MINUTES OF THE PUBLIC HEARING REGULAR MEETING OF
LA PORTE CITY COUNCIL
APRIL 22, 1996
1. CALL TO ORDER
The meeting was called to order by Mayor Norman L. Malone at 6:00 P.M.
Members of City Council Present: Mayor Norman L. Malone, Councilpersons Guy Sutherland, Mike

The invocation was delivered by Dr. Bobbye Worsham pastor of the Second Baptist Church, La Porte,
Texas.

Council considered approving minutes of Regular Meeting April 8, 1996
Motion was made by Councilperson Maxwell to approve the minutes of April 8th as presented. Second
by Councilperson Thrower. The motion carried, 6 ayes, 0 nays, and one abstain.

4. PRESENTATION:
SPECIAL PRESENTATION BY MR. MARVIN TOWNSEND, EXECUTIVE DIRECTOR OF
TEXAS MUNICIPAL LEAGUE - INTERGOVERNMENTAL RISK POOL
Mr. Marvin Townsend, Executive Director of TML-IRP, presented a check to the City of La Porte for
$19,329.60. This check is the results of effective loss prevention measures instituted by the City of La
Porte and other Fund participants. Mr. Townsend also thanked Council for Mr. Herrera's participation
on the Board of Trustees of the TML Intergovernmental Risk Pool since May of 1993.

Mayor Malone opened the public hearing at 6:08 P.M. Director of Planning Guy Rankin reviewed the
summary and recommendation for the request. There was no one speaking in opposition to the request.
Mr. Larry Womack, owner of Heritage Corporation who is seeking the rezoning, spoke in favor of the
change. Mr. Rankin reported staff and the Planning & Zoning Commission are recommending the
rezoning request be approved. Mayor Malone closed the public hearing at 6:14 P.M.

Mayor Malone opened the public hearing at 6: 15 P.M. Director of Planning Guy Rankin reviewed the
summary and recommendation for Special Conditional Use Permit SCU96-OO1. There was no one speaking
in opposition to the request. Speaking in favor of the request was Mr. Lewis Cline, of Care Concepts of
East Texas, Inc., representing the developer of the 61 unit senior citizen Assisted Living Center. Mr.
Rankin stated, "Staff recommends the permit request with the following conditions:
· Any development beyond that currently presented will require a separate Special Conditional Use
Permit.
· No changes or amendments shall be made to the recorded site plan and covenants without first
obtaining authorization from the City of La Porte.
· It should be noted in the Special Conditional Use Permit and in the deed covenants that the use
of this property is limited to a 61 unit "senior citizen" assisted living center, as defined in SIC
8361, for these purposes; a senior citizen is defined as a person who is 55 years of age or older."
Mr. Rankin reported the Planning and Zoning Commission has, by a unanimous vote, recommended that
Special Conditional Use Permit Request SCU96-OO1 be approved. Mayor Malone asked if anyone in the
audience would like to speak regarding this project. Mrs. Shelia Moore asked Mr. Cline how many units
will be available, and how many of those will be double units? She also asked if the monthly fee will be
assessed according to the senior's salary. Mr. Cline stated, "There are three different types of units
available. They will vary by square footage. Some units will have kitchenettes, and some will not. We
have designed our facilities to fit the typical retired teacher income level. Entry level is about $1,200.
This is all inclusive; meals, transportation, utilities, cable T. V, housekeeping, and laundry." Councilperson
Gay asked about a couple wishing to move into the facility. Mr. Cline said, "The rooms are designed to
accommodate a couple also. The fee would be an additional $500, therefore the monthly cost would be
$1,700 for a couple." Mayor Malone closed the public hearing at 6:33 P. M.

LOCATED IN THE 200 BLOCK OF NORTH 15TH STREET

Mayor Malone opened the public hearing at 6:34. Director of Planning Guy Rankin reviewed with Council
the summary and recommendation for the Special Conditional request, SCU96-OO2. Mr. Rankin reported
the applicant has agreed to improve a portion of West Polk Street. This will be done according to City
standards. The applicant has requested that an alley be closed. Staff is reviewing the request. There are
no utilities in the alley, but staff is waiting on one franchise company, Southwestern Bell, to respond with
their permission. This is the lone issue to resolve regarding this offsite parking. There was no one
speaking against the request. Lynn Pfeiffer, owner of Pfeiffer and Son, Inc., who is seeking the permit,
spoke in favor of approval. Mr. Rankin stated, .Staff supports this request and has full approval of the
Planning and Zoning Commission, and they would ask Council for your support-. Mayor Malone closed
the public hearing at 6:40 P.M.
11. CONSIDER APPROVAL OR OTHER ACTION REGARDING SPECIAL CONDITIONAL USE

