The invocation was given by Councilperson Porter.
Council considered approving the minutes of the regular
meeting of Council held October 26, 1992.
Motion was made by Councilperson Sutherland to approve the
minutes of October 26 as presented. Second by Councilperson
Thrower. The motion carried, 9 ayes and 0 nays.

4. Centennial Certificates of Appreciation were presented to

6. Council considered an ordinance amending Ordinance 1743, the
City of La Porte Health Ordinance, to authorize Harris County
to issue citations for violations.

Motion was made by Councilperson McLaughlin to adopt Ordinance
1743-A with an amendment that a clause be added to be able to
close an establishment on the spot if need be. Second by
Councilperson Cooper.
The City Attorney explained that an ordinance must be voted on
as it appears in writing at the time the vote is taken.
Motion was made by Councilperson McLaughlin to table item 6.
Second by Councilperson Thrower. The motion carried, 6 ayes
and 3 nays.

Direction from Council was to bring the ordinance back to the
December 14 meeting with the added clause.
7. Council considered an ordinance authorizing the City Manager
to enter into an agreement with Uretek USA, Inc., for
rehabilitation of Coupland Drive, in an amount not to exceed
$90,960.00.
Mr. Carl Ferm, Executive Vice President of Uretek, addressed
Council regarding the process and showed various
representative slides.

il. Administrative Reports - Bob Herrera reported on the hotel
market study done by Coopers & Lybrand, and asked for the
draft copies of the study be returned to him so they could be
sent to the consultant. He announced arrangements for a
meeting with Council and Sunbelt Hotels representatives for
November 24 at 6:30 P.M. at the Hobby Hilton, to work on
preliminary design for a hotel at Sylvan Beach.
12. Council Action - Councilpersons Porter, Gay, Clarke and Mayor
Malone brought items to Council's attention.
13. There was no executive session.
14. There being no further business to come before the Council,
the meeting was duly adjourned at 7:09 P.M.

SUMMARY & RECOMMENDATION
Backgroun8
This past summer during fire inspections of different restaurants
in La Porte, the Fire Marshal and Assistant Fire Marshal began to
notice what appeared to be unsanitary conditions in several
restaurants. It was felt that the Harris County Health Department
was not performing their inspection process properly in La Porte.
During a meeting with the Harris County Health Department, we were
provided with a more accurate picture of their process and
enforcement procedures. From that meeting, we developed the
following solutions to the problem:
1. Due to their inability to be here more often than once a
quarter, the Fire Marshal will note violations when
making fire inspections and then notify the Health
Department of possible hazards. At that time they will
make special inspections.
2. There is a problem in enforcing the Health Ordinance. As
it is now, the only enforcement tool is revocation of a
permit. This requires the following procedure:
Note problem and allow ten (10) days to resolve the
violation.
Re-inspect and if that violation still exists, the
permit is suspended pending a hearing on the
permit. If the original problem is corrected but a
new one is found, the process begins again. Many
times this process can take 30 days or more to
clear up a possible health hazard. In order to
accomplish this, the Health Department requested La
Porte to authorize them to issue citations to
violators of the Health Ordinance. The citations
would be handled through the La Porte Municipal
Court, thereby returning the fees to La Porte as
well as offering fairly quick enforcement.
Recommendation
The staff recommends that Council approve Ordinance Amendment 1743-
A which will allow the issuance of citations by the Harris County
Health Department in La Porte.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Section 1 of Ordinance No. 1743, passed and
approved on April 22, 1991, is amended, and shall hereafter read
as follows, to-wit:
"Section 1. DESIGNATION Or' HEALTH AUTHORITY
The City of La Porte designates the Director of the Harris
County Health Department as its health authority for the purpose
of food establishment surveillance for the public health
protection of its residents.
Harris County Health Department shall be responsible for
enforcement of the City's food permit ordinance and shall provide
a semi-annual report to the City's Health Officer which documents
violations of health ordinances, and food establishment
surveillance program activities within the City of La Porte.
The City of La Porte hereby grants to the Harris County
Health Department and its designated representatives, the
authority to issue citations, give notices, make inspections and
file charges arising out of any violation of this Ordinance."
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted~at a place convenient to the public at the City Hall
of the City for the time required by law preceding this meeting,

as required by the Open Meetings Law, Article 6252-17, Texas
Revised Civil Statutes Annotated; and that this meeting has been
open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,

