MINUTES OF THE PUBLIC HEARINGS AND REGULAR MEETING
LA PORTE CITY COUNCIL
FEBRUARY 22, 1993
The meeting was called to order by Mayor Malone at 6:00 P.M.
Members of City Council Present: Mayor Norman Malone,
Councilpersons Guy Sutherland, Mike Cooper, Bob Thrower, Bob
McLaughlin, Alton Porter, Deotis Gay, Jack Maxwell, Jerry
Clarke
Members of City Council Absent: None

The invocation was given by Councilperson Gay.
Council considered approving the minutes of the regular
meeting of Council held February 9, 1993.
Motion was made by Councilperson Sutherland to approve the
February 9 minutes as presented. Second by Councilperson
Thrower. The motion carried, 9 ayes and 0 nays.

McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor

Nays: None
Mr. Lee Huebel, Southeast Texas Housing Finance Corporation
addressed Council to briefly describe the programs carried out
by SETH. He distributed a detailed booklet to Council.
Mr. Richard Hays, La Porte ISD Superintendent of Schools,
addressed Council to voice his support of the juvenile curfew
ordinance.
5. Public Hearings
A. Mayor Malone opened public hearing A at 6:12 P.M. This
was the request of Stone Castle Industries for a special
conditional use permit for 205 North filth Street to allow

Stone Castle to use an existing building as a facility
for manufacturing of synthetic stone products.
Mr. Henry Blair, owner of Stone Castle, addressed Council
to explain what his company does and how it does it, and
showed a sample of the product.
Planning Director Chuck Harrington reviewed the request.
Mayor Malone asked for public input. There was none.
Councilperson Gay spoke for Mary Carella, who had been
asked by a property owner to represent them. She had
known nothing of the request or anything about the
business. Councilperson Gay had explained it to her, and
she had found it to be satisfactory.
Mr. Harrington stated that the recommendation of the
Planning and Zoning Commission is to approve the Special
Conditional Use permit for Stone Castle Industries.
The Mayor adjourned Public Hearing A at 6:18 P.M.
B. The Mayor opened public hearing B at 6:18 P.M. This
public hearing was a request of Houston Shell & Concrete
for a Special Conditional Use permit for 12803 Old La
Porte Road, to allow construction and operation of a
concrete batch plant.
Mr. Harrington reviewed the request for Council.
Mayor Malone asked for public input. Mr. Patton
Caldwell, representing Houston Shell & Concrete,
addressed Council and gave details of their operations.
There was no other public input.
Mr. Harrington gave the recommendation of the Planning
and Zoning Commission, which was to approve the Special
Conditional Use permit with two conditions added.
The Mayor adjourned Public Hearing B at 6:25 P.M.
6. Council considered approving request of Stone Castle
Industries for Special Conditional Use permit # SCU92-002.
Motion was made by Councilperson Sutherland to approve the
Special Conditional Use permit for Stone Castle Industries.
Second by Councilperson McLaughlin. The motion carried, 9
ayes and 0 nays.

7. Council considered approving request of Houston Shell &
Concrete for Special Conditional Use permit # SCU93-001.
Motion was made by Councilperson Gay to approve the special
Conditional Use permit for Houston Shell & Concrete. Second
by Councilperson McLaughlin. The motion carried, 9 ayes and
0 nays.

8. Workshop Item: Discuss amendments to juvenile curfew
ordinance.
Discussion was held by Council on proposed amendments to the
juvenile curfew ordinance, which were (1) change the
definition of minor to mean any person under seventeen (17)
years of age; and to delete item 2, daytime curfew, from
Section 13.52(a).
9. Council considered an ordinance amending Ordinance 93-1887
addressing juvenile curfew.
The City Attorney read: ORDINANCE 93-1887-A - AN ORDINANCE
AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE,
TEXAS, BY ADDING A NEW ARTICLE IV TO CHAPTER 13, RELATING TO
THE ESTABLISHMENT OF A NIGHT TIME JUVENILE CURFEW; CONTAINING
FINDINGS AND OTHER PROVISIONS RELATING TO THE FOREGOING
SUBJECT; DECLARING CERTAIN CONDUCT TO BE UNLAWFUL AND
PROVIDING PENALTIES THEREFOR; PROVIDING FOR SEVERABILITY;
PROVIDING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Maxwell to adopt Ordinance
93-1887-A as read by the City Attorney. The motion died for
lack of a second.
Motion was made by Councilperson Cooper to amend the ordinance
to include only the under 17 year olds to be considered minors
provision. Second by Councilperson Maxwell. The motion
failed, 2 ayes and 7 nays.

