Water Authority Funds to the General Fund will be determined by City management during the budget process and shall not exceed an overhead allocation , where administrative fees are distributed to all City divisions based on their share of non-capital expenditures (expenses) as compared to all City non- capital expenditures (expenses). Transfer from Golf Course Fund - An administrative transfer from the Golf Course Fund to the General Fund shall be based on 10% of its estimated ending working capital balance, as long as its the transfer does not cause its working capital balance to fall below its targeted reserve balance as established in Section 3. Transfer from Commercial Solidwaste Fund - Upon successful privitation of the commercial solidwaste operation, the Commercial Solidwaste Fund will be dissolved by an administrative transfer to the General Fund. These transfers will occur over a multi-year period to minimize the impact on ongoing General Fund revenues. 3. Reserve Policies The objectives of the reserve policies is not to hold resources solely as a source of interest revenue, but rather to provide adequate resources for cash flow and contingency purposes, while maintaining reasonable tax rates and charges for services. Any excesses over this amount will be used over a sufficient length of time as to provide a minimum impact on the City's Interest and Sinking portion of the tax rate. 4 e e 4. Debt Policies The objectives of the debt management policies is to maintain the City's ability to incur present and future debt at minimal interest rates in amounts needed for infrastructure and economic development of the City without endangering the City's ability to finance essential City services. Revenue supported bonds The City shall utilize, where feasible, revenue supported or backed bonds to finance public improvements for its enterprise operations. Debt management The City shall strive to maintain a balanced relationship between debt service requirements and current operating costs, encourage growth of the tax base, actively seek alternative funding sources, minimize interest costs and maximize investment rate of returns. Bond term The City shall issue bonds with terms no longer than the economic useful life of the project. For revenue supported bonds, principal repayments and associated interest costs shall not exceed projected revenue streams. 5. Capital Budget Policies The objective of the capital budget policies is to ensure that the City maintains its public infrastructure in the most efficient manner. Capital improvement program The City shall prepare and adopt a five-year Capital Improvement Program which shall detail each capital project, the estimated cost, and funding source. An adopted priority system shall be used to rank recommended projects. Operated budget impacts Operating expenditures (expenses) shall be programmed to include the cost of implementing the Capital Improvement Program and shall reflect estimates of all associated personal expenditures (expenses) and operating costs attributable to the capital outlays. 5 e e .... Repair and replacement The City shall maintain its physical assets at a level adequate to protect the City's capital investments and minimize future maintenance and replacement costs. The capital budget shall provide for the adequate maintenance, repair and orderly replacement of the capital plant and equipment from current revenues where possible. 6. Herrera Department: Administration Report Resolution x Ordinance Exhibits: SUMMARY & RECOMMENDATION The attached contract is one whereby the city is contracting office space with Confrontation Church of God in Christ then subleasing the property to the Texas Department of Human Services. Please recall at one time the Texas Department of Human Services leased from the City of La Porte office space adjacent to the Police Department. Sometime in 1991 they moved their offices out of La Porte into Bay town. The Texas Department of Human Services has made a commitment to reopen a food stamp division of their agency in La Porte. The office will be open twice a week for the next eight (8) months. The Department of Human Services has also committed to expanding the services they offer in La Porte on a long term basis. They are currently negotiating with Reverend Joe Lewis for such an opportunity. I truly believe this agreement will benefit many. · Those in need of social services Church is provided with new steady income stream The City's Police Department has additional office space to meet growth by assuming the space once occupied by Texas Department of Human Services The City's role in this arrangement is one whereby we recognize a need within the community that can be better fulfilled by another public agency and put the parties together. The city is not spending any money nor does the ci ty make any money on this proposal. The Texas Department of Human Services is interested in leasing this space and appreciates the interest and effort demonstrated by yourself, Mayor MaIone, Senator Chet Brooks, Reverend Lewis, and several other interested members of your community. The General Services Commission is the leasing agent for State Agencies in the State of Texas. A representative from General Services will have to sign the lease. I have enclosed a Negotiated Lease