MINUTES OF THE REGULAR MEETING OF LA PORTE CITY COUNCIL
APRIL 13, 1992
1. The meeting was called to order by Mayor Malone at 6:00 P.M.
Members of City Council Present: Mayor Norman Malone,
Councilpersons Guy Sutherland, Mike Cooper, Bob Thrower, Bob
McLaughlin, Alton Porter (arrived at 6:34), Deotis Gay
(arrived at 6:34), B. Don Skelton, Jerry Clarke

2. The invocation was given by Councilperson Skelton.
3. Council considered approving the minutes of the meeting held
March 23, 1992.
Motion was made by Councilperson Thrower to approve the March
23 minutes as presented. Second by Councilperson Cooper. The
motion carried, 7 ayes and 0 nays (Councilpersons Porter and
Gay had not yet arrived).

Nays: None
4. The Mayor and Police Chief Powell presented Retiree Bill Kelly
with a gold watch and a gold "Retired" police badge to
commemorate his years of service to the city.
5. Centennial Certificates of Appreciation were presented to Tom
Turner, Jack Jackson and J. R. Ensminger.
6. Mayor Malone read a letter from Ray Foulds, commending the
Public Works Department and their service to the Glen Meadows
subdivision. He also read a letter from Ms. Joy Edwards,
expressing appreciation and commending David Hyde for his
support in locating a lost diamond from her wedding ring.

The following citizens addressed Council: Bill Bentley, who
is concerned about firearms being found in schools. He asked
Council to consider passing some kind of ordinance which would
make parents financially responsible for damages when their
children are caught with firearms.
Chuck Engelken addressed Council as a representative of the
Brookglen Home Owners Association, asking for help in getting
various stop signs, flooding problems, control of wild dogs
and asking for more frequent police patrols.
Rick Cotton was scheduled to address Council, but did not
appear.
7. Council considered an ordinance authorizing purchase of
certain parcels of land in Fairmont park subdivision, to be
dedicated for use as public park property.
The City Attorney read: ORDINANCE 1832 - AN ORDINANCE
AUTHORIZING THE PURCHASE OF CERTAIN PARCELS OF LAND IN THE
FAIRMONT PARK SUBDIVISION, TO BE DEDICATED FOR USE AS PUBLIC
PARK PROPERTY OF THE CIT OF LA PORTE; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Thrower to adopt Ordinance
1832 as read by the City Attorney. Second by Councilperson
Cooper. The motion carried, 7 ayes and 0 nays (Councilpersons
Porter and Gay had not yet arrived).

8. Council considered an ordinance authorizing the Airport
Manager to execute a lease with the U.S. Government for
installation of a clearance delivery system.
The City Attorney read: ORDINANCE 1833 - AN ORDINANCE
APPROVING AND AUTHORIZING A LEASE AGREEMENT BETWEEN THE CITY
OF LA PORTE AND THE FEDERAL AVIATION ADMINISTRATION; MAKING
VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING
AN EFFECTIVE DATE HEREOF.

9. Council considered an ordinance granting a pipe line permit to
Air Products Manufacturing Corporation.
The City Attorney read: ORDINANCE NO. 915-GG - AN ORDINANCE
GRANTING A PERMIT UNDER SECTION 18-a-3 OF ORDINANCE NO. 915,
"PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED NOVEMBER 25,
1975, TO CONSTRUCT AN 8-INCH PIPE LINE FOR THE TRANSPORTATION
OF HYDROGEN; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Clarke to adopt Ordinance
915-GG as read by the City Attornev. Second by Councilperson
Thrower. The motion carried, 7 ayes and 0 nays
(Councilpersons Porter and Gay had not yet arrived).

