The meeting was called to order by Mayor Norman Malone at 6:00 P.M. Herrera, Assistant City Attorney John Armstrong, City Secretary Sue Lenes, Assistant City Manager John Joerns, Municipal Court Judge J.B. The invocation was given by Councilperson Maxwell. 3. Council considered approving minutes of Regular Meeting April 25, 1994. of April 25 as presented. Second by Councilperson Thrower. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone Nays: None 4. Mayor Malone presented a proclamation to La Porte EMS Paramedics Joe Berry and Norma Witten proclaiming the week of May 15 through 21 as Emergency Medical Services Week. This proclamation recognizes the emergency medical services teams for their value and accomplishments as medical service providers. Mayor Malone presented a proclamation to Sean Lester proclaiming May 9th as Sean Lester Day and urged all citizens to recognize Sean for his many accomplishments especially in Martial Arts. • • Minutes Regular Meeting La Porte City Council May 9, 1994, Page 2 5. There were no citizens wishing to address Council. 6. Council canvassed the votes and considered an ordinance declaring results of the election held May 7, 1994. Assistant City Attorney Armstrong read: ORDINANCE 94-1981 - AN ORDINANCE DECLARING THE RESULTS OF THE ELECTION HELD IN THE CITY OF LA FORTE ON MAY 7, 1994, FOR THE ELECTION OF MAYOR; COUNCILPERSON DISTRICT 2; AND COUNCILPERSON, DISTRICT 3; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Whereas, there was an election held in the City of La Porte electing a Mayor; Councilperson District 2; and Councilperson District 3; all in accordance with Section 8.10 of the Home Rule Charter of the City of La Porte; and Whereas, there were cast at said election for the following listed persons the number of votes opposite their respective names. In the races for -- Mayor Tom Barrett 308 Norman Malone 810 Councilperson District 2 Mike Cooper 76 Councilperson District 3 Bob Thrower 199 as shown in the official election returns heretofore delivered by the Election Judge and officials to the Mayor and City Council of the City of La Porte and submitted to the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF LA FORTE: Section 1. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone Nays: None Judge J.B. Williamson administered the oath of office to Mayor, Norman Malone; Councilperson District 2, Mike Cooper; Councilperson District 3, Bob Thrower. Mayor Malone asked if the newly seated Councilpersons would like to speak. Councilperson Mike Cooper thanked everyone for their vote of confidence and stated he was honored to be here for another three years. Councilperson Thrower thanked those voters who supported him and was looking forward to the next three years with great anticipation. He stated, "The last three years were quite exciting and, hopefully, the next three will be as exciting." Mayor Malone stated, "I appreciate the staff working as hard as they did; and if we did not have the staff, the guidance, and leadership of Mr. Herrera, we would not do as well." The Mayor asked Mr. Herrera to pass this on to the staff. Mayor Malone stated, "Council, you are easy to work with, and I appreciate working with you very much." 7. Council considered an ordinance appointing a Mayor Pro Tem for a term to begin May 9, 1994 and ending May 9, 1995. City Manager Robert T. Herrera stated, "At the conclusion of a successful election, Council has normally elected among themselves a Mayor Pro Tem. This item is before you tonight." Councilperson Cooper nominated Councilperson Jack Maxwell to serve as Mayor Pro Tem. Councilperson Porter nominated Councilperson Gay to serve as Mayor Pro Tem. Mayor Malone asked if there were any other nominations. There being none, . ..., ,. .. z- 7 ~ _ • • Minutes Regular Meeting La Porte City Council May 9, 1994, Page 4 Mayor Malone stated the vote would be in the order in which the two candidates were nominated. Council considered Ordinance 94-1981, naming a Mayor Pro Tem as follows: Vote for Councilperson Jack Maxwell - Ayes: Councilpersons Cooper, Thrower and Maxwell Nays: Councilpersons McLaughlin, Porter, Gay, Clarke Abstain: Councilperson Sutherland and Mayor Malone Vote for Councilperson Deotis Gay - Ayes: Councilpersons McLaughlin, Porter, Gay, Clarke Nays: Councilpersons Cooper, Thrower and Maxwell Abstain: Councilperson Sutherland and Mayor Malone Mayor Malone said, "It is always a hard decision to make when electing a Mayor Pro Tem, and it is an honor to be considered for this position. I will try not to miss any more meetings than I have to." Mayor Malone proclaimed Councilperson Deotis Gay as the Mayor Pro Tem for a term to begin May 9, 1994, and end May 9, 1995, with the passing of Ordinance 94-1981. 