MINUTES OF THE PUBLIC HEARING AND REGULAR
MEETING OF LA PORTE CITY COUNCIL
JULY 14, 1997
1. CALL TO ORDER
The meeting was called to order by Mayor Norman L. Malone at 6:00 p.m.
Members of City Council Present: Mayor Norman L. Malone, Councilpersons
Guy Sutherland, Chuck Engelken, Howard Ebow, Bob McLaughlin, Alton
Porter, Deotis Gay, Jack Maxwell and Jerry Clarke.
Members of Council Absent: None
Members of City Executive Staff and City Employees Present: City Manager
Robert T. Herrera, City Attorney Knox Askins, Assistant City Manager John
Joerns, Assistant City Manager Jeff Litchfield, Assistant City Secretary Rhonda

Dr. Wayne Spears delivered the invocation.
3. CONSIDER APPROVING MINUTES OF SPECIAL CALLED REGULAR
MEETING JUNE 23, 1997.
Motion was made by Councilperson Maxwell to approve the minutes of June
23. 1997 as presented. Seconded by Councilperson Guy Sutherland. The
motion carried, 8 ayes, 0 nays.
Ayes: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Porter, Gay,
Maxwell, Clarke and Mayor Norman Malone.

KAREN WHEELER HALL DAY - CHEMICAL INDUSTRY
COMMUNITY SAFETY
Mayor Malone proclaimed July 14, 1997, as Karen Wheeler Hall Day. Karen
Wheeler Hall accepted the proclamation. OxyChem donated One Thousand
Dollars ($1,000) to La Porte Independent School District in the name of Karen
Wheeler Hall.
5. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND
CITIZENS AND TAX PAYERS WISHING TO ADDRESS COUNClL.
8iU Scott, 1802 Lomax School Road, La Porte, addressed Council concerning
the following issues:
His concerns that open records request for audiotape of conversation between
Mr. Scott and Assistant City Attorney John Armstrong are not being met and
dealt with properly.
His concerns regarding legal fees paid to Askins and Armstrong law firm.
He advised Council that he intends to involve the District Attorney and Texas
A ttorney General.
He advised Council of plans to get the newspaper involved.
Mr. Scott also presented an outline to Council referencing the above concerns.
Mr. Scott requested to speak an additional five (5) minutes under Section 2.12 of the
Zoning Ordinance or Ordinance 1435. Mayor Malone advised Mr. Scott that we are
not granting an additional five minutes and he would need to stop speaking when
the timer went off.
Micheal Hyde, 3834 Pecan Circle, La Porte, addressed Council concerning the
following issues:
Cliff Hyde Flying Service lease. Mr. Hyde requested Council to consider not
requiring Cliff Hyde Flying Service to move their building out of Park 77 air space
with a new 1e.ase.
6. PUBLIC HEARING - TO CONSIDER APPROVAL OF SPECIAL
CONDITIONAL USE PERM.IT (SCU) PERMIT #SCU97-001. THE
APPLILCANT'S REQUEST IS FOR AN APARTMENT COMPLEX
LOCATED IN A PLANNED UNIT DEVELOPMENT.

Mayor Malone opened the Public Hearing at 6: 17 P.M.
REVIEW BY STAFF
Director of Planning, Guy Rankin, reviewed the summary and recommendation
by the Planning and Zoning Commission regarding Special Conditional Use
Permit #SCU97-0 I.
PUBLIC INPUT
Jim Clifton, Sterling Development spoke in favor of the program.
RECOMMENDA TION FROM PLANNING AND ZONING
The Planning and Zoning Commission held a public hearing on June 19, 1997.
At this meeting, they considered and recommended approval of Special
Conditional Use (SCU) Permit Request #SCU97-001. Mr. Rankin asked that
Council approve the above referenced permit.
CLOSE PUBLIC HEARING
City Council had no questions. Mayor Malone closed the public hearing at 6:23
P.M.
7. CONSIDER APPROVAL OR OTHER ACTION REGARDING SPECIAL
CONDITIONAL USE PERMIT. (SCU97-00l) - G. Rankin
Motion was made by Councilperson Sutherland to approve SCU97-001. Second
by Councilperson Ebow. The motion carried, 9 ayes, and 0 nays.

