1. CALL TO ORDER
The meeting was called to order by Mayor Norman L. Malone at 6:00 p.m.
Members of City Council Present: Mayor Norman L. Malone, Councilpersons
Guy Sutherland, Chuck Engelken, Howard Ebow, Bob McLaughlin, Alton
Porter, Deotis Gay, Jack Maxwell and Jerry Clarke.
Members of Council Absent: None
Members of City Executive Staff and City Employees Present: City Manager
Robert T. Herrera, Assistant City Manager John Joerns, Assistant City Manager
Jeff Litchfield, City Attorney Knox Askins, Police Chief Bobby Powell,
Director of Public Works Steve Gillett, City Secretary Martha Gillett, Planning
Director Guy Rankin, Director of Administrative Services Louis Rigby,
Purchasing Agent Susan Kelley, Assistant Finance Director Cynthia Alexander
and City Manager's Secretary Carol Buttler.
Others Present: Spero Pomonis, Eugene Edmonds, Mr. and Mrs. Strong, Joyce
Sease, Jan Lawler, Lou Lawler, Mary McLain, Ramona Gatsberry, Sgt. David
Koch and a number of La Porte Citizens.

Reverend Chun delivered the invocation.
3. CONSIDER APPROVING M.lNUTES OF REGULAR MEETING
SEPTEMBER 22, 1997.
Motion was made by Councilperson Maxwell to approve the minutes of
September 22. 1997 as presented. Second by Councilperson Clarke. The
motion carried, 8 ayes, 0 nays, and I not in Council Chambers when vote was
taken.
Ayes: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Gay,
Maxwell, Clarke, and Mayor Norman Malone.
Nays: None
Other: Councilperson Porter not in Council Chambers when vote was taken.

A. RED RIBBON WEEK - JOYCE SEASE
Mayor Malone proclaimed October 23 through 31, 1997 as Red Ribbon Week.
Joyce Sease accepted the proclamation and thanked everyone. In addition, Ms.
Sease introduced Eric Adsit who is the student representative for the Crime
Stoppers group at La Porte High School.
B. STA Y IN SCHOOL/STAY OFF DRUGS/PLAN FOR LIFE - SGT.
DA VlD KOCH
Mayor Malone proclaimed 1997-98 School Year, as Stay in School, Stay Off
Drugs and Plan for Life Year. Sgt. David Koch, United States Army, accepted
the proclamation and thanked everyone.
C. PLANNING AND ZONING COM'MISSION MEMBER
RECOGNIT.ION
Mayor Malone presented a Proclamation to Eugene Edmonds, retiring Planning
And Zoning Commission Member. Mr. Edmonds stated he enjoyed serving
on the Planning and Zoning Commission and thanked everyone.
5. PETITIONS, REMONSTRANCES, COM'MUNICA TIONS, AND
CITIZENS AND TAXPA YERS WISHING TO ADDRESS COUNCIL.
Jan Lawler, 1400 N. IOU', La Porte, Texas 77571, introduced a program for
small businesses, community, industry and L.E.P.C. for chemical emergency
prepared ness.
Mary McLain, 128 S. 16lh St., La Porte, Texas 77571, signed up to speak.
However, when she was called to podium, she opted not to address Council.
6. CONSlDER APPROVAL OR OTHER ACTION REGARDING AN
ORDINANCE GRANTING A PERMIT UNDER SECTION 18-A-3 OF
ORDINANCE NO. 915, "PIPELINE TRANSPORTATION", BEING
CHAPTER 18-A OF THE CODE OF ORDINANCES OF THE CITY OF
LA PORTE, TEXAS, DATED NOVEMBER 25, 1975, TO CONSTRUCT A
4.5-INCH PIPE LINE FOR THE TRANSPORTATION OF ANHYDROUS
AMMONIA, AND AN 18-INCH PIPE LINE FOR THE
TRANSPORTATION OF ANHYDROUS HYDROGEN CHLORIDE TO
ARCO PIPE LINE COMPANY (O."d. 97-9J5-00) - S. Gillett.

