MINUTES OF THE REGULAR MEETING
OF LA PORTE CITY COUNCIL
JULY 23, 2001
1. CALL TO ORDER
The meeting was called to order by Mayor Norman Malone at 6:00 p.m.
Members of City Council Present: Councilpersons Chuck Engelken, Howard Ebow, Peter
Griffiths, Alton Porter, James Warren, Charlie Young, Jerry Clarke, and Norman Malone.
Members of Council Absent: Councilperson Guy Sutherland
Members of City Executive Staff and City Employees Present: City Manager Robert T.
Herrera, Assistant City Manager John Joerns, Assistant City Attorney John Armstrong,
City Secretary Martha Gillett, Finance Director Cynthia Alexander, Assistant Finance
Director Mike Dolby, Interim Director of Administrative Services Carol Buttler, Parks
and Recreation Director Stephen Barr, Assistant City Secretary Sharon Harris, Public
Works Director Steve Gillett, Purchasing Manager Susan Kelley, Emergency Services'
Director Joe Sease, Planning Director Doug Kneupper, City Engineer Carlos Martinez,
City Coordinator Masood Malik, Police Chief Richard Reff, and Golf Pro Alex Osmond.
Others Present: Carlos Smith, Deborah Johnson, Dave Turnquist, Nick Barrera, Nazar
Momin, Charles Underwood, Paul Larson, Colleen Hicks, Davis Wilson, Sib Carpenter,
Spero Pomonis, and a number of citizens.
2. Reverend Michael Bingham of Abundant Life church delivered the invocation.
3. Council considered approving the minutes of the Regular Meeting and Special Called
Workshop Meetings on July 9,2001.
Motion was made by Councilperson Clarke to approve the minutes of the Regular
Meeting and Special Called Workshop Meetings on July 9.2001 as presented. Second by
Councilperson Griffiths. The motion carried.
Ayes: Engelken, Ebow, Griffiths, Porter, Warren, Young, Clarke, and Malone.
Nays: None
Abstain: None
4. PETITIONS, REMONSlRANCE, COMMUNICATIONS, AND CITIZENS AND
TAXPAYERS WISHING TO ADDRESS COUNCIL.
The following citizens addressed City Council.
Davis Wilson - 11222 Richmond Houston, TX an architect requested that council vote in
favor of the street and alley closing Item No.9 on the agenda.
Paul Larson - 406 4th Street La Porte, TX spoke against the street and alley closing in
Blocks 328 and 329, Town of La Porte and the North 2nd Street right-of-way between
Blocks 328 and 329.

Nazar Momin - 6306 Hiddencrestway Sugarland, TX was opposed to the same street and
alley closing and provided Mayor and Council with a signed petition in opposition of the
closure.
5. PRESENTATIONS
City Manager Robert Herrera presented Cynthia Alexander, Michael Dolby, and Shelly
Wolny with a Certificate of Distinction for the City's Investment Policy.
6. Assistant City Attorney John Armstrong requested this item be tabled until the next
meeting, due to needed changes.
Motion was made by Councilperson Griffiths to table Resolution 2001-06 as
recommended by Assistant City Attorney John Armstrong. Second by Councilperson
Ebow. The motion carried.
Ayes: Engelken, Ebow, Griffiths, Porter, Warren, Young, Clarke, and Malone.
Nays: None
Abstain: None
7. Council considered approving an ordinance appointing members to various Boards and
Commissions.
Assistant City Attorney read: ORDINANCE 2001-2494 - AN ORDINANCE
APPOINTING MEMBERS TO VARIOUS BOARDS, COMMISSIONS, AND
COMMITIEES, OF THE CITY OF LA PORTE, PROVIDING A SEVERABILITY
CLAUSE, CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Warren to approve Ordinance 2001-2494 as
presented by Mr. Armstrong. Second by Councilperson Clarke. The motion carried.
Ayes: Engelken, Ebow, Griffiths, Porter, Warren, Young, Clarke, and Malone.
Nays: None
Abstain: None
8. Council considered approving ordinances authorizing the City Manager to sign an
agreement with the La Porte Independent School District for law enforcement services.
Police Chief Richard Reff presented summary and recommendation and answered
Council's questions.

Assistant City Attorney read: ORDINANCE 2001-2499 - AN ORDINANCE
APPROVING AND AUTHORIZING THE RENEWAL OF A LAW ENFORCEMENT
SERVICES AGREEMENT BETWEEN THE CITY OF LA PORTE AND THE LA
PORTE INDEPENDENT SCHOOL DISTRICT, MAKING VARIOUS FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Engelken to approve Ordinances 2001-2499
presented by ChiefReff. Second by Councilperson Ebow. The motion carried.
Ayes: Engelken, Ebow, Griffiths, Porter, Warren, Young, Clarke, and Malone.
Nays: None
Abstain: None.
9. Council considered approving an ordinance approving to vacate, abandon, and close the
alleys in Blocks 328 & 329, and North 2nd Street Right-of-Way, and to also authorize
execution of a Street & Alley Closing Agreement with the applicant.
Planning Director Doug Kneupper presented summary and recommendation and
answered Council's questions.
Assistant City Attorney read: ORDINANCE 2001-2500 - AN ORDINANCE
VACATING, ABANDONING AND CLOSING THE ALLEYS IN BLOCKS 328 AND
329, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, AND A PORTION OF THE
RIGHT -OF-WAY OF NORTH 2ND STREET, TOWN OF LA PORTE, HARRIS
COUNTY TEXAS, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW;
AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Warren to table item until next meeting as presented
by Mr. Kneupper. Second by Councilperson Griffiths. The motion carried.

