CALL TO ORDER The meeting was called to order by Mayor Norman Malone at 6:00 p.m. Members of City Council Present: Councilpersons Guy Sutherland, Chuck Engelken, Howard Ebow, Alton Porter, Peter Griffiths, Deotis Gay, Charlie Young, Jerry Clarke, and Mayor Norman Malone. Members of Council Absent: None Members of City Executive Staff and City Employees Present: City Manager Robert T. Motion was made by Councilperson Engelken to approve the minutes of the Regular Meeting and Public Hearing as presented. Second by Councilperson Ebow. The motion carried. Mayor Malone and EMS Chief Chris Osten presented Paramedic Lisa Camp with the Employee of the Quarter Award for July, August, and September 1999. 6. Open Public Hearing - Mayor Malone opened the Public Hearing at 6: 15 PM. Review by Staff - City Planner Brad Ellis presented summary and recommendations concerning rezoning parts of Tract 8A, 8C, and 8E, Block 2 ofW.J. Payne Survey, part of Tracts 8A, and 9A, of the W.J. Payne Survey, located in the 10000 Block of West Main Street La Portl~, Harris County, Texas from High Density Residential (R-3) to General Commercial (GC). Public Input - No public input. Review by Staff-City Planner Brad Ellis presented summary and recommendations concerning rezoning Blocks 328, 329, 330, and 331, from General Commercial (GC) to Business Industrial (BI). Public Input - No public input. Recommendation of Planning and Zoning/Staff - Planning & Zoning and Staff recommending Blocks 328, 329, 330, and 331, from General Commercial (GC) to Business Industrial (BI). Council considered approving an ordinance amending Ordinance 150 I, more commonly referred to as the zoning ordinance of the City of La Porte, by changing classification of that certain parcel of land herein described - rezone Blocks 328, 329, 330, and 331, from General Commercial (GC) to Business Industrial (BI). City Planner Brad Ellis presented summary and recommendation and answered City Council's questions. Council considered approving an ordinance authorizing a construction contract between the City of La Porte and R. Hassell Builders, Inc., for the construction of the La Porte Community Li,brary; appropriating $2,591,900.00, to fund said contact. City Attorney read: ORDINANCE 2000-2400 - AN ORDINANCE APPROVING AND AUTHORIZING A CONSTRUCTION CONTRACT BETWEEN THE CITY OF LA PORTE AND R. Council considered approving an ordinance authorizing an agreement between the City of La Porte and Harris County, providing for the operation of the Harris County Library-La Porte Branch, :for an initial term commencing January 1, 2001. Administrativf: Assistant Carol Buttler presented summary and recommendation and answered City Council's questions. City Attorney :read: ORDINANCE 2000-2401 - AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LA PORTE AND HARRIS COUNTY, PROVIDING FOR THE OPERATION OF THE HARRIS COUNTY LIBRARY-LA PORTE BRANCH, FOR AN INITIAL TERM COMMENCING JANUARY 1, 2001; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN EFFECTNE DATE HEREOF. Motion was made by Councilperson Ebow to approve Ordinance 2000-2401 as presented bv Ms. Buttler. Second by Councilperson Griffiths. The motion carried. Council received a report regarding a street end petition for conversion of Bayshore Drive into a Park and providing direction. Director of Parks and Recreation Stephen Barr provided a report on Bayshore Drive. Council directc~d staff to move forward with this project. 13. ADMINISTRATIVE REPORTS City Manager Robert T. The award will be presented to Lisa Camp, Paramedic III, EMS/Fire Department. Congratulations to Lisa Camp, Paramedic III, for being selected as Employee of the Quarter for July, August & September 1999. Lisa was nominated by Ray Nolen, Paramedic Supervisor and has served in the EMS Division for eight years. Ray has stated, "Lisa has a strong sense of responsibility and is matched by a personable nature. Recently Lisa has implemented a program that will have a lasting effect on our community. She started a child immunization program, free to any child. She coordinated the locations, secures the medications, and ensures that there are enough personnel to administer the shots. Lisa ensures that all our Paramedics not only receive the state-mandated education, but also the training on innovative techniques to guarantee that our paramedics are the best they can be. Lisa never complains about the extra tasks that have been assigned to her, or projects that she has implemented. She takes these tasks on with eagerness unmatched by most." Ordinance 1501- 2. Figures Summary & Recommendation The Planning and Zoning Commission, during its March 16, 2000, meeting held a public hearing to receive citizen comments regarding the Rezone Request #R99-005. The joint request submitted by Ms. Zelda Wright and Mr. Eddie Gray, seeks to rezone parts of Tract 8A, 8C and 8E, BLK 2 of the W.J. Payne Survey; part of Tracts 8A and 9A, of the W.J. Payne Survey The Property is located in the 10000 Block of West Main Street (Spencer. Highway). The applicants are seeking a zone change to allow construction of a building and additional parking for the expansion of an existing business, Two Cajuns Cafe. The Requested zone change is from High Density