Public Works Director Steve Gillett reported summary and recommendation
regarding request to approve Ordinance to grant a permit under Section 18-A-3
of Ordinance 915, "Pipeline Transportation", being Chapter 18-A of the Code
of Ordinances of the City of La Porte, Texas, dated November 25, 1975, to
construct a 4.5-inch pipeline for the transportation of anhydrous ammonia, and
an 18-inch pipeline for the transportation of anhydrous hydrogen chloride to
Arco Pipeline Company. Council had several questions, which were addressed
by Mr. Gillett and representatives from Arco Pipeline Company and Bayer
Corporation.
City Attorney read: ORDINANCE 97-915-00 AN ORDINANCE GRANTING
A PERMIT UNDER SECTION 18-A-3 OF ORDINANCE NO. 915,
"PIPELINE TRANSPORTATION", BEING CHAPTER 18-A OF THE CODE
OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED
NOVEMBER 25, 1975, TO CONSTRUCT A 4.5-INCH PIPELINE FOR THE
TRANSPORTATION OF ANHYDROUS AMMONIA, AND AN 18-INCH
PIPELINE FOR THE TRANSPORATION OF ANHYDROUS HYDROGEN
CHLORIDE; PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Gay to approve Ordinance 97-915-00 as
read by the City Attorney. Second by Councilperson Sutherland. The motion
carried, 9 ayes and 0 nays.
Ayes: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Porter, Gay,
Maxwell, Clarke and Mayor Malone.
Nays: None
7. CONSIDER APPROVAL OR OTHER ACTION REGARDING A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE,
TEXAS EXPRESSING ITS DESIRE TO CHANGE THE POLICY OF THE
TEXAS DEPARTMENT OF TRANSPORTATION (TxDot:) FOR CITIES
TO INSTALL, MAINTAIN AND OPERATE TRAFFIC SIGNALS
WITHIN THEIR CORPORATE LIMITS TO CITIES WITH A
POPULATION OF 100,000 OR GREATER (Res. 97-09) - R. Herrera
City Manager Robert T. Herrera reported to Council the summary and
recommendation for the City to support a resolution requesting the Department
of Transportation (TxDot) to change its policy regarding the size of incorporated
cities within which it is responsible for installing, maintaining, and operating
tratl"ic signals. Curr~nt policy sets the population at less than 50,000 (latest
federal census). The proposal is that the population level be changed to those

cities with a population less than 100,000. The City of Missouri City
approached the City of La Porte to support this issue.
Motion was made by Councilperson Ebow to approve Resolution No. 97-09
expressing its desire to change the policy of the Texas Department of
Transportation (TxDoO for cities to install. maintain. and operate traffic signals
within their corporate limits to cities with a population of 100.000 or greater.
Second by Councilperson Engelken. The motion carried, 9 ayes and 0 nays.
Ayes: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Porter, Gay,
Maxwell, Clarke and Mayor Malone.
Nays: None

Motion was made by Councilperson McLaughlin to approve Consent Agenda as
Presented. Second by Councilperson Gay. The motion carried, 9 ayes and 0
nays.
9. ADMINISTRA TIVE REPORTS
A. LA PORTE AREA WATER AUTHORITY RETREAT - OCTOBER
16, 1997
Mr. Herrera announced the La Porte Area Water Authority Retreat will
be on October 16, 1997.
B. CITY COUNCIL WORKSHOP - OCTOBER 20, 1997
Mr. Herrera announced there will be a Workshop Meeting on October
20, 1997.

Council retired into executive session at 6:46 p.m. under Section 551.075
(CONFERENCE WITH EMPLOYEES), to discuss contractual matter with the
City Manager, City Attorney and Airport Manager. Council returned to the
table at 7:28 p.m. with no action taken.

