MINUTES OF THE REGULAR MEETING OF LA PORTE CITY COUNCIL
JULY 27, 1992
1. The meeting was called to order by Mayor Malone at 6:00 P.M.
Members of City Council Present: Mayor Norman Malone,

2. The invocation was given by Councilperson Alton Porter.
3.. Council considered approving the minutes of the Council
meeting held July 13, 1992.
Motion was made by Councilperson Clarke to approve the Julv 13
minutes as presented. Second by Councilperson Cooper. The
motion carried, 8 ayes and 0 nays (Councilperson Gay was away
from the table).

The Mayor delayed item 4 and addressed item 5 at this time.
°i. Centennial Certificates of Appreciation were presented to
Ramona Hardwick and Joe Camp.
4. The Mayor proclaimed PPG Day. Plant Manager Harry Hank and
two other PPG representatives accepted the proclamation and
invited citizens of La Porte to attend the country fair at PPG
on August 8.
6. Mrs. Sue Lenes addressed Council to relay greetings from
Mayor Jon Braekke of Horton, Norway, where she and husband
Peter had recently visited.

7. Council considered approving and authorizing a one year
extension of an agreement between the City of La Porte and
Country Club Catering and 19th Hole, Inc., for Bay Forest Golf
Course.

10. Council considered an ordinance appointing members to the La
Porte Area Water Authority. This item was delayed until after
the executive session.
11. Council considered an ordinance appointing members to the
Airport Advisory Board. This item was delayed until after the
executive session.
12. Council considered an ordinance approving and authorizing a
contract for sitting services at the La Porte
Recreation/Fitness Center.

1.3. Council considered an ordinance approving and authorizing a
contract for concessions at Little Cedar Bayou Wave Pool.

14. Council considered a resolution fulfilling response to EPA
Administrative Order Docket No. VI-92-0123.
Motion was made by Councilperson Porter to approve Resolution
92-06, fulfillinq response to EPA Administrative Order Docket
No. VI-92-0123. Second by Councilperson McLaughlin. The
motion carried, 9 ayes and 0 nays.

15. Council considered a consent agenda, as follows: (A) Consider
awarding a bid for hydraulic rescue equipment; (B) Consider
awarding a bid for street materials; (C) Consider awarding a
bid for automated meter reading devices.
Motion was made by Councilperson Sutherland to approve the
consent agenda as presented. Second by Councilperson Porter.

16. Administrative Reports
A. Purchasing Manager Louis Rigby reported that the city
auction held jointly with the City of Deer Park had
resulted in a total of $52,751 for La Porte.
B. Stan Sherwood reported that an opening reception for the
Recreation/Fitness Center would be held July 31 from 5:45
until 8:00 P.M., and on August 1 there will be an open
house for the public, in conjunction with a Health Fair.
C. Louis Rigby reported there will be a completion ceremony
in the Council Chambers on August 4 at 1:30 P.M. for
those employees completing the Supervisory Training
course.
D. John Joerns advised Council of a SWAT incident at Green
Oaks Apartments that had occurred today. There were no
injuries, and the suspect was taken into custody and sent
to Baywood Hospital for observation.
].7. Council Action - Councilperson McLaughlin and Mayor Malone
brought items to Council's attention.
]_8. Council adjourned into executive session at 6:52 P.M. to
address Personnel items under V.A.T.S. - Article 6252-17 -
Section 2(G), as follows: Discuss appointments to various
Boards and Commissions. Council returned to the table at 7:18
P.M. and addressed agenda items 8, 9, 10 and 11, as follows:
8. The City Attorney read: ORDINANCE 1849 - AN ORDINANCE
APPOINTING MEMBERS TO THE CITY OF LA PORTE PLANNING AND ZONING
COMMISSION; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE
WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE
HEREOF. The following persons were appointed: Chairman,

