MINUTES OF THE REGULAR MEETING
OF LA PORTE CITY COUNCIL
MAY 5, 1997
1. CALL TO ORDER
The meeting was called to order by Mayor Malone at 6:00 p.m.
Members of City Council Present: Mayor Norman Malone, Councilpersons Guy
Sutherland, Mike Cooper, Bob McLaughlin, Alton Porter, Deetis Gay, Jack Maxwell and
Jerry Clarke
Members of City Council Absent: None

2. INVOCATION
Reverend David Cochran of La Porte Worship Center delivered the invocation.
3. CONSIDER APPROVING MINUTES OF REGULAR MEETING APRIL 28, 1997
Motion was made by Council person Cooper to approve the minutes of April 28. 1997. as
~resented. Seconded by Council person Maxwell. The motion carried, 8 ayes, 0 nays.
Ayes: Councilpersons Sutherland, Cooper, McLaughlin, Porter, Gay, Maxwell, Clarke and
Mayor Malone
Nays: None
4. PRESENTATION
EMPLOYEE OF THE QUARTER - JANUARY, FEBRUARY, AND MARCH 1997
Mayor Malone read a dossier and recognized Jesus Alfaro, Equipment Operator n as the
"Employee of the Quarter" for the months of January, February and March of 1997. The
Director of Public Works Steve Gillett and Solid Waste Superintendent Phil Webb presented
Mr. Alfaro with a plaque.

5. PROCLAMATIONS
A: MARCH FOR JESUS - LINDA BARLEY
Mayor Malone proclaimed Saturday, May 17, 1997 as March for Jesus Day and presented a
proclamation to Father Rafferty, Rev. Cochran, Rev. Roscoe, Rev. Stillwell and Linda Barley.
Ms. Barley thanked Mayor Malone for the proclamation.
B. BOAT SAFI'EY MONTIl- POWER SQUADREN ELAINE PROCTOR
Mayor Malone proclaimed the Month of Mayas Safe Boating Month and presented a
proclamation to Vice President Elaine Proctor and Secretary Suzy Littlejohn. Ms. Proctor'
stressed the importance of safe boating and Ms. Littlejohn thanked the Mayor for the
proclamation.
6. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX
PAYERS WISIllNG TO ADDRESS COUNCIL
There were no citizens or taxpayers wishing to address Council.
7. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE
DECLARING THE RESULTS OF THE ELECTION HELD IN THE CITY OF LA
PORTE ON MAY 4, 1996 (Ord 96-2173) - K. Askins
City Attorney Knox Askins stated that a revised ordinance with election tally's have been
placed before them. Mr. Askins then read the ordinance:
AN ORDINANCE DECLARING THE RESULTS OF THE ELECTION HELD IN THE
CITY OF LA PORTE ON MAY 3, 1997, FOR THE ELECTION OF MAYOR;
COUNCILPERSON DISTRICT 2; AND COUNCILPERSON DISTRICT 3; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF
Motion was made by Council person Cooper to approve Ordinance 97-2173 as ready by the
City Attorney. Seconded by Council person Porter. The motion carried, 8 ayes, 0 nays.
Ayes: Councilpersons Sutherland, Cooper, McLaughlin, Porter, Gay, Maxwell, Clarke and
Mayor Malone