EASEMENT IN BLOCK 143, TOWN OF LA PORTE (Res. 97-05) - J.
Joerns
Assistant City Manager, John Joerns, reviewed the summary and reason for the
request. Mr. Joerns requested Council to approve Resolution 97-05. Council
had no questions for Mr. Joerns.
City Attorney read: RESOLUTION 97-05 - A RESOLUTION
AUTHORIZING THE ACQUISITION OF A SANITARY SEWER
EASEMENT IN BLOCK 143, TOWN OF LA PORTE; FI NDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Maxwell to approve Resolution 97-05 as

ORDINANCE APPROVING AND AUTHORIZING A CONTRACT
BETWEEN THE CITY OF LA PORTE AND R.L. UTILITL.IES, INC.
FOR CONSTRUCTION OF WATER AND SEWER LINES TO FUND
SA.lD CONTRACT (Ord. 97-2185) D. - Kneupper
City Engineer, Doug Kneupper reported the summary and recommendation
regarding a contract between the City of La Porte and R. L. Utilities, Inc. in the
amount of $106,814.00 for construction of Water and Sewer Lines Along SH
146. In addition, it is recommended that $5,186 (4%) be set aside as
contingency for a total of $112,000.00 for the project. Mr. Kneupper answered
questions from Council.
City Attorney read: ORDINANCE 97-2185 - AN ORDINANCE APPROVING
AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE
AND R.L..UTILITIES, INC., FOR CONSTRUCTION OF WATER AND

Motion was made by Councilperson Clarke to approve Ordinance 97-2185 and
as read by the City Attorney. Second by Councilperson Engelken. The motion
carried, 9 ayes and 0 nays.

Maxwell, Clarke, and Mayor Malone.

10. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN
ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION
OF THE NORTH 17'1'11 STREET RIGHT-OF-WAY, AND THE ALLEYS
OF BLOCKS 679 AND 680, TOWN OF LA PORTE, HARRIS COUNTY,
TEXAS (Ord. 97-2186) - G. Rankin
Director of Planning, Guy Rankin, reviewed the summary and recommendation
regarding the request by Doug Latimer to close, vacate, and abandon the alleys
of Blocks 679 & 680 as well as the North 17th Street Right-of-Way between
Blocks 679 & 680, Town of La Porte. Mr. Rankin reported the City has no
immediate or future plans to utilize the rights-of-way in question. Mr. Rankin
recommends approval for future expansion of applicant's business. City
Council had no questions.
City Attorney read: ORDINANCE 97-2186 - AN ORDINANCE VACATING,
ABANDONING AND CLOSING A PORTION OF THE NORTH 17TH
STREET RIGHT-OF-WA Y, AND THE ALLEYS OF BLOCKS 679 AND 680,
TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
Motion was made by COllncilperson Ebow to approve Ordinance 97-2186 as
read by the City Attorney. Second by Deotis Gay. The motion carried, 9 ayes,

FOR CONSTRUCTION OF THE CITY WIDE SIDEW ALK
REPLACEMENT AND FAIRMONT PARKWAY PEDESTRIAN PLAN
APPROPRIATING $56,911.50 PLUS A CONTINGENCY OF $13,088.50
TO FUND SAID CONTRACT (Ord. 97-2187) G. Rankin
Director of Planning, Guy Rankin, reported the summary and recommendation
regarding a contract between the City of La Porte and Purtis Construction in the
amount of $56,911.50 for construction of sidewalks and further authorizing
$13,088.50 to be set aside for contingency. Mr. Rankin answered questions
from Council.

AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE
AND PUTIS CONSTRUCTION FOR CONSTRUCTION OF THE CITY

Mayor Malone recommended Council continue with the remainder of the
Agenda and go into executive session with 12 at the request of the City Manager
Robert T. Herrera.

Councilperson Sutherland pulled item B. for discussion asking Public Works Director,
Steve Gillett questions about the quality of tires and number of bidders. Steve Gillett
responded to Mr. Sutherland's questions.
Motion was made by Councilperson Clarke to approve the Consent'Agenda as
presented. Second by Councilperson McLaughlin. The motion carried 9 ayes and 0
nays.

