MINUTES OF THE REGULAR MEETING AND PUBLIC HEARINGS
OF LA PORTE CITY COUNCIL
APRIL 10, 2000
1. CALL TO ORDER
The meeting was called to order by Mayor Norman Malone at 6:00 p.m.
Members of City Council Present: Councilpersons Guy Sutherland, Chuck Engelken,
Howard Ebow, Alton Porter, Peter Griffiths, Deotis Gay, Charlie Young, Jerry Clarke,
and Mayor Norman Malone.
Members of Council Absent: None

3. Council considered approving the minutes of the Regular Meeting and Public Hearing
on March 27,2000.
Motion was made by Councilperson Engelken to approve the minutes of the Regular
Meeting and Public Hearing as presented. Second by Councilperson Ebow. The
motion carried.

5. PROCLAMATIONS/PRESENT A nONS
A. Mayo:r Malone presented a Proclamation to Deborah Moseley and Deloris Tully
from the Bridge in recognition of April as Sexual Assault Awareness Month.
B. Mayor Malone and EMS Chief Chris Osten presented Paramedic Lisa Camp with
the Employee of the Quarter Award for July, August, and September 1999.
6. Open Public Hearing - Mayor Malone opened the Public Hearing at 6: 15 PM.
Review by Staff - City Planner Brad Ellis presented summary and recommendations
concerning rezoning parts of Tract 8A, 8C, and 8E, Block 2 ofW.J. Payne Survey, part of
Tracts 8A, and 9A, of the W.J. Payne Survey, located in the 10000 Block of West Main
Street La Portl~, Harris County, Texas from High Density Residential (R-3) to General
Commercial (GC).

Recommendation of Planning and Zoning/Staff - Planning & Zoning and Staff

City Planner Brad Ellis presented summary and recommendation and answered City
Council's questions.

ORDINANCE NO. 1501, MORE COMMONLY REFERRED TO AS THE ZONING
ORDINANCE OF THE CITY OF LA PORTE, BY CHANGING CLASSIFICA nON
OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; MAKING

8. Open Public Hearing - Mayor Malone opened the Public Hearing at 6:26 PM.
Review by Staff-City Planner Brad Ellis presented summary and recommendations
concerning rezoning Blocks 328, 329, 330, and 331, from General Commercial (GC) to
Business Industrial (BI).
Public Input - No public input.
Recommendation of Planning and Zoning/Staff - Planning & Zoning and Staff

9. Council considered approving an ordinance amending Ordinance 150 I, more commonly
referred to as the zoning ordinance of the City of La Porte, by changing classification of
that certain parcel of land herein described - rezone Blocks 328, 329, 330, and 331, from
General Commercial (GC) to Business Industrial (BI).
City Planner Brad Ellis presented summary and recommendation and answered City
Council's questions.

10. Council considered approving an ordinance authorizing a construction contract between
the City of La Porte and R. Hassell Builders, Inc., for the construction of the La Porte
Community Li,brary; appropriating $2,591,900.00, to fund said contact.

11. Council considered approving an ordinance authorizing an agreement between the City of

12. Council received a report regarding a street end petition for conversion of Bayshore
Drive into a Park and providing direction.
Director of Parks and Recreation Stephen Barr provided a report on Bayshore Drive.
Council directc~d staff to move forward with this project.

Subject:
Please include an Employee of the Quarter award presentation on the Agenda for the
Council Meeting scheduled on April 1 oth, 2000. The award will be presented to Lisa
Camp, Paramedic III, EMS/Fire Department.
Congratulations to Lisa Camp, Paramedic III, for being selected as Employee of the
Quarter for July, August & September 1999. Lisa was nominated by Ray Nolen,
Paramedic Supervisor and has served in the EMS Division for eight years.
Ray has stated, "Lisa has a strong sense of responsibility and is matched by a
personable nature. Recently Lisa has implemented a program that will have a lasting
effect on our community. She started a child immunization program, free to any
child. She coordinated the locations, secures the medications, and ensures that there
are enough personnel to administer the shots. Lisa ensures that all our Paramedics
not only receive the state-mandated education, but also the training on innovative
techniques to guarantee that our paramedics are the best they can be. Lisa never
complains about the extra tasks that have been assigned to her, or projects that she
has implemented. She takes these tasks on with eagerness unmatched by most."
Lisa is an outstanding Paramedic and has made a real impact on our community; she
is well deserving of Employee of the Quarter.

Summary & Recommendation
The Planning and Zoning Commission, during its March 16, 2000, meeting held a public hearing to
receive citizen comments regarding the Rezone Request #R99-005. The joint request submitted by Ms.
Zelda Wright and Mr. Eddie Gray, seeks to rezone parts of Tract 8A, 8C and 8E, BLK 2 of the W.J.
Payne Survey; part of Tracts 8A and 9A, of the W.J. Payne Survey The Property is located in the 10000
Block of West Main Street (Spencer. Highway). The applicants are seeking a zone change to allow
construction of a building and additional parking for the expansion of an existing business, Two Cajuns
Cafe. The Requested zone change is from High Density Residential (R-3) to General Commercial(GC).
The site under consideration comprises 5.08 acres, which includes the La Petite Academy, and Two
Cajuns care and an undeveloped parcel. This site is currently zoned R-3. The surrounding area is
comprised of apartments to the west undeveloped land to the north, residential to the ~ and south.
The Two Cajuns Cafe is a nonconforming use and the proposed expansion of the restaurant is prohibited
under Section 106-263 of the Code of Ordinance under its current zoning of Residential (R-3). Before
any expansion of the restaurant occurs, the site must be rezoned to General Commercial (GC), where
restaurant is a permitted use.
The effect of the change in zoning from R-3 to GC should not have an adverse impact upon the
infrastructure. The overall impact on public services should be minimal. Spencer Highway, a major
thoroughfare should have the additional capacity to aCcOinmodate the traffic generated by the restaurant.
The impact upon the public health, safety, and welfare of the City will be minimal.
The zone change from R-3 to GC would fit into the character of the local area. A restaurant and other
possible uses that are allowed in a GC district would be compatible in an area that includes a mixture of
single fiunily, apartment and other. commercial uses.
The proposed zoning change would be in character with the current land use plan, which calls for either
commercial or high-density residential land use for the site under consideration.

TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY CHANGING
CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED;
MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING

DATE HEREOF;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
"Section 1. The City Council of the City of La Porte hereby finds,. determines
and declares that heretofore, to-wit, on the 16th day of March, 2000, at 6:00 p.m. a
Public Hearing was held before the Planning and Zoning Commission of the City of La
Porte, Texas, pursuant to due notice as required by the Open Meetings Law, Chapter
551, Texas Government Code, to consider the question and the possible
reclassification of the zoning classification of the hereinafter described parcels of land.
There is attached to this Ordinance as Exhibit "A", and incorporated by reference herein
and made a part hereof for all purposes, a copy of Notice of Public Hearing which the
City Council of the City of La Porte hereby finds was properly mailed to all owners of all
properties located within two hundred feet (200') of the properties under consideration.
"Section 2. The publisher's affidavit of publication of notice of said hearing is
attached hereto as Exhibit "B", incorporated by reference herein and made a part
hereof for all purposes.
"Section 3. Subsequent to and immediately following such public hearing, the
Planning and Zoning Commission of the City of La Porte met in regular session to
consider the changes in classification which were the subject of such public hearing.
The City Council of the City of La Porte is in receipt of the written recommendations of
the City of La Porte Planning and Zoning Commission, by letter dated March 17,2000,

a true copy of which letter is attached hereto as Exhibit "C", incorporated by reference
herein and made a part hereof for all purposes.
"Section 4. Subsequent to receipt of the recommendation of the City of La
Porte Planning and Zoning Commission, the City Council of the City of La Porte called a
public hearing on the proposed classification changes and the recommendation of the
Planning and Zoning Commission on the 10th day of April, 2000, at 6:00 p.m., and
pursuant to due notice, to consider the recommendation of the Planning and Zoning
Commission regarding the possible reclassification of the zoning classification of the
hereinafter described parcels of land. There is attached to this Ordinance as Exhibit
"0", incorporated by reference herein and made a part hereof for all purposes, a copy of
the notice of public hearing which the City Council of the City of La Porte hereby finds
was properly mailed to the owners of all properties located within two hundred feet
(200') of the properties under consideration.
"Section 5. The publisher's affidavit of publication of notice of said hearing is
attached hereto as Exhibit "E", and incorporated by reference herein and made a part
hereof for all purposes.
"Section 6. The City Council of the City of La Porte hereby accepts the
recommendation of the City of La Porte Planning and Zoning Commission, and the
zoning classification of the hereinafter described parcels of land, situated within the
corporate limits of the City of La Porte, is hereby changed, and the zoning classification
of said parcels of land shall hereafter be "G.C. - General Commercia!." The description

and declares that all prerequisites of law have been satisfied and hereby determines
and declares that the amendments to the City of La Porte Zoning Map and
Classification contained in this Ordinance as amendments to City of La Porte Zoning
Ordinance No. 1501 are desirable and in furtherance of the goals and objectives stated
in the City of La Porte's comprehensive plan Ordinance No. 1501 (A),
"Section B. The City Council officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public at the City Hall of the city
for the time required by law preceding this meeting, as required by the Open Meetings
Law, Chapter 551, Texas Government Code; and that this meeting has been open to
the public as required by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted upon. The City
Council further ratifies, approves and confirms such written notice and the contents and
posting thereof.

In accordance with the provisions of Section 106-171 of the Code of Ordinances of the City
of La Porte, and the provisions of the Texas Local Government Code, notice is hereby given that the
La Porte Planning and Zoning Commission will conduct a public hearing at, 6:00 P oM. on the 16th
day of March, 2000, in the Council Chambers of the City Hal~ 604 West Fairmont ,Parkway, La
Porte, Texas. The purpose of this hearing is to consider rezone request #99-005, which has been

Subdivision, known as Two Cajuns Restamant located at 10003 Spencer Highway. The request

General Commercial (GC).
On the recommendation of the staft: adjoining properties on tract BE (.7346 ac) known as be-
Petite-l>aY"eare~Center and a 4.312 acres out of tract SA, W.J. Payne Subdivision, Block 2, La
Porte, Harris County, will also be looked as a comprehensive rezoning to achieve orderly
development in conformance with the Zoning Ordinance.
A regular meeting of the Planning and Zoning Commission will follow the public hearing
for the purpOse of acting upon the public hearing items and to conduct other matters pertaining to
the Commission. .
Citizens wishing to address the Commission pro or con during the Public Hearing will be
required to sign in before the meeting is convened.

