MINUTES OF THE PUBLIC HEARING AND REGULAR MEETING OF
LA PORTE CITY COUNCIL
AUGUST 14, 1995
1. CALL TO ORDER
The meeting was called to order by Mayor Norman L. Malone at
6:00 P.M.

3. CONSIDER APPROVING MINUTES OF REGULAR MEETING JULY 24, 1995
Motion was made by Councilperson Thrower to aPt>rove the
minutes of July 24 as presented. Second by Councilperson
Maxwell. The motion carried, 8 ayes, 0 nays and 1 abstain.

Gay, Maxwell, Clarke and Mayor Malone

4. PROCLAMATION
A. Phil Baxley Week
Mayor Malone proclaimed the week of August 20 - 27, 1995 as
Phil Baxley Week. Mayor Malone reported Mr. Baxley is in need
of a liver transplant and is trying to raise $15,000 through
fund raising projects. Mr. Baxley expressed his appreciation
to Council and the city of La Porte for their assistance in
his efforts
5. PRESENTATION
A. EMPLOYEE OF THE QUARTER (Leonard Nichols)
Mayor Malone reported the selection of Leonard (Nick) Nichols
as "Employee of the Quarter" for April, May, and June 1995.
Assistant utility Superintendent Don R. Pennell presented Mr.
Nichols with a plaque for his outstanding performance in his
position as Senior Maintenance utility Worker. Mr. Nichols
expressed his appreciation for this honor.
6. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX
PAYERS WISHING TO ADDRESS COUNCIL
There were no citizens wishing to speak at this time.
7. PUBLIC HEARING - FOR THE PURPOSE OF CONDEMNING AND ORDERING
DEMOLITION OF DANGEROUS BUILDINGS

PUBLIC HEARING CLOSED
Mayor Malone opened the public hearing at 6:12 P.M. Chief
Building Official Mark Lewis reviewed with Council the summary
and recommendation for the condemning and ordering the
demolition of thirteen (13) structures. Two (2) structures,
item M, located at 800 Blk. Santa Anna Lane and item 0,
located at 309 S. 5th were deleted from the list after posting
of the agenda due to the owners having the buildings
demolished prior to the City Council meeting. Inspector
Debbie Wilmore assisted with a video presentation
representative of the structures in question.

6,7; SAN JACINTO HOMES, OWNER, TERRY S. DIANA. Zygmund
Kawczynski, 406 San Jacinto, La Porte, spoke in favor of
demolition. Mrs. Marshall La Grange, 409 San Jacinto, La
Porte, spoke in favor of demolition.
G. BUILDING LOCATED AT CRESCENT & BAY STREET, BLK. 3; LOT 4 &
N. 1/2 OF LOT 5; OAKHURST, OWNER, KARL L. SPRINGER. Ms. Peggy
Antone, 8418 Collingdale, La Porte spoke against demolition.
J. BUILDING LOCATED AT 10900 N. H STREET, TR. 466; W. 1/2 OF
E. 1/2; LA PORTE OUTLOTS, OWNERS, C. WADE BAKER AND DEBBIE
BAKER. Mr. C. Wade Baker, 3406 Park Dale, spoke in favor of
demolition. He stated he is a contractor and planning to
demolish the structure himself within thirty (30) days.
L. BUILDING LOCATED AT 1803 LOMAX SCHOOL ROAD, S. 1/2 OF LOT
421; TR. 421; LA PORTE OUTLOTS, OWNER, MRS. CLIONE J. PULLEN.
Ms. Valerie Tees, niece of Mrs. Pullen, 706 Garden Walk, La
Porte, spoke against demolition. Ms. Tees asked Council to
delay their decision for destruction for thirty (30) days.
N. BUILDING LOCATED AT 515 S. 4TH STREET, BLK. 112; LOTS
10,11; TOWN OF LA PORTE, OWNERS, (1) MARY MARTIN; 2) CHARLIE
MARTIN; (3) DANIEL A. MILLER. Mr. Charlie Martin, owner,
spoke against demolition. Mr. Donald Scott, 423 South 4th
Street, spoke in favor of demolition.

thought his second was for discussion of Ordinance 95-2051.
councilperson Sutherland stated, "Let the record show I will
second the motion to deny Ordinance 95-2051". The motion to
deny destruction of Item G. failed, 4 ayes and 5 nays.

11. ADMINISTRATIVE REPORTS
City Manager Robert T. Herrera reported, "If the Council sees
fit, after this Council meeting, the Council should adjourn
for about five minutes and then go into a Budget Workshop."
Mayor Malone asked City Attorney Knox Askins to introduce the
newest member of his law firm. Mr. Askins introduced Charles
R. Huber Jr. and stated, "Mr. Huber, as of August 1st, is with
our firm full time and we are very happy to have him with us."
12. COUNCIL ACTION
Councilpersons Cooper, McLaughlin, Porter, Gay, Maxwell and
Mayor Malone brought items to Council's attention.
Mayor Malone asked city Manager Robert T. Herrera if there was
any thing that could be done to aid the property owner next to
the structure located at Crescent & Bay Street, by placing

some type of structure or barricade to prevent people from
driving on private property. Mr. Herrera stated, "The
arguments heard tonight are very compelling and City staff
enjoys a good challenge. We will work out what we can do
legally, report back to City Council if we can do something to
help out the neighborhood, and to alleviate some of their
fears."

Transplant Fund in assisting the Baxley family in raising $15,000 through fund raising projects

Help - transplant families like the Baxley family; and
NOW, THEREFORE, I, NORMAN L. MALONE, MAYOR of the
City of La Porte, do hereby prockdm August 20 - 27, 1995 as
PHIL BAXLEY WEEK
in the City of La Porte, and urge all citizens to observe this week and strive to provide a
-Second Chance at life- for Phil Baxley.

APRIL, MAY, JUNE, 1995
Leonard Nichols (Nick) was chosen as the City of La Porte
"Employee of the Quarter", for the months of April, May, and
June. Nick has served the City of La Porte since September, 15,
1982. As a Senior Utility Maintenance Worker, Nick always
completes his responsibilities, performs extra tasks in his
department, and assists his supervisor when needed. His assigned
equipment is always in tip-top shape enabling Nick to perform
excellent maintenance procedures. No matter the weather, he just
keeps "plugging away". Congratulations, Nick!

