Members of City Council Present: Mayor Norman Malone, Councilpersons Guy Sutherland, Mike Cooper, Bob Thrower, Bob McLaughlin, Alton Porter, Jack Maxwell, Jerry Clarke Members of City Council Absent: Councilperson Deotis Gay (had been called away shortly before the meeting began due to a death in the family) Members of City Staff Present: City Manager Bob Herrera, City Attorney Knox Askins, City Secretary Cherie Black, Assistant City Manager John Joerns, Finance Director Jeff Litchfield, Human Resources/Purchasing Manager Louis Rigby, Planning Director Chuck Harrington, Police Chief Bobby Powell, Director of Parks and Recreation Stan Sherwood, Finance Officer Linda Stubbs, Accounting Supervisor Kathy Hutton, Recreation Superintendent Tim O'Connor Others Present: John Black, Bayshore Sun; 13 citizens 2. The invocation was given by City Attorney Askins. 3. Council considered approving the minutes of the regular meeting held January 25, 1993. Motion was made by Councilperson Cooper to approve the Januar 25 minutes as presented. Second by Councilperson Maxwell. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Maxwell, Clarke and Mayor Malone Nays: None At this time, Mayor Malone presented a Centennial Certificate of Appreciation to Mr. Harold Pfeiffer. Mr. Pfeiffer had been scheduled to receive this award in July, but had been unable to attend a Council meeting before tonight. The Mayor left the Council table briefly; Mayor Pro Tem Mike Cooper presided during the Mayor's absence. 4. Mr. Allen Shubert, partner in Glen Meadows Partners, addressed Council regarding placement of temporary real estate signs. He complimented the City on the cooperation he has gotten from them. He asked that Council consider some type of relief from the current sign ordinance for his company so that they might place temporary real estate signs to advertise their location, 0 9 Minutes, Regular Meeting, La Porte City Council February 9, 1993, Page 2 since the road work going on around the subdivision is keeping the public from really knowing there is any building going on. The site of construction is at the back of the subdivision, and unless they use temporary signs, they feel the homes will not be sold as rapidly. He suggested some rules and regulations be put in place to govern the temporary signs. Mr. Jeff Payson, Cervelle Homes, addressed Council to echo Mr. Shubert's comments. He explained that the directional signs did more than just show how to find the community, it also showed that there is activity there. Mr. Joe Green addressed Council regarding the proposed curfew ordinance. He read a letter signed by School Superintendent Richard Hays, supporting the ordinance. Mr. Green also supports the ordinance. Mrs. Janet Graves addressed Council as president of the La Porte Bayshore Garden Club. She thanked Council for their efforts in landscaping the City and their other beautification efforts. She feels it has really made a difference. Mr. H. P. Pfeiffer, President of the Board of Bayshore National Bank, addressed Council and read a short statement on the history of the bank, and thanking the City for the privilege of being considered as a depository for the City. Mrs. Lou Lawler addressed Council to thank them for their participation in the pancake breakfast and help making it the success it was. She reminded Council of the annual American Heart Breakfast to be held on February 10 at Sylvan Beach Pavilion at 7:30 A.M., and hoped to see them there. Mrs. Betty Waters addressed Council on behalf of herself and all other City retirees, to thank them for all the consideration given to retired employees this past year. She has received letters and phone calls from retirees asking her to represent them and come to Council to thank them. 5. Council considered an ordinance calling the regular annual election. The City Attorney read: ORDINANCE 93-1886 - AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE CITY OF LA PORTE; CALLING A RUN-OFF ELECTION, IF NECESSARY; DESIGNATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING FOR THE USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS; PROVIDING FOR METHOD AND DATES OF EARLY VOTING; PROVIDING FOR AN EARLY VOTING BALLOT BOARD; PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION; PROVIDING FOR NOTICE; PROVIDING FOR FILING Minutes, Regular Meeting, La Porte City Council February 9, 1993, Page 3 DEADLINE AND FILING FEES FOR CANDIDATES; PROVIDING A SAVINGS CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Porter to adopt Ordinance 93- 1886 as read by the City Attorney. Second by Councilperson Clarke. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Maxwell, Clarke and Mayor Malone Nays: None 6. Council considered an ordinance amending the Code of Ordinances of the City of La Porte, by adding a new Article IV to Chapter 13, relating to the establishment of a daytime and night time juvenile curfew. The City Attorney read: ORDINANCE 1887 - AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, BY ADDING A NEW ARTICLE IV TO CHAPTER 13, RELATING TO THE ESTABLISHMENT OF A DAYTIME AND NIGHT TIME JUVENILE CURFEW; CONTAINING FINDINGS AND OTHER PROVISIONS RELATING TO THE FOREGOING SUBJECT; DECLARING CERTAIN CONDUCT TO BE UNLAWFUL AND PROVIDING PENALTIES THEREFOR; PROVIDING FOR SEVERABILITY; PROVIDING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. City Manager Bob Herrera stated that at the last Council meeting this proposed ordinance was workshopped and there was some discussion as to what constitutes an adult and what age this ordinance would be in effect. Chief Powell explained that the school attendance law says if you are 16 when you start the school year, then you must finish that year. If you turn 16 before school starts the first semester, you don't have to attend. However, a person can leave home at 17 you cannot consider them runaways, but if that 17 year old is injured, parental consent is needed to treat. So it's up to Council what age they want in the ordinance. After discussion by Council regarding the daytime portion of the curfew and counseling services available, motion was made by Councilperson Maxwell to table the ordinance for further refinement. The motion died for lack of a second. Motion was made by Councilperson Porter to adopt Ordinance 93- 1887 as read by the City Attorney. Second by Councilperson Thrower. Council considered an ordinance awarding banking services agreement. The City Attorney read: ORDINANCE 93-1888 - AN ORDINANCE APPROVING AND AUTHORIZING A BANKING SERVICES AGREEMENT BETWEEN THE CITY OF LA PORTE AND BAYSHORE NATIONAL BANK OF LA PORTE, FOR A TWO YEAR TERM, COMMENCING MARCH 1, 1993, AND TERMINATING FEBRUARY 28, 1995, AND ON A MONTH TO MONTH BASIS THEREAFTER; MAKING VARIOUS FINDINGS AND PROVISION RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. At this time Mayor Malone, Councilperson Sutherland, and City Attorney Askins left the Council table and Mayor Pro Tem Cooper presided. Motion was made by Councilperson Thrower to adopt Ordinance 93-1888 as read by the City Attorney. Second by Councilperson McLaughlin. The motion carried, 6 ayes and 0 nays. Ayes: Councilpersons Cooper, Thrower, McLaughlin, Porter, Maxwell and Clarke Nays: None Mayor Malone, Councilperson Sutherland and City Attorney Askins returned to the Council table. 8. Council considered awarding a bid for recreation programs tee shirts. Motion was made by Councilperson Maxwell to award the tee shirt bid to Prestige Promotional, with a contingency contract to Constanzo's. Second by Councilperson Thrower. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Maxwell, Clarke and Mayor Malone Nays: None 9. Workshop Item: Discuss Resolution supporting legislation to provide a penalty of capital punishment for child abuse resulting in death of a child under six years of age. The City of Garland is asking support for a proposed bill for legislative action to provide a penalty of capital punishment Minutes, Regular Meeting, La Porte City Council February 9, 1993, Page 5 for child abuse resulting in death of a child under six years of age. After discussion, Council consensus was to present a resolution at the next meeting, with a possible age change. Mr. Herrera will contact the City Manager in Garland to see if there was a particular reason for the six years of age limit. The Mayor announced that Deer Park will sponsor this resolution at the next meeting of the Harris County Mayors' and Councils' Association. He asked the City Manager to inform Council of a draft letter to be sent to legislators to protest increased user fees and new fees mandated to municipalities, funds from which would be used to help balance the state budget. 10. Administrative Reports Mr. Herrera asked that, since the Council would be at a conference in Washington, D.C. on the date of the next regular meeting, that the meeting be moved to March 1. Council concurred with this suggestion. 11. Council Action Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Maxwell, Clarke and Mayor Malone brought items to Council's attention. Councilperson Clarke introduced his nominee for the Planning and Zoning position, Ron Gragg. A legislative contact committee, consisting of Councilpersons Sutherland, Cooper, Thrower and Gay, was named by Mayor Malone. This committee will closely monitor pending or proposed legislation, and notify Council on items that affect municipalities. 12. Council adjourned into executive session at 7:17 P.M. to address the following items under V.A.T.S. - Article 6252-17, Section 2(E), (F), (G) and (R) - (Legal, Land Acquisition, Personnel, and Conference(s) with City Employee(s) to Receive Information): (A) Section 2(G) - (Personnel) - Receive report from City Manager on personnel matter; (B) Section 2(E) - (Legal) - Discuss Industrial District contracts; (C) Section 2(G) - (Personnel) - Discuss appointment to Planning and Zoning Commission, and an executive session addendum which was posted February 5 - Section 2(E) - (Legal) - Receive report from City Attorney on contractual matter. Council returned to the Council table at 9:10 P.M., with no action taken. 