SUMMARY & RECOMMENDATION
The City of La Porte currently has a contract with Country Club Catering and 19th Hole,
Inc., to provide concessions at Bay Forest Golf Course. Country Club Catering pays the
City ten (10) percent of gross sales earned at the golf course.
The attached ordinance will extend this contract, with the same provisions, for one (1)
year.
Action Required by Council:
Approve attached ordinance to extend concessions contract at Bay Forest Golf Course
with Country Club Catering & 19th Hole, Inc., for one year.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTS:
Section 1. The City Council hereby approves and authorizes the
contract, agreement or other undertaking described in the title of
this ordinance, in substantially the form as shown in the document
which is attached hereto and incorporated herein by this reference.
The City Manager is hereby authorized to execute such document and
all related documents on behalf of the City of La Porte. The City
Secretary is hereby authorized to attest to all such signatures and
to affix the seal of the City to all such documents.
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves

Report Resolution XX Ordinance
SUNIIKARY & RECOMMENDATION
Advertised, sealed bids #0043 for the sitting service room were
opened and read on July 13, 1992. Bid requests were mailed to
eight (8) suppliers with one (1) returning bid.
The following specifications were asked to be met
1. Must be a State licensed and bonded Day Care Service.
2. Must offer service to children two (2) years through ten
(10) years of age.
Insurance requirements stated the indemnitor shall, at its sole
cost and expense, maintain in effect at all times insurance
coverages with limits not less .than those set forth in the Schedule
of Insurance Coverages with insurance companies licensed to do
business in the State of Texas (with a Best's rating of no less
than A) and acceptable to Indemnitees and under forms of policies
satisfactory to Indemnitees.
The only returning bid was from Sweet Pee's Day Care in La Porte.
Sweet Pee's did meet the specifications.
Sweet Pee's Sitting Service agrees to pay the City a monthly rate
of 28$ of gross earnings for the sitting service per month.
Further, as part of the bid, Sweet Pee's Sitting Service agrees to
charge to the public the price of $3.00 per child per hour, with a
minimum of one (1) hour and maximum of three (3) hours.
Staff recommends approval of Sweet Pee's Day Care Service for the
term of the contract to be one (1) year, with an option for the
City to renew for a total of three (3) additional years.
Action Required by Council:
Approve contract with Sweet Pee' s Day Care Service to provide a
sitting service for La Porte Recreation/Fitness Center.

Section 1. The City Council hereby approves and authorizes
the contract, agreement or other undertaking described in the title
of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The City Manager is hereby authorized to execute such
document and all related documents on behalf of the City of La
Porte. The City Secretary is hereby authorized to attest to all
such signatures and to affix the Seal of the City to all such
documents.
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to
the public as required by law at all times during which this
ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordained.

Requests for Proposals #0042 were sent out to twelve (12)
concessionaires for Little Cedar Bayou Wave Pool with no proposals
being returned. At that time the City of La Porte again contacted
several local businessmen personally, requesting that they submit
proposals. Two (2) companies responded.
Las Hadas Mexican Restaurant came in with a 15.5$ commission on
sales and Country Club Catering & 19th Hole with a 20$ commission
on sales at the wave pool.
Staff recommends awarding contract to Country Club Catering & 19th
Hole with high bid at 20~ commission for operating concessions at
Little Cedar Bayou Wave Pool.
Action Required by Council:
Authorize City Manager to sign contract between City of La Porte
and Country Club Catering & 19th Hole for operating concessions at

Excerpt from NPDES Permit
SUMMARY £u RECOMMENDATION
The National Pollutant Discharge Elimination System (NPDES) Permit for
wastewater collection and treatment, issued by the U.S. Environmental
Protection Agency, requires the City to submit, By August 1, 1992, an
Enviranmental Audit Report, accompanied by a resolution by the permittee's
governing body. The resolution must state that the governing body has read
and understands the Report, and is committed to ensuring complianr_e with
the terms of the NDPES Permits .
The City scared quite well on the Audit, primarily due to the rer_ent
expansion and upgrade of the Little Cedar bayou Wastewater Treatment Plant
and the City Counr_il's continued support of operation and maintenance
budgets. The major deficiency is with reported overflows in the collectian
system during wet weather. The resolution recognizes this, and commits to
provide adequate resources to continue the City`s Infiltration and Inflow
Redur_tion Program.

