The meeting was called to order by Mayor Malone at 6:00 P.M.

The invocation was given by Mayor Malone.
Council considered approving minutes of the regular meeting
held August 24, 1992.
Motion was made by Counciloerson Cooper to approve the minutes
o August 24 as presented. Second by Councilperson
Sutherland. The motion carried, 7 ayes, 0 nays, 2 abstain.
Ayes: Councilpersons Sutherland, Cooper, Porter, Gay,
Maxwell, Clarke and Mayor Malone

Abstain: Councilpersons Thrower and McLaughlin (had not been
present at that meeting)

4. Centennial Certificates of Appreciation were presented to Hal
and Jan Lawler and children, Tim and Irene O'Connor and sons,
The La Porte Dixieland Band and Directors Lloyd and Mary Pat
Wells, Mayor and Ann Malone.
5. A Proclamation was presented to Marie Russell for Constitution
Week.
6. Proclamations were presented to Postal Employees for Charles
Gunnells, Patsy Meza, Ray Escobedo Appreciation Week.
Mayor Malone acknowledged letters of appreciation to Chief
Powell from the City of Shoreacres for the support our police
department provided during the emergency due to Hurricane
Andrew. Also, Shoreacres sent. letters of thanks to Officer
Dan Hoffman and Officer Skip Young for their professionalism
and courtesy while acting as escorts for the funeral
procession of their former Municipal Court Clerk.
Mayor Malone asked Mr. & Mrs. John Lott and daughter, Crystal,
Lt. Aaron Corrales and Lt. Carl Crisp to approach the Council
table. Mayor Malone expressed Council's appreciation for the
quick response of Lieutenants Corrales and Crisp to the
emergency call when Crystal Lott had apparently stopped
breathing.
7. There were no citizens wishing to address Council.
8. Public Hearing A - Request of Ronnie and Melody Elledge for a
Special Conditional Use Permit to allow a tract of land to be
utilized for raising livestock.
Mayor Malone Opened the Public Hearing at 6:39.
Director of Planning Chuck Harrington reviewed the applicants'
request for a Special Conditional Use Permit.
Mayor Malone asked if anyone wished to speak against the
granting of the permit. There were no citizens wishing to
speak against the permit.

request.

Council decided to move Agenda .Item 10 forward for a vote.
10. Council considered approving Special Conditional Use Permit to
allow a tract of land to be utilized for raising livestock.
MQt~on was made by Councilperson Sutherland to issue a permit
livestock. Second by Councilperson Cooper. The motion
carried, 9 ayes and 0 nays.

9. Public Hearing B - Budget for FY 1992-93
Mayor Malone opened the Public Hearing at 6:58.
City Manager Bob Herrera asked Council to consider going into
Executive Session after Public Hearing B to meet with the
Attorney who was present. Bob Herrera commended the staff on
their efforts in preparation of the 1992-93 Budget and
introduced Director of Finance Jeff Litchfield, who reviewed
the proposed budget.
The Mayor asked if anyone from the public would like to speak
regarding the proposed budget. There were no requests to
speak and the Mayor closed the public hearing at 7:05.
11. Council considered an ordinance adopting the budget for fiscal
year 1992-93.
The City Attorney read: ORDINANCE 1859 - AN ORDINANCE
APPROVING AND ADOPTING THE BUDGET FOR THE CITY OF LA PORTE,
TEXAS, FOR THE PERIOD OF OCTOBER 1, 1992 THROUGH SEPTEMBER 30,
1993; FINDING THAT ALL THING REQUISITE AND NECESSARY HAVE BEEN
DONE IN PREPARATION AND PRESENTMENT OF SAID BUDGET; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made by Councilperson McLaughlin to adopt Ordinance
3<859 as read by the City Attornev. Second by Councilperson
Thrower. The motion carried, 9 ayes and 0 nays.

returned to the Council table at 8:07 P.M., with no action
being taken.
12. Council considered a resolution adopting 1992 appraisal roll
of Harris County Appraisal District.
City Attorney read: RESOLUTION NO. 92-07 - A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, ADOPTING THE
1992 APPRAISAL ROLL OF THE HARRIS COUNTY APPRAISAL DISTRICT.
92-07 as read by the City Attorney. Second by Councilperson
Sutherland. The motion carried, 9 ayes and 0 nays.