14. ADMINISTRATIVE REPORTS
City Manager, Robert T. Herrera, reported on the upcoming'Council Retreat. He
informed Council to look at the notes on their schedule. The retreat will begin this
Friday and will end up at 12 Noon on Sunday.
Mr. Herrera also introduced and congratulated Debbie Wilmore as the new Chief
Building Official for the City of La Porte.
Lastly, Mr. Herrera reported that he has received many positive comments about the
Fourth of July Fireworks program.

EVEN HAVE A WRITTEN CONTRACT WITH THESE LEGAL
VENDORS. THE VENDORS ruST CHARGE WHAT THEY

5. THE POOR QUALITY OF OUR LEGAL SERVICES:

On the 20th of March, 1997, the Inspection Division of the City of La Porte inspected the
above referenced property and found it to be in violation of City Ordinance No. 1501 '& 1358.
Violation #1: Ord. 1501: S. 10-403 - Prohibits exterior storage in a residential zone unless the
materials and equipment are stored within a building or fully screened so as not to be visible
from adioining properties (i.e. furniture and miscellaneous items near house). Violation #2: Ord.
1358: S. 3 - Prohibits any' debris and other obiectionable matter (Le. wood. metal.
concrete. etc. ). and Violation #3: Ord. 1358: S. 5 - Prohibits stagnant water standing on the
property.
As record owner of the property, you are given notice to abate the violation within 10 days
of receipt of this notice. Failure to abate this violation within the specified time will result in
further action to insure compliance with the City Ordinance. Further action could include
issuance of a formal citation and subsequent prosecution in the Municipal Court of the City of
La Porte.
Please note that in this case we issued you a .court citation without a formal written
warning. Although we believe you were issued several verbal warnings it is our customary
practice to issue written warnings. The court citation you received will be dismissed if the
.violations above are abated p~rsuant to the terms of this abatement notice.

Cliff Hyde Flying Service Lease Issues
· Cliff Hyde Flying Service appreciates the time and effort the city of LaPorte
has put into the airport.
· Cliff Hyde Flying Service has enjoyed 40 years as a family owned and
operated business here in LaPorte and would welcome the opportunity to
continue operations here as San Jacinto College's Flight Contractor for many
more years to come.
· Cliff Hyde Flying Service has submitted a proposal to extend their lease and
remain in their current location under the new lease standards and criteria.
e The City of LaPorte has taken the position that they will only issue a new lease
for a different location due to Part 77 Rules.
· The 'rexas Department of Transportation states that the Part 77 Rules are not
mandatory for preexisting establishments.
. Due to the fact that the buildings at Cliff Hyde Flying Service existed long
before the Part 77 Rules, Cliff Hyde Flying Service feels that the Grandfather
Clause should be invoked and they should be able to sign a new lease at their
current location.
. LaPorte Airport currently has more than one business inside the Part 77 Clear
Zone and all cross the new building line. Despite this, some of these
bus~esses have renewed..their.lease.
. Cliff Hyde Flying Service is not in the current financial position to meet the
proposal made by the City of LaPorte.
. Therefore, so that Cliff Hyde Flying Service may continue to offer aviation
services to the City of LaPorte, they encourage you to allow them to renew
their lease under their current proposal.

SUMMARY & RECOMMENDATION
Summary
The Planning and Zoning Commission, at its June 19, 1997, meeting, considered and
recommended approval of Special Conditional Use (SCU) Permit Request #SCU97-
001. The permit is requested for the development of a 176 unit apartment complex
to be located on a 10.54 acre tract of land in the 1200 block of McCabe Road. The
proposed development is located within a Planned Unit Development, which requires a
Special Conditional Use Permit. City Council approval of the SCU Permit is needed to
continue with the development process within the Planned Unit Development.
In preparation for this City Council Public Hearing, staff has satisfied all public notice
requirements, including a mailout to the owner of all properties located with 200 feet
of the tract in question. A total of 3 notices were mailed. If any responses are
received, they will be provided to Council during the July 14th, Public Hearing.
Recommendation
The Planning and Zoning Commission, by unanimous vote, has recommended
approval of SCU97-001 .