SUMMARY & RECOMMENDATION
SummarY:
city Council is asked to consider condemning and ordering the
demolition of fifteen (15) substandard structures. Subsequent to
this meeting, as required by Ordinance #1145, two (2) separate
notices were published in the Bayshore Sun. certified letters
containing public notices were mailed to the owner(s) of the
buildings in question. A placard, identifying the structures as
substandard was posted on each building.
The purpose of this public hearing is to take property owner and
citizen comments as to why each of the buildings should or should
not be condemned and demolished. Following the close of the
hearing, council will be asked to consider condemnation of the
structures. A separate ordinance is required to condemn each of
the structures.
As of August 07, 1995, the date on which this request is being
prepared, fifteen (15) structures remain. A demolition permit for
11711 W. Main has been issued, but the structure has not yet been
removed.
Condemnation ordinances have been prepared for each of the
remaining fifteen (15) structures. One complete ordinance is
attached as reference. As the ordinances are all in a standardized
form, in the interest of reducing the bulkiness of the agenda
packet, only cover pages and inspection reports have been included
for the other ordinances
Recommendation:
The Dangerous Building Board of Inspection unanimously recommends
that all fifteen (15) of the remaining dangerous buildings be
condemned and demolished.

twenty-four (24) hours of the receipt of said complaint, make
a thorough inspection of said alleged dangerous building: and
WHEREAS, Sectiori 8-118(c) provides that:
After the inspection provided. for in this Section has
been made, with or without the aid of experts, the Board shall
immediately report its conclusion in writing to each of the
members of the City Council and to the City Attorney. Such
report shall state the circumstances and the condition of the
building upon which such conclusion was based. The report
shall be filed in all cases no matter what conclusion is
stated by the Board: and

WHEREAS, it has heretofore come to the attention of the
Board of Inspection that the building located on Blk. 66: Lots
21.22: Town of La Porte. which is further described as 209 N. 5th
Street Harris County, Texas, has, for the reason of neglect or
misuse, been allowed to deteriorate into a condition of decay or
partial ruin or has become a fire hazard, as defined in Section 8-
117 of the Code of Ordinances of the city of La Porte: and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated Mav 11. 1995, finding said building
to be in fact a dangerous building:
WHEREAS, city Council received such report, and ordered notice
to the record owner(s) of said property, Mrs. Sweetie Evans c/o
Johnnv Joe Evans and patricia Althea Evans, whose address is 212 N.
8th Street - La Porte. Tx 77571, that a hearing as provided in
Section 5 of said Ordinance would be held at 604 West Fairmont
Parkway, at the Council Chambers, ci ty Hall, ci ty of La Porte,
Texas, at which time the Council would hear evidence for and
against the conclusions of the Board;
WHEREAS, the City Secretary has heretofore served notice of
said hearing upon said owner(s), by registered mail, return receipt
requested, which return receipt indicates that said owner(s)
received said notice on Auaust 03. 1995, a date more than ten (10)
days before the date set for said hearing:

WHEREAS, at said date, time, and place, city council met in
regular session to conduct such public hearing, at which time
evidence was presented both for and against the conclusions of the
Board of Inspection;
WHEREAS, City Council, after due deliberation, and within
fifteen (15) days after the termination of the hearing, is required
to make its decision in writing and enter its order: and
WHEREAS, city Council entered its order on Auaust 14. 1995 a
day which is within fifteen (15) days after the termination of the
hearing: NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
section 1. This Ordinance contains the findings and orders
of the City council of the city of La Porte, and its conclusions"
based upon the evidence presented at said hearing.
section 2. Based on the evidence presented at said
hearing, the city Council hereby adopts the attached report of the
Board of Inspection, in full, and incorporates such by reference
herein as fully as though set out herein.
section 3. The City Council hereby finds, determines and
declares such building to be a nuisance, and orders such building
condemned.

section 4. The city Council hereby finds, determines and
declares that Mrs. Sweetie Evans c/o Johnnv Joe Evans and Patricia
Althea Evans, who resides at 212 N. 8th Street - La Porte. Tx
77571, is the record owner(s) of the property on which this
building is situated, and that as such record owner(s), the said
Mrs. Sweetie Evans c/o Johnnv Joe Evans and Patricia Althea Evans
has been duly and legally notified of these proceedings.
Section 5. The city Council hereby orders the said Mrs.
Sweetie Evans c/o Johnnv Joe Evans and Patricia Althea Evans to
entirely remove or tear down such building, and further orders the
said Mrs. Sweetie Evans c/o Johnny Joe Evans and Patricia Althea
Evans to commence such removal within ten (10) days from the
effective date of this Ordinance, and to complete such removal of
demolition of such building within a reasonable time.
Section 6. The city Council hereby orders the Board of
Inspection of the ci ty of La Porte to cause a notice of the
dangerous, insanitary condition of the building to be affixed in
one or more conspicuous places on the exterior of the building,
which notice or notices shall not be removed or defaced by any
person, under penalty of law.
Section 7. The city council hereby orders the City
Secretary to forward a certified copy of this Ordinance, to the
record owner(s) of said property, the said Mrs. Sweetie Evans c/o
Johnnv Joe Evans and Patricia Althea Evans, by registered mail,
return receipt requested.

section 8. Should the said Mrs. Sweetie Evans c/o Johnnv
Joe Evans and Patricia Althea Evans not comply with the orders
contained in this Ordinance relating to the removal or demolition
of such building within ten (10) days after hereof, then the Board
of Inspection of the city of La Porte shall enter upon the said
premises with such assistance as it may deem necessary, and cause
the said building to be removed or demolished without delay, and
the expenses of such procedure shall be charged against the said
Mrs. Sweetie Evans c/o Johnnv Joe Evans and Patricia Althea Evans,
record owner(s) of said property, and shall thereupon become a
valid and enforceable personal obligation of said owner of such
premises, and the said Board of Inspection shall carefully compute
the cost of such removal or demolition, which cost shall be
hereafter assessed against the land occupied by such building, and
made lien thereon.
section 9. The City council officially finds, determines,
and recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the city council
was posted at a place convenient to the public at the City Hall of
the City for the time required by law
preceding this meeting, as required by the Open Meetings Law,
Article 6252-17, Texas Revised civil Statutes Annotated; and that
this meeting has been open to the public as required by law at all

