MINUTES OF THE REGULAR MEETING OF
LA PORTE CITY COUNCIL
FEBRUARY 13, 1995
The meeting was called to order by Mayor Norman L. Malone at
6:00 P.M.

McLaughlin. The motion carried, 9 ayes and 0 nays

4. PRESENTATION:
A CERTIFICATE OF ACHIEVEMENT FOR EXCELLENCE - J. Litchfield
City Manager Robert T. Herrera introduced Director of Finance
Jeff Litchfield and presented a plaque and the Certificate of
Achievement for Excellence in Financial Reporting awarded from
the Government Finance Officers Association of the United
States and Canada (GFOA) for the City of La Porte's
comprehensive annual financial report (CAFR). Mr. Herrera
congratulated Mr. Litchfield and reported this is the
thirteenth certificate of performance the City of La Porte has
received.
Director of Finance Jeff Litchfield introduced members of his
staff present at tonight's meeting; Assistant Director of
Finance Cynthia Alexander, Accounting Supervisor Kathy Hutton,
Fixed Assets Accounting Technician Shirley Mosley, Finance
Secretary Gay Walker, and Lori Commander who works with
Accounts Payable Records and Document Imaging. Mr. Litchfield
also named those of his staff absent from tonight's meeting;
Suki Choi, Accounts Payable and Lorie Doughty, Payroll
Accounting Technician. Mr. Litchfield reported that of all
the municipalities in the United States only about 5% receive
this certificate.
Mayor Malone congratulated Mr. Litchfield on a job well done.
5. PROCLAMATION:
A. THE RANDOM ACTS OF KINDNESS WEEK
Mayor Malone read the proclamation and stated that all
citizens should be more kind and considerate of others.
6. REPORT FROM BARBOURS CUT SEAFARERS CENTER
PAT SHIPPPEY
FATHER RANDY ALBONO
Father Randy Albono was unable to attend tonight's meeting.
Director of Seafarer Center Pat Shippey gave the annual report
on the status and growth of the Seafarer Center (see attached
Exhibit A). Mrs. Shippey invited Council and Citizens to
volunteer and assist the Seafarer Center in the Center's
future accomplishments.

Councilperson McLaughlin reported he has been a volunteer for
a number of years. He assured Council and Citizens this is a
very rewarding experience and encouraged other to participate.
7. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAB
PAYERS WISHING TO ADDRESS COUNCIL
There were no citizens wishing to address Council.
8. CONSIDER AN ORDINANCE REGARDING A CERTIFIED REFERENDUM
PETITION TO THE CITY SECRETARY, SEEKING THE REPEAL OF
ORDINANCE NO 94-1994; CONSIDERING SUCH REFERRED ORDINANCE BY
CITY COUNCIL AND THE FINAL VOTE ON SUCH RECONSIDERATION BY
CITY COUNCIL (Ord. 95-2015) - K. Askins
City Attorney Knox Askins reviewed for Council the final
certification letter to Council from City Secretary Sue Lenes
(See attached Exhibit A). Attorney Askins explained the
options which are before Council for action regarding the
Referendum Petition and the next Agenda Item - Calling a
Referendum Election and a Regular Annual Election of the City
of La Porte.

City Attorney Knox Askins reported that a vote to pass
Ordinance 95-2015 was a vote not to repeal ORDINANCE 94-1994 -
AN ORDINANCE APPROVING AND AUTHORIZING AN OPTION AGREEMENT
BETWEEN THE CITY OF LA PORTE AND HAROLD P. PFEIFFER, FOR THE
PURCHASE BY THE CITY OF LA PORTE OF TWO TRACTS OF LAND FOR
PUBLIC PURPOSES. City Attorney Askins recommended the passage
of Ordinance No. 94-2015.
Motion was made by Councilperson Clarke to pass Ordinance No.
94-2015 as read by the City Attorney. Second by Councilperson
Gay. The motion carried, 9 ayes and 0 nays.

City Attorney reviewed Ordinance 95-2016 and answered Council
questions.
Motion was made by Councilperson Maxwell to approve Ordinance
95-2016. Second by Councilperson Sutherland. The motion

10. CONSIDER AN ORDINANCE APPROVING AND AUTHORIZING AN EXTENSION
OF THE PRIME CABLE TELEVISION FRANCHISE AGREEMENT, WHICH
EXPIRES ON MARCH S. 1995, THROUGH DECEMBER 31, 1995 (Ord. 95-
2017) - K. Askins
City Attorney explained background and necessity of an
extension on the Prime Cable Television Franchise Agreement.
(Exhibit A). Ms. Kathleen Abel, Director of Community Affairs
with Prime Cable, was in the audience and Council invited Ms.
Able to address Council regarding Prime Cable services and
upgrade. Ms. Abel answered Council questions and presented a
Prime Cable Channel listing of all future channels (Exhibit
B) .

APPROVING AND AUTHORIZING AN EXTENSION OF THE PRIME CABLE
TELEVISION FRANCHISE AGREEMENT, WHICH EXPIRES ON MARCH 8,
1995, THROUGH DECEMBER 31, 1995; MAKING VARIOUS FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH

the Director of Finance to enter into a agreement with TRW
REDI for the purpose of providing tax information to them.