13. The City Secretary of the City of La Porte shall forthwith issue Notice of said election by causing a substantial copy of this Ordinance to be published one time in the BAYSHORE SUN, which is hereby found and declared to be a newspaper of general circulation in said City, not less than ten (10) days nor more than thirty (30) days prior to the date of the said election. Section 8. Upon a candidate tendering his application on the form prescribed, the City Secretary shall furnish to such candidate all information relative to the qualifications for the office being sought; the method of placing the candidate's name on the ballot; the amount of the required filing fee; and any other pertinent information concerning said election. Section 9. Each candidate for the office of Councilperson must be a resident elector of the City. Each candidate for the office of District Councilperson must also be a resident of the district for which he files. Section 10. The deadline for a candidate to make application to have his name appear upon the ballot for such election, is hereby designated and established as 5:00 o'clock P.M., Wednesday March 17, 1993. No application shall be accepted for filing prior to February 16, 1993. The filing fee for each candidate for the office of Councilperson is hereby established as Fifty Dollars ($50.00). That the findings contained in the preamble to this Ordinance are determined to be true and correct and are hereby adopted as part of this Ordinance. Section 2. That Chapter 13 of the Code of Ordinances of the City of La Porte, Texas, is hereby amended by adding a new Article IV, which shall read as follows: ORDINANCE NO. 93- "ARTICLE IV. JUVENILE CURFEW. PAGE 2 Sec. 13.51. Definitions. The following words, terms and phrases when used in this Article shall have the meanings ascribed to them in this section, unless the context of their usage clearly indicates another meaning: Emergency shall mean an unforeseen combination of circumstances or the resulting state that calls for immediate action. The term shall include but not be limited to a fire, natural disaster, vehicular accident, or a serious medical condition of sudden onset. Guardian shall mean the person who, under a court order, is the guardian of the person of a minor or the public or private agency with whom a minor has been placed by a court. Minor shall mean any person under eighteen (18) years of age. Parent shall mean the natural mother or father or adoptive mother or father of a minor. Public place means any place to which the public or a substantial group of the public has access and includes, but is not limited to, streets, highways, and the common areas of schools, hospitals, apartments, houses, office buildings, transport facilities, and shops. Sec. 13.52 Offenses. (a) It shall be unlawful for any minor to knowingly remain, walk, run, stand, drive or ride about, in or upon any public place in the City: 1. between the hours of twelve o'clock at night (midnight) and 6:00 o'clock a.m. on any day of the week; or 2. between the hours of 9:00 o'clock a.m. and 2:30 o'clock p.m. on any day on which classes are in session in the La Porte Independent School District. (b) It shall be unlawful for the parent or guardian having legal custody of a minor to knowingly allow or permit the minor to be in violation of the curfew imposed in Sec. 13.52(a) of this Code. Sec. 13.53 Defenses. It is a defense to prosecution under Sec. 13.52 of this Code that: (a) The minor was accompanied by his or her parent or guardian; (b) The minor was accompanied by an adult designated by his or her parent or guardian; (c) The minor was on an errand made necessary by an emergency; (d) The minor was attending a school, religious, or government -sponsored activity or was traveling to or from •, • ORDINANCE NO. 93- PAGE 3 a school, religious, or government -sponsored activity; (e) The minor was engaged in a lawful employment activity or was going directly to or coming directly from lawful employment; (f) The minor was on the sidewalk of the place where he or she resides; (g) The minor was on an errand directed by his or her parent or guardian; (h) The minor was in a motor vehicle involved in intrastate or interstate transportation; (i) The minor was engaged in, participating in, or traveling to or from any event, function or activity for which the application of Section 13.52 of this Code would contravene his or her rights protected by the Texas or United States Constitutions; (j) The minor was married or had been married or had disabilities of minority removed in accordance with Chapter 31 of the Texas Family Code; or (k) With respect to the hours between 9:00 o'clock a.m. and 2:30 o'clock p.m. only, that the offense occurred during the school summer vacation break period of the school in which the minor is enrolled or on a holiday observed by the closure of classes in the school in which the minor is enrolled or that the minor has graduated from high school or received a high school equivalency certificate. Sec. 13.54 Supplemental effect. The provisions of this article are supplemental and shall be cumulative with all other laws and ordinances applicable in any manner to juveniles. Sec. 13.55 Enforcement Notwithstanding the penal effect of this article the chief of police is encouraged to develop alternative enforcement strategies, which may include but need not be limited to the return of minors to their residences or schools, counseling with minors and their parents or guardians, the issuances of warning citations to minors or their parents or guardians, or the referral of instances that appear to also involve the violation of school attendance laws to those officers who are responsible for the enforcement of those laws. The enforcement strategies shall be promulgated in writing to members of the police department so that this article may be enforced in a uniform manner." Section 3. If any provision, section, subsection, sentence, clause, or phrase of this ordinance, or the application of same to any person or set of circumstances is for any reason held