CALL TO ORDER The meeting was called to order by Mayor Norman Malone at 6:00 p.m. Members of City Council Present: Councilpersons Guy Sutherland, Chuck Engelken, Howard Ebow, Peter Griffiths, Alton Porter, Deotis Gay, Charlie Young, Jerry Clarke, and Mayor Norman Malone. Members of Council Absent: None Members of City Executive Staff and City Employees Present: City Manager Robert T. Herrera, City Attorney Knox Askins, Assistant City Manager John Joerns, Assistant City Manager Jeff Litchfield, City Secretary Martha Gillett, Director of Planning Doug Kneupper, Director of Administrative Services Louis Rigby, Police Chief Richard Reff, Assistant Chief of Police Aaron Corrales, City Planner Masood Malik, Purchasing Agent Susan Kelley, Golf Course Superintendent :Dennis Hlavaty, Court Coordinator Aimee Bird, Patrol Officer Tim Bird, Special Operations Sergeant Ed Butchee, Patrol Lieutenant Ron Parker, Auxiliary Services Lieutenant Carl Crisp, and Crime Prevention Officer Jerome McKown. Councilman Jerry Clarke delivered the Invocation. 3. Council considered approving the minutes of the Regular Meeting, Workshop Meeting, and Public Hearing on December 13, 1999. Motion was made by Councilperson Engelken to approve the minutes of the Regular Meeting, Workshop Meeting, and Public Hearing as presented. Second by Councilperson Clarke. The motion carried. Ayes: Sutherland, Engelken, Ebow, Griffiths, Gay, Young, Clarke, and Mayor Malone Nays: None Abstain: Porter 4. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAXPAYERS WISHING TO ADDRESS COUNCIL. There were no citizens wishing to address Council. City Council Minutes — January 10, 2000 — Page 2 5. Presentations: A. Ed Butchee, Special Operations Sergeant for the Police Department was recognized as retiring from the City of La Porte. Mr. Herrera and Chief Reff presented Sergeant Butchee with a gift from the City. B. Bill White with the American Legion presented the Officer of the Year Award to Jerome McKown. The Honorable Senator Mike Jackson and numerous personnel from the Police Department were in attendance for the presentation. 6. Open Public Hearing — Mayor Malone opened the Public Hearing at 6:18 PM. Review by Staff — Director of Planning Doug Kneupper presented summary and recommendation outlining rezoning approximately 9.71 acres from Planned Unit Development (P.U.D.) to Medium Density Residential (R-2) zone. Mr. Kneupper noted that the Planning and Zoning Commission unanimously approved the request. Public Input — Spero Pomonis voiced his opinion against the change. Danny Manor, 3718 Sunrise, voiced his opinion against the change. J.L. Thompson, Tarpan Lane, voiced his opinion to stay with R-1 rating. Recommendation of Staff— Mr. Kneupper advised council they may want to table this item to a future meeting date due to the comments from citizens and council, otherwise, the recommendation of staff is to proceed forward with this change as approved by the Planning and Zoning Commission. Close Public Hearing — Mayor Malone closed the Public Hearing at 7:06 PM. 7. Council considered approving an ordinance amending ordinance number 1501, more commonly referred to as the Zoning Ordinance, by changing classification of that certain parcel of land herein described - approximately 9.71 acres from Planned Unit Development (P.U.D.) to Medium Density Residential (R-2) zone. City Attorney read: ORDINANCE 1051-HH — AN ORDINANCE AMENDING ORDINANCE NO. 1501, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY CHANGING CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Porter to approve the ordinance as presented by Mr. Kneupper. Second by Councilperson Gay. The motion carried. Council considered approving an ordinance authorizing a contract between the City of La Porte and the Bluebonnet Stroder Company for construction of the city-wide sidewalk replacement project FY 99-2000: appropriating $45,196 plus a contingency of $4,520 to fund said contract. Director of Planning Doug Kneupper presented summary and recommendations and answer questions for City Council. City Attorney read: ORDINANCE 2000-2373 - AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND THE BLUEBONNET STRODER COMPANY FOR CONSTRUCTION OF THE CITY- WIDE SIDEWALK REPLACEMENT PROJECT FY 99-2000: APPROPRIATING $45,196 PLUS A CONTINGENCY OF $4,520 TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council considered approving an ordinance authorizing the purchase of AS/400 upgrade for $119,389 from IBM Director of Administrative Services Louis Rigby presented summary and recommendations and answer questions for City Council. City Attorney read: ORDINANCE 2000-2374 - AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LA PO.RTE AND HTE, INC., OF ORLANDO, FLORIDA, TO PROVIDE AN OPERATING SYSTEM UPGRADE TO THE CITY'S IBM AS/400 COMPUTER SYSTEM; APPROPRIATING $119,389, TO FUND CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Ebow to approve the ordinance as presented by Mr. Rigby. Second by Councilperson Sutherland. Council considered awarding bid for Golf Course equipment to .Brookside Equipment, AMC Industries, .Lansdowne Moody, and Carruth Doggett Industries. Golf Course Superintendent Dennis Hlavaty presented summary and recommendations to City Council. Motion was made by Councilperson Sutherland to award the bid as presented by Mr. Hlavaty. Second by Councilperson Clarke. The motion carried unanimously. Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Mayor Malone. Nays: None Abstain: None 11. ADMINISTRATIVE REPORTS City Manager Robert T. Herrera reminded Council of the following events: A. Chamber of Commerce Installation Banquet — Sylvan Beach Pavilion — January 27, 2000 B. City Council Workshop Meeting January 17, 2000 12. COUNCIL ACTION Councilpersons Sutherland, Engelken, Ebow, Griffiths, Porter, and Gay brought items to Council's attention. 