10. Council considered approving an ordinance authorizing the City Manager to execute a
Special Warranty Deed and coordinate the exchange of property with Charlie Hinds.

AUTHORIZING THE EXECUTION OF A SPECIAL WARRANTY DEED FROM
THE CITY OF LA PORTE TO CHARLES C. HINDS, IN ACCORDANCE WITH THE
TERMS AND PROVISIONS OF AN EXCHANGE AGREEMENf BETWEEN THE
CITY OF LA PORTE AND CHARLES C. HINDS, DATED MAY 17, 2001, MAKING
VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT,
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Griffiths to approve Ordinance 2001-2501 as
presented by Mr. Kneupper. Second by Councilperson Engelken. The motion carried.

11. Council considered awarding the bid for two new Fire Units to Metro Fire Apparatus
Specialist in the amount of $458,908.00.
Director of Emergency Services Joe Sease presented summary and recommendation and
answered Council's questions.
Motion was made by Councilperson Griffiths to approve awarding the bid as presented
by Mr. Sease. Second by Councilperson Ebow. The motion carried.
Ayes: Engelken, Ebow, Griffiths, Porter, Warren, Young, Clarke, and Malone.

12. Consent Agenda
A. Consider awarding annual contract for janitorial service to Sparkling
Maintenance Service- S. Kelley
B. Consider approval to purchase the 13 tactical body armor with the bulletproof
vest partnership grant funds- R. Reff
Motion was made by Councilperson Porter to approve the consent agenda as presented by
Ms. Kelley and Chief Reff. Second by Councilperson Young. The motion carried.

City Manager Robert T. Herrera reported on the City Auction held on July 12,2001.
Council was also informed of the Blood Drive scheduled for July 27,2001 at City Hall.

Councilpersons Engelken, Ebow, Griffiths, Porter, Warren, Young, Clarke, and Malone
brought items to Council's attention.

The Bayport Terminal Expansion Project seems to be a reality since the citizen of Harris County has
approved the $1.3 billion dollars bond issues. Bayshore I La Porte's economic as well as residential
growth is just about to take off in a big way. We may enjoy growth as it comes along but we the citizen
may face some difficult challenges.
While all these activities are happening around us we should maintain La Porte as a bedroom
community. We need to encourage more single-family residential development and commercial retail
shopping power centers. Weare glad that the City Council as well as Planning and Zoning Board with
conjunction of City Planning Department are working together with the master plan. However, we wish
to bring to your attention the following serious and thought provoking ideas for your consideration:
1. In order to beautify the area, we should come up with construction criteria. City of La Porte
should not allow building a metal building facing Highway 146. The front as well as both sides
of building should be brick, concrete block and or stucco. These metal buildings do not give a
very good impression about the city's image. Those metal buildings are eyesore.
2. City of Deer Park recently passed an ordinance that will prohibit building of new apartment
complexes. In order to improve the beautification on Barbours Cut Blvd, Highway 146 and 225,
city of La of Porte should consider banning permanently building truck depots as well as truck
stops, truck fueling stations (attended or unattended). These kinds of operation creates
environmental problems, prostitute and drug related crimes. Wherever we look around we see
tankers, containers and trucks rather than park and recreational facility. Therefore, we are
requesting the city of La Porte Council to consider prohibiting these kinds of operations.
3. We believe these restrictions will (a) calm down the opposition and outrage of citizen for the
Bayport Terminal Project and (b) enhance opportunities for other. development to take place
that will beautify the city's highway and main thoroughfares.
We hope that you will make a right decision for the city to look more beautiful.

For
Investment Policy
The City conforms to all statues governing the investment of funds in
accordance with the Public Funds Investment Act, Chapter 2256, of the
Texas Government Code, which governs the investment of government
funds in Texas. Under this law, specific parameters are set for Texas cities,
requiring them to adopt an investment policy and designate an investment
officer, who is required to attend approved training courses.
It is the policy of the City of La Porte, Texas to administer and invest its
funds in a manner which will preserve the principal and maintain the
liquidity through limitations and diversification, while meeting the daily
cash flow requirements of the City.
The Government Treasurer's Organization of Texas (GTOT) conducts an
Investment Policy Certification Program that is designed to provide
professional guidance in developing an investment policy, and to recognize
outstanding examples of written investment policies.
Weare proud to announce that the Government Treasurer's Organization of
Texas has awarded the Certificate of Distinction to the City of La Porte for
its Investment Policy. The city was congratulated for its success in
developing a comprehensive written investment policy that meets the criteria
set forth by GTOT.
Only 24 Texas cities have been awarded the Certificate of Distinction for
their Investment Policy, which is good for a period of two years.