10. Council considered an ordinance approving and authorizing a
contract between the City of La Porte and Pas -Key Construction
Service, Inc., for construction of Farrington Boulevard water
line.
The City Attorney read: ORDINANCE 93-1889 - AN ORDINANCE
APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA
PORTE AND PAS -KEY CONSTRUCTION SERVICE, INC., FOR CONSTRUCTION
OF FARRINGTON BOULEVARD WATER LINE; APPROPRIATING $172,919.96
PLUS A CONTINGENCY OF $27, 080.04 TO FUND SAID CONTRACT; MAKING
VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING

ADOPTING A SCHEDULE OF MINIMUM FINES FOR TRAFFIC VIOLATIONS
FOR THE CITY OF LA PORTE MUNICIPAL COURT; AUTHORIZING THE
PRINTING OF SUCH SCHEDULE OF MINIMUM FINES ON THE REVERSE OF
THE VIOLATOR'S COPY OF TRAFFIC CITATIONS; PROVIDING A
SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS
ACT; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Clarke to adopt Ordinance 93-
1890 as read by the City Attorney. Second by Councilperson
McLaughlin. The motion carried, 9 ayes and 0 nays.

12. Council considered a resolution urging Governor and
Legislature of the State of Texas to adopt and enact
legislation providing capital punishment for persons who abuse
and murder children.
The City Attorney read: RESOLUTION 93-04 - A RESOLUTION
URGING THE GOVERNOR AND LEGISLATURE OF THE STATE OF TEXAS TO
ADOPT AND ENACT LEGISLATION PROVIDING CAPITAL PUNISHMENT FOR
PERSONS WHO ABUSE AND MURDER CHILDREN, AND PROVIDING AN
EFFECTIVE DATE.
Motion was made by Councilperson Cooper to adopt Resolution
93-04 as read by the City Attorney. Second by Councilperson
Thrower. The motion carried, 9 ayes and 0 nays.

13. Administrative Reports: City Manager Herrera reminded Council
of the subdivision developers who spoke on February 9
regarding temporary real estate signs and asking for some
relief from the sign ordinance regulations. Mr. Herrera asked
for direction from Council on what staff should do. Consensus
was to put this on as a workshop item at the March 1 meeting
and Council would discuss it and give staff direction at that
time.
14. Council Action: Councilpersons Thrower, Gay, Maxwell, Clarke
and Mayor Malone brought items to Council's attention.
15. There was no executive session.
16. There being no further business to be brought before the
Council, the meeting was duly adjourned at 7:19 P.M.

SUMMARY & RECOMMENDATION
Summary:
Stone Castle Industries is seeking a Special Conditional Use Permit
for 205 North llth Street. The purpose of the permit is to allow
Stone Castle to utilize an existing building as a facility for
manufacturing of synthetic stone products. A Conditional Use
Permit is required due to the Light Industrial Zoning of the
property in question.
The Planning & Zoning Commission considered this request during its
December 17, 1992 public hearing and regular meeting. The
Commission by a unanimous vote of members present has recommended
City Council approval of this permit. No additional conditions are
recommended.
Staff, in accordance with Zoning Ordinance requirements has mailed
public hearing notices to all properties located within 200 feet of
the tract in question. In the case of this request, notices were
mailed to 13 property owners. As of Monday, February 15, four (4)
replies favoring approval of the permit have been received. Should
any additional replies be received prior to February 22, they will
be presented to Council during the course of the public hearing.
Recommendation:
Staff concurs with the Planning & Zoning Commission and recommends
City Council approval of Special Conditional Use Permit #SCU92-002.

