Ms. Ruth Pavelko asked to speak to Council regarding Little Cedar Bayou Park and Ball Field. Ms. Pavelko presented a petition with 104 names requesting a gate be placed at the corner of 8th Street and West "M" Street. Ms. Pavelko stated there is loud music and other disturbances in the park late at night. Mr. Andrew Pavelko also spoke on the same subject adding other disturbing incidents occurring in the late evening and early morning hours in Little Cedar Bayou Park. 6. Council considered an ordinance calling a Special Election on November 2, 1993. City Attorney read: ORDINANCE 93-1931 - AN ORDINANCE CALLING A SPECIAL ELECTION OF THE CITY OF LA PORTE; DESIGNATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING FOR USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS; PROVIDING FOR METHOD AND DATES OF EARLY VOTING; PROVIDING FOR AN EARLY VOTING BALLOT BOARD; PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION; PROVIDING FOR NOTICE; PROVIDING A SAVINGS CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council considered an ordinance vacating, abandoning and closing the alley between Lots 9-24, both inclusive, Block 1446, Town of La Porte. Council considered an ordinance approving and authorizing a contract to Sentell Lawn Maintenance for clean-up and removal of debris from block 1446 and the adjacent "Q" Street right- of -way . Council made the decision to consider and vote on items 7, 8 and 9 all together as they are related to one issue. Motion was made by Councilperson Thrower to approve Ordinance 93-1932, 93-1933 and 93-1934 as read by the City Attorney. Second by Councilperson Maxwell. Council considered authorizing a Public Hearing for the purpose of condemning and ordering demolition of dangerous buildings. Chief Building Official Mark Lewis briefed Council on basis and reason for the Public Hearing and requested October 25, 1993 as the hearing date. Mr. Lewis turned the review over to Inspector II Debbie Wilmore. Ms. Wilmore showed video of the eight (8) structures being considered. Motion was made by Councilperson Cooper to authorize a oublic hearinc,L on October 25 , 1993 , for the purpose of condemning and order demolition of dangerous buildings. Second by Councilperson Gay. Council considered adopting Resolution No. 93-13 adopting the Bayfront Master Plan dated August 27, 1993. Director of Planning Chuck Harrington introduced Keith Carlson of the consortium of Mitchell, Carlson & Associates, Inc., SLA Studio Land Inc. and Carter Burgess Inc., who developed the plan. Mr. Carlson gave a presentation and explanation of the development of this plan. City Attorney read: RESOLUTION 93-13 - A RESOLUTION APPROVING THE BAY FRONT MASTER PLAN DATED AUGUST 27, 1993; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Mayor Pro Tem Jerry Clarke called to order the Workshop regarding "Family and Medical Leave Act of 1993" at 7:15 P.M. Director of Administrative Services Louis Rigby led discussion with Council regarding amending Chapter 6, adding Section 14, "Family/Medical Leave", of the City of La Porte Personnel Policy Manual. City Manager Bob Herrera gave an overview of the recommendations from staff and the changes suggested by Council. Mr. Herrera recommended Ordinance 93-1924 remain tabled and brought back at the next regular council meeting for consideration. The workshop was closed at 8:28 P.M. 13. Council decided to delay adopting Ordinance 93-1924 until the necessary changes can be made to the ordinance as discussed at the workshop. Therefore, Ordinance 93-1924 will remained tabled until it can be place on the agenda for October 11, 1993. 14. City Manager Bob Herrera had no administrative reports to present. 15. Councilpersons Cooper, Thrower, McLaughlin, Gay and Mayor Pro Tem Clarke brought items before Council. Mr. Herrera stated a recommendation for combating the problems in the Little Cedar Bayou Park will be forthcoming. 16. Council adjourned into executive session at 8:37 P.M. The clearing went beyond their property line approximately 40 feet into City property. The City contacted Mr. Angel to discuss damages to the City's property. Mr. Angel offered to deed to the City Lots 1-16, Block 1446 as compensation. His offer was contingent upon City releasing him of obligations for debris removal. In addition, Mr. Angel requested the City to close a sixteen (16) foot alley adjacent to Lots 9-24, Block 1446 (3,200 sq. ft.) and relinquish City's half to Angel. Council expressed their interest in pursuing this offer. However, prior to final agreement, Council instructed staff to secure an Environmental Site Assessment of the property conveyed to the City. ACER Environmental Systems performed an