AND WORKSHOP MEETING
OF LA PORTE CITY COUNCIL
MAY 9, 2000
1. CALL TO ORDER
The meeting was called to order by Mayor Norman Malone at 6:00 p.m.
Members of City Council Present: Councilpersons Guy Sutherland, Chuck Engelken,
Howard Ebow, Peter Griffiths, Alton Porter, Deotis Gay, Charlie Young, Jerry Clarke,
and Mayor Norman Malone.
Members of Council Absent: None
Members of City Executive Staff and City Employees Present: City Attorney Knox
Askins, Assistant City Manager John Joerns, Judge J.B. Williamson, Director of Public
Works Steve Gillett, City Secretary Martha Gillett, Finance Director Cynthia Alexander,
Planning Director Doug Kneupper, Director of Emergency Management Joe Sease,
Assistant Fire Chief Champ Dunham, Administrative Assistant Carol Buttler, Director of
Administrative Services Louis Rigby, Assistant Finance Director Mike Dolby, Police
Chief Richard Reff, Tax Assessor Kathy Powell and Purchasing Manager Susan Kelley.
Others Present: Sib Carpenter, Jeff Elliott, Mr. Engelken, Reverend Oliver Stillwell and a
number of citizens.
2. Reverend Oliver Stillwell delivered the Invocation.
3. Council considered approving the minutes of the Regular Meeting on April 24, 2000.
Motion was made by Councilperson Engelken to approve the minutes of the Regular
Meeting as presented. Second by Councilperson Sutherland. The motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Mayor
Malone
Nays: None
Abstain: None
4. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND
TAXPAYERS WISHING TO ADDRESS COUNCIL.
A. Sam Kamal — 4933 Crestway — Addressed City Council and requested them to
remove the traffic humps in the Glen Meadows Subdivision.
B. Patricia Clarke — 4929 Crestway — Addressed City Council and requested them to
remove the traffic humps in the Glen Meadows Subdivision.

5. Council considered approving an ordinance declaring the results of the election held in
the City of La Porte on May 6, 2000, for the election of Mayor; Councilperson District 2;
and Councilperson District 3.
City Attorney read: ORDINANCE 2000-2404 — AN ORDINANCE DECLARING THE
RESULTS OF THE ELECTION HELD IN THE CITY OF LA PORTE ON MAY 6,
2000, FOR THE ELECTION MAYOR; COUNCILPERSON DISTRICT 2; AND
COUNCILPERSON DISTRICT 3; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF.
City Attorney Knox Askins read the results of the final official canvass of votes at the
May 6, 2000, General Election. In the race for Mayor, Norman Malone was unopposed
with 656 votes. In the race for District 2; Chuck Engelken 131, Nick Barrera 45. In the
race for District 3, Howard Ebow was unopposed with 99 votes. Mayor Norman Malone
was re-elected. Councilperson Engelken was re-elected. Councilperson Howard Ebow
was re-elected.
Motion was made by Councilperson Young to approve Ordinance 2000-2404 as
presented by Mr. Askins. Second by Councilperson Clarke. The motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Mayor
Malone
Nays: None
Abstain: None
6. Judge J. B. Willamson administered the Oath of Office to Mayor Norman Malone.
Mayor Norman Malone administered the Oath of Office to District 2 Councilperson
Chuck Engelken and District 3 Councilperson Howard Ebow.
7. Council considered approving an ordinance appointing a member of City Council to
serve as mayor Pro-Tem for the period of May 10, 2000 through May 8, 2001.
City Attorney read: ORDINANCE 2000-2405 — AN ORDINANCE APPOINTING A
MEMBER OF THE CITY COUNCIL TO SERVE AS MAYOR PRO-TEM OF THE
CITY OF LA PORTE, FOR THE PERIOD MAY 10, 2000, THROUGH MAY 8, 2000;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Young to approve Ordinance 2000-2405 nominatins;
Councilperson Jerry Clarke as Mayor Pro Tem. Second by Councilperson Porter. The
motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Young, and Mayor Malone
Nays: None
Abstain: Clarke
8. Council considered approving an ordinance authorizing issuance of refund of
overpayment to Huntsman Polymers Corporation.