Assistant Director of Public Works Buddy Jacobs reviewed for
Council the summary and recommendation of staff regarding
request to authorize the City Manager to execute a contract
with Follis Construction for the Construction of the City -Wide
Utility Replacement Project in the amount of $55,617.65.
City Attorney read: ORDINANCE 95-2019 - AN ORDINANCE APPROVING
AND AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LA PORTE AND
FOLLIS CONSTRUCTION COMPANY, FOR THE CONSTRUCTION OF THE CITY-
WIDE UTILITY REPLACEMENT PROJECT; APPROPRIATING NOT TO EXCEED

Jordon Interests, Inc. in the amount of $8,400.

ABANDONING AND CLOSING A PORTION OF THE ALLEY IN BLOCK 753,

LA PORTE (Ord. 95-1466-F) - C. Harrington
Director of Planning Chuck Harrington reviewed the summary and
recommendation of staff to approve the ordinance establishing
speed limits along Spencer Highway Westbound from SH 146 to
1,900 feet west of South 16th Street establishing a 35 mph
limit. From 1,900 feet west of South 16th Street to the
western corporate limit to 45 mph. Eastbound from the western
corporate limit to 1,900 feet west of South 16th Street to a
limit of 45 mph. From 1,900 feet west of South 16th Street to
SH 146 to 35 mph.

17. ADMINISTRATIVE REPORTS

City Manager Robert T. Herrera reported that President Clinton
announced a new policy where he was providing more funding for
the municipal side for police matters. Mr. Herrera asked
Chief Bobby Powell to give Council a update.
Chief Bobby Powell reported, "Wednesday evening the City of La
Porte received word from the U.S Attorney of the Houston
District, Gay Nell Griffin Jones, that La Porte has been
awarded $69,628.50 under the new Crime Bill Act. We have not
received all of the information to date, but we are under the
impression this will be for two new Police Officers. This is
a 75% to 25% matching grant for three years." As soon as we
receive all the information we will review with the City
Manager to ascertain what the City should do with these funds.

Councilpersons Cooper, McLaughlin, Gay, Maxwell and Mayor
Malone brought item to Council's attention.
City Attorney Knox Askins introduced two young City of La
Porte citizens to Council, Christy Jacobs and Clark Askins.
Mr. Askins stated, "These young citizens have a great interest
in their City Government."

REPORT TO THE CITY Of LAPORTE
(An Outline)
The last Report that we (at the Barbours Cut Seafarers' Center)
made to this Council\City was in 1989 and we, feel embarrassed
for the negligence on our part, during those "silent years".
From 1989, BCSC has grown:

4. we added new employees: a. 1 full time chaplain
b. 2 drivers
5. From a 3-bedroom house to a 2-storey building
that houses a Chapel, bigger store, library,
Tv room, kitchen, and more offices and conference
rooms at the second floor.
6. The Chapel is a very significant change. Before, we did not
have any Chapel for Seafarers to meditate and worship
together. It must be remembered that a Seafarers' Center,
aside from its being a "home -away -from -home", is and should
be a "Spiritual Bank" whereby Seafarers come to deposit and
withdraw their Spirituality or Religiosity. Our Chapel is
Ecumenical and an Interfaith Chapel.
As a whole, the Barbours Cut Seafarers' Center,
1. has been a mirror to men and women from all
over the world. The BCSC has promoted the City of
La Porte's good and excellent image to the whole
world through its services to the men and women
who come to visit the Centr.
2. BCSC has been a big family for our citizens to
work in unity and in the bond of love reflecting
the very good culture and rich traditions of our
country to all Seafarers.
In order to maintain the Ministry of the Seafarers' Center,
we need some help.
I must tell you that the Port of Houston is growing very
tremendously and the growth is moving this way to Barbours Cut.

1. more volunteers to to help us in the Seafarers Center.
2. we need a 15-passenger Van to transport Seafarers.
3. we need funding to keep the Center open, ready to meet
the needs and concerns of all Seafarers.

On January 6, 1995, a Referendum Petition was filed with the City

Pursuant to Article VI of the Home Rule Charter of the City of La
Porte, I have examined each paper of the Petition to determine if
it has a proper statement of the circulator and whether the
Petition is signed by a sufficient number of qualified electors.
Based upon my examination, I have found and determined that the
Petition has been signed by a sufficient number of qualified
electors.
By letter dated January 19, 1995, I advised the circulators of the
Petition of certain legal insufficiencies. The legal
insufficiencies have now been corrected.
I hereby certify as sufficient the Referendum Petition, as amended,
under Article VI, of the Home Rule Charter of the City of La Porte.
The certified Referendum Petition is delivered to City Council
herewith, for its consideration under Section 6.04 of the Home Rule
Charter of the City of La Porte.

