1. CALL TO ORDER
Thc~ meeting was called to order by Mayor Norman L. Malone at 6:00 p.m.
Members of City Council Present: Mayor Norman L. Malone, Councilpersons
Chuck Engelken, Howard Ebow, Bob McLaughlin, Deotis Gay, Jack Maxwell
and Jerry Clarke.
Members of Council Absent: Councilpersons Guy Sutherland and AIton Porter.
Members of City Executive Staff and City Employees Present: City Manager

Mayor Norman L. Malone delivered the invocation.
3. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND
CITIZENS AND TAX PAYERS WISHING TO ADDRESS COUNCIL
Stev(~ Valarius, 140 Hazel Street, La Porte, Texas addressed City Council
regarding its decision at the last meeting for failing to accept the Dolphin
Pilings. Mr. Valarius pointed out to Council that the pilings would prevent
dama.ge to the pier, and requested Council to reconsider this matter.

City Manager Robert T. Herrera presented summary and recommendation. Mr.
Herrera thanked City Council for attending this Special Called Meeting. He
noted that Joe Camp is in the process of expanding his existing facility here in

La Porte. In order to accommodate and work with Mr. Camp, certain streets
and alleys require closing. Mr. Herrera advised Council there was a diagram in
their packet outlining this matter. The value of this street and alley closing is
$83,981.13. This value was based on the new appraisal method. More
importantly, this will create new jobs within the City. Mr. Herrera advised
Council staff recommended approval of this Ordinance.

the City Attorney. Second by Councilperson Maxwell. The motion carried, 7

SUMMARY & RECOMMENDATION
The City has been petitioned by Mr. Joe Camp to close, vacate, and abandon the alley in Block 117, Town of La
Porte, the West "E" Street Right-of-Way between Blocks 117 & 124, Town of La Porte, and the northernmost
40' of the West "F" Street Right-of-Way between South 8th Street and State Highway 146 to facilitate the
expansion of his dlealership. The Planning and Public Works Departments have reviewed this request and have
determined that the City needs to retain a 16' utility easement within the West "E" St. & West "F" St. rights-of-
way to facilitate existing utilities. Staff has solicited comments from the City's franchised utility companies and
has determined that utility easements must be retained for Entex, H.L.&P., and Southwestern Bell in order to
facilitate existing facilities within the area of the closings.
In accordance with Article II, Section 62-358 of the Code of Ordinances, the HCAD x 1.75 method has been
utilized to establish fair market value for the closings due to the fact that Mr. Camp's application predates
Ordinance 98-2225 which revised the City's street & alley closing process. The HCAD method results in a
value of $2.15 per square foot for the rights-of-way in question (containing a total of 39,124 square feet)
resulting in closing fees to the City in the amount of $83,981.13. Administration concurs with this approach
and option due to the fact that 11th Street, across the highway recently closed for $2.63 per square foot and
we are offering no reduction for permanent easements retained by the City.
Recommendation
Staff recommends closing, vacating, and abandoning the alley of Block 117, Town of La Porte, the West "E"
Street Right-of-Wa" between Blocks 117 & 124, and the northernmost 40' of the West "F" Street Right-of-Way
between South 8th Street and State Highway 146, and providing for various easements to be retained by the
City and its franchised utility companies.
Action Required by Council:
Consider approval of an ordinance to close, vacate, and abandon the alley of Block 117, Town of La Porte, the
West "E" Street Ri!~ht-of-Way between Blocks 117 & 124, and the northernmost 40' of the West "F" Street

WHEREAS, the City Council of the City of La Porte has been requested by the record owner of
all of the property abutting the hereinafter descn'bed alley of Block 117, Town of La Porte, a portion of the
West "E" Street Right-of-Way, and a portion of the West "F" Street Right-of-Way, Town of La Porte,
Harris County, Texas; to vacate, abandon, and permanently close that portion of the alley of Block 117,
Town of La POlte, a portion of the West "E" Street Right-of-Way, and a portion of the West "F" Street
Right-of-Way, Town of La Porte, Harris County, Texas; and
WHEREAS, the City COlUlCil of the City of La Porte has detennined and does hereby fwd,
determine, and declare that the hereinafter descn'bed alley of Block 117, Town of La Porte, a portion of the
West "E" Street Right-of-Way, and a portion of the West "F" Street Right-of-Way, Town of La Porte,
Harris County, Texas, is not suitable, needed, or beneficial to the public as a public road, street, or alley,
and the dosing (If hereinafter described alley of Block 117, Town of La Porte, a portion of West "E" Street
Right-of-Way, W!ld a portion of the West "F" Street Right-of-Way, Town of La Porte, Harris County,
Texas, is for the i!>rotection of the public and for the public interest and benefit, and that the hereinafter
described alley of Block 117, Town of La Porte, a portion of West "E" Street Right-of-Way and a portion
of the West "F" Street Right-of-Way, Town of La Porte, Harris County, Te.'<3S, should be vacated,
abandoned, and permanently closed.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1.
, Under and by virtue of the power granted to the City of La Porte under its home rule
charter and Chapter 253, Section 253.001, Texas Local Government Code, the hereinafter described alley
of Block 117, Town of La Porte, a portion of the West "E" Street Right-of-Way, and a portion of the West
"F" Street Right-of-Way, Town of La Porte, Harris County, Te.xas, as generally depicted by Exhibit "A", is
hereby permanently vacated, abandoned, ~d closed by the City of La Porte, to wit:

The entire alley in Block 117, Town 0 fLa Porte, Harris County, Texas, more specifically
described by Metes and Bounds as on Exlubit "B" attached hereto~ Provided, however, the City of
La Porte saves and excepts the area described in E.xhibit "B" as a public utility easement for the
use and benefit of Houston Lighting & Power, Southwestern Bell, and Entex. Said public utility
easement shall be further subject to the provisions and restrictions contained in Sections 2, 3, & 4
of this ordinance.
A pOr1ion of West "E" Street right-of-way, as described by Metes and Bounds on Exhibit "C"
attachled hereto. Provided, however, the City of La Porte saves and excepts the area described in
Exhibi.t "C" as a public utility easement for the use and benefit of the City of La Porte, Houston
Lightillg & Power, Southwestern Bell, and Entex. Said public utility easement shall be further
subject to the provisions and restrictions contained in Sections 2,3, & 4 of this ordinance.
A portiion of West "F" Street right-of~way, as described on Exhibit "0" attached hereto~ Provided,
howev,el', the City of La Porte saves and excepts the North sixteen (16) feet of the area described
in Exhiibit "0" as a public utility easement for the use and benefit of the City of La Porte, Houston
Ligh1iIng & Power, Southwestern Bell, and TCI. Said public utility easement shall be further
subject to the provisions and restrictions contained in Sections 2,3, and 4 of this ordinance.
Section 2. The City of La Porte. for itself, its successors and assigns, and the public utilities holding
franchises from it, shall have the perpetual right, privilege and easement, with appropriate rights of ingress
and egress and J'l=asonable working area for construction and maintenance, to enter upon and construct,
reconstroct, maintain, operate. inspect, replace, restore, repair, and remove public utility facilities, together
with all necessm:y improvements in, over, lUlder, through and across the public utility easements retained
and described in Section 1.
Section 3. No buildings, awnings, overlJangs, or other SbUctures may be placed on, over or across
the public utility easements retained and described in Section 1. Provided, however, nothing in this

paragraph shall prevent the right of the owner of said property, to pave, landscape, or otherwise use the
surface of said public utility easements so long as such use is not inconsistent with the rights of the City of
La Porte and its fianchised public utilities as described in Section 2. All paving plans and specifications
shall be subjec::t to the prior approval of the City of La Porte, including, but not limited to the placement of
constructionjclints in any paving. The City of La Porte and itS fianchised public utilities shall not be
obligated to restore or repair any such paving, landscaping or other improvementS disturbed, damaged, or
removed by th,e exercise of such public utility rightS and privileges described in Section 2.
Section 4. The public utility easementS retained in Section I and the provisions and restrictions
contained in S€:ctiODS 2 & 3 of this ordinance may be redefined by mutual agreement between the property
owner and the ;:lppropriate fianchised utility and or the City of La Porte.
Section 5. The license for the surface use of the North forty (40) feet of West "F" Street granted by
City of La Porte: Ordinance No. 95-2033-C shall be null and void upon the passage of this ordinance.
Section 6. The City Council officially finds, detennines, recites, and declares that a sufficient
written notice of the date, hour, place, and subject of this meeting of the City Cmmcil was posted at a place
convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been
open to the public as required by law at all times during which this ordinance and the subject matter thereof
has been discussed, considered, and fottnally acted upon. The City Council further ratifies, approves, and
confirms such written notice and the contents and posting thereof. 1bis ordinance shall be effective from
and after itS passage and approval, and it is so ordered.

Joe Camp, Inc. is currently in the process of expansion. We will be using almost
seven acres OIf land when we are finished.
Our plans include 101,016 square feet of additional paving and 18,000 square feet
of additional buildings. The project will be around two million dollars. The service
department 'will over double its size. The body shop will increase in size by one third.
We will have a new showroom, approximately 3,000 square feet. Also a new used
vehicle office facility and pre-delivery center are planned.
After ,completion of our expansion project, we will be hiring about twenty more
people. As the highway interchange nears completion, we will hire an additional work
force of up to thirty more people. When all is said and done, we will employee between
one hundred and one hundred thirty people in the short term. Our work force is currently
at 75-80.
Many delays have been experienced and we had planned a closing on April 1 st or
2nd. Ioe Camp, InC. would greatly appreciate the approval of an ordinance before this, so
we can finally close the loan and get started.
