MINUTES OF THE REGULAR MEETING
OF LA PORTE CITY COUNCIL
NOVEMBER 27, 2000
1. CALL TO ORDER
The meeting was called to order by Mayor Norman Malone at 6:00 p.m.
Members of City Council Present: Councilpersons Guy Sutherland, Chuck Engelken,
Howard Ebow, Peter Griffiths, Alton Porter, Deotis Gay, Charlie Young, Jerry Clarke,
and Norman Malone.
Deotis Gay arrived at 6:32 P.M.
Members of Council Absent: None
Members of City Executive Staff and City Employees Present: City Manager Robert T.
Herrera, Assistant City Attorney John Armstrong, Assistant City Manager John Joerns,
City Secretary Martha Gillett, Finance Director Cynthia Alexander, Assistant Finance
Director Mike Dolby, Assistant City Secretary Janis Goulder, Public Works Director
Steve Gillett, Planning Coordinator Masood Malik, Purchasing Manager Susan Kelley,
Emergency Services Director Joe Sease, Planning Director Doug Kneupper and Police
Chief Richard Reff.

3. Council considered approving the minutes of the Regular Meeting and Special Called
Workshop Meeting held November 13, 2000.
Motion was made by Councilperson Clarke to approve the minutes of the Regular
Meeting and Special Called Workshop Meeting on November 13 2000 as presented.
Second by Councilperson Young. The motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Young, Clarke, and Malone.
Nays: None
Abstain: None
4. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND
TAXPAYERS WISHING TO ADDRESS COUNCIL.
The following citizens addressed City Council: Janis Goulder, 409 Texaco Weldon Rd.,
Dayton, Texas, addressed council to say thank you for the opportunity to work for the
City of La Porte. Ms. Goulder informed Council her resignation is effective Friday,
December 1, 2000.
Sib Carpenter, 5234 Glenpark, LaPorte, Texas, addressed Council and recommended
they seek volunteers for committees rather than appointing. She stated they would get
a

more volunteers. In addition, she encouraged Council to encourage more younger people
to attend Council meetings so they would have people to take their places.
5. PUBLIC HEARING — SPECIAL CONDITIONAL USE PERMIT (SCU) PERMIT
SCU00-002 FOR A REQUEST TO OPERATE A FUEL QUALITY TESTING
BUSINESS LOCATED AT 320 N. 16TH STREET
Open Public Hearing — Mayor Malone opened the Public Hearing at 6:17 PM.
Review by Staff — Planning Director Doug Kneupper presented summary and
recommendation.
Public Input — Alfred Barry — provided Council with an overview of his company and
encouraged Council to approve this Special Conditional Use Permit.
Councilmember Deotis Gay arrived at 6:32 P.M.
Recommendation of Staff — as recommended by the Planning and Zoning Commission,
staff recommends approval of the Special Conditional Use Permit.
Close Public Hearing — Mayor Malone closed the Public Hearing at 6:34 PM.
6. Council considered approving an ordinance amending the Code of Ordinances of the City
of La Porte, Chapter 106, more commonly referred to as the Zoning Ordinance of the
City of La Porte, by granting a Special Conditional Use Permit for that certain parcel of
land described as follows: To Wit: Lots 1 through 8 and the adjoining west one-half of
the alley of Block 681, J. Hunter Survey 1-35 for the purpose of operating a fuel quality
testing business and storing a limited quantity of petroleum services products within a
Light Industrial Zone (Ord. 1501-MM).

Motion was made by Councilperson Clarke to approve Ordinance 1501-NM as read by
the Mayor. Second by Councilperson Engelken. The motion carried.

7. Council considered approving the purchase of a fluorescien evidence enhancement kit —

Police Chief Richard Reff presented summary and recommendation and answered
Council's questions.
Motion was made by Councilperson Young togpnrove the purchase of a fluorescien
evidence enhancement kit as recommended by the Police Chief. Second by
Councilperson Griffiths . The motion carried.

Council considered awarding a bid for the purchase of an A.D.A. compliant, 26-30
passenger bus to Thomas Bus Gulf Coast, Ltd. — S. Gillett
Director of Public Works Steve Gillett presented summary and recommendation and
answered Council's questions.
Motion was made by Councilperson Ebow to approve purchase of an A.D.A. compliant
26-30 passenger bus to Thomas Bus Gulf Coast, Ltd. Second by Councilperson Griffiths.
The motion carried.

