Prior to calling the meeting to order Mayor Malone asked that Boy Scout Leaders Bill Ballard
from Troop 514 and Joe Brown from Troop 519 to bring forth the Boy Scouts. The Boy
Scouts aze Scott Ballard and Kenneth Ballard of Troop 514, Eric Brown, J.J. Gazish, and John
Joerns of Troop 519 to meet the City Council. Mayor Malone stated that these Boy Scouts aze
working on their citizenship merit badges. Councilperson Bob McLaughlin, Mike Cooper and
Guy Sutherland presented the Boy Scouts and their Leaders with City of La Porte Lapel Pins

The meeting was called to order by Mayor Malone at 6:00 p.m.

INVOCATION BY REV. MARLiN FENN -FIRST UNITID METHODIST CHURCH
Reverend Marlin Fenn of First United Methodist Church delivered the invocation.
Councilman Sutherland stated that he visited Rev. Fenn's new Church dedication and expressed
how beautiful the Church is and urged the Council and Citizens to stop by and visit the
Church.
3. CONSIDER APPROVING MINUTES OF REGULAR MEETING MARCH 24, 1997
Motion was made by Councilperson Cooper to approve the minutes of March 24. 1997. as

4. PRESENTATIONS
A. RETIREE RECOGNITIOAN -SUE LENES
City Manager Robert T. Herrera expressed joy in having Ms. Lenes as a City Employee and
that she touched the lives all the employees she worked with. Mr. Herrera then presented Ms.
Lenes with a Watch from the City of La Porte. Mr. Herrera also presented Ms. Lenes with a
picture of Ms. Lenes and a Porcelain Angel as a gift from the Executive Staff.
Ms. Lenes graciously accepted the Picture, Watch and the Porcelain Angel and expressed how
she was going to miss working with employees of the city; however, she was looking forward
to retirement.
5. PROCLAMATION
A. SUE LENES DAY
Mayor Malone Proclaimed Mazch 31, 1997 as Sue Lenes Day in the City of La Porte and all
of the Councilmembers presented a proclamation to Ms. Lenes.
Ms. Lenes also graciously accepted her proclamation and expressed her delight to have the
friendship she has with the City Council of La Porte.
B. 911 WEEK
Mayor Malone Proclaimed the week of April 14 - 19, 1997 as 911 Telecommunicator Week in
the City of La Porte and this proclamation will be taken to the Boazd of Directors of 911.
6. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX
PAYERS WISHING TO ADDRESS COUNCIL
There were not citizens or taxpayers wishing to address Council.
7. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH
CASUAL CATERING FOR PROVISION OF FOOD, BEVERAGE, AND CONCESSION
SERVICES AT LITTLE CEDAR BAYOU WAVE POOL (Ord. 97-2170) - S. Barr
Director for Parks and Recreation Stephen Barr reviewed the summazy and recommendation to
awazd a seasonal operations bid contract with specified conditions to Casual Catering for
concession operations at the Little Cedaz Bayou Wave Pool.

Director of Planning Guy Ranking reviewed the summary and recommendation to approve
Ordinance 97-2171 to close, vacate, and abandon the alley of Block 898 in the Town of
La Porte.

Purchasing Agent Susan Kelley reviewed the summary and recommendation to authorize the
purchase of radios and pagers from HGAC in the amount of $24,127.43.
Motion was made by Councilperson McLaughlin to approve the Purchase of these items from
HGAC. Seconded by Councilperson Cooper. The motion carried, 7 ayes and 0 nays.

City Manager Robert T. Herrera reported on the Police Overtime Program,

La Porte Independent School District on April 11 and 12, 1997, and a memorial dedication to
Councilperson Robert (Bob) Thrower.

SUBJECT: Retirement of Sue Lenes
Please place Sue Lenes' retirement presentation on the City Council Agenda for
Monday, April 14,1997. I have provided you with the watch that should be
presented to her at the meeting. A summary of her tenure with the City of La
Porte is as follows:

Sue began her employment on January 16, 1978 os o Receptionist/Secretary.
On September 27, 1982, she was promoted to Secretory/PBX
Telecommunicotor. On November 2, 1987, she wos promoted to
Communications Technician. On February 17, 1992, she got to move away
from the switchboard and wos promoted to Records Management
Administrator. Finally, upon the retirement of Cherie Block, Sue wos
promoted to City Secretory on May 1, 1993 .
Sue is the owner of that glowing smile that has been with the City of Lo Porte
for the lost 19 years. She will be missed by her moray friends and colleagues
here in Lo Porte. Congrotulotions on your retirement, Sue!