WHEREAS, at said date, time, and place, City Council met in
regular session to conduct such public hearing, at which time
evidence was presented both for and against the conclusions of the
Board of Inspection;
WHEREAS, city Council, after due deliberation, and within
fifteen (15) days after the termination of the hearing, is required

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
section 1. This Ordinance contains the findings and orders
of the city council of the City of La Porte, and its conclusions"
based upon the evidence presented at said hearing.
section 2. Based on the evidence presented at said
hearing, the City Council hereby adopts the attached report of the
Board of Inspection, in full, and incorporates such by reference
herein as fully as though set out herein.
Section 3. The City Council hereby finds, determines and
declares such building to be a nuisance, and orders such building
condemned.

section 4. The city council hereby finds, determines and
declares that Marv Ann Warner, who resides at 3339 Somerton Dr. -
La Porte, Tx 77571-3729, is the record owner(s) of the property on
which this building is situated, and that as such record owner(s),
the said Marv Ann Warner has been duly and legally notified of
these proceedings.
Section 5. The city Council hereby orders the said ~
Ann Warner to entirely remove or tear down such building, and
further orders the said Marv Ann Warner to commence such removal
within ten (10) days from the effective date of this Ordinance, and
to complete such removal of demolition of such building within a
reasonable time.
Section 6. The City Council hereby orders the Board of
Inspection of the Ci ty of La Porte to cause a notice of the
dangerous, insanitary condition of the building to be affixed in
one or more conspicuous places on the exterior of the building,
which notice or notices shall not be removed or defaced by any
person, under penalty of law.
Section 7. The city council hereby orders the city
Secretary to forward a certified copy of this Ordinance, to the
record owner(s) of said property, the said Mary Ann Warner, by
registered mail, return receipt requested.

section 8. Should the said Mary Ann Warner not comply with
the orders contained in this Ordinance relating to the removal or
demolition of such building within ten (10) days after hereof, then
the Board of Inspection of the city of La Porte shall enter upon
the said premises with such assistance as it may deem necessary,
and cause the said building to be removed or demolished without
delay, and the expenses of such procedure shall be charged against
the said Marv Ann Warner, record owner(s) of said property, and
shall thereupon become a valid and enforceable personal obligation
of said owner of such premises, and the said Board of Inspection
shall carefully compute the cost of such removal or demolition,
which cost shall be hereafter assessed against the land occupied by
such building, and made lien thereon.
section 9. The city council officially finds, determines,
and recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City council
was posted at a place convenient to the public at the City Hall of
the city for the time required by law
preceding this meeting, as required by the Open Meetings Law,

twenty-four (24) hours of the receipt of said complaint, make
a thorough inspection of said alleged dangerous building: and
WHEREAS, Section 8-118(C) provides that:
After the inspection provided for in this Section has
been made, with or without the aid of experts, the Board shall
immediately report its conclusion in writing to each of the
members of the city Council and to the City Attorney. Such
report shall state the circumstances and the condition of the
building upon which such conclusion was based. The report
shall be filed in all cases no matter what conclusion is
stated by the Board; and

Town of La Porte, which is further described as 409 So. 2nd street
Harris county, Texas, has, for the reason of neglect or misuse,
been allowed to deteriorate into a condition of.decay or partial
ruin or has become a fire hazard, as defined in section 8-117 of
the Code of Ordinances of the City of La Porte; and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated Mav 11, 1995, finding said building
to be in fact a dangerous building;
WHEREAS, City Council received such report, and ordered notice
to the record owner(s) of said property, william Harold Eastman,
whose address is 409 So. 2nd st. - La Porte, Tx 77571, that a

604 West Fairmont Parkway, at the Council Chambers, City Hall, city

out of the necessary duties of such member, or by reason of a
complaint of any citizen of the City or of the City Council,
that a dangerous building exists, the Board shall, wi thin
twenty-four (24) hours of the receipt of said complaint, make
a thorough inspection of said alleged dangerous building: and
WHEREAS, Section 8-118(C) provides that:
After the inspection provided for in this Section has
been made, with or without the aid of experts, the Board shall
immediately report its conclusion in writing to each of the
members of the City Council and to the city Attorney. Such
report shall state the circumstances and the condition of the
building upon which such conclusion was based. The report
shall be filed in all cases no matter what conclusion is
stated by the Board; and

WHEREAS, it has heretofore come to the attention of the
Board of Inspection that the building located on Blk. 224: Lots
6,7: San Jacinto Homes, which is further described as 407 San
Jacinto st. Harris County, Texas, has, for the reason of neglect or
misuse, been allowed to deteriorate into a condition of decay or
partial ruin or has become a fire hazard, as defined in section 8-
117 of the Code of Ordinances of the City of La Porte: and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated June 21, 1995, finding said
building to be in fact a dangerous building:
WHEREAS, city Council received such report, and ordered notice
to the record owner(s) of said property, Terrv S. Diana, whose
address is 407 San Jacinto st. - La Porte, Tx 77571, that a hearing
as provided in section 5 of said Ordinance would be held at 604
West Fairmont Parkway, at the Council Chambers, city Hall, City of
La Porte, Texas, at which time the Council would hear evidence for
and against the conclusions of the Board;
WHEREAS, the city Secretary has heretofore served notice of
said hearing upon said owner(s), by registered mail, return receipt
requested, which return receipt indicates that said owner(s)
received said notice on "Notice Returned", a date more than ten
(10) days before the date set for said hearing;

WHEREAS, at said date, time, and place, City Council met in
regular session to conduct such public hearing, at which time
evidence was presented both for and against the conclusions of the
Board of Inspection:
WHEREAS, City council, after due deliberation, and within
fifteen (15) days after the termination of the hearing, is required
to make its decision in writing and enter its order; and
WHEREAS, city council entered its order on Auaust 14, 1995 a
day which is within fifteen (15) days after the termination of the
hearing: NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
section 1. This Ordinance contains the findings and orders
of the city Council of the City of La Porte, and its conclusions"
based upon the evidence presented at said hearing.
section 2. Based on the evidence presented at said
hearing, the city Council hereby adopts the attached report of the
Board of Inspection, in full, and incorporates such by reference
herein as fully as though set out herein.
Section 3. The City council hereby finds, determines and
declares such building to be a nuisance, and orders such building
condemned.