Cabe Road. The project is identified as the Bayou Forest
Apartments. (See Exhibit A)
Planned Unit Development (p.U.D.) and Neighborhood
Commercial (NC)
Applicants are seeking a Special Conditional Use Permit
(SCUP) for the purpose of developing an apartment
complex within a Planned Unit Development (p.u.n.)
zone. This SCUP is required by Section 8-400 of the City
Zoning Ordinance 1501.
The purpose of this hearing is to consider Special
Conditional Use Permit Request #SCU97-001. This
request is being processed simultaneously with the Bayou
Forest Apartments General Plan as required by the City's
zoning ordinance.
Zoning Ordinance Section 10-200 establishes the following
review criteria and conditions for approval of Special
Conditional Use Permits:
. That the specific use will be compatible with and not
injurious to the use and enjoyment of other property,
nor significantly diminish or impair property values
within the immediate vicinity.
· That the conditions placed on such use, as specified in
each district, have been met by the applicant.
. That the applicant has agreed to meet any additional
conditions imposed, based on specific site constraints
necessary to protect the public interest and welfare of
the community.

Regarding the first of these conditions, compatibility with
neighboring properties. Staff would note that the tract in
question will be surrounded by a 6.7526 acre
Neighborhood Commercial (NC) tract and the remaining
6.46 acre P.U.D. tract. In 1994, the Planning & Zoning
Commission and City Council considered and approved the
overall 17 acre tract for possible development of higher
density housing or apartments. Since that time, no changes
have occurred in this area which would impact their
decision.
The second criteria to be considered is compliance with
conditions and regulations of the zoning district in which
the development is to be located. The development, as
proposed in their General Plan, has issues that must be
addressed. However, with necessary changes the overall
layout may be workable. Specifics regarding the project
issues are outlined in the staff report for the General Plan.
. The final issue is the need for site specific conditions that
the applicant must agree to meet. The proposed
development does not come with any recommendation
from staff
If the Special Conditional Use Permit #SCU 97-001 is
granted by the Planning and Zoning Commission it
must also be approved by City Council.
Approval of the SCUP allows the applicant to submit a
general plan for the Bayou Forest Apartments. A General
Plan has been submitted by the applicant and will be
considered by the Commission as a separate Agenda item.
Please note that the proposed Bayou Forest Apartments,
Phase I developments represent 176 units. If#SCU 97-001
is approved, it would allow the development of only Phase
1. The Phase II development will require the applicant to
return to the Commission for formal approval. At this time,
staff is not recommending approval of Phase II of the
apartments.

The City has a Utility Extension Agreement with Decker McKim. The agreement requires the developer to
obtain any necessary easements. Mr. McKim has secured easements from 5 of the 6 property owners involved.
Mr. McKim has tried unsuccessfully to secure an easement from the one holdout, Mr. aJ.N. Taub. I have recently

contacted Mr. Taub in support ofMr. McKim, and have requested on behalf ofthe City, execution of the easement.
We are asking Council to pass this Reso.lution .in the event we are unable to secure the easement from Mr.
Taub. If refused, we WIll proceed with format "condemnation proceedings. Please note that prior to the
condemnation, the City will secure an appraisal and make an appropriate offer.
Although Illh St. is available as an alternate route, the City has chosen not to use it as it would prevent the
opportunity for a street closing and hinder further economic development for the area.

Thank you for taking my call on Tuesday. I appreciate your time and sincerely hope that
we can quickly come to an agreement.
This letter is intended to further explain the City's request for a utility easement across
Blk. 143, lots 9-16. Although initially presented by Decker McKim, this utility installation
project is actually a joint venture between Decker McKim and the City. The project is intended
to bring water and sewer mains to an area along SH 146 that is presently without service.
We have received, without compensation, easements from the other landowners along the
route and hope to convince you to do likewise. We feel that the route chosen is best for both the
City's and your interests, especially when considering future development potential of your tract.
To better explain the project, I am enclosing an outline explaining the City's position and