A RESOLUTION PROHIBITING THE ISSUANCE OF BUILDING PERMITS
WITHIN AN AREA DESIGNATED FOR RIGHT-OF-WAY ACQUISITION FOR
HARRIS COUNTY FLOOD CONTROL DISTRICT PROJECT F216-00-00; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
BE IT RESOLVED BY THE CITY COUNCIL OF LA PORTE:
Section I. The Harris County Flood Control District, through cooperation with
the City of La Porte, has determined the preliminary right-of-way proposed for the F216-
00-00 project. A map or plat showing the location of the preliminary right-of-way is
attached to this resolution as Exhibit "A", incorporated by reference herein, and made a
part hereof for all purposes. The Harris County Flood Control District has requested that
the City of La Porte issue no building permits for any area within the proposed right-of-
way.
Section 2. From and after the effective date of this resolution, no City of La Porte
building permits shall be issued in the area of the proposed right-of-way for Harris
County Flood Control District Project F216-00-00, as shown on the map or plat attached
hereto as Exhibit "A".
Section 3. The City Council officially finds, determines, recites and declares that
a sufficient written notice of the date, hour, place and subject of this meeting of the City
Council was posted at a place convenient to the public at the City Hall of the City of La
Porte, Texas for the time required by law preceding this meeting, as required by the Open
Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been
open to the public as required by law at all times during which this resolution and the
subject matter thereof has been discussed, considered and formally

permanently vacated, abandoned and closed by the City of La Porte,
to-wit:
TRACT ONE:
Being all of the alleys in Blocks Three Hundred Twenty-
eight (328) and Three Hundred Twenty-nine (329), Town of
La Porte, Harris County, Texas;
TRACT TWO:
That portion of the right-of-way of North 2nd Street
lying and being situated between Blocks Three Hundred
Twenty-eight (328) and Three Hundred Twenty-nine (329),
Town of La Porte, Harris County, Texas, and between the
north right-of-way of North "E" Street, and the south
right-of-way of West Barbours Cut Boulevard, SAVE AND
EXCEPT a sixty foot (60') wide drainage easement on said
Tract Two.
Section 2.
The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required

by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon.
The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
Section 3. This Ordinance shall be effective upon full and
complete performance of the terms of a Street and Alley Closing
Agreement executed between the City of La Porte and the owner of
Blocks 328 and 329, Town of La Porte, Harris County, Texas. In the
event all terms of said agreement are not fulfilled within ninety
(90) calendar days from the date of passage and approval, this
ordinance shall be deemed null and void.

This agreement., made this
day of
,2001, by and between the City of La Porte,
herein called "City", acting herein through its City Manager and Ameen Narsi, an individual, of La Porte, Harris County,
Texas, hereinafter called "Owner".
WITNESSETH
1. All references to "Alley Closing" hereunder shall, for the pwposes of this agreement, refer to vacating, abandoning and
closing of the alleys in Block 328 and 329, and the North 2nd Street Right-of-Way between Blocks 328 & 329, Town of
La Porte, Harris County, Texas.
(Re: CLP File No. SAC-2000-03 & CLP Ordinance No.

2. Owner is the owner of certain property in the City of La Porte, Harris County, Texas, identified as Blocks 328 & 329,
Town of La Porte, Harris County, Texas.
3. Owner has petitioned City to vacate, abandon and close the alleys of Blocks 328 & 329 and the North 2nd Street Right-
of-Way between Blocks 328 & 329, Town of La Porte, Harris County, Texas.
4. As a condition of passage and approval of an ordinance vacating, abandoning and closing of said alley, Owner shall be
responsible for the following:
. Owner shall submit plat of proposed subdivision of Owner's property for approval by City. Said subdivision
plat shall include dedication of a ten foot (10') wide sanitary sewer easement., as shown on the attached
Exhibit" A", to facilitate the relocation of an existing eight-inch (8") sanitary sewer line from the alley of
Block 328, Town of La Porte.
. Owner shall be fully responsible for relocation of said eight-inch (8") sanitary sewer main from alley in Block
328, Town of La Porte to the aforementioned ten-foot (10') wide sanitary sewer easement to be dedicated by
Owner's subdivision plat This shall include the preparation and submittal of engineered drawings.
construction of new 8" sanitary sewer line, and acceptance of relocated 8" sanitary sewer line by City.
. As a result of unauthorized clearing conducted by Owner within the North "E" Street Right-of-Way, Owner
has compensated City $4,610 to plant trees.
5. City will inspect and approve all work performed under the terms of this agreement for compliance to City standards.
6. Owner shall have ninety (90) calendar days from the date of passage and approval of an ordinance closing the
aforementioned rights-of-way to fulfill all terms of this agreement.

Our annual surplus auction was held in conjunction with the City of Deer Park, City of
Pearland, and San Jacinto College on Thursday, July 1ih at our Public Works facility. Due to
scheduling with the auctioneer and the auction being held late in the summer, the decision was
made to hold the auction on a weeknight.
We had a good tumout with 111 people registering, and 63 of those buying. This number is
about the same as last year at the City of Deer Park, and 18% over the 1999 auction held at
the City of La Porte. Our net receipts yielded about 13% less than last year. This appears to
be due to the fact we sold fewer vehicles than in the past. Our miscellaneous items were
about the same in volume, however, we received slightly more in dollar value.