Dear Mayor Malone,
The La Porte Planning and Zoning Commission at its December 17, 1992, public hearing
and regular meeting considered Special Conditional Use Permit Request #SCU92-002. The
permit has been requested for the purpose of allowing Stone Castle Industries to operate
its business in an existing building located at 205 North 11th Street.
Stone Castle will manufacture a synthetic stone and mould it into ornaments and
architectural trim pieces. This type of business activity requires a Special Conditional Use
Permit when operated in a Light Industrial Zone.
The Planning and Zoning Commission, after considering this request during the public
hearing, has found the application to satisfy Zoning Ordinance prerequisites. The
Commission, by a unanimous vote of members present, has recommended that City Council

Requested For: 205 North Eleventh Street which is further described as Lots
9-11 and 22-24; Block 72; Town of La Porte. (Exhibit A)
Requested By: Mr. Henry Blair, owner of Stone Castle Industries.
Zonin : Light Industrial (LI)
Purpose of Reguest: Special Conditional Use Permit #SCU92-002 is requested to
allow Stone Castle Industries to locate at the above referenced
facility for the purpose of manufacturing architectural and
ornamental trim from synthetic stone. This business activity,
SIC #3272, is listed by Zoning Ordinance Section 7-500, Table
A, as conditional in LI zones.
Background: The facility in question, which consists of two (2) buildings, is
owned and operated by Barrett's Air Conditioning and Heating.
Barrett's is down sizing its operation and is proposing to lease
the "rear" building to Stone Castle Industries.
This rear building was constructed some years ago as a
secondary or accessory building for Barrett's Air Conditioning.
The building has no improved street frontage but rather, is
accessed from Barrett's parking lot. The alley separating the
two structures has been surfaced with what appears to be a
shell/gravel mixture and is used as a driveway to the rear
structure (see Exhibit A). While current ordinance provisions
would prohibit construction of a new building without its own
improved street frontage, the rear building can be considered
as a legally pre-existing, non -conforming structure in regards to
this issue. As the applicant is proposing no building additions
or site modifications, staff is considering the present situation
as an acceptable given. However, if this building were to be
enlarged at any time in the future, development of the

unimproved North 12th Street right-of-way would become
necessary. The issue of parking and traffic control is discussed
further in the analysis section of this report.
Stone Castle manufactures its products by blending sand and
polymer resins. This mixture is then poured into moulds. The
end product is a material which visually resembles various types
of stone and is shaped for specific applications. Mr. Blair, the
applicant, will present photo examples of typical products to the
Commission during the Public Hearing.
Based on information provided by the applicant, the entire
operation will take place indoors. The sand and other raw
materials must be protected from rain and other contaminants.
All material storage will also be indoors. Products will be
produced in relatively small runs of 300 - 500 pound batches.
Analysis: Zoning Ordinance Section 7-700 establishes performance
standards for Industrial, Conditional Uses. These standards are
too lengthy to list verbatim in this report. They can be found
on pages 63 and 64 of the Zoning Ordinance. The standards,
as they apply to this request, are as follows:
A. Traffic Control:
The intent of this section is to prevent excessive traffic
congestion and safety hazards. The requirement also
seeks to keep industrial traffic out of residential
neighborhoods. The property in question is located in a
Light Industrial zone. There is ready access to nearby
truck routes; specifically, Highway 146, West Main Street
(west of Hwy. 146.), and Barbour's Cut Boulevard.