SUMMARY & RECOMMENDATION
The Planning and Zoning Commission, during its November 16, 2000, meeting, held a public hearing to receive
citizen comments regarding Special Conditional Use Permit Request #SCU00-002. The request, submitted by Mr.
Alfred Barry, seeks aXproval of a Special Conditional Use Permit (SCUP) to operate a fuel quality testing business
located at 320 N. 16 Street. A fuel quality testing establishment within a Light Industrial Zone is a Conditional
Use, per Section 106-441 of the Code of Ordinances.
In July 1999, a Special Conditional Use Permit was approved for Alliance Recovery Services for the same property.
Alliance Recovery Services did not follow through with their permit. This request is for use of an existing building
with some site modifications. The use will be fuel quality testing on site.
Staff has found the request satisfies all applicable ordinance requirements. The property is surrounded by Maxim
Rentals (formerly Anthony Crane Rentals) on the west, warehouses on the south and east, and a heavy wooded area
on the north. The facility is compatible with the surrounding properties and should not be injurious to the use,
enjoyment or value of those properties.
Seven (7) notices of public hearing were mailed to neighboring property owners. One favorable response was
received in this regard.
The Planning and Zoning Commission, by unanimous vote, has recommended City Council approval of Special
Conditional Use Permit #SCU00-002 with the following conditions:
1. A minor development site plan prepared in accordance with the requirements of the Development
Ordinance 1444 shall be submitted for review and approval by the City.
2. Landscaping of the facility shall be required.
3. The applicant is responsible for public hearing costs of $106.86.
Action Required by Council:
1. Conduct public hearing.
2. Consider approval of Special Conditional Use Permit #SCU00-002.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA
PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING
ORDINANCE OF THE CITY OF LA PORTE, BY GRANTING A SPECIAL

MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
"Section 1. The City Council of the City of La Porte hereby finds, determines
and declares that heretofore, to -wit, on the 16`h of November, 2000, at 6:00 p.m. a
Public Hearing was held before the Planning and Zoning Commission of the City of La
Porte, Texas, pursuant to due notice as required by the Open Meetings Law, Chapter
551, Texas Government Code, to consider the question and the possible issuance of a
Special Conditional Use Permit of the hereinafter described parcels of land. There is
attached to this Ordinance as Exhibit "A", and incorporated by reference herein and
made a part hereof for all purposes, a copy of Notice of Public Hearing which the City
Council of the City of La Porte hereby finds was properly mailed to all owners of all
properties located within two hundred feet (200') of the properties under consideration.
"Section 2. The publisher's affidavit of publication of notice of said hearing is
attached hereto as Exhibit "B", incorporated by reference herein and made a part
hereof for all purposes.
"Section 3. Immediately following such public hearing on November 16, 2000,
the Planning and Zoning Commission of the City of La Porte met in regular session to
consider the issuance of a Special Conditional Use Permit, which was the subject of

such public hearing. The City Council of the City of La Porte is in receipt of the written
recommendations of the City of La Porte Planning and Zoning Commission, by letter
dated November 17, 2000, a true copy of which letter is attached hereto as Exhibit "C",
incorporated by reference herein and made a part hereof for all purposes.
"Section 4. Subsequent to receipt of the recommendation of the City of La
Porte Planning and Zoning Commission, the City Council of the City of La Porte called a
public hearing on the proposed classification changes and the recommendation of the
Planning and Zoning Commission on the 27" day of November, 2000, at 6:00 p.m., and
pursuant to due notice, to consider the recommendation of the Planning and Zoning
Commission regarding the possible reclassification of the zoning classification of the
hereinafter described parcels of land. There is attached to this Ordinance as Exhibit
"D", incorporated by reference herein and made a part hereof for all purposes, a copy of
the notice of public hearing.
"Section 5. The publisher's affidavit of publication of notice of said hearing is
attached hereto as Exhibit "E", and incorporated by reference herein and made a part
hereof for all purposes.
"Section 6. The City Council of the City of La Porte hereby accepts the
recommendation of the City of La Porte Planning and Zoning Commission, and the
Special Conditional Use Permit for the hereinafter described parcels of land, situated
within the corporate limits of the City of La Porte, is hereby granted. The conditions of
said Conditional Use Permit shall be that it will be permissible to perform fuel quality
testing and storage of a limited quantity of petroleum services products on the premises
but subject to all ordinances and regulations of the City of La Porte and other applicable