Dear Ms. Abel:
At a regular meeting of City Council on February 13, 1995, the City
Council of the City of La Porte agreed to extend the terms of the
above referenced Franchise Agreement between the City of La Porte
and Prime Cable, as amended, through December 31, 1995.
The purpose of this extension is to allow the City of La Porte and
Prime Cable to negotiate terms of a new agreement between the City
and Prime Cable. This extension agreement will terminate on the
earliest to occur of (1) the effective date of a new Franchise
Agreement passed and approved by the City Council of the City of
La Porte, and accepted by Prime Cable; or (2) December 31, 1995.

AN ORDINANCE REGARDING A CERTIFIED REFERENDUM PETITION TO THE CITY
SECRETARY, SEEKING THE REPEAL OF ORDINANCE NO. 94-1994; CONSIDERING
SUCH REFERRED ORDINANCE BY CITY COUNCIL AND THE FINAL VOTE UPON

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council has received from the City
Secretary, a certified referendum petition pursuant to Section 6.04
of the Home Rule Charter of the City of La Porte, a copy of which
certification is attached to this ordinance as Exhibit "A" and made
a part hereof for all purposes.
Section 2. Pursuant to Section 6.04(b) of the Home Rule
Charter, City Council has considered Ordinance No. 94-1994, and has
taken a final vote upon such reconsideration upon the question,
"Shall the ordinance and the referendum petition be repealed?"
Section 3. The City Council of the City of La Porte hereby
determines that the ordinance in the referendum petition, Ordinance
No. 94-1994, shall not be repealed.
Section 4. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to
the public as required by law at all times during which this
ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.

Section 4. Voting at said election, including early voting,
shall be by the use of voting machines, and the ballots of said
election shall conform to the Texas Election Code, as amended.
Section 5. An Early Voting Ballot Board is hereby created to
process Early Voting results for the election and the runoff
election, if necessary. C. David Young is appointed
Presiding Judge of the Early Voting Ballot Board. At least two (2)
other members of the Early Voting Ballot Board shall be appointed by
the Presiding Judge, in the same manner as the precinct election
clerks.
Early Voting by personal appearance shall begin on the 20th day
and shall continue through the 4th day preceding the day of
election.
Early Voting by mail shall begin on the 45th day preceding the
date of the election, or as soon thereafter as ballots are
available, and shall continue until seven o'clock (7:00) P.M. on
election day.
Early Voting shall be conducted by a clerk for Early Voting,
namely, Cherie Black , and the place at which the Early
Voting shall be conducted is designated as the La Porte City Hall,
604 West Fairmont Parkway, La Porte, Texas, to which address ballot
applications and ballots voted by mail may be mailed. Early Voting
by personal appearance shall be conducted on the weekdays of the
early voting period and during the hours that the City Secretary's
main business office is regularly open for business.
Section 6. The Council Conference Room of the La Porte City
Hall is hereby designated as the Central Counting Station to receive
all ballots cast at said election, and Sue Lenes is hereby

appointed the Presiding Judge for said Central Counting Station.
Said Judge shall appoint any clerks necessary to assist in receiving
ballots and other records and in performing the other duties of said
Judge in this regard. The City Manager is hereby authorized and
directed to obtain, or cause to be obtained, the necessary
electronic tabulating equipment, to arrange for the testing thereof
as provided by law and to employ a duly qualified manager and a duly
qualified tabulation supervisor to perform the duties respectively
imposed on them by law with respect to the processing and tabulation
of ballots at the Central Counting Station.
Section 7. That all election materials including notice of the
election, ballots, instruction cards, affidavits and other forms
which voters may be required to sign and all early voting materials
shall be printed in both English and Spanish, or Spanish
translations thereof shall be made available in the circumstances
permitted and in the manner required by law.
Section S. The City Secretary of the City of La Porte shall
forthwith issue Notice of said election by causing a substantial
copy of this Ordinance to be published one time in the BAYSHORE SUN,
which is hereby found and declared to be a newspaper of general
circulation in said City, not less than ten (10) days nor more than
thirty (30) days prior to the date of the said election.
Section 9. Upon a candidate tendering his application on the
form prescribed, the City Secretary shall furnish to such candidate
all information relative to the qualifications for the office being
sought; the method of placing the candidate's name on the ballot;
the amount of the required filing fee; and any other pertinent
information concerning said election.
Section 10. Each candidate for the office of Councilperson
must be a resident elector of the City. Each candidate for the

office of District Councilperson must also be a resident of the
district for which he files.
Section 11. The deadline for a candidate to make application
to have his name appear upon the ballot for such election, is hereby
designated and established as 5:00 o'clock P.M., Wednesday, March
22, 1995. No application shall be accepted for filing prior to
February 20, 1995. The filing fee for each candidate for the office
of Councilperson is hereby established as Fifty Dollars ($50.00).
The filing fees shall be used to defray the cost of the election,
and said fees shall be prorated and any surplus shall be refunded to
said candidates. As an alternative to paying a filing fee, a
candidate may obtain a place on the ballot by filing a petition as
provided for in City of La Porte Home Rule Charter, Article 2.04
c.3.
Section 12. Said election shall be held in accordance with the
provisions of the City Charter of the City of La Porte, and the
general election laws of the State of Texas governing general and
municipal elections, so far as same may be applicable thereto.
Section 13. Immediately after said election, the officers
holding the same shall make and deliver the returns of the results
thereof and the accompanying records for use in the official canvass
to the City Council of the City of La Porte, and the City Council
shall canvass said returns at the earliest practicable time, and
shall, immediately after canvassing the returns, declare the results
of the election. The Mayor shall immediately thereafter deliver to
the candidate for whom the majority of votes has been polled for
each respective office, a certificate of election. Such elected
officials shall assume their duties within ten (10) days thereafter,
Sundays, excluded, upon their taking the oath of office.