TO TAXATION IN THE CITY OF LA PORTE, TEXAS; MAKING
APPROPRIATIONS FOR SUPPORT, MAINTENANCE, AND IMPROVEMENT OF
THE CITY GOVERNMENT OF SAID CITY OF LA PORTE; FINDING THAT ALL
REQUIRED NOTICES HAVE BEEN PUBLISHED AND ALL REQUIRED HEARINGS
HELD; CONTAINING A REPEALING CLAUSE; CONTAINING A SEVERABILITY

contract for reconstruction of East H Street and sanitary
sewer line replacement.

PORTE AND MEB ENGINEERING, INC. FOR THE RECONSTRUCTION OF EAST

16. Council considered setting a public hearing date to consider
condemnation of dangerous buildings.
Inspector Mark Lewis presented to Council dangerous building
inspection reports and a video presentation of the six
targeted structures. Council agreed to an October 12th Public
Hearing date.
17. Council considered authorizing emergency repairs and approve
payment for replacement of failed air conditioner compressor
at City Hall.
Motion was made by Councilperson Clarke to authorize emergency
repairs and approve payment to Bay Refrigeration for
replacement of failed air conditioner compressor at Citv Hall.
Second by Councilperson Gay. The motion carried, 9 ayes and
0 nays.

18. Council considered a consent agenda, as follows: (A) Consider
awarding bid for roof for Fire Station #3; (B) Consider

pipe.
Motion was made by Councilperson Porter to approve the consent

19. Administrative Reports
Mr. Herrera reminded the Council that the Dow tour to Freeport
to view the industrial incinerator is scheduled for tomorrow
morning. The Mayor stated everyone is supposed to meet at the
Post Office and leave at 7:30 A.M.

20. Council Action - Councilpersons Gay, McLaughlin, Porter and
Mayor Malone brought items to Council's attention.
21. Council adjourned into executive session at 8:45 P.M to
discuss the following under V.A.T.S. - Article 6252-17, (B)
Section 2(G) - (Personnel): Receive report from City Manager
regarding personnel matter; (C) Section 2(G) - (Personnel):
Discuss annual performance review of City Manager. Council
returned to the table at 10:22 P.M.
A. Section 2(e) - (Legal): Meet with Attorney(s) regarding
Houston Chemical Services, Inc./Southern Ionics, Inc.
Council covered this item in a previous executive session
tonight.
B. Section 2(G) - (Personnel): Receive report from City
Manager regarding personnel matter: Council upholds the
administrative decision made by the City Manager. No
action was taken.
C. Section 2(G) - (Personnel): Discuss annual performance
review of City Manager: Council held discussion only.
Adjourned from executive session at 10:20 P.M.

City Manager's salary 7 1/2$ and leave the car allowance at
5400.00 as it is presently. Second by Councilperson
McLaughlin. The motion carried 9 ayes and 0 nays.

Summary
Ronnie and Melody Elledge own a 1.44 acre tract of property located
in the Battleground Estates Subdivision. They are seeking a
Special Conditional Use (SCU) permit to allow livestock to be
housed on the property. Section 5-600 of the Zoning Ordinance
requires a SCU permit for this type of activity. The Planning and
Zoning Commission, after considering this request at it's August
20, public hearing, have recommended City Council's approval of
this request.
Council, as the final step in the review process, is required to
hold a public hearing for consideration of this request. At the
close of the hearing, Council will vote to approve or deny this
Special Conditional Use permit. Should Council choose to approve
the permit, it may do so either as presented or with additional
conditions.
Staff, as required by the Zoning Ordinance, has mailed public
notices to all people who own property located within 200 feet of
the applicant's tract. All replies received prior to September 8
(the date the agenda packet was assembled) are attached. Any
replies which have been received subsequent to that date will be
presented to Council during the public hearing.
Recommendation:
Based on the facts of this case, staff concurs with the Planning
and Zoning Commission and recommends approval of this request as
presented.

