The meeting was called to order by Mayor Norman Malone at 6:00 P.M. Members of City Council Present: Mayor Norman Malone, Councilpersons Guy Sutherland, Mike Cooper, Bob Thrower, Bob McLaughlin, Alton Porter, Deotis Gay, Jack Maxwell and Jerry Clarke Members of Council Absent: None Members of City Staff Present: City Manager Robert T. Herrera, City Attorney Knox Askins, City Secretary Sue Lenes, Director of Administrative Services Louis Rigby, Director of Planning Chuck Harrington, Police Lieutenants Aaron Corrales and Tom Neely, Police Officer Matthew Deaumer, and MIS Manager Larry Mabe Others Present: Attorney Barry Abrams, General Manager of Prime Cable Service Robert Burns and several of his staff members, team members and coaches of the Texas Storm girls fast pitch soft ball team, State Representative Robert Talton, and',a number of La Porte citizens 2. The invocation was given by City Attorney Knox Askins. 3. Council considered approving minutes of Public Hearing and Regular Meeting September 12, 1994. Motion was made by Councilnerson Cooper to approve the minutes of September 12 as presented. Second by Councilperson Maxwell. The motion carried, 9 ayes, 0 nays. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone Nays: None 4. Mayor Malone proclaimed September 26, 1994, as Matthew Deaumer Day. Officer Deaumer and his wife accepted the proclamation. Also, Mayor Malone presented a proclamation to the girls fast pitch soft ball team, Texas Storm. A copy of the proclamation was presented to each of the young ladies on the team and to their coaches by the La Porte City Council, City Attorney and City Manager. 5. Mr. Rickie Edward of Cenikor asked to speak to Council regarding the Cenikor Foundation. Mr. Edwards resides at Minutes Regular Meeting La Porte City Council September 26, 1994, Page 2 5. Mr. Rickie Edward of Cenikor asked to speak to Council regarding the Cenikor Foundation. Mr. Edwards resides at 10920 Dogwood, La Porte. Mr. Edwards explained Cenikor is a nonprofit organization assisting people in a drug and alcohol treatment behavioral modification program. Mr. Edwards introduced one of the participants in the Cenikor program Mr. Carl Bellinger who spoke about the program and its potentials. Three other La Porte citizens, Liz Brandt, 1708 Roscoe; Julian Fisher, 3030 Old Highway 146; and Charlie Young, 214 Reynolds, addressed Council regarding Prime Cable. They each were seeking Council's assistance in asking Prime Cable to reconsider their action in removing CNBC and C-SPAN from their program schedule. 6. Council considered approving a resolution stating concerns to Prime Cable Company. City Attorney read: RESOLUTION NO. 94-09 - A RESOLUTION REQUESTING PRIME CABLE, THE CITY'S FRANCHISED CABLE TELEVISION OPERATOR, TO RECONSIDER ITS DECISION TO DELETE C-SPAN AND CNBC FROM ITS PROGRAMMING TO ITS LA PORTE SUBSCRIBERS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. City Manager Robert T. Herrera explained this resolution has been brought about because the Council has been receiving several inquiries and phone calls about the concern of removal of C-SPAN and CNBC from the cable program. City Hall as well has received a large number of phone calls referencing the same concerns. Mr. Herrera stated, "I have visited by phone with the General Manager of Prime Cable, Mr. Robert Burns and invited him to the meeting tonight, and he will be more than happy to answer any questions from the Council." Mr. Robert Burns addressed the Council -introducing himself as Bob Burns, Vice President and General Manager of Prime Cable of Houston. Mr. Burns introduced three associates, Kathleen Able, Director of Community Affairs, Jerry Lambert, Director of Regulatory Compliance at the corporate office in Austin, and Dorothy Bryant, Director of Regulatory Accounting, also from the corporate office in Austin. Mr. Burns explained that one feature of the Cable Act of 1992 required cable operators to carry local broadcasters. He said Prime did not add Channel 51 or 57 for sometime because he knew if compelled to add these two channels, Prime would have to remove other stations which had been a part of the channel lineup. Mr. Burns explained that for four years the Nelson Polls which research television viewers nationally stated their survey Minutes Regular Meeting La Porte City Council September 26, 1994, Page 3 ref lectedC-SPAN and CNBC were the least viewed and least valued of the cable channels carried on this system. Mr. Burns stated, "Whether we liked it or not we received an order from Federal Communications requiring Prime to add Channels 51 and 57 and as Business Manager and General Manager of the Company, it was my decision