There was no consideration for this item.

Dear Mayor:
The United States Army Recruiting Command is launching in September a national
awareness campaign called TAKE CHARGE! Army commanders and recruiters are reaching out
to students all over America to stay in school, stay off drugs and plan for the future.
Our nation is facing a serious education crisis today. Each time a student drops out of school,
the nation loses a valuable natural resource. Through the years, we've been advising America's
youth to "Be all you can be" by serving in the Army. Now, we are urging them to be all they can
be in high school - to stay drug-free and to graduate.
The Army's front line of defense in this "battle~' is made up of nearly 5,000 Army recruiters
living and working in communities across the nation. All Army recruiters are high school
graduates and most have college education. As valid role models, they can present potential
dropouts with concrete reasons for why they should stay in school and graduate. Armed with
promotional materials such as posters, video tapes, speeches and news releases, recruiters are
ready to embark in their new mission.
In support of our campaign efforts, I am requesting your office to issue an official
proclamation declaring school year 1997-98 as "Stay in School/Stay off Drugs/Plan for Life
Year" in your community. I strongly believe that with your support, we can reach our goal of
making staying in school a norm in our school districts.

City of La Porte Planning and Zoning Commission. I'have
served the .Commission for nearly ten years. I feel that

SUMMARY & RECOMMENDATION
The ARCO Pipe Line Company has requested a permit to construct
two (2) pipelines within the City of La Porte. The first is a
4.5-inch line transporting Anhydrous Ammonia at an operating
pressure of 400 psig and an operating temperature of 1500 F. The
other pipeline, 18 inch, will transport Anhydrous Hydrogen
Chloride at an operating pressure of 225 psig and a temperature
of 1500 F.
ARCO Pipe Line Company has paid all fees, in a total amount of
$1,000, for two permit fees at $300 each and two annual fees at
$200 each. All requirements of Ordinance No. 915 have been met.
Action Required by Council: Approve Ordinance No. 97-915-00
authorizing ARCO Pipe Line Company to construct two (2)
pipelines in the City of La Porte.

AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-a-3 OF ORDINANCE
NO. 915, "PIPELINE TRANSPORTATION", BEING CHAPTER 18-A OF THE CODE
OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED NOVEMBER 25,
1975, TO CONSTRUCT A 4.5-INCH PIPE LINE FOR THE TRANSPORTATION OF
ANHYDROUS AMMONIA, AND AN 18-INCH PIPE LINE FOR THE TRANSPORTATION
OF ANHYDROUS HYDROGEN CHLORIDE; PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1 D
The City Council of the City of La Porte has
received an application dated September 17, 1997, from ARCO PIPE
LINE COMPANY, requesting a permit under Section 18-A-3 of Ordinance
915, being Chapter 18-A of the Code of Ordinances of the City of La
Porte, to construct and operate its 4. 5-inch pipe li"ne for the
transportation of ANHYDROUS AMMONIA and its 18-inch pipe line for
the transportation of ANHYDROUS HYDROGEN CHLORIDE, crossing the
City of La Porte, all as shown on said application. The
application of ARCO PIPE LINE COMPANY has been reviewed by the
City's Director of Public Works,
who has found that said

has recommended its approval.
Section 2. The City Council of the city of La Porte hereby
approves the application of ARCO PIPE LINE COMPANY, dated September
17, 1997, and this Ordinance shall constitute a permit to ARCO PIPE
LINE COMPANY to operate said pipe lines wi thin the City of La
Porte, all in conformance with the requirements of Ordinance No.
915, contingent upon its filing with the City of La Porte prior to
commencement of construction, copies of its permits from the Texas
Department of Highways and Transportation; Harris County; and the
Harris County Flood Control District. Any future relocation of the
pipe lines herein permitted, within the City, State, or County
rights-of-way, shall be at the sole expense of permittee.

