MINUTES OF THE REGULAR MEETING
OF LA PORTE CITY COUNCIL
FEBRUARY 24, 1997
Prior to calling the meeting Mayor Malone asked Shane Whitmore and Councilman Guy
Sutherland to come forward. Mayor Malone stated "Shane is working on his merit badge in
Citizenship in the Community and is a Boy Scout with Troop 514 and Den Chief for Cub
Scout Troop 520". Councilman Sutherland presented Shane with the City of La Porte
Lapel Pin.
1. CALL TO ORDER
The meeting was called to order by Mayor Malone at 6:00 p.m.

3. CONSIDER APPROVING MINUTES OF REGULAR MEETING FEBRUARY 10, 1997
Motion was made by Council person Maxwell to approve the minutes of February 10. 1997. as
presented. Seconded by Council person Clarke. The motion carried, 7 ayes and 0 nays.

A. RETIREE RECOGNITION - JOHN PROMISE
Mayor Malone read a dossier of Mr. Promise's employment with the City. City Manager
Robert T. Herrera and Director of Public Works Steve Gillett presented Mr. Promise with
watch from the City of La Porte and congratulated him on his decision to retire. Mr. Promise
thanked the Mayor, Steve Gillette and the City of La Porte employees for a wonderful 14 years
of employment.
B. EMPLOYEE OF THE QUARTER - OCTOBER, NOVEMBER, DECEMBER 1996
Mayor Malone recognized Jon Klingen, Sr. Parks Maintenance Worker, as the "Employee of
the Quarter" for the months of October, November, and December 1996, and read Mr.
Klingen's dossier. The Director of Parks and Recreation Stephen Barr presented Mr. Klingen
with a plaque. Mr. Klingen thanked the City for the plaque and stated, "It has been a pleasure
to work for the City of La Porte" .
5. PROCLAMATIONS:
A. AMERICAN RED CROSS MONTH - META WALTERS AND RHONDA GUINN
Mayor Malone proclaimed the month of March as the American Red Cross month and
presented a proclamation to Meta Walters and Rbonda Guinn.
B. PUBLIC SCHOOL WEEK
Mayor Malone proclaimed the week of March 2 through 8 as Texas Public Schools Week and
presented a proclamation to Cleo Davison, Dr. Barney IIes, Mary McDermott-Jackson, Charles
Wilder, and Beth Rickert. Ms. Beth Rickert thanked the City for its support.
C. POISON PREVENTION WEEK
Mayor Malone proclaimed the week of March 16 through 22 as Poison Prevention Week. A
representative from the Poison Control Center was unavailable to accept the proclamation.
6. PETlTIONS, REMONSTRANCES, COMMUNICATIONS, AND CmZENS AND TAX
PAYERS WISlDNG TO ADDRESS COUNCIL
Spero Pomonis, 218 Bay Colony Circle, La Porte, addressed Council regarding the Board of
Adjustment meeting scheduled for Thursday February 27, 1997. Mr. Pomonis asked the City
Council to attend the scheduled meeting because he feels the zoning ordinances of the City of
La Porte have been violated.

7. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE
APPOINTING AND RECONFIRMING THE APPOINTMENT OF A MUNICIPAL
JUDGE AND ALTERNATE MUNICIPAL JUDGES OF THE CITY OF LA PORTE
MUNICIPAL COURT (Ord. 97-2163) - R. T. Herrera
City Manager Robert T. Herrera stated "In the last City Council meeting Judge J. B.
Williamson met with Mayor Malone and City Council, and as a result of that meeting, an
action item has been presented on this agenda tonight".
Municipal Court Judge J. B. Williamson addressed Council regarding Ordinance 97-2163
appointing a Municipal Judge, Alternate Municipal Judge and the City of Deer Park's Judge
Thomas G. Richey as the Visiting Judge for the City of La Porte. Judge Williamson
introduced Denise C. Mitrano to the City Council.
City Attorney read: AN ORDINANCE APPOINTING AND RECONFIRMING THE
APPOINTMENT OF A MUNICIPAL JUDGE AND ALTERNATE MUNICIPAL JUDGES
OF THE CITY OF LA PORTE MUNICIPAL COURT; PROVIDING A SEVERABILITY
CLAUSE; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Council person Maxwell to approve Ordinance 97-2163 as read by the
City Attorney. Seconded by Councilperson Clarke. The motion carried, 7 ayes and 0 nays.