UTILITY INSTALLATION ALONG SH 146
. Block 143 Area Map shows the proposed route for the water and sewer mains
. The water main is within the right-of-way of SH 146. The right-of-way of SH
146 cannot accommodate both utilities.
. A portion of the proposed sanitary sewer is within the initial 10 foot of
property, parallel to and adjacent to SH 146 right-of-way. This location
would not interfere with future development because;
. The minimum building setback in a General Commercial Zone is 20 ft.
(See attached Table: Section 6-500, Table B - Commercial)
. The Zoning Ordinance also requires 6% landscaping. Many
developments choose to landscape along the frontage.
. The utility easement (forin attached) does not prevent access to the
property. Driveway. access according to applicable State and City
policies and regulations is 'permissible.
. The City avoided using the 11th Street right-of-way because;
. City has no long range plans to use II th Street as a roadway
. Having this right-of-way available for closing would allow for
adjacent landowners to accumulate larger tracts for development.
. Avoiding 11th Street also allows the City to negotiate additional right-
of-way for Little Cedar Bayou. In your specific case, if a street and
alley closing were applied for, I would recommend to City Council an
exchange of the residual of lots 15 and 16 for a similarly valued
portion of 11th Street. This has been done previously under a plan
blessed by City Council. (See exhibit 96-10).

EASEMENT IN BLOCK 143, TOWN OF LA PORTE; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has found
and determined that public necessity requires the location of a ten
foot (10') wide public sanitary sewer line easement on the
hereinafter described real property, in the City of La Porte,
Harris County, Texas; and
WHEREAS, the City Council of the City of La Porte has found
and determin.ed that a ten foot (10') wide utility easement over and
across the hereinafter described real property is suitable and
needed for such purpose, and that it is necessary to acquire same
for a public sanitary sewer line; and
WHEREAS, the City Council of the City of La Porte deems it
advisable to authorize, and does hereby authorize, Knox W. Askins,
City Attorney of the City of La Porte, to represent the City of La
Porte in the acquisition of the hereinafter described property:
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE:
Section 1. That the said Knox W. ASkins, as City Attorney for
the City of La Porte, be and he is hereby authorized to negotiate
with the owners of the hereinafter described land, concerning the
acquisition by the City of La Porte, of the perpetual right,
privilege and easement, with appropriate rights of ingress and
egress and reasonable working area for construction and
maintenance, to enter upon and construct, reconstruct, maintain,
operate, inspect, replace, repair and remove, a sanitary sewer line

to agree with such owners as to the fair market value of such
public sanitary sewer line easement, then, and in that event, said
attorney be, and he is hereby authorized and directed to file
against all owners and lienholders, proceedings in eminent domain
to acquire an easement over and across the above described
property, for public sanitary sewer line easement purposes.

recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the

Code; and that this meeting has been open to the public as required

On February 10, 1997, Council approved a Utility Extension Agreement with Decker
McKim to provide water and sewer service to several blocks along southbound SH 146
between the Les Marks complex and the Kroger center. The Utility Extension Agreement
estimated that the project might cost as much as $112,000. Since that time, plans have been
prepared by Carlos Smith, easements have been obtained, the project has been advertised, and
bids were received on June 19, 1997. A bid tabulation is attached.
Staff has reviewed the bids submitted and determined the low bid from R.L. Utilities, Inc. is
within the budgeted amount and R.L. Utilities, Inc. is qualified to perform this work. Staff
recommends that the City Council authorize the City Manager to execute a contract with
R.L. Utilities, Inc. in the amount of 106,814.00 for construction of Water and Sewer Lines
Along SH 146. In addition, it is recommended that $5,186 (4.9%) be set aside as contingency
for a total of $112,000.00 for the project.
Action Required by Council:
Consider approving an ordinance authorizing the City Manager to execute a contract with
R.L. Utilities, Inc. in the amount of $106,814.00 for construction of the water and sewer lines