Section 14. Each and every provision, paragraph, sentence and
clause of this Ordinance has been separately considered and passed
by the City Council of the City of La Porte, Texas, and each said
provision would have been separately passed without any other
provision, and if any provision hereof shall be ineffective, invalid
or unconstitutional, for any cause, it shall not impair or affect
the remaining portion, or any part thereof, but the valid portion
shall be in force just as if it had been passed alone.
Section 15. This Ordinance shall be in effect immediately upon
its passage and approval.
Section 16. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was

found to exist at any intersection or other place or upon any part
of a street or highway within the City of La Porte, taking into
consideration, but not limited to, the width and condition of the
pavement and other circumstances on such portion of said street or
highway, as well as the usual traffic thereon, said governing body
may determine and declare a reasonable and prudent prima facie
speed limit thereat or thereon by the passage of an ordinance,
which shall be effective when appropriate signage giving notice
thereof is erected at such intersection or other place or part of
the street or highway; and
WHEREAS, the City Council of the City of La Porte has directed
that an Engineering and Traffic Investigation take place for the
purpose of ascertaining reasonable and prudent prima facie speed
limits on Mockingbird Lane and Meadowlark Lane within the City of
La Porte; and

WHEREAS, the results of said Engineering and Traffic
Investigation have become known unto the City Council of the City
of La Porte; and
WHEREAS, the City Council of the City of La Porte finds that
it is consistent in promoting the health, safety, and welfare of
the citizens of the City of La Porte to reduce the maximum speed
on said streets of the City of La Porte based upon the results of
said engineering and traffic investigation;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE:
Section 1. Upon the basis of an engineering and traffic
investigation heretofore made as authorized by the provisions of
Article 6701d, Vernon's Texas Civil Statutes, the Code of
Ordinances, City of La Porte, Harris County, Texas, Chapter 25
"Traffic", Article 2, Section 25-23, subparagraph (d), "Maximum
limits and school zones," is hereby amended by adding subparagraphs
"y" and "z", to read as follows, to -wit:
Section 25-23
(d)(1)(y): Along Mockingbird Lane from North "H" Street
to North "L" Street, a distance of 1,800 feet,

(d)(1)(z): Along Meadowlark Lane from North "H" Street to
North "L" Street, a distance of 1,800 feet,

Section 2. The City Council officially finds, determines,

Penal Code, who shall violate any provision of this ordinance,
shall be deemed guilty of a misdemeanor and upon conviction shall
be punished by a fine not to exceed Two Hundred Dollars ($200.00).
Section S. All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict only.
Section 6. This ordinance shall be effective fourteen (14)
days after its passage and approval. The City Secretary shall give
notice of the passage of this ordinance by causing the caption
hereof to be published in the official newspaper in the City of La
Porte at least twice within ten (10) days after the passage of this

Meadowcrest Subdivision
The question of school zones in the Meadowcrest subdivision was
raised at the workshop meeting of January 30, 1995. The following
is an analysis and recommendation regarding the installation of
school zones.
INTRODUCTION
The Meadowcrest subdivision is located in Northwest La Porte
between North H and North L Streets. The streets are installed in
a simple grid pattern, with interior streets intersecting the two
collector streets, Mockingbird and Meadowlark Lane. Construction
is standard concrete curb and gutter, although no sidewalks exist.
The La Porte Independent School District constructed Lomax
Elementary on North L Street between Mockingbird and Meadowlark
Lane in 1986 . The City enacted Ordinance No 1466 - A establishing
a school zone along North L Street between Mockingbird and
Meadowlark Lane on July 28, 1986. Concern has been expressed by
Meadowcrest residents that additional school zones are needed in
this area.
ANALYSIS
The primary routes used by students in Meadowcrest are Mockingbird
and Meadowlark Lane. A school crossing guard is used on North L
Street at Mockingbird Lane, and a crosswalk is in place on North L
Street at Meadowlark Lane. This route is used by students
attending Lomax Jr. High. Additionally, students attending Lomax
Elementary and La Porte High School are picked up by bus on
Mockingbird and Meadowlark Lane. All students use Meadowlark and
Mockingbird Lane for school access.
Additional considerations are also relevant to the installation of
school zones in this area. The lack of sidewalks force students to
walk in the street. On -street parking obstructs vision of both
pedestrians and motorists. Finally, Mockingbird and Meadowlark
physically connect North H and North L Streets. With North H
Street lacking a bridge at Big Island Slough, motorists use
Meadowcrest Subdivision as access to the remainder of the area.

