1. CALL TO ORD.ER
The meeting was called to order by Mayor Pro-Tern Sutherland at 6:00 p.m. Mayor Pro-Tern
stated that a quorum of council was present.

Mayor Pro-Tem Guy Sutherland delivered the invocation.
3. CONSIDER APPROVING MINUTES OF REGULAR MEETING APRIL 28, 1997
Motion was made by Councilperson Maxwell to approve the minutes of Aoril 28. 1997. as
presented. Seconded by Councilperson Gay. The motion carried, 7 ayes, 0 nays.

4. PROCLAMATIONS
PUBLIC WORKS WEEK - MAYOR MALONE
Mayor Pro-Tern Guy Sutherland presented the Director of Public Works Steve Gillett with a
proclamation proclaiming the week of May 18 - 24, 1997 as Public Works Week. Mr. GiBett
thanked the Council for the Proclamation.

Charles Sewell, 8415 Collingdale Rd, La Porte, addressed Council regarding the change in
billings, the pricing of a TV box for the cable from TCI Cablevision and a possible future
problem with TCI providing fiber-optics for digital service.
6. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE
AUTHORIZING A CONTRACT BETWEEN CITY OF LA PORTE AND HUBCO FOR
THE SOUTH 14TH STREET PAVING EXTENSION PROJECT (Ord 97-2175) - G.
Rankin
City Engineer Doug Kneupper reviewed the summary and recommendation to authorize the
City Manager to execute a contract with Hubco, Inc. in the amount of $135,390.25 for
construction of the street and further authorizing $2,600 for contingencies.
Motion was made by Councilperson Clarke to approve ordinance 97-2175 with the remainder
of the budf!eted funds used for continf!ency funds. Seconded by Council person Gay. The
motion carried, 7 ayes, 0 nays.

7 . CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE
AUTHORIZING AN INTERWCAL COOPERATION CONTRACT BETWEEN THE
CITY OF LA PORTE AND THE TEXAS DEPARTMENT OF PUBLIC SAFETY (Ord.
97-2176) - B. Powell
Police Chief Bobby Powell reviewed the summary and recommendation to approve an
interlocal cooperation contract between the City of La Porte and the Texas Department of
Public Safety. Chief Powell presented Municipal Court Judge J. B. Williamson to comment in
support of the contract. Municipal Court Judge J. B. Williamson detailed the need for this
contract to improve collecting monies owed on outstanding warrants in the municipal court.
City Attorney read: AN ORDINANCE APPROVING AND AUTHORIZING AN
INTERLOCAL COOPERATION CONTRACT BETWEEN THE CITY OF LA PORTE AND
THE TEXAS DEPARTMENT OF PUBLIC SAFETY, TO IMPLEMENT THE PROVISIONS
OF V.C.S. ART. 6687d, DENIAL OF RENEWAL OF LICENSE FOR FAILURE TO
APPEAR; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVING AN EFFECTIVE DATE HEREOF.
Motion was made by Council person Maxwell to approve Ordinance 97-2176 as read by the
City Attorney. Seconded by Councilperson Clarke. The motion carried, 7 ayes, 0 nays.

8. CONSIDER APPROVAL OR OTHER ACTION REGARDING AWARDING BIDS FOR
CHEMCIAL AND FERTILIZERS FOR THE GOLF COURSE - D. Hlavaty
Golf Course Superintendent Dennis Hlavaty reviewed the summary and recommendation to
award bids to Terra International and Turf Industries ,for chemical and fertilizers to be used at
the Golf Course and Parks Maintenance Department.
Motion was made by Council person Clarke to approve bids awarded as recommended by staff.
Seconded by Council person McLaughlin. The motion carried, 7 ayes , 0 nays.

9. WORKSHOP - RECODIFICATION
REVIEW AND DISCUSS PROPOSED EDITS TO PROPOSED RE-CODIFIED
MUNICIPAL CODES - J. Armstrong
Mayor Pro-Tern Guy Sutherland opened the Workshop at 6:35p.m.
Assistant City Attorney John Armstrong reviewed the proposal for re-codified municipal
ordinances and answered questions from Council. Mr. Armstrong stated this proof set will be
submitted to Municipal Code Corporation. They will typeset and place the codes in final form
and return them to the City with an ordinance, at which point and time Council will need to
pass and re-codify the ordinances of the City of La Porte.
Mayor Pro-Tem Guy Sutherland closed the Workshop and reopened the Regular Meeting at
6:43 p.m.

