MINUTES OF THE PUBLIC HEARING AND REGULAR MEETING OF LA PORTE CITY COUNCIL SEPTEMBER 12, 1994 1. The meeting was called to order by Mayor Norman Malone at 6:00 P.M. Members of city Council Present: Mayor Norman Malone, councilpersons Guy Sutherland, Mike Cooper, Bob Thrower, Bob McLaughlin, Alton Porter, Deotis Gay, Jack Maxwell and Jerry Clarke Members of Council Absent: None Members of ci ty Staff Present : City Manager Robert T. Herrera, City Attorney Knox Askins, City Secretary Sue Lenes, Assistant city Manager John Joerns, Chief of Police Bobby Powell, Director of Finance Jeff Litchfield, Director of Administrative Services Louis Rigby, Purchasing Agent Susan Kelley, Director of Planning Chuck Harrington, Director of Public Works Steve Gillett, Director of Parks and Recreation Stephen Barr, Assistant Fire Chief Champ Dunham, Customer Services Representative Robin Klataska. Others Present: Representative From Houston Lighting and Power Company David Murphy, and a number of La Porte citizens. 2. The invocation was given by Councilperson Porter. 3. Council considered approving minutes of Regular Meeting August 8, 1994. Motion was made ,bv Councilperson McLauahlin to approve the minutes of Auqust 8 as presented. Second by Councilperson Thrower. The motion carried, 9 ayes, 0 nays. Nays: Councilpersons McLaughlin, Gay, Malone None Sutherland, Cooper, Thrower, Porter, Maxwell, Clarke and Mayor Ayes: 4. Mayor Malone presented a plaque to Robin Klataska for Employee of the Quarter for April, May and June of 1994. He also presented a certificate of Appreciation to Neighborhood Centers, Inc., for their involvement with environmental programs benefiting the City of La Porte. Receiving the certificate for Neighborhood Centers was Director of the Neighborhood Centers from the Houston Office Jo Monday, Director of Harris County JPTA Program Deanie Diamond, Summer Program Councilor Donna Navarro and a student representative who participated in the storm drain stenciling program Laqunta Doughty. Miss Doughty presented Mayor and Council with a e e Minutes Public Hearing and Regular Meeting La Porte city Council September 12, 1994, Page 2 plaque denoting Neighborhood Centers appreciation of city of La Porte's support for their Environmental Education Project. 5. Mayor Malone deferred the proclamation for Officer Matthew "Matt" Deaumer until a future meeting. The Mayor proclaimed the week of September 17th through 23rd as "Constitution Week" in the City of La Porte. Receiving the proclamation was a Representative of the Jane Long Chapter of the Daughters of the American Revolution Marie Russell. 6. There were three citizens wishing to address Council. Elaine Moore, 11722 Bear Street, representing residents from Monument Estates subdivision. She thanked Councilperson Sutherland for attending their neighborhood meeting August 9th and for his support and guidance for helping address their concerns to the proper persons. The concerns were for the 30 miles per hour speed limits set on their neighborhood streets. They would like to change those limits to 20 miles per hour on the side streets. The second concern addressed the underground drainage system. She stated that teenagers are removing the covers to these drainage systems and causing neighborhood concern for the safety of their children. Helen McFerren, 925 Oak Grove, spoke to Council and Staff regarding the proposed park project on the Beasley Property, further described as Seabreeze sailing Club. She stated she has turned in several names of area citizens to be placed on any committee which might be formed to decide the manner of use for this property. She relinquished her remaining time to Brenda Knapp. Ms. Knapp also voiced her concerns for developing a park in their neighborhood and stated, "The city is rich in parks but very poor in other retail areas." Mr. Lynn Green, 10131 Quiet Hill Road, spoke in support of raising the green fee rates at La Porte Bay Forest Golf Course. He stated, "It is one of the best kept courses around." He explained, "I would like to see our debt at that course knocked down sooner by raising the rates." 7. Mayor Malone opened Public Hearing - A at 6:23 P.M. Public Hearing A - To consider amendments to the city of La Porte Zoning Ordinance 1501; Article III, section 3-100, "Definitions"; Article V, section 5-600, "Table A- Residential"; Article VI, section 6-400, "Table A-Commercial" , section 6-500 "Table B-Commercial", Section 6-501 "Footnotes", section 6-600 "special Use Performance Standards", and Article X, section 10-300, "Accessory Buildings, Uses and Equipment", e e Minutes Public Hearing and Regular Meeting La Porte City Council September 12, 1994, Page 3 and section 10-600 "Off-Street Parking Requirements", Adding a new section 6-100 et seq. "Commercial Recreational (C.R.) District" . Director of Planning Chuck Harrington reviewed for Council the background, information, and reason for the request for the amendments and answered Council's questions. Mayor Malone asked for Public Input on the proposed changes. Mrs. Helen McFerren was the only citizen with a question. She was concerned about the "Commercial Recreational (C.R.) District". Mr. Harrington clarified that this district is to provide a specialized district for the establishment of businesses providing or supporting recreational, leisure or entertainment activities. Mr. Harrington stated, "The staff and the Planning and Zoning Commi ttee are very happy and pleased to recommend these changes to the City Council for their approval." Mayor Malone closed Public Hearing A at 6:36 P.M. 8. Council considered approving an ordinance amending the City of La Porte Zoning Ordinance, Ordinance 1501. Mayor Malone read: ORDINANCE 1501-S - AN ORDINANCE AMENDING ORDINANCE 1501, THE CITY OF LA PORTE ZONING ORDINANCE, ARTICLE III, SECTION 3-100 "DEFINITIONS"; ARTICLE V, SECTION 5-600 "TABLE A-RESIDENTIAL"; ARTICLE VI, SECTION 6-400 "TABLE A- COMMERCIAL", SECTION 6-500 "SPECIAL USE PERFORMANCE STANDARDS"; AND ARTICLE X, SECTION 10-300 "ACCESSORY BUILDINGS, USES AND EQUIPMENT", AND SECTION 10-600 "OFF-STREET PARKING REQUIREMENTS"; ADDING A NEW SECTION 6-100 et seq "COMMERCIAL