Council considered approving minutes of the regular meeting May 10, 1993. Motion was made bv CouncilDerson Sutherland to approve the May 10 minutes as presented. Second by Councilperson McLaughlin. The motion carried, 6 ayes and 0 nays and 2 abstaining. Proclamations: PBX/Telecommunicator Week Proclamation was presented to Nancy Kelley, President of the Pasadena-Bay Area PBX/Telecommunicator Club. Mayor Malone read letter from Chuck Harrington recommending Planning Department Secretary Peggy Lee as "Employee of the Quarter". Chuck Harrington presented a plaque to Peggy Lee. 6. Mrs. Lou Lawler addressed Council regarding the Seafarers Center. She gave a brief history of the founding of the Center and invited Council and staff to the dedication ceremonies Friday June 4th from 4:00 to 6:00 P.M. The new address for the center is 1700 East Barbours Cut Boulevard. Mrs. Lawler thanked Council for their help in making the center a reality. 7. Council considered ordinance repealing Ordinance 1812 requesting vacating, abandoning and closing a portion of North 17th Street. The City Attorney read: ORDINANCE 93-1812-A - AN ORDINANCE REPEALING "AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF NORTH 17TH STREET, IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS"; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council considered ordinance approving and authorizing a contract between the City of La Porte and Harris County, for fire fighting and fire protection services. The city Attorney read: ORDINANCE 93-1911 - AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND HARRIS COUNTY, FOR INCLUSION OF CITY OF LA PORTE POPULATION WITH HARRIS COUNTY FOR THE PURPOSE OF APPLICATIONS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR FUNDING FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND THE HOME INVESTMENT PARTNERSHIP PROGRAM; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Assistant City Manager John Joerns led a discussion with Council regarding EPA Administrative Order Docket No. VI-93- 1047, and NPDES Permit No. TX0022799. Mr. Joerns highlighted three elements of the information packet Council received. He introduced City Engineer Fred Thompson who has been designated e e Minutes, Regular Meeting La Porte City Council May 24, 1993, Page 5 as program manager for this effort and the person most familiar with the approach the City will take to comply with the EPA administrative order. Fred provided Council with an update of the City's approach and methods for solving some of the problems with inflow and infiltration reduction. These methods should bring the City of La Porte into compliance with EPA requirements. Bob Herrera stressed "the importance of the data complied by staff and the biggest problem the City is faced with at this time is not infiltration, but inflow, and as a result of some of the recommendations heard tonight, the Phase I programming will be a direct effort and plan of attack to hit those areas and take care of the big problems first." 13. Council considered a consent agenda as follows: (A) Consider awarding bid for purchase of open channel flow monitoring system; (B) Consider awarding bid for the supply of manhole chemical sealing material; (C) Consider awarding contract for removal and replacement of potable water tank; (D) Consider awarding bid for water and sewer supplies; (E) Consider awarding bid for pumper apparatus. Council discussed all of the items on the consent agenda and decided to vote on item (B) first. Item (B) Consider awarding bid for supply of manhole chemical sealing material. Motion was made bv Councilperson Sutherland to award the bid in a manner which would be commensurate with the lowest cost to the City of the manhole chemical sealina material. Second by Councilperson Maxwell. The motion carried, 8 ayes and 0 nays. Council Action: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Maxwell, Clarke and Mayor Malone brought items to council's attention. 16. Executive Session: There was no executive session held on A. section 2 (G) - (Personnel) Consider appointment to Airport Advisory Board. This item was deferred to the executive session of the regular meeting to be held on June 14, 1993. Also, at the executive session, the City Council will consider all vacancies to any boards or co_issions to which the Council makes appointments. 17. '01', .~ ~(? r l1!Jl1rrra.s : Emergency Medical Services is a vital public service and access to quality emergency care dramatically improves the survival rate of those who experience sudden illness or injury; and WHEREAS, efforts to establish emergency medical services as a medical specialty began twenty-five years ago; and WHEREAS, the members of emergency medical services teams consist of emergency physicians, emergency nurses, emergency medical technicians, paramedics, educators, administrators, and others; and WHEREAS, the members of emergency medical services teams engage in thousands of hours of specialized training and continuing education to enhance their lifesaving skills and the people of La Porte, Texas benefit daily from the knowledge and skills of these highly trained individuals; and WHEREAS, it is appropriate to recognize the value and the accomplishments of emergency medical services