City Manager Robert T. Herrera reported on the meeting schedule for June, the wonderful
response at the Employee Picnic, a proposed grant for the Jennie Riley Center and the plaque
for Councilman Thrower will be mounted in front of the oak tree at the Bayforest Golf Course.

Summary &: Recommendation
As part of the FY 96-97 Budget for Capital Improvement Projects, City Council approved
$140,000 for the South 14th Street Paving Extension. This project begins at Fairmont
Parkway, is along the west side of the Kroger development, and proceeds north for about 700
feet. This is the first phase of a street network that will service the area north of Fairmont
Parkway and west of SH146. Design and engineering were performed on this project utilizing
City staff. On may 5, 1997, the City received competitive bids from six qualified paving
contractors (see attached Bid Tabulation). The low bid was submitted by Hubco, Inc. of
Houston in the amount of $135,390.25.
Staff has reviewed the bids submitted and determined the low bid from Hubco, Inc. is within
the budgeted amount and Huhco, Inc. is qualified to perform this work. Staff recommends
that the City Council authorize the City Manager to execute a contract with Hubco, Inc. in
the amount of 135,390.25 for construction of the South 14th Street Paving Extension. In
addition, it is recommended that $2~600 be set aside as contingency for a total of $137,990.25
for the project.
Action Required by Council:
Consider approving an ordinance authorizing the City Manager to execute a contract with
Hubco, Inc. in the amount of $135,390.25 for construction of the street and further
authorizing $2,600 to be set aside for contingency.

AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT
BETWEEN THE CITY OF LA PORTE AND HUBCO, INC. FOR
CONSTRUCTION OF THE SOUTH 14TH STREET PAVING 81 DRAINAGE
IMPROVEMENTS; APPROPRIATING $135,390.25 PLUS A
CONTINGENCY OF $2,600, TO FUND SAID CONTRACT; MAKING
VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW;
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA
PORTE:
Section 1. The City Council hereby approves and authorizes the
contract, agreement, or other undertaking described in the title of this
ordinance, in substantially the form as shown in the document which is
attached hereto and incorporated herein by this reference. The City
Manager is hereby authorized to execute such document and all related
documents on behalf of the City of La Porte. The City Secretary is hereby
authorized to attest to all such signatures and to affIX the seal of the City
to all such documents.
City Council appropriates the sum of
$135,390.25 plus a contingency of $2,600 from Capital Improvement
Fund 015 to fund said contract.
Section 2. The City Council officially finds, determines, recites,
and declares that a sufficient written notice of the date, hour, place and
subject of this meeting of the City Council was posted at a place
convenient to the public at the City Hall of the City for the time required
by law preceding this meeting, as required by the Open Meetings Law,
Chapter 551, Texas Government Code; and that this meeting has been

open to the public as required by law at all times during which this
ordinance and the subject matter thereof has been discussed, considered
and formally acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting thereof.

SUMMARY & RECOMMENDATION
I am reques~ing an Ordinance approving and authorizing an
interlocal cooperation contract between the City of La Porte and
The Texas Department of Public Safety, to implement the provisions
of V.C.S. ART. 6687d, denial of renewal of license for failure to
appear. The Texas Department of Public Safety will not issue a
renewal drivers license if there is an existing failure to appear
warrant out of the City of La Porte Municipal Court.
DPS has contracted with a vendor which will collect ticket data
electronically from this city. They will provide a computer system
for compiling and submitting information. DPS will receive the
data, screen it and include it in the driver license database.
In addition to ticket fines, offenders entered in the FTA system
must pay $30 for each offense. Ten dollars go to the city, which
must pay the vendor $6 for each offense when fees are collected.
The city does not pay when fines go uncollected or when offenders
serve jail time instead of paying the failure to appear cost. The
police department, municipal court and the finance department, all
concur that this is the best solution to the problem.

pursuant to Govemment Code Chapter 791. This Contract is entered into specifically to
implement V.C.S. art. 6687d. The TDPS is authorized 10 contract with a private vendor
pursuant to V.C.S. art. 6687d, ~5.

