State law allows the City to file a lien against a property when the user fails to pay the City for City provided utilities. The lien process is similar to that which we use for our demolition and lot mowing liens. There are two cases where we can not file a lien against the property. They are: ^ When the property is a homestead as protected by the Texas Constitution, or ^ The property is rental property and the owner of the property has provided notice to the City that the property is rental property. We believe that the passage of this ordinance will provide the City an opportunity to collect some amounts due for previous utility service that would otherwise be uncollectible.