12. CONSIDER APPROVAL OR OTHER ACTION REGARDING THE ADDITION OF THREE
PERSONNEL TO THE EMS DMSION - R. T. Herrera
City Manager Robert T. Herrera reviewed the summary and recommendation for the request for three
additional paramedic personnel in the EMS Division. Mr. Herrera asked that Council appropriate
approximately $32,000 for the remainder of the current fiscal year from the General Fund contingency
account to fund this request. He stated, "This would insure that the level of service our citizens are
currently receiving is adequate, improved, and better as time goes on".
Mayor Malone read a letter, see Exhibit A, from Councilperson Porter who was unable to attend the
meeting tonight due to an out-of-state business meeting. Mr. Porter's letter stated, as member of the audit
committee, he is in support of the recommendation and would like to encourage other Councilmembers to
support the recommendation. Mr. Herrera stated, "As a result of this effort to improve our services, I
would like to have a Workshop with the City Council perhaps on May 13th to address some of the EMS
policies concerning one, Municipal Aide agreement with neighboring communities, and also issues dealing
with transportation".
Motion was made bv Councilperson Maxwell to approve the request for three additionall'ersonnel to the

13. CONSIDER AWARDING A BID FOR INSECTICIDES AND FAIRWAY FERTILIZERS TO GOLD
KIST, AND HERBICIDES, FUNGICIDES, GREENS GRADE FERTILIZER, AND OTHER
PRODUCTS TO TERRA INTERNATIONAL - A. Osmond
Golf Course Superintendent Dennis Hlavaty reviewed the recommendation for awarding the bid.
Motion was made by Council person Clarke to award the bid as presented bv Mr. Hlavaty. Second by
Council person Thrower. The motion carried, 7 ayes, and 0 nays.

14. ADMINISTRATIVE REPORTS
City Manager Robert T. Herrera reminded Council this weekend is Sylvan Beach Day. The Council is
invited to participate in the festivities. You have been asked to meet at the Fitness Center at 8:30. If you
are not planning to attend the festivities, please notify Sue Lenes or Carol Buttler. Mayor Malone
reminded Council that each had contributed $20.00 last year for candy to be distributed during the parade
and asked that this be done again this year. Councilperson Maxwell recommended Councilperson
Sutherland be in charge of this project. Councilperson Sutherland agreed to the suggestion.

15. COUNCIL ACTION
Councilpersons Sutherland, Cooper, Gay, Maxwell, and Mayor Malone brought items to Council's
attention. Mayor Malone also reminded Council about the La Porte Manager's Network breakfast and
meeting. He asked Council to contact Ms. Lenes if they are planning to attend.

SUMMARY & RECOMMENDATION
The Texas Municipal League Workers' Compensation Fund ended 1994-95 in a strong financial
position, with $148 million in assets and members' equity of more than $59 million. The Fund's
strong performance in recent years can be attributed to two major factors, the 1991 workers'
compensation reform and, reduced losses resulting from effective loss prevention measures
instituted by the Fund's members.
In response to these outstanding year end results, the TML Intergovernmental Risk Pool (IRP)
Board of Directors has announced the return of $2.7 million to members of the Workers'
Compensation Fund. The amount returned is based on the length of time each member has
participated in the Fund.
Mr. Marvin Townsend, Executive Director of TML-IRP, is here tonight to present a check to
the City of La Porte for $19,329.60 which represents 1 % of our 1995-96 workers' compensation
contribution for each consecutive year of membership up to a maximum of 10%..
The City of La Porte is fortunate to be a part of an organization that not only provides workers'
compensation, liability, and property coverage, but also provides a total risk management service
which includes safety audits and training.