SUMMARY ~ RECOMMENDATION
The City of La Porte has requested proposals for food, beverage, and concession items for the
summer season at the City of La Porte, Little Cedar Bayou Wave Pool. Request for Proposals were mailed
to eighteen area food service vendors. Proposals were opened on March 31, 1997 and one (1) proposal
response was received, from Casual Catering, a catering company located in the City of La Porte.
The Request for Proposal package asked for prospective vendors to submit two bids; (1)
percentage of gross revenues if food is not allowed to be brought into the wave pool by patrons, and (2)
percentage of gross revenues if food is allowed to be brought in to the wave pool by patrons. Casual
Catering declined to give a bid on the second option due to losses incurred last year by trying to compete
against food and beverages which were allowed to be brought in. They are interested in providing services
only if they are sole providers of food and beverage service at the wave pool during the swim season.
If their proposal is accepted, Casual Catering proposes to furnish for sale a variety of food,
snacks, and beverages for customers at the Wave Pool during public swim sessions (arrangements for
food and beverage service for private rentals of the Wave Pool may be made either through Casual
Catering, other caterers, or companies may bring their own food and beverages). The Concessionaire
will provide uniformed staff for the concession operation. In addition to other interests, the company has
been in the catering business for approximately six (6) years, including the past two years at the wave pool
where they provided very good service and quality food. Casual Catering proposes to pay the City of La
Porte ten percent (10%) of gross sales of food, beverages, and other items sold as a part of the
concession. The proposed prices to be charged are moderate and compares to their price schedule for
last year. Staff expects this contract to generate approximately $4,000 in revenues to the City for the four-
month swim season.
Staff recommends the award of a seasonal concession operations contract, subject to the
conditions specified, at the Little Cedar Bayou Wave Pool; said contract will also provide for no food or
beverages to be brought into the pool by patrons.
Action Required by Council:
Award seasonal concession operations, subject to the specified conditions, to Casual Catering
for concession operations at the Little Cedar Bayou Wave Pool.