RECOMMENDATION
The existing use of Mockingbird and Meadowlark Lane as a school
route, existing crossings on North L Street, lack of sidewalks, on -
street parking, and heavy traffic volumes support the installation
of school zones. It is recommended that the City Council approve
an ordinance declaring Mockingbird Lane and Meadowlark Lane a
school zone between North H and North L Streets.

TRW REDI is a local firm that provides tax information to the Title Insurance
industry and other financial related markets, such as mortgage companies. TRW
receives tax information from the various taxing entities and places it into
their own computer system and provide a one stop location for the firms that
utilize their service.
TRW has requested that the City of La Porte participate in their program and
has offered to pay the City $200 per reporting period, which will be about 18
times per year. The responsibility of the City will be to prepare a computer
tape of the accounts with tax paid and tax outstanding information.
After reviewing their proposal, staff believes it has merit. Currently, the
title companies have to come to our office, where we provide a terminal for
them to check the status of the tax accounts. If we were to provide the
information to TRW, the title companies would receive the information when
they checked on the taxes paid for the county. This would save our staff time
and we would be adequately reimbursed (about $3,600) for the time it takes to
prepare the tape.
The information provided to TRW is public information. My first concern was
the possibility that the information could be electronically provided to
someone else and used as a mailing list. The proposed contract with TRW
restricts the use of the data so that this can not occur.
Prior to our taking over the school tax office, they provided the information
to TRW.
ACTION REQUIRED BY COUNCIL:
Authorize Director of Finance to enter into agreement with TRW REDI for the
purpose of providing tax information.

AFFIDAVIT AND AGREEMENT
TRW RED[ is a joint venture partnership of TRW, Inc., and Elsevier, NV. TRW REDI affirms that it is
in the business of reporting the status of Harris County property taxes to the Title Insurance industry,
FDIC, and other financially related markets. National real estate tax service agencies such as
Transamerica and First American Real Estate Tax Service are also customers of TRW REDI. The
property tax databases maintained by TRW REDI are separate and not connected in any way to the data
bases of TRW's consumer and business credit businesses, nor is the property tax data shared with other
TRW components.
In the course of its normal business, TRW REDI collects real property tax information on computer
readable magnetic tape from many of the tax collecting agencies situated within the boundaries of
Harris County. This information is reformatted and placed in the TRW REDI databases where it is
available for access by the Title Insurance company and other financially related customers that
conduct business or have an interest in property within Harris County. Computer terminals are placed
in the customer offices which facilitate their inquiries into the TRW REDI databases.
TRW REDI further affirms that:

It is willing to enter into separate agreement with the City of LaPorte for use of the
city's and school district's property tax information. Said use is to provide tax reports
to the Title Insurance industry and related financial markets.
The purchased data will n9t be copied in whole and distributed to third parties without
the expressed written authorization from the City of LaPorte.
It recognizes that the information contained in their databases will never be as current
as the City's, however, TRW REDI will use its best efforts to maintain the maximum
current status of its information.
CONDITIONS OF AGREEMENT
In consideration of the agreement from the City of LaPorte ("City"), the information from its files on
magnetic tape or cartridge any other electronic media, TRW REDI agrees:
1 . City will provide a tape cartridge of the city's and school district's tax data to TRW REDI
on the 5th and 20th of each month. TRW REDI will provide all media necessary.
2. Any and all information in the original form provided to TRW REDI under this agreement
is for use of TRW REDI only and will not be conveyed in such original form to any firm
or individual.
3. CITY DOES NOT GUARANTEE, NOR ACCEPT RESPONSIBILITY FOR THE ACCURACY OF
THE INFORMATION.
4. The City or any of its officials, agents or employees will be held harmless and TRW
REDI will waive any liability that may accrue due to any negligence for data errors of
any type or due to any cause whatsoever.
5. TRW REDI will pay City $Zoo per run. A check for $J-4-0 will be left at City on
the 20th of each month.

6. TRW REDI is responsible for all fees incurred with Easy Access for
installation of the program that allows City tp produce the data for TRW REDI.

Sealed bids were opened on January 23, 1995 for the construction of the
City -Wide Utility Replacement Project. Bids were sent to eight (8)
contractors, with five (5) returning bids. The Project was designed and
bid by the City's Engineering Division.
The Project consists of four (4) separate projects, and includes (1)
Replacement of waterlines on two (2) bridges; (2) installation of a 12 inch
force main diversion in Northwest La Porte; (3) replacement of three (3)
manholes in Northwest La Porte; and (4) replacement of 8 inch sewer line at
the La Porte Jr. High Football Field. The first project was identified
through the 1994-95 budget process. The remaining three (3) projects were
identified through the City Infiltration & Inflow (I&I) Program.

AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE
CITY OF LA PORTE AND FOLLIS CONSTRUCTION COMPANY, FOR THE
CONSTRUCTION OF THE CITY-WIDE UTILITY REPLACEMENT PROJECT;
APPROPRIATING NOT TO EXCEED $55,617.65 TO FUND SAID CONTRACT;
MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The City Manager is hereby authorized to execute such
document and all related documents on behalf of the City of La
Porte. The City Secretary is hereby authorized to attest to all
such signatures and to affix the seal of the City to all such
documents. The City Council appropriates the sum not to exceed
$29,160.00 from the Utility CIP Fund No. 003, and the sum not to
exceed $26,457.65 from the Inflow and Infiltration Fund No. 018,
for a total appropriation not to exceed $55, 617.65 to fund said
contract.
Section 2. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject

matter thereof has been discussed, considered and formally acted
upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.