RESOLUTION NO. 92-06
WHEREAS, the City Council of the City of La Porte has found
and determined that it is in the public interest to set forth the
actions necessary to maintain the permit requirements contained in
the National Pollutant Discharge Elimination System (NPDES) Permit
issued by the Environmental Protection Agency.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE THAT THE FOLLOWING ACTIONS WERE TAKEN BY THE CITY
COUNCIL OF THE CITY OF LA PORTE:
1. Reviewed the Municipal Pollution Prevention Environmental
Audit Report which is attached to this resolution.
2. Set forth the following actions necessary to maintain
permit requirements contained in the NPDES Permit number
TX0022799:
a. Provide adequate funding in the annual budget to
maintain the treatment facilities and collection
system.
b. Provide adequate resources to continue the
Infiltration and Inflow Reduction Program as set
forth in the City of La Porte's response to the EPA
Administrative Order Docket No. VI-92-0123.

bid. The one bidder Neel Associates submitted a bid that meets the
specifications and is in an acceptable price range.
I recommend that the City award the bid to Hale Fire Pump Company
as requested by Neel Associates in the amount of $7,707.00.

Item 1-A - Cutback Asphalt MC-30 - Picked up by City Crews - Low bid was
submitted by Wright Asphalt. in the amount of $0.70 per gallon. However,
Wright Asphalt has a minimum quantity of 500 gallons and is located in
Channelview. Gulf States has no minimum quantity and is closer. Recommend
hid award to Gulf States at a price of $0.72 per gallon. Contract value
using estimated yearly quantities - $3,600.00
Items 2-A & 2-B - Liquid Asphalt Cement - AC-5 & AC-10 - Delivered -
Identical low bids of $0.47 per gallon. submitted by Wright Asphalt and

SUMMARY AND RECOMMENDATION
On July 20, 1992, the City opened and read sealed bid #0494 for automated meter reading
devices. Bid requests were mailed to six vendors with one (1) returning a bid.
The process the City desires is the ability to obtain a monthly reading for meters that
are continually submerged under water or are in an awkward location (i.e. in a fenced area
that is either kept locked or contains unfriendly dogs). The process is accomplished by
the attachment of a solid state interrogator device attached to the meter. The meter
reader places an electronic meter reading gun to a touchpad wired to the meter and presses
a button which submits an electronic signal through a wire to obtain the reading of the
meter. The meter reader can then obtain the accurate reading and enter the number into
the ITRON data capture unit. This process will not replace the ITRON system, it will
enhance it.
A misunderstanding of Bid Item 1, the device to capture the read of the meter, resulted in
the company bidding a unit the City does not desire. Therefore, we do not want to award
Item 1. The device the City needs is expected to cost around $800 each with a projected
quantity of three. We will procure these at a later date, following proper purchasing
procedures. Items 2A and 2B are for new meters fitted with the device. Items 2C and 2D
are for devices that can be retro-fitted to existing meters.
Areas targeted for initial installation include: the Spenwick area (south of Spencer and
west of Underwood); the 400 and 500 blocks of North 11th, 12th, 13th, and 14th; North
Circle and Circle Drive; Jefferson, Sylvan, Lobit, Carroll, Holmes, and Nugent Streets.

On July 20, 1992, the City opened and read sealed bid #0494 for automated

returning a bid.

The company which submitted a bid was Sensus Technologies, Inc.. Sensus was
the company the City used in their pilot program and appears to be the only
company able to provide this service to the City. The primary meter in place
in the City is a Rockwell meter. The Rockwell Meter Division is now owned by
Sensus.
The City's pilot program has been in place for one year. During that time,
the meter readers have successfully read the test meters, both those submerged
under water and those located more than 100 feet from the meter.
The bid included a requirement that the product have a proven track record in
a moisture intensive environment. A check of their references verified this
requirement. The reference they provided that most resembles the City of La
Porte was the City of Freeport. Their rainfall and drainage conditions most
resembles ours. The City of Freeport started installing their devices in 1986
and currently have several thousand installed.

2D. This group of retro-fitted meters will be placed into service in the
second targeted area and the testing and retro-fitting process will begin
anew.