providers by designating Emergency Medical Services week; and WHEREAS, then designation of Emergency Medical Services week will serve to educate the people of La Porte, Texas about injury preVention and how to respond to a medical emergency. Peggy originally came to the City of La Porte on March 27, 1990, where she worked as part time Clerk I for the Parks and Recreation Department. She performed numerous duties for several staff members. After applying, and receiving several positive recommendations from staff, she obtained the position of Planning Department Secretary. In this position Peggy performs secretarial and related tasks for the entire division, consistently exceling at coordination of all departmental purchasing and personnel record keeping. She also has a major role assisting with project contract administration, maintaining eIP project budgets and departmental records management. Also, she serves as secretary to the Planning and Zoning Commission, spending many after work hours attending meetings and transcribing detailed minutes. In addition Peggy enjoys the respect of her co-workers, has an excellent attendance record and maintains a professional appearance. The City Secretary has contacted all franchised utility companies and City departments requesting review and comment. All comments have been received and there were no objections to the proposed closing, The adjacent property owners have submitted their letters of consent and hold harmless statements, The Harris County Appraisal District appraised value of the property is $.25 per square foot. The total fair market value determined for this closing is $9,000 which per the ordinance, is derived in the follo~ing manner. . · 24,000 sq. ft. X $.25 per sq, ft. WHEREAS, the City of La Porte desires to regulate the sale of beer and prescribe the hours when it may be sold, for consumption on premises in accord with provisions of Texas Codes Annotated, Alcoholic Beverage Code, Chapter 105, Section 105.05 and Section 105.06; and in accord with the provisions of Texas Codes Annotated, Alcoholic Beverage Code, Chapter 109, Subchapter C, Section 109.31 et seq; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: section 11 DEFINITIONS: Restaurant: A building or portion of a building, not operated as a dining room in connection with a hotel or boarding hotel, where the primary business is the on-premises sale of prepared food, with adequate kitchen facilities for the preparation of the food to be sold, the adequacy of said kitchen facilities to be based upon the seating capacity of the restaurant and the type of menu offered, and where alcoholic beverages may be sold under ~he following conditions: , J (1) At least sixty-five percent (65%) of the gross income shall be derived from the sale of prepared food. (2) Any outside entrances, outside separate identification, outside signs or other advertising shall not use any of the words "bar, " "tavern, " "lounge, " " ice house," or "beer, " or any word of like import, to identify the business. (3) Beer shall be served ~s a beverage only in connection with the service of prepared food to a customer. This project has moved forward to the point that the remaining section of the project is that portion from Underwood Road to SH 146. This was originally scheduled to be let for bid in late November with construction to begin soon after. TX DOT has now moved the project forward six (6) months and is in the process of bidding the project. As a part of the project, there was significant reconstruction planned for the intersection of Sens Road. This reconstruction will impact water and sewer utilities in the area and requires the city of La Porte to relocate their lines in the vicinity. The estimated cost of this relocation is $147,009.39. While the staff has been aware of the proposed relocation, we had not anticipated the accelerated bid and construction dates. In our discussions with TX DOT, we notified them that funding was not set aside during this fiscal year. In order to accommodate our situation, Tx DOT has agreed to allow the city to pay for the project in three (3) equal installments, beginning with the new fiscal year in October. This will allow TX DOT to proceed with the project and allow the City to budget for the expenditures. Recommendation The staff recommends that the city Council approve an ordinance authorizing an agreement between the City of La Porte and the State of Texas in the amount of $147,009.39, to be paid in three (3) equal payments for the relocation of water and sanitary sewer utilities at the intersection of Sens Road and SH 225. This method of pooling populations allows for a larger pool of money in the consortium than anyone city could qualify to receive. That in turn allows for each city to compete for funding of projects that would never be accomplishable on their own. The current agreement has expired and Harris county is now requesting that the city of La Porte now execute a new agreement for the time period of 1994 - 1996. Attached is a copy the agreement that is proposed by Harris County for the time period. As can be noted in the agreement, it will not require the City of La Porte to provide any funds for the program. The program merely pools our population