Summary and Recommendation
Harris County Flood Control District (HCFCD) in conjunction with a consulting engineer, Binkley &
Barfield, Inc. has prepared a preliminary report titled Hydraulic Analysis for Little Cedar Bayou
Watershed. The purpose of this report is to identify flooding and storm water characteristics in this
watershed and recommend improvements. Of particular importance is analyzing Little Cedar Bayou at its
upstream end near Sens Road and identifying improvements to decrease the water surrace elevation in
that area. Lowering the water surrace elevation would be beneficial for a future curb and gutter road
project for Sens Road.
Improvements recommended in this report can be divided into two parts, 1) Linear Detention between SH
146 and Spencer Highway, and 2) Channel Improvements from Spencer Highway upstream toSens Road.
The detention pond calls for the excavation of approximately 200,000 cubic yards of material and is
intended to be linear and follow the existing alignment of Little Cedar Bayou. The channel improvements
will be widening and deepening of the existing channel to provide greater flow rates downstream to the
detention pond.
The attached Resolution was prepared using the aforementioned engineering report and identifies
the area recommended for detention improvements and the area recommended for channel
improvements. This Resolution will provide the City with a tool to restrict development of
property needed for future drainage improvements. This is similar to action taken in 1988 to
help secure property for improvements to F-I0l in the Lomax area.
Action Required by Council:
Consider approval of a Resolution restricting the development of certain parcels of land intended to be
acquired by the City (or others) for drainage improvement purposes.

HARRIS COUNTY FLOOD CONTROL DISTRICT PROJECT F216-00-00; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN

BE IT RESOLVED BY THE CITY COUNCIL OF LA PORTE:
Section 1. The Harris County Flood Control District, through cooperation with
the City of La Porte, has determined the preliminary right-of-way proposed for the F216-
00-00 project. A map or plat showing the location of the preliminary right-of-way is
attached to this resolution as Exhibit "A", incorporated by reference herein, and made a
part hereof for all purposes. The Harris County Flood Control District has requested that
the City of La Porte issue no building permits for any area within the proposed right-of-
way.
Section 2. From and after the effective date of this resolution, no City of La Porte
building permits shall be issued in the area of the proposed right-of-way for Harris
County Flood Control District Project F216-00-00, as shown on the map or plat attached
hereto as Exhibit "A".

declared to be the intention of this City Council to have passed
each section, sentence, phrase or clause, or part thereof,
irrespective of the fact that any other section, sentence, phrase
or clause, or part thereof, may be declared invalid.
Section 10. All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of such conflict only.
Section 11. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the

On February 23, 1998 the City Council authorized an Agreement between the City of La Porte and the La Porte
Independent School District under Ordinance 98.2224. The agreement was to furnish two (2) Police Officers to
work on the campus of the La Porte High School and the Agreement was for a three year period, ending on the last
day of school in 200 1, with an option to extend for anther two years.
The City of La Porte and the La Porte Independent School District desires to continue with the Agreement for an
. additional two years with an option for renewal. This Agreement will end on the last day of school in the year 2003,
unless renewed.
The La Porte Independent School District agrees to pay the City of La Porte a sum of $93,000.00 for the assignment
of those two Officers. There will an increase after the first year by a factor equal to any Consumer Price Index -
Urban (CPI-U) for each year after that using January 1, 200 I as the base.
These Officers work at the La Porte High School under the direction of the Chief of Police to assist the School
District in providing a safe learning environment for its students and investigate any violations of the City of La
Porte's Ordinances and State laws.
There are no additional costs to the Oty of La Pone.

ENFORCEMENT SERVICES AGREEMENT BETWEEN THE CITY OF LA PORTE AND THE
LA PORTE INDEPENDENT SCHOOL DISTRICT, MAKING VARIOUS FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT, FINDING COMPLIANCE WITH THE

Section 1. The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The city Manager is hereby authorized to execute such
document and all related documents on behalf of the City of La
Porte. The city Secretary is hereby authorized to attest to all
such signatures and to affix the seal of the City to all such
documents.

AGREEMENT
STATE OF TEXAS

COUNTY OF HARRIS
WHEREAS, this Agreement is made and entered into by and
between the LA PORTE INDEPENDENT SCHOOL DISTRICT, hereinafter
called "DISTRICT", and the CITY OF LA PORTE, a Texas Municipal
Corporation, hereinafter called "CITY".
WIT N ESE T H:
WHEREAS, DISTRICT desires to have the Chief of Police of the
City of La Porte, hereinafter called "CHIEF", authorize and direct
two (2) of CITY's patrol officers, hereinafter called "PATROL
OFFICERS", to devote those officers' working time to the District
Schools, during the normal school year, including teacher work
days; and
WHEREAS, DISTRICT is willing to pay the CITY an agreed amount
equal to the cost to the CITY for supplying law enforcement
services, including salary and any additional expenses the CITY may
incur in providing these services, so as to enable the PATROL
OFFICERS assigned by the CHIEF to provide those services;
NOW THEREFORE, in consideration of the mutual covenants,
agreements, and benefits to both parties, it is AGREED as follows:
1.
The CITY agrees to authorize the CHIEF to assign PATROL
OFFICERS to provide law enforcement services to La Porte Schools.
As used herein, the phrase "working time" means the usual or normal
hours that the PATROL OFFICER is required to work in any calendar
month and does not include any extra overtime work. The time the
PATROL OFFICERS are on duty within the area of the schools, the
time the PATROL OFFICERS are in court in connection with cases
arising out of events occurring within the area, the time the
PATROL OFFICERS spend in preparing reports and documents pertaining
to events occurring in the area, the time the PATROL OFFICERS spend
transporting persons arrested in the area to jail, the time the
PATROL OFFICERS spend investigating crimes or possible crimes
committed in the area, and the time spent in any and all activities
related to performing law enforcement services for the DISTRICT
shall be deemed working time. The items listed above are
explanatory and the meaning for "working time" is not limited to
said list.