13. EXECUTIVE SESSION — PURSUANT TO PROVISION OF THE OPEN MEETINGS LAW, CHAPTER 551.071 THROUGH 551.076, AND 551.084, TEXAS GOVERNMENT CODE, - (CONSULTATION WITH ATTORNEY, DELIBERATION REGARDING REAL PROPERTY, DELIBERATION REGARDING PROSPECTIVE GIFT OR DONATION, PERSONNEL MATTERS, CONFERENCE WITH EMPLOYEES DELIBERATION REGARDING SECURITY DEVICES, OR EXCLUDING A WITNESS DURING EXANIINATION OF ANOTHER WITNESS IN AN INVESTIGATION) There were no items to be discussed in Executive Session. 14. Malone, Mayor • • 0 C� • December 31, 1999 Ed Butchee was hired as a La Porte patrol officer on October 9, 1976. He had worked for the Harris County Sheriff Buster Kern for six years before coming to La Porte. Ed worked in the Patrol Division until January 22, 1979, when he was transferred to the Criminal Intelligence Division (C.I.D.). It was through his efforts there that he was nominated and awarded the 100 Club Officer of the Year on January 20, 1981. He was promoted to Sergeant on December 25, 1981, and has worked in the Patrol CID, and Special Operations Divisions since that time. Ed says that after completing his multi -page "honey do" list, he will be doing plenty of fishing. Public Notice Reply Form Summary & Recommendation The Planning & Zoning Commission, during its December 16, 1999 meeting, held a public hearing to receive citizen comments regarding Rezone Request #R99-004. The Whittenton's approached City staff about building a single-family residence on a 0.512 acre tract that they own and is currently zoned P.U.D. Current regulations require a minimum 5 acre site for development in a P.U.D. zone. Planning Dept. staff and the applicant are requesting this rezone for the following reasons: o Development of a single-family house on an existing '/2 acre, subdivided lot is not an effective use of P.U.D. zoning. o This is an opportunity to remove some existing subdivided lots, and existing townhouses and condos from the P.U.D. zone and place them in a more appropriate (R-2) zoning district. Staff has studied the existing land uses of nearby properties. The area in question is surrounded by single-family dwellings to the north and south, to the east by townhouses and condos, and to the west by undeveloped tracts along the Bayou. With the extent and nature of existing development, the area is suitable for the Mid Density Residential (R-2) zoning district, where Single Family Residential is a permitted use. Staff, using the City's Zoning Map and Land Use plan as a guide, finds this area suitable for a limited amount of residential development. The current land use and development pattern also conforms to the proposed use. Creating a small Medium Density Residential (R-2) zone at this location would not run contrary to the intents of the Comprehensive Plan. Moreover, the development within this area should not negatively impact the surrounding properties and should not harm the value of the nearby properties. For the public hearing, 35 notices were mailed to surrounding property owners with two responses. One was in favor and the other no longer owns the property there. After receiving public input, the Planning and Zoning Commission, by unanimous vote, has recommended approval of Rezone Request #R99-004. Action Reguired by Council: Consider approval of an Ordinance rezoning approximately 9.71 acres from Planned Unit Development (P.U.D) to Medium Density Residential (R-2) zone. This new computer, an IBM AS/400, was bought to run the new software applications that the City purchased from the HTE Corporation. Both IBM and HTE advised the City that once the AS/400 approaches or surpasses 80% capacity, we should consider upgrading the model with more memory. Recognizing that with the applications and databases installed, the AS/400 would surpass the recommended capacity, $120,000 was budgeted in this year's operating budget to upgrade the AS/400 located at City Hall. In 1998, Council approved replacing the hardware and software used by the Police Department and Municipal Court because the vendor was no longer supporting portions of the software that the City deemed important and they also could not guarantee Y2K compliance with the Municipal Court applications. Due to the interface that Municipal Court has with the Finance applications, including posting payments, a decision was made to install the Municipal Court applications on the AS/400 at City Hall, rather than on the one at PD. This installation, along with the current data, pushed the capacity in use to just over 91%. While still operative, this reduces the reaction time of all applications thus reducing productivity. The cost of the upgrade is $119,389, and, as stated above, sufficient funds were budgeted for this item. Staff researched further and found that although an upgrade to the next level would be sufficient, we could upgrade one more level for the funds budgeted, and reduce the capacity in use to approximately 30%. With no more new applications forecasted, this upgrade should last at least five (5) years. Upgrading the hardware is exempt from competitive bidding for two reasons. One, it is a captive replacement part (IBM parts for an IBM computer) and two, we are purchasing the upgrade from the state contract, through IBM. In other words, the State of Texas has already bid this item. In order to expedite this upgrade, a purchase order has been issued and the replacement should be delivered and installed by mid -February.
