CALL TO ORDER The meeting was called to order by Mayor Norman L. Malone at 6:00 p.m. Members of City Council Present: Mayor Norman L. Malone, Councilpersons Guy Sutherland, Chuck Engelken, Howard Ebow, Bob McLaughlin, Alton Porter, Deotis Gay, Jack Maxwell and Jerry Clarke. Members of Council Absent: None Members of City Executive Staff and City Employees Present: City Manager Robert T. WAYNE SPEARS - FAIRMONT BAPTIST CHURCH Dr. Wayne Spears delivered the invocation. 3. CONSIDER APPROVING MINUTES OF SPECIAL CALLED REGULAR MEETING JUNE 23, 1997. Motion was made by Councilperson Maxwell to approve the minutes of June 23. 1997 as presented. Seconded by Councilperson Guy Sutherland. The motion carried, 8 ayes, 0 nays. Ayes: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Norman Malone. Nays: None 4. PROCOLAMA TIONS: . e Minutes Regular Meeting and Public Hearing La Porte City Council July 14, 1997, Page 2 KAREN WHEELER HALL DAY - CHEMICAL INDUSTRY COMMUNITY SAFETY Mayor Malone proclaimed July 14, 1997, as Karen Wheeler Hall Day. Karen Wheeler Hall accepted the proclamation. OxyChem donated One Thousand Dollars ($1,000) to La Porte Independent School District in the name of Karen Wheeler Hall. 5. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX PAYERS WISHING TO ADDRESS COUNClL. 8iU Scott, 1802 Lomax School Road, La Porte, addressed Council concerning the following issues: His concerns that open records request for audiotape of conversation between Mr. Scott and Assistant City Attorney John Armstrong are not being met and dealt with properly. His concerns regarding legal fees paid to Askins and Armstrong law firm. He advised Council that he intends to involve the District Attorney and Texas A ttorney General. He advised Council of plans to get the newspaper involved. Mr. Scott also presented an outline to Council referencing the above concerns. Mr. Scott requested to speak an additional five (5) minutes under Section 2.12 of the Zoning Ordinance or Ordinance 1435. Mayor Malone advised Mr. Scott that we are not granting an additional five minutes and he would need to stop speaking when the timer went off. Micheal Hyde, 3834 Pecan Circle, La Porte, addressed Council concerning the following issues: Cliff Hyde Flying Service lease. Mr. Hyde requested Council to consider not requiring Cliff Hyde Flying Service to move their building out of Park 77 air space with a new 1e.ase. 6. PUBLIC HEARING - TO CONSIDER APPROVAL OF SPECIAL CONDITIONAL USE PERM.IT (SCU) PERMIT #SCU97-001. THE APPLILCANT'S REQUEST IS FOR AN APARTMENT COMPLEX LOCATED IN A PLANNED UNIT DEVELOPMENT. e e Minutes Public Hearing and Regular Meeting La Porte City Council July J4, 1997, Page 3 OPEN PUBLIC HEARING Mayor Malone opened the Public Hearing at 6: 17 P.M. REVIEW BY STAFF Director of Planning, Guy Rankin, reviewed the summary and recommendation by the Planning and Zoning Commission regarding Special Conditional Use Permit #SCU97-0 I. PUBLIC INPUT Jim Clifton, Sterling Development spoke in favor of the program. RECOMMENDA TION FROM PLANNING AND ZONING The Planning and Zoning Commission held a public hearing on June 19, 1997. At this meeting, they considered and recommended approval of Special Conditional Use (SCU) Permit Request #SCU97-001. Mr. Rankin asked that Council approve the above referenced permit. CLOSE PUBLIC HEARING City Council had no questions. Mayor Malone closed the public hearing at 6:23 P.M. 7. CONSIDER APPROVAL OR OTHER ACTION REGARDING SPECIAL CONDITIONAL USE PERMIT. (SCU97-00l) - G. Rankin Motion was made by Councilperson Sutherland to approve SCU97-001. Second by Councilperson Ebow. The motion carried, 9 ayes, and 0 nays. CONSIDER APPROVAL OR OTHER ACTION REGARDING A RESOLUTION e e Minutes Regular Meeting and Public Hearing La Porte City Council July 14, 1997, Page 4 AUTHORIZING THE ACQUISITION OF A SANITARY SEWER EASEMENT IN BLOCK 143, TOWN OF LA PORTE (Res. 97-05) - J. Joerns Assistant City Manager, John Joerns, reviewed the summary and reason for the request. Mr. Joerns requested Council to approve Resolution 97-05. Council had no questions for Mr. Joerns. City Attorney read: RESOLUTION 97-05 - A RESOLUTION AUTHORIZING THE ACQUISITION OF A SANITARY SEWER EASEMENT IN BLOCK 143, TOWN OF LA PORTE; FI NDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Maxwell to approve Resolution 97-05 as read by the City Attorney. Second by Council person Gay. The motion carried, 9 ayes, and 0 nays. Ayes: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone. Nays: None 9. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND R.L. UTILITL.IES, INC. FOR CONSTRUCTION OF WATER AND SEWER LINES TO FUND SA.lD CONTRACT (Ord. 97-2185) D. - Kneupper City Engineer, Doug Kneupper reported the summary and recommendation regarding a contract between the City of La Porte and R. L. Utilities, Inc. in the amount of $106,814.00 for construction of Water and Sewer Lines Along SH 146. In addition, it is recommended that $5,186 (4%) be set aside as contingency for a total of $112,000.00 for the project. Mr. Kneupper answered questions from Council. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE NORTH 17'1'11 STREET RIGHT-OF-WAY, AND THE ALLEYS OF BLOCKS 679 AND 680, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS (Ord. 97-2186) - G. Rankin Director of Planning, Guy Rankin, reviewed the summary and recommendation regarding the request by Doug Latimer to close, vacate, and abandon the alleys of Blocks 679 & 680 as well as the North 17th Street Right-of-Way between Blocks 679 & 680, Town of La Porte. Mr. Rankin reported the City has no immediate or future plans to utilize the rights-of-way in question. Mr. Rankin recommends approval for future expansion of applicant's business. City Council had no questions. City Attorney read: ORDINANCE 97-2186 - AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE NORTH 17TH STREET RIGHT-OF-WA Y, AND THE ALLEYS OF BLOCKS 679 AND 680, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by COllncilperson Ebow to approve Ordinance 97-2186 as read by the City Attorney. Second by Deotis Gay. The motion carried, 9 ayes, o nays. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BET'VEEN THE CITY OF LA PORTE AND PURTIS CONSTRUCTION FOR CONSTRUCTION OF THE CITY WIDE SIDEW ALK REPLACEMENT AND FAIRMONT PARKWAY PEDESTRIAN PLAN APPROPRIATING $56,911.50 PLUS A CONTINGENCY OF $13,088.50 TO FUND SAID CONTRACT (Ord. 97-2187) G. Rankin Director of Planning, Guy Rankin, reported the summary and recommendation regarding a contract between the City of La Porte and Purtis Construction in the amount of $56,911.50 for construction of sidewalks and further authorizing $13,088.50 to be set aside for contingency. Mr. Rankin answered questions from Council. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE AMENDING SECTION V OF THE ELECTRIC CODE OF THE CITY OF .LA PORTE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF TJ-IIS ORDINANCE.SHALL BE GUILTY OF A MISDEMEANOR AND UPON CONV.ICTION THEREOF SHALL BE F.INEDIN ANY SUM NOT MORE THAN FIVE HUNDRED DOLLARS ($500.00) (Ord. 97-1637-B) R. Gillett Councilperson Sutherland pulled item B. for discussion asking Public Works Director, Steve Gillett questions about the quality of tires and number of bidders. Steve Gillett responded to Mr. Sutherland's questions. Motion was made by Councilperson Clarke to approve the Consent'Agenda as presented. Second by Councilperson McLaughlin. The motion carried 9 ayes and 0 nays. Ayes: Councilpersons Sutherland, Engelken, Ebow, Mclaughlin, Porter, Gay, Maxwell, Clarke and Mayor Malone. Nays: None 14. ADMINISTRATIVE REPORTS City Manager, Robert T. Herrera, reported on the upcoming'Council Retreat. He informed Council to look at the notes on their schedule. The retreat will begin this Friday and will end up at 12 Noon on Sunday. Mr. Herrera also introduced and congratulated Debbie Wilmore as the new Chief Building Official for the City of La Porte. Lastly, Mr. Herrera reported that he has received many positive comments about the Fourth of July Fireworks program. 