CALL TO ORDER The meeting was called to order by Mayor Norman Malone at 6:00 p.m. Members of City Council Present: Councilpersons Guy Sutherland, Chuck Engelken, Howard Ebow, Peter Griffiths, Alton Porter, Deotis Gay, Charlie Young, Jerry Clarke, and Norman Malone. Deotis Gay arrived at 6:32 P.M. Members of Council Absent: None Members of City Executive Staff and City Employees Present: City Manager Robert T. Herrera, Assistant City Attorney John Armstrong, Assistant City Manager John Joerns, City Secretary Martha Gillett, Finance Director Cynthia Alexander, Assistant Finance Director Mike Dolby, Assistant City Secretary Janis Goulder, Public Works Director Steve Gillett, Planning Coordinator Masood Malik, Purchasing Manager Susan Kelley, Emergency Services Director Joe Sease, Planning Director Doug Kneupper and Police Chief Richard Reff. Francis Foger, Assistant Pastor, First United Methodist Church delivered the invocation. 3. Council considered approving the minutes of the Regular Meeting and Special Called Workshop Meeting held November 13, 2000. Motion was made by Councilperson Clarke to approve the minutes of the Regular Meeting and Special Called Workshop Meeting on November 13 2000 as presented. Second by Councilperson Young. The motion carried. Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Young, Clarke, and Malone. Nays: None Abstain: None 4. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAXPAYERS WISHING TO ADDRESS COUNCIL. The following citizens addressed City Council: Janis Goulder, 409 Texaco Weldon Rd., Dayton, Texas, addressed council to say thank you for the opportunity to work for the City of La Porte. Ms. Goulder informed Council her resignation is effective Friday, December 1, 2000. Sib Carpenter, 5234 Glenpark, LaPorte, Texas, addressed Council and recommended they seek volunteers for committees rather than appointing. She stated they would get a Council Minutes — Pg. 2 — 11/27/00 more volunteers. In addition, she encouraged Council to encourage more younger people to attend Council meetings so they would have people to take their places. 5. PUBLIC HEARING — SPECIAL CONDITIONAL USE PERMIT (SCU) PERMIT SCU00-002 FOR A REQUEST TO OPERATE A FUEL QUALITY TESTING BUSINESS LOCATED AT 320 N. 16TH STREET Open Public Hearing — Mayor Malone opened the Public Hearing at 6:17 PM. Review by Staff — Planning Director Doug Kneupper presented summary and recommendation. Public Input — Alfred Barry — provided Council with an overview of his company and encouraged Council to approve this Special Conditional Use Permit. Councilmember Deotis Gay arrived at 6:32 P.M. Recommendation of Staff — as recommended by the Planning and Zoning Commission, staff recommends approval of the Special Conditional Use Permit. Close Public Hearing — Mayor Malone closed the Public Hearing at 6:34 PM. 6. Council considered approving an ordinance amending the Code of Ordinances of the City of La Porte, Chapter 106, more commonly referred to as the Zoning Ordinance of the City of La Porte, by granting a Special Conditional Use Permit for that certain parcel of land described as follows: To Wit: Lots 1 through 8 and the adjoining west one-half of the alley of Block 681, J. Hunter Survey 1-35 for the purpose of operating a fuel quality testing business and storing a limited quantity of petroleum services products within a Light Industrial Zone (Ord. 1501-MM). Mayor read: ORDINANCE 1501-MM — AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY GRANTING A SPECIAL CONDITIONAL USE PERMIT FOR THAT CERTAIN PARCEL OF LAND DESCRIBED AS FOLLOWS: TO WIT: LOTS 1 THROUGH 8 AND THE ADJOINING WEST ONE-HALF OF THE ALLEY OF BLOCK 681, J. HUNTER SURVEY 1-35 FOR THE PURPOSE OF OPERATING A FUEL QUALITY TESTING BUSINESS AND STORING A LIMITED QUANTITY OF PETROLEUM SERVICES PRODUCTS WITHIN A LIGHT INDUSTRIAL ZONE. Motion was made by Councilperson Clarke to approve Ordinance 1501-NM as read by the Mayor. Second by Councilperson Engelken. The motion carried. Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Clarke, and Malone. Nays: Young Abstain: None 7. Council considered approving the purchase of a fluorescien evidence enhancement kit — R. Reff. 0 • City Council Minutes — Pg. 3—11-27-00 Police Chief Richard Reff presented summary and recommendation and answered Council's questions. Motion was made by Councilperson Young togpnrove the purchase of a fluorescien evidence enhancement kit as recommended by the Police Chief. Second by Councilperson Griffiths . The motion carried. Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Malone. Nays: None Abstain: None Council considered awarding a bid for the purchase of an A.D.A. compliant, 26-30 passenger bus to Thomas Bus Gulf Coast, Ltd. — S. Gillett Director of Public Works Steve Gillett presented summary and recommendation and answered Council's questions. Motion was made by Councilperson Ebow to approve purchase of an A.D.A. compliant 26-30 passenger bus to Thomas Bus Gulf Coast, Ltd. Second by Councilperson Griffiths. The motion carried. Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Malone Nays: None Abstain: None 9. ADMINISTRATIVE REPORTS City Manager Robert T. Herrera reminded Council of the following events. A. Annual tree lighting ceremony —November 30, 2000 10. COUNCIL ACTION Councilpersons Sutherland, Engelken, Ebow, Griffiths, Porter, Gay, Young, Clarke, and Malone brought items to Council's attention. 11. CHAPTER 551.071 THROUGH 551.076, AND 551.084, TEXAS GOVERNMENT CODE, - EXECUTIVE SESSION - PURSUANT TO PROVISION OF THE OPEN MEETINGS LAW, (CONSULTATION WITH ATTORNEY, DELIBERATION REGARDING REAL PROPERTY, DELIBERATION REGARDING PROSPECTIVE GIFT OR DONATION, PERSONNEL MATTERS, CONFERENCE WITH EMPLOYEES DELIBERATION REGARDING SECURITY DEVICES, OR EXCLUDING A WITNESS DURING EXAMINATION OF ANOTHER WITNESS IN AN INVESTIGATION). 