Environmental Site Assessment and follow up in place soil-gas survey. The Assessment found no evidence of dumping, storage, or of a release of hazardous materials. The soil samples found no contamination. Staff returned to Council with this information and was asked to finalize the negotiations. The proposed agreement between the City of La Porte and Bruce Angel includes: • the deeding of Lots 1-16, Block 1446 to the City of La Porte, • the agreement by the City to close a sixteen (16) foot alley adjacent to Lots 9-24, Block 1446, • the relinquishing of City's half of the alley adjacent to Lots 9-24, Block 1446, • the City recognizing encroachment of the fencing, porch and related unprovements and providing for termination of the encroachment upon 90 days written notice or August 9, 2003 whichever is sooner. Action Required by Council: Approve Ordinance 93-1932 authorizing City Manager to execute an agreement between the City of La Porte and Angel's Self Service, Inc. Said agreement sets forth the following: • Deeding of Lots 1-16, Block 1446 to the City of La Porte. • Closing of alley adjacent to Lots 9-24, Block 1446, and relinquishing City's half of alley. • Recognization of encroachment. The City Council hereby approves and authorizes the contract, agreement, or other undertaking described in the title of this ordinance, in substantially the form as shown in the document which is attached hereto and incorporated herein by this reference. The City Manager is hereby authorized to execute such document and all related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. La Porte, in consideration of such conveyance, agrees to vacate, abandon and close the 16' alley adjacent to Lots 9-24, both inclusive, in Block 1446, Town of La Porte, Harris County, Texas, and La Porte further agrees to relinquish to Angel, La Porte's one-half interest in and to said alley, for a total area of approximately 3,200 square feet to be relinquished to Angel under the terms of this agreement; 3. La Porte, at its sole cost and expense, shall clean up and remove the debris on Lots 1-16, both inclusive, Block 1446, Town of La Porte, Harris County, Texas; and 4. Angel is allowed to keep its existing mobile home and fenced yard adjacent to said mobile home, now located on the alley, and on a portion of Lots 1-16, Block 1446, in place, but only upon the following terms and conditions: • Mr. David Angel Angel's Self Service, Inc. August 30, 1993 Page -2- a. Angel does not obtain any prescriptive rights to use of the portion of Lots 1-16, Block 1446 currently occupied by the fenced-in area and the mobile home. In any event, the encroachment of the mobile home and the fenced area shall terminate upon August 9, 2003, even if the City of La Porte has not given the 90-day notice to terminate the encroachment as provided in Paragraph 4(a) above. c. Pre-existing, non-conforming status of the mobile home and the fenced area. Notwithstanding the agreements relating to the encroachment of the mobile home and fenced area upon a portion of Lots 1-16, Block 1446 mentioned above, La Porte and Angel agree that the mobile home and the fenced area (including the nvn-encroaching portion of the fenced area) constitute a pre-existing, non- conforming use, as said term is defined in the Zoning Ordinance of the City of La Porte. All aspects of La Porte's Zoning Ordinance apply to said mobile home and fenced-in area as the same are constituted as a pre-existing, non-conforming use. d. Even if La Porte gives the 90-day advance notice to Angel that Angel must remove the mobile home and fenced-in encroachment as provided above, if and only if Angel moves the mobile home and fenced-in area off of Lots 1-16, Block 1446 onto the land adjacent to said lots currently owned by Angel (and being a portion of the same lot of record) • Mr. David Angel Angel's Self Service, Inc. Resolution SUMMARY & RECOMMENDATION Back ra ound During FY 1993 the City of La Porte entered into an agreement with Southwestern Bell Telephone, whereby Southwestern Bell agreed to provide the City of La Porte $10,000.00 for the preparation of a Bayfront Master Plan. To this amount the City added $15,000.00 and employed the consortium of Mitchell, Carlson and Associates, Studio Land Associates, and Carter & Burgess, Inc. to develop the plan. Attached for the Council's approval is that Bayfront Master Plan. This document has been through several meetings of the Planning and Zoning Commission, City Council and one Town Hall Meeting where special emphasis was placed on public input. The resultant document has been refined to present the best guide as to the desired development of La Porte's bayfront area. On September 