Jordan Interests, Inc. has petitioned the City of La Porte to close, vacate, and abandon
an existing public right-of-way, being the alley in Block 753 between West "A" and West
"B" Streets. The total area equals 6,400 square feet.
The closure is to facilitate the applicant's ability to utilize their property on both sides of
the alley. Staff has reviewed the request and processed it through applicable procedures
with no objection noted.
The appraisal value of the property equals $8,400, which is payable to the City of La
Porte.
Staff recommends approval of this request subject to:
Payment of $8,400.
2. Maximum length of time stipulated for completion of this alley closing shall
be thirty (30) days from date of approval by the City Council.

AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE ALLEY
IN BLOCK 753, TOWN OF LA FORTE, HARRIS COUNTY, TEXAS; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has been
requested by record owner of all of the property abutting the
hereinafter described portion of the alley in Block 753, Town of La
Porte, Harris County, Texas, to vacate, abandon, and permanently
close that portion of the alley in Block 753, Town of La Porte,
Harris County, Texas; and
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine and declare that the
hereinafter described portion of the alley in Block 753, Town of La
Porte, Harris County, Texas, is not suitable, needed, or beneficial
to the public as a public road, street and alley, and that the
closing of the hereinafter described portion of the alley in Block
753, Town of La Porte, Harris County, Texas, is for the protection

Background
Following completion of the Spencer Highway reconstruction, speed zone signs were
temporarily erected while a speed zone study was completed for the new facility. As
stated in the attached memo, a number of factors were considered in establishing the
new speed zones, including 85th percentile speeds (see Exhibit A) and maximum design
speeds.
Recommendation
As shown on the attached Exhibit B, staff recommends the following speeds on Spencer
Highway:
Westbound from SH 146 to 1,900 feet west of South 16th Street, the speed
limit should be established as 35 mph. From 1,900 feet west of South 16th
Street to the western corporate limit, the speed zone should be established
as 45 mph.
Eastbound from the western corporate limit to 1,900 feet west of South
16th Street should be 45 mph. From 1,900 feet west of South 16th Street
to SH 146, the speed limit should be 35 mph.
Action Required by Council:
Consider approving an ordinance establishing speed limits along Spencer Highway as
outlined above.

AN ORDINANCE AMENDING CHAPTER 25, ARTICLE 2, SECTION 25-23 OF THE
CODE OF ORDINANCES OF THE CITY OF LA PORTE; FOR THE PURPOSE OF
DESIGNATING MAXIMUM SPEED LIMITS UPON STREETS WITHIN THE CITY OF
LA PORTE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS
ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON
CONVICTION SHALL BE FINED IN A SUN NOT TO EXCEED TWO HUNDRED
DOLLARS; PROVIDING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, Article 6701d, Vernon's Texas Civil Statutes,
provides that whenever the governing body of the City of La Porte
shall determine upon the basis of an engineering and traffic
investigation that any prima facia speed therein set forth is
greater or less than is reasonable or prudent under conditions
found to exist at any intersection or other place or upon any part
of a street or highway within the City of La Porte, taking into
consideration, but not limited to, the width and condition of the
pavement and other circumstances on such portion of said street or
highway, as well as the usual traffic thereon, said governing body
may determine and declare a reasonable and prudent prima facie
speed limit thereat or thereon by the passage of an ordinance,
which shall be effective when appropriate signage giving notice
thereof is erected at such intersection or other place or part of
the street or highway; and
WHEREAS, the City Council of the City of La Porte has directed
that an Engineering and Traffic Investigation take place for the
purpose of ascertaining reasonable and prudent prima facie speed
limits upon West Main Street within the City of La Porte; and
WHEREAS, the results of said Engineering and Traffic
Investigation have become known unto the City Council of the City
of La Porte; and

WHEREAS, the City Council of the City of La Porte finds that
it is consistent in promoting the health, safety, and welfare of
the citizens of the City of La Porte to designate and alter
heretofore established maximum speed limits upon West Main Street
in the City of La Porte based upon the results of said engineering
and traffic investigation;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE:
Section 1. Upon the basis of an engineering and traffic
investigation heretofore made as authorized by the provisions of
Article 6701d, Vernon's Texas Civil Statutes, the Code of
Ordinances, City of La Porte, Harris County, Texas, Chapter 25
"Traffic", Article 2, Section 25-23, is hereby amended by repealing
subparagraphs (g) (2) , (g) (4) , (h) (2) , (i) (3) , and (j) (2) , and
replacing said subparagraphs with the following new subparagraphs
(g)(4) and (i)(3) to read as follows, to -wit:
"Section 25-23
(g)(4) Along West Main Street, from State
Highway 146 to a point 1,900 feet
west of South 16th Street;
(i)(3) Along West Main Street, from a point
1,900 feet west of South 16th Street
to the western corporate limits;"
Section 2. The City Council officially finds, determines,