to be unconstitutional, void or invalid, the validity of the remaining 0 • ORDINANCE NO. 93- PAGE 4 portions of this ordinance or their application to other persons or sets of circumstances shall not be affected thereby, it being the intent of the City Council in adopting this ordinance that no portion hereof or provision or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality, voidness or invalidity of any other portion hereof, and all provisions of this ordinance are declared to be severable for that purpose. Section 4. All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Sec. 13.9 of the Code of Ordinances of the City of La Porte is expressly repealed. Section 5. Any person who violates a provision of this ordinance, upon conviction in the municipal court of the City of La Porte, shall be subject to a fine not to exceed two hundred dollars ($200.00) for each offense. In analyzing the proposals submitted by the two banks, there are three distinct areas that need to be reviewed. They are the costs of the proposal, the financial condition of the bank and the services provided by the bank. The proposals submitted by each bank were identical in 90% of their requests. The only two items of difference were in the charges for safekeeping and the account maintenance on the average daily collected balance. Based on the aggregate annual transactions we estimated when we sent out the proposals, we can expect to pay $26,436 if we continue with Bayshore National and $25,794 if we change to Baytown State Bank. In regards to financial condition, I believe that both banks are going concerns and will be in business during the term of the contract. Services provided by the bank are the next area of consideration. Baytown State Bank has been in operation in La Porte for three years and have grown to have total deposits at their branch bank of $3 million. Their total deposits, including their Baytown Bank, are $44 million. Bayshore State Bank has total deposits of $125 million with their main bank being located in La Porte. My primary concern is Baytown State Bank's ability to address an immediate 18% growth in their branch bank. We will be dealing primarily with the branch bank with all documents being stored at the location in Baytown. In reviewing the physical facilities offered by the bank, it is an obvious advantage to Bayshore National. It appears Bayshore offers an advantage to our employees by providing easier access to cash their checks. In comparing loans for each of the banks, I found that Bayshore National had a loan to deposit ratio of 76% and Baytown State was 34%. I interpret this to mean that for every dollar on deposit, Bayshore has loaned out 76 cents to its customers and Baytown has loaned out 34 cents. I have just briefly touched these three areas and additional information can be found in the backup documentation. Staff's conclusion and recommendation is that we do not change banks at this time. The incidental costs and hardships associated with a change as well as the different levels of service, will offset the extra cost ($642) we would incur. Staff met with the Audit Committee on January 28, 1993 and received their unanimous support in continuing with Bayshore National Bank. When two year old Donny Martin was murdered by his stepfather, I and other community leaders vowed to take the lead in an all out effort to reduce child abuse. Though child abuse alone is a horrendous crime which should carry a heavy penalty, child abuse resulting in death is a crime deserving of extraordinary punishment. I am asking for your support in urging the Texas Legislature and the Governor to enact specific legislation that will provide capital punishment for anyone who takes the life of a child under six years of age. Senator J.E. "Buster" Brown is introducing such a bill for legislative action. It is identified as SB 13. I will be making special trips to Austin to encourage the passage of this legislation, and I need your help in making this become a reality. Would you, as Mayor, strongly urge your fellow councilmembers to adopt the attached sample resolution, and forward it along with a letter of support to your legislative representatives at the following addresses: Texas Senate, P.O. WHEREAS, the City Council of the City of Garland, Texas, has determined that Texas is experiencing an overwhelming problem with child abuse which ultimately leads to the death of the abused child; and WHEREAS, though child abuse alone is a horrendous crime which should carry a heavy penalty, child abuse resulting in death is a crime deserving of extraordinary punishment; and WHEREAS, the Texas Penal Code does not provide for capital punishment for persons whose abuse of a child leads to the death of that young victim; and WHEREAS, the City Council desires to urge State lawmakers to adopt legislation that would provide for capital punishment for those convicted of killing a child in the course of or following a period of abuse of the victim; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GARLAND, TEXAS: Section 1 That the City Council of the City of Garland, Texas, urges the Texas Legislature and the Governor to enact specific legislation that will provide capital punishment for anyone who takes the life of a child if it is found that the killing occurred during the course of or following a period of physical abuse of the child by the defendant.