SUMMARY & RECOMMENDATION
Summary
The Planning & Zoning Commission, at its April 11, 1996, meeting, considered and
recommended approval of Rezoning Request #R96-002. This request seeks to rezone
a 4.049 acre tract out of the W.B. Root/William M. Jones Survey from Manufactured
Housing (MH) to General Commercial (GC). The tract in question is part of the Pecan
Plantation Mobile Home Park located at 8902 Spencer Highway.
The April 11, Commission hearing constituted the first phase of the Rezoning review
and approval process. The final phase will be the April 22, Public Hearing conducted
by City Council. After closing the hearing, Council will consider approval of the
rezoning request.
In preparation for this City Council Public Hearing, staff has satisfied all public notice
requirements, including a mailout to the owners of all properties located within 200
feet of the tract in question. A total of 5 notices were mailed. As of April 16, the
date on which this agenda request is being prepared, no replies have been received,
either in favor or against the request. If any replies are received, they will be provided
to Council at the April 22, Public Hearing.
Recommendation
The Planning and Zoning Commission, by unanimous vote, has recommended approval
of R96-002. Staff concurs with this recommendation.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
"Section 1. The City Council of the City of La Porte hereby finds, determines
and declares that heretofore, to-wit, on the 11th day of April, 1996, at 6:00 p.m. a Public
Hearing was held before the Planning and Zoning Commission of the City of La Porte,
Texas, pursuant to due notice to consider the question and the possible reclassification
of the zoning classification of the hereinafter described parcels of land. There is
attached to this Ordinance as Exhibit "A", and incorporated by reference herein and
made a part hereof for all purposes, a copy of Notice of Public Hearing which the City
Council of the City of La Porte hereby finds was properly mailed to all owners of all
properties located within two hundred feet (200') of the properties under consideration.
"Section 2. The publisher's affidavit of publication of notice of said hearing is
attached hereto as Exhibit "B", incorporated by reference herein and made a part
hereof for all purposes.
"Section 3. Subsequent to such public hearing, the Planning and Zoning
Commission of the City of La Porte met in regular session on the 11 th day of April,
1996, at 6:00 p.m., to consider the changes in classification which were the subject of
such public hearing. The City Council of the City of La Porte is in receipt of the written
recommendations of the City of La Porte Planning and Zoning Commission, by letter

"Section 4. Subsequent to receipt of the recommendation of the City of La
Porte Planning and Zoning Commission, the City Council of the City of La Porte called
a public hearing on the proposed classification changes and the recommendation of the
Planning and Zoning Commission on the 22"d day of April, 1996, at 6:00 p.m., and
pursuant to due notice, to consider the recommendation of the Planning and Zoning
Commission regarding the possible reclassification of the zoning classification of the
hereinafter described parcels of land. There is attached to this Ordinance as Exhibit
"0", incorporated by reference herein and made a part hereof for all purposes, a copy
of the notice of public hearing which the City Council of the City of La Porte hereby
finds was properly mailed to the owners of all properties located within two hundred
feet (200') of the properties under consideration.

corporate limits of the City of La Porte, is hereby changed in accordance therewith, and
the zoning classification of said parcels of land shall hereafter be "GC - General

"Section 7. The City Council of the City of La Porte hereby finds, determines,
and declares that all prerequisites of law have been satisfied and hereby determines
and declares that the amendments to the City of La Porte Zoning Map and
Classification contained in this Ordinance as amendments to City of La Porte Zoning
Ordinance No. 1501 are desirable and in furtherance of the goals and objectives stated
in the City of La Porte's comprehensive plan Ordinance No. 1501 (A), Page 3.
"Section 8. The City Council officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public at the City Hall of the city
for the time required by law preceding this meeting, as required by the Open Meetings
Law, Chapter 551, Texas Government Code; and that this meeting has been open to
the public as required by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted upon. The City
Council further ratifies, approves and confirms such written notice and the contents and
posting thereof.

NOTICE OF PUBLIC HEARING
In accordance with the provisions of Ordinance 1501, the City
of La Porte zoning Ordinance, notice is hereby given that the La
Porte Planning and Zoning commission will conduct a public hearing
at 6:00 P.M. on the 11th day of April, 1996, in the Council
Chambers of the City Hall, 604 West Fairmont Parkway, La Porte,
Texas. The purpose of this hearing is to consider request R96-002
which has been requested for Tract 12 A, a 4.0490 acre tract out of
the W. B. Root and W. M. J ones Surveys, Abstract A -482 . The
property in question is more particularly described as being
located at 8902 Spencer Highway. The request, which has been
submitted by Heritage corporation, the property owner, seeks to
have the property in question rezoned from Manufactured Housing
(M.H.) to General Commercial (C.C)
A regular meeting of the Planning and Zoning commission will
follow the public hearing for the purpose of acting upon the public
hearing items and to conduct other matters pertaining to the
Planning and Zoning commission.

is convened.

