MINUTES OF THE REGULAR MEETING
OF LA PORTE CITY COUNCIL
OCTOBER 12, 1998
1. CALL TO ORDER
The meeting was called to order by Mayor Norman L. Malone at 6:00 p.m.
Members of City Council Present: Mayor Norman L. Malone, Council persons Guy
Sutherland, Chuck Engelken, Howard Ebow, Peter Griffiths, Alton Porter, Deotis Gay,
Charlie Young and Jerry Clarke
Members of Council Absent: None

2. The Invocation was delivered by Mayor Malone.
3. Council considered approving the minutes of the Regular Meeting and Public Hearings
on September 28, 1998.
Motion was made by Council person Clarke to a!)prove the minutes of Sq>tember 28.
1998 meetin~ as presented. Second by Councilperson Engelken. The motion carried.
Ayes: Sutherland, Engelken, Griffiths, Porter, Gay, Young, Clarke and Mayor Malone

4. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND
TAX PAYERS WISHING TO ADDRESS COUNCIL
Bill Scott, 1802 Lomax School Rd., La Porte, Texas 77571, Mr. Scott presented the
Council with a petition to abandon the proposed Phase I Fairmont Parkway Road
expansion. Mr. Scott explained that he felt this Phase I road would turn into another
Myrtle Creek through fare street. Mr. Scott advised Council that on the October 26,
1998 Council meeting he will provide facts and responses to remarks made by some
Council members on the September 28, 1998 Council meeting.

5. Council considered approving an Ordinance finding that there is not public necessity for
the extension and improvement of Farrington Boulevard and Lomax School Road to
connect with State Highway 225, or to Upgrade Lomax School Road as a four lane
street; repealing references to said connection in the City of La Porte Comprehensive
Plan; Repealing the Provision in the City's 1998-99 Capital Improvement budget for the
improvement and paving of a 28 foot wide connection between Farrington Boulevard
and Lomax School Road.

THERE IS NO PUBLIC NECESSITY FOR THE EXTENSION AND

Porter, Griffiths, Sutherland, Mayor, Ebow revealed concerns and suggestions
concerning this issue.
Motion was made by Council person Sutherland to lU'prove the Ordinance as read by the
City Attorney. Seconded by Councilperson Porter. The motion carried unanimously.

6. Council considered an Ordinance authorizing the Execution of a Deed to Ava Jean
Robertson, Individually and as Independent Executrix of the Estate of Gladys Lorene
Welch, Deceased, of a 0.265 Acre (11,560 square feet) parcel of land, as a portion of
the consideration for the acquisition of a 1.064 Acre (46,356 square feet) parcel of
land, for the Lomax Flood Control Project

Assistant City Manager John Joerns presented the summary and recommendation
information and answered Council's questions.
Motion was made by Councilperson Sutherland to cwprove the Ordinance as read by the
City Attorney. Seconded by Councilperson Engelken. The motion carried
unanimously.

7. Council considered approving an Ordinance authorizing a Contract between the City of
La Porte and Trimble and Stephens Construction Services, Inc. for Construction of a
parking lot and restroom/pavilion for Seabreeze Park; appropriating $259,000.
Director of Planning Doug Kneupper presented the summary and recommendation
information and answered Council's questions. Mr. Herrera also answered Council's
questions.
City Attorney read: ORDINANCE 98-2289 - AN ORDINANCE APPROVING AND
AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND
TRIMBLE AND STEPHENS CONSTRUCTION SERVICES, INC. FOR
CONSTRUCTION OF A PARKING LOT AND RESTROOMIPA VILION FOR
SEABREESE PARK; APPROPRIATING $259,000.00 PLUS A CONTINGENCY OF
$12,950.00, TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH
THE OPEN MEEI1NGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF
Motion was made by Councilperson Clarke to approve the Ordinance as read by the
City Attorney. Seconded by Councilperson Porter. The motion carried unanimously.

8. Council considered approving an Ordinance authorizing an extension of Industrial
District Agreement between the City of La Porte and Southern Ionics, Inc., for the term
commencing January 18,2000, and ending December 31, 2000.
City Manager Robert T. Herrera presented the summary and recommendation
information and answered Council's questions.
City Attorney read: ORDINANCE 98-2290 - AN ORDINANCE APPROVING AND
AUTHORIZING AN EXTENSION OF INDUSTRIAL DISTRICT AGREEMENT

9. Council considered an Ordinance Appointing members to the Comprehensive Plan
Steering Committee of the City of La Porte
City Attorney Knox Askins presented information concerning the ordinance and the
names of the citizens chosen for this ordinance.
City Attorney read: ORDINANCE 98-2291 - AN ORDINANCE APPOINTING
MEMBERS TO THE COMPREHENSIVE PLAN STEERING COMMITTEE OF THE
CITY OF LA PORTE; PROVIDING A SEVERABILITY CLAUSE; CONTAINING A
REPEALING CLAUSE; FIND COMPLIANCE WITH THE OPEN MEETINGS
LAW; PROVIDING AN EFFECTIVE DATE HEREOF
Motion was made by Council person Clarke to lij)prove the Ordinance as read by the
City Attorney. Second by Councilperson Young. The motion carried unanimously.