10. Council considered an ordinance establishing rates for use of
municipal swimming pools and the hours of operation for the
municipal swimming pools.
The City Attorney read: ORDINANCE 1644-C - AN ORDINANCE
ESTABLISHING THE RATES FOR THE USE OF THE MUNICIPAL SWIMMING
POOLS AND THE HOURS OF OPERATION FOR THE MUNICIPAL SWIMMING
POOLS.
Motion was made by Councilperson Skelton to adopt Ordinance
1644-C as read by the City Attornev. Second by Councilperson
Thrower. The motion carried, 7 ayes and 0 nays
(Councilpersons Porter and Gay had not yet arrived).

il. Council considered an ordinance authorizing the City Manager
to enter a professional services agreement with Manning
Engineering Corporation for design of lift station 30 force
main diversion.

Motion was made by Councilperson Clarke to authorize the Cit
Manager to enter into the agreement with Manning Engineering
in the amount of S6,900, and appropriate the necessary funds
from the Utility Contingency Fund. Second by Councilperson
Gay. The motion carried, 8 ayes and 1 nay.
Ayes: Councilpersons Sutherland, Cooper, Thrower, Porter,
Gay, Skelton, Clarke and Mayor Malone
Nays: Councilperson McLaughlin
12. Council considered awarding bid for 10 ton air conditioner.
Motion was made by Councilperson Thrower to award the bid for
a 10 ton air conditioner to HVAC Mechanical Services, Inc. in
the amount of 56,250. Second by Councilperson Skelton.
Motion was made by Councilperson Sutherland to amend the
motion to include selling the old unit for scrap. Second by
Councilperson Clarke. The amended motion failed, 4 ayes and
5 nays.
Ayes: Councilpersons Sutherland, Cooper, Thrower and
Clarke
Nays: Councilpersons McLaughlin, Porter, Gay, Skelton and
Mayor Malone
The original motion was voted, and the motion carried, 9 ayes
and 0 nays.

13. Administrative Reports: City Manager Bob Herrera stated that
the joint venture with Harris County for various road
improvements had proven very successful, and he is looking
forward to the City participating in more such joint ventures
with the County.
14. Council Action: Councilpersons Cooper, Thrower, McLaughlin,
Porter, Gay and Skelton brought items to Council's attention.
15. Council adjourned into executive session at 7:04 P.M. to
discuss the following items under V.A.T.S. - Article 6252-17:
(A) Section 2(E) - (Legal) - Discussion with special counsel

regarding Prince suit; (B) Section 2(E) - (Legal) - Discussion
with City Attorney regarding proposed Southwestern Bell
Telephone franchise agreement; (C) - Section 2(G) -

personnel items. Council returned to the Council table at
8:45 P.M., with no action being taken.
16. There being no further business to come before the Council,
the meeting was duly adjourned at 8:48 P.M.

This letter is to recognize the outstanding support I
received from David Hyde, employee in the City Parks and
Recreation Department, in locating a lost item in the Evelyn
Kennedy Civic Center.
Late in the day, after exercising with "Evelyn" on Monday,
March 30, 1992, I discovered the diamond from my wedding ring
was missing. As a last resort, I decided to check the
exercise area in the Civic Center. I contacted David who
readily agreed to open the building even though he had gone
for the day.
After opening the Center, David, alongside me, got down on
his hands and knees and began to search the floor area of the
building. I did not see the stone and suddenly David said
"Here it is", and handed me the diamond. When I attempted to
thank David, he said, "Oh no - I was just doing my job".
I would like to express my appreciation to the City on behalf
of the service of this employee and commend David for going
"beyond the call of duty", in his support to me in locating
the stone.