is hereby declared to be the intention of this ordinance, and it
is hereby declared to be the intention of this City Council to
have passed each section, sentence, phrase, or clause, or part
thereof, irrespective of the fact that any other section,
sentence, phrase or clause, or part thereof, may be declared
invalid.
Section 4. Any person, as defined in Section 1.07(28), Texas
Penal Code, who shall violate any provision of this ordinance,
shall be deemed guilty of a misdemeanor and upon conviction shall
be punished by a fine not to exceed Two Hundred Dollars ($200.00).
Section 5. All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict only.
Section 6. This ordinance shall be effective fourteen (14)
days after its passage and approval. The City Secretary shall
give notice of the passage of this ordinance by causing the
caption hereof to be published in the official newspaper in the
City of La Porte at least twice within ten (10) days after the
passage of this ordinance.

SUBJECT: Spencer Highway Speed Zones
As you may recall, the Texas Department of Transportation erected speed zone signs along
Spencer Highway that did not accurately reflect the existing speed zones that were
established by ordinance prior to the reconstruction of Spencer Highway.
Following completion of Spencer Highway, TX DOT performed a speed zone study from
S.H. 146 to Willow Spring Gully to determine the speeds that motorists were driving along
this stretch. On the attached Exhibit A, I have provided the 85th percentile speed east and
westbound at different points along Spencer Highway. As you can see, the 85th percentile
speeds range from 37 m.p.h. near 12th Street to 50 m.p.h. near Canada Street.
In attempting to recommend new speed zones, the Planning Department reviewed the
following information:
Road surface characteristics, shoulder condition, grade alignment and sight
distance.
The 85 percentile speed.
Roadside development.
Safe speed for curves or hazardous locations.

On December 16, 1994, a detective from the Police Department was involved in an accident
which resulted in the City's unit #56-20 being totalled. The other party was at fault and their
insurance company is forwarding a check in the amount of $9,920. There have been
approximately $3,842 paid in lease fees for this vehicle making a total of $13,762 available for
replacement.
Quotations were received from three auto dealers for used rental vehicles:
Joe Camp Ford - 1994 Ford Taurus - $12,300
Les Marks Chevrolet - 1994 Cavalier - $13,217
Ron Craft Chevrolet - 1994 Lumina - $12,500
The Taurus from Joe Camp has approximately 22,000 miles on it and has been inspected by
Equipment Services and appears to be in good working order. It is recommended that this
vehicle be purchased for $12,300.
This item is exempt from formal sealed bidding due to "...unforseen damage to public
machinery, equipment, or other property".

The Accord Group presented a proposal to the City in December to provide professional
assistance in selecting the City's new financial information system. The new hardware and
software will replace the Data General system currently in use.
Their proposal consisted of six tasks to complete this project. The first two have been
completed and the third, analysis of proposals, is in process. The remaining three tasks are
estimated to cost $7,600 plus miscellaneous costs of $1,444, for a total not to exceed $9,044.
Funds for this project were budgeted in the general capital improvement fund.

Thank you for the opportunity to provide professional assistance in selecting the
CiWs new financial information system. The purpose of this letter is to propose this
assistance. As before, this assistance is structured to allow city staff to perform most
of the labor intensive tasks. The ACCORD GROUP will function as a reviewer and
coordinator of the selection process. Tasks will include:
Task 1: Review of Request for Proposals
The ACCORD GROUP will review the City's request for proposals (RFP) for the
new Financial information system. During Task 1, our consultants will review the
RFP for major system requirements. Any suggested changes will be identified and
discussed with the City.
Task 2: RFP Mailed to Vendors
The ACCORD GROUP will assist you in developing a list of prospective vendors.
During the two - three weeks vendors are preparing their proposals, our consultants
will be available to answer vendor questions or resolve any issues. The city staff
will take the lead in answering vendor questions.
Task 3: Analysis of Proposals
When the Proposals are received, our consultants will assist the City in the analysis.
This analysis will be based upon the evaluation criteria in the RFP. The city staff
will conduct most of the analysis and all of the reference checks. Reference check
lists will be provided to the city for staff to use. After the City has completed its
analysis The ACCORD GROUP will review the findings and hold a workshop with
staff to discuss which vendors should be asked to make presentations. Each vendor
should be given two days of dedicated time — at La Port City Hall.