Re: Special Conditional Use Permit Request #SCU92-001
Dear Mayor Malone,
The Planning and Zoning Commission at it's August 20, 1992, public hearing and regular
meeting considered Special Conditional Use Permit Request #SCU92-001. This request has
been submitted by Ronnie and Melody Elledge who reside at 11002 Monument Road in the
Battleground Estates Subdivision. The purpose of the requested permit is to allow the
Elledges to house livestock on a 1.44 acre tract of land located directly across the street
from their home. The tract is comprised of several contiguous subdivision lots. The legal
description of the property is as follows: Lots 36-47; Block 3; Battleground Estates, Section
I.
The applicants propose to fence the property, construct a 624 square foot barn, and house
a maximum of two (2) head of livestock. Livestock on the property is to be limited to
animals being raised as 4H and FFA projects by the applicants' children.
After considering this request, the Planning and Zoning Commission, by unanimous vote of
members present, recommended approval of this Special Conditional Use Permit subject to
the following conditions:
I. Fencing shall be setback at least 25 feet from side property lines.
II. A maximum of two (2) head of livestock shall be housed on this
property at any time.
III. No animal which could be classified as wild or dangerous under the
provisions of Ordinance 1401 shall be housed on this property at any
time.

SPECIAL CONDITIONAL USE PERMIT
REQUEST #SCU 92-001
Requested For: Lots 36-47; Block 3; Battleground Estates, Section I which is
further described as being located in the 11000 Block of
Monument Road. (See Exhibit A)
Prouerty Zoning: R-1, Low Density Residential
Requested By: Ronnie and Melody Elledge, Property Owners
Purpose of ReQuest: A Special Conditional Use (S.C.U.) Permit has been requested
to allow the subject tract to be utilized for raising livestock.
Proposed improvements are to consist of a barn and fencing.
Zoning Ordinance 1501 classifies this activity as Agricultural
Production (Animal Specialties, SIC 027). Agricultural
Production, as a primary .use is listed as "Conditional" in R-1
zones (Ordinance 1501, Section 5-600, Table A.)
Background: Ronnie and Melody Elledge, the applicants, reside at 11002
Monument Road in the Battleground Estates Subdivision. They
also own twelve (12) lots that are located immediately across
the street from their home (see Exhibit A). These lots, which
front on both Monument and Houston Streets, comprise a 210
foot by 300 foot (approximately 1.44 acres) tract. This is the
tract of property for which the Elledge's are seeking the S.C.U.
Permit.
The applicants are proposing to fence the property and erect a
shed or barn (24 x 26) (See Exhibit B). The area would then
be used to house animals being raised by their children for
F.F.A. projects.

Analysis: As noted, the Zoning Ordinance designates Animal Specialties
as a "Conditional Use" in R-1 zones. Section 10-203 of the
Ordinance sets the following general conditions for this activity.
I. Livestock may only be kept on lots of an acre or
more in size.
II. Pasture and structures used to house livestock
must be setback at least 25 feet from any
property line except when the adjoining property
is also used to house domestic livestock.
III. Livestock may be kept in concentrations not to
exceed two (2) animals per acre (these
concentration limits are not applicable to fowl).
Section 10-502 would allow fencing to extend to the front
property lines. Additionally, Ordinance 1401 ("Wild Animals")
would regulate the types of animals which could be kept on this
property.
Section 10-202 deals specifically with Special Conditional Use
Permits and sets conditions which must be satisfied in order for
a S.C.U. Permit to be approved. These conditions are as
follows:
I. That the specific use will be compatible with and
not injurious to the use and enjoyment of other
property, nor significantly diminish or impair
property values within the immediate vicinity.
II. That the conditions placed on such use as
specified in each district have been met by the
applicant.
III. That the applicant has agreed to meet any
additional conditions imposed, based on specific
site constraints, and necessary to protect the
public interest and welfare of the community.

