MINUTES OF THE REGULAR MEETING
OF LA PORTE CITY COUNCIL
JUNE 2, 1997
1. CALL TO ORDER
The meeting was called to order by Mayor Norman L. Malone at 6:00 p.m.
Members of City Council Present: Mayor Norman L. Malone, Council persons Guy
Sutherland, Chuck Engelken, Bob McLaughlin, Alton Porter, Deotis Gay, Jack Maxwell and
Jerry Clarke
Members of City Council Absent:

Reverend Stan Jordan delivered the invocation.
3. CONSIDER APPROVING MINUTES OF REGULAR MEETING MAY 19, 1997
Motion was made by Councilperson Sutherland to approve the minutes of May 19. 1997. as
presented. Seconded by Councilperson Clarke. The motion carried, 8 ayes, 0 nays.
Ayes: Council persons Sutherland, Engelken, McLaughlin, Porter, Gay, Maxwell, Clarke and
Mayor Malone
Nays: None
4. PETITIONS, REMONSTRANCES, COMMUNICA nONS, AND CmZENS AND
TAX PAYERS WISHING TO ADDRESS COUNCIL
Rand Valentin, home 3201 Bayshore Drive La Porte, office 2601 South Broadway addressed
Council regarding the impact of placing marketing Real Estate signs through out the City.
Mr. Valentin provided Council with some background information concerning the Zoning
ordinance that eliminated all signs being placed in the right of ways. Mr. Valentin stressed to
Council the negative impact this ordinance is having on the home developing industry in La
Porte and how the current home sales have decreased. Mr. Valentin is proposing that the City
amend this ordinance and allow directional home development marketing signs to be used with
the following stipulations:

Permitting.
Signs professionally made.
Have a licensed vendor place the sign out after 5:00 p.m. on Fridays and pick
up the before 8:00 a.m. on Mondays.
Signs to be placed in key areas of town during peek sales time.
Mr. Valentin thanked Council for their time concerning this matter and hoped they will give
this matter further consideration.
Joe Watkins, 111 Howald Court, La Porte addressed Council regarding a designated right-of-
way on Howald Court in Crescent Shores subdivision. Mr. Watkins brought to the Councils
attention that the property owner on the south side of the right of way on Howald Court has
built into the right of way. Mr. Watkins also provided Council with a letter and picture.
5. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE
DECLARING THE RESULTS OF THE RUNOFF ELECTION HELD ON MAY 31, 1997

City Attorney Knox Askins informed Council that the Ordinance in their packet was a blank
Ordinance and before them is the report from the Election Officials declaring the results of the
Runoff Election.
City Attorney read AN ORDINANCE DECLARING THE RESULTS OF THE RUNOFF
ELECTION HELD IN THE CITY OF LA PORTE ON MAY 31,1997, FOR THE
ELECTION OF A COUNCILPERSON DISTRICT 3; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Sutherland to approve ordinance, 97-2177 as read by the
City Attorney. Seconded by Councilperson Gay. The motion carried, 8 ayes, 0 nays.

Mayor Malone

6. ADMINISTERING OATH OF OFFICE FOR NEW COUNCILPERSON - Mayor Malone
Mayor Malone stated that Mr. Howard Ebow was out of town and that he will be sworn in on
Thursday June 5, 1997.
7. CERTIFICATE OF APPRECIATION - Mayor Malone
Mayor Malone presented Councilman Chuck Engelken a certificate of appreciation for his
valuable service during his term on the Planning and Zoning Commission. Councilman
Engelken thank Mayor Malone and the Council for this Certificate.

8. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE
AUTHORZING AN EXTENSION OF THE PRIME CABLE TELEVISION FRANCHISE
AGREEMENT (Ord. 97-2178) - K. Askins
City Attorney read AN ORDINANCE APPROVING AN AUTHORIZING AN
EXTENSION OF THE PRIME CABLE TELEVISION FRANCHISE AGREEMENT,
WHICH EXPIRES ON JUNE 30, 1997, THROUGH DECEMBER 31, 1997; MAKING
VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDNG
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF
Councilpersons Clarke, Engelken, Sutherland, and Maxwell asked questioned concerning the
Franchise Agreement and information concerning the TCI Cablevision Company.
Motion was made by Councilperson Clarke to approve ordinance 97-2178 as read by the City
Attorney. Seconded by Council person Sutherland. The motion carried, 6 ayes , 1 nays , 1
abstain.
Ayes: Councilpersons Sutherland, Engelken, McLaughlin, Gay, Clarke and Mayor Malone
Nays: Councilperson Maxwell
Abstain: Council person Porter
9. CONSIDER APPROVAL OR OTHER ACTION REGARDING AWARDING A BID FOR
PLASTIC GARBAGE BAGS - S. Gillett
Public Works Director Steve Gillett reviewed the summary and recommendation to award a bid
to Arrow Industries for the purchase of plastic garbage bags.
Motion was made by Counciloerson Porter to approve a bid be awarded to Arrow Industries.
Seconded by Councilperson Gay and McLaughlin. The motion carried, 8 ayes, 0 nays.
Ayes: Councilpersons Sutherland, Engelken, McLaughlin, Porter, Gay, Maxwell, Clarke and
Mayor Malone

10. CONSIDER APPROVAL OR OTHER ACTION REGARDING AND ORDINANCE
AUTHORIZING THE APPOINTMENT OF MEMBERS TO VARIOUS BOARDS,
COMMISSIONS, AND COMMITfEES (Ord. 97-2179) - K. Askins
Mayor stated that the Civil Service Appointments be delayed since the City Manager Mr.
Herrera is out of town. Mayor Malone presented his recommendations for the Fire Code
Review Committee. Councilman Engelken presented his recommendation for the Planning and
Zoning Commission District 2 vacancy. Councilman McLaughlin stressed his concerns about
Mr. Engelken's recommendation and would have to vote nay. Mayor presented Councilman
Ebow's recommendation for District 3. Councilperson Gay stated that he did not have a

recommendation and would like to table District 4 tonight. Mayor Malone stated that the
appointments to the La Porte Area Water Authority have already been made. Mayor then made
his recommendations for the Board of Adjustment, Airport Advisory Board and the Southeast
Texas Housing Finance Corporation Board of Directors. Councilman Porter stressed his
concern that he was not aware of some of the persons that are being recommended for these
Boards and Commissions.
Motion was made by Council person McLau~hlin to Table all of ordinance 97-2179 until the
next Council meetin\!. Seconded by Councilperson Gay. The motion carried, 6 ayes, 2 nays.

Assistant City Manager John Joerns read a letter for new Councilman Howard Ebow and
reported on all the above events to Council and that clarification and or direction from Council
concerning Mr. Valentin's comments about signs would be greatly needed if Council does have
an interest.
12. Councilman Porter called for a clarification and recount of the vote on the Motion to table
Ordinance 97-2179.
Mayor Malone direction was to go back to item # 10 and take a vote again to Table this item.

Motion was made to Mayor Malone by Councilman Porter to retire to an executive session.

Use of Developer Directional Signs under Ordinance 1501
1. History
a. At the April 29, 1993 meeting of the P and Z commission, Mr. Alan
Schubert developer of Glenn Meadows, requested an addition to the
siQ..,n ordinance to regulate and allow direction signs for real estate
development.
b. Mr. Schubert cited that 70% of most home shoppers shop for a home
on Saturday or Sunday, using directional signs to locate new
hames, far sale~_..Tbis..is..,still.. the case.
c. P and Z instructed code enforcement department to work things out
d. P and Z recommended passage of ordinance to City Council
e. During the pest four years, and most especially in the past year, La
Porte has experience sigf.1iftcant growth
f. The Houston Chronicle reported 1996 sales up 21 %
2. Problem
a. In April, builders were notified that all directional signs must be
eliminated.
b. Since that time, Pelican Bay has seen an 80% drop in traffic
c. Cervelle has reported a 75% drop in traffic
d. and Expree Homes at Pecan CrossingJis seen a 70% loss in traffic
3. Alternate methods not effective, expensive, and or require long lead times
a. Newspaper - 1/8 page ad costs $2,400 a day yet only pulled in three
customers in the past three weekends.
b. Billboards are not located in needed locations and require long lead
times to erect
4. There are ways to utilize Directional Si9..r:'Is without ugly, unwanted sign
prol iferation
a. Require permitting
b. Require sig,ns professionally, made of a standard size t5 sq. ft)
c. Require a licensed company to handle the placement and removal of
sig,ns, to ensure no litter problems
d. Limit the total number of signs, number at a given location, and or
specify specific key intersects to accommodate all but say 5 signs,
which could then be used for the final approach to the subdivision.
5. Other cities in the area are following this approach ( have attached Seabrook
requirements ).
6. What we would like you to consider:
a. City Council request P and Z Commission and I or staff to review the
ordinance for possible improvements
b. Provide some form of interim relief during this peak selling season to
allow promotion of properties while the issue is receiving the proper
full review., ,

