The meeting was called to order by Mayor Norman Malone at 6:00 P. M. The invocation was given by Councilperson Alton Porter. 3. Council Considered approving minutes of Regular Meeting September 27, 1993. Motion was made by Councilperson Clarke to approve September 27 minutes as presented. Second by Councilperson Cooper. The motion carried, 6 ayes and 0 nays and 1 abstain. Ayes: Councilpersons Sutherland, Cooper, McLaughlin, Maxwell, Clarke and Mayor Malone Nays: None Abstain: Councilperson Porter 4. Mayor Malone proclaimed October 29, 1993 as "Orange Crush Day". Ms. Margaret Anderson and Mr. Steve Barton and a number of Bulldog football players accepted the proclamation. The Mayor also proclaimed October 19, 1993 as "Retired Senior Volunteer Program Recognition Day". Mr. J. R. Ensminger and Evelyn Kennedy accepted the proclamation. Mr. Joseph Shunta, 138 Oakdale, La Porte, spoke to Council regarding the Hunting Ordinance. Mr. Shunta was asking Council to reconsider the passing of this ordinance and give him permission to bow hunt in the city limits of La Porte. 6. Council considered adopting an ordinance amending Chapter 6, adding Section 14, "Family/Medical Leave", of the City of La Porte Personnel Policy Manual. (Tabled by Councilperson Clarke at August 23, 1993 Meeting) Motion was made by Councilperson Clarke to brinct this ordinance back to Council for. consideration. Second by Councilperson Maxwell. The motion carried, 7 ayes and 0 nays. City Manager Bob Herrera explained the intent of the resolution and the staff recommendation. Motion was made by Councilperson Cooper to adopt Resolution 93-14 regarding federal unfunded mandates. Administrative Reports: City Manager Bob Herrera thanked City Council for the Workshop on the item dealing with the "Family/Medical Leave" and also complimented Mr. Louis Rigby for his ability to answer the question asked by Council regarding this amendment. Mr. Herrera will be out of town Thursday, Friday and Saturday attending a board meeting for the Texas Municipal League Insurance Board. 10. Councilpersons Sutherland, Cooper, McLaughlin, Porter, Maxwell and Mayor Malone brought items before the Council. Councilperson Porter was congratulated by Council on his appointment to represent small cities on the Area Emission Reduction Credit Organization Board of Directors. il. The law requires employers with 50 or more employees to offer its workers up to twelve (12) weeks of unpaid leave for family medical emergencies or the birth or adoption of a child. This law went into effect August 5, 1993. This item was taken before City Council on September 27, 1993, as a workshop item. The attached ordinance amends the City's Personnel Policy Manual and incorporates .the changes recommended by Council during that workshop, including: Allowing all full time, regular employees to take up to 12 weeks of unpaid leave because of the birth or adoption of a child (whether that employee is the mother or father), or if his or her spouse, child or parent suffers a serious illness. If requested by the employee, any accrued vacation leave balance may be substituted for unpaid leave, first, and the remainder of the 12 weeks shall be with no pay. In addition, an employee is entitled to a leave if his or her own medical condition prevents the employee from working. If requested by the employee, any accrued sick leave balance may be substituted for unpaid leave, first, then any accrued vacation leave balance may be substituted, and the remainder of the 12 weeks shall be with no pay. In section 7, regarding notice of unforeseen events, the language from the statute was used: "...must give notice as soon as practicable, ordinarily within one or two working days." Herrera Date City Manager • • ORDINANCE NO. 93-1924 AN ORDINANCE ADOPTING AN AMENDMENT TO CHAPTER 6, SECTION 14, "FAMILY/MEDICAL LEAVE", OF THE CITY OF LA PORTE PERSONNEL POLICY MANUAL DATED JANUARY 1, 1992; PROVIDING A SEVERAHILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; .PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Chapter 6, Section 14, "Family/Medical Leave" of the City of La Porte Personnel Policy Manual dated January 1, 1992, ; is hereby amended, and shall hereafter read as follows, to-wit: ~~, "SECTION 14 -FAMILY/MEDICAL LEAVE Any regular full time employee with at least 12 months of service, and that has worked at least 1250 hours in the last 12 months, may be eligible to take up to 12 weeks of unpaid Family/Medical Leave within any 12 month period and be restored to the same , or an equivalent position upon return from the leave. (The City will calculate the 12 month _ period by using a "rolling" 12 month period.) Family/Medical Leave may be granted to regular full time employees to maintain continuity of service and to allow them to take the necessary time to handle compelling matters. 1. Family/Medical Leave shall be defined as an approved absence available to eligible employees for up to 12 weeks per year under particular circumstances. Circumstances that would constitute Family/Medical Leave are as follows: (1) the birth of a child and in order to care for such child; (2) the placement of a child with you for adoption or foster care; (3} to care for your spouse, son, daughter, or parent with a serious health condition; or _ (4) because of your own serious health condition which renders yoi~ unable to perform the functions of your position. Leave because of reasons (1) or (2) must be completed within the 12 month period beginning on the date of birth or placement. In addition, spouses employed by the City who request leave because of reason (1) or (2) or to care for an ill parent may only take a combined total of 12 weeks leave during any 12 month period. 