12. The request, submitted by Mr. Alfred Barry, seeks aXproval of a Special Conditional Use Permit (SCUP) to operate a fuel quality testing business located at 320 N. 16 Street. A fuel quality testing establishment within a Light Industrial Zone is a Conditional Use, per Section 106-441 of the Code of Ordinances. In July 1999, a Special Conditional Use Permit was approved for Alliance Recovery Services for the same property. Alliance Recovery Services did not follow through with their permit. This request is for use of an existing building with some site modifications. The use will be fuel quality testing on site. Staff has found the request satisfies all applicable ordinance requirements. The property is surrounded by Maxim Rentals (formerly Anthony Crane Rentals) on the west, warehouses on the south and east, and a heavy wooded area on the north. The facility is compatible with the surrounding properties and should not be injurious to the use, enjoyment or value of those properties. Seven (7) notices of public hearing were mailed to neighboring property owners. One favorable response was received in this regard. The Planning and Zoning Commission, by unanimous vote, has recommended City Council approval of Special Conditional Use Permit #SCU00-002 with the following conditions: 1. A minor development site plan prepared in accordance with the requirements of the Development Ordinance 1444 shall be submitted for review and approval by the City. 2. Landscaping of the facility shall be required. 3. The applicant is responsible for public hearing costs of $106.86. Action Required by Council: 1. Conduct public hearing. 2. "Section 4. Subsequent to receipt of the recommendation of the City of La Porte Planning and Zoning Commission, the City Council of the City of La Porte called a public hearing on the proposed classification changes and the recommendation of the Planning and Zoning Commission on the 27" day of November, 2000, at 6:00 p.m., and pursuant to due notice, to consider the recommendation of the Planning and Zoning Commission regarding the possible reclassification of the zoning classification of the hereinafter described parcels of land. There is attached to this Ordinance as Exhibit "D", incorporated by reference herein and made a part hereof for all purposes, a copy of the notice of public hearing. "Section 5. The publisher's affidavit of publication of notice of said hearing is attached hereto as Exhibit "E", and incorporated by reference herein and made a part hereof for all purposes. "Section 6. The City Council of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission, and the Special Conditional Use Permit for the hereinafter described parcels of land, situated within the corporate limits of the City of La Porte, is hereby granted. Failure to begin construction within one (1) year after issuance or as scheduled under the terms of a special conditional use permit shall void the permit as approved, except upon an extension of time granted after application to the Planning and Zoning Commission. Luminol would help the investigator to locate blood evidence even though the blood had been washed away and even painted over. The problem with the technique was the clean up problems after using the reagent Luminol. Recently it has been determined to be carcinogenic and considered a bio-hazard which further complicates the clean up issue after use. Researchers have found another process that has been used in the medical and food processing field that will render the same results as Luminol, but completely safe. They determined that by using Fluorescein as the reagent and then using a intense light sources with specific wave lengths they can locate the same trace elements that Luminol could find and additional evidence by utilizing different wave length frequencies. This new process utilizing the proper light source can locate old bruises or wounds that have healed and not visible to the naked eye and is safe to apply to the skin of a victim to obtain this evidence. The density information is there- fore essential for determining the weight of the fuel received. Den- sity must be known in order that the shipboard staff can set the centrifuges correctly and also for calculating the calorific value of the fuel. Viscosity Viscosity is the parameter deter- mining fuel grade and thus the price of the product delivered. It must be known for determining the fuel pre -heating temperature prior to centrifuging and fuel injection. Where additional heating capacity on board the ship is available, considerable savings in fuel costs can be made by burning a higher viscosity grade without necessarily compromising on fuel quality, provided that there are no limita- tions due to engine condition and engine manufacturer's recommendations. Salt water can lead to corrosion, the sticking of pumps, injectors and deposits in cylinders and turbochargers. Micro -Carbon Residue The Micro -Carbon Residue con- tent reflects the tendency for incomplete combustion and the formation of carbonaceous depos- its. When burning a high carbon residue fuel it is important to avoid engine conditions which tend to increase deposit forma- tion. Some engines are more prone to problems when burning a high MCR fuel. C, except for emergency use (as in the life- boat) where 43 deg. C and above would be acceptable. If the flash point of the fuel is below the values indicated, the vessel would have contravened Classification Rules and the insur- ance policy would be invalidated. Calculated Carbon Aromaticity Index (SHELL formula) This is calculated based on an empirical formula from Shell and is useful as a guide to indicate the ignition quality of the residual fuel. Other Metals In addition to the above, if the percentage ash levels exceed the limits for the respective grades as shown in the ISO specifications, additional metals such as iron, calcium, nickel, lead, zinc and magnesium will also be tested.