II.
The DISTRICT agrees to pay to the CITY the sum of $93,000.00
for assignment of two (2) PATROL OFFICERS to the DISTRICT. This
sum is based on two (2) officers working eight (8) hours each day,
for 189 days in the school year. The sum shall be for working time
of the PATROL OFFICERS, and include all items provided by the City
to the officers, including automobiles, uniforms, and related
equipment. This cost shall remain constant for the first year, and
may be increased by a factor equal to any Consumer Price Index -
Urban (CPI-U) increases, for each year thereafter, using January
2001, as a base. The CITY shall notify the DISTRICT of any
increases at least thirty (30) days prior to the effective date of
the proposed increase.
The CITY agrees to provide to the DISTRICT an invoice, at the
beginning of each semester, setting forth the costs for providing
the law enforcement services to the DISTRICT. The DISTRICT agrees
to reimburse the CITY the cost as set forth in the invoice within
thirty (30) days of the date of such invoices. If the DISTRICT,
for any reason disputes any items in any invoices submitted by the
CITY, the DISTRICT shall promptly notify the CITY of the dispute
and request clarification and/or remedial action. The decision of
the CITY regarding all disputes involving the cost for providing
PATROL OFFICERS shall be final. Payment shall be made to the City
of La Porte, Attention: Finance Director, 604 West Fairmont
Parkway, La Porte, Texas 77571. Invoices sent by the CITY shall be
addressed to La Porte Independent School District: Attention:
David Webb, Business Office, 301 East Fairmont Parkway, La Porte,
Texas 77571. Either party hereto may change its address for the
purposes of this agreement by giving written notice of such change
in the manner provided for in this agreement.
III.
The term of this agreement shall be for each school year, as
determined by the DISTRICT, commencing August 20, 2001, for the
2001-2002 school year, and ending on the final day of school in the
year 2003, and shall include an option to extend this agreement for
an additional two (2) years, with the same terms and conditions,
upon the approval of the CITY and the DISTRICT. It is expressly
understood and agreed that the period or term of this agreement may
be terminated with or without notice by the CITY at any time after
the DISTRICT has defaulted on any payment of any obligation
hereunder. Payments hereunder shall be pro-rated to effective date
of cancellation.
Any notice permitted or required to be given in this paragraph
to the DISTRICT shall be given by registered or certified United
States mail, postage prepaid, return receipt requested, and
addressed to the DISTRICT at 301 East Fairmont Parkway, La Porte,
Texas 77571.

the CITY, Attention: city Manager, at 604 West Fairmont Parkway, La

IV.
It is expressly understood and agreed that any PATROL OFFICERS
assigned to work at the DISTRICT shall be subject to the exclusive
control and supervision of the CHIEF and to the same extent as all
other PATROL OFFICERS, and shall have no duty or obligation to the
DISTRICT other than those duties or obligations which the PATROL
OFFICERS would have to the public generally, to enforce state laws
and CITY ordinances, specifically, PATROL OFFICERS shall not be
required to enforce DISTRICT rules and regulations. The CHIEF
shall set the working times (hours and days) for the PATROL
OFFICERS after consulting with a designated agent of the DISTRICT.
V.
It is expressly agreed and understood between the DISTRICT and
the CITY, that if, in the opinion of the CHIEF, it is necessary to
use the PATROL OFFICERS assigned to carry out this agreement for
other duties due to an emergency, or other reasons as determined
solely by the CHIEF, that the CHIEF may temporarily suspend the
assignment of PATROL OFFICERS to comply with this agreement. It
is, however understood by both the CITY and the DISTRICT that the
DISTRICT will be credited on a pro-rata basis for charges hereunder
if an officer is temporarily assigned to other duties at the
direction of the CHIEF.
VI.
Both parties mutually agree that the CITY is an independent
contractor, and shall have exclusive control of performance
hereunder, and that employees of the CITY are in no way to be
considered employees of the DISTRICT.
VII.
Should any litigation be commenced between the parties hereto
concerning this agreement, or the rights and duties of either party
in relation thereto, the party prevailing in such litigation shall
be entitled,in addition to such other relief as may be granted, to
a reasonable sum as and for its attorney's fees in such litigation.
Nothing in this paragraph shall be construed so as to limit or
waive the sovereign immunity of either the CITY of the DISTRICT.
VIII.
This agreement shal'l be construed under and in accordance with
the laws of the State of Texas, and all obligations of the parties
hereunder shall be performed in Harris County, Texas.