10. Council considered approval of The Exemption of Emergency Access Streets from the
City Speed Hump Policy
Fire Chief Joe Sease presented the summary and recommendation information and
addressed Council's questions. Mr. Herrera also addressed and answered Council's
questions.
Motion was made by CounciJperson Ebow to adopt an Amended Exempt of Emergency
Access Streets List from the Speed HuIIlP Policy by removini the Myrtle Creek Street
from the ori2inallist. Second by Councilperson Sutherland. The motion failed.

City Attorney Knox Askins addresses Council suggesting the adoption of the Original

Councilperson Clarke. The motion carried.

IN THE CITY'S 1998-99 CAPITAL IMPROVEMENT BUDGET FOR THE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1"
The City Council hereby finds, determines and
declares that there is no public necessity for the extension and
improvement of Farrington Boulevard and Lomax School Road to
connect with State Highway 225, or to upgrade Lomax School Road as
a four lane street. Any reference to this project in the City of
La Porte Comprehensive Plan is repealed.
Section 2 .
The provision in the ci ty' s 1998-99 Capi tal
Improvement Budget for the improvement and paving of a 28 foot wide
connection between Farrington Boulevard and Lomax School Road is
repealed.
The City's Comprehensive Plan Study Committee will
recommend whether this project will be included in the City's
updated Comprehensive Plan.
Section 30 The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject

matter thereof has been discussed, considered and formally acted
upon. The city Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
Section 40 This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

SUMMARY & RECOMMENDATION
The City bas reached agreement with Ms. Ava Robertson for the purchase of a 1.06 ac. tract needed for the FI0l
drainage project. Part of the consideration includes deeding to Ms. Robertson an 11,560 sq. ft. tract, which the City
acquired from a Mr. Parmer. This 11,560 sq. ft tract is considered an unusable remnant and the City bas no public need
for this tract. The potential to offer the Parmer residual was recognized early on and referenced in the City's 7/10/97
letter to Ms. Robertson. The value of the tract credited against the purchase price of the Robertson property is the City's
actual per square foot price paid to Parmer.
(NOTE: As of Wednesday at 5 PM, Ms. Robertson bad not delivered the signed Earnest Money Agreement. She bas
assured me that it will be delivered by Monday night's Council meeting. If it is not delivered by 10/12, I suggest that we
table this item.)
RECOMMENDATION:
Staff recommends that City Council approve the Ordinance authorizing the City Manager to execute a Warranty
Deed.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 10 The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The City Manager is hereby authorized to execute such
document and all related documents on behalf of the City of La
Porte. The City Secretary is hereby authorized to attest to all
such signatures and to affix the seal of the City to all such
documents.

SUMMARY & RECOMMENDATION
The City of La Porte requested formal bids for Phase I construction of Seabreeze Park,
located at 1320 Bayshore Drive, Project 965201, as approved by Council. Phase I includes
site preparation; site utilities; concrete paving, curbing, and walks; and electrical service
to construct a 52 space Parking Lot, and Restroom/Pavilion for Sea breeze Park. Bidding
and construction documents were delivered to nine contractors. Six (6) contractors
returned bids for the project; the bids were opened on October 1, 1998. The low bidder
(Base Bid) meeting specifications for the project was the contracting firm of Trimble and
Stephens Construction Services, Inc. with a bid of Two Hundred Seventy-Eight Thousand,
Dollars ($278,000.00). After staff review and concurring with the Architect's Letter of
Recommendation, staff proposes to accept the Alternate #1 Deduct of $19,000.00 from
the Base Bid, which would utilize composition shingles for roofing, rather than metal
roofing and flashing as specified in the Base Bid. The resulting adjusted bid for the
proposed project is Two Hundred Fifty Nine Thousand Dollars ($259,000.00). Projected
length of the project is 150 days from award. There are sufficient funds in the specified
Capital Improvement account to fund the proposed project.
Staff Recommendation:
Staff recommends that the bid submitted by Trimble & Stephens Construction Services,
Inc. be accepted as low bid meeting specifications for this project.
Action Required by Council:
Consider award of contract to Trimble & Stephens to construct Phase I, Sea breeze Park
project.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA

Section 1. The City Council hereby approves and authorizes the
contract, agreement, or other undertaking described in the title of this

attached hereto and incorporated herein by this reference. The City
Manager is hereby authorized to execute such document and all related
documents on behalf of the City of La Porte. The City Secretary is hereby

Dear Mr. Kneupper:
Please find enclosed a copy of the bid tabulation from six of the nine contractors of record for
the above referenced project.
The apparent low bidder is Trimble & Stephens in the amount of $278,000 for the base bid,
Architect's estimate of $265,000. Please note the deduct alternate #1 amount of $19,000 from
Trimble & Stephens which would bring the project within $4,000 or approximately 1 Yz% over
the Architect's estimate.
We recommend the following items for consideration and approval:
1. Apparent low bidder is responsible and willing to enter into a contract for the amount as
bid.
2. Accept the deduct alternate for asphalt roof shingles in lieu of metal roofing. The contractor
claims the metal roof warranty will not be available for structures on the waterfront.
The Phase I project should be substantially complete in five (5) months.
Phase II, Corps permit and drawings, should be complete in four (4) months to allow one (1)
month for bidding and review. This schedule will allow Phase II to commence immediately
upon Phase I completion.

