CALL TO ORDER The meeting was called to order by Mayor Norman Malone at 6:00 p.m. Members of City Council Present: Councilpersons Guy Sutherland, Chuck Engelken, Howard Ebow, Peter Griffiths, Alton Porter (arrived at 6:50PM), Deotis Gay, Charlie Young, Jerry Clarke, and Mayor Norman Malone. Motion was made by Councilperson Engelken to approve the minutes of the Regular Meeting, and Public Hearing as presented. Second by Councilperson Ebow. The motion carried. Council considered approving the minutes of the Special Called Workshop Meeting on January 17, 2000. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAXPAYERS WISHING TO ADDRESS COUNCIL. There were no citizens wishing to address Council. 6. Presentations: A. Bill White introduced Sandy Dwyer from La Porte High School. Ms. Dwyer introduced the 1999 American Legion Post 428 La Porte High School Representatives for the Boys' State and Girls' State. The following young men and women were in attendance at the Council Meeting: Henry Poullard, James Yancy, John Joiner, Chace Urich, Shawn Smith, Kelly Herrick, Jill Crocker, Darcy Rivas, Courtney Tolles. B. Recognition of participation in the community rating system - Assistant City Manager John Joerns advised City Council, the Federal Emergency Management Association makes available to communities, on a voluntary basis, participation in a community rating program. If you exceed the basic requirements of the National Flood Plan Program, then your community is eligible for a discount in flood insurance. Since October 1, 1999, La Porte has become one of these communities and our participation in this program has made eligible a 10 % reduction on all flood insurance policies that are in zones B, C, and X, and a 5% reduction for all flood insurance policies that are in special hazard zones which are flood plan A's or the coastal zones. Mr. Joerns presented Director of Planning Doug Kneupper with a plaque from the Federal Emergency Management Association recognizing the City of La .Porte for participation in this program. 7. Public Meeting to discuss Risk Management Plan (RMP) for the Wastewater Plant as required by the Environmental Protection Agency (EPA) — S. Gillett. The City of La Porte has developed a Risk Management Plan (RMP) for the Little Cedar Bayou Wastewater Treatment Plant, as required by the EPA. The RMP, which is identical to plans developed by local industry, is required due to the storage of a regulated substance in excess of the threshold amount (Chlorine — over 2,200 pounds). The Wastewater Plant typically stores 12,000 pounds of Chlorine for disinfection purposes. The City of La Porte is required to hold a public meeting by February 1, 2000 to discuss the RMP. Receive Public Input — There were no citizens wishing to address this item. Public Meeting was closed at 6:32 PM. 8. Council considered approving a resolution approving the resale of tax properties. Offer from Ignacio Ramirez for Lot 3-4 & 13-14 Block 100 of Town of La Porte. Bid amount - $10,500, appraised value - $28,100, approximate amount due - $16,500. City Attorney read: RESOLUTION 2000-05 — A RESOLUTION AUTHORIZING THE RESALE OF CERTAIN PROPERTY TO DAE INTERESTS. Motion was made by Councilperson Engelken to approve the resolution as presented by Mr. Litchfield. Second by Councilperson Griffiths. The motion carried. Council considered approving an ordinance authorizing a drainage easement from the City of La Porte to Union Pacific Railroad Company. Union Pacific Railroad requested a 10' easement of the City for property it owns along the north -south corridor from the Strang Yard to Fairmont Parkway. Concurrent with this request, the City of La Porte worked closely with the Union Pacific Railroad to acquire property for the F101 Drainage Project. The sale of the needed property was successfully concluded at a favorable rate to the City, and it was recommended that the Drainage • City Council Minutes — January 24, 2000 — Page 5 easement requested by Union Pacific Railroad be grated at no cost. All filing and recording costs will be paid by Union Pacific Railroad. Assistant City Manager John Joems presented summary and recommendations and answer questions for City Council. Herrera Date City Manager • • LITTLE CEDAR BAYOU WASTEWATER TREATMENT PLANT NO. 1 RISK MANAGEMENT PLAN EXECUTIVE SUMMARY The City of La Porte operates the Little Cedar Bayou Wastewater Treatment Plant No. 1 located at 1301 S. 4'' Street in La Porte. In the processes of this plant, only one (I) -regulated substance is utilized in quantities above the threshold amount. This substance, chlorine liquefied under pressure, is used as a disinfectant to treat the treatment plant effluent prior to discharge to Little Cedar Bayou and thence to Galveston Bay. This process assures the safety and water quality of the receiving stream and the general public. Chlorine is contained in one ton cylinders of which two (2) are fed in tandem through a chlorinator mechanism and into the plant effluent. Two cylinders are always on line to actively feed and four (4) cylinders are in inventory to ensure constant availability of chlorine as required by State and Federal regulations. The total maximum amount of chlorine on hand is 12,000 pounds. For purposes of this plan, a Worst Case Scenario was examined where the total content of one cylinder of chlorine was released into the atmosphere by catastrophic failure of the cylinder. This release was over duration of 10 minutes with a total chemical release of 2,000 pounds. This type of release would affect an area of 1.3 miles radius of the plant site with approximately 2,600 citizens being affected. A more realistic scenario was examined where a line leak occurred where a release of 630 pounds of chemical was released over a 60-minute duration. This type of leak would affect an area of approximately 0.1 miles radius of the plant. There are no permanent residents within this area. No citizens would be affected by this size release. Within the past five (5) years there has been no release of chlorine gas beyond the immediate vicinity of the chlorine building. No chlorine gas has escaped the perimeters of the plant site. All plant personnel are trained, both classroom and on-the-job, in the proper methods of handling chlorine both as a gas and as a liquid. The equipment is regularly checked for operation within the required tolerances and is routinely changed as it nears the minimum operating levels. There are written operations and maintenance manuals describing the step-by-step procedures on maintenance and replacement of chlorine cylinders. A hazard review has been performed attempting to determine the consequences of both man-made and natural conditions that could cause a release of chlorine into the atmosphere and determining the