City Attorney read: ORDINANCE 2000-2406 — AN ORDINANCE AUTHORIZING
TAX ROLL ASSESSMENT CORRECTIONS; AUTHORIZING A REFUND TO THE
TAXPAYER; APPROPRIATING FUND FOR THE REFUND; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE
DATE HEREOF.
Motion was made by Councilperson Clarke to approve Ordinance 2000-2406 as
presented by Ms. Alexander. Second by Councilperson Porter. The motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Mayor
Malone
Nays: None
Abstain: None
9. Council considered authorizing the removal of two traffic humps installed on Crestway
between Farrington Blvd. and Glenmeadows Drive.
Director of Public Works Steve Gillett presented summary and recommendations.
Motion was made by Councilperson Griffiths to approve the removal of traffic humps as
recommended by Mr. Gillett. Second by Councilperson Sutherland. The motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Mayor
Malone
Nays: None
Abstain: None
Councilperson Sutherland left the meeting at 6:35 P.M.
10. Council considered authorizing purchase of plastic garbage bags through H-GAC
Cooperative Purchasing Program.
Director of Public Works Steve Gillett presented summary and recommendations and
answered questions for City Council.
Motion was made by Councilperson Young to approve the purchase of plastic garbage
bags as recommended by Mr. Gillett. Second by Councilperson Engelken. The motion
carried.
Ayes: Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Mayor Malone
Nays: None
Abstain: None
11. The special called workshop meeting was called to order by Mayor Norman Malone at
6:38 P.M.
A. Receive report from Purchasing manager and discuss a City marquee.
City Council Minutes — May 9, 2000 — Page 4
Purchasing Manager Susan Kelley presented report to Council on a City
marquee. Funds to purchase the marquee would be funded through the
hotel/motel capital improvement project account. Ms. Kelley noted she had
visited with the La Porte Independent School District in order to place the
marquee on school property. In return, the school district will be able to utilize
the marquee for citywide messages.
Council indicated they would like to see more than one location for marquees.
Workshop adjourned and the special called meeting re -convened at 6:55 P.M.
12. Council considered approval or other action authorizing purchase of EZ Marquee, Model
#EZ4076 from Spectrum Corporation as sole source vendor.
Motion was made by Councilperson Clarke to table this item until after the Council
Retreat. Second by Councilperson Griffiths. The motion carried.
Ayes: Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Mayor Malone
Nays: None
Abstain: None
13. ADMINISTRATIVE REPORTS
Assistant City Manager John Joerns reminded Council of the following events:
A. May 10, 2000 — Library Groundbreaking — 2:00 P.M.
B. May meeting dates — Special Called Workshop Meeting May 15, 2000 — Regular
Called Meeting May 22, 2000
C. May 16, 2000 — Traffic Hump meeting — City Hall Council Chambers.
D. May 17, 2000 —Chamber of Commerce Luncheon
E. May 29, 2000 — City observes Memorial Day Holiday
F. Mayor Malone reminded Mr. Joerns the Council Retreat has been set for July 8,
2000 at City Hall Council Chambers.
14. COUNCIL ACTION
Councilpersons Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Mayor
Malone brought items to Council's attention.
Mayor Malone's comments:
Mayor Malone informed Council that he had received a letter that disturbed him. The
letter criticized the council regarding the Port of Houston. The City of La Porte has
position paper concerning the proposed Port expansion. The presentation by Dana Olivo
at the last council meeting regarding the Port of Houston is an issue the majority of the
council does not want to participate in. Mayor advised Council he met with the Mayor of

Morgan's Point, Shoreacres, and Deer Park; they are not going to participate. He is
waiting for a response from the City of Pasadena. Mayor closed by saying that the City
of La Porte is not interested in making a study of another study.

No executive session.
16. CONSIDERATION AND POSSIBLE ACTION ON ITEMS CONSIDERED IN
EXECUTIVE SESSION
Due to no executive session there was no action taken.
17. ADJOURNMENT
There being no further business to come before Council, the Regular Called Meeting was
duly adjourned at 7:09 PM.

AN ORDINANCE DECLARING THE RESULTS OF THE ELECTION HELD IN THE CITY
OF LA PORTE ON MAY 6, 2000, FOR THE ELECTION MAYOR; COUNCILPERSON
DISTRICT 2; AND COUNCILPERSON DISTRICT 3; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, there was held in the City of La Porte on the 6th day
of May, 2000, an election for the purpose of electing a Mayor;
Councilperson District 2; and Councilperson District 3; all in
accordance with Section 8.10 of the Home Rule Charter of the City
of La Porte; and
WHEREAS, there were cast at said election for the following
listed persons the number of votes opposite their respective names:

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE:
Section 1. That said election was duly called and notice
thereof given in accordance with law; that said election was held
in the manner required by law; that due returns of said election
have been made by the proper officers; that said returns have been
canvassed by the City Council of the City of La Porte; that said
election has resulted in the election of the following named
persons, to -wit:

Section 2. The City Council officially finds, determines,

City for the time required by law preceding this meeting, as
required by Chapter 551, Texas Government Code; and that this
meeting has been open to the public as required by law at all times
during which this ordinance and the subject matter thereof has been
discussed, considered and formally acted upon. The City Council
further ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

hereto as Exhibit "A", incorporated by reference herein, and made
a part hereof for all purposes. The over assessment resulted in an
overpayment to the City of La Porte of $41,329.66. The taxpayer
has requested refund of said overpayment.