RootlWilliam M. Jones Survey. The tract in question is part of the Pecan Plantation Mobile

Requested Zone Change: From Manufactured Hou';;ing (MH) to General Commercial (GC)
Background:
The tract in question is part of the Pecan Plantation Mobile Horne Park. It
is specifically the paved & fenced area that previously had served as a
manufactured housing sales lot for the Mobile Horne Park. The present MH
zoning designation has been in place since March 1989, when are-zoning
requested by the former owner was granted. Prior to the 1989 rezoning, the
tract was zoned General Commercial or (GC). This was the designation
established by the 1987 comprehensive rezoning of the City. The rezoning
sought by the current property owners would restore the previous General
Commercial designation.
In acting upon a rezoning Request, the Planning and Zoning Commission
and in turn, City Council, are charged to consider the following factors:
. Was the current zoning designation reasonable?
. Was any error made in the assignment of the current zoning?
. Is the requested designation compatible with the intent and
goals of the City's Comprehensive Plan?
It is the burden of the applicant to demonstrate whether any of these criteria
have been satisfied.

The applicant seeks to open a business that would sell new and used manufactured
housing from the proposed tract. The previous owner of the property requested the
MH designation in 1989 to expand Pecan Plantation, a mobile homes park. The
expansion of the mobile home park never occurred, and the Park was sold. The
new owners request that the property be changed to GC, which was the previous
zoning classification of the property.
This request is somewhat unusual in that it seeks to restore the zoning designation
that was assigned to the subject tract at the time of the 1987 comprehensive
rezoning. As is illustrated on Exhibit A, the tract in question is located between two
General Commercial Tracts.
The request creates and would maintain a General Commercial Corridor in
accordance with the Citys Comprehensive Plan.
The area in which the subject tract is located is one that, based on the criteria
established by the City's Comprehensive Plan, is suitable for either the present MH,
or the requested GC zoning.
The Zoning change would not have a significant impact on traffic conditions in the
area. Moreover, utilities would not significantly be affected.
The request for a rezoning of the above mentioned property would change
the property from MH to GC. The GC designation would allow for a
contiguous GC zone along this portion of Spencer highway. If the applicants
are able to demonstrate that the requested zoning, the commission should
grant the rezoning request. The change would not be contrary to the goals
and intent of the Comprehensive Plan.

Summary
The Planning & Zoning Commission, at its March 21, 1996, meeting, considered and
recommended approval of Special Conditional Use (SCU) Permit Request #SCU96-
001. The permit is requested for the construction of a 61 unit senior citizen assisted
living center to be located in the 8700-8800 block of Fairmont Parkway.
The March 21, Commission hearing constituted the first phase of the SCU review and
approval process. Several citizen comments in opposition were received. During the
Hearing, the SCU Permit process and conditions were explained which included
requirements for the Intra-District PUD process, which limits type, size and use. After
staff's and the developer's report, many concerns were addressed and the Planning
and Zoning Commission recommended a favorable consideration.
The final phase will be the April 22, Public Hearing conducted by City Council. After
closing the hearing, Council will consider approval of the SCU Permit.
In preparation for this City Council Public Hearing, staff has satisfied all public notice
requirements, including a mailout to the owners of all properties located within 200
feet of the tract in question. A total of 52 notices were mailed. As of April 16, the
date on which this agenda request is being prepared, no replies have been received,
either in favor or against the request. If any replies are received, they will be provided
to Council at the April 22, Public Hearing.
Recommendation
The Planning and Zoning Commission, by unanimous vote, has recommended approval
of SCU96-001, subject to the specified conditions including requirements for an Intra-
Staff concurs with this

Requested for:
A 5.637 acre tract of property out of the W.M. Jones Survey, Abstract 482, which is
further described as being located in the 8700-8800 Block of Fairmont Parkway. (See
Exhibit A)
Requested by:

Purpose of Request:
To allow construction of a 61 unit senior citizen Assisted Living Center.
Backap-ound:
The Planning and Zoning Commission, at its February 15, 1996, meeting, conducted a
public hearing for the purpose of taking citizen comment regarding Special Conditional
Use Permit Request #SCU96-OOl. After taking comments and questions, the
Commission suspended the hearing with the intention of re-opening it at the March 21,
1996, meeting.
The request is now being brought back to the Commission in a somewhat amended form.
It is now being presented as an intra-district P.U.D. As such, it still requires a Special
Conditional Use Permit. The need for rezoning, however, is eliminated. The facility
itself is still proposed to contain 61 units housed in a single, one story building.
Analysis:
An intra-district P.U.D. is simply a P.U.D. development located in a district zoned
something other than P. U . D. When considering an intra-district P. U . D., adherence to
performance standards is one of the primary concerns.
Using this request as an example, the proposed facility has an assigned SIC use code of
8361. This use code is listed as conditional in R-3 zones and not permitted in R-2 zones.
The tract in question is zoned R-2. As an intra-district P.U.D., the issue is not whether
the use is allowed in an R-2 zone, but rather, will the specific facility being proposed
conform with performance standards applicable within R-2 zones.
In addition to performance standards there are a number of development standards that
are specified by the Zoning Ordinance. These standards are applicable to all P. U.D.
developments. Discussion of these issues follows:

The Zoning Ordinance specifies that a Minor Development Site Plan be submitted
in conjunction with a P.U.D. request. In the case of this project, the Minor
Development Site Plan should be prepared in a form that is proper for filing and
recordation with the Harris County Department of Deed Records. This has not
been done as of yet~ The applicant has, however, provided a detailed
architectural site plan that provides a substantial portion of the information
required for review of the application.
While final approval of the P. U. D. should be withheld until the site plan is
submitted, reviewed and approved, the site plan currently in the City's possession
is adequate for determining overall compliance with ordinance guidelines. A
summary of the site plan/submittal packet follows. Ordinance requirements are
shown in bold face type.
. The entire outline, overall dimensions and area of the tract described
in the application.
This information is properly noted and satisfies ordinance parameters.
. The use, zoning and ownership of all adjacent properties within one
hundred feet (100') of the tract boundaries including the location of
all structures thereon and the right-oC-way widths of all adjacent
public roadways.

intervals not greater than 1 foot (1').

. The location, general exterior dimensions and approximate gross floor
areas of all proposed buildings, or where appropriate, examples of
housing units to be built on lots.
This information is shown on the building construction plans submitted by
the applicant and satisfies applicable ordinance and Building Code
requirements .
. The type of each use proposed to occupy each building and the
approximate amount of building floor are devoted to each separate
use, if appropriate.

. The proposed location, arrangement and number of automobile

parking stalls, or appropriate examples for each housing type.
The applicant's site plan indicates 65 parking spaces. The Zoning
Ordinance requires (based on 61 units), fifteen tenant spaces, plus one per
staff member. Staff member parking would be based on maximum
employees working on a single shift and not total employees.
. The proposed location, arrangement and general dimensions of all
truck loading facilities, if appropriate.
Loading bay location and configuration are acceptable.
. The location and dimensions of all vehicular entrances, exits and
driveways and their relationship to all existing or proposed district or
development examples for each housing type.
Driveway access to the P.U.D. will be from Fairmont Parkway.
Driveway, locations, dimensions, and configurations are adequate.
. The location and dimensions of all walls, fences, and plantings
designed to screen the proposed district or development from adjacent
uses.
More information is needed regarding these issues. They will be
discussed in greater detail in subsequent sections of this report.
. The general drainage system.
This information has not yet been provided.
. Standards for exterior signs, architectural style, landscape concepts,
and other variables which will be controlled in the design of buildings
in the development area.

. Proposed exterior architectural elevations illustrating the basic design
elements and material appearances.
This information has been provided as part of the project's building
construction plans submittal.
Construction Schedule
. The applicant shall submit a proposed schedule of construction. If the
construction of the proposed Planned Unit Development is to be in
stages, then the components contained in each stage must be clearly

delineated. In addition, the Developer or Subdivider must submit a
General Plan in accordance with the requirements of the City of La
Porte Development Ordinance. Said General Plan shall be submitted
prior to the submission of a Development Site Plan or Preliminary
Plat, as the case may be. The development schedule shall indicate the
approximate starting date and the approximate completion date of the
complete Development Plan.
This information has not yet been provided.
Minimum Proiect Size
. The tract of land for which a Planned Unit Development-General
Residential project is proposed and permit requested shall contain not
less than five (5) acres of land.
The tract in question consists of 5.637 acres.
Required Frontage
. The tract of land for which a project is proposed and permit
requested shall not have less than two hundred feet (200') of frontage
on a public right-of-way.
The tract in question has 254 feet of frontage along Fairmont Parkway.
Yards
. The front, rear and side yard restrictions at the periphery of the
Planned Unit Development site, at a minimum, shall be the same as
imposed in the respective districts.
The setbacks proposed for the facility are approximately 67 feet to the
front, approximately 616 feet to the rear, 64 feet to the east side, and 10
feet to the west side.
These setbacks satisfy R-2 requirements (30 feet front, 20 feet rear, 10
feet side). There is, however, an additional setback provision that will be
discussed in the next paragraph.
. No building shall be nearer than its building height to the rear or side
property line when such line abuts an "R-l" or "R-2" use direct.
Based on a review of the building construction plans that have been
submitted to the city, it appears the proposed building will be twelve feet
in height. This is when measured as specified by Zoning Ordinance
Section 3-100 (page 11). This will require that the setback adjacent to the