2. Family/Medical Leave is generally unpaid. An employee may substitute accrued paid leave under certain circumstances. If leave is requested because of a birth, adoption or foster care placement of a child, or to care for a spouse, child, or parent with a serious health condition, any accrued • ORDINANCE NO. 93-1924 PAGE 3 7. If the need for Family/Medical Leave is foreseeable, the employee must give the City 30 days prior written notice. When unforeseen events occur that require Family/Medical Leave, employees must give notice as soon as practicable, ordinarily within one or two working days. Failure to provide such notice may be grounds for delay of leave. The City has Request for Family/Medical Leave forms available from the Human Resources Department. These forms should be used when requesting leave. 8. If leave is taken because of the employee's own serious health condition or to care for a covered relation, the employee must contact the City on the first and third Friday of each month regarding the status of the condition and their intent to return to work. 9. Upon completion of leave because of the employee's own serious health condition, the employee is required to provide medical certification that they are fit to resume work. Return to Work Medical Certification Forms may be obtained from the Human Resources Department. Employees failing to provide the Return to Work Medical Certification Form will not be permitted to resume work until it is provided. NOTE: For the purposes of the Family/Medical Leave Policy, the following definitions apply: "Spouse" is defined in accordance with applicable State law. "Parent" includes biological parents and individuals who acted as your parents, but does not include parents-in-law. "Child" includes biological, adopted, foster children, stepchildren, legal wards, and other persons for whom you act in the capacity of a parent and who is--under 18 years of age or over 18 years of age but incapable of caring for themselves. "Serious Health Condition" means any illness, impairment, or physiicaf or mental condition that involves: (1) any incapacity or treatment in connection with inpatient care; (2) an incapacity requiring absence of more than three calendar days and continuing treatment by a health care provider; or (3) continuing treatment by a health care provider of a chronic or long-term condition that is incurable or will likely result in incapacity of more than three days if not treated. "Continuing Treatment" means: (1) two or more treatments by a health care provider; (2) two or more treatments by a provider of health care services (e.g., physical therapist) on referral by or under orders of a health care provider; (3) at least one treatment by a health care provider which results in a regimen of continuing treatment under the supervision of the health care provider (e.g., a • • ORDINANCE NO. 93-1924 PAGE 4 program of medication or therapy); or (4) under the supervision of, although not actively treated by, a health care provider for a serious long-term or chronic condition or disability which cannot be cured (e.g., Alzheimer's or severe stroke). "Health Care Provider" includes: licensed MD's and OD's, podiatrists, dentists,- clinical psychologists, optometrists, chiropractors authorized to practice in the State, nurse practitioners, and nurse-midwives authorized under State law, and. Christian Science practitioners." Section 2. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this ordinance or amendment of the City of La Porte Personnel Policy Manual hereby adopted, shall for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, or said Personnel Policy Manual, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section 3. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 4. Askins, City Attorney • • • UNFIINDED MANDATES Recently, the Texas Municipal League (TML), in the September 24, 1993 issue of TML Leaislative Update, discussed the upcoming "Unfunded Mandate Day", sponsored by the National League of Cities, the U.S. Conference of Mayors, the National Association of Counties and the International City;'County Management Association. The Program is designed the call attention to "Washington's practice of imposing, but not funding, costly programs or requirements that local governments are directed to carry out". TML requests that any city that has felt the effects of unfunded federal mandates adopt a resolution, supplied in the above referenced report (copy of Resolution attached). This report examines the City of La Porte's experience with current and future unfunded mandates. The issue must first be defined to identify true mandates. A recent issue of American City and County (September 1993) defines unfunded mandates as "the federal habit of tossing environmental mandates at the cities without giving the wherewithal to meet those mandates" . This definition differs from the TML definition in that it specifies "federal environmental" mandates, whereas TML more broadly defines federal "programs or practices". The problem with both definitions is that they limit consideration to federal dictates. In fact, states, counties, and other political subdivisions also pass down unfunded mandates to cities, although some of these can be traced back the Washington. In effect, these secondary mandates are directives passed on from the federal government, often embellished and made more restrictive than originally planned. States, counties, special districts and authorities frequently impose their own unfunded mandates unrelated to federal action. To some degree, even cities are guilty of unfunded mandate delegation, passing on the cost and administrative burden of compliance to its citizens. Nhat are these mandates, what to they cost the City of La Porte, and how do they effect the way the City operates? To answer these questions, one must identify the source, whether they are recurring or intermittent costs, and whether they are current or anticipated mandates. The most identifiable mandates are those involving environmental issues. A total of $71,225 is budgeted in the current fiscal year for compliance with environmental mandates, and includes fees, taxes, required testing and procedures (matrix attached). Conversion to surface water, mandated by the Harris - Galveston Coastal Subsidence District, cost the City of La Porte approximately $8.9 million dollars in capital costs, and $480,000 per year for the purchase of treated water. Other mandates include such items as compliance with SARA Title III and HAZWOPER, public safety training and certification requirements and maintenance of county and state traffic signals. Of equal concern are future mandates, most with uncertain or unknown costs. The upcoming compliance with the mandates of the Americans With Disabilities Act (ADA) is currently under evaluation. The costs of compliance with this one requirement will impact the City's fiscal outlook for some years to come, due to the phased nature of compliance. It is likely that every department in the city will be impacted in some way. Other upcoming mandates include the recently approved Family Medical Leave Policy, federal health-care reform and trip reduction. Environmental mandates anticipated to impact the City include Storm water permitting, changes in landfill permitting through Subtitle D legislation, mandatory recycling and yard-waste bans, alternative fuels conversion and upgrading of underground fuel storage facilities. These are known issues that will effect La Porte in the future. With the current climate of legislating regulations and requirements almost continuously, and budget difficulties at all levels of government, cities can expect more frequent and costly unfunded mandates from all sides. Awareness of this issue by the public is vital to easing the financial burden on cities like La Porte. Passage of a resolution supporting the National League of Cities and the Texas Municipal League to educate citizens on the effect of federal mandates is a good start. However, it should be remembered that the states, counties and other governmental subdivisions are equally blameworthy. TOTAL ANN UAL COST $71 225 TNRCC -TEXAS NATURAL RESOURCES CONSERVATION COMMISSION TDA -TEXAS DEPARTMENT OF AGRICULTURE EPA -UNITED STATES ENVIRONMENTAL PROTECTION AGENCY H-GCSD -HARRIS - GALVESTON COASTAL SUBSIDENCE DISTRICT ~ ~ ` RESOLUTION 93-14 WHEREAS, federal unfunded mandates on city governments have increased significantly in recent years; and WHEREAS, federal mandates require cities to perform duties without consideration of local circumstances or capacity; and WHEREAS, federal mandates require compliance regardless of other pressing local needs and priorities affecting the health, welfare, and safety of municipal citizens; and WHEREAS, excessive federal burdens on cities force upon citizens and taxpayers either higher local taxes and fees, reduced local services, or both; and WHEREAS, federal mandates are too often inflexible, "one-size-fits- all" requirements that impose unrealistic time frames and specify procedures or facilities when less costly alternatives might be just as effective; and WHEREAS, existing mandates impose harsh pressures on local budgets and the federal government has imposed a freeze upon funding to help compensate for any new mandates; and WHEREAS, the cumulative impact of these legislative and regulatory actions directly affects the citizens of our cities; and WHEREAS, the National League of Cities (NLC), in conjunction with other state and local government representatives and state municipal leagues, including the Texas Municipal League (TML), has begun a national public education campaign to help citizens understand and then reduce the burden and inflexibility of unfunded mandates, beginning with a National Unfunded Mandates Day on October 27, 1993; NOW, THEREFORE, BE IT RESOLVED that the City of La Porte endorses the efforts of the National League of Cities and the Texas Municipal League and supports working with NLC and TML to fully inform our citizens about the impact of federal mandates on our city finances and the pocketbooks of our citizens; and BE IT FURTHER RESOLVED that the City of La Porte endorses the events that will begin this process on October 27th; and BE IT FURTHER RESOLVED that the City of La Porte resolves to redouble efforts to inform and work with members of our Congressional delegation to inform them about the impact of federal mandates and actions necessary to reduce their burdens on our citizens.