The La Porte Planning and Zoning Commission, during its March 16, 2000,
meeting, held a public hearing to consider Rezone Request IR99-005. The
request, submitted by Ms. Zelda Wright of Two Cajuns Cafe at 10003 West
Main Street, seeks to rezone the said property to allow expansion of the
existing business. The applicant seeks to have the property rezoned from
Multi-family Residential (R-3) to General Commercial (GC).
On the recommendation of staff, the prop.!:!rty at TR SC, SE, and Pts. TR SA,
W. J. Payne Subdivision, Block 2 of the W. Jones Survey, A-4S2, La Porte,
Harris County have been considered to provide additional GC zoning for the
vacant property adjacent to We~t Main Street.
The Planning and Zoning Commission, by unanimous vote, has recommended

Summary & Recommendation
The Planning and Zoning Commission, during its March 16, 2000, meeting held a public hearing to
receive citizen comments regarding the Rezone Request #ROO-OO 1. The request submitted by Narsi Inc.,
seeks to rezone lots 1 through 32 of Block 329, La Porte from General Commercial (GC) to Business
Industrial (BI). Staff has added blocks 328, 330 and 331 to provide a more uniform zoning along
Barbour's Cut Blvd.
The site under consideration comprises 9.18 acres which currently is zoned General Commercial (GC).
The site for the proposed rezoning is located along Barbour's Cut Blvd., which is the main truck route for
trucks transporting loads to or from the port facility. The surrounding area has numerous businesses that
are located there due to the proximity to the Barbour's Cut Container Tenninal. The notable exception is
the residential neighborhood directly to the south of the site.
The effect of the change in zoning from GC to BI should not have an adverse impact upon the
infrastructure. The overall impact on public services should be minimal. Barbour's Cut Blvd. is the
primary truck route for the port facility and should have additional capacity to handle the traffic generated
by this site. The impact upon the public health, safety, and welfare of the City will be minimal.
The zoning change from GC to BI would fit into the character of the local area. A truck sales center or
other possible uses that is allowable in a BI district would be compatible with the surrounding uses that
range from industrial to residential.
Some of the uses allowed in a business industrial district:
General and heavy contractors Light machine and fabrication shops
Highway bus terminals Food storage facilities
Warehouses Welding shops
Wholesale trade facilities Printing and publishing shops
Electrical and electronics suppliers Furniture manufactures
Although not complete at this time, the Northside Neighborhood Planning effort will make
recommendations for buffering the residential areas from the commercial and industrial developments
that are located along Barbour's Cut Blvd.

TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY CHANGING
CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED;

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
"Section 1. The City Council of the City of La Porte hereby finds, determines
arid, declares that heretofore, to-wit, on the 16th day of March, 2000, at 6:00 p.m. a
Public Hearing was held before the Planning and Zoning Commission of the City of La
Porte, Texas, pursuant to due notice as required by the Open Meetings Law, Chapter
551, Texas Government Code, to consider the question and the possible
reclassification of the zoning classification of the hereinafter described parcels of land.
There is attached to this Ordinance as Exhibit "A", and incorporated by reference herein
and made a part hereof for all purposes, a copy of Notice of Public Hearing which the
City Council of the City of La Porte hereby finds was properly mailed to all owners of all
properties located within two hundred feet (200') of the properties under consideration.
"Section 2. The publisher's affidavit of publication of notice of said hearing is
attached hereto as Exhibit "B", incorporated by reference herein and made a part
hereof for all purposes.
"Section 3. Subsequent to and immediately following such public hearing, the
Planning and Zoning Commission of the City of La Porte met in regular session to
consider the changes in classification whic~ were the subject of such public hearing.
The City Council of the City of La Porte is in receipt of the written recommendations of
the City of La Porte Planning and Zoning Commission, by letter dated March 17, 2000,

public hearing on the proposed classification changes and the recommendation of the
Planning and Zoning Commission on the 10th day of April, 2000, at 6:00 p.m., and
pursuant to due notice, to consider the recommendation of the Planning and Zoning
Commission regarding the possible reclassification of the zoning classification of the
hereinafter described parcels of land. There is attached to this Ordinance as Exhibit
"0", incorporated by reference herein and made a part hereof for all purposes, a copy of
the notice of public hearing which the City Council of the City of La Porte hereby finds
was properly mailed to the owners of all properties located within two hundred feet
(200') of the properties under consideration.
"Section 5. The publisher's affidavit of publication of notice of said hearing is
attached hereto as Exhibit "E", and incorporated by reference herein and made a part

The La Porte Planning and Zoning Commission, during its March 16, 2000,
meeting, held a public hearing to consider' Rezone Request #ROO-001.
Which has been requested for the property described as lots 1-32, Block 329
of La Porte Outlots, Harris County, Texas. The request submitted by Narsi,
Inc., seeks to have the property rezoned from General Commercial (GC) to
Business Industrial (BI). The purpose of the request is to establish a truck
sales center at this location along Barbours Cut Blvd.
On the recommendation of staff, blocks 328, 330, and 331 have also
been looked as a comprehensive rezoning to provide a more uniform zoning
district along Barbours Cut Blvd.
The Planning and Zoning C~mmission, by unanimous vote, has recommended

In accordance with the provisions of Section 106-171 of the Code of Ordinances of the City
of La Porte, and the provisions of the Texas Local Government Code, notice is hereby given that the
LaPorte City Council will conduct a public hearing at 6:00 P.M. on the 10th day of April, 2000, in
the Council Chambers of~e City Hall, 604 West Fairmont Patkway, La Porte, Texas. The purpose
of this hearing is to consider rezone request #ROO-001, which has been requested for the property
described as lots 1-32 of Block 329, Johnson Hunter Survey, Abstract No. 35 La Porte, Ranis
County, Texas. The request submitted by Nars~ Inc., seeks to have the property in question rezoned
from General Commercial (GC) to Business Industrial (BI). The purpose of the zone change request
is to allow construction of a 1IUck sales center.
On the recommendation of staff, properties on Blocks 328, 330, and 331 will also be looked
as a comprehensive rezoning of the area to achieve orderly, contiguous development that is
compatible with the Zoning Ordinance.
A regular meeting of the City Council will follow the public hearing for the pmpose of
acting upon the public hearing items and to conduct other matters pertaining to the Council. Citizens
wishing to address the Council pro or con during the public hearing will be required to sign in
before the meeting is convened.