SUMMARY & RECOMMENDATION
In May, 1999, 43 citizens signed petitions requesting the installation of Traffic Humps on Crestway Drive in the
Glen Meadows Subdivision from Farrington Blvd to Valleybrook Dr. A speed study performed in July, 1999
indicated only the portion of Crestway Dr. from Farrington Blvd. to Glenmeadows Dr. met the criteria outlined
in City of La Porte Ordinance No. 98- 2274. Two Traffic Humps were installed in July, 1999.
In March, 2000, a petition was received from that section of Crestway Dr. from Farrington Blvd. to Glen Meadows Drive
with 27 signatures to remove the Traffic Humps. This represents more than 2/3 of the residences in the affected area and
meets the criteria set forth in the ordinance for the requesting of removal of Traffic Humps.
The cost to remove a Traffic Hump is approximately $750.00 (this is labor and equipment only. No materials are needed.)
The cost to remove the two Traffic Humps would be approximately $1,500.00.
Action Required by Council: Approve request to remove two traffic humps installed on Crestway between
Farrington Blvd. and Glenmeadows Drive..

Advertised, sealed bids #0802 for Plastic Garbage Bags were opened and read on April 24, 2000. Bid requests were
mailed to nine (9) vendors with two (2) returning bids.
Low bid meeting specifications was submitted by Bemis Company through the H-GAC Cooperative Purchasing
Program in the amount of $0.391 per pound. The cost of bags for 147,000 pounds for the August, 2000 semiannual
handout would be $57,477.00. Including the H-GAC Administrative Fee of $1094.14 the total cost of this contract
would be $58,571.14. This represents the same price as the past two bids.
Staff recommends purchase of the Plastic Garbage Bags for the August, 2000 bag handout through the H-GAC
Cooperative Purchasing Program. Adequate funds for this purchase are budgeted in the Residential Solid Waste FY
1999/2000 Operating Budget.

During the July 1999 City Council Retreat, various types of electronic signs were presented to Council. At that
time, Council chose a reflective type sign called EZ Marquee. Spectrum Corporation, located in Houston, is
the sole distributor for this sign. Funds were budgeted for Fiscal Year 1999-2000 in the Hotel/Motel Fund for
the amount of $30,000 to begin the procurement process.
More information concerning this sign was collected and City sign requirements were researched. The
EZ Marquee, Model #EZ4076, meets all City requirements and is conducive to our needs. The 8' x 7-1/3' sign
will include the words "La Porte" in the top three-foot (3') section, allowing adequate space of approximately
five feet (6) for wording. Staff visited the distributor of this sign, and viewed the flexibility and simplicity of
programming messages by computer software.
Following Council's direction at the Retreat to utilize this sign in a high traffic area toward the west side of town,
staff began looking for high visibility sites for sign installation. After reviewing and evaluating several sites,
staff recommends the Spencer/Underwood area as the best location. With City Manager approval, staff met
with LPISD staff and asked permission to place the sign on Baker Jr. High School property. Dr. Sawyer and
his staff were very receptive to the City's proposal. If Council approves staffs recommendation, the
City Manager and LPISD Superintendent will enter into a written agreement for this proposal. City staff will
prepare written guidelines for the electronic sign's usage.
The cost for this electronic sign, including installation, software, training, and two (2) year warranty is
$25,845.00. We anticipate other expenses such as electrical connections, telephone cable and connection for
the modem, and removal/replacement of existing fencing for installation not to exceed $3,000. In addition, staff
will need to stake the exact location of the proposed sign, contact Public Works and utility companies to check
for underground lines, and coordinate with the Baker Junior High School for installation.
Staff requests approval to expend budgeted funds for purchase and installation of an electronic sign for public
service announcements, as requested above.
Sufficient funds have been budgeted from Hotel/Motel Capital Improvement Project Account
#037-9898-832-1100.
Action Required by Council:
Authorize purchase of EZ Marquee, Model #EZ4076 from Spectrum Corporation as sole source in the amount
of $25,845, approve $3,000 for installation expenses, and provide direction to proceed at the recommended
site.