SUMMARY & RECOMMENDATION
The City has been petitioned by Mr. Doug Latimer to close, vacate, and abandon the alleys
of Blocks 679 & 680 as well as the adjacent North 17th Street Right-of-Way between Blocks
679 & 680, Town of La Porte, to facilitate future expansion of his business. The Planning and
Public Works Departments have reviewed this request and have determined that the City has
no immediate or future plans to utilize the rights-of-way in question. Staff has solicited
comments and received letters of no objection from each of its franchised utility companies.
In accordance with Chapter 21, Section 21-28 of the Code of Ordinances, the fair market
value of the rights-of-way in question have been determined to be $0.546875 per square foot.
This process utilizes the average HCAD appraised value of adjacent, comparible properties
($0.3125 per square foot) and multiplies by a factor of 1.75. The rights-of-way to be closed
contain 36,800 square feet, resulting in a total payment of $20,125.00 of which the City has
subsequently received from the applicant.
Recommendation
Staff recommends vacating, closing, and abandoning the alleys of Blocks 679 & 680, Town
of La Porte as well as the North 17th St. Right-of-Way for future expansion of applicant's
business.

AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF
THE NORTH 17m STREET RIGHT-OF-WAY, AND THE ALLEYS OF BLOCKS 679
AND 680, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has been requested by
record owner of all of the property abutting the hereinafter described right-of-way of
North 17th Street and the alleys of Blocks 679 and 680, Town of La Porte, Harris County,
Texas; to vacate, abandon, and permanently close that portion of North 17th Street and the
alleys of Blocks 679 & 680, Town of La Porte, Harris County, Texas; and
WHEREAS, the City Council of the City of La Porte has determined and does
hereby find, determine and declare that the hereinafter described portion of North 17th
Street and the alleys of Blocks 679 and 680, Town of La Porte, Harris County, Texas, is
not suitable, needed, or beneficial to the public as a public road, street and alley, and the
closing of the hereinafter described portion of North 17th Street and the alleys of Blocks
679 and 680, Town of La Porte, Harris County, Texas, is for the protection of the public
and for the public interest and benefit, and that the hereinafter described portion of North
17th Street and the alleys of Blocks 679 and 680, Town of La Porte, Harris County,
Texas, should be vacated, abandoned, and permanently closed.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1.
Under and by virtue of the power granted to the City of La Porte
under its home rule charter and Chapter 253, Section 253.001, Texas Local Government
Code, the hereinafter described portion of North 17th Street and the alleys of Blocks 679
and 680, Town of La Porte, Harris County, Texas, is hereby permanently vacated,

Porte, Harris County, Texas, lying and being situated between Block Six
Hundred Seventy-nine (679), and Block Six Hundred Eighty (680), Town
of La Porte, Harris County, Texas, and between the north right-of-way line
of West Adams Street and the south right-of-way line of West Tyler
Street, in the Town of La Porte, Harris County, Texas, and containing
24,000 square feet, as shown on the map attached hereto as Exhibit "A".
Being the alley in Block Six. Hundred Seventy-nine (679), Town of La
Porte, Harris County, Texas, as shown on the map attached hereto as
Exhibit "A".
Being the alley in Block Six Hundred Eighty (680), Town of La Porte,
Harris County, Texas, as shown on the map attached hereto as Exhibit
"A".
Section 2.
The City Council officially finds, determines, recites, and declares
that a sufficient written notice of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public at the City Hall of the City
for the time required by law preceding this meeting, as required by the Open Meetings
Law, Chapter 551, Texas Government Code; and that this meeting has been open to the
public as required by law at all times during which this ordinance and the subject matter
thereof has been discussed, considered and formally acted upon. The City Council
further ratifies, approves and confirms such written notice and the contents and posting
thereof.
Section 3.
This ordinance shall be effective from and after its passage and
approval, and it is so ordered.