SUMMARY & RECOMMENDATIONS
At the December 13, 1999, City Council meeting, staff presented Council a status report of the new community library
project and Council directed the City Manager and architect to proceed with the Bidding Phase.
At that time, City staff indicated contractors would be required to pre-qualify according to Ordinance No. 1476-B and to
attend a pre-bid conference before being allowed to bid on this project.
19 contractors were invited to pre-qualify on January 5 and 12, 2000. Of 26 contractors who requested and received
pre-qualifications packets, 12 contractors submitted Contractor's Statements for the pre-qualification review process that
was completed by March 6, 2000. All 12 contractors pre-qualified and were notified to bid on March 8 and 15, 2000.
11 contractors attended the required pre-bid conference on March 21. Bids were opened on March 28 with 9 contractors
submitting bids.
R. Hassell Builders, Inc. submitted the lowest responsible base bid at $2,356,000.00 with Alternate Bid #1 at $19,200.00
for two (2) monument style signs and with Alternate Bid #2 at $216,700.00 for furniture (book shelving, tables,
chairs, etc.) for a total submitted bid of $2,591,900.00. This bid does not include the phone system, security system,
computer equipment, or audio/visual equipment for the meeting room. City staff will bid these items separately and will
encumber funds within the project budget, which will include a 2% contingency amount of$51,838.00.
R. Hassell Builders, Inc. bid 365 days from Notice to Proceed to complete construction. Estimated completion date of the
library is spring 2001. The contractor will be assessed liquidated damages of $500.00 per day for each day of
construction beyond the agreed deadline.
Payment for the construction will come from the, La Porte Development Corporation Fund (038), fund balance to be
reimbursed from proceeds from the 4B Sales Tax notes.
Action Required by Council:
Approve Ordinance No. 2000- awarding the construction bid to R. Hassell Builders, Inc. and
authorizing the City Manager to expend funds for the library's construction.

CONSTRUCTION OF THE LA PORTE COMMUNITY LIBRARY; APPROPRIATING
$2,591,900.00, TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIUCE WITH THE
OPEN MEETINGS LAW; PROVIDING U EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The City Manager is hereby authorized to execute such
document and all related documents on behalf of the City of La
Porte. The City Secretary is hereby authorized to attest to all
such signatures and to affix the seal of the City to all such
docwnents.
City Council appropriates the sum not to exceed
$2,591,000.00 from the City of La Porte Development Corporation
Fund Account No. 038 to fund said contract.
Section 2. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
ci ty for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.

5.1 PROGRESS PAYMENTS
5.1.1 Based upon Applications for Payment submitted to the Architect by the Contractor and
Certificates for Payment issued by the Architect. the Owner shall make progress payments on
account of the Contract Sum to the Contractor as provided below and elsewhere in the Contract
Documents.
5.1.2 The period covered by each Application for Payment' shall be one calendar month
ending on the last day of the month. or as follows: '

third (3rd) day of a month. the oWner shall make payment to the Contractor not

determine for incomplete Work, retainage applicable to such work and unsettled claims;
and (Subparagraph !I.8-5 of AlA Document A20l-l!1!17 requires release of applicable retainage upon
Substantial Completion of Work with consent of surety, if any.)
.2 Add, if final completion of the Work is thereafter materially delayed through no fault of
the Contractor, any additional amounts payable in accordance with Subparagraph 9.10.3

not waive the Owner's right, if any, subsequently to declare a
Contractor Default~ and
3.2 The Owner has declared a Contractor Default mId fonnally
tenninated the Contractor's right to complete the contract. Such
Contractor Default shall not be declared earlier than twenty days
after the Contractor and the Surety have received notice as
provided in Subparagraph 3.1; and
3.3 The Owner has agreed to pay the Balance of the Contract
Price to the Surety in accordance with the tenns of the
Construction Contract or to a contractor selected to perfonn the
Construction Contract in accordance with the tenns of the
contract with the Owner.
4 When the Owner has satisfied the conditions of Paragmph 3, the
Surety shall promptly and at the Surety's expense take one of the
following actions:
4.1 Arrange for the Contractor, with ~t of the Owner, to
nerfonn and complete the Construction C"....llct; or
4.2 UndCrtake to perfonn and complete the Construction Contract
itself, through its agents or through independent contractors~ or
4.3 Obtain bids or negotiated proposals from qualified contractors
acceptable to the Owner for a contract for perfonnance and
completion of the Construction Contract. arrange for a contract to be
prepared for execution by the Owner and the contractor selected with
the Owner's concurrence, to be secured with perfonnance and
payment bonds executed by a qualified surety equivalent to the bonds
ISSUed on the Construction Contract. and pay to the Owner the
amount of damages as described in Paragraph 6 in excess of the
Balance of the Contract Price incurred by the Owner resulting from
the Contractor's default; or
4.4 Waive its right to perfonn and complete, arrange for completion,
or obtain a new contractor and with reasonable promptness under the
circwnstances:
. 1 After investigation, detennine the amount for which it
may be liable to the Owner and, as soon as practicable
after the amount is detennined, tender payment therefor
to the Owner, or
.2 Deny liability in whole or in part and notifY the Owner
citing reasons therefor.
5 If the Surety does not proceed as provided in Paragraph 4 with
reasonable promptness, the Surety shall be deemed to be in default on this
Bond fifteen days after receipt of an additional written notice from the
Owner to the Surety demanding that the Surety perfonn its obligations
under this Bond, and the Owner shall be entitled to enforce any remedy
available to the Owner. If the Surety proceeds as provided in
Subparagraph 4.4, and the Owner refuses the payment tendered or the
Surety has denied liability, in whole or in part, without further notice the
Owner shall be entitled to enforce any remedy available to the Owner.
6 After the Owner has tenninated the Contractor's right to complete the
Construction Contract. and if the Surety. elects to act under Subparagraph
4.1,4.2, or 4.3 above, then the responSIbilities of the Surety to the Owner
shall not be greater than those of the Contractor WIder the Construction
Contract. and the responsibilities of the Owner to the Surety shall not be