that CNBC and C-SPAN would be the two channels that we would regrettably have to take off to accommodate this order from the FCC and to comply with the Cable Act of 1992." Mr. Burns indicated Prime Cable is working on an expansion of their channel capacity and by the third quarter of 1995 will increase from the current 40 to 65 channels. At this time C-SPAN and CNBC will be the first two channels added to the cable system. Motion was made by Councilperson Thrower to approve Resolution 94-09 as read by the City Attorney. Council considered awarding a contract to American Computer Solutions to furnish personal computer parts and related equipment. MIS Supervisor Larry Mabe reviewed summary and recommendation regarding the proposal for personal computer parts and related equipment. computer parts and related equipment. City Manager Robert T. Herrera reminded Council Salute to Industry Banquet honoring Lyondell Polymers is scheduled for Thursday, September 29th, at Sylvan Beach Pavilion. Mr. Herrera called on Director of Planning Chuck Harrington to report on the utility relocation on Underwood Road. The report was regarding the emergency situation on Underwood Road reconstruction Phase III, the section between Fairmont Park 11 MinutesRegular Meeting La Porte City Council September 26, 1994, Page 4 and Spencer Highway. This area is served by a 2" water line. Due to an unforeseen situation the line had to be moved, and a temporary 1" service put in. The City plans to replace this water line with an 8" main for the approximately eight hundred feet. This report is to inform you of the emergency situation. we 'are presenting to you tonight a plan for handling the situation, and staff will come back in two weeks for a ratification of the proceedings necessary to alleviate the emergency. 9. Councilpersons Sutherland, Cooper, McLaughlin, Porter, Gay, Maxwell and Mayor Malone brought items to CouncillIs attention. 10. Council retired into executive session at 7:18 P.M. under Government Code V.A.T.S. - Chapter 551.071 through 551.076, and 551.084, Section 551.071 - (Legal), discuss with Legal Counsel lawsuit with Houston Chemical Services. Council reconvened the meeting at 7:58 P.M. with no action taken. 11. There being no further business to come before the Council the meeting duly adjourned at 8:01 P.M. The narrowest margin of victory in all their games was a 4 to 0 win Out of fifty-nine teams Texas Storm was the only team to go undefeated; and WHEREAS, these young ladies took fast place in the Spring Klein Pepsi Challenge Tournament, fast place in the Houston Metro Tournament, second place in the Humble Tournament and third place in the Coca Cola Classic Tournament in Alvin; and WHEREAS, these are some of the finest young ladies in La Porte and they have distinguished themselves on a national level They worked very hard to achieve their goals and the City of La Porte is very proud of this team. (6 RESOLUTION NO. 94- 09 A RESOLUTION REQUESTING PRIME CABLE, THE CITY'S FRANCHISED CABLE TELEVISION OPERATOR, TO RECONSIDER ITS DECISION TO DELETE C-SPAN AND CNBC FROM ITS PROGRAMMING TO ITS LA PORTE SUBSCRIBERS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, Section 1. Prime Cable offers cable television programming to subscribers in the City of La Porte under franchise from the City of La Porte. On September 9, 1994, Prime Cable dropped C- SPAN, a cable television channel offering public affairs programming and coverage of the United States House of Representatives; and CNBC, a financial and public affairs programming cable network; from its programming for its subscribers in the City of La Porte, to make room for local stations whose signals Prime Cable is required to carry by federal law. However, the choice of channels to be deleted to accommodate the local stations, was a policy decision made by Prime Cable, in its sole discretion. Section 2. Although the City of La Porte does not have legal jurisdiction to control the programming offered by Prime Cable, the City of La Porte nevertheless respectfully requests and urges Prime Cable to reconsider its decision to drop C-SPAN and CNBC. The City of La Porte has received communications from many of its citizens who are subscribers to Prime Cable, complaining of the actions of Prime Cable in dropping C-SPAN and CNBC from its cable lineup, rather than other programming. Section 3. In view of the overwhelming response from Prime Cable subscribers, the City Council of the City of La Porte RESOLUTION NO. 94-09 PAGE 2 respectfully urges Prime Cable to reconsider its decision, and to reinstate C-SPAN and CNBC to its cable lineup in the City of La Porte. Section 4. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this 'meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council. further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 5. On September 6, 1994 the City received six offers in responses to the request. The vendor who is awarded the contract shall provided the City with microcomputer systems and components for the next twelve months. It is recommended by the MIS Manager that we accept the proposal made by American Computer Solutions for the purchase of microcomputer systems and components. The estimated expenditure for supplies is $41,739.00. The 94-95 budget has adequate funds ($45,070) budgeted for these projected expenditures . The following is a brief synopsis of each proposal: American Computer Solutions All items were proposed and an adjustment had to be made to reflect the expected $300 in shipping cost. This company is located in S.W. Houston and is the same company that had the contract for the 1993-94 budget year. It has changed its name from Ti Pan to American Computer Solutions. Their delivery, replacement and assistance has been good for the last year. The reliability of the equipment has been good. We had a problem with a batch of video cards, but they replaced them. I am recommending renewal of the City's contract with this company. Jeff Litchfield has reviewed the financial statement of American Computer Solutions and found no particular problems. Multi -Systems Support All items were proposed and only a minor adjustment had to be made to reflect an equal count of removable disks to balance with the other proposals. No financial statement was provided as required by the RFP. The only drawback of this company is that it has one full-time employee. I do not think there is a permanent business address, that is not a residence.. We have purchased a few small items from them, but reliability and stability of this company in the future is an unknown factor. This company is lower, in total cost proposed, than the next lowest by $1,858. The City would be taking a chance at this point in time and I cannot recommend it. United Business MachA& All items were proposed and no adjustment fore made in the total proposed cost. The major exceptions and advantages of the items proposed by this company are as follows: Mother boards meet EPA Energy Star specifications Mother boards utilize Intel CPUs and are Pentium upgradeable Floppy drives are the more reliable TEAC brand. Only offerer to propose EPA Energy Star Monochrome VGA monitors. Unlimited phone support by a degreed technician and service personnel. This company is located in S.W. Houston area and is large and well established. They have a large technical staff on hand and significant warehousing facilities. This company's proposal was not recommended last year due to its handling of problems for customers in previous year. Management indicates they have corrected their service and delivery problems, but two of the five references provided by them still indicated problems. I would have recommended this company over American Computer Solutions because of the better value of the equipment offered, but the continued reports of service and delivery problems give me cause for concern. I can not recommend them at this time. OMAC Group, Inc. All items were proposed and a $300 adjustment was made in the total proposed cost for expected shipping cost. A financial report was not furnished as required in the RFP. The major exceptions and advantages of the items proposed by this company are as follows: Mother boards meet EPA Energy Star specifications Floppy drives are the more reliable TEAC brand. Electronic Parts Outlet All items were proposed and no adjustment were made in the total proposed cost. This company is in the Clear Lake area and it is large and well established. They have a good technical staff on hand and significant warehousing facilities. The company's proposal is not recommended due to the higher proposed cost but I am recommending them as an alternate in event American Computer Solutions cannot meet the City's needs. Welton/Solar Systems Not all items were proposed and page 14 of the proposal was missing and submitted on 9/8/94 after I contacted Mr. Jerald Harris' office. I used the lowest cost proposed for the items that were not offered. No financial statement was provided. This company is located in Clear Lake and provided computers and parts during the 1992-93 budget year. Service was good and the equipment was reliable. The company is also a one-man operation, but he does have a business office. No financial statement was included in the proposal. Delivery was somewhat slower than American Computer Solutions.
