The meeting was called to order by Mayor Malone at 6:00 P.M. Members of citv Council Present: Mayor Norman Malone, Councilpersons Guy Sutherland, Mike Cooper, Bob Thrower, Bob McLaughlin, Alton Porter, Deotis Gay, Jack Maxwell, Jerry Clarke (arrived at 6:08 P.M.) The invocation was given by Mayor Malone. 3. Council considered approving the minutes of the regular meeting held September 28, 1992. Motion was made bv Counciloerson Sutherland to aoorove the Seotember 28 minutes as oresented. Second by Councilperson Thrower. The motion carried, 8 ayes and 0 nays (Councilperson Clarke had not yet arrived). Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell and Mayor Malone None Nays: 4. Mr. Howard Ebow, 5405 Beaver Creek,President of the Creekmont civic Association, addressed Council regarding continuing traffic problems on Myrtle Creek and aSking for the City to do everything possible to alleviate these problems. Mayor Malone called forward Justin Barnhill and Michael McDonald, Scouts who are working on their communications badge. The Mayor asked Councilpersons Thrower and Gay to present each of the young men with City pins. 5. Mayor Malone called the public hearing regarding demolition of dangerous buildings to order at 6:15 P.M. e . Minutes, Public Hearing and Regular Meeting La Porte City Council October 12, 1992, Page 2 Mark Lewis, Building Inspector, reviewed the list of dangerous buildings, and reported that the property at 11527 Spencer Highway and at 3242 Hillsdale had been removed from the list because the property owners had waived their right to public hearing and presented the City with notarized consent to demolish. He also stated that the owner of the property at 117 North 4th has obtained a permit and proceeded to demolish, but sufficient progress has not been made at this time to warrant taking it off the list for consideration. Questions from Council regarding some of the properties on the list were answered by Mr. Lewis. The Mayor asked for public input. Mr. curtis Thompson addressed Council asking for additional time to demolish the structure at 117 North 4th Street, as he is doing it himself. Mr. stanley Green addressed Council requesting additional time to demolish the structure at 201 North 5th Street. There being no further public input, the Mayor declared the public hearing adjourned at 6:30 P.M. 6. Council considered ordinances declaring dangerous buildings. Item 6A and Item 6E were deleted from the list. B. The City Attorney read the full caption of the first ordinance: ORDINANCE 1865 - AN ORDINANCE DECLARING THE BUILDING LOCATED ON LOTS 17-20, BLOCK 66, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, TO BE IN FACT A NUISANCE; ORDERING SUCH BUILDING CONDEMNED; FINDING THAT EVERLENA THORNTON C/O STANLEY GREEN IS THE RECORD OWNER OF SAID PROPERTY; ORDERING THE SAID OWNER TO ENTIRELY REMOVE OR TEAR DOWN SUCH BUILDING; ORDERING THE SAID OWNER TO COMMENCE SAID REMOVAL OR DEMOLITION WITHIN TEN (10) DAYS FROM THE EFFECTIVE DATE OF THIS ORDINANCE; ORDERING THE BOARD OF INSPECTION TO PLACE A NOTICE ON SAID BUILDING; ORDERING THE CITY SECRETARY TO FORWARD A COpy OF THIS ORDINANCE TO SAID OWNER; PROVIDING FOR THE REMOVAL BY SAID OWNER IN THE MANNER PROVIDED HEREIN; PROVIDING AN EFFECTIVE DATE HEREOF; AND FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW. The City Attorney read: ORDINANCE 1868 - PROPERTY LOCATED ON LOTS 27-30, BLOCK 56, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, RECORD OWNER CURTIS THOMPSON Motion was made by Counciloerson Clarke to adoot Ordinance 1868 and extend the time to 120 davs. Second by Councilperson Porter. Council considered an ordinance approving and authorizing a contract between the City of La Porte and Pas-Key Construction Service, Inc., for sanitary sewer extensions; appropriating $144,775.18 to fund said contract. The City Attorney read: ORDINANCE 1870 - AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND PAS-KEY CONSTRUCTION SERVICE, IN., FOR SANITARY SEWER EXTENSIONS; APPROPRIATING $144,'775.18 TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Counciloerson Gay to adoot Ordinance 1870 as read bv the City Attornev. and authorize transfer of $39.158.70 from the utilitv Fund Continaencv Account. Second by Councilperson Thrower. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, McLaughlin, Porter, Gay, Maxwell, Clarke Malone None Thrower, and Mayor Nays: 9. Council considered amending the capital improvement budget by $25,000. Motion was made bv Counciloerson McLaughlin to amend the caoital imorovement budget in the amount of $25.000. Second by Councilperson Thrower. The motion carried, 8 ayes and 0 nays (Councilperson Gay was away from the table). Ayes: Councilpersons Sutherland, Cooper, McLaughlin, Porter, Gay, Maxwell, Clarke Malone None Thrower, and Mayor Nays: 10. Council considered setting a meeting schedule for the holiday season. Motion was made bv Counciloerson Sutherland to hold the November meetina on November 16 and the December meetina on December 14. Second by Councilperson Thrower. Council considered a consent agenda as follows: (A) Consider awarding bid for Christmas decorations; (B) Consider awarding a bid for bio-monitor laboratory analysis; (C) Consider awarding a bid for polymer. Councilperson Gay requested that item B be pulled and Councilperson McLaughlin requested that item C be pulled. After Council questions were answered, motion was made bv Counciloerson Cooner to aoorove the consent aaenda as oresented. Second by Councilperson Sutherland. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, McLaughlin, Porter, Gay, Maxwell, Clarke Malone None Thrower, and Mayor Nays: 12. Administrative Reports: A. City Manager Herrera reported that the Hillridge Bridge first stage has been completed and should be open soon. B. A reminder was given by Mr. Herrera of the dedication of the fire training facility at 9:30 A.M. on October 17. He urged Council to please attend, as there would be a special treat in store. C. Police Chief Bobby Powell reported to Council on an incident in Morgan's Point in which the La Porte police assisted. 13. Council Action: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Gay, Clarke and Mayor Malone brought items to Council's attention. 14. Council adjourned into executive session at 7:18 P.M. to address the following items under V.A.T.S. - Article 6252-17: (A) section 2 (E) (Legal) Receive report from Attorneys regarding Houston Chemical Services, Inc. /Southern Ionics, Inc.; (B) Section 2(G) - (Personnel) Receive report from City Manager regarding a personnel matter; (C) Article 2 (G) (Personnel) Discuss appointment to Board of Adjustment (item 7 on agenda which was requested to go to executive session). Council returned to the table at 8:13 P.M.; no action was taken during executive session. Council considered an ordinance appointing a member, Alternate 1, of the La Porte Zoning Board of Adjustment, to fill the unexpired term of Bob Capen, term to expire May 30, 1994. Motion was made bv Counciloerson Clarke to anooint Ruben Salinas to the oosi tion of Al ternate 1 of the Board of Adiustment and adont Ordinance 1869 to do so. Second by Councilperson Cooper. The motion carried, 8 ayes and 0 nays (Councilperson Sutherland had left the meeting at 8:00 P.M.) At the close of the hearing, Council will consider passage of the condemnation ordinances. Reoommendation Order demolition of all six (6) structures by passage of condemnation ordinances. Harrington, Director of Planning THRU: FROM: SUBJECT: Structures Without Sanitary Sewer During the FY 1991 Budget process, the City Council considered and authorized a project to provide sanitary sewer and water service to properties without service. As these projects have now moved forward to the point that the design is complete, J would like to provide you the following administrative status report. . Background t-..\ \ \'....\!::: During the budget process, the staff provided a report to the Council that identified.:seven\ (9) pocket areas of La Porte to which there were no sanitary sewer facilities. This IisfwaS' pared down to seven (7) areas that could be served. Two (2) areas were eliminated due to the high cost per structure to provide service. The list of properties by area is shown on Attachment "A" The properties located on North "H" Street were eliminated from the list as later field investigations revealed a line that placed the eight (8) properties in that area within a 200 foot distance of sanitary sewer service. The original concept for the project included several different design elements including individual grinder pumps and low pressure force mains for twelve (12) of the properties, gravity flow systems for eighteen (18) of the properties and "throw-away" status for the pumps and force main systems. In addition to the sanitary sewer system problems, the staff identified one (1) area along North "H" Street that was without water service. e e After considering the design problems. the City Council authorized proceeding with the water and sanitary sewer extensions at a cost of $2,415.00 per structure for water service and $4,000.00 per structure for sanitary sewer service. The total $137.000.00 was carried forward into the FY 1992 Budget. Current Status The project has now moved forward to the point of design completion for the sanitary sewer extension. In the design process. we have been able to solve some of the original problem elements anticipated in the preliminary study phase. We no longer will have individual grinder pumps and low pressure force mains serving the previously mentioned twelve (12) properties. The Engineering Division was able to design gravity flow systems for all of the individual structures and at the same time creating the need for only two (2) small package type sanitary sewer lift stations to be maintained by the City. The obvious benefit will be to eliminate the numerous pumps and maintenance problems that would be inherent in the original design concept. At the same time. it will add only one (1) lift station to the original approach. The final design was not, however, able to eliminate the "throw-away" status of some of the project. This situation was created by the decision to provide service to an area that will ultimately be served in a different manner when fully developed. This "temporary" service will be provided for anywhere between five (5) and ten (10) years depending on development activity. At that point in time, the City will abandon a portion of the lines shown on the accompanying map (Attachment B). These will include all of line #7, and the lift stations and force mains of lines #3 