which is a standard lease form used by this agency when negotiating contracts with other governmental entities, such as cities like the City of LaPorte. If you would please sign the enclosed lease and then return it to me, I will forward it to Austin. There is one discrepancy noted in your letter of March 2, 1992. Reverend Lewis and I discussed a full service lease at $.95 per square foot. This was to include the lessor paying for all utilities and janitorial services. Janitorial Services was omi tted from your proposal but is included in the negotiated contract. John H. Winters Human Services Center · 701 West 51st Street Central Office Mailing Address P.O. The lessor is Confrontation Church of God in Christ located at 501 West Main street. Reverend Joe Lewis is very pleased with this opportunity and has agreed to lease 481 sq. ft. to the City at ninety-five cents (.95) per square foot including utilities. The term of the lease will be for eight (8) months beginning on March 1, 1992, and expiring on December 31, 1992. Lease payments will be due on the 15th of each month. In turn, the City will contract with the Texas Department of Human Services for the same lease requirement stipulations. The City is also closely negotiating a permanent lease agreement with Reverend Lewis for the remaining portion of the office space for the expansion of the Food stamp Division of the Texas Department of Human Services in La Porte. Once we have completed this effort the same lease terms will be honored by the City and forwarded to your office under a separate lease. I truly want to thank you for returning the Food Stamp Program to La Porte, Texas. I am convinced without your sincere efforts and leadership this much needed social service program would not have returned. P,U,Bllxlll'). Box ll15 La Porte, Texas 77572-l115 Dear Mayor Malone: The City of Houston and Harris County are dedicated to reaching solutions to the criminal justice challenges facing local communities today. One of the great challenges is the early release of parolees back into our community. In this regard, the City Council and Commissioners Court have adopted a joint resolution that solidifies our commitment and outlines a short-term agenda for bringing this goal to fruition. Please find this resolution attached for your review. This agenda is not a panacea, but one that will bring about worthwhile changes to the current system. We will continue to look at other administrative and legislative solutions to our state's criminal justice problems. We encourage you to adopt similar strategies in lobbying our State representatives on these issues. We must make ourselves heard in Austin. We urge you to join our fight for meaningful reform. Sincerely, ~~ ~~ '-' Bob Lanier Mayor ~dsa~1 'County Judge @ Printed on Recycled Paper e e RESOLUTION NO. 92-05 WHEREAS, rampant crime continues to be the number one problem in Houston/Harris County, resulting in law-abiding citizens living in fear of crime; and WHEREAS, a leading cause of crime in Houston/Harris county is the early release of parolees who have not served significant portion of their sentence; and WHEREAS, the early release of parolees in Texas has been caused by a severe shortage of state prison and correction facilities for felons and by overly restrictive court orders agreed to by the state in the Ruiz prison overcrowding lawsuits; and WHEREAS, early release has become so extensive that convicted felons are routinely released on parole having served less than one month for each year of their sentence; and WHEREAS, lack of adequate supervision of parolees by the state in Houston/Harris county. has made this region a parolee haven, especially since a lack of corrections facilities for parole ~iolators allows parolees to violate the terms of their parole with impunity; and WHEREAS, fear of crime has resulted in the 10ss of convention business in Houston/Harris County and damaged the ability of Houston/Harris County to attract new businesses to the region. , NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: section 1. The Governor of Texas is requested to work with the City of Houston and Harris County to develop reliable and objective numerical information on parolees, their destinations, and the allocation of parole officers per parolee. section 3. The Governor of Texas is requested to work with the city of Houston and Harris County to reform the process by which parolees are released in the Houston area, including improved communication between Pardons and Paroles and 10cal law enforcement agencies. section 4. State Officials are requested to establish as soon as possible an intermediate sanctions facility for parole violators in Houston/Harris County. section 6. The Attorney General should immediately request the Federal Courts for an expedited hearing of the State's attempt to reverse the earlier Ruiz court actions and that the State must fight the Ruiz plaintiffs and Judge Justice by not compromising nor settling for a hollow victory that ends the Ruiz lawsuit yet leaves in place the expensive restrictions of that litigation. section 7. The Texas Department of Criminal Justice should change the policy on "gate money" to require parolees to check in to their halfway house before receiving all $200 instead of the present practice of