proper response for each condition. Plant personnel have written guidelines and procedures of required actions should a leak occur. These include notification of the La Porte Fire Department's Emergency Response Team along with requesting assistance of our local chlorine vendor. The public would be notified, if required, through the activation of the City of La Porte's Whelan System of audible alarms and/or the FirstCall system which can be programmed to call all telephones within the affected area of the release. In addition, there is an AM 830 radio station which broadcasts information to the public in emergency situations and a paging system to notify all City employees and all School District employees of the emergency. Plant and response personnel perform annual drills through the La Porte Emergency Operations Center which test the adequacy and the knowledge of response procedures. Any deficiencies found to exist from these drills are addressed and necessary changes made. This facility has been located at this site for over thirty years without any major releases of chlorine occurring. The La Porte Tax Office actively markets these resale properties. When a bid is received that is greater than either the amount due on the property or the HCAD appraised value, the Tax Office is able to complete the sale. If a bid is received that is less than either the amount due or the HCAD appraised value, then the sale requires the approval of all three taxing entities. Tonight, we are bringing five properties before you for your consideration. In all cases, the amounts due are less than either the amount due or the appraised value. We are recommending the City Council approve all five of the sales so at least a portion of the back taxes can be recovered and the properties can be placed back on the tax roll as tax producing properties. As a part of the Project, Union Pacific desires to provide drainage for this new track along the western edge of the facility. A ten -foot (10') easement was requested of the City for property it owns along this route — the Public Works and. Fire Training Facilities. Concurrent with this request, the City of La Porte worked closely with the Union Pacific Railroad to acquire property for the F101 Drainage Project. The sale of the needed property was successfully concluded at a favorable rate to the City, and it is recommended that the Drainage easement requested by Union Pacific Railroad be granted at no cost. In addition, Grantee shall have the right to use such additional space as may be necessary for the construction, maintenance and repair of the drainage Swale along the route of some. Grantor further grants and conveys unto Grantee the right of ingress and egress on, over, across and through said ten foot (10') strip of land for all purposes necessary or incidental to the exercise of the rights herein granted. Grantor reserves the right to use and enjoy said lands except as may be necessary for like purposes herein granted, provided Grantor shall not construct or permit to be constructed any house, structure, reservoir or other obstruction or excavation on, over or within said permanent right of way and easement and will not change the grade of any drainable Swale constructed hereunder; however, Grantor specifically reserves the right for perpendicular crossings of Grantee's drainage Swale with pipelines, roads, streets, driveways, rail spurs, water lines, sewer lines and other utilities or facilities constructed so as to not Interfere with Grantee's drainage Swale. The consideration recited above shall constitute the full consideration for the right of way and easement herein granted, and for normal construction damages. Grantee further agrees to pay for all damages to growing crops, fences and timber on said land which may be caused In the future by the exercise of the rights granted hereunder, provided that after the drainage Swale has been constructed, Grantee shall not be liable for damages caused by keeping the said right of way area clear of trees, undergrowth, brush and obstructions. The terms and provisions hereof shall be binding upon and shall inure to the benefit of the heirs, personal representatives, successors, and assigns of Grantor and Grantee, and Grantee is expressly granted the right to assign tills right of way and easement, or any part thereof or interest therein, and the same shall be divisible among two or more parties as to any right or interest created hereunder. This agreement may be executed in counterparts and shall be binding upon each party executing any counterpart. Each such counterpart so executed shall have the same force and effect as an original Instrument as If all of the parties to the aggregate counterparts had signed in the same instrument. Signature pages and acknowledgments from separate counterparts [pay be combined and attached to one counterpart for recording purposes. This agreement Is the result of open and extended negotiations between the parties hereto, each Party having contributed toward the drafting hereof. directly and/or by counsel. Additionally, attached is a letter from John Joems discussing the granting of this easement, which is linked to the Railroad's sale of property to the City of La Porte for the F101 Project. John advises that this sale has closed. In return for the favorable price, the City agreed to grant the drainage easement at Public Works without compensation. Dear Mr. Morrissey, I have reviewed your request for a permanent 10' utility easement from the City. The location adjacent and parallel to the UPRR does not effect City operations. However, if granted, the City requests that the natural overland flow from our adjacent undeveloped property be allowed to drain to the proposed drainage swale. Additionally, as you are aware, the easement will be subject to other rights previously granted to Houston Lighting & Power. The City Manager's office is prepared to recommend granting this 10' easement without compensation. This recommendation is based on our recent successfully negotiated price of $87,891.48 for the property (and 3.27 + acre remnant) needed for the CitYs F101 drainage project. This recommendation. to City Council will also request that execution of the easement be withheld until the City and UPRR close the above referenced transaction. Please understand that this drainage project is extremely important to our city. It has been planned for over thirteen years and has been implemented in phases. The UP parcel is the last parcel needed to let a construction contract for the next phase of work budgeted by Hams County Flood Control District. Once the form of easement is received I will forward it to our City Attorney for review and if in order, present it to City Council for their consideration.