The construction of two pipelines is planned to start in January 1998
and end in June 1998, and the proposed routes will traverse the city limits of
La Porte. The 4.5" pipeline will go from Rohm & Haas Corporation in Deer
Park, Texas to Bayer Corporation in Bay town, Texas, and the 18" pipeline will
go from Bayer Corporation in Bay town, Texas to The Geon Company on Miller
Cut-Off Road north of La Porte, Texas and east of Deer Park, Texas.
Attached is a check for $1,000.00 payable to the City of La Porte for
the $300.00 permit fee and the $200.00 annual fee for each line. Also,
attached are two sets of plans for each proposed crossing along with vicinity
maps and official city maps of La Porte with the pipeline routes and shutoff
valve locations shown. The plans are included in the attached drawings for
the following crossings:

Your attention is directed to governing laws, especially to Article 6674w-l, Vernon's Annotated Civil Statutes of Texas, penaining
to Control of Access. Access for serving this installation shall be limited to access via (a) frontage roads where prO\.;ded, (b)
nearby or adjacent public rOads or streets. (c) trails along or near the highway right-of-\\tay lines. connecting only to an il.ltersecting
road; from anyone or all of which entry may be made to the outer portion of the highway right-of-way for normal service and
maintenance operations. The Owner's rights of access to the through-traffic roadways and ramps shall be subject to the same rules
and regulations as apply to the general public except, however, if an emergency situation occurs and usual means of access for
normal service operations will not permit the immediate action required by the Utility Owner in making emergency repairs as
required for the safety and welfare of the public, the Utility Owners shall have a temporary right of access to and from the through-
traffic roadways ::nd ramps as necessary to accomplish the required emergency repairs, provided TxDOT is immediately notified
by the Utility Owner when such repairs are initiated and adequate provision is made by the Utility Owner for convenience and

of trees within the highway right-of-way, so that we may provide specifications for the extent and methods to govern in trimming,

investment in highway planting and beautification, by reducing damage due to trimming.

1. All excavations ~ithin the right of ~ay and not under surfacing
shall be backfilled by tamping in 6-inch horizontal layers arrd/or
as directed. All surplus material shall be removed from the right
of ~ay and the excavation finished flush ~ith surrounding natural
ground.
2. Vhere sodding is disturbed by excavation or backfilling operations,
such areas shall be replaced by seeding. Slopes 4;1 or steeper
sh~ll be replaced by block sodding. This ~ork shall be in accord-
ance ~ith Highway Department specifications.
3. Highway crossings under surfaced roads and surfaced crossroads

THE REQUIREMENTS ITEMIZED BELOW ARE ONLY A SUMMARY OF THE BASIC
REQUIREMENTS OF THE ORDER OR SOUND ENGINEERING PRACTICES GOVERNING
THIS CONSTRUCTION. THE APPROPRIATE COML'v1ISSIONERS' COURT ORDER SHOULD
BE CONSULTED IF ADDITIONAL INFORJV1ATION IS NEEDED.
1.
THE CONTRACTOR MUST PROVIDE WRITTEN NOTIFICATION TO THE HARRIS
COUNTY PERMIT DIVISION OF THE ENGINEERING DEPARTMENT FORTY-EIGHT
(48) HOURS PRIOR TO COMMENCING CONSTRUCTION.
2.
NO MORE TRENCH SHALL BE OPENED AT ONE TIME THAN CAN BE BACKFILLED
AND COMPACTED IN 10" LIFTS AT THE END OF EACH WORI< DAY. (NO TRENCH
SHALL REMAIN OPEN OVERNIGHT).
3.
ALL EXCESS EXCAVATION SHALL BE REMOVED FROM THE ROAD RIGHT-OF;WAY
AT THE END OF EACH WORK DAY.
4.
DITCHES SHALL BE OPENED AT THE END OF EACH DAY OR WHENEVER A
THREAT OF RAINFALL EXISTS TO ASSURE ADEQUATE DRAINAGE.
5.
ALL ROADS MUST BE KEPT OPEN TO TRAFFIC AND THE CONTRACTOR MUST
PROVIDE ADEQUATE FLAGMEN, SIGNS, SIGNALS, ETC., TO PROVIDE COMPLETE
SAFETY TO THE PUBLIC.
6.
IF IT BECOMES NECESSARY FOR EQUIPMENT TO OPERATE ON A PORTION OF
THE PAVEMENT, PRECAUTIONS MUST BE TAKEN TO PREVENT A~'Y DA~1AGE
\VHA TSOEVER TO THE PAVEMENT.