contents and posting thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

Background
Coupland Drive in the Diamond "C" Addition was improperly
constructed in 1977, which Ott the time was part of the City of
Lomax. In addition, over the intervening years, the subgrade has
settled in a somewhat uneven fashion. The result of these two
factors is a street that ponds and floods after rainfall events.
A number of alternatives have been reviewed over the years, but
none of these proved to be viable.
Finally, this summer, the Engineering staff found a proprietary
process that will solve the problem with a minimal investment and
a short construction time. The process as described in the
attached report calls for pressure injection of polyurethane to
lift or jack the street to proper levels which will provide a
positive grade and drain the street.
After the street has been raised, the City will provide loads of
sand for adjoining property owners to raise their yards to the
level of the new curb height. The sand will be placed at strategic
points around the subdivision to allow the owners to gradually
raise their grass levels.
The approval of this process will require Council to approve a sole
source bid to Euretek USA, Inc., in the amount of $90,960.00.
Under state law, Council is authorized to do so when ... "items that
are available from only one source because of patents, copyrights,
secret processes, or natural monopolies;"....
Recommendation
Staff recommends that Council approve a contract to Uretek USA,
Inc. in the amount of $90,960.00 for the rehabilitation of Coupland
Drive.
Action Required by Council:
Approve an ordinance authorizing the City Manager to enter into an
agreement with Uretek USA, Inc. in the amount of $90,960.00 for the
rehabilitation of Coupland Drive.

Pavement Rehabilitation Project
Background
Coupland Drive is a 24 foot wide reinforced concrete paved street with curbs serving a
subdivision of Outlot 442, La Porte Outlots, Enoch Brinson Survey, A-5, La Porte, Harris
County, Texas. The street right-of-way is sixty feet in width and is in the shape of a "U" (or
horseshoe) with the open ends of the "U" entering on North "L" Street. The subdivision is
named Diamond "C" Addition, and is filed for record in Volume 254, Page 123, of the Map
Records of Harris County, Texas. It was constructed in 1977 under the subdivision
regulations of the City of Lomax.
Coupland Drive was not constructed in conformance with the plans for the project which
call for a minimum design grade of 0.20%. It was designed to drain from the top of the
"horseshoe" north to two pairs of inlets located at the intersection with "L" Street. The
actual grade constructed for most of the street was about 0.10%. Also, over the years, there
has been very significant and non-uniform settlement of the subgrade, probably due to
inadequate compaction. The combined effects of these factors has resulted in a very
inconsistent and uneven longitudinal and transverse gradient causing low spots to form in
the pavement. As a consequence, there is shallow ponding of stormwater in these low areas
after a rainfall event. The depth of standing water ranges from a fraction of an inch to up
to two or three inches in some areas and the ponding is fairly widespread.
This problem has created a nuisance for the residents that live along Coupland Drive in that
the water stands in the road for days after a rainfall. The water cannot runoff, but instead
simply sits in the road until it is dissipated by evaporation. This problem has been looked
at for some time, dating back to a study done by H. Carlos Smith in September of 1982.
Several alternatives were investigated, including asphalt overlay, complete reconstruction of
the street, and open ditch drainage along each side of Coupland Drive. As reported in the
H. Carlos Smith study, the most viable option was to provide open ditch drainage.
However, this concept was rejected by the residents of Coupland Drive, as curb and gutter
is generally considered more aesthetically pleasing than open ditch drainage. The concept
of adding inlets near the top of the horseshoe, where some of the worst ponding occurs, and
piping the drainage east to Lomax School Road was also considered. This was not feasible
due to the inadequate depth at the outfall swale ditch along Lomax School Road.

Current Status
Finally, the Engineering Department began looking into a process which is relatively new
to the United States, but which has been used in Europe and other parts of the world since
1975. The Uretek process, developed in Finland, utilizes high density polyurethane injected
through half-inch diameter holes between the slab and subgrade to successfully resolve
concrete slab and pavement settlement problems. As the polyurethane expands and
hardens, it exerts a lifting force of four tons per square foot raising the slab to it's required
level. Precise control of the lifting process is provided by "state of the art" laser leveling
devices. Essentially, this process will raise the low areas along Coupland Drive and restore
a more uniform crown to the road, as well as a relatively consistent longitudinal slope of
about 0.10%. While this is certainly well below design standards, it will provide sufficient
grade to allow the runoff to drain off the road in a relatively short time. This process
should eliminate any ponding in the street in as short a time as thirty minutes after a heavy
rainfall. The Uretek process will also underseal the entire road which will prevent any
further slab settlement. Also, since the polyurethane hardens to 90% of it's full strength in
only 15 minutes, there will be very minimal disruption to traffic. The process is guaranteed
for ten years and would take approximately seven days to complete. Uretek, USA is the
exclusive licensee for the URETEK method in the United States.
Pressure grouting or "mud jacking" is a similar process which was also investigated, but was
rejected based on the following: According to a report prepared by the University of Illinois
and the Illinois Department of Transportation "pressure grouting was very effective in
reducing pavement deflections, but that currently used grouts quickly break up under the
pounding of traffic so the treatment has a very short life expectancy (less than one year)".
Hayward Baker, one of the well known pressure grouting contractors, would not guarantee
their process.