Regazding the first of these conditions, staff would note that
Lomax is largely a rural type of azea and that the Zoning
Ordinance recognizes this in it's livestock regulations. It should
also be noted that one of the reasons for instituting these
regulations was to allow children to participate in F.F.A
projects. While the livestock regulations were not instituted
with subdivisions in mind, Battleground Estates is a somewhat
sparsely developed subdivision with many homes occupying
relatively large lots.
Based on staffs review, it does not appeaz that the requested
development would be "injurious to the use and enjoyment of
other properties" nor should it "significantly diminish or impair
property values within the immediate vicinity".
Conclusion: This request satisfies ordinance prerequisites and is eligible for
the requested Special Conditional Use Permit subject to the
following conditions.
I. Fencing shall be setback at least 25 feet from
side property lines.
II. A maximum of two (2) head of livestock shall be
housed on this property at any time.
III. No animal which could be classified as wild or
dangerous under the provisions of Ordinance
1401 shall be housed on this property at any time.
Recommendation: Subject to the above conditions, approve Special Conditional
Use Permit Request SCU# 92-001.

AN ORDINANCE APPROVING AND ADOPTING THE BUDGET FOR THE CITY OF LA PORTE, TEXAS, FOR
THE PERIOD OF OCTOBER 1, 1992 THROUGH SEPTEMBER 30, 1993; FINDING THAT ALL THINGS
REQUISITE AND NECESSARY HAVE BEEN DONE IN PREPARATION AND PRESENTMENT OF SAID
BUDGET; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF.
WHEREAS, the Charter of the City of La Porte, Texas, and the Statutes of the
State of Texas, require that an annual budget be prepared and presented to the City
Council of the City of La Porte, Texas, prior to the beginning of the fiscal year of
said City, and that a public hearing be held prior to the adoption of said Budget;
and
WHEREAS, the Budget for the fiscal year October 1, 1992, through September 30,
1993, has heretofore been presented to the City Council and due deliberation had
thereon, was filed in the office of the City Secretary on August 12, 1992, and a
public hearing scheduled for September 14, 1992 was duly advertised and held.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
SECTION 1: That the Budget for the City of La Porte, Texas, now before the said
City Council for consideration, a complete copy of which is on file with the City
Secretary and attached hereto by reference as Exhibit "A", is hereby adopted as the
Budget for the said City of La Porte, Texas, for the period of October 1, 1992,
through September 30, 1993.
SECTION 2: Be it FURTHER ORDAINED, that the said City Council finds that all
things requisite and necessary to the adoption of said Budget have been performed as
required by charter or statute.
SECTION 3: The City Council officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this
meeting of the City Council was posted at a place convenient to the public at the
City Hall of the City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes
Annotated; and that this meeting has been open to the public as required by law at
all times during which this Ordinance and the subject matter thereof has been
discussed, considered and formally acted upon. The City Council further ratifies,
approves and confirms such written notice and the contents and posting thereof.

WHEREAS, the City's Assessor and Collector of Taxes submitted to the City Council
for approval the 1992 tax appraisal roll; and
WHEREAS, the City Council is of the opinion that the 1992 appraisal roll with the
amounts shown therein should be adopted;
WHEREAS, The City's Assessor and Collector of Taxes has reported to the City
Council that there was situated in the City of La Porte, as of January 1, 1992,
property with a total appraised value of $957,842,700 and a total taxable value of
$874,928,460;
WHEREAS, new personal property added to the appraisal roll had a total taxable
value of $1,844,800 as of January 1, 1992;
BE IT RESOLVED BY THE CITY COUNCIL

hundred dollar valuation.
A breakdown of the tax rate is as follows:

The effective tax rate for the new year is .8445 cents per hundred dollar
valuation. The proposed rate for the new year of .71 cents per hundred dollar
valuation represents a decrease from the effective rate of 16g. This is the
third year in a row that the City has been able to adopt a tax rate that is
below the effective rate.

FINDING THAT ALL REQUIRED NOTICES HAVE BEEN PUBLISHED AND ALL REQUIRED HEARINGS
HELD; CONTAINING A REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE
Section 1. That there is hereby levied for the current fiscal year
beginning October 1, 1992, and ending September 30, 1993, on all real
property situated and all personal property owned within the taxable
limits of the said City of La Porte, on the first day of January, 1992,
except so much as may be exempt under the constitution and laws of the
United States, this State, and the City of La Porte, the following taxes:
(1) An Ad Valorem Tax of and at the rate of five zero point five cents ($.505)
on the one hundred dollars ($100.00) cash value thereof, estimated in
lawful currency of the United States for the current expenses for the
support, maintenance, and improvement of the City Government of said City
of La Porte; and
(2) An Ad Valorem Tax of and at the rate of two zero point five cents ($.205)
on the one hundred dollars ($100.00) cash value thereof, estimated in
lawful currency of the United States, to pay current interest on and
provide one year's sinking fund and to pay all of the Principal and
Interest accruing on all outstanding general obligation bonds and
certificates of obligation lawfully issued by the City of La Porte.
That this provides the sum of total Ad Valorem tax at the rate of
seventy-one cents ($.71) on the one hundred dollars ($100.00) cash value
thereof, estimated in lawful currency of the United States.
Section 2. All property upon which a rate of taxation is hereinabove
levied shall be assessed on a ratio of one hundred percent (100) of the
estimated market value thereof.

Section 3. That the sums hereinafter accruing and collected from the
hereinabove taxes so levied be and the same are hereby appropriated for
the support, maintenance, and improvement of the City Government of the
City of La Porte.
Section 4. The City Council officially finds, determines, recites and
declares that all notices required by law have been published, and that a
public hearing as required by law was duly called and held, and that all
matters prerequisite to the establishment and levy of an ad valorem tax
have been accomplished, all as required by the laws of the State of Texas,
and the Home Rule Charter of the City of La Porte.
Section 5. If any section, sentence, phrase, clause, or any part of
any section, sentence, phrase, or clause, of this Ordinance shall, for any
reason, be held invalid, such invalidity shall not affect the remaining
portions of this Ordinance, and it is hereby declared to be the intention
of this City Council to have passed each section, sentence, phrase, or
clause, or part thereof, irrespective of the fact that any other section,
sentence, phrase, or clause, or part thereof, may be declared invalid.
Section 6. All ordinances or parts of ordinances in conflict herewith
are hereby repealed to the extent of such conflict only.
Section 7. The City Council officially finds, determines, recites and
declares that a sufficient written notice of the date, hour, place, and
subject of this meeting of the City Council was posted at a place conven-
cent to the public at the City Hall of the City for the time required by
law preceding this meeting, as required by the Open Meetings Law, Article

Sealed bids for the reconstruction of East H Street and sanitary sewer line
replacement were opened on September 8, 1992. Bids were received from six
(6? contractors, per the attached bid tabulation. Low bid was received
from MEB Engineering, Inc. for a base bid of $223,151.50. Alternate base
bid totaled $229,001.50, which includes pressure grouting of the abandoned
sanitary sewer lines. It is recommended that the base bid be accepted.

EAST H STREET AND SANITARY SEWER LINE REPLACEMENT; APPROPRIATING
$223,151.50 TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The City Manager is hereby authorized to execute such
document and all related documents on behalf of the City of La
Porte. The City Secretary is hereby authorized to attest to all
such signatures and to affix the seal of the City to all such
documents. City Council appropriates the sum of $223,151.50 from
the Utility Capital Improvement Fund, out of the Fiscal Year 1992-
1993 Utility CIP Budget to fund said contract.
Section 2. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to
the public as required by law at all times during which this
ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

around an increase in the Green Fee rates. The attached ordinance will

All other fees will remain the same.

Section 1: Effective October 1, 1992, the City Council of the City of La
Porte hereby establishes the following user fees for green fees for the City of
La Porte Bay Forest Golf Course.

SECTION 2: All ordinances or parts of ordinances in conflict herewith are

The Dangerous Buildings Board of Inspection has
identified and prepared reports on six buildings that, due to

an October 12 public hearing for the purpose of considering their
condemnation.
Recommendation:
Authorize a public condemnation hearing for all six
structures.

SUMMARY ac RECOMMENDATION
On Monday, August 24, 1992, one of the compressors in the
City Hall air conditioning system broke down. This resulted
in a substantial failure of the entire air conditioning
system. Due to the type and degree of damage, repair of the
compressor did not appear feasible. After soliciting three
(3) comparative quotes, staff authorized Bay Refrigeration
to replace the failed unit. The work which was authorized
as an emergency repair has been satisfactorily completed.
The cost fo the repair was ~b,441.47, the same price quoted
on Bay Refrelgeration's estimate. The repairs have been
paid for with budgeted Clty Hall maintenance funds.
Action Required by Council:
Approve staff's authorization of emergency repairs and
approve payment to Bay Refrigeration.