IX.
If anyone or more of the provlslons contained in this
agreement shall for any reason be held to be invalid, illegal, or
unenforceable in any respect, such invalidity, illegality, or
unenforceability shall not affect any other provision thereof and
this agreement shall be construed as if such invalid, illegal, or
unenforceable provision had never been contained herein.
X.
This agreement constitutes the sole and only agreement of the
parties hereto and supersedes any prior understanding of written or
oral agreements between the parties respecting the subject matter
within.
XI.
No amendment, modification, or alteration of the terms hereof
shall be binding unless submitted in writing, dated subsequent to
the date hereof, and duly executed by both parties.
XII.
Neither party to this agreement may assign their rights,
duties, or interests without first obtaining the written consent of
the other party. Consent to one assignment shall not be deemed to
be consent to any subsequent assignment. An assignment without the
written agreement of both parties, or an assignment by operation of
law, shall be void, and shall, at the option of either party,
terminate this agreement.
IN WITNESS WHEREOF, the undersigned DISTRICT and CITY hereto
execute this agreement effective on this 20th day of August, 2001.

SUMMARY & RECOMMENDATION
Ameen Narsi ofNarsi, Inc. has petitioned the City to vacate, abandon and close the alleys in Blocks 328 & 329, Town
of La Porte and the North 2nd Street Right-of-Way between the Blocks 328 & 329. The purpose of his request is to
facilitate a new business development at this site. In reviewing the closing request, Staff has determined that an
inactive 8" sanitary sewer line exists within the alley of Block 329 and an active 8" sanitary sewer line exists within the
alley of Block 328. Additionally, drainage facilities exist within the North 2nd Street Right-of-Way (see Exhibit "A").
In order to address these issues, Staffhas determined that the 8" line in the alley of Block 329 should be abandoned in
place, a drainage easement should be retained within the North 2nd Street Right-of-Way to facilitate existing drainage
facilities, and the active 8" waterline in the alley of Block 328 should be relocated to a dedicated easement on the
applicant's property. All franchised utility companies have received notification of the closing application and have
responded to the applicant's request. Reliant Energy, Southwestern Bell and Time Warner Communications have each
provided letters of no objection to the closing. Mr. Narsi has entered into a Street & Alley Closing Agreement which
requires submission of a subdivision plat, relocation of the active 8" sanitary sewer line, and restoration of vegetation
within the North "E" Street Right-of-Way.
In accordance with Ordinance No. 98-2225, Staff has arranged for an independent appraisal to be conducted for the
rights-of-way in question As a result, the fair II13.Iket value of the property has been assessed at $0.74 per square foot.
The City has received compensation from the applicant for 36,800 square feet of public right-of-way in the amount of
$20,424 (75% of fair market value per City ordinance). Mr. Narsi has also submitted payment in the amount of $4,610
for the restoration of the North "E" Street Right-of-Way.
Recommendation:
Staff recommends closing, vacating, and abandoning the alleys in Blocks 328 & 329, Town of La Porte and the North
2nd Street Right-of-Way between Blocks 328 & 329. Staff also recommends abandoning an existing 8" sanitary sewer
line in the alley of Block 329, retaining a 60' wide drainage easement within the North 2nd Street Right-of-Way and
execution of a Street & Alley Oosing Agreement between Ameen Narsi and the City.
Action Required by Council:
Consider approval of an ordinance to vacate, abandon and close the alleys in Blocks 328 & 329, Town of La Porte and
the North 2nd Street Right-of-Way between Blocks 328 & 329. Said ordinance to also authorize execution of a Street &
Alley Closing Agreement with the applicant.

ORDINANCE NO. 2001-
AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEYS IN BLOCKS
328 AND 329, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, AND A PORTION
OF THE RIGHT-OF-WAY OF NORTH 2ND STREET, TOWN OF LA PORTE, HARRIS
COUNTY, TEXAS, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND
PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has been
requested by record owner of all of the property abutting the
hereinafter described alleys in Blocks 328 and 329, Town of La
Porte, Harris County, Texas, and a portion of the right-of-way of
North 2nd Street, Town of La Porte, Harris County, Texas, to
vacate, abandon, and permanently close the alleys in Blocks 328 and
329, Town of La Porte, Harris County, Texas, and a portion of the
right-of-way of North 2nd Street, Town of La Porte, Harris County,
Texas; and
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine and declare that the
hereinafter described alleys in Blocks 328 and 329, Town of La
Porte, Harris County, Texas, and a portion of the right-of-way of
North 2nd Street, Town of La Porte, Harris County, Texas, are not
suitable, needed, or beneficial to the public as a public road,
street and alley, and the closing of the hereinafter described the
alleys in Blocks 328 and 329, Town of La Porte, Harris County,
Texas, and a portion of the right-of-way of North 2nd Street, Town
of La Porte, Harris County, Texas, is for the protection of the
public and for the public interest and benefit, and that the
hereinafter described alleys in Blocks 328 and 329, Town of La
Porte, Harris County, Texas, and a portion of the right-of-way of
North 2nd Street, Town of La Porte, Harris County, Texas, should be
vacated, abandoned, and permanently closed.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Under and by virtue of the power granted to the
City of La Porte under its Home Rule Charter and Chapter 253,
section 253.001, Texas Local Government Code, the hereinafter
described alleys in Blocks 328 and 329, Town of La Porte, Harris
County, Texas, and a portion of the right -of -way of North 2nd
Street, Town of La Porte, Harris County, Texas, all as shown on the
plat attached hereto as Exhibit "A", incorporated by reference
herein and made a part hereof for all purposes, are hereby
permanently vacated, abandoned and closed by the City of La Porte,
to-wit:
TRACT ONE:
Being all of the alleys in Blocks Three Hundred Twenty-
eight (328) and Three Hundred Twenty-nine (329), Town of
La Porte, Harris County, Texas;
TRACT TWO:
That portion of the right-of-way of North 2nd Street
lying and being situated between Blocks Three Hundred
Twenty-eight (328) and Three Hundred Twenty-nine (329),
Town of La Porte, Harris County, Texas, and between the
north right-of-way of North "E" Street, and the south
right-of-way of West Barbours Cut Boulevard, SAVE AND
EXCEPT a sixty foot (60') wide drainage easement on said
Tract Two.
Section 2.
The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the city Hall of the
city for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required