Existing on -site parldng should be adequate for both
Stone Castle and Barrett's ongoing operation. This
business should have little impact on existing traffic
volume or patterns.
B. Drainage:
This is an existing facility. No building additions or site
modifications are proposed. Drainage is not applicable
to this request.
C. Compatibilily with Surrounding Area:
The facility is located in a relatively undeveloped Light
Industrial zone. As noted, all storage and processing will
take place indoors. There should be no incompatibility
with the surrounding area.
D. Required Licenses Obtained:
If the requested Conditional Use Permit is approved, the
applicant will have to obtain a City Zoning Permit and
a City Industrial Waste Permit. These are the only
operating permits required for this type of business.
E. Availability and Adequacy of Public Services:
Utilities and services currently available to the rear
structure appear to be adequate. Both of Barrett's
buildings are supplied with water from a single meter.
They also share a common sewer tap. The property is
to remain under single ownership. Stone Castle is
leasing not purchasing the rear building. Stone Castle's
manufacturing process does not rely heavily on water.
The primary water and sewer demand will be to
accommodate the sanitary needs to the approximately
five employees to be working out of the building. The
building does have its own restrooms. Impact on water
and sewer systems should be minimal.

F. Loading Berths:
While this building does not have any loading berths as
such, there is a large overhead door with adequate off
street maneuvering room to accumulate loading and
unloading. There will be no obstruction of pedestrian
traffic or visual obstruction of rights -of -way.
Conclusion: The request satisfies Zoning Ordinance prerequisites and is
therefore, eligible for the requested permit. Staff recommends
approval of Special Conditional Use Permit #SCU92-002.

noted on the letter of recommendation from Chairman Waters.
Staff, in accordance with Zoning Ordinance requirements, has mailed
public hearing notices to all properties located within 200 feet of
the tract in question. In the case of this request, notices were
mailed to three (3) property owners. As of Monday, February 15, no
replies have been received. Should any replies be received prior

The La Porte Planning and Zoning Commission, at its January 21, 1993, public hearing and
regular meeting considered Special Conditional Use Permit Request #SCU93-001. This
permit has been requested for the purpose of allowing Houston Shell & Concrete, the
applicant, to construct and operate a concrete batch plant in a Light Industrial Zone. The
proposed site for this plant is 12803 Old La Porte Road. The permit has been requested
as required by Section 7-500 of Zoning Ordinance 1501.
The Commission, by unanimous vote of members present, has recommended City Council
approval of Special Conditional Use Permit #SCU93-001. The Commission has also
recommended attaching the following two (2) conditions to this permit.
I. The applicant shall install an on site septic system to accomodate
sanitary waste.
H. All areas currently surfaced with calcium sulfate shall be topped with
a material suitable for control of dust.

Requested For: 12803 Old La Porte Road which is further described as a 1.726
acre tract out of the Enoch Brinson Survey (see Exhibit A).
Requested By: Mr. Patton H. Caldwell on behalf of Houston Shell & Concrete
Zonin : Light Industrial (LI)
Purpose of Request: = A Special Conditional Use Permit is requested to allow
construction and operation of a concrete batch plant (SIC 3273)
in a Light Industrial Zone.
Background: The tract in question is located at the southwestern comer of
the Hwy. 225, Hwy. 146 interchange. It is bounded to the west
by Strang Road and to the south by the Southern Pacific rail
right-of-way (see Exhibit A). The property, which is surfaced
with calcium sulfate, has until recently, been used as a
parking/marshalling yard for heavy trucks and trailers. The
eastern most portion of this tract (the portion which abuts the
Hwy. 146 right-of-way) will remain under separate lease and
continue to be utilized for this purpose. The property to the
north (which is a separate tract) is also used as a trucking
facility. This business will continue to operate as well.
Houston Shell & Concrete is proposing to set up and operate
a 'batch plant" at this location (see Exhibit B). The plant will
mix concrete from dry components and water. The wet
concrete will then be loaded into trucks which are dispatched
to job sites. A somewhat more detailed description of this
process has been submitted by the applicant and is attached as
Exhibit C. The tract in question is zoned LI. Zoning
Ordinance Section 7-500, Table A, lists this business activity as
Conditional in LI zones. A Special Conditional Use Permit is,
therefore, required.