section 4. The city Council hereby finds, determines and
declares that Terrv S. Diana, who resides at 407 San Jacinto st. -
La Porte, Tx 77571, is the record owner(s) of the property on which
this building is situated, and that as such record owner(s), the
said Terrv S. Diana has been duly and legally notified of these
proceedings.
Section 5. The city council hereby orders the said Terrv
S. Diana to entirely remove or tear down such building, and further
orders the said Terrv S. Diana to commence such removal within ten
(10) days from the effective date of this Ordinance, and to
complete such removal of demolition of -such building within a
reasonable time.
Section 6. The city Council hereby orders the Board of
Inspection of the ci ty of La Porte to cause a notice of the
dangerous, insanitary condition of the building to be affixed in
one or more conspicuous places on the exterior of the building,
which notice or notices shall not be removed or defaced by any
person, under penalty of law.
Section 7. The City council hereby orders the City
Secretary to forward a certified copy of this Ordinance, to the
record owner (s) of said property, the said Terry S. Diana, by
registered mail, return receipt requested.

premises with such assistance as it may deem necessary, and cause

the expenses of such procedure shall be charged against the said

out of the necessary duties of such member, or by reason of a
complaint of any citizen of the City or of the City Council,
that a dangerous building exists, the Board shall, wi thin
twenty-four (24) hours of the receipt of said complaint, make
a thorough inspection of said alleged dangerous building; and
WHEREAS, Section 8-118(C) provides that:
After the inspection provided for in this Section has
been made, with or without the aid of experts, the Board shall
immediately report its conclusion in writing to each of the
members of the city Council and to the city Attorney. Such
report shall state the circumstances and the condition of the
building upon which such conclusion was based. The report
shall be filed in all cases no matter what conclusion is
stated by the Board; and

WHEREAS, it has heretofore come to the attention of the
Board of Inspection that the building located on Blk. 3: Lot 4 & N.
1/2 of Lot 5: Oakhurst, which is further described as Crescent
Shores Dr. at Bay st. Harris county, Texas, has, for the reason of
neglect or misuse, been allowed to deteriorate into a condition of
decay or partial ruin or has become a fire hazard, as defined in
section 8-117 of the Code of Ordinances of the city of La Porte:
and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated June 21, 1995, finding said
building to be in fact a dangerous building:
WHEREAS, City Council received such report, and ordered notice
to the record owner(s) of said property, Karl L. Sprinqer c/o
Elizabeth Kav Marconi. Betty Marconi, whose address is 10215
Catlett - La Porte, Tx 77571, that a hearing as provided in section
5 of said Ordinance would be held at 604 West Fairmont Parkway, at
the Council Chambers, city Hall, city of La Porte, Texas, at which
time the council would hear evidence for and against the
conclusions of the Board:
WHEREAS, the City Secretary has heretofore served notice of
said hearing upon said owner(s), by registered mail, return receipt
requested, which return receipt indicates that said owner(s)
received said notice on "Notice Returned", a date more than ten
(10) days before the date set for said hearing;

regular session to conduct such public hearing, at which time

WHEREAS, City council entered its order on Auaust 14, 1995 a

County, Texas, has, for the reason of neglect or misuse, been
allowed to deteriorate into a condition of decay or partial ruin or
has become a fire hazard, as defined in section 8-117 of the Code
of Ordinances of the City of La Porte: and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated June 22, 1995, finding said
building to be in fact a dangerous building:

604 West Fairmont Parkway, at the Council Chambers, city Hall, City
of La Porte, Texas, at which time the Council would hear evidence
for and against the conclusions of the Board;
WHEREAS, the city Secretary has heretofore served notice of
said hearing upon said owner(s), by registered mail, return receipt
requested, which return receipt indicates that said owner(s)

Section 1. This Ordinance contains the findings and orders

section 4. The city Council hereby finds, determines and
declares that Clovis Furlow, who resides at 11002 N. Ave. H - La
Porte, Tx 77571-9125, is the record owner(s) of the property on
which this building is situated, and that as such record owner(s),
the said Clovis Furlow has been duly and legally notified of these
proceedings.
Section 5. The city Council hereby orders the said Clovis
Furlow to entirely remove or tear down such building, and further
orders the said Clovis Furlow to commence such removal within ten
(10) days from the effective date of this Ordinance, and to
complete such removal of demolition of .such building within a
reasonable time.
Section 6. The city Council hereby orders the Board of
Inspection of the ci ty of La Porte to' cause a notice of the
dangerous, insanitary condition of the building to be affixed in
one or more conspicuous places on the exterior of the building,
which notice or notices shall not be removed or defaced by any
person, under penalty of law.
Section 7. The City Council hereby orders the City
Secretary to forward a certified copy of this Ordinance, to the
record owner (s) of said property, the said Clovis Furlow, by
registered mail, return receipt requested.

section 8. Should the said Clovis Furlow not comply with
the orders contained in this Ordinance relating to the removal or
demolition of such building within ten (10) days after hereof, then
the Board of Inspection of the City of La Porte shall enter upon
the said premises with such assistance as it may deem necessary,
and cause the said building to be removed or demolished without
delay, and the expenses of such procedure shall be charged against
the said Clovis Furlow, record owner(s) of said property, and shall
thereupon become a valid and enforceable personal obligation of
said owner of such premises, and the said Board of Inspection shall
carefully compute the cost of such removal or demolition, which
cost shall be hereafter assessed against the land occupied by such
building, and made lien thereon.
section 9. The City Council officially finds, determines,
and recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the city Council
was posted at a place convenient to the public at the City Hall of
the city for the time required by law

WHEREAS, Section 8-118(c) provides that:

been made, with or without the aid of experts, the Board shall

members of the City Council and to the city Attorney. Such
report shall state the circumstances and the condition of the

WHEREAS, the City council of the City of La Porte, passed and
approved Sections 8-115 through 8-126 of the Code of Ordinances of
the city of La Porte, creating a Board of Inspection to be composed
of the Building Official or his duly authorized representative, the
Fire Chief or his duly authorized representative, and the Fire
Marshal or his duly authorized representative: and
WHEREAS, Section 8-118(aa) of said Sections provide that:
Whenever it shall come to the attention of the Board
of Inspection or any member thereof, by reason of the carrying
out of the necessary duties of such member, or by reason of a
complaint of any citizen of the city or of the City council,
that a dangerous building exists, the Board shall , within
twenty-four (24) hours of the receipt of said complaint, make
a thorough inspection of said alleged dangerous building; and
WHEREAS, Section 8-118(c) provides that:
After the inspection provided for in this Section has
been made, with or without the aid of experts, the Board shall
immediately report its conclusion in writing to each of the
members of the city Council and to the City Attorney. Such
report shall state the circumstances and the condition of the
building upon which such conclusion was based. The report
shall be filed in all cases no matter what conclusion is
stated by the Board; and