P. U . D's western boundary line be increased by two feet from ten to
twelve feet.
. No buildi!1g shall be located less than fifteen feet (15') from the back
of the curb line along those roadways which are part of the internal
street pattern.
This will be discussed in a subsequent section of this report. It may be
necessary to dedicate a private street within the facility. If this. is done,
it will be necessary to increase the separation between the eastern face of
the building and the driveway that would become a private road.
Landscaping and Screening
. The entire site other than that taken up be structures or landscaping
shall be surfaced with a material to control dust and drainage.
All open areas of the property that are not landscaped or paved will be
grassed. Grass provides adequate dust control.
. A drainage system subject to the approval of the Director of Planning
shall be installed.
A Minor Development Site Plan must be submitted for this project.
Drainage plans will be specified on the site plan.
. Developments abutting an "R-l", "R-2", "R-3" or MH district shall be
screened and landscaped in compliance with required screening and
landscaping for the specific use involved as required in Sections 6 &
7, Table B.
The northern and western faces of the property in question abut the
Brookglen Subdivision. The eastern face abuts undeveloped R-2 property.
These property faces will require landscape screening. The screening
plants must be evergreen and of a type and size that they can be
reasonably expected to form an effective visual screen within two years
of planting. The final planting plan, which must receive approval from
the Director of Planning, will be considered a component of the overall
landscape plan.
Property Controls
. In order that the purpose of this section may be achieved, the
property shall be in single ownership or under the management and
supervision of a central authority or otherwise subject to such
supervisory lease or ownership control as may be necessary to carry
out the provisions of this Ordinance.

. Prior to the use or occupancy or sale or the execution of contracts for
sale of an individual building unit, parcel, tract, townhouse,
apartment, or common area, a declaration of covenants, conditions
and restrictions or an equivalent documents shall be fIled with the
City of La Porte; said filing with the City to be made prior to the
filing of said declaration or documents or plans with the recording
officers of Harris County.
. Prior to recording in Harris County Deed Records, approval of the
City of La Porte shall be secured as to the documents described in
paragraph (b) above.
. The declaration of covenants, conditions or restrictions or equivalent
document shall specify that deeds, leases or documents of conveyance
affecting buildings, units, parcels, tracts, townhouses, or apartments
shall subject said properties to the terms of said declaration.
Although this facility is, for the present, to consist of a single building
under single ownership, staff recommends that the property be bound by
covenants, prepared and filed in accordance with the provisions of the
preceding paragraphs. Specific terms of the covenants should include the
following:
. Tenancy shall be restricted to persons aged 55, or older.
. Clear responsibility for maintenance of landscaping, screening,
fencing, and undeveloped portions of the property.
. Clear responsibility for maintenance of all stormwater drainage
systems located on site including swales, channels, and detention
facilities.
. Clear responsibility for maintenance of private roads located with
the P.D.D.
. A clear statement specifying and limiting the future use of
undeveloped portions of the property.
. Architectural standards (buildings and signage).
. The funding mechanism to be used to provide for maintenance
items specified by covenants.
. A clear statement specifying the parties responsible for
administration and enforcement of covenants.
These covenants should be submitted for review and comment by the City

Attorney's office. They should not be released for recordation until such time as
the City Attorney deems them to be satisfactory in terms of form and content.
No building permit for the project should be approved or released until the
approved covenants have been filed for rec~rdation with Harris County Deed
Records.
Public Services
The proposed project shall be served by the City water and sewer system and
fIre hydrants shall be installed at such locations as necessary to provide fll"e
protection. Proposed utility connections shall be subject to approval by the
Director of Phmning.
As has been noted, prior to final approval of the project, a Minor Development
Site Plan must be prepared and submitted to the City for review and approval.
Specific utility connection points will be evaluated as part of the site plan review.
For the purposes of this report, however, staff would note the following:
. Sanitary sewer, in adequate capacity to serve the facility, is available from
the adjacent Brookglen Subdivision. As proposed, sewer demand from the
facility will not impact the ability to provide service to future R-2
development in the area.
. Potable water is not readily available, but can be extended to serve the
site. Although they can be handled under the umbrella of a single
request, what in essence will be two separate extensions will be required.
The first will make water available by extending water along the Fairmont
Parkway property face. The second extension will be for the purpose of
providing internal fire protection to the facility. This extension must run
north from Fairmont Parkway and will ultimately have one or more fire
hydrants installed on it. The line and hydrants must be located within a
dedicated utility easement. The easement should extend through the full
depth of the tract. This is for the purpose of providing access for future
water and fire protection to adjacent undeveloped property located both
within and outside the boundaries of the subject tract.
Roadways
Private roadways within the project shall have an improved surface to twenty
four feet (24') or more in width and shall be so designed as to permit the City
fll"e trucks to provide protection to each building. No portion of this
required twenty four foot (24') road system may be used in calculating
required off-street parking space or be used for parking.
As presently designed, there are no private roads within the facility's perimeters.
The northern portion of the tract is to remain undeveloped at this time. Future
access must, however, be provided for as part of the facility's initial design