6.1 The responsibilities of the Contractor for correction of detective

failure to act of the Surety under Paragraph 4~ and
6.3 Liquidated damages, or ifno liquidated damages are specified in
the Construction Contract, actual damages caused by delayed
perfonnance or non-perfonnance of the Contractor.
MODIFICATIONS TO TInS BOND ARE AS FOLLOWS:
7 The Surety sb At be liable to the Owner or others for obligations
of the Contractor th..~~ unrelated to the Construction Contract, and the
Balance of the Contract Price shall not be reduced or set off on accowlt of
any such unrelated obligations. No right of action shall accrue on this
Bond to any person or entity other than the Owner or its heirs, executors,
administrators or successors.
8 The Surety hereby waives notice of any change, including changes of
time, to the Construction Contract or to related subcontracts, purchase
orders and other obligations.
9 Any proceeding, legal or equitable, under this Bond may be
instituted in any court of competent jurisdiction in the location in which
the work or part of the work is located and shall be instituted within two
years after Contractor Default or within two years after the Contractor
ceased working or within two years after the Surety refuses or fails to
perfonn its obligations under this Bond, whichever occurs first. If tile
provisions of this Paragraph are void or prohibited by law, the minimum
period of limitation available to sureties as a defense in the jurisdiction of

12 DEFINITIONS
12.1 Balance of the Contract Price: The total amOlUlt payable by
the Owner to the Contractor under the Construction Contract after 011
proper adjustments have been made, including allowance to the
Contractor of any amounts received or to be received by the Owner
in settlement of insurance or other claims for damages to which the
Contractor is entitled, reduced by all valid and proper payments
made to or on behalf of the Contractor WIder the Construction

Contract Documents and changes thereto.
12.3 Contractor Default: Failure of the Contractor, which has

3 With respect to Claimants, this obligation shall be null and void if
the Contractor promptly makes payment, directly or indirectly, for all

4 The Surety shall have no obligation to Claimants under this Bond

4.1 Claimants who are employed by or have a direct contract
with the Contractor have given notice to the Surety (at the
address described in Paragraph 12) and sent a copy, or notice
thereof, to the Owner, stating that a claim is being made under
this Bond and, with substantial accuracy, the amowlt of the

stating that a claim is being made under this Bond and
enclosing a copy of the previous written notice furnished to the
Contractor.
5 If a notice required by paragraph 4 is given by Owner to the
Contractor or to the Surety, that is sufficient compliance.
6 When the Claimant has satisfied the conditions of Paragraph 4, the
Surety shall promptly and at the Surety's expense take the following
actions:
6.1 Send an answer to the Claimant, with a copy to the Owner,
within 4S days after receipt of the claim, stating the amounts
that are lUldisputed and the basis for challenging allY amowlts
that are disputed.
6.2 Payor arrange for payment of any undisputed amounts.
7 The Surety's total obligation shall not exceed the amount of this Bond,
and the amount of this Bond shall be credited for any payments made in
good faith by the Surety.
8 Amounts owed by the Owner to the Contractor wlder the Constmction
Contract shall be used for the perfonnance of the Construction Contract
and to satisfY claims, if any, under any Construction Perfonnance Bond.
By the Contractor furnishing and the Owner accepting this Bond, they
agree that all fimds earned by the Contractor in the perfonnance of the
Construction Contract are dedicated to satisfY obligations of the Contractor
and the Surety under this Bond, subject to the Owner's priority to use the
fimds for the completion of the work.
9 The Surety shall not be liable to the Owner, Claimants or others for
obligations of the Contractor that are unrelated to the Constmction
r"ntract. The Owner shall not be liable for payment of WlY costs or
::uses of any Claimant under this Bond, and shall have under this bond
11l' obligations to make payments to, give notices on behulf of, or otherwise
have obligations to Claimants under this Bond.
10 The Surety hereby waives notice of any change, including changes of
time, to the Construction Contract or to related subcontracts, purchase
orders and other obligations.
11 No suit or action shall be commenced by a Claimant wlder this Bond
other than in a court of competent jurisdiction in the location in which