Residential (R-3) to General Commercial(GC). The site under consideration comprises 5.08 acres, which includes the La Petite Academy, and Two Cajuns care and an undeveloped parcel. This site is currently zoned R-3. The surrounding area is comprised of apartments to the west undeveloped land to the north, residential to the ~ and south. The Two Cajuns Cafe is a nonconforming use and the proposed expansion of the restaurant is prohibited under Section 106-263 of the Code of Ordinance under its current zoning of Residential (R-3). Before any expansion of the restaurant occurs, the site must be rezoned to General Commercial (GC), where restaurant is a permitted use. The effect of the change in zoning from R-3 to GC should not have an adverse impact upon the infrastructure. The overall impact on public services should be minimal. Spencer Highway, a major thoroughfare should have the additional capacity to aCcOinmodate the traffic generated by the restaurant. The impact upon the public health, safety, and welfare of the City will be minimal. The zone change from R-3 to GC would fit into the character of the local area. A restaurant and other possible uses that are allowed in a GC district would be compatible in an area that includes a mixture of single fiunily, apartment and other. commercial uses. The proposed zoning change would be in character with the current land use plan, which calls for either commercial or high-density residential land use for the site under consideration. The request submitted by Narsi Inc., seeks to rezone lots 1 through 32 of Block 329, La Porte from General Commercial (GC) to Business Industrial (BI). Staff has added blocks 328, 330 and 331 to provide a more uniform zoning along Barbour's Cut Blvd. The site under consideration comprises 9.18 acres which currently is zoned General Commercial (GC). The site for the proposed rezoning is located along Barbour's Cut Blvd., which is the main truck route for trucks transporting loads to or from the port facility. The surrounding area has numerous businesses that are located there due to the proximity to the Barbour's Cut Container Tenninal. The notable exception is the residential neighborhood directly to the south of the site. The effect of the change in zoning from GC to BI should not have an adverse impact upon the infrastructure. The overall impact on public services should be minimal. Barbour's Cut Blvd. is the primary truck route for the port facility and should have additional capacity to handle the traffic generated by this site. The impact upon the public health, safety, and welfare of the City will be minimal. The zoning change from GC to BI would fit into the character of the local area. A truck sales center or other possible uses that is allowable in a BI district would be compatible with the surrounding uses that range from industrial to residential. LoCAL GoV'T CODE ANN. ~323.008 (VERNON 1999); and WHEREAS, the County is willing to operate the Library, provided the City maintains the building as provided herein; NOW, THEREFORE, the City and COWlty, in consideration of the mutual covenants and agreements herein contained, agree as follows: I. Following the completion of the construction of the building for the Harris County Public Library-La Porte Branch by the City, the City will own the Library building and will provide maintenance for the Library building including, but not limited to, the air conditioning and heating equipment, walls, doors, doorways, floors, floor covering, ceilings, windows and roof, and will provide grounds maintenance, landscaping, garbage pick up and janitorial service for the Library on a regular basis. The City will also provide utilitie,l; and pay the utility bills at the Library. The City will also provide furniture and furnishings for the Library, and will maintain the furniture and furnishings it provides. The City will retain ownership of furnishings and fixtmes provided by the City. ' ll. The County will operate the Library and provide a full range of library materials for the Library, which are customarily provided in public library programs to the citizens of Harris County. The County will provide support services for the Library including acquisitions, cataloging and processing of all materials; delivery of materials; continuing education for the staff; management support for the operation of the Library; and a technology system for the Library. m. The COWlty will fonnulate the policies and procedmes of operation of the Library, and will schedule the use of the meeting room in the Library. The City will coordinate, with the La Porte Branch librarian, scheduling and use of the meeting room for any and all City hosted or sponsored activities. e e IV. The County will appoint as many librarians, library aides and other support staff as are necessary to provide library services. The programs will be under the complete supervision, management, control and direction of the County. The City will not direct or supervise the County or any of its employees. The City will look to the County for results only. The County employees are to be directly responsible to the County and will receive their salaries from the County. v. The County retains ownership of