process. As presently drawn, the facility site plan indicates a twenty foot wide
driveway that is to be located along the eastern face of the building. It appears
that this drive is intended to provide access to the rear of the facility as well as
the undeveloped portion of the site. Under the circumstances, staff would
recommend the following:
. The driveway be treated as a private access road; and
. As such, it be widened to 24 feet in order to provide access for
emergency vehicles.
Performance or "density intensity" standards in effect within R-2 zones are
established by Ordinance Section 5-700.
Based on the 61 units proposed for the facility and the 5.637 acres available,
overall density will be 10.8 units per acre. This is very close to the 10 unit per
acre limit established for quadreplex townhomes, one of the highest density
permitted R-2 uses. Future units constructed on the undeveloped portion of the
site would of course significantly impact overall density and would, therefore,
require careful review and consideration. Future development should also hold
to R-2 Density parameters.
Staff would recommend as a condition of the SCU approval, that any site
development beyond that which is presently proposed, require a new SCU permit.
Conclusion:
The application for SCU96-OO1 substantially complies with ordinance requirements.
However, due to outstanding items, it would be premature to recommend City Council
approval. Staff will be willing to recommend approval (with certain conditions) once the
following items have been addressed.
. A Minor Development Site Plan has been reviewed and approved by the
City.
. Side building setbacks have been adjusted as necessary.
. Internal access to the northern portion of the tract is adequately provided
for by provision of a private street (minimum width, 24 feet).
. Adequate provisions are made for fire protection and potable water service
to the interior portions of the tract.
. P. U . D. covenants are submitted for City review and approval.
. Adequate landscape/screening plans are developed.

The conditions to be attached to approval would be as follows:
. Any development beyond that currently presented will require a separate
Special Conditional Use Permit.
. No changes, or amendments shall be made to the recorded site plan and
covenants without first obtaining authorization from the City of La Porte.

SUMMARY & RECOMMENDATION
Summary
The Planning & Zoning Commission, at its April 11, 1996, meeting, considered and
recommended approval of Special Conditional Use (SCU) Permit Request #SCU96-
002. The permit is requested for the construction of an off-site parking lot to be
located in the 200 block of North 15th Street.
The April 11, Commission hearing constituted the first phase of the SCU review and
approval process. The final phase will be the April 22, Public Hearing conducted by
City Council. After closing the hearing, Council will consider approval of the SCU
Permit.
In preparation for this City Council Public Hearing, staff has satisfied all public notice
requirements, including a mailout to the owners of all properties located within 200
feet of the tract in question. A total of 10 notices were mailed. As of April 16, the
date on which this agenda request is being prepared, no replies have been received,
either in favor or against the request. If any replies are received, they will be provided
to Council at the April 22, Public Hearing.
Recommendation
The Planning and Zoning Commission, by unanimous vote, has recommended approval
of SCU96-002, subject to the specified condition. Staff concurs with this
recommendation.

Failure to begin construction within one (1) year after issuance or as scheduled under the terms
of a special conditional use permit shall void the permit as approved, except upon an extension
of time granted after application to the Planning and Zoning Commission.
If construction is terminated after the completion of any stage and there is ample evidence that
further development is not contemplated the ordinance establishing such special conditional use
permit may be rescinded by the City Council, upon it's own motion or upon the recommendation
of the Planning and Zoning Commission of the City of La Porte, and the previous zoning of the
entire tract shall be in full effect on the portion which is undeveloped.