13 When this Bond has been furnished to comply with a statutory or
other legal requirement in the location where the construction was to be

legal requirement shall be deemed deleted herefrom and provisions

14 Upon request by any person or entity appearing to be a potential
beneficiary of this Bond, the Contractor shall promptly fumish a copy of
this Bond or shall pennit a copy to be made.
15 DEFINITIONS
15.1 Claimant: All individual or entity having a direct contract
with the Contractor or with a Subcontractor of the Contractor to
furnish labor, materials or equipment for use in the perfonnwlce of
the Contract. The intent of this Bond shall be to include without
limitation in tenus "labor, materials or equipment" that part of
water, gas, power, light, heat, oil, gasoline, telephone service or
rental equipment used in the Construction Contract, architectural
and engineering services required for perfonnance of the work of tile
Contractor and the Contractor's subcontractors, wld all other items
for which a mechanic's lien may be asserted in the jurisdiction where
the labor, materials or equipment were fumished.
15.2 Construction Contract: The agreement between the Owner
and the Contractor identified on the signature page, including all
Contract Documents wld changes thereto.
15.3 Owner Default: Failure of the Owner, which has neither

Pertinent Information to All Public Entities Using Prevailing Wage Rate Determinations
Produced by the General Services Commission
1. The contracting entlty awarding any contract for non-federally funded, public works constNctlon projects
(regardless of size or dollar value) shall include in bid specification documents and contract documents Ii
prevailing wage rate determination of per diem wages for the locality in which the work is to be pedorrned,
. for each craft or type of workman or mechanic needed to execute the contract. The Prevailing Wage Rate
Determination is defined as (1) the Prevailing Wage Rate Detennlnatlon Information sheet (document
.' numb(~r WR1001), (~ the Prevailing Wage Rate Determination for Building Construction Trades. and (3)
the Department of labor (DOL) Heavy Highway Determination. The DOL Heavy Highway rates are to be
p~d to workers engaged in site work determined to be fIVe (5) feet beyond the building, extending to the
property boundary. '
2. It shall be the responsibility of the contracting entIty to ensure that the General Contractor posts the
applienble Prevailing Wage Rate Detenninat/on in a Drominent, ~ accessible place at the work site.
3. It shall be the responsibility of the contracting entity to ensure that not less than the posted, specified rates
are paid to all cfasslflcations of wor1<<nen, mechanics and laborers employed by the General Contractor
and/or Subcontractors, In the execution of their contract with the contracting entity, and to ensure that all
workels fit Into one of the listed worker classifications for work of a sImilar character. For example,
werders are to be paid the rate of pay for the trade they are working for.
4. It shall be the responsibility of the contracting entity to take cognlnnce of wage rate disputes andfor
complnints of all violations of the provisions of Chapter 2258 Texas Government Code Title 10.
5. It shafl be the responsIbility of the contracting entity to address the issue of frtnge benefits in the bid
specfficatlon documents and contract documents. The Prevailing Wage Rate Deteonlnatlons produced by
the General Services Commission include fringe benefits in the total Wages. The bId specffication
documents and contract documents need to specify whether the contracting entity Is requiring that fringe
benefits be paid.
6. It shall be the responsibility of the contracting entity to address the Issue of the use of apprentices and
their payment rate In the bid specification documents and contract documents. The rates specified in the
Prevalllng Wage Rate Determination produced by the General Services Commission are Joumeyman
rates. Historically, the apprentice rate Is commensurate with the experience and skill of the wolkor. For
example, on GSC projects, apprentices are paid at a rate of not more than 60% of the Journeyman's wage.
Also on GSC projects, at no time shall a journeyman supervise mo~e than one (1) apprentice.
Note: The tenns joumoyman and apprentice apply to both union and Independent wor1cers, and are not
intended to imply that these positions are union workers only.
7. Some Prevailing Wage Rate Detennlnations for Building Canst'ruetlon Trades may Indicate $0.00 in ihe
-Total Wage- column, rather than a dollar amount. In such cases, The General Services Commission did
not r'ecl~lve sufficient survey data to tabulate a prevailing wage for this worker classification, In the
specified area, and can not provide a prevailing wage rate for this classification. Where this occurs. .
General Contractors and Subcontractors shall not be bound to a prevailing wage rate for the c1a~iflcatlon

Prevailing Wage Rate Determination InformatIon
The following infonnalion from Chapter 2258 Texas Government Code Title 10 should be included ill your bid
specification documents and oontract documents:
2258.021. Duty of Governmental Entity to Pay Prevailing Wage Rates
(a) The slate or any pofltl~f subdivision of the state shall pay a worker employed by It or on behalf of It:
(1) not less than the genGraI prevailing rate of per dlem wages for work of a slmflar character In the
locality in which the work Is perfonned; and
(2) nst less than the general prevalllng rate of per diem wages for legal holiday and oVGrtfme work.
(b) Subsection (a) does not apply to maintenance work.
(c) A worker Is employed on a public work for the purposes of this section If the worker Is employed by a
contractor or subcontractor In the execution of a contract for the public work with the state. a political
suhdlvlslon of the state, or any officer or public bOdy of th~ state or a political subdivision of the state.
2258.023. Prevailing Wage Rates to be Paid by Contractor and Subcontractor; Penalty
(a) Thu contractor who is awarded a contract by a public body or a subcontractor of the COntractor shall
pay not less than the rates determined under Section 2258.022 to a worker employed by it in the
execution of the contract.
(b) A contractor or subcontractor who violates this section shall pay to the state or a pofiticaf subdivision of
the state on whose behalf the contract is made, $60 for each worker employed tor each calendar day
or part of the 'day that the worker is paid less than the wage rates stfpulated In the contract. A public
body awarding a oontract shall specify this penalty in the contract.
Note: This penalty applies even if the oontractor or SUbcontractor and the worker come to an
agreement on the und'erpald wages (seo Attorney General Opinion DM-469).
(c) A contractor or subcontractor does not violate this section if a public body awarding a contract does not
determIne the prevalflng wage rates and specify the rates In the contract as provided by Section
2258.022. .
(d) The public body shall use any money collected under thIs section to offset the costs incurred in the
administration of this chapter.
(e) A municipality Is entitled to oollect a penally under this section only if the munIcipality has a population
of more than 10,000.
2258.051. Duty of Publlo Body to Hear Complaints and Withhold Payment
(a) A public body awarding a contract, and an agent or officer of the public body, shall:
(1) take cognizance of complaints of all violations of thIs chapter: committed in the execution of the
contract; and
(2) withhold money forfeIted or required to be withheld under this chapter from the payments to the
contractor under the contract, except that the public body may not withhold money from other
than the fInar payment without determination by the public body that there Is good causa to
believe that the contractor has violated this chapter.