base with other similar cities and Harris Co. Recommendation As the proposed agreement will provide a larger pool of funds for the city of La Porte to possibly use for any upcoming projects and will provide a central agency such as Harris County to perform all of the administrative functions necessary for a CDBG Program, the staff recommends that the Council approve an ordinance authorizing a cooperative agreement between the City and Harris county for purposes of the Community Development Block Grant Program. Department of Housing and Urban Development (HUD) for funding for the Community Development Block Grant (CDBG) program under the Housing and- Community Development Act of 1974 and funding for the HOME Investment Partnership (HOME) program under Title II of the National Affordable Housing Act for Fiscal Years 1994-96 and such additional funding periods as provided by the terms of this Agreement, said applications being hereinafter sometimes referred to as the "Grant Applicationsll; and WHEREAS, the County is willing to include all of the City's population in the Grant Applications and to cooperate with the City in the implementation of the City's community Development Program; and WHEREAS, the Texas Legislature has enacted the IITexas Community Development Act of 1975," codified as Chapter 373 of the TEX.LOC.GOV'T CODE ANN. (Vernon Supp. 1993), which provides, in part, for the authorization of cities to implement a community development program; and WHEREAS, the Texas Legislature has further enacted liThe Interlocal Cooperation Act, II codified as Chapter 791 of the TEX.GOV'T CODE ANN. (Vernon 1993), which provides, in part, that the County may contract with the City to perform governmental functions and services for the city. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That the County and the City in consideration of the mutual covenants and agreements herein contained, do mutually agree as follows: e e I. The ci ty agrees to allow the County to include the City's population in the Grant Applications, and the County agrees to include the same in the Grant Applications. II. The City agrees to allow the U. S. Department of Housing and Urban Development to use the City's population and other necessary demographic characteristics in the determination of whether the County will qualify as an "urban county" as defined in the Housing and Community Development Act of 1974 (42 U.S.C. 5301 et seq.), as amended, and the rules and regulations promulgated pursuant thereto. III. The County and the City agree to cooperate to undertake, or to assist in undertaking, community renewal and lower income housing assistance activities, specifically urban renewal and publicly assisted housing, as further set out in 24 CFR 570.307(cf. IV. (A) The City acknowledges that it is aware that the Grant Applications have not yet been completed or submitted to the U. S. Department of Housing and Urban Development and that no determination has been made at the time of execution of this Agreement as to where and for what purposes the funding, if any, for the CDBG and the HOME programs will be sought or expended. In this regard it is agreed that Harris County shall not be obligated to seek funds for expenditure in the city or for assistance to residents of the City in the Grant Applications. If such funds for expenditure in the City or for assistance to its residents are awarded as a result of the Grant Applications, the County may, in its sole discretion, override such distribution of the award and spend such funds elsewhere and/or for other purposes when necessary or desirable in order to achieve compliance with Title I of the Housing and Community Development Act of 1974, as amended, and all appropriate implementing regulations applicable thereto. The City has received no assurance, written or oral, from the County to the contrary and is aware that the execution of this contract does not consti tute any guarantee on the part of the County that funds received pursuant to the Grant Applications, if any, will be expended for projects within the City limits of the City or for assistance to the residents of the City. (B) The city also acknowledges that upon execution of this Agreement, the city: 2 e e (1) may not apply for grants under the Small cities or State CDBG Programs from appropiriations for fiscal years during the period in which it is participating in the urban county's CDBG program; and (2) may not participate in a HOME consortium except through the urban county, regardless of whether the urban county receives a HOME formula allocation. v. This Agreement shall remain in full force and effect for the following period: (1) During the entire urban qualification funding period for Fiscal Years 1994-96 and for such additional time as may be required for the expenditure of CDBG and HOME funds granted to the County for such period, as well as any income received with respect to such period. The city acknowledges that it has been advised and is aware that federal regulations applicable to the Grant Applications do not permit the County to allow the Ci.ty to withdraw from this Agreement or otherwise terminate this Agreement at any time during this period, unless the County fails to receive a grant for any