16, the Planning and Zoning Commission, in regular session approved the recommendation to the City Council that the Bayfront Master Plan be approved as the development guide for La Porte's bayfront area. Recommendations The staff recommends approval of the resolution adopting the Bayfront Master Plan. The law requires employers with 50 or more employees to offer its workers up to twelve (12) weeks of unpaid leave for family medical emergencies or the birth or adoption of a child. This law went into effect August 5, 1993. The attached ordinance amends the City's Personnel Policy Manual and allows all full time, regulaz employees to take up to 12 weeks because of the birth or adoption of a child (whether that employee is the mother or father), or if his or her spouse, child or pazent suffers a serious illness. The employee will be required to use any accrued vacation leave balance first and the remainder of the 12 weeks shall be with no pay. In addition, an employee is entitled to a leave if his or her own medical condition prevents the employee from working. The employee will be required to use any accrued sick leave balance first and the remainder of the 12 weeks shall be with no pay. On returning from leave, the employee will be allowed to return to their old job, or to a job with comparable pay and benefits. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA FORTE: Section 1. Chapter 6, Section 14, "Family/Medical Leave" of the City of La Porte Personnel Policy Manual dated January 1, 1992, is hereby amended, and shall hereafter read as follows, to-wit: "SECTION 14 -FAMILY/MEDICAL LEAVE Any regular full time employee with at least 12 months of service, and that has worked at least 1250 hours in the last 12 months, may be eligible to take up to 12 weeks of unpaid Family/Medical Leave within any 12 month period and be restored to the same or an equivalent position upon return from the leave. (The City will calculate the 12 month period by using a "rolling" 12 month period.) Family/Medical Leave may be granted to regular full time employees to maintain continuity of service and to allow them to take the necessary time to handle compelling matters. 1. Family/Medical Leave shall be defined as an approved absence available to eligible employees for up to 12 weeks per year under particular circumstances. Circumstances that would constitute Family/Medical Leave are as follow: (1) the birth of a child and in order to care for such child; (2) the placement of a child with you for adoption or foster care; {3) to care for your spouse, son, daughter, or parent with a serious health condition; or (4) because of your own serious health condition which renders you unable to perform the functions of your position. Leave because. of reasons {1) or (2) must be completed within the 12 month period beginning on the date of birth or placement. In addition, spouses employed by the City who request leave because of reason (1) or (2) or to care for an ill parent may only take a combined total of 12 weeks leave during any 12 month period. 2. Family/Medical Leave is unpaid. If leave is requested because of a birth, adoption or foster care placement of a child, or to care for a spouse, child, or parent with a serious health condition, any accrued paid vacation, first will be substituted for any unpaid Family/Medical Leave. If leave is requested because of the employee's own serious health condition, any accrued paid sick leave will be substituted first and then accrued paid vacation will be substituted for any unpaid Family/Medical Leave. The use of paid leave time for unpaid leave time does not extend the 12 week leave period. ORDINANCE NO. 93924 • PAGE 2 3. If leave is requested because of the employee's own or a covered relation's serious health condition, the employee and the relevant health care provider must supply appropriate medical certification. Medical Certification Forms may be obtained from the Human Resources Department. When leave is requested, the City will notify the employee of the requirement for medical certification and when it is due (at least 15 days after leave is requested). Failure to provide requested medical certification in a timely manner may result in denial of leave until it is provided. The City, at its expense, may require an examination by a second health care provider designated by the City, if it reasonably doubts the medical certification initially provided. If the second health care provider's opinion conflicts with the original medical certification, the City, at its expense, may require a third, mutually agreeable, health care provider to conduct an examination and provide a final and binding opinion. The City may require subsequent medical recertification on a reasonable basis. 