law. The description of said parcels of land permitted pursuant to said SCUP are as
follows, to -wit:
Lots 1 through 8 and the adjoining west one-half of the alley of Block 681;
J. Hunter Survey A-35, Town of La Porte, Harris County, Texas.
"Section 7. The City Council of the City of La Porte hereby finds, determines,
and declares that all prerequisites of law have been satisfied and hereby determines
and declares that the amendments to the City of La Porte Zoning Map and
Classification contained in this Ordinance as amendments thereto are desirable and in
furtherance of the goals and objectives stated in the City of La Porte's Comprehensive
Plan.
"Section 8. The City Council officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public at the City Hall of the city
for the time required by law preceding this meeting, as required by the Open Meetings
Law, Chapter 551, Texas Government Code; and that this meeting has been open to
the public as required by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted upon. The City
Council further ratifies, approves and confirms such written notice and the contents and
posting thereof.

The La Porte Planning and Zoning Commission, during a regular meeting on
November 16, 2000, held a public hearing to consider Special Conditional Use
Permit Request #SCU 00-002. The request, submitted by Mr. Alfred Barr, seeks
approval to operate a fuel quality testing business located at 320 N. 16 Street,
La Porte, Texas. The proposed facility will be developed within a Light Industrial
Zone.
The Planning and Zoning Commission has, by unanimous vote, recommended

use permit may be rescinded by the City Council, upon its own motion or upon the
recommendation of the Planning and Zoning Commission of the City of La Porte, and the
previous zoning of the entire tract shall be in full effect on the portion which is undeveloped.

DW Petroleum Services pioneered Fuel Quality Testing in 1980
at a time when the market was seriously concerned with rising fuel
costs and declining quality of marine fuels at many ports of the world.
The incidence of engine problems and failures attributed to substand-
ard residual fuel was showing an alarming increase. Owners were
reporting more and more cases of short delivery, incorrect density
or viscosity, and unacceptable impurity levels. Concern of the 80's
regarding fuel quality has worsened with the impact of environmental
awareness and industrial legislation in the 90's. Contaminants from
industrial waste are now increasingly being detected in marine
fuels as well.
Operating conditions are getting tougher in the shipping industry
with insurance premiums and deductibles at an all time high,
resulting in shipowners and operators paying out considerable sums
for machinery damages in spite of being insured. With longer lead
time on spare parts, some vessels may even end up being laid up
for extended periods.

specially made of high density
polypropylene (HDPE) and are
complete with bottle plugs,
security seals, bottle labels, des-
patch cartons and a comprehensive
programme manual.
Custody Transfer Sampling
DNVPS advocates that there should
be only one single official sampling
point and this is at the point of
custody transfer, which is the point
where the product changes hands
from the deliverer to the receiver.
The custody transfer point in this
instance is the interface between the
ship's bunker manifold flange and
the bunker hose flange. A sampling
device should be installed at this
location for taking a continuous drip
sample throughout the whole dura-
tion of the bunkering.
It is a common practice for the supplier's representative to ask the
Chief Engineer to sign sample labels in advance of bunkering. This
practice of pre -signing the sample label must be avoided as it will put
you in a legally disadvantageous position if the labels are misused. If
offered a sample by the supplier where the contents were not taken
at the point of custody transfer or where sampling was not witnessed,
it is important to sign `For receipt only, source unknown.'
DNVPS has designed a line sampler which makes sampling very con-
venient for the shipboard staff. This is available on order.
The one -litre sample bottles are sealed, labelled and signed by all parties present. One sample is offered
to the supplier and one retained on board the ship for safe keeping in case further testing is required. In
some instances, the charterer and the shipowner may both be in the FQT programme and may require
samples to be tested separately. The additional two samples are intended for this purpose. Details of
sample preparation and documentation are contained in the Manual provided in each kit.
It is important to ensure that a proper sampling device is used so that a representative sample can be taken
during bunkering. A representative sample is essential to ensure that the DNVPS analysis results and
technical advice provided to'the vessel are valid and useful.