Dear Mayor Malone:
The La Porte Planning and Zoning Commission, during its April 11, 1996, meeting, held a
public hearing to consider Special Conditional Use Permit Request #SCU96-002. This permit
has been requested by Lindsay Pfeiffer for Lots 11-22, Block 687; Town of La Porte. The
purpose of the permit is to allow construction of an off-site parking lot.
A condition that staff recommended for this permit is that the permit for construction of the
parking lot be withheld until the applicant has received approval from the City Council for the
closure of the alley in Block 687.
The Planning and Zoning Commission has, by a unanimous vote, recommended that Special
Conditional Use Permit Request #SCU96-002 be approved.

Purpose of Request:
Applicants are seeking a Special Conditional Use (SCU) Permit for
the purpose of allowing construction of an off-site parking lot. This
type of development is classified as a Conditional Use by Section 6-
400 of Zoning Ordinance 1501.
Background:
The purpose of this hearing is to consider Special Conditional Use
Permit Request SCU96-002 which has been requested for lots 11-
22 and the adjacent alley of Block 687, Town of La Porte, which is
further described as being located in the 100 Block of North 16th
Street. The permit, which is being requested by pfeiffer and Son,
Inc., the property owner, seeks approval to construct an "off-site"
parking lot which is to serve the company's office and shop facility
located at 116 North 16th Street. Off-site parking within General
Commercial Zones is described as a Conditional Use by Section 6-
400 of Zoning Ordinance 1501.
Analvsis:
Zoning Ordinance Section 10-200 establishes the following review
criteria and conditions for approval of Special Conditional Use
Permits:
· That the specific use will be compatible with and not
injurious to the use and enjoyment of other property,
nor significantly diminish or impair property values
within the immediate vicinity.
· That the conditions placed on such use, as specified
in each district, have been met by the applicant.

· That the applicant has agreed to meet any additional
conditions imposed, based on specific site constraints
necessary to protect the public interest and welfare
of the community.
Regarding the first of these conditions, compatibility with
neighboring properties, staff would note that the tract in question is
surrounded on all sides by General Commercial zoning. This
property and the applicants' existing business are located in an area
with very little off-street parking in the area. Additional off-street
parking would improve this condition. Moreover, there is no
reasonable location on the existing business site to provide
additional parking.
The second criteria to be considered is compliance with conditions
and regulations of the zoning district in which the development is to
be located
As proposed, the parking lot complies with all applicable zoning
regulations. Parking spaces and maneuvering aisles are of adequate
dimension. The location of the handicap parking spaces should be
appropriate when the proposed building is constructed Landscape
area will exceed the City's 6% minimum requirement. The
Landscaping plan will be submitted to the Director of Planning for
final approval.
This parking lot will serve an existing business that wishes to
expand in the near future. It will benefit the area by moving cars
off the street into proper and adequate parking areas.
Staff recommends approval of the SCUP, subject to City Council
approval of the street alley closing of Block 687.

In an effort to improve the level of service in our EMS operation, we are
requesting the addition of three new EMS personnel. 'Currently, we have two
fully staffed ambulances available at all times. The times in which both
ambulances are in service grows each year. I challenged staff to find a
method to improve our service coverage without having to absorb the full
financial impact of adding a third shift, which involves the addition of a new
ambulance and six full time employees. Staff reviewed the situation and
presented a viable solution to this concern and I am at this time proposing it
to the Council.
The proposal is to hire three new paramedics. These paramedics will be entry
level staff and will ride the ambulances. By placing these three employees on
the vehicle, it will free up our three most senior shift personnel to act as
shift coordinators. The shift coordinator will work out of the EMS Suburban
vehicle (the EMS Chief currently drives this vehicle but he will began to
drive the EMS car, which is a full emergency vehicle). Three primary
advantages of this set up are:
a. The Shift Supervisor, operating from the suburban. can go to the
majority of calls, thereby providing a third set of experienced hands
to control the emergency situation more efficiently.
b. The suburban is equipped with all the equipment necessary to start
and continue advanced trauma and cardiac life support.
c. In those instances when both ambulances are on a call and a mutual
aid is placed for a third call that comes in, the Shift Supervisor
would normally be available to take control of the scene and assure
the patient receives the appropriate level of care.
We are requesting we add these individuals at this time. The estimated
financial impact of the addition of these three personnel is $32,000 for the
remainder of the current fiscal year. Funding will come from the budgeted
contingency account in the General Fund.
This request has been reviewed with the Audit Committee and received their
full support.
ACTION REQUIRED BY COUNCIL:
Approve or deny the addition of three personnel to the EMS Division at a cost
of $32,000 for the remainder of the 1995-96 fiscal year with funding to be
taken from the Budgeted Contingency Account in the General Fund.