4. If medically necessary for a serious health condition of the employee or his or her spouse, child, or parent, leave may be taken on an intermittent or reduced leave schedule. If leave is requested on this basis, the City may require the employee to transfer temporarily to an alternative position (equivalent in pay and benefits) which accommodates recurring periods of absence. 5. No loss of service credit with the City will occur as a result of the leave, but no benefit credits will accrue toward vacation or sick leave during unpaid leave. However, accruals toward vacation and sick leave may be earned during paid leave. 6. The employee's health benefits will continue during the leave, in accordance with the City of La Porte Medical Plan Document. However, if the employee does not return to work they will be responsible for 100% repayment, unless they cannot return to work because of a serious health condition or other circumstances beyond their control. The employee is responsible for payment of their dependent coverage premiums and other authorized payroll deductions while they are on leave. 7. If the need for Family/Medical Leave is foreseeable, the employee must give the City 30 days prior written notice. Where the need for leave is not foreseeable, the employee is expected to notify the City within 1 to 2 business days of learning of the need for leave, except in extraordinary circumstances. Failure to provide such notice may be grounds for delay of leave. The City has Request for Family/Medical Leave forms available from the Human Resources Department. These forms should be used when requesting leave. ORDINANCE NO. 931924 • PAGE 3 8. if leave is taken because of the employee's own serious health condition or to care for a covered relation, the employee must contact the City on the first and third Friday of each month regarding the status of the condition and their intent to return to work. 9. Upon completion of leave because of the employee's own serious health condition, the employee is required to provide medical certification that they are fit to resume work. Return to Work Medical Certification Forms may be obtained from the Human Resources Department. Employees failing to provide the Return to Work Medical Certification Form will not be permitted to resume work until it is provided. NOTE: For the purposes of the Family/Medical Leave Policy, the following definitions apply: "Spouse" is defined in accordance with applicable State law. "Parent" includes biological parents and individuals who acted as your parents, but does not include parents-in-law. "Child" includes biological, adopted, foster children, stepchildren, legal wards, and other persons for whom you act in the capacity of a parent and who is under 18 years of age or over 18 years of age but incapable of caring for themselves. "Serious Health Condition" means .any illness, impairment, or physical or mental condition that involves: (1) any incapacity or treatment in connection with inpatient care; (2) an incapacity requiring absence of more than three calendar days and continuing treatment by a health care provider; or (3) continuing treatment by a health care provider of a chronic or long-term condition that is incurable or will likely result in incapacity of more than three days if not treated. "Continuing Treatment" means: (1) two or more treatments by a health care provider; (2) two or more treatments by a provider of health care services (e.g., physical therapist) on referral by or under orders of a health care provider; (3) at least one treatment by a health care provider which results in a regimen of continuing treatment under the supervision of the health care provider (e.g., a program of medication or therapy); or (4) under the supervision of, although not actively treated by, a health care provider for a serious long-term or chronic condition or disability which cannot be cured (e.g., Alzheimer's or severe stroke). "Health Care Provider" includes: licensed MD's and OD's, podiatrists, dentists, clinical psychologists, optometrists, chiropractors authorized to practice in the State, nurse practitioners, and nurse-midwives authorized under State law, and Christian Science practitioners." Section 2. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this ordinance or amendment of the City of La Porte Personnel Policy Manual hereby adopted, shall for any reason, be held invalid, such ORDINANCE NO. 9~ 9 2 4 • PAGE 4 invalidity shall not affect the remaining portions of this Ordinance, or said Personnel Policy Manual, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section 3.