WHEREAS, it has heretofore come to the attention of the
Board of Inspection that the building located on Tr. 466: W. 1/2 of
E. 1/2: La Porte Outlots, which is further described as 10900 Blk.
N. H street Harris county, Texas, has, for the reason of neglect or
misuse, been allowed to deteriorate into a condition of decay or
partial ruin or has become a fire hazard, as defined in Section 8-
117 of the Code of Ordinances of the city of La Porte; and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated June 22, 1995, finding said
building to be in fact a dangerous building:
WHEREAS, city council received such report, and ordered notice
to the record owner(s) of said property, c. Wade Baker and Debbie
Baker, whose address is 11001 N. H st. - La Porte, Tx 77571, that
a hearing as provided in section 5 of said Ordinance would be held
at 604 West Fairmont Parkway, at the Council Chambers, city Hall,
city of La Porte, Texas, at which time the council would hear
evidence for and against the conclusions of the Board:
WHEREAS, the city secretary has heretofore served notice of
said hearing upon said owner(s), by registered mail, return receipt
requested, which return receipt indicates that said owner (s)
received said notice on "Notice Returned", a date more than ten
(10) days before the date set for said hearing:

WHEREAS, at said date, time, and place, City council met in
regular session to conduct such public hearing, at which time
evidence was presented both for and against the conclusions of the
Board of Inspection:
WHEREAS, city council, after due deliberation, and within
fifteen (15) days after the termination of the hearing, is required
to make its decision in writing and enter its order: and
WHEREAS, city council entered its order on Auaust 14, 1995 a
day which is within fifteen (15) days after the termination of the
hearing: NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
section 1. This Ordinance contains the findings and orders
of the City Council of the city of La Porte, and its conclusions"
based upon the evidence presented at said hearing.
section 2. Based on the evidence presented at said
hearing, the city council hereby adopts the attached report of the
Board of Inspection, in full, and incorporates such by reference
herein as fully as though set out herein.
section 3. The city council hereby finds, determines and
declares such building to be a nuisance, and orders such building
condemned.

section 4. The city council hereby finds, determines and
declares that c. Wade Baker and Debbie Baker, who resides at 11001
N. H st. - La Porte, Tx 77571, is the record owner(s) of the
property on which this building is situated, and that as such
record owner(s), the said c. Wade Baker and Debbie Baker has been
duly and legally notified of these proceedings.
Section 5. The City council hereby orders the said c. Wade
Baker and Debbie Baker to entirely remove or tear down such
building, and further orders the said c. Wade Baker and Debbie
Baker to commence such removal within ten (10) days from the
effective date of this Ordinance, and to complete such removal of
demolition of such building within a reasonable time.
Section 6. The City Council hereby orders the Board of
Inspection of the ci ty of La Porte to cause a notice of the
dangerous, insanitary condition of the building to be affixed in
one or more conspicuous places on the exterior of the building,
which notice or notices shall not be removed or defaced by any
person, under penalty of law.
Section 7. The city council hereby orders the city
Secretary to forward a certified copy of this Ordinance, to the
record owner(s) of said property, the said c. Wade Baker and Debbie
Baker, by registered mail, return receipt requested.

section 8. Should the said c. Wade Baker and Debbie Baker
not comply with the orders contained in this Ordinance relating to
the removal or demolition of such building within ten (10) days
after hereof, then the Board of Inspection of the city of La Porte
shall enter upon the said premises with such assistance as it may
deem necessary, and cause the said building to be removed or
demolished without delay, and the expenses of such procedure shall
be charged against the said c. Wade Baker and Debbie Baker, record
owner(s) of said property, and shall thereupon become a valid and
enforceable personal obligation of said owner of such premises, and
the said Board of Inspection shall carefully compute the cost of
such removal or demolition, which cost shall be hereafter assessed
against the land occupied by such building, and made lien thereon.
section 9. The city council officially finds, determines,
and recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City council
was posted at a place convenient to the public at the City Hall of
the city for the time required by law
preceding this meeting, as required by the Open Meetings Law,

WHEREAS, the City Council of the city of La Porte, passed and
approved Sections 8-115 through 8-126 of the Code of Ordinances of
the city of La Porte, creating a Board of Inspection to be composed
of the Building Official or his duly authorized representative, the
Fire Chief or his duly authorized representative, and the Fire
Marshal or his .duly authorized representative: and
WHEREAS, Section 8-118(aa) of said Sections provide that:
Whenever it shall come to the attention of the Board
of Inspection or any member thereof, by reason of the carrying
out of the necessary duties of such member, or by reason of a
complaint of any citizen of the City or of the city council,
that a dangerous building exists, the Board shall, within
twenty-four (24) hours of the receipt of said complaint, make
a thorough inspection of said alleged dangerous building; and
WHEREAS, Section 8-118(c) provides that:
After the inspection provided for in this Section has
been made, with or without the aid of experts, the Board shall
immediately report its conclusion in writing to each of the
members of the city Council and to the City Attorney. Such
report shall state the circumstances and the condition of the
building upon which such conclusion was based. The report
shall be filed in all cases no matter what conclusion is
stated by the Board: and

WHEREAS, it has heretofore come to the attention of the
Board of Inspection that the building located on S. 1/2 Lot 421:
Tr. 421: La Porte Outlots, which is further described as 1803 Lomax
School Rd. Harris County, Texas, has, for the reason of neglect or
misuse, been allowed to deteriorate into a condition of decay or
partial ruin or has become a fire hazard, as defined in section 8-
117 of the Code of Ordinances of the City of La Porte; and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated June 22, 1995, finding said
building to be in fact a dangerous building;
WHEREAS, City Council received such report, and ordered notice
to the record owner(s) of said property, Mrs. Clione J. Pullen,
lone Juanita Allwriqht SUllivan, whose address is 706 Garden Walk -
La Porte, Tx 77571, that a hearing as provided in section 5 of
said Ordinance would be held at 604 West Fairmont Parkway, at the
Council Chambers, city Hall, city of La Porte, Texas, at which time
the Council would hear evidence for and against the conclusions of
the Board;
WHEREAS, the City Secretary has heretofore served notice of
said hearing upon said owner(s), by registered mail, return receipt
requested, which return receipt indicates that said owner(s)
received said notice on August 03, 1995, a date more than ten (10)
days before the date set for said hearing:

WHEREAS, at said date, time, and place, city Council met in
regular session to conduct such public hearing, at which time
evidence was presented both for and against the conclusions of the
Board of Inspection:
WHEREAS, city council, after due deliberation, and within
fifteen (15) days after the termination of the hearing, is required
to make its decision in writing and enter its order: and
WHEREAS, City council entered its order on AUQUst 14, 1995 a
day which is within fifteen (15) days after the termination of the
hearing; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
section 1. This Ordinance contains the findings and orders
of the City Council of the city of La Porte, and its conclusions"
based upon the evidence presented at said hearing.
section 2. Based on the evidence presented at said
hearing, the City Council hereby adopts the attached report of the
Board of Inspection, in full, and incorporates such by reference
herein as fully as though set out herein.
section 3. The City Council hereby finds, determines and
declares such building to be a nuisance, and orders such building
condemned.

section 4. The City Council hereby finds, determines and
declares that Mrs. Clione J. Pullen, lone Juanita Allwriqht
Sullivan, who resides at 706 Garden Walk - La Porte, Tx 77571, is
the record owner (s) of the property on which this building is
situated, and that as such record owner(s), the said Mrs. Clione J.
Pullen, lone Juanita Allwriqht Sullivan has been duly and legally
notified of these proceedings.
Section 5. The city Council hereby orders the said Mrs.
Clione J. Pullen, lone Juanita Allwriqht Sullivan to entirely
remove or tear down such building, and further orders the said Mrs.
Clione J. Pullen, lone Juanita Allwriqht Sullivan to commence such
removal within ten (10) days from the -effective date of this
Ordinance, and to complete such removal of demolition of such
building within a reasonable time.
Section 6. The city Council hereby orders the Board of
Inspection of the City of La Porte to cause a notice of the
dangerous, insanitary condition of the building to be affixed in
one or more conspicuous places on the exterior of the building,
which notice or notices shall not be removed or defaced by any
person, under penalty of law.
Section 7. The city council hereby orders the City
secretary to forward a certified copy of this Ordinance, to the
record owner(s) of said property, the said Mrs. Clione J. Pullen,
lone Juanita Allwright Sullivan, by registered mail, return receipt
requested.

Section 8. Should the said Mrs. Clione J. Pullen, lone
Juanita Allwriqht Sullivan not comply with the orders contained in
this Ordinance relating to the removal or demolition of such
building within ten (10) days after hereof, then the Board of
Inspection of the City of La Porte shall enter upon the said
premises with such assistance as it may deem necessary, and cause
the said building to be removed or demolished without delay, and
the expenses of such procedure shall be charged against the said
Mrs. Clione J. Pullen, lone Juanita Allwriqht Sullivan, record
owner(s) of said property, and shall thereupon become a valid and
enforceable personal obligation of said owner of such premises, and
the said Board of Inspection shall carefully compute the cost of
such removal or demolition, which cost shall be hereafter assessed
against the land occupied by such building, and made lien thereon.
section 9. The city council officially finds, determines,
and recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall of
the City for the time required by law
preceding this meeting, as required by the Open Meetings Law,
Article 6252-17, Texas Revised civil Statutes Annotated; and that
this meeting has been open to the public as required by law at all

Council further ratifies, approves and confirms such written notice

Street Harris county, Texas, has, for the reason of neglect or
misuse, been allowed to deteriorate into a condition of decay or
partial ruin or has become a fire hazard, as defined in section 8-
117 of the Code of Ordinances of the city of La Porte; and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated June 23. 1995, finding said
building to be in fact a dangerous building:
WHEREAS, city council received such report, and ordered notice
to the record owner(s) of said property, Charlie Martin and Marv
Martin, whose address is 1424 Waseca st. - Houston. Tx 77055-4412,
that a hearing as provided in section 5 of said Ordinance would be
held at 604 West Fairmont Parkway, at the council Chambers, city
Hall, city of La Porte, Texas, at which time the Council would hear
evidence for and against the conclusions of the Board:
WHEREAS, the city Secretary has heretofore served notice of
said hearing upon said owner(s), by registered mail, return receipt
requested, which return receipt indicates that said owner(s)
received said notice on Auaust 03. 1995, a date more than ten (10)
days before the date set for said hearing;

WHEREAS, at said date, time, and place, city council met in
regular session to conduct such public hearing, at which time
evidence was presented both for and against the conclusions of the
Board of Inspection;
WHEREAS, City Council, after due deliberation, and within
fifteen (15) days after the termination of the hearing, is required
to make its decision in writing and enter its order; and
WHEREAS, city council entered its order on Auaust 14. 1995 a
day which is within fifteen (15) days after the termination of the
hearing; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
section 1. This Ordinance contains the findings and orders
of the city Council of the city of La Porte, and its conclusions"
based upon the evidence presented at said hearing.
Section 2. Based on the evidence presented at said
hearing, the city council hereby adopts the attached report of the
Board of Inspection, in full, and incorporates such by reference
herein as fully as though set out herein.
section 3. The city council hereby finds, determines and
declares such building to be a nuisance, and orders such building
condemned.

section 4. The city council hereby finds, determines and
declares that Charlie Martin and Marv Martin, who resides at 1424
Waseca st. - Houston. Tx 77055-4412, is the record owner(s) of the
property on which this building is situated, and that as such
record owner(s), the said Charlie Martin and Marv Martin has been
duly and legally notified of these proceedings.
Section 5. The city council hereby orders the said Charlie
Martin and Marv Martin to entirely remove or tear down such
building, and further orders the said Charlie Martin and Marv
Martin to commence such removal within ten (10) days from the
effective date of this Ordinance, and to complete such removal of
demolition of such building within a reasonable time.
Section 6. The city council hereby orders the Board of
Inspection of the ci ty of La Porte to cause a notice of the
dangerous, insanitary condition of the building to be affixed in
one or more conspicuous places on the exterior of the building,
which notice or notices shall not be removed or defaced by any
person, under penalty of law.
Section 7. The city council hereby orders the city
Secretary to forward a certified copy of this Ordinance, to the
record owner(s) of said property, the said Charlie Martin and Mary
Martin, by registered mail, return receipt requested.