furnishings, books and equipment furnished by the County inside the building. The County will maintain the furnishings provided by the County. VI. The County will provide fax and data communication lines for the Library's Information Technology System. The County will provide photocopy machines for both staff and public use. The City will purchase computer and printer equipment to open the library, according to County Library specifications. The City has no duty to maintain, repair and replace the computer and printer equipment, nor purchase any additional computer and printer equipment. VIT. The term of this Agreement is for a period of one (1) year, beginning on January 1,2001 and ending December 31, 2001. The term of this agreement will be automatically extended for one-year periods, provided, however, notwithstanding anything herein to the contrary, or that may be construed to the contrary, either party may terminate this agreement at any time upon thirty (30) days prior written notice to the other party. vm. In the event of the County's default in any of the terms or provisions for this agreement, the sole remedy of the City is to terminate this agreement. IX. All notices and communications required or permitted to be given by the County to the City under this Agreement may be given by registered or certified U.S. Mail, postage prepaid, return receipt requested, addressed to City Manager, City of La Porte, P.O. Tabulation of Street End Petition - Bayshore Drive @ "F" Street Area Map Exhibits: SUMMARY & RECOMMENDATION In January of thIS year, staff presented a workshop repo" on a proposal to utilize street enas along Galveston Bay as parkland. There were a number of citizens in attendance at the meeting who opposed the proposal across the board. Council's consensus was that: Council does not want staff to move forward with any of the proposals presented. However, there may be some merit in particular cases and the City should look at each individual case as they may come up in the future. This matter will not be pursued any further by the City at this point. "any resident has a particular request for a particular street ending, they need to contact the City regarding their special request. /fthe City receives an application to close a street/alley, all residents within 500 feet will be contacted. On February 3, 2000 the City received a petition from a number of residents of the Pine Bluff subdivision requesting that the City provide a park at the Bayshore street end at its intersection with "F" Street. As instructed. City staff determined which property owners fell within the 500-foot radius of the subject street end, On February 10th the City mailed certified letters to the 43 property owners of record that fell within the designated 500 foot radius of the subject area in the Pine Bluff, Crestview, and Bayside Terrace subdivisions. The letter asked each property owner to "vote" for 1 of 3 choices; 1) to leave the property,\as is", 2) to "close the property by selling the right of way to the adjacent property owners", or 3) "to convert__ the property into a park". The City received 39 returns from the post office indicating that the letters had been received, 4 were unclaimed. One property owner, Ms. Ann Holmes, received 2 letters because her property is in both subdivisions. We only used one of her responses leaving 38 responses. Of the 38 received, 16 property owners or 42% did not respond. Of the remaining responses 4 property owners, or 10.5% voted to keep the property "as is", 3 property owners, or 7.9% voted to allow the property to be "closed to the adjacent property owners", and 15 property owners, or 39% voted to turn the subject property into a park. The largest group of property owners was non-responsive to the letter. Of this group of 16,8 property owners were from the Bayside Terrace or Crestview subdivisions, and 2 were companies (Le. Boy's Harbor), Of the 30 property owners in Pine Bluff, the majority (53%) were in favor of converting the property into a park. Staff recommends approval of conversion of the street end at Bayshore Drive Street End @ "P' Street into a City park, with funding for the project in the amount of $25,000 to be taken from the Capital Improvement Contingency Account, should Council approve. Officer's Alan Gudgell and Marcus Upchurch found that a 1985 Mazda driven by RYAN MINK, 21 YOA, of 5229 G1envalley, had struck a 10-year old boy riding a bicycle. The child was identified as MATlHEW ADAMS of 4902 Parkcrest Street. The child was injured by the impact and was subsequently transported to Memorial-Hermann Hospital by Lifetlight. He was reported in stable condition Sunday evening. An accident reconstruction specialist, Officer Jeff Tippit, was called to the scene to reconstruct the accident. Preliminary findings are that the bicyclist was west-bound on Parkcrest and entered the intersection after disregarding the stop sign. He was struck by the automobile driven by Mr. Mink, which was north-bound on Glenmeadows at what appears to be at a higher than legal rate of speed. The speed limit on Glenmeadows is 30 MPH. The accident rem9-in!; under investigation and the filing of any charges is pending the completion of the investigation.