Vl1. Warning on Citation
A peace officer who is authorized to issue citations in the local political subdivision shall issue
a written warning to each person. to whom the officer issues a citation [or a traffic law violation
in the jurisdiction of the local political subdivision. This warning shall be in addition to any
otber wamings required by law. The wanting must state in subs13.nce that jf the person fails to
appear in court, as provided by law, for u1C prosecution of the ot'fense, the persOIl may lJe
denied renewal of the person's driver's license. The wrinen warning may be on the citation or
on a separate insuumcnt. Once the person cited has signed a citation, which constituh..."S a
promise to appear, the person is bound thereaffer to appe..1T and respond to the traffic citation,
VIII. FI'A Report
If the person fails to appear without good cause, the J~1 political subdivision must provide a
report to the TDPS containing the following information: the jurisdiction in which offense
occurred; the polilical subdivision submitting the rcpoI1~ the name, dare of birth, and the Texas
driver license number of the person aHeged to have ccmmitr.ed the traffic law violation; the
date of violation; a brief description of trafiic Jaw violation; a statement that the person
promised toappe<lr and failed to appear as promised; the dare the person failed to appear; and
any other information required by the TDPS. TIlere is no requiremem that a criminal warrant
be issued in response to the person's failure to appeal'. The local political subdivision must
make reasonable efforts to ensure that each FT A report is accurate, complete, and non-
duplicative.
IX. Clearance Report

Except as otherwise required by law or provided herein, the local political subdivision shall
require the person to pay an administrative fee of $30.00 for each violation for which the
person failed to appear, in. addition to any other fees required by law. The local political
subdivision must promptly file a clearance report with the TDPS upon payment of a $30.00
fee as provided by statute and one of the following conditions:
(1) the cnUy of a judgment against. the person;
(2) th~ petfection of an appeal of the case for which the warrant of arrest W3S
issued;
(3) the posting of bond or the giving of other security to reinstate the chargcs for
which the warrant was issued; or
(4) the payment of fines owed on an outstanding COUrt order to pay a fine.
x. Compliance With Law
The local political subdivision understands and agrees t11at it will comply wit1I an local, state,
and federal laws in the perfonnance of this Contract, including 3dministrative roles adoprcd by
the TDPS.
Xl. Accounting Procedw'es
The local political subdivision underst3nds and agrees to keep proper account of fund~
collected under this Contract. AD officer coJ)ccting fees due under this article shall keep
separate records of the funds collected under this article and shall deposit the funds in the
appropriate municipal treasur"j. The custodian of the municipal treasury may deposit fees
collected under this article in an il1terc.st-bea.ring acc{)unt and retain for the local' political
subdivision the interest canioo thereon. TI1C custodian shall keep accurate and complete
records of funds received and djsbursed, pursuant Lo this contract. ,All reports shall be in a

unresolved citations will follow scofflaws throughout
the state and put the brakes on their driver
license renewal.
Historically, cities and counties have
been on their own when it came to collect.

"If a person passes through Austin and commits a
Class C misdemeanor traffic violation, they're probably
not going to worry about defaulting on a payment or
failure to appear, because they live outside the im.
'Tlediate jurisdiction," explained Project Administrator
Jan Coffey. "'n many cases, they may nElVer be brought
:0 justice." .
Last year, the Legislature passed Senate Bill 1504,
:reating what is called the failure to appear (FTA) pro.
lram. As a result, motorists can be denied renewal of
heir driver licenses if they haven't paid traffic ,tickets
)r appeared in court to protest them.
DPS has contracted with a vendor which will collect
icket data electronically from cities, counties and
ourts. The company will provide computer hardware
nd software that political subdivisions will use to compile
nd submit information on delinquent tickets. DPS then will
~ceive the data, screen it and include it in the driver license
atabase.
DPS began offering contracts to political subdivisions in
eptember, and Coffey said the system may be fully opera.