Fuel delivery is measured by
volume but invoiced by weight.
The density information is there-
fore essential for determining the
weight of the fuel received. Den-
sity must be known in order that
the shipboard staff can set the
centrifuges correctly and also for
calculating the calorific value
of the fuel.
Viscosity
Viscosity is the parameter deter-
mining fuel grade and thus the
price of the product delivered.
It must be known for determining
the fuel pre -heating temperature
prior to centrifuging and fuel
injection. Where additional .
heating capacity on board the
ship is available, considerable
savings in fuel costs can be made
by burning a higher viscosity
grade without necessarily
compromising on fuel quality,
provided that there are no limita-
tions due to engine condition

tion. Some engines are more
prone to problems when burning
a high MCR fuel.
Turbocharger fouling from
sea -Boater contamination
Sulphur
Sulphur content representsooss of energy con-
tent in the fuel. Very low levels of sulphur may
represent some risk of deposit formation in the
form of alkaline ashes in crosshead engines, while
high sulphur content combined with reduced
load, low temperature and moist scavenge air, can
lead to corrosion.
Ash
Gives a useful indication of the amount of incom-
bustible impurities in the fuel. Such impurities may
include sodium, vanadium and powder, which can
remain in the fuel in high concentrations after
catalytic cracking. Such particles are very abrasive
and can cause rapid wear of the cylinders and high
pressure fuel system components, unless they are
efficiently removed in fuel pre-treatment. Silicon in
the fuel may also originate from sand.

Pour Point (upper)
This test is carried out for fuels with viscosity below
100cSt at 50 deg. C only. It is an important test in
relation to storage and handling of residual and
distillate fuels in outdoor tanks, equipment.for
emergency use as well as ship bunker tanks
exposed to low temperatures. Failure of the fuel
to flow at low temperatures can cause engine
stoppages and adversely affect the safe operation
of the vessel.

The SOLAS Convention requires that the fuel should have a Flash
Point above 60 deg. C, except for emergency use (as in the life-
boat) where 43 deg. C and above would be acceptable.
If the flash point of the fuel is below the values indicated, the
vessel would have contravened Classification Rules and the insur-
ance policy would be invalidated.

(SHELL formula)
This is calculated based on an empirical formula from Shell and is
useful as a guide to indicate the ignition quality of the residual fuel.
Other Metals
In addition to the above, if the percentage ash levels exceed the limits
for the respective grades as shown in the ISO specifications, additional
metals such as iron, calcium, nickel, lead, zinc and magnesium will
also be tested. These additional metals are recorded in the FQT
database and are reported to the member only if relevant.

The Police Department budgeted for a CIP project called the Fluorescein Evidence Enhancement Kit.
This kit consists of two major components. The first being the Master kit which provides the necessary
equipment to apply the reagent, the necessary filter to photograph and record the evidence, and the filters
to convert our labs current light source to the proper frequencies. The cost for this portion will be
$2770.00.
The second component is the Polilight PL500 that is used to illuminate trace evidence once it has been
treated by the reagent. The Polilight PL500 will illuminate entire walls and rooms and will allow
investigators to photograph the evidence so that they can record in a medium that is visible to the naked
eye. The Polilight also has proven beneficial in locating old bruises and wounds on victims even after
they have healed and are no longer visible. The Polilight due to its range of light frequencies also allows
the evidence technicians to locate other fluid and fiber evidence. This piece of equipment will cost
$16,625.00. Southwestern Engineering and Equipment is the exclusive agent for the Polilight PL500.
Total Project Cost: $19,395.00

Fluorescein Evidence Enhancement Kit
Description:
In the past number of years, crime scene investigators have been using a process called Luminol
to locate trace evidence, particularly blood evidence at crime scenes. Luminol would help the
investigator to locate blood evidence even though the blood had been washed away and even
painted over. The problem with the technique was the clean up problems after using the reagent
Luminol. Recently it has been determined to be carcinogenic and considered a bio-hazard which
further complicates the clean up issue after use.
Researchers have found another process that has been used in the medical and food processing
field that will render the same results as Luminol, but completely safe. They determined that by
using Fluorescein as the reagent and then using a intense light sources with specific wave lengths
they can locate the same trace elements that Luminol could find and additional evidence by
utilizing different wave length frequencies. This new process utilizing the proper light source can
locate old bruises or wounds that have healed and not visible to the naked eye and is safe to apply
to the skin of a victim to obtain this evidence.
This project contains two basic components, the first being the Master Kit which provides the
necessary equipment to apply the reagent, the reagent chemicals, the necessary filter to
photograph and record the evidence, and the filters to convert our labs current light source to the
proper frequencies. The cost for this portion will be $2770.00 and contains the following
components:
• One portable air compressor
• One sprayer model number 1985 with extension wand
• One high pressure canister sprayer
• One sprayer model number 1998 for the hydrogen peroxide
• Bottles of hydrogen peroxide
• Two leak proof Nalgene bottles for distilled water
• One Chemical reagent kit consisting of five separate batches of chemical reagents
• Four filter goggles for technicians to see the trace evidence
• Camera and video camera filters to record the evidence for normal viewing