SUMMARY & RECOMMENDATION
The Industrial District Agreement between Southern Ionics, Inc. and the City of La Porte dated January 1, 1987,
the tenn of which was extended by the U.S. District Court in Houston to a date "four years and nine months after a
final, non-appealable order is entered in the state pennit litigation," will expire, by the City's calculations, on January
18,2000. The City of La Porte's current Industrial District Agreements with other industrial companies expire on
December 31, 2000.
The City of La Porte proposes to extend the tenn of the Southern Ionics, Inc. Industrial District Agreement to the
common expiration date of December 31, 2000. This would allow this 8.greement to be included with the other
industries in negotiations for renewal of existing Industrial District Agreements.
Staff recommends Council approve the extension of this agreement as outlined in the Ordinance and Agreement
documents.

the City of La Porte, dated January 1, 1987, the term of which was
extended by the U. S. District Court in Houston to a date "four
years and nine months after a final, non-appealable order is
entered in the state permit litigation," will expire, by the City's
calculations, on January 18, 2000. The City of La Porte's current
Industrial District Agreements with its other industrial companies,
expire on December 31, 2000.
The City of La Porte proposes to extend the term of the Southern
Ionics, Inc. Industrial District Agreement to the common expiration
date of December 31, 2000. Southern Ionics, Inc. would then be
included with the other industries in negotiations for renewal of
existing Industrial District Agreements, which negotiations we
anticipate will begin in 1999.
I have enclosed with this letter a short form of extension of the
existing agreement. If this agreement is satiSfactory with
Southern Ionics, Inc., I would appreciate your signing and
returning the enclosed multiple copies to me, and I will have the
matter placed on a City of La Porte City Council agenda for formal
approval, and return to your firm an executed copy.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
section 10 The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The City Manager is hereby authorized to execute such
document and all related documents on behalf of the City of La
Porte. The City Secretary is hereby authorized to attest to all
such signatures and to affix the seal of the City to all such
documents.

recites, and declares that a sufficient written notice of the date,

$126,253.00. Specifications were sent to 5 vendors with 4 returning a total of9 quotations(Some submitted

Scourge Mosquito Control Agent is used by the city in mosquito control.
This material is more efficient and is environmentally safe compared to
malathion. Due to the lesser amount needed, less Scourge must be used than
other types of materials. Most mosquito control agencies have switched to
this material due to the inherent problems of malathion.
B & G Chemical is the sole authorized distributor of Scourge for this
area. The cost of Scourge at this time is $291.00 per gallon. A total of
60 gallons is needed for the next mosquito spraying season. This would be
a cost of $17,460.00. A total of 990 gallons of BVA Oil, the distributing
agent, is -needed at a cost of $3.40 per gallon for a cost of $3,366.00.
The total cost of the contract would be $20,826.00. This represents a 3%
increase over last year's pricing.
staff recommends declaring Scourge a sole source item from B & G Chemical
and the purchase of 60 gallons of Scourge Mosquito Control Agent at $291.00
per gallon for a cost of $17,460.00 and 990 gallons of BVA Oil, the

Notes for Bill Scott's 10-12-98 City Council 5 minute presentation
From the 10-6-98 meeting of the taxpayers group "Common Sense Govt.", I
understand from Council Members that an Ordinance to help solve this
problem is forthcoming so I'll keep this statement short.
1. This petition asks the City of La Porte to abandon the proposed connection
of Farrington Blvd to Lomax School Rd. arid to remove all "Comprehensive
Plan" references to connecting Fainnont Parkway to Highway 225.
2. 570+ taxpayers have signed the petition. To gauge just how high resistance
to this Project is.. there were only 997 voters in the last La Porte general
election.
3. Even if the Phase 1 road is officially disconnected from Phases 2 & 3 by
eliminating Phases 2 & 3, there is still great resistance to this Phase 1 road. I
would guess that 85% of the hundreds of people that I have talked to do
NOT want this Phase 1 road under any circumstances because they believe it
will greatly increase traffic through 2 elementary school zones and 3 park
areas. Several taxpayers believe that through traffic traveling this Phase 1
road to avoid the SpencerlUnderwood and Spencer/Sens intersections will
turn it into a pennanent "Mertle Creek", for those of you that remember that
neighborhood street that was turned into a fast thoroughfare because of
congestion at SpencerlUnderwood...and we already have a high level of
congestion at Spencer/Sens.
4. On Oct. 26,1998, I'll provide facts in response to remarks made by some
members of the City Council during the 9-28-98 City Council meeting.