15. THEIR ADVERTISED, PROPOSED SALARY IS $37,725 A YEAR 6. LA PORTE, TX., POPULATION 32,000 A. IN 1996 THE CITY PAID CONT.RACT ATTORNEYS $186,423.70 FOR 1483.15 HOURS OF WORK. B. THAT EQUATES TO $262,646.17 FOR A FULL ATTORNEY YEAR. C. AN APPLES TO APPLES ROUND NUMBERS COMPARISON OF TOTAL COST SHOWS LA PORTE SPENT OVER A QUARTER OF A MILLION DOLLARS FOR WHAT LIKE SIZED CITIES SPENT APP. $100,000 FOR. THE REALLY OUTRAGEOUS PART IS; THE CITY DOESN'T EVEN HAVE A WRITTEN CONTRACT WITH THESE LEGAL VENDORS. THE VENDORS ruST CHARGE WHAT THEY WANT AND THE CITY PAYS IT;.... WITH THE TAXPAYERS MONEY. 5. THE POOR QUALITY OF OUR LEGAL SERVICES: A. THE CITY PAID OUR LEGAL VENDORS $27,114.44 FOR A WORTHLESS POSITION IN THE DA VIS/MILLS CASE. THE DA VIS/MILLS PAID THEIR ATTORNEY IN THE mGH TEENS FOR FilS CORRECT POSITION. B. THE ZONING ORDINANCE 1501 ADDENDUM ON NON CONFORMING USES IS EXTREMELY POOR WORKMANSIDP. I CHALLENGE ANYONE HERE TO TRY TO MAKE SENSE OF IT. EVEN COUNCILMEN WHO HA VB STUDIED CAN'T MAKE SENSE OF IT. C. The project is identified as the Bayou Forest Apartments. (See Exhibit A) Planned Unit Development (p.U.D.) and Neighborhood Commercial (NC) Applicants are seeking a Special Conditional Use Permit (SCUP) for the purpose of developing an apartment complex within a Planned Unit Development (p.u.n.) zone. Zoning Ordinance Section 10-200 establishes the following review criteria and conditions for approval of Special Conditional Use Permits: . That the specific use will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values within the immediate vicinity. · That the conditions placed on such use, as specified in each district, have been met by the applicant. . That the applicant has agreed to meet any additional conditions imposed, based on specific site constraints necessary to protect the public interest and welfare of the community. Staff would note that the tract in question will be surrounded by a 6.7526 acre Neighborhood Commercial (NC) tract and the remaining 6.46 acre P.U.D. tract. In 1994, the Planning & Zoning Commission and City Council considered and approved the overall 17 acre tract for possible development of higher density housing or apartments. Since that time, no changes have occurred in this area which would impact their decision. The second criteria to be considered is compliance with conditions and regulations of the zoning district in which the development is to be located. The development, as proposed in their General Plan, has issues that must be addressed. However, with necessary changes the overall layout may be workable. Specifics regarding the project issues are outlined in the staff report for the General Plan. . The final issue is the need for site specific conditions that the applicant must agree to meet. The proposed development does not come with any recommendation from staff If the Special Conditional Use Permit #SCU 97-001 is granted by the Planning and Zoning Commission it must also be approved by City Council. Approval of the SCUP allows the applicant to submit a general plan for the Bayou Forest Apartments. A General Plan has been submitted by the applicant and will be considered by the Commission as a separate Agenda item. Please note that the proposed Bayou Forest Apartments, Phase I developments represent 176 units. If#SCU 97-001 is approved, it would allow the development of only Phase 1. The Phase II development will require the applicant to return to the Commission for formal approval. Although initially presented by Decker McKim, this utility installation project is actually a joint venture between Decker McKim and the City. The project is intended to bring water and sewer mains to an area along SH 146 that is presently without service. We have received, without compensation, easements from the other landowners along the route and hope to convince you to do likewise. We feel that the route chosen is best for both the City's and your interests, especially when considering future development potential of your tract. To better explain the project, I am enclosing an outline explaining the City's position and several exhibits describing the project. Taub NOTES: UTILITY INSTALLATION ALONG SH 146 . Block 143 Area Map shows the proposed route for the water and sewer mains . The water main is within the right-of-way of SH 146. The right-of-way of SH 146 cannot accommodate both utilities. . A portion of the proposed sanitary