RECREATIONAL (C.R.) Mayor Malone opened Public Hearing - B at 6:38 Public Hearing - B - City Budget FY 94-95 Director of Finance reviewed with Council the summary of all funds which appear in the city of La Porte Budget for 1994- 1995. There was no public input regarding the proposed budget. Jeff Litchfield stated staff's recommendation is to approve the adoption of the Budget FY 94-95 as presented. Mayor Malone closed Public Hearing - B at 6:48 P.M. 10. Council considered an ordinance approving and adopting the Budget for City of La Porte, Texas, for the period of October 1, 1994 through September 30, 1995. City Attorney read: ORDINANCE 1995 - AN ORDINANCE APPROVING AND ADOPTING THE BUDGET FOR THE CITY OF LA PORTE, TEXAS, FOR THE PERIOD OF OCTOBER 1, 1994 THROUGH SEPTEMBER 30, 1995; FINDING THAT ALL THINGS REQUISITE AND NECESSARY HAVE BEEN DONE IN PREPARATION AND PRESENTMENT OF SAID BUDGET; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. It is always how wonderful he is. He will do anything to help a citizen or a co-worker, no matter what time it is or where they are. He is not liked by everyone; but loved. I hear this on a daily basis from citizens and co-workers. He completes his assignments to perfection and on time, regardless of obstacles. He gives 110% of his time to do it and maintains a good positive attitude. He never complains and is always the first to volunteer in anything that we may need help in. It does not matter if it takes him away from his personal time, even if it is 3:00 in the morning. He listens to calls on the radio and if he hears calls for his employees he meets them at the job site. Robin himself is not on call and does not have to be there. He is considerate enough to care about the welfare and well being of all his employees. He wants to help them get the job done faster so his employees can go home and get back to bed quicker. If he is short staffed or there has been bad weather he gets out there with his employees and helps them complete their routes so it does not put his employees behind. It does not matter if it puts his regular duties behind. His employees come first, then his co- workers and then himself. He is the most unselfish person I have ever known. He is very conscientious and dedicated to his job. He sets a good example for his employees and co-workers. For the purpose of public hearing review, the amendments have been prepared in the form in which they will (if approved) appear in the Zoning Ordinance. The State of Texas has amended its Manufactured Housing Act. The terms used to define certain types of manufactured structures have changed. Language now found in the Zoning Ordinance no longer matches that used by State Law. The amendments noted below will not alter any City regulation pertaining to mobile or manufactured homes. They merely update the terms used to describe certain types of structures. This will allow the Zoning Ordinance to remain current with State Law. Amending language is highlighted by bold face type. The increase was for fees associated with roll off service and was driven by landfill fees for non compacted trash. At that time, staff indicated that an offsetting increase for our rates to our customers would be needed and that we would request the change with the new budget, so as to not increase rates during the middle of the year. The City has not adjusted its rates for commercial solid waste since the original ordinance was passed in 1990. Since that time, the City has received increases from BFI that are driven by their increased costs and capped by a Consumer Price Index factor. The City has been able to absorb these increases without having to increase the rates to its customers. At this time, it is necessary to increase the amount charged for container service by five percent (5%) and the amount for roll off service to five percent (5%) more that we are being charged by BFI. SUMMARY & RECOMMENDATION On March 14, 1994, the City' executed a joint agreement with Harris County to restore the existing pier located at Sylvan Beach Park. As a part of that agreement, Harris County is to provide construction materials for the restoration and the City is to provide plans, specifications, contract administration, and cost for labor on the project. In accordance with the agreement, the City had the enineering design work performed and developed specifications for the project. Staff advertised for bids in early August of 1994, and opened bids on August 22, 1994, Of the ten (10) contractors anticipated to bid, only three (3) did so (see attached bid tabulation). After evaluation of the bids received, it has been determined that the lowest qualified bidder is Galveston Bay Land & Marine with a bid of $62,848,50. Due to the nature of this type of construction (ie: over water, etc.), staff would also recommend an additional 10% contingency of $6,284,85 be included to cover any extra work items that may arise as a result of the construction. Funding for this project will be from an Escrow Account established in 1987 by private . contributions to the City for the pier restoration. Bombs are used in the Infiltration and Inflow reduction Program to identify sources of water inflow in the sewer system. Bid requests were sent to four (4) vendors with four (4) bids returned. Bid requests were mailed to five (5) vendors with one (1) returning a bid. The only bid received was submitted by Sensus Technologies. The amount of their bid totals $45,937.30 when unit prices are multiplied by estimated quantities. Their price represents a 3% increase over our current contract price. The other vendors who were contacted but did not turn in a bid indicated that either they did not sell meters that met our specifications, they could not met the price of the manufacturer or their bid package was returned to the City with no forwarding address. The City advertised in the Bayshore Sun and sent a bid notice to the Chamber of Commerce. The meters bid will be used by City utility staff to install at various locations within the city. These meters permit City staff to economically obtain meter consumption reads (for billing purposes) in inclement weather.
