MINUTES OF THE REGULAR MEETING OF LA PORTE CITY COUNCIL
MAY 4, 1992
1. The meeting was called to order by Mayor Malone at 5:30 P.M.
Members of City Council Present: Mayor Norman Malone,
Councilpersons Guy Sutherland, Mike Cooper, Bob Thrower, Bob
McLaughlin, Alton Porter, Deotis Gay (arrived 5:55), B. Don
Skelton, Jerry Clarke (arrived 5:50)
Members of City Council Absent: None
Members of City Staff Present: Assistant City Manager John
Joerns, City Attorney Knox Askins, City Secretary Cherie
Black, Police Chief Bobby Powell, Planning Director Chuck
Harrington, Fire Chief Joe Sease, Finance Director Jeff
Litchfield, Human Resources/Purchasing Manager Louis Rigby,
Police Administrative Assistant Elaine Bonner, MIS Manager
Larry Mabe
Others Present: Chris Osten and members of EMS; Family of
newly elected Councilperson Jack Maxwell; John Black, Bayshore
Sun; 2 citizens
2. The invocation was given by Councilperson Thrower.
3. There were no citizens wishing to address Council.
4. Mayor Malone proclaimed May 10 through 16, 1992, as Emergency
Medical Services Week. EMS Chief Chris Osten and several
members of EMS accepted the proclamation.
5. Council canvassed the results of the City election held on May
2, 1992, and considered declaring the winners by adoption of
Ordinance 1838.
The City Attorney read: ORDINANCE 1838 - AN ORDINANCE
DECLARING THE RESULTS OF THE ELECTION HELD IN THE CITY OF LA
PORTE ON MAY 2, 1992, FOR THE ELECTION OF COUNCILPERSON-AT-
LARGE--POSITION A; COUNCILPERSON DISTRICT 4; AND
COUNCILPERSON, DISTRICT 5; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
The winners were declared to be as follows: Councilperson at
Large, Position A - Bob McLaughlin; Councilperson, District 4
- Deotis Gay; Councilperson, District 5 - Jack Maxwell.
Motion was made by Councilperson Thrower to adopt Ordinance
1838 as read by the City Attorney. Second by Councilperson
Sutherland. The motion carried, 7 ayes and 0 nays
(Councilpersons Gay and Clarke had not yet arrived.)

Nays: None
Honorable Judge J. B. Williamson gave the oath of office to
Councilpersons McLaughlin and Maxwell, who then took their
places at the Council table.
6. Council considered an ordinance naming a Mayor Pro Tem.
The Mayor asked for nominations and Councilperson Sutherland
nominated Councilperson Mike Cooper. Councilperson McLaughlin
nominated Councilperson Alton Porter.
Motion was made by Councilperson Thrower that the vote be
taken by secret ballot. After advice from the City Attorney
that this could not be done in open meeting, the motion died
for lack of a second.
Councilperson Cooper was elected as Mayor Pro Tem.
The City Attorney read: ORDINANCE 1839 - AN ORDINANCE
APPOINTING A MEMBER OF THE CITY COUNCIL TO SERVE AS MAYOR PRO
TEM OF THE CITY OF LA PORTE, FOR THE TERM MAY 4, 1992, UNTIL
MAY 4, 1993; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW;
AND PROVIDING AN EFFECTIVE DATE HEREOF.
7. Council considered an ordinance approving and authorizing an
agreement between the City of La Porte and United System
Technology, Inc., including application software contract,
application software maintenance agreement, and hardware
purchase agreement.
8. Council considered an ordinance approving and authorizing a
contract between the City of La Porte and IBM Corporation for
hardware purchase, and hardware maintenance agreement.
The City Attorney read: ORDINANCE 1840 - AN ORDINANCE
APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LA
PORTE AND UNITED SYSTEMS TECHNOLOGY, INC., INCLUDING
APPLICATION SOFTWARE CONTRACT, APPLICATION SOFTWARE
MAINTENANCE AGREEMENT, AND HARDWARE PURCHASE AGREEMENT; MAKING
VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
The City Attorney read: ORDINANCE 1841 - AN ORDINANCE
APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA
PORTE AND IBM CORPORATION FOR HARDWARE PURCHASE, AND HARDWARE
MAINTENANCE AGREEMENT; MAKING VARIOUS FINDINGS AND PROVISIONS

RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Sutherland to adopt Ordinance
1840 and Ordinance 1841 as read by the Citv Attorney,

agreements to be funded in fiscal year 92-93: and amend the
Police Administration Budget by S11 318, which re}~resents the
Public Safety Computer Support Specialist position. Second by
Councilperson Porter. The motion carried, 8 ayes and 0 nays.

McLaughlin, Porter, Maxwell, Clarke and Mayor
Malone
Nays: None
9. Administrative Reports - John Joerns announced that Fred
Thompson will be coming on board on May 26 as City Engineer.
John also extended thanks to Larry Mabe, Bobby Powell, Jeff
Litchfield and Elaine Bonner for their efforts in putting
together the package for the computer awards just approved.
At this time, Mayor Malone gave the oath of office to
Councilperson Deotis Gay, District 4.
10. Councilpersons Sutherland, Cooper, Thrower, McLaughlin,
Porter, Gay, Maxwell, Clarke and Mayor Malone brought items to
Council's attention.
11. There was no executive session.
12. There being no further business, the meeting was duly
adjourned at 6:12 P.M.

and skill of these trained individuals; and
WHEREAS,Advances in emergency medical careincreasethe number of lives
every year; and
WHEREAS, The professional organizations ofproviders of emergency medical
services promote research to improve and adapt their skills as new methods of emergency
treatment are developed; and
WHEREAS, The members of emergency medical services teams encourage
national standardization of training and testing of emergency medical personnel and reciprocal
recognition of training and credentials by the States; and
WHEREAS ,The designation of Emergency Medical Services Week will serve
to educate the people of the City of La Porte about injury prevention and what to do when
confronted with a medical emergency; and
NO W, THEREFORE, I, NORMAN L. MALONE, MAYOR of
the City of La Porte, do hereby proclaim the week of May 10-16, 1992, as
EMERGENCY MEDICAL SERVICES WEEK
in the City of La Pone, and encourage the community to observe this week with appropriate
programs, ceremonies, and activities.

AN ORDINANCE DECLARING THE RESULTS OF THE ELECTION HELD IN THE CITY
OF LA PORTE ON MAY 2, 1992, FOR THE ELECTION OF COUNCILPERSON-AT-
LARGE--POSITION A; COUNCILPERSON DISTRICT 4; AND COUNCILPERSON,
DISTRICT 5; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, there was held in the City of La Porte on the 2nd day
of May, 1992, an election for the purpose of electing Councilperson-
at-Large--Position A; Councilperson -- District 4; and Councilperson
-- District 5; all in accordance with Section 8.10 of the Home Rule
Charter of the City of La Porte; and
WHEREAS, there were cast at said election for the following
listed persons the number of votes opposite their respective names:

COUNCILPERSON -- DISTRICT 4
Deotis Gay
COUNCILPERSON -- DISTRICT 5

as shown in the official election returns heretofore delivered by
the Election Judge and officials to the Mayor and City Council of
the City of La Porte and submitted to the City Council.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE:
Section 1. That said election was duly called and notice
thereof given in accordance with law; that said election was held in
the manner required by law; that due returns of said election have
been made by the proper officers; that said returns have been
canvassed by the City Council of the City of La Porte; that said
election has resulted in the election of the following named
persons, to-wit:

Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.