Analysis: Zoning Ordinance Section 7-700 establishes "Special Use
Performance Standards" which apply to Conditional Uses.
These standards, as they apply to this request, will be discussed
in this section of staff s report. The text of these standards is
too lengthy to be included in this report in full, but can be
found on Zoning Ordinance pages 63-64.
A. Traffic Control:
The proposed site, as noted, was formerly used as a
truck marshalling yard. With well over an acre of
surfaced area, there is adequate on site parking for both
employee's personal vehicles and concrete trucks. The
section of Strang Road which connects this site with
Hwy. 225 primarily serves industrial traffic; the
Southern Pacific rail yard and the trucking firms
referenced above. This facility should not have a
significant impact on the type or volume of traffic
utilizing Strang Road and the adjoining Section of Hwy.
225.
B. Drainage:
The site in question is already surfaced and graded.
Drainage modifications, should any be required, will be
addressed during the course of the certified site plan
review which takes place prior to issuance of any
building permit for new commercial or industrial
development.
C. Compatibility with Surrounding Area:
The tract in question is zoned for industrial use. It is
located in a somewhat isolated, secluded area (see
Exhibit A). This facility should not cause any
impairment to the value or use of the adjoining trucking
yards or the Southern Pacific rail yard. The location is
isolated enough to preclude impact on other properties.

D. Reguired Licenses:
Houston Shell & Concrete has applied for and received
a permit exemption for plant operation from the Texas
Air Control Board (see Exhibit D). The supporting
documentation for this letter is in staffs file and is
available for the Commission's review. This letter
constitutes State approval for operation of this plant. If
this request is approved, a City Zoning Permit will also
be required.
E. Availability and Adequacy of Public Services:
There is no potable water or sanitary sewer service to
this tract; nor are there water or sewer lines in a
location to be readily extended to this site. Electric
service is available. The applicants propose to utilize an
existing 4" well to provide water for process and sanitary
needs. Bottled water is to be provided for drinking.
There is additionally, no water available for fire
protection. The applicant's request has been reviewed
by the City's Fire Marshall and Fire Chief. In their
opinion, the proposed plant and its operation should not
provide a significant degree of fire hazard. They,
therefore, based on fire protection needs, have no
objection to approval of the requested permit.
Regarding sanitary needs, staff would recommend as a
condition of permit approval, the applicant be required
to install an on site septic system for employee restroom
facilities.
F. Loading Berths:
This facility has no loading berths as such. The loading
chute and material silos are located in a manner that
will allow trucks to load, unload, and maneuver on site.
There should be no interference with traffic on Strang
Road.

Additional Requirements:
As noted, this site is surfaced with calcium sulfate. This
material is very stable and provides an excellent base to support
heavy truck traffic. It is not, however, dust free. Zoning
Ordinance Section 10-605.6 requires driveways, parking lots,
and storage yards to be "surfaced to control dust". Staff would
recommend that as a condition of permit approval, this site be
topped with a material that will provide dust free parking.
Conclusion: This request satisfies Zoning Ordinance prerequisites. Subject
to the following conditions, staff recommends approval of
Special Conditional Use Permit #SCU93-001.
I. Applicant shall install an on site septic system to
accommodate sanitary waste.

WHEREAS, the City Council has determined that there has been
an increase in juvenile violence, juvenile gang activity and an
increase in crime by persons under the age of seventeen in the City
of La Porte; and
WHEREAS, persons under the age of seventeen are particularly
susceptible by their lack of maturity and experience to participate
in unlawful and gang -related activities and to be victims of older
perpetrators of crime; and
WHEREAS, the City of La Porte has an obligation to provide for
the protection of minors from each other and from other persons,
for the enforcement of parental control of and responsibility for
their children, for the protection of the general public, and for
the reduction of the incidence of juvenile criminal activities;
and
WHEREAS, a curfew for those under seventeen years of age will
be in the interest of the public health, safety, and general
welfare, and will help to attain the foregoing objectives and to
diminish the undesirable impact of such conduct on the citizens of
the City of La Porte;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE:
Section 1. That the findings contained in the preamble to
this Ordinance are determined to be true and correct and are hereby
adopted as part of this Ordinance.
Section 2. That Chapter 13 of the Code of Ordinances of the
City of La Porte, Texas, is hereby amended by adding a new Article
IV, which shall read as follows:

"ARTICLE IV. JUVENILE CURFEW.
Sec. 13.51. Definitions.
The following words, terms and phrases when used in this
Article shall have the meanings ascribed to them in this section,
unless the context of their usage clearly indicates another
meaning:
Emergency shall mean an unforeseen combination of
circumstances or the resulting state that calls for immediate
action. The term shall include but not be limited to a fire,
natural disaster, vehicular accident, or a serious medical
condition of sudden onset.
Guardian shall mean the person who, under a court order, is
the guardian of the person of a minor or the public or private
agency with whom a minor has been placed by a court.
Minor shall mean any person under seventeen (17) years of age.
Parent shall mean the natural mother or father or adoptive
mother or father of a minor.
Public place means any place to which the public or a
substantial group of the public has access and includes, but is not
limited to, streets, highways, and the common areas of schools,
hospitals, apartments, houses, office buildings, transport
facilities, and shops.
Sec. 13.52 Offenses.
(a) It shall be unlawful for any minor to knowingly remain,
walk, run, stand, drive or ride about, in or upon any public place
in the City between the hours of twelve o'clock at night
(midnight) and 6:00 o'clock a.m. on any day of the week.
(b) It shall be unlawful for the parent or guardian having
legal custody of a minor to knowingly allow or permit the minor to
be in violation of the curfew imposed in Sec. 13.52(a) of this
Code.
Sec. 13.53 Defenses.
It is a defense to prosecution under Sec. 13.52 of this Code
that:
(a) The minor was accompanied by his or her parent or
guardian;
(b) The minor was accompanied by an adult designated by his
or her parent or guardian;
(c) The minor was on an errand made necessary by an
emergency;
(d) The minor was attending a school, religious, or
government -sponsored activity or was traveling to or from
a school, religious, or government -sponsored activity;
(e) The minor was engaged in a lawful employment activity or
was going directly to or coming directly from lawful
employment;
(f) The minor was on the sidewalk of the place where he or

she resides;
(g)
The minor was
on an errand directed by his
or her parent
or guardian;
(h)
The minor was
in a motor vehicle involved
in intrastate
or interstate
transportation;
(i)
The minor was

for which the
application
of Section 13.52 of this
Code would
contravene his
or her rights protected by
the Texas or
United States
Constitutions;
(j)
The minor was married or had been married or had
disabilities
of minority removed in accordance with
Chapter 31 of
the Texas Family Code.
Sec. 13.54 Supplemental effect.
The provisions of this article are supplemental and shall be
cumulative with all other laws and ordinances applicable in any
manner to juveniles.
Sec. 13.55 Enforcement
Notwithstanding the penal effect of this article the chief of
police is encouraged to develop alternative enforcement strategies,
which may include but need not be limited to the return of minors
to their residences or schools, counseling with minors and their
parents or guardians, the issuances of warning citations to minors
or their parents or guardians, or the referral of instances that
appear to also involve the violation of school attendance laws to
those officers who are responsible for the enforcement of those
laws. The enforcement strategies shall be promulgated in writing
to members of the police department so that this article may be
enforced in a uniform manner."
Section 3. If any provision, section, subsection, sentence,
clause, or phrase of this ordinance, or the application of same to
any person or set of circumstances is for any reason held to be
unconstitutional, void or invalid, the validity of the remaining
portions of this ordinance or their application to other persons
or sets of circumstances shall not be affected thereby, it being
the intent of the City Council in adopting this ordinance that no
portion hereof or provision or regulation contained herein shall
become inoperative or fail by reason of any unconstitutionality,
voidness or invalidity of any other portion hereof, and all

provisions of this ordinance are declared to be severable for that
purpose.
Section 4. All ordinances or parts of ordinances inconsistent
with the terms of this ordinance are hereby repealed; provided,
however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance. Sec. 13.9 of the Code of
Ordinances of the City of La Porte and Ordinance No. 93-1887 are
expressly repealed.
Section 5. Any person who violates a provision of this
ordinance, upon conviction in the municipal court of the City of
La Porte, shall be subject to a fine not to exceed two hundred
dollars ($200.00) for each offense.
Section 6. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to
the public as required by law at all times during which this
ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the