CONTRACT FOR PROVISION OF FOOD, BEVERAGE, AND CONCESSION
SERVICES AT LITTLE CEDAR BAYOU WAVE POOL
This Contract for provision of food, beverage, and concession Services (the "Contract") is
entered into by and between CASUAL CATERING, whose address is 616 North Shady Lane, La
Porte, Texas 77571 (hereinafter referred to as the "Concessionaire") and who agrees to provide
food, beverage, and concession services as an independent contractor, and not an agent or
employee, at the Little Cedar Bayou Wave Pool, located at 600 Little Cedar Bayou Drive, La
Porte, Texas; (hereinafter referred to as "the Pool"); and the City of La Porte (hereinafter referred
to as "the City") according to the terms set forth in this Contract.
The Concessionaire agrees to perform the following services and to accept the following
obligation during the term of the Contract:
1. GENERAL: The Concessionaire agrees to provide food, beverages, and
concessions at the Pool according to the schedule set forth in Exhibit A and
attached hereto. The services called for in this Contract shall be offered to the
public at all times that a reasonable demand for such services exists, during such
times which the Little Cedar Bayou Park Wave Pool is open to the public and
subject to the requirements set forth in the proposal. Where approval or direction
of the City is required for items, prices or procedures not specifically covered herein,
such approval or direction will be granted by the City. Special promotional price or
service changes will be allowed only following approval of the City.
2. CONCESSION EQUIPMENT FURNISHED: The Concessionaire will be responsible
for maintaining the assigned premises and equipment in good repair and the
replacement of any equipment damaged or missing through his operation. The cost
of installing any new or added equipment, when approved by the city of La Porte,
will be borne by the concessionaire and such equipment will be his property. At the
termination of the contract, the Concessionaire may remove his own equipment, but
will be responsible for leaving the premises in their original state of repair, less
normal wear and tear, or replace or reimburse the city for any damaged or missing
equipment assigned to him. This will be done to the satisfaction of the City of La
Porte, prior to releasing the Concessionaire of his sureties from obligation.
3. ITEMS FOR SALE: The Concessionaire agrees to charge to the public the retail
prices, exclusive of any sales tax, as shown on Exhibit A attached hereto,
incorporated by reference herein, and made a part hereof for all purposes.
Concessionaire shall offer no other item for sale that is not on the approved price
•
list. Initial pricing shall be in accordance with Exhibit A. The Concessionaire may
add, delete or make price adjustments from time to time, provided each item and
price change is approved, in writing, by the City prior to its offering. Chewing gum
and tobacco products shall NOT be sold. All drinks must be served in plastic or
paper cups.
4. FOOD PROVISION EXCLUSIVE: Food, ice or other items which are to be cooked,
prepared or bagged for sale or use at any facility, cannot be used at any facility
other than City of La Porte owned facilities.
5. PRODUCT QUALITY AND BRAND: Quality of all products is to be of prime
consideration in the operation of this concession contract. Food, once heated, shall
not be reheated at a later time and offered for sale to the public. A system shall be
employed in order to maintain properly sealed products and ensure product
freshness at the time it is served.
6. JANITORIAL SERVICE AND CLEANING: Concessionaire must pass Health
Department Inspections. Equally binding upon the Concessionaire are inspections
conducted by the Parks and Recreation representative or other representative of
the City of La Porte, of the facilities as deemed necessary or desirable. The
concession area must be cleaned by the Concessionaire at the close of each day
in order to prevent the accumulation and spoilage of food residue. The concession
area must be thoroughly cleaned and sanitized within 24 hours of operation when
not in continuous use. Any and all tables used by concessionaire for any reason
must also cleaned after each use. The Concessionaire and his employees are
responsible for pick up of litter generated by his operation at the Pool.
7. UNIFORMS: All employees of the Concessionaire shall be neatly attired in clean,
matching uniforms, as approved by the Director of Parks and Recreation of the City
of La Porte, identifying the Concessionaire. Hawkers shall prominently and
professionally display the prices of the products being sold. Each employee shall
be properly identified with name and/or numbered badge.
8. SIGNS: The number, size, and working location of advertising signs, except for
identifications signs within the concession areas, must be approved by the Director
of Parks and Recreation of the City of La Porte.
9. PAYMENT: Concessionaire shall remit to the City a percentage of the gross receipts
generated by its operations at the Pool, exclusive of sales tax. The percentage of
gross receipts that is to be paid to the City under this contract shall be ten percent
(10%) of gross receipts. The Concessionaire shall remit commissions due the City
no later than ten (10) days following the last day of the month for which sales have
been made along with reports of gross sales. Any payment postmarked after the