Mayor Malone presented Councilman Cooper with a certificate of appreciation and stated what
a pleasure it has been to work with him. City Manager Robert T. Herrera on behalf of the
City Staff stated that Mr. Cooper it has been very supportive of the Staff and thanked him.
Mr. Herrera then presented Councilman Cooper with several gifts from the City Staff.
Councilman Cooper spoke of his time on Council and thanked the Council members and the
City Staff for their friendship and that it has been a pleasure working with each of them.
9. ADMINISTERING OATH OF OFFICE FOR NEW COUNCILPERSONS - Judge D.
Mitrano
City Municipal Judge Denise Mitrano administered the oath of office to Mayor Norman L.
Malone and District 2 Council person Chuck Engelken.
Mayor Malone welcomed Councilman Engelken and thanked Judge Mitrano for administering
the oaths. Councilman Engelken thanked Mr. Cooper for his help on the election and to
especially thank the volunteers and the voters.
10. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE
APPOINTING A MEMBER OF CITY COUNCn. TO SERVE AS MAYOR PRQ-TEM
FOR THE PERIOD MAY 5,1997 TIlROUGH MAY 5,1998 (97-2174) - K. Askins
City Attorney read: AN ORDINANCE APPOINTING A MEMBER OF THE CITY
COUNCIL TO SERVE A MAYOR PRO-TEM OF THE CITY OF LA PORTE, FOR THE
PERIOD MAY 5, 1997, THROUGH MAY 5, 1998; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF.
Mayor Malone requested nominations.
Motion was made by Council person Maxwell to nominate Guy Sutherland as Mayor Pro-Tern.
Seconded by Council person Clarke.
Motion was made by Council person Sutherland to nominate Jack Maxwell as Mayor Pro-Tern.
Council person Maxwell declined the nomination.
Motion was made by Council person Gay to nominate Bob McLau~h1in as Mayor Pro-Tern.
Seconded by Council person Porter.
Mayor Malone declared nominations ceased.
Votes for McLaughlin - Gay, Porter, Sutherland, McLaughlin
Votes for Sutherland - Engelken, Maxwell, Clarke

Mayor Malone stated "I am going to vote and make it a tie vote" .
Motion was made by Councilperson Maxwell to have this item tabled till a full Council is
present. Motion died for lack of second.
Mayor Malone called for a second vote.
Votes for McLaughlin - Gay, Porter, McLaughlin
Votes for Sutherland - Engelken, Maxwell, Clarke, Sutherland
Motion was made by Council person Porter to vote in Favor of Council person Sutherland to
serve as Mayor Pro-Tern. Seconded by Council person McLaughlin.
Ayes: Councilpersons Sutherland, Engelken, McLaughlin, Porter, Gay, Maxwell, Clarke and
Mayor Malone
Nays: None
Motion was made by Mayor Malone to vote on the Main Motion to appoint Guy Sutherland as
Mayor Pro-Tem.
Ayes: Councilpersons Sutherland, Engelken, McLaughlin, Porter, Gay, Maxwell, Clarke and
Mayor Malone
Nays: None
11. ADMINISTRATIVE REPORTS
City Manager Robert T. Herrera officially congratulated Councilman Engelken on his election
"and congratulated the new Mayor Pro-Tern Councilman Sutherland. Mr. Herrera stated he
had no other report.
12. COUNCIL ACTION
Councilpersons Sutherland, Engelken, McLaughlin, Porter, Gay, Maxwell, Clarke, Mayor
Malone brought items to Council's attention.

I would like to nominate Jesus Alfaro for "Employee of The
Quarter". Jesus has been with the City for Eight Years and has
worked as a garbage truck driver since December of 1993. Jesus
has an outstanding attitude toward his job. His crew is usually the
first one of three crews finished each day. He often helps other
crews that have fallen behind schedule. He maintains his
equipment extremely well and has had the fewest breakdowns in
the Solid Waste Division. His crew always has the highest morale
and the safest work record. Jesus is well thought of in Public
Works because of his attitude and performance. This is the second
Nomination for Mr. Alfaro, and he is due serious consideration for
this recognition.

ORDINANCE NO. 97-
AN ORDINANCE APPOINTING A KEMBER OF THE CITY COUNCIL TO SERVE AS
KAYOR PRO-TEll OF THE CITY OF LA PORTE, FOR THE PERIOD KAY 5, 1997,
THROUGH KAY 5, 1998; FINDING COKPLIANCE WITH THE OPEN KEETINGS LAW;
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Sec~iOD 1. The City Council of the City of La Porte hereby
appoints to serve as Mayor Pro-Tem of the City
of La Porte, for the period May 5, 1997, through May 5, 1998, or
until his successor shall have been duly appointed and qualified.
Sec~iOD 2.
The Mayor Pro-Tem shall serve in such off ice
during said term, during the absence or incapacity of the Mayor and
shall do all things, perform all duties, and in fact have ,all the
powers and duties of the Mayor of the City of La Porte during such
absence or incapacity of the Mayor.
Sec~ioD 3. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
ci ty for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon.
The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.

its passage and approval, and it is so ordered.