Section 7. This Ordinance shall be effective from and after
its passage and approval, and publication of its caption as
provided by law.

SUMMARY & RECOMMENDATION
During the Fiscal Year 1992 budget process, one of the projects
submitted and approved as a part of the Utility CIP Fund was the
construction of a new 12 inch water line along Farrington Blvd.
from Spencer Highway to the existing water storage tower in
Fairmont Park. This project has now been designed by the firm of
Claunch & Miller, Inc. and was released for the receipt of on
January 18, 1993.
As a result of the bidding process the City received four bids from
area contractors. These bids were reviewed and tabulated by
Claunch & Miller with a copy of those tabulations attached. As Mr.
Claunch states in his attached letter, the low bid in the amount of
$ 172,919.96 was submitted by Pas -Key Construction Service, Inc. of
Pasadena. In Mr. Claunch's letter he recommends award of the bid
to Pas -Key Construction in the amount stated above.
The Staff has reviewed Mr. Claunch's recommendation and concurs.
We, therefore, recommend that Council award the bid in the amount
of $ 172,919.96 to Pas -Key Construction Services, Inc. and that an
additional $ 27,080.04 be set aside for contingencies for a total
of $ 200,000.00 for construction of the water line.
Action Required by Council:
Approval of Ordinance # authorizing the City Manager to
execute a contract with Pas -Key Construction Services, Inc. in the
amount of $ 172,919.96 for the construction of the Farrington Blvd.
Water Line and authorizing that $ 27, 080.04 be established as a

On January 18, 1993, bids were received on the above referenced project. A tabulation of
the bids is attached herewith.
Claunch & Miller, Inc. has conducted research on the qualifications of the low bidder. Pas
Key Construction Service, Inc. provided CMI with a qualification statement, a financial
statement and a list of references.
The following is a summary of our analysis:
1. Bid Tabulation Sheet - Four construction firms participated in the bidding process.
The bids for the total project are as follows:
Lowest Bidder - Pas Key Construction - $172,919.96
Second Lowest Bidder - T & R Utilities - $243,114.00
Third Lowest Bidder - Kinsel Industries - $254,657.95
Fourth Lowest Bidder - Ramex Construction - $257,751.60
The difference between the low bidder and the second low bidder was $70,194.04.
The engineer's estimate was $246,509.50.
2. Oualification Statement - Pas Key Construction Service, Inc. provided a qualification
statement. Please see the attached form.
3. Financial Statement - The financial statement submitted by Pas Key Construction
Service, Inc. indicated the company's financial status as of July 31, 1992. The
statement is the result of an independent audit by Benton, Duroy & Ivey, P.C.,
Certified Public Accountant. The statement indicates that the company appears to be
financially stable.
4. References and Proiects - A list of references and similar projects was obtained from
Pas Key Construction Service, Inc.

5. Telephone Conversations with References - Various references were contacted by
telephone and asked to respond to a series of questions. For the most part they were
all very happy with the work that Pas Key Construction Service, Inc.. had performed
and would use them again in the future. References from the City of Alvin indicated
that they had some controversy with Pas Key on a paving project. However,
circumstances surrounding the controversy prevented the City from being fully
capable of commenting on Pas Key's quality of work. Please see the attached
documentation for further information on the conversations with the references.
6. Previous Work for the City of La Porte - Pas Key Construction Service, Inc. has
worked previously for the City of La Porte, on a sewer project. They have performed
very well on that project and the City has been pleased with their work.
In view of the above and attached documentation, Pas Key Construction Service, Inc. appears
to be a responsible firm that is capable of performing the specified work in a satisfactory
manner.
For these reasons, we recommend that the City of La Porte award the Farrington Blvd. Water
Line Project to Pas Key Construction Service, Inc. for the amount of $172,919.96.