Offenders will be notified by the vendor when their ticket
information is reported and will receive letters from
DPS about potential denial instead of driver license
renewal notices, If offenders don't take care of their
tickets within 60 days of license expiration or
renewal application, renewal will be denied, Cof.
fey said.
In addition to ticket fines, offenders entered in the
FTA system must pay $30 for each offense. Ten dollars
go to the political subdivisions, which must pay the
vendor $6 for each offense when fees are collected. ...,

As a result of this new law, traffic citations will in- fif
elude a warning that motorists can lose their driver
license privilege if they don't make payments on time,
Coffey said.
Based on a'1993 survey, DPS estimated that of the
more than 2.3 million outstanding traffic warrants, as
few as 25 percent were ever settled. That means un-
paid traffic tickets could translate to more than $43
million in lost revenue for the state and $70 million for
political subdivisioris.
"I believe the lost revenue that cities and counties
incur will decrease considerably, and the State of Texas will
collect on fees associated with outstanding cases that or-
dinarily wouldn't have been collected," Coffey said. "We hope
it will deter violators from signing traffic citations promising
to appear in court and then not abiding by the traffic law re-
quirements."

Technical Overview

Figure 1 illustrates the standard setup that political
subdivisions willllse to transmit their r::cords to the
OmniBasc server. The application that will be doing
the transmission, as well 35 managing the database
and re,porting: is called Remote Entry System
(RES). A poJi.ical subdivision will use a typical
comput.cr (Mac. JB,M or compatible) to upload datn
r~t:ords through a modem to the OmniBasc ser'..er.
The server will e>':Jlort all newly transmitted records
to a 3480 tape that \\oi,[) be ca.'Tied to DPS daily.
DPS will export confinnation or denial status of the
records ihat were transmitLed the 'previous d.iy.
These cnnGnnation records arc then. loaded onto the
server and download~d into the RES system ,II the
poli.ical subdivision's next transmission. .RES can
report all records denied by [he DPS so they can be
corrected and retrdnsrnitted.

Description of 'FT A Import Routines
The "loader.lbr" is em application that call run on the
sen'cr 01' on a client that has access to the file
manager on the HP server. The purpose of the
LlP1llicaticm 1S to import records from, files deposited,
on the se.l'ver via the RES system. Wildcat 5 (the
BBS software) has been cOlltigured to recognize an
Upload and Download direcL.1ry. Wildcat is
configured to place files do....nloaded via RES into
the Dowlll()n\1 director)'. TIle name of the file
downloaded 'NiB be the Political Subdivision ID
number, plu~ a two-digit number generated by RES,
and n suffix of ".lNP".
If for some reason the "loader.lbr" were to quit
operating, the only impact would be that the files
would beg; n to slack up. Once restarted, the
"Ioadcr.lbr" \....<.llIJd he able to catch up with the extrn
load.
Once imcortcd. .the files v..i 11 b~ moved to another

directory. All files transmit.t~d by RES will be
hacked up on :J'uaily schedule.
A series of checks must be made to ensure integrity
whl:J1 imp0l1ing records. The l.ol.lowing is a

Re-Codification Project
This binder contains the cumulative effect of staff's efforts to re-codify the Ordinances
of the City of La Porte. This project involved reviewing the 1987 Code and
incorporating changes or updates that have been caused by ordinances passed in the
last 9 years.

This binder is in three sections. The first section contains an introductory letter from
John Armstrong, who provided legal oversight for this project. The second section
contains a summary list of changes that were made to the proof set. The third section
contains the proof set. We have highlighted the pages with changes by making them
on blue paper.
The changes that have been made to the proof set can be placed in three distinct
categories. First, typographical errors were corrected. Second, where State law has
superseded a City Ordinance, the update caused by State law was inserted. Third,
updates were made where titles have changed, i.e. City Commission is now City
Council.
It is my desire to have a workshop on this project at the May 19, 1997 City Council
meeting.

June City Council Meeting Dates
The Run-Off Election for the City of La Porte is scheduled for Saturday, May 31, 1997. The City
Council will need to canvass the votes on the following Monday at a Special Called Regular
Meeting. Therefore, I recommend the June meeting dates as follows:
Special Called Regular Meeting - June 2, 1997
Canvass votes and regular business meeting.
Regular Meeting - June 23, 1997
Regular business meeting.
This schedule should accommodate Council, Staff and Citizens and allow Council and Staff the
ability to handle all matters of City business for the month of June.