by law at all times during which this ordinance and the subject
matter thereof has been discussedt considered and formally acted
upon.
The City Council further ratifiest approves and confirms
such written notice and the contents and posting thereof.
Section 3. This Ordinance shall be effective upon full and
complete performance of the terms of a street and Alley Closing
Agreement executed between the city of La Porte and the owner of
Blocks 328 and 329t Town of La Portet Harris CountYt Texas. In the
event all terms of said agreement are not fulfilled within ninety
(90) calendar days from the date of passage and approvalt this
ordinance shall be deemed null and void.

STREET & ALLEY CLOSING AGREEMENT
THE STATE OF TEXAS:

This agreement, made this
day of
,2001, by and between the City of La Porte,
herein called "City", acting herein through its City Manager and Ameen Narsi, an individual, of La Porte, Harris CoWIty,
Texas, hereinafter called "Owner".
WITNESSETH
1. All references to "Alley Closing" hereunder shall, for the pwposes of this agreement, refer to vacating, abandoning and
closing of the alleys in Block 328 and 329, and the North 2nd Street Right-of-Way between Blocks 328 & 329, Town of
La Porte, Harris County, Texas.
(Re: CLP File No. SAC-2000-03 & CLP Ordinance No.

2. Owner is the owner of certain property in the City of La Porte, Harris County, Texas, identified as Blocks 328 & 329,
Town of La Porte, Harris CoWIty, Texas.
3. Owner has petitioned City to vacate, abandon and close the alleys of Blocks 328 & 329 and the North 2nd Street Right-
of-Way between Blocks 328 & 329, Town of La Porte, Harris County, Texas.
4. As a condition of passage and approval of an ordinance vacating, abandoning and closing of said alley, Owner shall be
responsible for the following:
. Owner shall submit plat of proposed subdivision of Owner's property for approval by City. Said subdivision
plat shall include dedication of a ten foot (10') wide sanitary sewer easement, as shown on the attached
Exhibit "A", to facilitate the relocation of an existing eight-inch (8") sanitary sewer line from the alley of
Block 328, Town of La Porte.
. Owner shall be fully responsible for relocation of said eight-inch (8") sanitary sewer main from alley in Block
328, Town of La Porte to the aforementioned ten-foot (10') wide sanitaxy sewer easement to be dedicated by
Owner's subdivision plat This shall include the preparation and submittal of engineered drawings,
construction of new 8" sanitary sewer line, and acceptance of relocated 8" sanitary sewer line by City.
. As a result of unauthorized clearing conducted by Owner within the North "E" Street Right-of-Way, Owner
has compensated City $4,610 to plant trees.
5. City will inspect and approve all work performed under the terms of this agreement for compliance to City standards.
6. Owner shall have ninety (90) calendar days from the date of passage and approval of an ordinance closing the
aforementioned rights-of-way to fulfill all terms of this agreement.

Land Exchange Agreement
Summary and Recommendation
The City has recently purchased property from Charlie Hinds for the F -101 drainage project.
Mr. Hinds has requested an almost equal exchange of property with the City. The City and Mr.
Hinds executed an "Exchange Agreement" dated May 17,2001.
As stipulated in the Exchange Agreement, Mr. Hinds has provided $5,000 to cover costs
associated with document production (survey, legal, title research, etc.). No money will be
exchanged with the property exchange. Upon approval of this ordinance, the City Attorney will
coordinate the exchange of deeds with Mr. Hinds.
Action Required by Council:
Consider approval of an ordinance authorizing the City Manager to execute a Special Warranty
Deed and coordinate the exchange of property with Charlie Hinds.

THE TERMS AND PROVISIONS OF AN EXCHANGE AGREEMENT BETWEEN THE CITY
OF LA PORTE AND CHARLES C . HINDS, DATED MAY 17, 200 I, MAICING
VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT, FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance. The City Manager is hereby authorized to
execute a Special Warranty Deed attached to this ordinance as
Exhibit "A", in accordance with the terms and provisions of an
exchange agreement between the city of La Porte and Charles C.
Hinds, dated May 17, 2001, a copy of which is attached to this
ordinance as Exhibit "B", incorporated by reference and made a part
hereof for all purposes. The City Secretary is hereby authorized
to attest to all such signatures and to affix the seal of the city
to all such documents.
Section 2.