SUBJECT: Joint Venture Project between Public Sector Agencies
The purchase of this property will complete our joint venture with HL&P and the
Texas Parks & Wildlife Department.
This joint venture project reflects an entrepreneurial spirit. It opened to the
City several areas of opportunity within the definition of Economic Development
and open space enhancement.
From this venture, the City gained the following through negotiations.
1. Park property (mini-bike park) built over an abandoned landfill as
designated by the Texas Parks and Wildlife Department will be
decommissioned as public park land. The land, which is
approximately 5 acres, remains with the City and is now located in
a prime industrial growth area. This action reduces the City's
liability in having land designated as park property over an
abandoned landfill.
2. The City has been paid $64,000 for navigating the decommissioning of
the property. By doing so, private commerce is now better able to
serve growth in that immediate area (640KVA Transmission Line)
• HL&P paid $35,000 - easement purchase
• HL&P paid $29,000 - partnership venture capital
3. The City has found and received permission from the Texas Parks and
Wildlife Department to purchase 1.993 acres of land that's equal or
greater in recreational value and purpose than the mini-bike park.
This land is adjacent to an existing well utilized park in Fairmont
Park. With this expansion the City may also address a parking
problem later in development of the Fairmont Complex.
4. The property to be purchased is being bought at a good price - .75
sq.ft. or $65,099.58. Furthermore, the partnership will have
provided almost all of the costs associated with this joint venture.
I am extremely pleased with this joint venture as I believe it marks the success
City's may have when working together with common partners to solve a Bevel opment
problem.

ORDINANCE NO. 1832
AN ORDINANCE AUTHORIZING THE PURCHA5E OF CERTAIN PARCELS OF LAND IN
THE FAIRMONT PARR SUBDIVISION, TO BE DEDICATED FOR USE AS PUBLIC
PARK PROPERTY OF THE CITY OF LA PORTS; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTS:
Section 1. The City Council hereby authorizes the purchase of
the property shown as Tracts "A", "D", and "E", on a plat attached
hereto as Exhibit "A", incorporated by reference herein for all
purposes, and more particularly described by metes and bounds in two
(2) deeds attached hereto as Exhibits "B" and "C", incorporated by
reference herein for all purposes; from Eddie V. Gray, Trustee, and
G. Decker McKim, Trustee, for a total price of $65,099.58 cash. The
purchase price is hereby appropriated from the General Capital
Improvement Fund. When purchased, such property is hereby dedicated
to public park purposes of the City of La Porte.
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

Dear Mr. Gray:
This letter will confirm our recent conversations,
concerning the City of La Porte's interest in acquiring
1.993 acres of land owned by Fairmont Park Joint Venture,
located west of the Fairmont Park swimming pool recently
acquired by the City of La Porte, and extending from the
swimming pool area westward to the bayou.
The City of La Porte is in negotiations with the Texas
Department of Parks & Wildlife, for the de-commissioning of
the former City of La Porte mini-bike park on North
Broadway. To accomplish the de-commissioning of the mini-
bike park, the City of La Porte must substitute land of like
recreation value. Subject to approval of the park land
substitution by the Texas Department of Parks & Wildlife,
the City of la Porte proposes to purchase the 1.993 acre
tract in Fairmont Park, on a bargain sale basis, with the
City paying a cash consideration of $0.75 per square foot,
with Fairmont Park Joint Venture then taking an income tax
deduction for a charitable contribution to the City of La
Porte, for the difference between the price of $0.75 and
your appraised value of the 1.993 acre tract. Of course,
valuation of the tract for your income tax deduction
purposes would be a matter between you, as seller-donor,
and the Internal Revenue Service. The City of La Porte
would agree to sign and deliver appropriate receipts and
acknowledgments of the transaction for your tax purposes.
The City of La Porte would require a stake survey showing
square footage; general warranty deed; and owner's title
policy to be provided by seller at closing.