AN ORDINANCE DECLARING THE RESULTS OF THE RUNOFF ELECTION HELD IN
THE CITY OF LA PORTE ON MAY 31, 1997, FOR THE ELECTION OF A
COUNCILPERSON DISTRICT 3; FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, there was held in the City of La Porte on the 31st
day of May, 1997, a runoff election for the purpose of electing a
Councilperson District 3; all in accordance with section 8.10 of
the Home Rule Charter of the City of La Porte; and
WHEREAS, there were cast at said election for the following
listed persons the number of votes opposite their respective names:

Gentlemen:
The franchise agreement between the City of La Porte and Prime
Cable, as previously extended, expires June 30, 1997.
Although representatives of TCl Cablevision have repeatedly
promised me to send me their comments and suggestions on a draft
franchise agreement which I submitted to Prime Cable, to date they
have not done so.
I request Council to further extend the existing franchise to
December 31, 1997. Hopefully, and with cooperation from Tel
Cablevision, this will give us time to complete negotiations and
publication of the renewal franchise agreement.

AN ORDINANCE APPROVING AND AUTHORIZING AN EXTENSION OF THE PRIME

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The city Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, in substantially the form as shown in the
docum~nt which is attached hereto and incorporated herein by this
reference. The City Manager is hereby authorized to execute such
document and all related documents on behalf of the City of La
Porte. The City Secretary is hereby authorized to attest to all
such signatures and to affix the seal of the City to all such
documents.
Section 2. The city Council officially finds, determines,

Exhibits: Bid Recap Sealed Bids #0708 - Plastic Garbage Bags
SUMMARY & RECOMMENDATION
Advertised, sealed bids #0708 for plastic garbage bags were opened and read
on May 19, 1997. Bid requests were mailed to eight (8) vendors with
three (3) returning bids and one (1) No Bid.
Low bid meeting specifications was submitted by Arrow Industries at a price
of thirty-eight cents ($0.38) per pound. With a purchase of 125,000 pounds
for the August bag handout, the total cost of the contract would be forty-
seven thousand, five hundred dollars ($47,500.00). This price represents a

recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was

City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted

Gentlemen:
I enclose draft of a proposed 1997 appointment ordinance, for
consideration by City council at its meeting of June 2, 1997. This
will be a meeting at which City council will canvass the results of
the runoff election of May 31, 1997, between John willis and Howard
Ebow.
I have therefore included District 4 on the Planning and Zoning
Commission, held by Howard Ebow, for a term expiring May 30, 1998,
and Alternate 2 on the Board of Adjustment, held by John Willis,
for a term also expiring May 30, 1998, as Council will have to fill
the vacancy created by the election of one of these two individuals
at the runoff election.
The draft ordinance includes, for your convenience, the names of
the present appointees to each of the positions. Please let me
know any changes which you may wish to make on the final version of
the ordinance.
On the civil Service Commission, the term of Robert Swanagan is
expiring. The civil Service Commissioners are appointed by the
City Manager, with ratification and confirmation by the City
Council.

Dear Mayor Malone:
This letter is to inform you that the Texas Transportation Commission approved an airport
improvement grant to the City of La Porte on April 23, 1997, in the amount of $222,222 for
improvements at the La Porte Municipal Airport. The financial assistance will be used for land
acquisition.
Federal funds have been approved for ninety (90) percent of estimated project costs. The City
of La Porte has respQnsibility for the remaining ten (10) percent. We intend to issue the grant to the
City of La Porte depending on the availability offederal funds in FY 98.
Weare pleased that the Department of Transportation will be able to participate in the
development of this needed air transportation project. We will continue to support the economic
development efforts of the City of La Porte as they relate to the improvement and development of
their aviation facilities.