Dear Mr. Hines:
The City of La Porte recently acquired certain parcels of land from you, for public
drainage purposes. Recently, you requested that the City of La Porte consider an
exchange of a certain portion of the land that you conveyed to the City, in exchange for
a certain tract of land which you retained. These tracts are identified as Parcel "AIf and
Parcel "B", respectively, on the plats attached to this letter.
The City of La Porte is agreeable to work with you on this exchange. Also, Harris
County Flood Control District has agreed in principle to this exchange, provided the
matter is completed promptly and with no additional cost to HCFCD for design changes.
The City of La Porte would expect you to place the sum of $5,000.00 cash in
escrow with the City, to cover an estimated $4,000.00 of survey cost, and an estimated
$1,000.00 in legal and filing fees. The survey will be conducted by the same company
HCFCD used for the project, and HCFCD will set the scope of the work. All surveying
and legal expenses will be paid from the escrow. You agree to pay any overages and
any remaining escrow will be refunded to you.
This agreement is subject to the formal written approval of Harris County Flood
Control District. This agreement is subject to your acceptance and return to the City of
La Porte within ten (10) days of the date of this letter.
If this letter accurately states the terms and conditions of the agreement between
you and the City of La Porte, please evidence your agreement by signing and returning
a copy of this letter to the undersigned as soon as possible. The other copy of this letter
is your copy for your files. Also, please furnish a check payable to the City of La Porte
for $5,000.00 for deposit to the escrow account.

SUMMARY & RECOMMENDATION
Advertised, sealed bid #0834 for two Fire Apparatus were opened on July 2,2001. Bid requests
were mailed to six (6) vendors with four (4) returning bids. These units will replace unit 51-15 a
1981 Pierce Ford Fire Apparatus and unit 51-27 a 1981 American LaFrance Fire Apparatus.
Unit 51-15, housed at Station Four, was originally purchased by the Shoreacres Vol. Fire Dept.
and acquired when the City annexed the Baymud area. Unit 51-27, housed at Station One, was
purchased new by the City in 1981 and was planned for replacement in the new budget, October
1,2001, however the engine on the unit is in bad shape. Our hope is that we can receive delivery
of the new units before a major overhaul might be needed on this unit.
The low bidder was Metro Fire Apparatus Specialists for two Luverne Fire Apparatus in the
amount of $229,454.00 each and a total of$458,908.00 with a delivery time of21O to 270 days.

Approve awarding the bid for two new Fire Units to Metro Fire Apparatus Specialist in the
amount of Four Hundred Fifty Eight Thousand Nine Hundred and Eight Dollars ($458,908.00).

Advertised, sealed proposals for RFP #0092 - Janitorial Service were opened on June 25,2001. Bid proposals were
mailed to eighteen (18) vendors with five (5) retuming bids.
Offerors were asked to submit pricing for one (1) year of janitorial service with an option to renew for two (2)
additional one (1) year periods. There is also a provision for termination of contract, with thirty (30) days notice, for
nonperformance of contract specifications.
A committee of five (5) City staff members interviewed four (4) of the vendors submitting proposals. Based on the
award criteria established in the specifications, the committee unanimously determined that Sparkling Maintenance
Service provided the best proposal.
Each department is charged according to their usage. Currently, six (6) buildings are provided janitorial service and
sufficient funds are budgeted for the current fiscal year. The library, record storage facility and police department
will be added upon approval of budget for the 01-02 fiscal year.
The total for all buildings, including the ones to be added should funds be approved, is $72,180. Total of all funds
budgeted for the 01-02 fiscal year is $79,580.

the amount of $33,420.00. With this Grant, BJA will reimburse 50% of the purchase amount for body armor back to
the City. The City's match of the grant, which was $16,710.00, was put in the 2000 budget in Protective Clothing.
Earlier this year we purchased $13,537.14 worth of body armor and received a reimbursement of $6,768.57. With
the remaining grant funds, I would like to purchase 13 Tactical Body Armor for the SWAT team. Bid requests were
mailed to six vendors with three returning bids. Direct Action Unifonns submitted the amount of $20,529.60 for the
actual low bid, meeting specifications. The City would be reimbursed $10,264.80 of that amount The rest would
come from budgeted funds and the reimbursement we already received. The purchase of the Tactical Body Armor
would close this grant

Advertised, sealed bids #0835 - Tactical Body Armor were opened and read on July 9,
2001. Bid requests were mailed to six (6) vendors with three (3) retuming bids.
Galls, Inc. submitted the lowest bid, but after we questioned the validity of their bid, they
sent a letter withdrawing due to miscommunication on their part. The actual low bid,
meeting specifications, was submitted by Direct Action Uniforms in the amount of
$20,529.60.
Please submit your recommendation with an agenda request form by the prescribed time
before the next regular council meeting. If there is a need to delay bringing this bid before
council, please notify me.

Our annual surplus auction was held in conjunction with the City of Deer Park, City of
Pearland, and San Jacinto College on Thursday, July 1 ih at our Public Works facility. Due to
scheduling with the auctioneer and the auction being held late in the summer, the decision was
made to hold the auction on a weeknight.
We had a good turnout with 111 people registering, and 63 of those buying. This number is
about the same as last year at the City of Deer Park, and 18% over the 1999 auction held at
the City of La Porte. Our net receipts yielded about 13% less than last year. This appears to
be due to the fact we sold fewer vehicles than in the past. Our miscellaneous items were
about the same in volume, however, we received slightly more in dollar value.