SUMMARY & RECOMMENDATION
The Federal Aviation Administration has offered to install a Clearance
Delivery System to enhance operations at the La Porte Municipal Airport.
The System will allow pilots to report flight plan information by radio,
rather than phone. The system will be installed and maintained by the FAA,
and will be housed in a concrete block building, located on the northern
quadrant of the Airport. The location has been coordinated with the
Airport Master Plan.
A formal lease with the United States Government is required. The lease
identifies the location and size of the parcel necessary (0.0074 acres).
No monetary consideration is offered for rental. The Government considers
its obligation to construct and operate the facility compensation to the
City. The City will be required to construct an all-weather (gravel) road
to the facility. The lease will expire September 30, 2012.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes the
contract, agreement or other undertaking described in the title of
this ordinance, in substantially the form as shown in the document
which is attached hereto and incorporated herein by this reference.
The Airport Manager is hereby authorized to execute such document
and all related documents on behalf of the City of La Porte. The
City Secretary is hereby authorized to attest to all such signatures
and to affix the seal of the City to all such documents.
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 3. This Ordinance shall be effective from and after

a. Together with a right-of-way for ingress to and egress from the
premises; a right-of-way or rights-of-way for establishing and maintaining a
pole line or pole lines for extending electric power, and telecommunications
facilities to the premises; and right-of-way for subsurface power,
communication and water lines to the premises; all rights-of-way to be over
the said lands and adjoining lands of the lessor, and unless herein described
by metes and bounds, to be by routes reasonably determined to be the most
convenient to the Government.
b. And the right of grading, conditioning, and installing drainage
facilities, and seeding the soil of the premises, and the removal of all
obstructions from the premises which may constitute a hindrance to the
establishment and maintenance of air navigation and telecommunications
facilities.
c. And the right to make alterations, attach fixtures, and erect
additions, structures, or signs, in or upon the premises hereby leased, which
alterations, fixtures, additions, structures or signs so placed in or upon, or
attached to the said premises shall be and remain the property of the
Government, and may be removed upon the date of expiration or termination of
this lease, or within ninety (90) days thereafter, by or on behalf of the
Government, or its grantees, or purchasers of said alterations, fixtures,
additions, structures, or signs.
2. RENEWAL OPTION:
This lease may, at the option of the Government, be renewed from year to
year and otherwise upon the terms and conditions herein specified. The
Government's options shall be deemed exercised and the lease renewed each year
for one (1) year unless the Government gives the Lessor thirty (30) days'
written notice that it will not exercise its option before this lease or any
renewal thereof expires; PROVIDED that no renewal shall extend this lease
beyond the 30th day of September 2012.
3. RENT•
The Government shall pay no monetary consideration in the form of rental,
it being mutually agreed that the rights extended to the Government herein are
in consideration of the obligation assumed by the Government in its
establishment, operation, and maintenance of the remote transmitter/receiver
outlet (RTR-O) facilities upon the premises hereby leased.
4. CANCELLATION:
The Government may terminate this lease at any time by giving at least
thirty (30) days' notice in writing to the Lessor. Said notice shall be sent
by certified or registered mail.

5. DISPUTES•
a. This lease is subject to the Contract Disputes Act of 1978 (Public
Law 95-563).
b. Except as provided in the Act, all disputes arising under or relating
to this lease shall be resolved in accordance with this clause.
c. (1) As used herein, "claim" means a written demand or assertion by
one of the parties seeking, as a legal right, the payment of
money, adjustment, or interpretation of lease terms, or other
relief, arising under or relating to this lease.
(2) A voucher, invoice, or request for payment that is not in dispute
when submitted is not a claim for the purposes of the Act.
However, where such submission is subsequently not acted upon in
a reasonable time, or disputed either as to liability or amount,
it may be converted to a claim pursuant to the Act.
(3) A claim by the Lessor shall be made in writing and submitted to
the Contracting Officer for decision. A claim by the Government
against the Lessor shall be subject to a decision by the
Contracting Officer.
d. For Lessor claims of more than $50,000, the Lessor shall submit with
the claim a certification that the claim is made in good faith, the
supporting data are accurate and complete to the best of the Lessor's
knowledge and belief; and the amount requested accurately reflects the
lease adjustment for which the Lessor believes the Government is
liable. The certification shall be executed by the Lessor if an
individual. When the Lessor is not an individual, the certification
shall be executed by a senior company official in charge at the Lessor
plant or location involved, or by an officer or general partner of the
Lessor having overall responsibility for the conduct of the Lessor's
affairs.
e. For Lessor claims of $50,000 or less, the Contracting Officer must
render a decision within 60 days. For Lessor claims in excess of
$50,000, the Contracting Officer must decide the claim within 60 days
or notify the Lessor of the date when the decision will be made.
f. The Contracting Officer's decision shall be final unless the Lessor
appeals or files a suit as provided in the Act.
g. The authority of the Contracting Officer under the Act does not extend
to claims or disputes which by statute or regulation other agencies of