section 8. Should the said Charlie Martin and Marv Martin
not comply with the orders contained in this Ordinance relating to
the removal or demolition of such building within ten (10) days
after hereof, then the Board of Inspection of the City of La Porte
shall enter upon the said premises with such assistance as it may
deem necessary, and cause the said building to be removed or
demolished without delay, and the expenses of such procedure shall
be charged against the said Charlie Martin and Marv Martin, record
owner(s) of said property, and shall thereupon become a valid and
enforceable personal obligation of said owner of such premises, and
the said Board of Inspection shall carefully compute the cost of
such removal or demolition, which cost shall be hereafter assessed
against the land occupied by such building, and made lien thereon.
section 9. . The city Council officially finds, determines,
and recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the city Council
was posted at a place convenient to the public at the city Hall of
the city for the time required by law

that a dangerous building exists, the Board shall, wi thin
twenty-four (24) hours of the receipt of said complaint, make
a thorough inspection of said alleged dangerous building; and
WHEREAS, section 8-118(C) provides that:
After the inspection provided for in this section has
been made, with or without the aid of experts, the Board shall
immediately report its conclusion in writing to each of the
members of the city Council and to the City Attorney. Such
report shall state the circumstances and the condition of the

SUMMARY & RECOMMENDATION
The city of La Porte has operated the transmission system for the La Porte
Area Water Authority under contract since the completion of the system in
1991. In the past, the term of the agreement was for one (1) year with an
option for an additional one (1) year at an annual contract price of
$40,000.00. Staff feels the agreed upon contract price is sufficient for
the City of La Porte to recoup its costs of operating the system and is
advantageous to the Authority.
The La Porte Area Water Authority Board, on August 1, 1995, approved the
Operator's Agreement for a term of three (3) years. Staff recommends
approval of the Operator's Agreement with a term of three (3) years and an
option of an additional three (3) year period at an annual contract price
of $40,000.00. This agreement would become effective on October 1, 1995.

AN ORDINANCE APPROVING AND AUTHORIZING AN OPERATOR' S AGREEMENT
BETWEEN THE CITY OF LA PORTE AND THE LA PORTE AREA WATER AUTHORITY;
MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The city Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The Mayor is hereby authorized to execute such document
and all related documents on behalf of the City of La Porte. The
City Secretary is hereby authorized to attest to all such
signatures and to affix the seal of the City to all such documents.
Section 2.
The City Council officially finds, determines,
recites, and declares that a sufficient written notice, of the date,
hour, place and subject of this meeting of the city Council was
posted at a place convenient to the public at the city Hall of the
city for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon.
The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

OPERATOR'S AGREEMENT
This agreement, entered into this 14th day of August , 192...-, by and
between the La Porte Area Water Authority, acting by and through its duly
authorized officers (hereinafter sometimes referred to as "OWNER") and the
city of La porte, Texas, acting by and through its duly authorized officers
(hereinafter sometimes referred to as "OPERATOR").
For and in consideration of the mutual undertakings herein contained,
Authority and city agree as follows:
I.
OPERATOR agrees to operate, maintain, repair, and manage OWNER'S property for
a term of three (3) years commencing October 1, 1995 with an option to renew
this agreement for an additional period of three (3) years, subject to the
agreement of both parties. This agreement is subject to termination at any
time without cause by either party giving ninety (90) day written notice to
the other.
II.
operation shall consist of furnishing labor and administrative support
services to provide efficient operation, maintenance, and management of
OWNER'S transmission system, shown on record construction drawings on file at
the La Porte city Hall, and to provide clerical and administrative su~port
for the billing, accounting, and other support needed for efficient operation
of OWNER'S transmission system, which includes, but not limited to 't.he
following:
1. Provide operating personnel at all times who hold valid water works
licenses issued by the Texas Water Commission.
2. Provide operating personnel on-call twenty-four (24) hours per ,iay,
seven (7) days per week with a twenty-four (24) hour telephone
dispatching service and vehicles equipped with two-way radios.
3. Provide clerical and administrative support for billing,
accounting, supervisory, and other support as needed for the
efficient operation of OWNER'S transmission system.
4. Daily check, at all customer takepoints, (including weekends and
holidays):
a. All control systems;
b. Take meter readings; and
c. Check all electrical operations.
5. Collect, on a monthly basis, all necessary water samples as
required by local, state, and federal regulations.
6. Run complete chemical analysis of water supply.

7. Prepare, submit, and furnish copy to OWNER all required reports to
local, state, and federal agencies having regulatory powers over
OWNER'S transmission system.
8. Furnish monthly operational, fiscal, and budgetary reports to
OWNER.
9. Prepare operation line-item budget estimate for OWNER'S approval
prior to the termination of this Agreement.
10. Perform preventive maintenance as required by
manufacturers' operating manuals, provided by OWNER.

11. Maintain required records of water system operations.
12. Report to OWNER system improvements and/or major repairs needed.
13. Prepare, mail, and collect monthly bills for water consumed by all
customers, in accordance with the Accounting Policy Statement
attached hereto as Exhibit "A".
14. Process invoices for materials, supplies, and services necessary to
operate the water supply system.
15. Provide necessary office space in its facilities for a master
control center needed for the control, historical recording, and
reporting of the water transmission system.
III.
OPERATOR shall receive compensation for services enumerated in Section II
above in the amount of $ 3,333.33 per month, payable on or before the
15th day of each month that this Agreement remains in effect.
IV.
OPERATOR will procure, to OWNER'S account, supplies, materials, equipment,
and services, utilizing funds allocated in OWNER'S approved budget, attached
hereto as Exhibit "B", for the routine operation of OWNER'S transmission
system. OPERATOR shall conform to all applicable purchasing laws of the
State of Texas in the procurement of all supplies and materials necessary for
the operation of the transmission system.
V.
Repairs, adjustments, and operation of the system outside of the scope of
services outlined in Section II of this Agreement will be billed to OWNER on
an actual cost basis. Whenever possible, OPERATOR will obtain advance
approval from OWNER prior to beginning non-routine work; however, OPERATOR is
authorized to proceed, unless specifically directed otherwise, in those cases
deemed necessary by the OPERATOR.