Task 4: Vendor Demonstrations and Site Visits
During Task 4, our consultant will schedule and attend demonstrations by the
vendor finalists to you and your staff. An agenda will be prepared by our consultant
and provided to each selected vendor. These demonstrations will be conducted at
the City. The vendors will be requested to show capabilities that are important to
the City. Once the demonstrations are complete, a brief workshop with the City's
Selection Team will be held to decide which vendors will be asked to arrange a visit
to a similar sized city using their proposed systems.
(Optional) The City will coordinate and schedule the site visits. The ACCORD
GROUP will accompany the City Team members on visits to the cities. The
number of vendors still under consideration should be limited to two. At the end of
the site visits, a discussion will be held to determine which vendor should be
recommended. If further discussions or issues need to be resolved a more formal
workshop will be conducted. The recommendation will be to attempt to negotiate a
contract with that vendor. The recommendation will be based upon the vendor's
proposal, system evaluation, comfort with the vendor, and how well the vendor's
system achieves your needs.
Task 5: Vendor Recommendation
Once the Selection Team has made a decision, a presentation will be developed by
city staff with in ut from our consultant. The presentation will be made to the City
Manager and Council by the MIS Committee. Our consultant will attend the
presentation to provide support and answer questions.
Task 6: Contract Negotiation
Our consultant will assist the City in negotiating a contract for the new Financial
information system. This will be conducted with the vendor selected in Task 4.
Price, payment terms, training hours, and implementation assistance will be issues.
Estimated Professional Fees and Expenses
Based upon the described Tasks, our professional fees for Tasks 1 through 6 will
not exceed $10,200. The professional fees allow for four (4) days of demonstrations
[two days for each vendor finalist] and two for site visits. If additional days are
necessary or if events materially affect the tasks, these will be discussed with the
City prior to any assistance being provided.

is Version 3, Release 1. We will have to purchase this upgrade

SUMMARY & RECOMMENDATION
The City of La Porte has advertised for bids to replace the lexan panels in Sylvan Beach Pavilion,
to replace rusted casements and glass in Jennie Riley Recreation Center, and to install framework
and glass in the new free weight room at the La Porte Recreation and Fitness Center. Bids were
opened and read on January 16, 1995. Bid requests were mailed to eight vendors with three
returning bids. Lohman Glass Company of La Porte submitted the low bid meeting specifications,
totalling $9,840.00. The amount budgeted in the FY 94-95 budget for these three projects are as
follows: Sylvan Beach Lexan replacement, $1 1,250.00; Jennie Riley casement and glass
replacement, $4,750.00;and Recreation & Fitness Center frame and glasswork for new free weight
room, $2,450.00. The budgeted funds for these three projects totals $18,450.00.
Staff recommends the award of this Glass Installation Contract to Lohman Glass Company, as
overall bidder meeting specifications, and the bid being within budgeted funds for the three specified
projects.
Action Required by Council:
Consider award of bid for Glass Installation Contract for replacement of Lexan panels at Sylvan
Beach Pavilion, replacement of casements and windows at Jennie Riley Recreation Center, and
installation of framework and glass in the new free weight room at the Recreation & Fitness Center

The City of La Porte uses a chemical grout to reduce infiltration to
sanitary sewer lines and manholes. This grout reacts with the soil to form
a barrier to stop migration of water through the soil around the lines and
manholes reducing the amount of ground water entering the sanitary sewer
system.
AV-100, the current material used, is a sole -source item from Avanti
International. This is a proprietary, patented product which no other
company can bid in the United States. There is a comparable product
available, AV-118 sold by Cues, Inc. This product will perform as well as
AV-100. It is a liquid product which costs less per pound than the AV-100.
The AV-100 is a powdered product which is mixed at the job site by Public
Works employees as needed. The AV-118 contains a large amount of water
which adds to the weight and means more of the AV-118 is needed to seal a
comparable area as compared to powdered AV-100. Fifty (50) pounds of AV-
100 costing $158.00 will treat the same area as 132 pounds of AV-118
costing $297.00. In addition, the powdered AV-100 is safer and easier for
the employees to handle with much less wasted product.
Under State law, Council can authorize declaration of a vendor as sole
source of an item when "items are available from only one source because of
patents, copyrights, secret processes, or natural monopolies." Staff
recommends declaration of Avanti International as the sole source supplier
of AV-100 as this company is the only authorized American dealer of this
product. The attendant chemicals needed (ammonium persulfate and
triethanalmine) are currently on an annual contract and are not included in
this designation. Cost of this contract would not exceed 13,200 lbs of
chemical grout at a cost of $3.16/lb, for a annual cost of $41,712.00.
Action Required by Council: Declare Avanti International the sole sources
supplier for AV-100 chemical grout, for an estimated annual purchase in an
amount not to exceed $42,000.00.

This letter is to verify the fact that Avanti International is
the only vendor of AV-100 acrylamide gel grout in the United
States.
AV-100 is the most popular chemical grout in North America. The
acrylamide grout is a gel, and its primary function is soil
consolidation. By filling the void spaces between particles of
soil while in a liquid state, and then changing to a solid,
looking much like a clear jelly, the acrylamide grout stops water
movement in the treated soil mass.
AV-100 is the same formulation as AM-9, which was manufactured by
American Cyanamid from the early 1950's until 1978. AV-100 is
now made in Japan by a manufacturer producing the grout since
1962. The gel is colorless, firm, but not very strong, with low
tensile strength. It has a very broad range of gel times and has
the lowest viscosity of any of the chemical grouts. The
longevity and effectiveness of the AV-100 has proven through the
years to be superior over other materials. It is still the most
economical grout to use and comes in powder form to make handling
much easier than the liquid form.
Pricing on the AV-100 is $790.00 for a 250 lb. drum., or $3.16
per lb., F.O.B. LaPorte, Texas. You will get 300 gallons of
mixed grout out of this 250 lb. drum.