ORDINANCE NO. 93-
AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE
CITY OF LA PORTE AND PAS -KEY CONSTRUCTION SERVICE, INC ., FOR
CONSTRUCTION OF FARRINGTON BOULEVARD WATER LINE; APPROPRIATING
$172,919 .96 PLUS A CONTINGENCY OF $27,080 .04 TO FUND SAID
CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE
SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes
the contract, agreement or other undertaking described in the
title of this ordinance, in substantially the form as shown in
the document which is attached hereto and incorporated herein by
this reference. The City Manager is hereby authorized to execute
such document and all related documents on behalf of the City of
La Porte. The City Secretary is hereby authorized to attest to
all such signatures and to affix the seal of the City to all such
documents. City Council appropriates the sum of $172,919.96 plus
a contingency of $27,080.04 from Capital Improvement Fund #003 to
fund said contract.
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall
of the City for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas
Revised Civil Statutes Annotated; and that this meeting has been
open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further

ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

VIOLATIONS FOR THE CITY OF LA PORTE MUNICIPAL COURT; AUTHORIZING
THE PRINTING OF SUCH SCHEDULE OF MINIMUM FINES ON THE REVERSE OF

Section 2. The Clerk of the City of La Porte Municipal Court
is hereby authorized to have said schedule of minimum fines for
traffic violations printed on the reverse side of the violator's
copy of traffic citations, and to furnish same to the City of La
Porte Police Department for its use.
Section 3. The Clerk of the City of La Porte Municipal Court
is hereby authorized to accept, upon a plea of guilty or upon a
plea of nolo contendere, the amount shown on the opposite of each
of the above described offenses, as a minimum fine therefor,
without the necessity of the violator appearing in Court.
Section 4. All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of conflict only.
Section 5. This Ordinance shall be in effect from and after
its passage and approval.

Section 6. If any section, sentence, phrase, clause, or any
part of any section, sentence, phrase, or clause, of this Ordinance
shall, for any reason, be held invalid, such invalidity shall not
affect the remaining portions of this Ordinance, it is hereby
declared to be the intention of the City of Council to have passed
each section, sentence, phrase, or clause, or part thereof,
irrespective of the fact that any other section, sentence, phrase,
or clause, or part thereof, may be declared invalid.

RESOLUTION NO. 93-04
A RESOLUTION URGING THE GOVERNOR AND LEGISLATURE OF THE STATE OF
TEXAS TO ADOPT AND ENACT LEGISLATION PROVIDING CAPITAL PUNISHMENT
FOR PERSONS WHO ABUSE AND MURDER CHILDREN, AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City Council of the City of La Porte, Texas, has
determined that Texas is experiencing an overwhelming problem with
child abuse which ultimately leads to the death of the abused
child; and
WHEREAS, though child abuse alone is a horrendous crime which
should carry a heavy penalty, child abuse resulting in death is a
crime deserving of extraordinary punishment; and
WHEREAS, the Texas Penal Code does not provide for capital
punishment for persons whose abuse of a child leads to the death of
that young victim; and
WHEREAS, the City Council desires to urge State lawmakers to
adopt legislation that would provide for capital punishment for
those convicted of killing a child in the course of or following a
period of abuse of the victim.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE, TEXAS:
Section 1. That the City Council of the City of Garland,
Texas, urges the Texas Legislature and the Governor to enact
specific legislation that will provide capital punishment for
anyone who takes the life of a child if it is found that the
killing occurred during the course of or following a period of
physical abuse of the child by the defendant.
Section 2. That this Resolution shall be and become effective
immediately upon and after its adoption and approval.