SUMMARY & RECOMMENDATION
As part of the FY 96-97 Budget for capital improvement projects, City Council
approved $50,000 for city wide sidewalk repairs and $20,000 for a new sidewalk
along Fairmont Parkway. The sidewalk repairs are in numerous locations, in different
neighborhoods throughout the City. The first phase of new sidewalk is along the
north side of Fairmont Parkway, between Broadway and City Hall. The next phase
will extend the sidewalk to SH 146. Design and engineering were performed on this
project utilizing City staff.
On July 3, 1997, the City received competitive bids from four qualified contractors
(see attached Bid Tabulation). The low bid was submitted by Purtis Construction of
Houston in the amount of $56,911.50. Staff has reviewed the bids submitted and
determined the low bid from Purtis Construction is within the budgeted amount and
Purtis Construction is qualified to perform the work. Staff recommends that the City
Council authorize the City Manager to execute a contract with Purtis Construction in
the amount of $56,911.50 for construction of the Fairmont Parkway sidewalk and for
city wide sidewalk repairs. In addition, it is recommended that $13,088.50 be set
aside as contingency for a total of $70,000 for these two projects.
Action Required by Council:
Consider approving an ordinance authorizing the City Manager to execute a
contract with Purtis Construction in the amount of $56,911.50 for construction of
sidewalks and further authorizing $13,088.50 to be set aside for Contingency.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA
PORTE:
Section 1. The City Council hereby approves and authorizes the
contract, agreement, or other undertaking described in the title of this
ordinance, in substantially the form as shown in the document which is
attached hereto and incorporated herein by this reference. The City
Manager is hereby authorized to execute such document and all related
documents on behalf of the City of La Porte. The City Secretary is hereby
au thorized to attest to all such signatures and to affIX the seal of the City
to all such documents. City Council appropriates the sum of $56,911.50
plus a contingency of $13,088.50 from Capital Improvement Fund 015 to
fund said contract.

In recent weeks there has been a question raised about the wiring in flexible conduit
known as BX/MC/Armor Clad within the City of La Porte. Flexible conduit is not
currently allowed by the City's electrical code (last updated in March 1989). After
some research, we know that the use of wiring in this conduit is safe and accepted by
communities that follow the National Electric Code.
It is staff's recommendation that "Section 5.02 Conduit in Commercial Buildings" of
the Electric Code be repealed. This section states:
"Wiring in all commercial and residential buildings shall be enclosed in rigid
conduit or metallic tubing. For the purpose of this Section 5.02, hotels and
motels shall be considered commercial buildings."
Several electrical contractors within the City also support this change.
Action Required by Council:
Consider approving Ordinance 97-1637-B repealing Section 5.02 of the Electric
Code.

Gentlemen,
Per our conversations over the last several weeks, I wish to support the revisions to the
City ordinance that allow the use of armored cable and metal-clad cable. Both of these
products are approved by the National Electrical Code and many of our neighboring
cities. We know of no safety problems with either cable, if as with any product, the
installation is done properly.
The deletion of section #5.02 would help reduce the fmancial burden on our business
customers in La Porte.

has supplied paper products to us. Both vendors have performed very well in the past.

SUMMARY & RECOMMENDATION
Advertised, sealed bids #0711 for tires were opened and read on July 7,
1997. Bid requests were mailed to sixteen (16) area suppliers with two (2)
returning bids and one (1) No Bid.
Low bid meeting specifications for section I - Small Tires was submitted by
Carr's City Tire Service. Using estimated yearly quantities, the total for
this section is $12,637.03. Low bid meeting specifications for Section II
- Heavy Truck, Tractor and Special Application was submitted by Carr's City
Tire Service. Using estimated yearly quantities, the total cost for this
section is $34,108.58. The total cost of the contract to Carr's would be
$46,745.61.
Low bid meeting specifications for Section III - Recap Only was submitted
by A to Z Tire & Battery. Using estimated yearly quantities, the total
cost of the contract to A to Z Tire & Battery would be $8,856.06.
Staff recommends award of bid for Sections I and II to Carr's City Tire
Service, low bidder meeting specifications and Section III to A to Z Tire &
Battery, low bidder meeting specifications. Using estimated yearly
quantities, the total cost of both contracts would be $55,601.67. This
represents a decrease of 16% from last year's prices. Adequate funds for
this contract were budgeted in the 1996/97 Vehicle Maintenance Division
Operating Budget.
Action Required by Council: Award bid for Sections I and II to Carr's city
Tire service, low bidder meeting specifications. Award bid for Section III
to A to Z Tire & Battery, low bidder meeting specifications.