specified date will incur a late charge of 10°~ of the balance due. After payment is
one month late, balance due will increase by 1 °~ each month until paid in full. If, at
any time, payments are 90 or more days in arrears, the city will seek payment under
the provisions of the contract bond.
10. ACCOUNTING: The Concessionaire shall maintain accounting records in a manner
acceptable to the Director of Finance, of the City. These records shall include, but
are not limited to, separate records of all sales and purchases made by and for the
concession operation. The City reserves the right to make periodic audits of the
accounts and inspections of the Concessionaire 's operations.
11. CONCESSIONAIRE 'S LOCATIONS: The City will furnish to the Concessionaire
the sole and exclusive right to the use of concession area and storage space
designated in the Wave pool during the term of the concession granted. The
Concessionaire shall have all rights of necessary ingress and egress to these
storage spaces and sales stands.
12. RIGHT OF ENTRY: The City, its officers, agents and representatives shall be
permitted to enter the said premises at all reasonable times of the day to examine
the same or to make such repairs therein as shall be deemed requisite by the City.
Entry keys will be provided by the City.
13. DELIVERIES: Deliveries of all supplies, goods, wares, merchandise and equipment
shall be made at the service entrance of the Pool and a person under hire by the
Concessionaire will be on hand during deliveries to receive materials.
14. VENDING MACHINES: Placement and location of vending machines shall be made
with prior approval of the Director of Parks and Recreation, or his designated
representative.
15. CONCESSION EQUIPMENT: The Concessionaire shall submit a complete list of
equipment he proposes to furnish for the concession operation, stating brand
names, model numbers, quantity, year of manufacture and other identifying data to
properly outline his proposed operation layout. The City representative shall
approve, in writing, any placement of equipment at the Pool prior to its installation.
16. INSTALLATION OF EQUIPMENT: The Concessionaire shall have completed
installation of all his equipment and be completely operational no later than May 26,
1997.
17. CONCESSION EMPLOYEES: Concessionaire's employees at the Wave pool shall
have working knowledge of preparing and serving food to the public. The City of
La Porte shall have access to references and verification of certification of all
•
prospective concession employees. A concession manager, employed by
Concessionaire shall be provided in a local office during normal business hours to
serve clients and potential clients of the Wave pool. All employees shall conduct
themselves professionally both in appearance and actions to the satisfaction of the
Director of Parks and Recreation Department, or his designated representative.
18. SMOKING/ALCOHOL PERMITS: Smoking is not permitted at the Pool at any time
by City Ordinance. Notwithstanding any other part of this agreement, alcohol is
permitted at the Pool by permit only. Alcohol permits will be governed by applicable
state law and prevailing City Ordinances. Alcohol sales and consumption will be
confined to the Pool area during special functions or rentals only, and may not be
carried out of the Pool area. Under no circumstances is alcohol to be served as a
part of the normal service provision of this contract. The Director of Parks &
Recreation, or his designee, shall determine the level of security required during
events where alcohol is served at the Pool.
19. The Concessionaire shall be the sole provider of food and beverage service for the
Pool during the time that the pool is open to the public. Patrons will not be allowed
to bring in their own picnics, food and beverages during public swim times. Lessees
for pool rentals, after public swim hours, may make arrangements with the
Concessionaire for food and beverage service; or may make -other arrangements
for food service; but in so doing, may not use facilities assigned to the
Concessionaire.
The City agrees to perform the following services and to accept the following obligations
during the term of the Contract:
1. FACILITY FURNISHED: City of La Porte shall furnish a concession area/room with
water and electrical connections and making all equipment connections in
accordance with all building and health codes, laws, statues and ordinances.
2. UTILITIES: The City of La Porte will pay normal utility bills in connection with
concession operation, excluding telephone service.
3. CLEANING: The City will provide the necessary janitorial supplies for the sanitary
operation of the restrooms and other materials and supplies as may be necessary for
operation of the Pool, except those materials and supplies directly related to the
Concessionaire service provision.
4. AUTHORITY OF THE FACILITY MANAGER: The City of La Porte shall decide any

and all questions which may arise as to the acceptability of services rendered and
as to the manner of performance, all questions which arise as to the interpretation
of the conditions and specifications, and all questions as to the acceptable
fulfillment of the contract. The City reserves the right to issue alcohol permits and
to allow certain groups to obtain temporary liquor or beer and wine licenses from
the Texas Alcoholic Beverage Commission, separate from the terms of this
contract.
The Concessionaire shall not assign, transfer, convey, sublet or otherwise dispose of the
contract, or any part thereof, to any person, partnership, company or corporation without prior
written consent of the City of La Porte.
IV.
The Concessionaire shall procure all permits and licenses, pay all charges and fees necessary
and incidental to the due and lawful conduct of the services. He shall keep himself fully informed
of all existing and future National, State and Local laws, ordinances and regulations that in any
manner affect the fulfillment of the contract and comply with same (City of La Porte fees shall be
waived).
The Concessionaire will be responsible for any and all additions and/or changes in
equipment design and layout necessary to comply fully with local Health and Fire
Department regulations. Additional electrical service, plumbing or drain lines shall be
approved by the City of La Porte, prior to planning and installation. Actual installation shall
be according to all applicable State laws, regulations and ordinances of City of La Porte.
Concessionaire must also provide approved filters for any and all exhaust systems that
may be utilized or installed.
V.
The Concessionaire shall provide a Business Service Bond covering every and all requirements
of the contract, in the amount of $3,000 shall be fumished concurrent with the execution of the
contract. In lieu of a bond, a negotiable Certificate of Deposit from a bank in Hams County,
Texas, or a Letter of Credit from a bank in Hams County, Texas may be fumished.
VI.
The Concessionaire agrees as its sole liability to indemnify, defend, protect, and hold harmless
the City of La Porte, its officers, employees, agents and/or assigns from liability, responsibility,
or losses arising out of any negligent act or omission or any willful wrongdoing on the part of the
Concessionaire its officers, employees, agents and/or assigns.

