• • MINUTES OF THE REGULAR MEETING OF LA PORTE CITY COUNCIL APRIL 10, 1995 1. CALL TO ORDER The meeting was called to order by Mayor Norman Malone at 6:00 P.M. Members of City Council Present: Mayor Norman L. Malone, Councilpersons Guy Sutherland, Mike Cooper, Bob Thrower, Bob McLaughlin, Alton Porter, Deotis Gay, Jack Maxwell and Jerry Clarke Members of Council Absent: None Members of City Staff and City Employees Present: City Manager R. CONSIDER APPROVING MINUTES OF SPECIAL CALLED REGULAR MEETING OF LA PORTE CITY COUNCIL MARCH 20. 1995 Motion was made by Councilperson Cooper to approve minutes of March 20, 1995. Second by Councilperson Sutherland. The motion carried, 9 ayes and 0 nays. CONSIDER APPROVING MINUTES OF SPECIAL CALLED TOWN MEETING ON MARCH 29. 1995 Motion was made by Councilperson McLaughlin to approve the minutes of March 29. 1995. Second by Councilperson Thrower. The motion carried, 8 ayes, 0 nays and 1 abstain. Ayes: Councilpersons Sutherland, Cooper, Thrower, McLaughlin, Gay, Maxwell, Clarke and Mayor Malone Nays: None Abstain: Councilperson Porter 5. PRESENTATIONS: A. EMERGENCY SERVICES AWARD Bill White - American Legion Post 428 B. SPECIAL PRESENTATION Lamoin Scott - Representing the Office of Representative Mike Jackson Mr. White introduced the Commander of the American Legion Post 428 Marvin Casteel, President of the La Porte Volunteer Fire Fighters Association Teri Crate, President of the La Porte Police Officers Association Officer Tim Bird. Mr. White reported all of the honorees tonight were selected by a vote of their peers. He announced the American Legion local winners as follows: Paramedic of the Year - Robyn Gallion Fire Fighters of the Year - Jimmy Crate and John Ladd Police Officers of the Year - Donna Cook and Ron Parker Americanism Award - Sammy Jacobs - Police Department Mr. White then announced Jimmy Crate was the winner of the American Legion District 22 award for Fire Fighter of the Year, Sergeant Ron Parker was Police Officer of the Year, and Robyn Gallion was Paramedic of the Year. Mr. White then proudly announced that Jimmy Crate was Texas State Fire Fighter of the Year, and Sergeant Ron Parker was Texas State Police Officer of the Year. Minutes Special Called Regular Meeting La Porte City Council ~a,-~~,~, 1995, Page 3 Mr. White introduced Fire Chief Joe Sease, Police Lieutenant Aaron Corrales, and Aid to State Representative Mike Jackson, Ms. Lamoin Scott. Ms. Scott read two resolutions which Representative Mike Jackson had passed in the House of Representatives, HR 237 honoring Jimmy Crate and HR 238 honoring Sergeant Ron Parker. Copies of the Resolutions were presented to the honorees and their respective Chiefs'. Mr. White gave special thanks to Teri Crate, La Porte Fire Fighter Association, Officer Tim Bird, La Porte Police Officers Association, and Representative Mike Jackson and his Aid Lamoin Scott for their assistance to the La Porte American Legion Post 428. Police Officer Donna Cook and EMS Paramedic Robyn Gallion entered the Council Chambers and were introduced to Council and the audience. 6. PETITIONS REMONSTRANCES, COMMUNICATIONS. AND CITIZENS AND TAX PAYERS WISHING TO ADDRESS COUNCIL At this time Council had no requests from citizens. 7. PRESENTATION OF 1994 COMPREHENSIVE ANNUAL FINANCIAL REPORT - J. Litchfield/Null & Associates Mr. Litchfield presented the Annual Comprehensive Financial Report which measures the activity of one fiscal year. Mr. Litchfield announced the independent audit firm of Null and Associates has reviewed the report to assure there are no mistakes in the presentation of the City of La Porte's financial status and condition. Null and Associates representatives Mr. Chuck Yaple and Mr. Chris Breaux were introduced. Mr. Yaple addressed Council stating, "It is the opinion of Null and Associates the City of La Porte's financial statements are presented fairly in all material respect in accordance with accepted accounting principals." Mayor Malone returned to Item 6. as two citizens had presented a request to address Council. Ms. Debra Herrera addressed council with a request to lower the speed limits and add more stop signs in residential areas of her subdivision. Ms. Annie Bustos also had signed the request to speak. Mayor Malone asked Ms. Bustos if she would like to speak, and she declined stating she wanted to say the same things Ms. Herrera had presented to Council. • Minutes Special Called Regular Meeting La Porte City Council ~m~ 1995, Page 4 8. CONSIDER AN ORDINANCE AUTHORIZING AND APPROVING AN AGREEMENT BETWEEN THE CITY OF LA PORTE AND WATER TANK SERVICE COMPANY FOR REPAINTING OF FAIRMONT PARK ELEVATED WATER STORAGE TANK jOrd. 95-2027) - S. Gillett Director of Public Works Steve Gillett reviewed summary and recommendation for the request to authorize the City Manager to execute a contract with Water Tank Services in the Amount of $116,230.00 for the repainting of the Fairmont Park elevated water storage tank. City Attorney read: ORDINANCE 95-2027 - AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LA PORTE AND WATER TANK SERVICE COMPANY, FOR REPAINTING OF THE FAIRMONT PARK ELEVATED WATER STORAGE TANK; APPROPRIATING NOT TO EXCEED $116,230.00 TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. CONSIDER AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-A-3 OF ORDINANCE NUMBER 915 "PIPELINE TRANSPORTATION,'!