SUMMARY & RECOMMENDATIONS
Currently, the City of La Porte and Harris County cooperate for the general operations of La Porte's existing library
facility. The City provides maintenance of the building and grounds. The County provides staffing, books and materials,
computer equipment and Internet service,
Both the City and the County are pleased with this arrangement and would like it to continue for the new community
library.
The proposed interlocal agreement for an initial one-year term beginning January 1,2001, and ending December 31,2001,
will renew automatically each year unless terminated by the City or the County with notice. The agreement clarifies
responsibilities of both parties,
The City will maintain the building and the grounds, pay utility bills, and provide janitorial services as well as garbage
pickup. The City will provide computers and related equipment only for the initial opening of the library,
The County will provide staffing, books, and other research materials, The County will provide data lines and Internet
service, maintain computers and related equipment, and will purchase additional equipment as needed. The value of
Harris County's contribution is anticipated to be approximately $1.3 million (including $600,000.00 for opening day
books and materials) for the first year and approximately $755,000,00 for the second year,
Once City Council approves this interlocal agreement, it will be forwarded to the Harris County Library Director to
present to Commissioner's Court on April 18, 2000,
A Groundbreaking Ceremony is scheduled for Wednesday, May 10, 2000, at 2:00 pm.

AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE
CITY OF LA PORTE AND HARRIS COUNTY, PROVIDING FOR THE OPERATION OF
THE HARRIS COUNTY LIBRARY-LA PORTE BRANCH, FOR AN INITIAL TED
COHHENCING JANUARY 1, 2001; MAKING VARIOUS FINDINGS AND PROVISIONS
RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN KEETINGS
LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The Mayor is hereby authorized to execute such document
and all related documents on behalf of the City of La Porte. The
City Secretary is hereby authorized to attest to all such
signatures and to affix the seal of the City to all such documents.
Section 2. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time .required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

Gentlemen:
I respectfully request that Judge Robert Eckels be given authorization to sign the
enclosed two original agreements between Harris County and the City of La
Porte pertaining to the operation of the new 23,257 square foot library building to
be completed in early 2001.
As part of this agreement, Harris County will operate the library and the City of La
Porte will own the building and maintain the building and grounds. The City of La
Porte will also provide the furnishings and technology for the new library.
This agreement is similar to the agreement Harris County has with the City of
Galena Park.
This agreement has been written and approved by the County Attorney's office.

COUNTY OF HARRIS ~
TIllS AGREEMENT, made and entered into by and between Harris COWlty, a body
corporate and politic under the laws of the State of Texas, hereinafter called the "C01mty," and
the City of LA PORTE, a municipal corporation Wlder the laws of the State of Texas, acting
herein by and through its Mayor, thereunto duly authorized, hereinafter called "City,"
WITNES SETH:
WHEREAS, the City, in the interest of providing a tool for continuing self education,
enlightenment and enrichment, houses a public library within the City limits of La Porte for the
residents of the City and the County; and
WHEREAS, the County is willing to operate the library as the Harris County Public
Library-La Porte Branch, hereinafter called "the Library", pmsuant to the provisions of TEx.
LoCAL GoV'T CODE ANN. ~323.008 (VERNON 1999); and
WHEREAS, the County is willing to operate the Library, provided the City maintains the
building as provided herein;
NOW, THEREFORE, the City and COWlty, in consideration of the mutual covenants and
agreements herein contained, agree as follows:
I.
Following the completion of the construction of the building for the Harris County Public
Library-La Porte Branch by the City, the City will own the Library building and will provide
maintenance for the Library building including, but not limited to, the air conditioning and
heating equipment, walls, doors, doorways, floors, floor covering, ceilings, windows and roof,
and will provide grounds maintenance, landscaping, garbage pick up and janitorial service for the
Library on a regular basis. The City will also provide utilitie,l; and pay the utility bills at the
Library. The City will also provide furniture and furnishings for the Library, and will maintain
the furniture and furnishings it provides. The City will retain ownership of furnishings and
fixtmes provided by the City. '

The County will operate the Library and provide a full range of library materials for the
Library, which are customarily provided in public library programs to the citizens of Harris
County. The County will provide support services for the Library including acquisitions,
cataloging and processing of all materials; delivery of materials; continuing education for the
staff; management support for the operation of the Library; and a technology system for the
Library.

The COWlty will fonnulate the policies and procedmes of operation of the Library, and
will schedule the use of the meeting room in the Library. The City will coordinate, with the La
Porte Branch librarian, scheduling and use of the meeting room for any and all City hosted or
sponsored activities.