year during such period. (2) This Agreement will automatically be renewed for the three-year urban qualification period which begins the year in which the next qualification of the urban county is scheduled, and for any successive three-year qualification periods, unless the following events occur: (a) The City or the County may terminate this Agreement at the end of any qualification period by giving written notice to the other party prior to the beginning of the next urban county qualification period, with a copy of such termination notice being sent to the HUD Field Office; or (b) In the event changes are made in the law or regulations relating to requirements for cooperation agreements, the parties must adopt an amendment to this Agreement incorporating such required changes. Failure to enter into such written amendment (with a copy thereof sent to the HUD Field Office), as necessary to meet the requirements set forth in the Urban County Qualification Notice applicable for the 3 e e year in which such qualification of the urban county is scheduled, shall void the automatic renewal provision of this Agreement. The County agrees to notify the City in writing of the City's right to elect not to participate in subsequent three-year qualification periods. Such notiGe must be sent to the City by the date specified in HUD's urban qualification notice for each successive qualification period. VI. In the performance of this Agreement, County and city agree to take all actions necessary to assure compliance with County's certification required by section 104(b) of Title I of the Housing and community Development Act of 1974, as amended, including Title VI of the civil Rights Act of 1964 (42 U.S.C. 2000d et seq.), the Fair Housing Act (42 U.S.C. 3601-20), section 109 of Title I of the Housing and community Development Act of 1974, the Americans with Disabilities Act and other applicable laws, regulations and executive orders, including but-not limited to those set out under Subpart K, 24 CFR 99 570.600-.613. The City agrees and understands that Harris County is prohibited from funding activities in or in support of any cooperating city that does not affirmatively further fair housing within its own jurisdiction or that impedes Harris County's actions to comply with its fair housing certification as required under 24 CFR 570.303. VII. The City 570.501(b), it sUb-recipients, set forth in 24 agrees and understands that pursuant to 24 CFR is subj ect to the same requirements applicable to including the requirement of a written agreement as CFR 570.503. VIII. Should the U. S. Department of Housing and Urban Development rej ect or refuse to accept this Agreement for any reason, the County may terminate this Agreement by giving written notice of such termination to the City. IX. The County and city agree that the County has authority to carry out activities which will be funded from annual Community Development Block Grants and HOME allocations and from any program income generated from the expenditure of such funds. 4 e e X. The County and City by executing this Agreement certify that each has adopted and is enforcing to the extent authorized by state law: (1) a policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in non-violent civil rights demonstrations; and (2) a policy of enforcing applicable state and local laws against physically barring entrance to or exit from a facility or location which is the subject of such non- violent civil rights demonstrations within its jurisdiction. XI. This Agreement shall be of no force and effect unless and until it is executed by both parties hereto and certified by counsel for all part~es hereto on the forms set forth below. Update on Administrative Activitv with EP A At the Council Retreat (November 1992) staff reported that: . Initial data collection and evaluation indicated that the most significant problem was excessive inflow. . The staffs approach was to initially target the inflow problem, followed by and where necessary, the more tedious and expensive tasks of identifying excessive infiltration and sanitary sewer line rehabilitation. . The Public Works Department would be adjusting their procedures to operate the Wastewater Treatment Plant at peak hydraulic capacity and still meet our permit requirements (completed! ongoing). . Public Works Department would be installing manhole inserts at various locations (ongoing). " e e Memo to RTH UpdatelIn House 1&1 Reduction Program May 20, 1993 Page 2 of 4 . The staff would investigate and pursue purchase of flow monitoring devices to assist in data collection and definition of problem service areas (Item 13, Council Meeting of May 24, 1993). . Approaches to manhole rehabilitation would be investigated (Item 13, Council Meeting of May 24, 1993). . Staff would investigate approaches for contracting various repair/rehabilitation techniques that are beyond the scope of City forces (under development). This above information was incorporated (along with other items) into quarterly reports mandated by EP A's Administrative Order. The reports also contained proposed approaches and schedules for achieving compliance. In March, we learned from the enforcement officer overseeing our file that his supervisor had concerns