and #5. While this proposal has the lines being abandoned at a cost of $26,165.20, it will not have the expense of grinder pumps that would have been abandoned in the original approach. The new design proposal has an estimated cost of $95,254.30 as shown in the breakdown sheet for the project (Attachment C). This is to be taken from a total of $120,094.00 available from the Utility CIP Fund. In regard to the water line extension project, there have been some additional delays incurred. We will not begin the final plans and implementation until we have a final alignment of the storm sewer outfall proposed for North "H" Street that supports Harris County's Underwood Road project. Depending on final alignment, it may be necessary to delay installation of the water line until the storm sewer outfall is installed. There are $16,906.00 available for this project. As it stands now, I anticipate advertising the project for bids during the next two (2) weeks and then submitting the bids for City Council action on either June 8, or June 22, 1992. The actual date for authorization to construct is dependent on securing easements along Buchanan from three (3) property owners and one (1) easement that will facilitate the service along Brownell Street. , e .~~~. e .",;-: ~: . , ~ One additional issue that will require policy action by the Council by the time we award the contract is that of front foot fee assessments. During past service extensions, the most recent being Battleground Vista, we assessed the front foot fees. Those were done, however, prior to the new rates established in 1990. Harrington, Director of Planning THRU: FROM: SUBJECT: Structures Without Sanitary Sewer During the FY 1991 Budget process, the City Council considered and authorized a project to provide sanitary sewer and water service to properties without service. As these projects have now moved forward to the point that the design is complete, I would like to provide you the following administrative status report. Background t-.\\NC During the budget process, the staff provided a report to the Council that identified:se~ (9) pocket areas of La Porte to which there were no sanitary sewer facilities. This IiSrwas-' pared down to seven (7) areas that could be served. Two (2) areas were eliminated due to the high cost per structure to provide service. The list of properties by area is shown on Attachment "A" The properties located on North "H" Street were eliminated from the list as later field investigations revealed a line that placed the eight (8) properties in that area within a 200 foot distance of sanitary sewer service. The original concept for the project included several different design elements including individual grinder pumps and low pressure force mains for twelve (12) of the properties, gravity flow systems for eighteen (18) of the properties and "throw-away" status for the pumps and force main systems. In addition to the sanitary sewer system problems, the staff identified one (1) area along North "H" Street that was without water service. . . After considering the design problems, the ~ity Council authorized proceeding with the water and sanitary sewer extensions at a cost of $2,415.00 per structure for water service and $4,000.00 per structure for sanitary sewer service. The total $137,000.00 was carried forward into the FY 1992 Budget. Current Status The project has now moved forward to the point of design completion for the sanitary sewer extension. In the design process, we have been able to solve some of the original problem elements anticipated in the preliminary study phase. We no longer will have individual grinder pumps and low pressure force mains serving the previously mentioned twelve (12) properties. The Engineering Division was able to design gravity flow systems for all of the individual structures and at the same time creating the need for only two (2) small package type sanitary sewer lift stations to be maintained by the City. The obvious benefit will be to eliminate the numerous pumps and maintenance problems that would be inherent in the original design concept. At the same time, it will add only one (1) lift station to the original approach. The final design was not, however, able to eliminate the "throw-away" status of some of the project. This situation was created by the decision to provide service to an area that will ultimately be served in a different manner when fully developed. This "temporary" service will be provided for anywhere between five (5) and ten (10) years depending on development activity. At that point in time, the City will abandon a portion of the lines shown on the accompanying map (Attachment B). These will include all of line #7, and the lift stations and force mains of lines #3 and #5. While this proposal has the lines being abandoned at a cost of $26,165.20, it will not have the expense of grinder pumps that would have been abandoned in the original approach. The new design proposal has an estimated cost of $95,254.30 as shown in the breakdown sheet for the project (Attachment C). This is to be taken from a total of $120,094.00 available from the Utility CIP Fund. In regard to the water line extension project, there have been some additional delays incurred. We will not begin the final plans and implementation until we have a final