VI.
OPERATOR will exercise good judgement in the replacement of equipment under
this Agreement. OWNER will not hold OPERATOR responsible for guarantees or
warranties for such equipment. The OPERATOR will make responsible efforts to
secure normal guarantees to OWNER.
VII.
OPERATOR is retained by OWNER only for the purpose and to the extent set
forth in this Agreement, and his relation to OWNER, during the period of this
Agreement, is that of an independent entity, and he shall be free to dispose
of such portion of his entire time not required to satisfy the terms of this
Agreement in any manner he deems advisable. OPERATOR shall not be considered
an employee of OWNER.
VIII.
OPERATOR agrees that all customers of OWNER will receive equal treatment
under the terms of this Agreement.
IX.
OPERATOR shall be required to operate within the current guidelines of its
governing body and shall notify OWNER of any possible conflicts with such
guidelines, as soon as practicable after the occurrence of said possible
conflicts.
X.
OPERATOR hereby assumes entire responsibility and liability for any and all
damage or injury of any kind or nature whatever (including death resulting
therefrom) to all persons, whether employees of OPERATOR or otherwise, and to
all property caused by, resulting from, arising out of, or occurring in
connection with the maintenance and operation of OWNER'S transmission system
provided for in this Agreement and if any person shall make a claim for any
damage or injury (inclUding death resulting therefrom) as hereinabove
described, whether such claim may be based upon the OWNER'S alleged active or
passive negligence or participation in the wrong or upon any alleged breach
of any statutory duty or obligation on the part of the OWNER, the OPERATOR
agrees to indemnify and save harmless the OWNER, its agents, servants, and
employees from and against any and all loss, expense, damage, or injury that
the OWNER may sustain as a result of any such claims and the OPERATOR agrees
to assume, on behalf of the OWNER, the defense of any action at law or in
equity, which may be brought against the OWNER upon such claim and to pay on
behalf of the OWNER, upon its demand, the amount of any judgement that may be
entered against the OWNER in any such action.

XI.
Before commencing the work, the OPERATOR shall procure and maintain liability
insurance, at its own expense, and procure and maintain workers' compensation
and employee liability insurance in accordance with the laws of the state of
Texas. The OPERATOR agrees that nothing contained in this paragraph shall
limit or release the OPERATOR from its obligations otherwise provided for in
this Agreement, including assumption of liabilities and indemnifications to
the OWNER.
If the OPERATOR fails to procure and maintain at least the above insurance,
the OWNER shall have the right to procure and maintain the said insurance for
and in the name of the OPERATOR, and the OPERATOR shall pay the cost thereof
and shall furnish all necessary information to make effective and maintain
such insurance.
XII.
The OPERATOR for the Contract Price herein provided for, hereby agrees to pay
and shall hold the OWNER harmless against the paYment of all contributions,
taxes, or premiums which may be payable under Federal, state, or Local laws
arising out of the performance of the work.
XIII.
If either the OPERATOR or OWNER believes it has a claim of any nature
whatsoever against the other party, it shall give the other written notice of
the amount, whenever possible, and nature of such claim within forty-five
(45) days (or such other time limits as may be expressly set forth in the
Agreement) of the occurrence of the event upon which such claim is based. In
default of such notice the claim is waived.

XIV.
All matters relating to the validity, performance, interpretation, or
construction of this Agreement or the breach thereof shall be governed by the
laws of the state of Texas.
IN WITNESS WHEREOF, the parties to these presents have hereunto set
their hands and seals the day and year first above written.

SUMMARY & RECOMMENDATION
Advertised, sealed bids #0653 for the annual supply of cement stabilized
sand were opened and read on July 24, 1995. Bid requests were mailed to
thirteen (13) vendors with five (5) returning bids.
Low bid meeting specifications was submitted by Stabilized Products, the
current supplier, at a cost of $10.00 per ton picked up by city forces and
$13.00 per ton delivered to the job site. This represents a five percent
(5%) increase over last year's bid.
Using estimated yearly quantities, the price for cement stabilized sand
picked up by city forces would be $9,000.00 and for sand delivered to the
job site would be $9,750.00 for a total cost of $18,750.00.
Staff recommends award of the annual supply of cement stabilized sand to
Stabilized Products, low bidder meeting specifications. Funds are
available in the 94/95 Operating Budget of the Streets Division and are
requested in the 95/96 Operating Budget.
Action Required by Council: Award bid for the annual supply of Cement
Stabilized Sand to Stabilized Products, low bidder meeting specifications,
for a total annual cost of $18,750.00.

SUMMARY & RECOMMENDATIO~
Advertised, sealed bids #0652 for the annual supply of street materials
were opened and read on August 7, 1995. Bid requests were mailed to eight
(8) vendors with five (5) returning bids.
Only one bid for Section 1 - Cut Back Asphalt by Gulf States, our current
supplier, was submitted at a price of ninety cents ($0.90) per pound. This
represents an increase of 3% over last year's bid. Overall low bid meeting
specifications for Section 2 - Liquid Asphalt Cement was submitted by Gulf
States. Using estimated yearly quantities, cost of Section 1 is $4,500.00
and Section 2 is $25,610.00 for a total cost of $30,110.00. This represents
an average increase of 25.75% over the bids for each item last year.
Low bid meeting specifications for Section 3 - Joint & Crack Sealer was
submitted by both Shepler's and Crafco Texas at a price of twenty-nine
cents ($0.29) per pound. Using estimated yearly quantities, the total cost
of the contract for Section 3 would be $11,600.00. This is the same price
as last year's bid.
Staff recommends award of Sections 1 - Cut Back Asphalt and Section 2 -
Liquid Asphalt Cement to Gulf States. For the past few years, the City has
used the Crack Sealer compound supplied by Crafco Texas and have found it
to be of high quality and performance. For this reason, Staff recommends
award of the annual contract for Section 3 - Joint & Crack Sealer to Crafco
Texas. Funds for these materials are budgeted in the 94/95 & 95/96
Operating Budget of the Streets Division.
Action Required by Council: Award bid for Sections 1 & 2 to Gulf States and
Section 3 to Crafco Texas for the annual supply of street materials.