the Executive Branch of the Federal Government are expressly
authorized to decide.
h. Interest on the amount found due on a Lessor claim shall be paid from
the date the claim is received by the Contracting Officer until the
date of payment. Interest on the amount found due on a Government
claim shall be paid from the date the claim is received by the Lessor
until the date of payment. Interest shall be computed at ten percent
(10~) per annum on the basis of a 365- or 366-day year, whichever
applies.
i. Except as the parties may otherwise agree, pending final resolution of
a claim by the Lessor arising under the lease, the Lessor shall
proceed diligently with the performance of the lease and its terms in
accordance with the Contracting Officer's decision.
6. OFFICIALS NOT TO BENEFIT:
No Member of or Delegate to Congress, or Resident Commissioner shall be
admitted to any share or part of this lease, or to any benefit that may arise
therefrom; but this provision shall not be construed to extend to this lease
if made with a corporation for its general benefit.
7. LESSOR WARRANTY:
The Lessor warrants that no person or selling agency has been employed or
retained to solicit or secure this lease upon an agreement or understanding
for a commission, brokerage, percentage or contingent fee, except bona fide
employees or bona fide established commercial or selling agencies maintained
by the Lessor for the purpose of securing business. For breach or violation
of this warranty, the Government shall have the right to annul this lease
without liability, or in its discretion to deduct from amounts otherwise due
under this lease or other consideration, the full amount of such commission,
brokerage, percentage, or contingent fee.
8. FUNDING RESPONSIBILITY CLASS I - II FACILITIES:
The airport owner agrees that any relocation, replacement, or modification
of any Federal Aviation Administration Class I and Class II facilities, or
components thereof, as.defined below, covered by this lease during its term or
any renewal thereof made necessary by airport improvements or changes which
impair or interrupt the technical and/or operational characteristics of the
facilities will be at the expense of the airport owner; except, when such
improvements or changes are made at the specific request of the Government.
In the event such relocations, replacements, or modifications are necessitated
due to causes not attributable to either the airport owner or the Government,
funding responsibility shall be determined by the Government.

9. NON-RESTORATION:
It is hereby agreed between the parties that upon termination of its
occupancy the Government shall have no obligation to restore and/or
rehabilitate, either wholly or partially, the property which is the subject
matter of this lease. It is further agreed that the Government may abandon in
place any or all of the structures and equipment installed in or located upon
said property by the Government during its tenure. Notice of abandonment will
be conveyed to the Lessor in writing.
10. FACILITY PLOT AND ACCESS ROAD:
The Lessor shall construct a 16-foot by 20-foot facility plot and an
all-weather access road approximately 1600 feet long by 12 feet wide for
access to the facility plot. The location of the facility plot and access
road are as shown on the attached drawing designated Exhibit "A." The
Government shall maintain the facility plot and access road.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAPORTE:
Section 1. The City Council of the City of La Porte has

Section 2. The City Council of the City of La Porte hereby
approves the applicator of AIR PRODUCTS MANUFACTURING CORPORATION,
dated April 3, 1992, and this Ordinance shall constitute a permit to
AIR PRODUCTS MANUFACTURING CORPORATION to operate said pipe line
within the City of La Porte, all in conformance with the
requirements of said Ordinance No. 915, contingent upon its filing
with the City of La Porte prior to commencement of construction,
copies of its permits from the Texas Department of Heghways and
Transportation; Harris County; and the Harris County Flood Control
District. Any future relocation of the pipeline herein permitted,
within the City, State, or County rights-of-way, shall be at the
sole expense of permittee.
Section 3. This Ordinance shall be in full force and effect
from and after its passage and approval.