Vll.
The Concessionaire specifically agrees to assume sole and total liability to indemnify, defend,
protect and hold harmless the City of La Porte from liability, responsibility or losses arising from
any and all incidents, accidents, or claims that may result from Concessionaire's operations
under the terms of this contract.
The City agrees to indemnify, defend, protect, and hold harmless the Concessionaire from
liability, responsibility, or loss arising out of any negligent act or omission or any willful
wrongdoing on the part of the City or any agent or employee of the City.
VIII.
The Concessionaire shall keep and maintain during the term of this contract, a
comprehensive general liability policy, with the City named as Additional Named Insured,
with limits of liability of not less than One Million Dollars ($1,000,000) combined single limit
bodily injury and property damage per occurrence, with a minimum deductible of One
Thousand Dollars ($1,000) per occur-ence. The Concessionaire shall fumish the City with
a Certificate of Insurance evidencing such coverage. Such insurance shall include
contractual liability insuring the indemnity agreements contained in this contract.
IX.
All salaries to be paid as a result of this contract shall include workers compensation,
social security, unemployment insurance and travel. The actual salaries shall be paid at
the discretion of the Concessionaire. The Concessionaire shall furnish to the City a
certificate of insurance or other evidence showing property liability insurance coverage,
general liability coverage, and workers compensation insurance coverage for its staff for
the duration of the contract.
X.

The term of this contract will be for a period of one (1) year with an option to renew
annually for a total of two (2) additional years provided both parties agree in writing to the
extension. If at any time, in the opinion of the City of La Porte, the Concessionaire has failed
to render services of proper quality, or has failed in any other respect to perform as •specified and
intended in and by the terms of the contract, notice thereof in writing will be served; and should
the Concessionaire neglect or refuse to provide means for a satisfactory compliance with the
agreement, directed by the City, within the time specked in such notice, the City shall have the
power to suspend the operation of the contract. Upon such suspension, the Concessionaire 's
control shall terminate and thereupon the Council of the City or its duly authorized representative
may employ other parties to carry the contrail to completion in such manner as the Council may
deem proper. Any excess cost arising therefrom will be charged against the Concessionaire and
his sureties, who will be liable therefore. In the event of such suspension and cancellation, all
money due the Concessionaire or retained under terms of the contract shall be forteited to the
City, but such forfeiture will not release the Concessionaire for his sureties from liability for failure
to fulfill the contract. The Concessionaire and his sureties will be credited with the amount of
money so forteited toward any excess cost incurred, arising from the suspension of the contract
and the completion of it by the City of La Porte as provided, and the Concessionaire will be
credited with any surplus remaining after all just claims for such completion have been paid.
XI.
This instrument contains the entire agreement between the parties relating to the rights granted
in the contract and the obligations assumed as a part of the contract. Any representations or
modfications concerning this contract shall have no force or effect unless modfied in writing, and
signed by each party to the agreement.
XII.
If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause,
of this contract shall, for any reason, not be legally or factually valid, such invalidity shall not affect
the remaining portions of this contract.

The contract shall be in force from May, 1997 until September, 1997, unless extended in writing
pursuant to the terms in Section IV. IN TESTIMONY WHEREOF, this instrument has been
executed in duplicate, each to have the effect of an original as follows:
(A) It has been executed on behalf of the City on the _ day of , 1997, by its City
Manager and attested by its City Secretary, pursuant to an Ordinance of the City
Council of the City of La Porte, authorizing such execution; and
(8) It has been executed on behalf of Casual Catering on the _ day of , 1997,
by Executive Officer of Casual Catering and attested by its Secretary, authorizing
such execution.

Sectioa 1. The City Council hereby approves and authorizes

document and all related documents on behalf of the City of La

Code; and that this meeting has been open to the public as required

On November 11, 1996, City Council approved Special Conditional Use Permit #SCU96-003 for Robert Boncosky to operate a
trucking operation with tank truck cleaning in the 1700 block of South 16th Street. One of the permit conditions was that approval
of the proposed truck terminal (SIC #4231) be subject to that portion of 16th Street being approved as a truck route. The property
is located South of Fairmont Parkway and is not on a designated truck route. Currently, 16th Street, from Barbour's Cut Blvd. South
of Fairmont Parkway is a designated truck route.
Boncosky Services has submitted a General Plan for the trucking operation which will be considered at the April 17, 1997, Planning
and Zoning Commission Meeting. If Council concurs with staffs recommendation of adding a section of South 16th Street in
accordance with the approved Special Conditional Use Permit, then we would ask that it be approved with the proposed addition of
Underwood Road.