IV.
The County will appoint as many librarians, library aides and other support staff as are
necessary to provide library services. The programs will be under the complete supervision,
management, control and direction of the County. The City will not direct or supervise the
County or any of its employees. The City will look to the County for results only. The County
employees are to be directly responsible to the County and will receive their salaries from the
County.

The County retains ownership of furnishings, books and equipment furnished by the
County inside the building. The County will maintain the furnishings provided by the County.
VI.
The County will provide fax and data communication lines for the Library's Information
Technology System. The County will provide photocopy machines for both staff and public use.
The City will purchase computer and printer equipment to open the library, according to County
Library specifications. The City has no duty to maintain, repair and replace the computer and
printer equipment, nor purchase any additional computer and printer equipment.
VIT.
The term of this Agreement is for a period of one (1) year, beginning on January 1,2001
and ending December 31, 2001. The term of this agreement will be automatically extended for
one-year periods, provided, however, notwithstanding anything herein to the contrary, or that
may be construed to the contrary, either party may terminate this agreement at any time upon
thirty (30) days prior written notice to the other party.

In the event of the County's default in any of the terms or provisions for this agreement,
the sole remedy of the City is to terminate this agreement.
IX.
All notices and communications required or permitted to be given by the County to the
City under this Agreement may be given by registered or certified U.S. Mail, postage prepaid,
return receipt requested, addressed to City Manager, City of La Porte, P.O. Box 1115, La Porte,
Texas 77572. All notices and communications required or permitted to be given by the City to
the County under this Agreement may be given by registered or certified U.S. Mail, postage
prepaid, return receipt requested, addressed to County Judge of Harris County, Harris County
Administration Building, 1001 Preston, 9th Floor, Houston, Texas 77002.

The City represents that it has sufficient funds available to meet its obligations hereunder.

The County ~ no County funds specifically available for the operation of the La Porte
Branch Library. In the event of the County's failure to perform its obligations hereunder, the sole
and exclusive remedy of the City is to terminate this Agreement.

SUMMARY & RECOMMENDATION
In January of thIS year, staff presented a workshop repo" on a proposal to utilize street enas along
Galveston Bay as parkland. There were a number of citizens in attendance at the meeting who opposed
the proposal across the board. Council's consensus was that:
Council does not want staff to move forward with any of the proposals presented.
However, there may be some merit in particular cases and the City should look
at each individual case as they may come up in the future. This matter will not be
pursued any further by the City at this point. "any resident has a particular
request for a particular street ending, they need to contact the City regarding
their special request. /fthe City receives an application to close a street/alley, all
residents within 500 feet will be contacted.
On February 3, 2000 the City received a petition from a number of residents of the Pine Bluff subdivision
requesting that the City provide a park at the Bayshore street end at its intersection with "F" Street. As
instructed. City staff determined which property owners fell within the 500-foot radius of the subject street
end, On February 10th the City mailed certified letters to the 43 property owners of record that fell within
the designated 500 foot radius of the subject area in the Pine Bluff, Crestview, and Bayside Terrace
subdivisions. The letter asked each property owner to "vote" for 1 of 3 choices; 1) to leave the property,\as
is", 2) to "close the property by selling the right of way to the adjacent property owners", or 3) "to convert__
the property into a park".
The City received 39 returns from the post office indicating that the letters had been received, 4 were
unclaimed. One property owner, Ms. Ann Holmes, received 2 letters because her property is in both
subdivisions. We only used one of her responses leaving 38 responses. Of the 38 received, 16 property
owners or 42% did not respond. Of the remaining responses 4 property owners, or 10.5% voted to keep
the property "as is", 3 property owners, or 7.9% voted to allow the property to be "closed to the adjacent
property owners", and 15 property owners, or 39% voted to turn the subject property into a park. The
largest group of property owners was non-responsive to the letter. Of this group of 16,8 property owners
were from the Bayside Terrace or Crestview subdivisions, and 2 were companies (Le. Boy's Harbor), Of
the 30 property owners in Pine Bluff, the majority (53%) were in favor of converting the property into a park.
Staff recommends approval of conversion of the street end at Bayshore Drive Street End @ "P' Street into
a City park, with funding for the project in the amount of $25,000 to be taken from the Capital Improvement
Contingency Account, should Council approve.

Major accident at Glenmeadows and Parkcrest Street
At approximately 1:47 PM, Sunday. 04/09/00, the La Porte Police and EMS personnel were
dispatched to the scene of an AutolBicyclist major accident in the 900 block of Glenmeadows at
Parkcrest Street.
Officer's Alan Gudgell and Marcus Upchurch found that a 1985 Mazda driven by RYAN MINK,
21 YOA, of 5229 G1envalley, had struck a 10-year old boy riding a bicycle. The child was
identified as MATlHEW ADAMS of 4902 Parkcrest Street.
The child was injured by the impact and was subsequently transported to Memorial-Hermann
Hospital by Lifetlight. He was reported in stable condition Sunday evening.
An accident reconstruction specialist, Officer Jeff Tippit, was called to the scene to reconstruct
the accident. Preliminary findings are that the bicyclist was west-bound on Parkcrest and entered
the intersection after disregarding the stop sign. He was struck by the automobile driven by Mr.
Mink, which was north-bound on Glenmeadows at what appears to be at a higher than legal rate
of speed. The speed limit on Glenmeadows is 30 MPH. The accident rem9-in!; under
investigation and the filing of any charges is pending the completion of the investigation.
As of 1030 AM, 04/10/00, Matthew Adams was reported in ''very Stable" condition.