SUBJECT: CITY HALL AIR CONDITIONING
' The air conditioning system for City Hall has failed,
the problem is one of the compressors has broken and
needs to be zeplaced. Bay Refrigeration, our
maintenance contractor, has given us a quote of
55441.47. I researched the cost of replacement of one
of these compressors and find the quote to be
compatible with the price we paid two years ago.
I recommend we authorize Bay Refrigeration to replace
the unit as soon as possible, in the present condition
we are operating at 50$ capacity.

SUMMARY & RECOMMENDATION
Advertised, sealed bids #0500 for the supply of aggregate for surface
treatment were opened and read on August 31, 1992. Bid requests were
mailed to five (5) area suppliers with one (1) Vulcan Materials returning a
bid.
Vulcan Materials submitted the only bid for supply of this material. This
company is the only company to our knowledge with the naturally impregnated
limestone rock asphalt aggregate. This material has provided better
results on road surfaces than the surface coated materials. Prior use has
shown the surface coated material tends to bleed through and requires more
maintenance and materials to keep the road surface acceptable to traffic.
Vulcan Materials submitted the following bids for materials:

Staff recommends award of bid to Vulcan Materials for the annual supply of
aggregate for surface treatment in the amounts as listed above. Funds for
this purchase are budgeted in the Street Division's 92-93 Operating Budget.

SUBJE Seal Coat Program - Street Division
The City has received bids for the annual contract for surface
treatment aggregate for the annual seal coat program. This
program, in effect for the past 13 years, is used for surface
treatment for new, reconstructed and recycled streets, as well as
maintenance of existing streets. It consists of the application of
one or more layers of liquid asphalt covered with coated aggregate,
and serves to seal and weatherproof the street base and subgrade.
Other, more expensive methods are available for this purpose,
primarily overlay with asphalt. For cost considerations, the
Street Division has limited overlays to streets that require
additional strength, as asphalt overlay increases the structural
integrity as well as performing weatherproofing. Labor, material
and equipment cost to overlay one square yard with asphalt costs
$4.00, and must be performed by outside contract. The City does
not own the proper equipment to perform this task.
Cost to sealcoat one square yard of street is $0.70, including
labor, equipment and material. The City owns and operates the
necessary equipment to perform this function. The aggregate used
in sealcoating is of two types - naturally impregnated limestone
rock asphalt aggregate (PE? and coated limestone rock aggregate
(PB). Naturally impregnated rock is available from only one
supplier in Texas - Vulcan Material. This material is mined in the
San Antonio area, and is shipped by rail to La Porte. Rail costs
exceed the cost of the material due to the distance involved.
Coated asphalt aggregate is available locally, and typically costs
15 - 30% less than naturally impregnated aggregate. The City has
used this material in the past, and found it unsatisfactory for
several reasons. The primary problem with coated aggregate is
bleeding. After the material is placed, summer heat melts the
asphalt coating, causing liquid asphalt to surface. This results
in citizen complains due to oil on vehicles, and also results in
the aggregate "picking up" from the surface. Additional
maintenance and costs to the city result. Coated aggregate also
sticks together, causing stockpile problems as well as with the
equipment used to place the aggregate.

have been stable over the past several years. The following is a
comparison of last years contract prices with the proposed prices.

In the past, the City has unloaded and trucked the material from
the public rail siding in La Porte. This years bid includes
unloading and trucking costs to the Public Works facility.
In summary, the Street Division has found that the most cost-
effective surface treatment for streets is seal coating, using
naturally impregnated limestone rock asphalt aggregate. Asphalt
overlays are used for structural treatment as needed. Naturally
impregnated limestone rock asphalt aggregate is a superior material
that has been successfully used by the City for the past 13 years
to provide a cost-effective surface treatment for street
maintenance.

meeting specifications, for the annual supply of reinforced concrete pipe.
It is further recommended a contingency contract be awarded to South