SUMMARY & RECOMMENDATION
Staff is proposing four (4) changes be made in the existing Municipal

A. Current: San Jacinto, Northwest Park, and Fairmont Park Pools are
available for rental as follows:
Tuesdays thru Fridays: 9:00 p.m. til 12 midnight
Saturdays: 9:00 p.m. til 12:00 midnight
Sundays: 5:00 p.m. til 9:00 p.m.
B. Proposed: San Jacinto, Northwest Park, and Fairmont Park Pools

Staff is requesting the flexibility to work with our major~~sponsors
in offering discount admissions and special promotions to increase
our daily attendance during the months of July and August.
Further, we are requesting the authority to enter aquatic
membership sales programs with local youth organizations. This
program would increase our membership sales, and allow for a
fifteen to twenty percent rebate to the organizations in their fund
raising efforts.

AN ORDINANCE ESTABLISHING THE RATES FOR THE USE OF THE MUNICIPAL
SWIMMING POOLS AND THE HOURS OF OPERATION FOR THE MUNICIPAL
SWIMMING POOLS.
Section 1. Admission to the Municipal Swimming Pools may be
obtained by either purchase of a season pass or by paying a general
admission fee.
A. Season passes for San Jacinto, Northwest & Fairmont
Municipal Pools may be purchased at the Parks and
Recreation offices or at the municipal swimming pools.
A member of the family must apply in person for the
pass/passes.
PROOF OF RESIDENCY: For purchase of discounted resident
season passes, residents must present a current water and
sewer bill, rental receipt or tax statement with valid
Texas Drivers License. (Drivers License not acceptable
proof by itself.)
Fees established for season passes are as follows:

Exhibits: Proposal for Professional Engineering Services
SUMMARY & RECOMMENDATION
On February 5, 1992, severe hydrogen sulfide corrosion at Lift Station 30
was discovered. The main contributing factor appeared to be the force main
entering the wet well from the Lomax area at the top of the structure.
Manning Engineering was contacted to evaluate the situation and recommend
corrective action.
The evaluation was completed in March 1992 for a cost of $2,150. The
Engineer recommended the force main be diverted to the Fairmont Parkway
Trunk Sewer as soon as possible. The diversion will reduce corrosion and
pumping costs, as well as relieve surcharging in the Fairmont Park gravity
sewer system. Repairs to the wet well can be deferred until next year, to
allow budgeting. Additionally, diversion of the Creekmont and Glen Meadows
force mains from the gravity system to the Lomax force main was also
recommended. These diversions will be accomplished with city crews.
Manning Engineering has submitted a proposal to perform the necessary
design to bid this project. Total engineering cost is as follows.

Force Main Diversion for a total cost of $6,900, and appropriate the
necessary fund from the Utility Contingency Fund.

SUNIIKARY & RECOMMENDATION
Sealed bids #0475 for the replacement of the existing Air
Conditioning and Heating system at the Evelyn Kennedy Civic Center
were opened and read on March 16, 1992. Invitations for bidding
were mailed to ten (10) vendors, eight (8) vendors responded to the
bid.
HVAC Mechanical Services, Incorporated submitted a bid in the
amount of $6,250.00 for a Lennox GCS 16 Air Conditioning and
Heating system, staff recommends approval of this low bid.
Action Required by Council:
Award bid to HVAC Mechanical Services Incorporated for the purchase
and installation of a 10 ton Air Conditioning and Heating system
for the Evelyn Kennedy Civic Center.