with the compliance schedule proposed by the City. This resulted in a new Administrative Order being issued which required the City to visit EP A and explain/defend the proposed compliance schedule. On April 28, Fred Thompson, City Engineer, Steve Gillett, Director of Public Works and I met with EPA to discuss our Administrative Order and proposed compliance schedule. At that meeting it became apparent that EP A would not approve our schedule as submitted. Based on the size of our system, EP A felt that we should put together a program that would target compliance in a four year period. Therefore, the City was asked to re-submit a more aggressive schedule within three weeks. Staff re-examined the issues and did submit a new schedule (attached) which has been confirmed (by telephone) as acceptable. Staff will be following up with formal submittal to EP A. The approach to resolving the 1&1 problem is essentially the same. The major change is the more aggressive schedule required by EPA. We feel we can meet this schedule but may have to supplement our in house forces from time to time with outside consultants or contractors. Update on In House 1&1 Efforts With the adjustments to the Wastewater Treatment Plant operation and diversion of flows at Lift Station #30, we have already noticed a reduction in citizen complaints and reported overflows. It appears that we have generally alleviated overflows and complaints for rainfall events up to 2"-2th" in a 24 hour period. As we proceed with the manhole repairs and flow monitoring we should continue to reduce inflows by a significant and measurable amount. This system will be utilized by the Inflow and Infiltration Reduction Program to assist in the evaluation of the sanitary sewer system to determine problem areas, as well as for follow-up evaluation after repairs. Originaly, one (1) unit, which also included software, was anticipated. Based on further evaluation by staff, as well as comments from the Environmental Protection Agency, it was determined that three (3) units were required to accomplish the necessary flow measurements in a timely manner. Because only one unit is needed with software, Maccaulay Controls was contacted to provide a quote for an additional two (2) units without software. Attached is a quote for an additional two units at $6,565.00 each for a total additional cost of $13,130. This would result in a total cost of $20,876.00. Funds in the amount of $150,000 are available in the Utility CIP Fund for the reduction of inflow and infiltration to the sanitary sewer system. Second low unit price was submitted by Avanti, Inc. for $3.00/lb for acrylamide; $17.00/gl for triethanolamine; and $1.56/lb for ammonium persulfate. A performance comparison between the materials bid, using literature supplied by the vendors, was performed by Staff personnel. To seal a single manhole, it requires approximately 150 lbs of AC 400 versus 50 lbs of acrylamide and approximately the same amounts of the other materials. The cost per manhole using the materials bid by Cues, Inc. is $294.00 versus a cost of $182.60 with the materials bid by Avanti, Inc. This is a difference of $111.40 per manhole sealed. The comparison of the materials cost is outlined in Exhibit 2. Based on the difference in cost per manhole sealed, staff recommends award of bid to Avanti, Inc., low bidder based on performance comparison, for the supply of manhole chemical sealing materials. A total of 323 more manholes can be sealed using the Avanti, Inc. materials versus the Cues, Inc. material. The total contract cost, using estimated yearly quantities, would be $96,446.80. Estimated expenditure this budget year is $48,223.40. Funds in the amount of $150,000 are available in the Utility CIP Fund for the reduction of inflow and infiltration to the sanitary sewer system. Proposal Tabulation - Request for Proposals #0050 - Removal and Replacement of 125,000 gallon, Bolted, Galvanized Potable Water Tank SUMMARY & RECOMMENDATION Proposals for the removal and replacement of a 125,000 gallon, galvanized potable water tank were opened and read on February 1, 1993. Proposal requests were mailed to eight (8) contracting firms with three (3) returning proposals. The lowest proposed price meeting specifications for removal and replacement of the potable water tank was submitted by Migon, Inc. at a total cost of thirty-eight thousand, nine hundred dollars ($38,900). Texas Water Commission regulations were revised, effective January, 1993. The revision states that all galvanized potable water tank coatings must be National Sanitation Foundation (NSF) approved prior to construction. The proposed tank construction was postponed pending approval by the NSF. Migon, Inc. agreed to extend the proposed construction price for a period of sixty (60) days. NSF approval was received on May 11, 1993. Migon, Inc. reissued an extension of the proposed construction price on May 13, 1993. It is recommended that the contract to remove and replace the 125,000 gallon bolted, galvanized potable water tanks located at 404 W. Fairmont Parkway be awarded to the lowest proposer meeting specifications, Migon, Inc. in the amount of $38,900.00, with a 5% contingency of $1,945.00 for a total project cost of $40,845.00.