8. Council considered an ordinance approving and authorizing a contract between the City of La Porte and Frost Constructors, Inc., for construction of a median break along Luella Boulevard. Director of Planning Chuck Harrington reported the information and background regarding this proposed project and the Staff recommendations. Assistant City Attorney read: ORDINANCE 94-1982 - AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND FROST CONSTRUCTORS, INC., IN THE AMOUNT OF $13,497.05, PLUS A CONTINGENCY OF $674.95, FOR CONSTRUCTION OF A MEDIAN BREAK ALONG LUELLA BOULEVARD; APPROPRIATING $3,722.00 TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW PROVIDING AN EFFECTIVE DATE HEREOF. otion was made by Counciherson Clarke to_approve 94-1982 as read by the Assistant City Attorney. Second by Councilperson Maxwell. The motion carried 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone Nays: None • • Minutes Regular Meeting La Porte City Council May 9, 1994, Page 5 City Manager R.T. Herrera stated he would like to share with the Council that he is very proud of Staff for their accomplishment in working with San Jacinto College in order to get to this point tonight. He said, "We were successful in helping redesign the median cut. We actually saved the College a considerable amount of money as well as the citizens of La Porte and the people that travel down that roadway." 9. Council considered an ordinance authorizing the execution by the City of La Porte for an Industrial District Agreement with Air Products Manufacturing Corporation. City Manager R.T. Herrera reported Staff has reviewed the contract; and it meets all of the City's IDA standards, requirements, and conditions. He recommended approval of this ordinance. He stated, "All but five of the original forty-eight of the companies from whom we received letters of intent have fully executed a contract with the City, and things are looking extremely well." Assistant City Attorney read: ORDINANCE 93-IDA-OI-B - AN ORDINANCE AUTHORIZING THE EXECUTION BY THE CITY OF LA PORTE OF AN INDUSTRIAL DISTRICT AGREEMENT WITH AIR PRODUCTS MANUFACTURING CORPORATION, FOR THE TERM COMMENCING JANUARY 1, 1994, AND ENDING DECEMBER 31, 2000; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. 93 IDA O1 B as read by the Assistant City Attornev Second by Councilperson Thrower. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone Nays: None Councilperson Sutherland asked City Manager R.T. Herrera if we could expect to received the other remaining five contracts by the next council meeting. City Manager Herrera said he hoped so. He stated, "The City Attorney, who was unable to be with us tonight, has had conversations with the companies' legal divisions; and I will have to defer that question to him." Councilperson Sutherland asked if there were any problems? Mr. Herrera said, "There are no problems, and it is just a matter of getting everything signed." • • Minutes Regular Meeting La Porte City Council May 9, 1994, Page 6 10. Consent Agenda - Council considered awarding bids as follow: (A) Consider awarding bids for uniforms to Uniforms of Texas and R & R Uniforms; (B) Consider awarding a bid to Joe Camp Ford for the replacement of a police vehicle which was destroyed by fire. Motion was made by Councilperson Thrower to accept the consent ~Qenda as presented. Second by Councilperson Clarke. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone Nays: None il. Administrative Reports: A. City Manager R.T. Herrera stated, "On behalf of the City Staff we would like to congratulate the Mayor on his successful election. We would also like to congratulate Councilman Mike Cooper and Councilman Bob Thrower. We look forward to our continuing relationship and moving together as a team." B. City Manager Herrera asked the Assistant City Manager to give a review of the problem we are currently experiencing on Farrington Boulevard. Assistant City Manager John Joerns reported some necessary repairs to the City's sanitary sewer system and to Farrington Boulevard. Mr. Joerns reported a blocked sewer that has a structural problem. It is the sewer lateral that serves the houses on the northside of Rustic Rock between Big .Island Slough and Farrington Boulevard. Mr. Joerns submitted pictures to Council to assist in the explanation of the situation. Mr. Joerns explained the necessity of authorizing these repairs as an emergency and suspending our regular bid procedures. We will get quotes so we know that we are staying competitive. Mr. Joerns also reported a storm sewer was laid on top of the sanitary sewer without any distance between them. In fact, it cuts through the top of the sanitary sewer. This has allowed storm water to pour directly into the sanitary sewer. He stated, "We will take care of this problem at the same time, but we have not received the quotes on this part of the repairs. We wanted to make Council aware of these situations. We will proceed with repairs as soon as we have a correctly identified plan of action. Mr. Joerns and Mr. Herrera answered Council's questions concerning these matters. 12. Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone brought items to Council's attention. 13. Council adjourned into executive session at 6:54 P.M. under V.A.T.S. - Article 6252-17, Section 2(E) - (Legal) to meet with Legal Counsel regarding lawsuit(s); Section (E) - (Legal) to meet with City Manager regarding contractual matter(s); Section 2(G) - (Personnel) discuss expiring terms of office for various boards and commissions. Council returned to the Council table at 9:18, reconvened the meeting at 9:20 P.M., with no action taken. 14. There being no further business to come before the Council, the meeting was duly adjourned at 9:21 P.M. Letter from San Jaclnto College The City of La Porte was originally contacted by San Jadnto College regarding a possible median break along LueNa Blvd. This median break was to be installed in an area Est north of the new Health and Sciences Building at the juncture of a new on campus roadway serving the northern parking lots. As was originally proposed, the estimated cost of the project was to be $ 25,000 and the request of the College was for the City to partldpate in the amount of $10,000. The Staff reviewed the proposal and felt that the City of La Porte Could save some money by designing and bidding the project in-house. In using this method, the City also felt that a savings could be realized by the College as well. San Jadnto College agreed to that proposal and offered to fund $10,450, toward the total project cost(see attached letter). The project was designed by the City Engineer and included several design improvements over the original plans. The project was bid on April 18, 1994, and the low bid of Frost Constructors, Inc., was received in the amount of $ 13,497.05. As this project wiU improve access to the San Jadnto College Campus and will Improve the traffic safety along Luella Blvd., the Staff recommends that $ 3,722, be allocated from the General Capital Improvements Fund Contingency Acx:ount to this project. The Staff also recommends that a contract be awarded to Frost Constructors, Inc. in the amount of $ 13,497.05 plus 596 contingency of $ 674.95 for a total of $ 14,172.00. AIR PRODUCTS MANUFACTURING CORPORATION has executed an industrial district agreement with the City of La Porte, for the term commencing January 1, 1994, and ending December 31, 2000, a copy of which is attached hereto, incorporated by reference herein, and made a part hereof for all purposes. Section 2. The Mayor, the City Manager, the. City Secretary, and the City Attorney of the City of La Porte, be, and they are hereby, authorized and empowered to execute and deliver on behalf of the City of La Porte, the industrial district agreement with the corporation named in Section 1 hereof. _ Section 3. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. SUMMARY & RECOMMENDATION Police patrol unit number 53-54 was damaged due to a fire which started under the dashboard. One estimator, from Timmer's Chevrolet, did provide the City with an estimate of "at least $7,000 for the cost of the wiring harness alone. The firewall, dashboard, radio, electrical equipment and etc. will have to be replaced also. He advised he would consider it a total loss. The Vehicle Replacement Fund has $4,461 applied toward a replacement of this vehicle. Knapp Chevrolet was awarded the City contract to provide police vehicles. They indicated they have a vehicle which exceeds our specifications. After painting and adding push bumpers and afire extinguisher the cost would be $15,320 (The vehicles meeting our specifications were $13,429 each). Joe Camp Ford has a police package vehicle on their lot, which after painting and adding push bumpers and a fire extinguisher would be $14,063.25. There would not be a need to rebid this item as it would fall under the exemptions of the purchasing status. The design of the Motor Pool Fund allows us to replace the damaged unit without causing a financial burden on the fund. Disposing of the burned vehicle by salvage by sealed bid we will recover more funds than if we hold the vehicle for auction. The money from the salvage will be returned to Vehicle Motor Pool for replacement of this vehicle. Recommend: Purchase of replacement vehicle from Joe Camp Ford for the amount $14,063.25. Cost to be taken from the Motor Pool Fund.