alignment of the storm sewer outfall proposed for North "H" Street that supports Harris County's Underwood Road project. Depending on final alignment, it may be necessary to delay installation of the water line until the storm sewer outfall is installed. There are $16,906.00 available for this project. As it stands now, I anticipate advertising the project for bids during the next two (2) weeks and then submitting the bids for City Council action on either June 8, or June 22, 1992. The actual date for authorization to construct is dependent on securing easements along Buchanan from three (3) property owners and one (1) easement that will facilitate the service along Brownell Street. e e 7. One additional issue that will require policy action by the Council by the time we award the contract is that of front foot fee assessments. During past service extensions, the most recent being Battleground Vista, we assessed the front foot fees. Those were done, however, prior to the new rates established in 1990. The grant is in the amount of $10,000 and was the result of a submission by the City requesting funding for a Bayfront Master Plan. The grant amount of $10,000 is the maximum amount awarded by Bell. The scope of the Bayfront Master Plan includes a review of existing planning data and exploration of La Porte's potential for future development or redevelopment as a community that utilizes and promotes the attributes of Galveston Bay. The plan is expected to include the following: · Identify water front properties desirable for, but not limited to the development of: marina, water sports complex, full service conference hotel, waterside restaurants, and offices; · Supplement residential access to the bayfront through zoning controls, including, but not limited to: single family low density residential and high density residential; · Review present zoning and development ordinances and La Porte planning documents, to insure that targeted development goals are realistic and obtainable; · Inventory current vacant land available for development, and land available for future development and/or redevelopment; and · Formulate and adopt an action plan with alternatives for public and/or private development of leisure/recreational facilities along the bay shoreline. The City will need to contribute $15,000 as matching funds for the grant. The City's portion will come from the donation made by Mr. Berdon Lawrence in 1987. The total amount of Mr. Lawrence's donation (including interest earned) is $137,207.80 at September 30, 1992 ACTION REQUIRED BY COUNCIL: Amend the Capital Improvement Fund (015) Budget by $25,000. HISTORY OF AGENCY AND DESCRIPTION OF PROJECT La Porte was initially developed in 1891 by a group of investors who promoted La Porte as a bayfront resort. In 1892 the City was incorporated and in the following years various hotels were developed in order to attract people to the new bay town. In 1915 much of the area was destroyed by a hurricane but La Porte continued to thrive due to the popularity of Sylvan Beach Park, which attracted numerous weekend visitors. It was not until after World War" that La Porte began to witness additional growth and take on a different character with the emergence of the petrochemical industry in the area. In recent years the petrochemical and shipping industries have been the prevalent economic forces within the City. A by-product of those industries is the perceived image of La Porte as a "smoke stack" area. Citizens and political leaders have noted this and have taken definite pro-active steps to provide La Porte with more quality of life features and economic diversification. The City Council's mission statement that fostered the Visions '89 Committee reflects this commitment. -To develop and set into motion a plan that will improve the quality of Dte and promote responsible and diversified economic growth. - A sincere area of interest is the development of leisure/recreation activities along the bayfront. This theme has been repeated in several documents including the La Porte Comprehensive Plan, Economic Development Strategies Report, and Goals Report of the La Porte Visions '89 Committee. La Porte's annual population growth has remained constant over the last five years. The City is now 29,000 strong in population. The objective of this grant request is to secure matching funds for the development of a "Bayfront Master Plan" which would further the community's efforts of economic diversification. Phase III Draft Final Bayfront Master Plan - provides a draft report and conceptual schemes and studies of the alternate plans selected for further development upon completion of Phase 1/. Phase IV Final Bayfront Master Plan - provides a final master plan of the bayfront study area, including development concepts, comments on possible phasing and priorities, and order of magnitude costs. It is the City's belief that a Bayfront Master Plan would be well supported and benefit the entire community by providing a footprint for economic diversification, resurgence and promotion of the assets of Galveston Bay in a manner that enhances th:e quality of life of our citizens and our business community. La Porte's future is not dependent on any single industry for growth. It's future is tied to diversified growth which turns into synergism.