_CHAPTER 18-A OF THE CODE OF ORDINANCE, TO CONSTRUCT AN 8-INCH PIPE LINE FOR THE TRANSPORTATION OF PROCESS WASTEWATER (Ord. 95- 915-MM) - S. Gillett Director of Public Works Steve Gillett reviewed for Council the summary and recommendation to approve a permit to Noltex L.L.C. to construct and operate an eight inch process wastewater pipeline. Osmond Golf Pro Alex Osmond reviewed summary and recommendation for request to consider an ordinance approving and authorizing a contract with Furlow Services, Inc., for $24,375.90 and allow a 3$ contingency for construction in the amount of $731.27. Motion was made by Councilperson Clarke to approve Ordinance 95-2028. Second by Councilperson Sutherland. The motion carried, 9 ayes and 0 nays. Bids were received from seven (7) contractors, per the attached bid tabulation. Low bid was received from Water Tank Service Company, of Pasadena, Texas, in the amount of $116,230.00. The Engineer has past experience working with this contractor, and recommends the bid be awarded. A total of $150,000.00 is budgeted for this Project. The City Council appropriates the sum not to exceed $116,230.00 from Capital Improvement Fund No. 003-706-620-100 to fund said contract. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. Gillett Department: Public Works Report Resolution XXXX Ordinance Exhibits: Ordinance No. 915- Letter from Dames & Moore Location Map SLTNIlKARY & RECOMMENDATION Dames & Moore, acting on behalf of Noltex L.L.C. has requested a permit to construct and operate an eight (8) inch neutralized process wastewater pipeline, operating at a maximum pressure of 102 psi at 100 degrees F., within the City of La Porte. The proposed pipeline will be constructed as depicted in the attached location map, within the Exxon Pipeline Corridor. The request meets all requirements of Ordinance 915 for the construction and operation of pipelines within the City, and the $300 permit fee, as well as the $200 annual fee, has been paid. Action Required by Council: Approve Ordinance No. 915- approving a permit to Noltex L.L.C. to construct and operate an eight (8) inch neutralized wastewater pipeline within the City of La Porte. Herrera DATE City Manager • ORDINANCE NO. 95-915-MM AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-a-3 OF ORDINANCE NO. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED NOVEMBER 25, 1975, TO CONSTRUCT AN 8-INCH PIPE LINE FOR THE TRANSPORTATION OF NEUTRALIZED WASTEWATER; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte has received an application dated March 31, 1995, from NOLTEX L.L.C., requesting a permit under Section 18-A-3 of Ordinance 915, being Chapter 18-A of the Code of Ordinances of the City of La Porte, to construct and operate its 8-inch pipe line for the transportation of NEUTRALIZED WASTEWATER, crossing the City of La Porte, all as shown on said application. The application of NOLTEX L.L.C. has been reviewed by the City's Director of Public Works, who has found that said application meets all requirements of said Ordinance No. 915, and has recommended its approval. Section 2. The City Council of the City of La Porte hereby approves the application of NOLTEX L.L.C., dated March 31, 1995, and this Ordinance shall constitute a permit to NOLTEX L.L.C. to operate said pipe line within the City of La Porte, all in conformance with the requirements of said Ordinance No. 915, contingent upon its filing with the City of La Porte prior to commencement of construction, copies of its permits from the Texas Department of Highways and Transportation; Harris County; and the Harris County Flood Control District. Any future relocation of the pipeline herein permitted, within the City, State, or County rights-of-way, shall be at the sole expense of permittee. Section 3. This Ordinance shall be in full force and effect from and after its passage and approval. The pipeline will convey neutralized process wastewater from the Noltex L.L.C. plant located east of Sens Road at 12220 Strang Road to the Gulf Coast Waste Disposal Authority located south of Fairmont Parkway. As Figure 2 indicates, the Noltex pipeline will run within two pipeline corridors, the DuPont Pipeline Corridor and the Exxon Pipeline Corridor System, respectively. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA FORTE: Section 1. Background. In 1989, the Visions '89 Committee identified the need for the City to obtain Bayfront property to insure future generations of La Porte residents will have access to Galveston Bay. In 1994, the City took a major step in accomplishing this goal by entering into an option purchase agreement for land on Galveston Bay. The City negotiated price for the property is $675,000, which is $120,000 less than the fair market value as appraised by a state certified appraiser. The agreement included an option payment of $105,000 with the owner financing the remaining amount over a six year period at 4.5%. This agreement was finalized by ordinance 94-1994 in August, 1994. Section 2. Benefits of this Purchase. 1. Establishes City owned park property on the Bayfront which can be used for water related activities for present and future generations. 2. Fulfills the goals of the City's Comprehensive Plan and the Visions '89 Goals Report. 3. Allows the City of La Porte to make decisions regarding the recreational future for Bayfront park property located in the City. 4. Relieves the overcrowding that occurs at Sylvan Beach Park by providing a reserved site for La Porte citizens. 5. Provides a family park atmosphere to enjoy one of the City's greatest assets - Galveston Bay. Section 3. This Property Acquisition: 1. Will not necessitate a tax increase. Monies have been set aside to purchase the land as a part of the normal budgeting process. • RESOLOTION NO. 95-06 PAGE 2 2. Will not adversely impact the City's financial condition nor will it represent an economic burden to the City or to the taxpayers. 3. Will not alter the City's bond or credit rating. 4. Initial Plans for Development. 1. Year 1 - remove existing buildings and secure the property; begin normal park maintenance activities. 2. Year 2 - establish a Citizen Review Committee to develop Park Master Plan. Section 5. Potential Improvements Envisioned. 1. Parking Lot. An on-site parking lot will be built and no street parking will be allowed. 2. Restroom Facilities. 3. Repair/Enlarge Pier and Install a Boardwalk. To make it accessible to all citizens of La Porte-(i.e. A.D.A.). 4. Cemetery. Preserve and enhance cemetery for historical purposes. 5. Walking and Jogging Trail. Park benches and exer-stations could be installed adjacent to the trail. 6. Picnic Pavilion. With a built-in barbecue pit to encourage and support family gatherings. 7. Water Related Recreational Programs. Fewer than 10% of the youth of this city have ever experienced sailing as a pastime. Not all La Porte citizens desire to join private yacht clubs or sailing clubs so that their children can learn to sail. A small fleet of one and two person sailboats, canoes and paddle boats could be purchased and used for giving lessons and for rentals during the season. Section 6. This material is more efficient and is environmentally safe compared to malathion. With dilution in the distributing agent, less Scourge is used than other types of materials. Most mosquito control agencies have switched to this material due to the inherent problems of malathion. B & G Chemical is the sole authorized distributor of Scourge for this area. The City has been notified of a price increase of $13.17 per gallon effective April 1, 1995. B & G Chemical is willing to hold the prior price of $250.40 per gallon for two weeks as the city has been a valued customer in the past. Purchase of the material under the old price will save the city $724.35. This material will be needed for the upcoming spraying season, and should last through October 1995. It is recommended that the City Council declare Scourge a sole source item from B & G Chemical and authorize the purchase of 55 gallons of Scourge Mosquito Control Agent at $250.40 per gallon, for a cost of $13,772.00, and 715 gallons of Orchex, the distributing agent, at a cost of $3.40 per gallon, for a cost of $2,431.00. The total cost of the contract would be $16,203.00. Funds for this purchase are available in the Streets Division 94/95 Operating Budget. Action Required by Council: Declare Scourge Mosquito Control Agent a sole source item and authorize purchase of the material as recommended by Staff. The park is relatively new and there is no play equipment on site. The equipment contemplated is: two (2) swing sets and associated equipment, and one (1) large modular multi-use play structure. Bids were opened and read on March 28, 1995. Bid requests were mailed to nine (9) vendors with four (4) returning bids. Overall low bid was submitted by Kraftsman Playground and Park Equipment in the amount of Eight Thousand, Seven Hundred Fifty-Two Dollars ($8,752.00). The amount budgeted in the FY 94-95 Parks Maintenance budget for this purchase is Five Thousand Dollars ($5,000.00). The City of La Porte received Five Thousand Dollars ($5,000.00) from Schubert Properties in matching funds, for a total of Ten Thousand Dollars ($10,000.00) to fund this playground equipment purchase for Glen Meadows Park. Staff recommends the bid award for playground equipment for Glen Meadows Park, to Kraftsman Playground and Park Equipment, as overall low bidder meeting specifications, and being within budgeted funds for this purchase.