The Texas Municipal Retirement System (TMRS) Act allows member cities to adopt Updated
Service Credits and Annuity Increases, providing cities the opportunity to upgrade retirement
benefits for both active employees and retirees who are currently receiving a monthly annuity
from the System.
By adopting the 100% Updated Service Credit effective January 1, 1993, a member's retirement
benefits will be recalculated based on the member's average monthly salary for the three year
period of 1989, 1990, and 1991. The member's retirement benefits are "updated" based on the
higher wages earned in recent years.
Adoption of the ordinance also increases the monthly annuities being paid to its retirees. The
increase that can be granted to retirees is calculated based on a maximum of 70% of the change
in the Consumer Price Index, less any previously granted increases.
This ordinance is non-repeating and will be effective January 1, 1993. Any future updates will
require adoption of a new ordinance. The City's contribution rate will be decreased to 8.77%
of gross salaries (9.38% in 1992) due to an increase in the amortization period.

Section 1. Authorization of Updated Service Credits.
(a) On the terms and conditions set out in Sections 853.401 through 853.403 of Subtitle
G of Title 8, V.T.C.A., Government Code, as amended (hereinafter referred to as the "TMRS
Act"), each member of the Texas Municipal Retirement System (hereinafter referred to as the
"System") who has current service creditor prior service credit in the System in force and effect
on the 1st day of January of the calendar year preceding such allowance, by reason of service
in the employment of the City, and on such date has at least 36 months of credited service with
the System, shall be and is hereby allowed "Updated Service Credit" (as that term is defined in
subsection (d) of Section 853.402 of said title) in an amount that is l00°l0 of the "base Updated
Service Credit" of the member (calculated as provided in subsection (c) of Section 853.402 of
said title). The Updated Service Credit hereby allowed shall replace any Updated Service
Credit, prior service credit, special prior service credit, or antecedent service credit previously
authorized for part of the same service.
(b) On the terms and conditions set out in Section 853.601 of said title, any member of
the System who is eligible for Updated Service Credits on the basis of service with this City,
and who has unforfeited credit for prior service and/or current service with another participating
municipality or municipalities by reason of previous service, and was a contributing member on
the 1st day of January of the calendar year preceding such allowance, shall be credited with
Updated Service Credits pursuant to, calculated in accordance with, and subject to adjustment
as set forth in said 853.601.
(c) In accordance with the provisions of subsection (d) of Section 853.401 of said title,
the deposits required to be made to the System by employees of the several participating
departments on account of current service shall be calculated from after the date aforesaid on
the full amount of such person's earnings as an employee of the City.
Section 2. Increase in Retirement Annu}ties.
(a) On terms and conditions set out in Section 854.203 of Subtitle G of Title 8,
V.T.C.A., Government Code, as amended, the City hereby elects to allow and to provide for
payment of the increases below stated in monthly benefits payable by the System to retired
employees and to beneficiaries of deceased employees of this City under current service annuities
and prior service annuities arising from service by such employees to this City. An annuity
increased under this Section replaces any annuity or increased annuity previously granted to the
same person.
(b) The amount of annuity increase under this Section is computed as the sum of the prior
and current service annuities on the effective date of retirement of the person on whose service
the annuities are based, multiplied by °o of the percentage change in Consumer Price Index
for All Urban Consumers, from December of the year immediately preceding the effective date
of the person's retirement to the December that is 13 months before the effective date of this
ordinance.
(c) An increase in an annuity that was reduced because of an option selection is reducible
in the same proportion and in the same manner that the original annuity was reduced.
(d) If a computation hereunder does not result in an increase in the amount of an annuity,
the amount of the annuity will not be changed hereby.

(e) The amount by which an increase under this Section exceeds all previously granted
increases to an annuitant is an obligation of this City and of its account in the municipality
accumulation fund of the System.
Sectiot~,. The City Council finds, determines, recites and declares that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council was posted
at a place convenient to the public at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the public as required by law
at all times during which this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
Section S. Subject to approval by the Board of Trustees of Texas Municipal Retirement
System, the updated service credits and increases in retirement annuities granted hereby shall
be and become effective on the 1st day of January, 1993.

SUMMARY AND RECOMMENDATION
The City's fiscal year ended September 30, 1992. At that time, there were 42
outstanding purchase orders. The purchase orders represent goods that were
ordered and budgeted funds that were committed to procure items necessary to
operate the City. We need to re-establish these items for the new fiscal
year. This action will have no effect on the working capital of the various
funds.
A breakdown of the "open" purchase orders by operating fund are as follows:
