The meeting was called to order by Mayor Norman Malone at 6:00 P.M. The invocation was given by Councilperson Alton Porter. 3. Council considered approving minutes of Regular Meeting January 24, 1994. Motion was made by Councilperson Thrower to approve the minutes of January 24 as presented. Second by Councilperson Cooper. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone Nays: None 4. Mayor Malone proclaimed February as Black History Month. Pastor and Mrs. Joe W. Lewis and Councilperson Deotis Gay received the proclamation. ~ ~ Minutes Regular Meeting La Porte City Council February 14, 1994, Page 2 Mayor Malone stated Council has been asked to discuss Item 12 as the next item of business. 12. Council considered resolution authorizing advance refunding for certain of the City's General Obligation and Water and Sewer Revenue Bonds. Director of Finance Jeff Litchfield introduced the City's financial advisors Mr. David Fetzer, Moss Fetzer and Pete Fisher of Moroney, Beissner & Company, Inc. Mr. Litchfield gave Council an overview of the Staff Analysis and methods involved in the General Obligation and Revenue Debt Refunding process reported in staff's recommendations. Council discussed the issues with Mr. Litchfield and Mr. David Fetzer. City Manager Robert T. Herrera made a couple of observations to the Council regarding the report. Staff's final recommendation was to proceed with the steps necessary for a successful refunding, as long as the saving to the City were within a 10$ range of the amounts presented. City Attorney read: RESOLUTION 94-03 - A RESOLUTION AUTHORIZING ADVANCE REFUNDING FOR CERTAIN OF THE CITY'S GENERAL OBLIGATION AND WATER AND SEWER REVENUE BONDS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Sutherland to anurove Resolution 94-03 as read by the Citv Attornev. Second by Councilperson Gay. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone Nays: None The Council proceeded with the regular order of business as the Agenda stated. 5. Mayor Malone read the staff recommendation for Employee of the Quarter. The recipient was Kay Fox of the Fire Department. Fire Chief Joe Sease and EMS Chief Chris Osten presented Kay with her plaque. Council and staff congratulated Kay on her accomplishments. 6. Mayor Malone presented a Certificate of Appreciation to Mr. Wayne Anderson who resigned from the Planning and Zoning Commission as the representative from District 2. Councilperson Clarke asked Mayor Malone to read the Certificate of Appreciation presented to Mr. Ronald R. Gragq, representing District 6, Planning and Zoning Commission who also resigned. Mr. Gragg was unable to attend the meeting and Councilperson Clarke wished to have the certificate read as a matter of record. 7. Ms. Malea Webber, 10002 Quiet Hill (Fairmont Park West), La Porte, addressed Council regarding the Code of Ordinances section which refers to pigs and/or potbellied pigs, as swine, therefore placing them in a livestock category. This designation prevents Malea and other citizens from having Potbellied pigs as house pets. Malea was asking Council to review the Code of Ordinances and change the designation of a potbellied pig to domesticated exotic animal which will allow citizens to have these animals as house pets. Melea explained to Council she has allergies and this is the only form of pet she can own without enduring medical problems. Mrs. Penny Garcia, 3110 Oaken Lane, La Porte also addressed Council regarding the subject of potbellied pigs. Mrs. Garcia indicated she also has a potbellied pig which is a house pet, and she wishes to keep her pet. If the ordinance is not changed these animals will not be allowed to remain with these owners. 8. Director of Finance Jeff Litchfield presented the Comprehensive Annual Financial Report for the fiscal year ending September 30, 1993, and Council members were given copies for their review. Mr. Litchfield introduced the members of the auditing firm of Null & Associates; Mr. John Null, Chuck Yapel, Chris Breaux and Don Irby. Mr. Litchfield reviewed the Comprehensive Annual Financial Report with Council and answered questions. Mr. Chuck Yapel of Null & Associates reported to Council of their meeting with the Audit Committee both before and after the audit was preformed. Mr. Yapel stated, " In our opinion, the general purpose financial position of the City of La Porte, Texas, as of September 30, 1993, and the results of its operations and the cash flows of it proprietary fund types for the year then ended in conformity with generally accepted accounting principles." Mr. Yapel thanked City staff for their assistance during the course of the audit, and he stated "Null & Associates appreciates the professional relationship • Minutes Regular Meeting La Porte City Council February 14, 1994, Page 4 which has been developed with the City Manager, Finance Director and his staff. We are also appreciative of the opportunity to be of service to the City Council." 9. Herrera. Mr. Herrera reviewed the six Industrial Districts Agreements to be approved tonight. He stated staff recommends entering into an Industrial District Agreement with these companies. Council will vote on the ordinances as "a one vot4 passos all agroomsnts". Administrative Reports: City Manager Robert T. Herrera reported to Council that San Jacinto College Business Assistance Center wishes to enter into a joint venture with the City of La Porte and the La Porte Bayshore Chamber of Commerce to publish a "Guide to Starting a Business in La Porte". Mr. Herrera stated staff is working on the partnership plan and will return to Council in 60 to 90 days with a proposal request for Councils approval. Assistant City Manager John Joerns gave Council an updated report on the F101 Drainage Improve Project (SPTC Railyard Crossing). Mr. Joerns stated to Council he has visited with Harris County Flood Control District and Harris County Precinct 2 in the attempt to keep the project moving forward. Mr. Joerns stated he had received a call from the Denver office of SPTC, Susan K. Grable, Manager of Public Projects, introducing herself as the new contact person for the street closing/real estate transaction. Ms. Grable said the construction agreement issue will be handled from their Denver office by Mr. Denman. Also, a Houston attorney, Huqh McCulley, will be heavily involved. Mr. Joerns stated with SPTC's renewed interest in expanding their rail storage capacity at Strang Yard he hopes the City will soon benefit from SPTC's "needs". 15. Kay has always been a pleasant, efficient employee, who does a very good job of handling not only the day to day secretarial duties and receptionist duties for out three divisions, but she has taken on the new EMS itemized billing. According to the City Auditor, the EMS revenues have "doubled" since last year. We feel that her hard work, and her ability to work with the customers and insurance companies has alot to do with this increase in revenues. Voting at said election, including early voting, shall be by the use of voting machines, and the ballots of said election shall conform to the Texas Election Code, as amended. Section 4. An Early Voting Ballot Board is hereby created to process Early Voting results for the election and the runoff election, if necessary. The Council Conference Room of the La Porte City Hall is hereby designated as the Central Counting Station to receive all ballots cast at said election, and Sue Lenes is hereby appointed the Presiding Judge for said Central Counting Station. Said Judge shall appoint any clerks necessary to assist in receiving ballots and other records and in performing the other duties of said Judge in this regard. The City Manager is hereby authorized and directed to obtain, or cause to be obtained, the necessary electronic tabulating equipment, to arrange for the testing thereof as provided by law and to employ a duly qualified manager and a duly qualified tabulation supervisor to perform the duties respectively imposed on them by law with respect to the processing and tabulation of ballots at the Central Counting Station. • ORDINANCE NO. 94- 1965 C~ Page 9 Section 6. That all election materials including notice of the election, ballots, instruction cards, affidavits and other forms which voters may be required to sign and all early voting materials shall be printed in both English and Spanish, or Spanish translations thereof shall be made available in the circumstances permitted and in the manner required by law. Section 7. The City Secretary of the City of La Porte shall forthwith issue Notice of said election by causing a substantial copy of this Ordinance to be published one time in the BAYSHORE SUN, which is hereby found and declared to be a newspaper of general circulation in said City, not less than ten (10) days nor more than thirty (30) days prior to the date of the said election. Section 8. Upon a candidate tendering his application on the form prescribed, the City Secretary shall furnish to such candidate all information relative to the qualifications for the office being sought; the method of placing the candidate's name on the ballot; the amount of the required filing fee; and any other pertinent information concerning said election. Section 9. Each candidate for the office of Councilperson must be a resident elector of the City. Each candidate for the office of District Councilperson must also be a resident of the district for which he files. Section l0. The deadline for a candidate to make application to have his name appear upon the ballot for such election, is hereby designated and established as 5:00 o'clock P.M., Wednesday March 23, 1994. No application shall be accepted for filing prior to February 21, 1994. The filing fee for each candidate for the office of Councilperson is hereby established as Fifty Dollars ($50.00). The filing fees shall be used to defray the cost of the election, and said fees shall be prorated and any surplus shall be refunded to said candidates. As an alternative to paying a filing fee, a candidate may obtain a place on the ballot by filing a petition as provided for in City of La Porte Home Rule Charter, Article 2.04 c.3. Section 11. Said election shall be held in accordance with the provisions of the City Charter of the City of La Porte, and the general election laws of the State of Texas governing general and municipal elections, so far as same may be applicable thereto. Section 12. Immediately after said election, the officers holding the same shall make and deliver the returns of the results thereof and the accompanying records for use in the official canvass to the City Council of the City of La Porte, and the City Council shall canvass said returns at the earliest practicable time, and shall, immediately after canvassing the returns, declare the results of the election. The Mayor shall immediately thereafter deliver to the candidate for whom the majority of votes has been polled for each respective office, a certificate of election. Such elected officials shall assume their duties within ten (10) days thereafter, Sundays, excluded, upon their taking the oath of office. Section 13. Each and every provision, paragraph, sentence and clause of this Ordinance has been separately considered and passed by the City Council of the City of La Porte, Texas, and each said provision would have been separately passed without any other provision, and if any provision hereof shall be ineffective, invalid or unconstitutional, for any cause, it shall not impair or affect the remaining portion, or any part thereof, but the valid portion shall be in force just as if it had been passed alone. • ORDINANCE NO. 94- 1965 Page 11 Section 14. E1 precio del registro para cada candidato para consejero esta establecido que sera de $50.00 (cincuenta dolares). The City currently has debt that has an average interest rate of about 6.78. City Staff and the City's Financial Advisors believe that we can refinance this debt and obtain interest rates that average more than 28 lower than the 6.78 we have now. Attached is a resolution that will give staff direction to begin the process of refunding the debt. Once this resolution is approved, we will take the necessary steps to refund the debt. The result of our process will be to obtain bids for debt that will replace the old debt, which will be defeased. After these bids are received, the City Council will have final approval of the refunding. The attached resolution references a letter that will be delivered during the council meeting on Monday. It will be reviewed in detail with the Council at Monday's meeting. A successful refunding will save the City several hundred thousand dollars in future debt service. The money that is borrowed today is placed in an escrow fund and is used to pay the old debt as it matures. Once this even occurs, the old debt is considered defeased and is no longer the responsibility of the issuing agency. The primary advantage of refunding debt is to lower the amount of payments that are needed to service or pay for debt. When you refund debt, there are three general methods of realizing your savings. Each is described below: Savings up Front - Under this method, the debt service requirements for the first four or five years are lower under the new issue that they were under the old issues. The later years remain relatively unchanged. The present value impact of a refunding of this method is nearer the actual savings than the other methods. Level Annual Savings - Under this method, the debt service requirements for each year of the refunding is proportionally smaller than under the old issue. The present value impact of a refunding of this method is between then other two methods. Future Savings - Under this method, the debt service for the early years of the new issue is greater than the old issues. The payment of the debt is accelerated and the average life is shortened. The present value impact of a refunding of this method is normally larger than the other two methods because the debt is retired sooner. In 1991, the City refunded its General Obligation Issues using the Level Annual Savings method and its Revenue Issues using the Savings Up Front method. At the time, those best fit the cash flows of the City. At the present time, staff recommends the Future Savincts method be utilized for both the General Obligation and Revenue Refunding issues. Staff recommends award of bid for the 60 ton air cooled condensing unit to Bay Refrigeration & A/C Company, low bidder meeting specifications. Thirty thousand, seven hundred and fifty dollars ($30,750.00) was budgeted for this purchase in the 1993/94 Hotel/Motel Occupancy Tax Fund Budget. San Jacinto College Business Assistance Center is very pleased to enter into a partnership with the City of LaPorte, with the intent to publish a 'Guide to Starting a ~ Business in LaPorte.u The Business Assistance Center is a full service business development center. One of our primary objectives is to counsel and assist businesses, both start-up and existing, through the business development, financing and site selection process. For the past 5 years we have published a guide for starting a business in Texas and it has proven to be one of the most helpful tools in the business development phase. It has become apparent that this guide stops short of putting the business into operation; as it does. not direct the. business through the necessary steps and permit requirements of the city.° With the City of LaPorte's cooperation and development assistance, the San Jacinto College Business Assistance Center intends to produce a 'Guide to Starting a Business in LaPorte.' As our contribution to the project, the college offers expertise and labor associated with the design, research; writing/editing, and printing of a professional document similar in design to the Texas guide; which you have seen. We are asking you, the City of LaPorte, and the LaPorte-Bayshore Chamber of Commerce to share the actual paper expense. If purchased on the open market, the estimated cost of the package is $13 - $15 each. With the college participation, we estimate pour cost to be- between $2 - $3 to cover the cost of the paper: This cost will be shared by the LaPorte- Bayshore Chamber of Commerce. You will be notified with a final cost estimate for approval. Herrera, City Mana FROM: John Jcerns, Assistant Ci ager DATE: February 11, 1994 SUBJECT: F101 Watershed Improvements • Proposed Construction Agreement between HCFCD and SPTC • Proposed Right Of-Way Closing Agreement between City and SPTC The following outline is an update on the F101 Drainage Improvement Project (SPTC Railyard Crossing}. • March 1993: Harris County Flood Contml District (HCFCD) conversation with City o The attorney assigned to the Southern Pacific Transport Company (SPTC) file by the Harris County Attorney's office expressed concerns relating to SPTC responsibilities under State law. o Their concerns were in addition to the already known issues of risk assignment, indemnification, and level of participation by SPTC. • July 16, 1993: John Joerns meets with HCFCD and Harris County Precinct 2 o Meeting at HCFCD to discuss and move toward resolution of the legal issues expressed by the Harris County Attorney's office. Due to car trouble the representative from Hams County Attorney's office was late and there was not much progress on legal issues. o John Joerns discussed strategy and reaffirmed with HCFCD (Art Storey) and Precinct 2 (Elmo Wright) that the land transaction right-of--way closing between the City and SPTC would not occur until the Construction Agreement between SPTC and HCFCD is resolved. • September 2, 1993: HCFCD (Art Storey) letter to SPTC San Francisco office pressuring/pleading responsiveness to Agreement offered by HCFCD. • Sept. -Nov. 1993: HCFCD and Harris County Attorney's Office work on Construction Agreement issues. t t ~ • • November 30, 1993: Letter from Art Storey to SPTC delivering the Construction Agreement as re-drafted by Harris County Attorney's Office. Urges the SPTC attorneys and Hams County Attorney's Office to communicate directly on the legal issues. • December 1993: SPTC requests and hosts two meetings with HCFCD. At meeting SPTC reveals a renewed interest in expanding Strang Yard's rail storage capacity. SPTC explores idea of expanding the box culvert installation with HCFCD. SPTC also names a local contact person for construction issues. • January 14, 1994: John Jcerns receives a cell from the Denver office of SPTC. Susan R. Grable, manager of Public Projects, introduces herself as the new contact person for the street closing/real estate transaction. Says that the Construction Agreement issues will also be handled out of the Denver office by Mr. Denman. Also, a Houston attorney, Hugh McCulley, will be heavily involved. An introductory letter to soon follow. • February 2, 1994: John Jcerns confirms with HCFCD that Mr. Denman of the Denver office is handling construction related matters and passes on that right-of--way closings will also be handled out of that office. • February 2, 1994: John Jcerns calls Hugh McCulley and confirms he will be local attorney for SPTC. Mr. McCulley visits and briefs John Jcerns that afternoon. Essentially confirms recent activities on part of SPTC to handle both the construction and right-of-way issues out of the Denver offiice. Also confirms SPTC's renewed interest in expending the rail storage capacity at Strang Yard. John Joerns emphasizes that all issues between HCFCD, City and SPTC must be resolved prior to or concurrently with any proposed railyard expansions. The City and HCFCD have attempted to keep this project moving forward. Unfortunately, we have been frustrated by the SPTC bureaucracy and by the legal issues raised by Harris County Attorney's office. Now it appears that SPTC's business opportunities may provide the momentum we need to complete this project. It has been insinuated that the "Railroad" is never in a hurry until they need something. Hopefully we can all soon benefit from SPTC's "needs".