sewer is within the initial 10 foot of property, parallel to and adjacent to SH 146 right-of-way. This location would not interfere with future development because; . The minimum building setback in a General Commercial Zone is 20 ft. (See attached Table: Section 6-500, Table B - Commercial) . The Zoning Ordinance also requires 6% landscaping. Many developments choose to landscape along the frontage. . The utility easement (forin attached) does not prevent access to the property. Driveway. access according to applicable State and City policies and regulations is 'permissible. . The City avoided using the 11th Street right-of-way because; . City has no long range plans to use II th Street as a roadway . Having this right-of-way available for closing would allow for adjacent landowners to accumulate larger tracts for development. . Avoiding 11th Street also allows the City to negotiate additional right- of-way for Little Cedar Bayou. The Planning and Public Works Departments have reviewed this request and have determined that the City has no immediate or future plans to utilize the rights-of-way in question. Staff has solicited comments and received letters of no objection from each of its franchised utility companies. In accordance with Chapter 21, Section 21-28 of the Code of Ordinances, the fair market value of the rights-of-way in question have been determined to be $0.546875 per square foot. This process utilizes the average HCAD appraised value of adjacent, comparible properties ($0.3125 per square foot) and multiplies by a factor of 1.75. '.11 SUMMARY & RECOMMENDATION As part of the FY 96-97 Budget for capital improvement projects, City Council approved $50,000 for city wide sidewalk repairs and $20,000 for a new sidewalk along Fairmont Parkway. The sidewalk repairs are in numerous locations, in different neighborhoods throughout the City. The first phase of new sidewalk is along the north side of Fairmont Parkway, between Broadway and City Hall. The next phase will extend the sidewalk to SH 146. Design and engineering were performed on this project utilizing City staff. On July 3, 1997, the City received competitive bids from four qualified contractors (see attached Bid Tabulation). The low bid was submitted by Purtis Construction of Houston in the amount of $56,911.50. Staff has reviewed the bids submitted and determined the low bid from Purtis Construction is within the budgeted amount and Purtis Construction is qualified to perform the work. Staff recommends that the City Council authorize the City Manager to execute a contract with Purtis Construction in the amount of $56,911.50 for construction of the Fairmont Parkway sidewalk and for city wide sidewalk repairs. In addition, it is recommended that $13,088.50 be set aside as contingency for a total of $70,000 for these two projects. Ordinance Letters from Electrical Contractors SUMMARY & RECOMMENDATION - In recent weeks there has been a question raised about the wiring in flexible conduit known as BX/MC/Armor Clad within the City of La Porte. Flexible conduit is not currently allowed by the City's electrical code (last updated in March 1989). After some research, we know that the use of wiring in this conduit is safe and accepted by communities that follow the National Electric Code. It is staff's recommendation that "Section 5.02 Conduit in Commercial Buildings" of the Electric Code be repealed. This section states: "Wiring in all commercial and residential buildings shall be enclosed in rigid conduit or metallic tubing. For the purpose of this Section 5.02, hotels and motels shall be considered commercial buildings." Several electrical contractors within the City also support this change. Low bid meeting specifications for section I - Small Tires was submitted by Carr's City Tire Service. Using estimated yearly quantities, the total for this section is $12,637.03. Low bid meeting specifications for Section II - Heavy Truck, Tractor and Special Application was submitted by Carr's City Tire Service. Using estimated yearly quantities, the total cost for this section is $34,108.58. The total cost of the contract to Carr's would be $46,745.61.