Vehicles transporting hazardous materials shall not leave the
Hazardous Cargo Route except to pick up or deliver. The vehicle shall

which is nearest the applicable place of loading or unloading and shall
return to the Hazardous Cargo Route by the most direct route.
"Sec. 25-85. Loading, unloading, repairs.
Truck traffic restricted to the streets designated as truck routes may
depart from such truck routes where it is necessary to load, unload or
seek repairs at a legitimate repair facility, at a location or locations
situated off designated truck routes. Provided, however, such truck traffic
shall not leave any designated truck route until such has reached a point
on some designated truck route which is nearest (by the most direct route
possible) the applicable place of loading, unloading, or servicing. After
leaving a designated truck route to load or unload, truck traffic may
continue off truck routes to as many points of destination as necessary.
Provided, further, however, that if, in the course of making the necessary
stops for loading and unloading, the truck traffic shall cross a designated
truck route, then, in that event, such truck shall not again leave any
designated truck route until it has reached a point on some designated
truck route which is nearest to the next place of loading and unloading by
the most direct route possible.
"Sec. 25-87. Signs, Markings.
(a) When signs are erected giving notice thereof, no person
shall operate any vehicle with a gross weight in excess of the amounts
specified on such signs at any time upon any of the streets or parts of
streets so signed. Under this section, as vehicle weight is indicated by the

(b) When signs are erected stating "No Through Truck," "No
Trucks" or designate no trucks by International Signage, no person shall
operate any commercial vehicle exceeding three thousand pounds gross

weight at any time upon any of the streets or parts of streets so signed,
except that such vehicles may be operated thereon for the purpose of
delivering or picking up materials or merchandise and then only by
entering such street at the intersection nearest the designation of the
vehicle and proceeding no farther than the nearest intersection thereafter.
"Sec. 25-89. Limitation on length of vehicles.
No motor vehicle shall exceed the limits set forth in the Texas
Transportation Code, Chapter 64, Subchapter C."
Section 3. Unless otherwise specifically amended herein, Article 5, Chapter 25
of the Code of Ordinances of the City of La Porte remains unchanged.
Section 4. If any section, sentence, phrase, clause, or any part of any section,
sentence, phrase, or clause, of this Ordinance shall, for any reason, be held invalid,
such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby
declared to be the intention of this City Council to have passed each section ,sentence,
phrase or clause, or part thereof, irrespective of the fact that any other section,
sentence, phrase or clause, or part thereof, may be declared invalid.
Section 5. Any person, as defined in Section 1.07(20), Texas Penal Code,
who shall violate any provision of the Ordinance, shall be deemed guilty of a
misdemeanor and upon conviction shall be punished by a fine not to exceed Five
Hundred Dollars ($500.00).
Section 6. The City Council officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public at the City Hall of the City
for the time required by law preceding this meeting, as required by the Open Meetings
Law, Chapter 551, Texas Government Code; and that this meeting has been open to

the public as required by law at all times during which this Ordinance and the subject
matter thereof has been discussed, considered and formally acted upon. The City
Council further ratifies, approves and confirms such written notice and the contents an
posting thereof.
Section 7. This Ordinance shall be effective fourteen (14) days after its
passage and approval. The City Secretary shall give notice of the passage of this
Ordinance by causing the caption hereof to be published in the official newspaper in the
City of La Porte at least twice within ten (10) days after the passage of this Ordinance.

SUMMARY & RECOMMENDATION
Various departments have budgeted for pagers and radios this fiscal
year. The City has historically purchased these items from the
Houston Galveston Area Council through an interlocal agreement.
The prices obtained through HGAC are lower than available from
manufacturer's distributors due to volume buying.
The total expenditure, including a 3% administrative fee would be
$24,127.43.
Departmental costs are as follows:

Subject: Availability of Police Department Fund for Selective Enforcement
I have reviewed the operating budgets of the Police Patrol and Criminal Investigation
Divisions and have concluded that there is $50,000 in available funds for the
implementation of the selective enforcement project.
The available funds are located in the Regular Earnings accounts and are available
because of lower than normal staffing levels, which is caused by the delay it takes to
replace an officer.
Attached is a budget transfer sheet that will provide the necessary adjustments to the
Police Patrol Regular Earnings and Overtime accounts and the Criminal Investigation
Regular Earnings account.