receiving all of the money upon leaving prison. Further, the ,money should be disbursed over the term of their stay at thehalfway house. - e Resolution 92-05, Page 2 Section 8. The Texas Department of Criminal Justice should transport parolees to halfway houses using TDCJ buses when those vehicles are scheduled to travel empty ,outbound from Huntsville to retrieve new admissions into the State prison system. The Texas Commission on Jail Standards and Texas Department of Criminal Justice should responsibly implement all of the provis~ons of H.B. 93 of the second called session of the 72nd Legislative and the County/State litigation settlement agreement. section 11. These change orders amount to $15,924.00. The current Contingency Fund of $45,279.00 would be reduced to $29,355.00 if these change orders are approved as recommended. The change orders as requested have been created by a number of factors which were unpredictable at the start of the proj ect. Items "c" and "F" were due to unknown situations in the existing building that now must be corrected to interface with the new construction. Items "A", "D", and "E" were due to equipment and design changes. Items "G" and "H" were changes required by the State of Texas to meet handicapped accessibility requirements. Item "B" was a requirement of the Fire Marshall. Item "I" was required as we have now acquired the property to the north and must make allowances to incorporate it into an overall site plan. The staff is satisfied that the proposed change orders are necessary to complete the project and therefore, recommend that the total of $15,924.00 be added to the contract with Marcus Thomas and Company, Inc. TWC Explanation of Fees for Regional Water Quality Assessment Program SUMMARY & RECOMMENDATION The Texas Legislature passed Senate Bill 818 in the regular 1991 session calling for a comprehensive water quality assessment in each river basin in Texas. This bill allowed the Texas Water Commission to recover reasonable fees from the state wastewater discharge permit holders to fund this program. Most cities were not aware of the fee portion of this bill. The City of La Porte did not budget for this expenditure. The city's fee for this assessment is seven thousand, three hundred and sixteen dollars ($7,316.00). This expenditure would have a major impact on the Wastewater Treatment Operating Budget. The line item to be used for this type fee is also used to cover costs of wastewater treatment from the South La Porte (Bay MUD) area at the Gulf Coast Waste Disposal Authority along with other fees and costs of required sampling. The Gulf Coast Waste Disposal Authority has notified the City of a large rate increase and required Bio- Monitoring of Plant effluent will begin this summer. Staff expects this line item to be expended by the September 30, 1992 end of the current fiscal year. staff recommends approval of payment of the Texas Water Commission Regional Water Quality Assessment Program fee of $7,316.00. Staff further recommends transfer of funds from the Utility Fund Contingency Fund to cover this expenditure. As of February 29, 1992, the Utility Contingency Fund had a balance of $57,416.40. . LPS Form AR4OC1 (Rev, 02-20-92) e e RECEIVED EXPLANATION OF FEES REGIONAL WATER QUALITY ASSESSMENT PROG MAR 2 1992 Ci I" MANAGERS OFFICE Senate Bill 818, which was passed by the Texas Legislature in the 1991 regular session and went into effect in June, 1991, requires a comprehensive water quality assessment in each river basin. In most cases, the assessment will be done by a river authority, or other designated local government, under supervision of the Texas Water Commission. The bill requires the Commission to recover the reasonable costs of administering the assessment program from wastewater permit holders and water right permit holders. Commission rules (TAC, Sections 320.21-320.22) were adopted to provide an equitable funding procedure, and the resulting fee calculation method is as follows: Wastewater Permits The fee is assessed on the basis of final flow and traditional pollutant limits. Flow calculations are based on the daily average flow limit in the permit; where the permit does not specify a daily average flow limit, the charge is based on 50% of the daily maximum flow limit. The fee per facility is the sum of the following: contaminated flow $300 per MGD, for 100 MGD or less $10 per MGD, over 100 MGD Uncontaminated flow $1 per MGD Traditional pollutants $2 per lb per day For permits which authorize a discharge, and/or with flow or pollutant limits, the fee will not be less than $200 nor more than $35,000. For permits without an authorized discharge, and without flow or pollutant limits, the fee is $150. For inactive permits, the fee is $100. Water Riqht Permits Charges for water rights are not included here, but will be billed separately within the next few weeks. Water right permit holders who have a water right for municipal or industrial use and who also have a wastewater permit will not be assessed a fee for the municipal or industrial portion of that wat~r right, but will be assessed a fee for the associated wastewater permit and a fee for any water right uses other than municipal or industrial. A copy of your permit may be purchased by contacting the TWC's Records Services at 512/463-8562.