ARca Pipe Line Company requests a permit to install,
construct, maintain, operate and/or repair a steel 4.5" O.D. pipeline
the location and description of such proposed installation being
detailed on the attached drawings approved by the Harris County
Flood Control District, and made a part hereof.
It is understood and agreed to by the l'ecipient of this permit that
hereafter the Harris County Flood Control District, its successors
and/or assigns, ~ay determine that it is necessary to modify or
adjust the utility facility described herein, and that such
modification or adjustment will be made by the QT..mer of such
utility facility at its sole expense, and to make such modification
or adjustment within 90 days after being requested
to do so by the Harris County Flood Control District, its
successors and/or assigns.
It is also understood and agreed to be the re~ipient of this permlt
that it will immediately restore the Harris county Flood Control's
premisQs, including the bed and banks of the waterway, to the same
. condition as that in which they existed prior to the commencement
of the "'lork herein permitted, to the satisfaction of the said
Harris County Flood Control District.

Re: Pipeline Permit
The ARCO Pipe Line Company has requested a permit to construct two (2) pipelines
within the City of La Porte. One, a 4.5-inch line, will transport Anhydrous Ammonia at
an operating pressure of 400 psig and a temperature of 1500 F. The other pipeline,
18 inch, will transport Anhydrous Hydrogen Chloride at an operating pressure of 225
psig and a temperature of .1500 F. The company has paid a total of $1,000 for.th~
$300 permit fee and $200 annual fee for each line. All requirements of Ordinance
No. 915 have been met.
Please prepare an ordinance granting a permit to ARCO Pipe Line Company to
construct these two lines. I anticipate placing this on the upcoming October 13, 1997
council meeting.

-Subject: TxDoT Traffic Signal Policy Change Resolution
Dear Mayor Malone:
Missouri City requests that your city support the attached resolution requesting the Texas
Department of Transportation (TxDoT) to change its policy regarding the size of incorporated
cities within which it is responsible for installing, maintaining, and operating traffic signals. The
policy currently sets the population size of cities that TxDoT is responsible for at less than
50,000 (latest federal census). The proposal is that the population level be changed to those
cities with a population less than 100,000.
The proposal is a win-win situation. Such a change would be beneficial for cities that
currently have populations between 50,000 and 99,999 since it would transfer maintenance
responsibility back to the state, saving them money in the process. Cities with a population less
than 50,000 will be able to better plan for take over of such a responsibility if and when they
reach the new population level. From Missouri City's perspective it makes sense that TxDoT
maintain traffic signals on roadways and facilities which are owned and operated by TxDoT.

SUMMARY & RECOMMENDATION
Advertised sealed bids #0716 for water and sewer supplies were opened and read on September 8,
1997. Bid requests were mailed to six (6) area suppliers with three (3) returning bids.
Golden Triangle Pipe and Supply submitted low bid meeting specifications.
Using estimated yearly quantities, the total cost would be $21,637.13.
This is an eleven percent (11%) increase over last year's bid.
Staff recommends award of water and sewer supplies to low bidder meeting specifications, Golden
Triangle Pipe, in the amount of $21,637.13. Funds have been budgeted by the water arid sewer
divisions. The items will be purchased for warehouse inventory throughout the year, then distributed
as needed.