the bunker hose flange. A sampling
device should be installed at this
location for taking a continuous drip
sample throughout the whole dura-
tion of the bunkering.
It is a common practice for the supplier's representative to ask the
Chief Engineer to sign sample labels in advance of bunkering. This
practice of pre -signing the sample label must be avoided as it will put
you in a legally disadvantageous position if the labels are misused. If
offered a sample by the supplier where the contents were not taken
at the point of custody transfer or where sampling was not witnessed,
it is important to sign `For receipt only, source unknown.'
DNVPS has designed a line sampler which makes sampling very con-
venient for the shipboard staff. This is available on order.
The one -litre sample bottles are sealed, labelled and signed by all parties present. One sample is offered
to the supplier and one retained on board the ship for safe keeping in case further testing is required. In
some instances, the charterer and the shipowner may both be in the FQT programme and may require
samples to be tested separately. The additional two samples are intended fof this purpose. Details of
sample preparation and documentation are contained in the Manual provided in each kit.
It is important to ensure that a proper sampling device is used so that a representative sample can be taken
during bunkering. A representative sample is essential to ensure that the DNVPS analysis results and
technical advice provided to the vessel are valid and useful.

Effective Fuel Management-.
To obtain maximum benefits from the FQT program, member
vessels are advised to adopt the following procedures:
• Increase fuel quality awareness of crew
• Order against safe specifications
• Keep about five -days' reserve of tested bunker
• Practise correct sampling procedures
• Ensure proper documentation
• Segregate incoming bunker
• Minimise co -mingling, pump ROB into one tank
• Use buffer stock of tested fuel only
• Avoid taking risks, test all bunkering samples
• If use of defective fuel is unavoidable notify underwriters and
supplier immediately
• Contact DNVPS for technical assistance on fuel handling in
order to minimise damages
• Keep proper records of all bunkering and test results. This m;

Density
Fuel delivery is measured by
volume but invoiced by weight.
The density information is there-
fore essential for determining the
weight of the fuel received. Den-
sity must be known in order that
the shipboard staff can set the
centrifuges correctly and also for
calculating the calorific value
of the fuel.
Viscosity
Viscosity is the parameter deter-
mining fuel grade and thus the
price of the product delivered.
It must be known for determining
the fuel pre -heating temperature
prior to centrifuging and fuel
injection. Where additional
heating capacity on board the
ship is available, considerable
savings in fuel costs can be made
by burning a higher viscosity
grade without necessarily
compromising on fuel quality,
provided that there are no limita-
tions due to engine condition
and engine manufacturer's
recommendations.

Besides representing a loss of

Micro -Carbon Residue
The Micro -Carbon Residue con-
tent reflects the tendency for
incomplete combustion and the
formation of carbonaceous depos-
its. When burning a high carbon
residue fuel it is important to
avoid engine conditions which
tend to increase deposit forma-
tion. Some engines are more
prone to problems when burning
a high MCR fuel.
Turbocharger fouling from
sea -water contamination
Introduction

Flash Point (PMCC)
The SOLAS Convention requires that the fuel should have a Flash
Point above 60 deg. C, except for emergency use (as in the life-
boat) where 43 deg. C and above would be acceptable.
If the flash point of the fuel is below the values indicated, the
vessel would have contravened Classification Rules and the insur-
ance policy would be invalidated.
Calculated Carbon Aromaticity Index
(SHELL formula)
This is calculated based on an empirical formula from Shell and is
useful as a guide to indicate the ignition quality of the residual fuel.
Other Metals
In addition to the above, if the percentage ash levels exceed the limits
for the respective grades as shown in the ISO specifications, additional
metals such as iron, calcium, nickel, lead, zinc and magnesium will
also be tested. These additional metals are recorded in the FQT
database and are reported to the member only if relevant.