City Engineer Doug Knuepper reviewed the summary and recommendation to approve
Ordinance 97-2164 to authorize the City Manager to execute an Interlocal Agreement for

Director of Public Works Steve Gillett reviewed the summary and recommendation to Award
Section I bid to Universal Die Cut and Section n to Custom Products. Also, to award a
contingency contract to Vulcan Sign for Sections I and n in the event the low bidders cannot
respond.
Motion was made by Council person McLaughlin to a.vprove the bids as presented. Seconded
by Councilperson Gay. The motion carried, 7 ayes and 0 nays.

10. ADMINISTRATIVE REPORTS
City Manager Robert T. Herrera stated "The contractor completed the demolition of buildings
at the Seabreeze Park site". He suggested that Council should go by and see the park, which
the citizens of La Porte will be enjoying in the future.

Background:
J.P. began his employment with the City of La Porte on March 22, 1982
at a Temporary Night Watchman. On October 26, 1982, he was hired as
a full time Operator I in the Public Works Department. He retired on
January 31, 1997 as a Mechanic Assistant. He served the City of La
Porte Public Works Department as a full time employee for 14 years and
10 months. We would like to commend J.P. for his loyalty to the City of
La Porte and the Public Works Department. Congratulations, J.P.I

SUMMARY & RECOMMENDATION
The FY '96-'97 Budget includes $66,000 to install three (3) utility casings. The first
phase is the SH 146/225 Interchange Project. This project includes two casings for
a water line and a sewer line crossing SH 146 at the northern limits of the SH
146/225 Interchange. These utility lines will ultimately provide water and sewer
service to approximately 40 acres within La Porte and approximately 200 acres within
our extra-territorial juriSdiction northwest of the interchange. (Both areas are currently
undeveloped and unserved.) The second phase, which will be addressed at a later
date, will include a casing project at Madison Street for an existing water line crossing
SH 146.
After some investigation, staff recommends utilizing TXDOT's highway contractor,
Williams Brothers Construction, for the installation of the two utility lines. The costs
provided by Williams Brothers are $35,630.46 and $32,132.68 for water and sewer
respectively.
The preliminary design for budgeting purposes showed both lines being 545 feet in
length. The current design requires that the water line be 640 feet and the sewer 620
feet. The additional length has created a budget deficit of $1,763.14 in addition to
the costs for the Madison Street project which will be constructed at a later date.
Additional funding for this current project would come from the Capital Improvement
Contingency Fund (Acct. No. 003-9890-700-9150), which currently has a balance of
$75,000.
Other options would be for the City to disannex the area or provide for utilities after
construction of the interchange at a cost much greater than the amount we are
currently requesting. Council may recall that in 1990 they made a policy decision to
install utility casings across SH 146/225 to provide for future utility service.
Staff recommends City Council authorize the City Manager to execute an Interlocal
Agreement for Advanced Fundi"ng with the Texas Department of Transportation in the
amount of $67,763.14 for the installation of casings and utility lines by Williams
Brothers Construction.

agreement, or other undertaking described in the title of this ordinance, in substantially
the form as shown in the document which is attached hereto and incorporated by
reference herein. The City Manager is hereby authorized to execute such document and
all related documents on behalf of the City of La Porte. The .City Secretary is hereby
authorized to attest to all such signatures and to affix the seal of the City to all such
documents. The City Council appropriates the total sum of $67,763.14 to fund said
Agreement from the Utility Capital Improvement Fund.

SUMMARY & RECOMMENDATION
Sealed Bid No. 0699, annual contract for sign materials, was opened on
February 10, 1997. Bids were sent to twenty (20) vendors, with eight (8)
returning bids. Bids were divided into two parts. section I included
reflective sheeting, sign faces, letters and numbers. section II included
Sign blanks, channel posts and hardware. These materials are used by the
Street Division to maintain signs and traffic control devices.
Low bid for section I was submitted by Universal Die cut. Low bid for
section II was submitted by Custom Products. Using estimated yearly
quantities, the total annual cost is $36,813.31. This represents less than
1% increase over the current contract.
Second low bid for section I & II was submitted by the current supplier,
Vulcan Signs. It is recommended that the City award a contingency contract
to Vulcan Signs in the event that the low bidder(s) cannot perform.
Action Required by Council: Award bid for section I to Universal Die Cut
and Section II to Custom Products. Award contingency contract to Vulcan
Sign for Section I & II.
