MINUTES OF THE REGULAR MEETING
AND PUBLIC HEARING
OF LA PORTE CITY COUNCIL
AUGUST 27, 2001
1. CALL TO ORDER
The meeting was called to order by Mayor Norman Malone at 6:00 p.m.
Members of City Council Present: Councilpersons Guy Sutherland, Chuck Engelken,
Howard Ebow, Peter Griffiths, Alton Porter, James Warren, Charlie Young, Jerry Clarke,
and Norman Malone.
Members of Council Absent: None
Members of City Executive Staff and City Employees Present: City Manager Robert T.
Herrera, City Attorney Knox Askins, Assistant City Manager John Joerns, City Secretary
Martha Gillett, Assistant Finance Director Michael Dolby, Director of Administrative

2. Reverend Ron Burnett of Victory Tabernacle Church delivered the invocation.
3. Council considered approving the minutes of the Regular Meeting and Workshop
Meeting on August 13,2001.
Motion was made by Councilperson Young to approve the minutes of the Regular
Meeting and Workshop Meeting on August 13.2001 as presented. Second by
Councilperson Clarke. The motion carried.
Ayes: Sutherland, Griffiths, Engelken, Ebow, Warren, Young, Clarke, and Malone.
Nays: None
Abstain: Porter
4. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND
T AXP AYERS WISHING TO ADDRESS COUNCIL.
The following citizens addressed City Council.
Robert Irizarry, 301 E. Fairmont Parkway - addressed Council to show his support of
continuing the Juvenile Curfew Ordinance.

Dave Turnquist - 8503 Ashwyne Lane - addressed Council on the following items:
Overpass and road improvements to Fairmont Parkway - he informed Council that he
was informed the Port of Houston met this day and passed a resolution to become a local
sponsor for the Fairmont Parkway overpass. They will assume 20% of the $5,000,000
estimated cost. He indicated the other 80% is expected to come from a federal clean air
act grant.
Swimming Pool- he requested Council consider building the pool marked for San
Jacinto and G Street at Sylvan Beach.
5. PRESENT A nONS
Public Works Director Steve Gillett recognized retiree Ruben Benavides and presented
him with a watch. Mr. Benavides was employed by the City of La Porte for 24 years.
6. Public Hearing - Juvenile Curfew - Discuss and review of annual review juvenile curfew
ordinance.
Mayor Malone opened Public Hearing at 6: 17 p.m.
Police Chief Richard Reff provided City Council with a report advising them the laws
require this ordinance to be reviewed on an annual basis to determine if it needs changes
or is to remain the same. Public Input - There were no citizens wishing to speak on this
matter.
Recommendation of Staff - Reff recommend the ordinance remain the same with no
changes.
Close Public Hearing - The Public Hearing was closed at 6:20 pm.
7. Council considered approving continuing, abolishing or modifying the Juvenile Curfew
Ordinance.
Motion was made by Councilperson Griffiths to keep the ordinance as is and make no
changes or modifications. Second by Councilperson Clarke. The motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Warren, Young, Porter, Clarke, and
Malone.
Nays: None
Abstain: None
8. Council considered approving an ordinance appointing Bill Harry Director ofthe Harris
County Appraisal District.
Mayor Malone reminded Council, Mr. Harry has been the Council's appointment for
several terms.

City Attorney read: ORDINANCE 2001-08 - A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF LA PORTE, TEXAS, NOMINATING A CANDIDATE
FOR A POSITION ON THE BOARD OF DIRECTORS OF THE HARRIS COUNTY
APPRAISAL DISTRICT.
Motion was made by Councilperson Porter to approve Resolution 2001- 08 as presented
by City Attorney. Second by Councilperson Clarke. The motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Warren, Porter, Young, Clarke, and
Malone.
Nays: None
Abstain: None.
9. Council considered approving an ordinance appointing members to the Civil Service
Commission.
City Manager Robert T. Herrera presented summary and recommendation, and answered
Council's questions.
City Attorney read: ORDINANCE 2001-2505 - AN ORDINANCE APPOINTING THE
CHAIRMAN AND MEMBERS OF THE CIVIL SERVICE COMMISSION,
PROVIDING A SEVERABILITY CLAUSE, CONTAINING A REPEALING CLAUSE,
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Griffiths to approve Ordinance 2001-2505 as
presented by City Manager Robert T. Herrera. Second by Councilperson Ebow. The
motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Warren, Young, Clarke, and
Malone.
Nays: None
Abstain: None
10. Council considered authorizing the purchase of the Omni-Directional Siren System and
the siren activation upgrade in the amount of $30,970.00.
Emergency Services Director Joe Sease presented summary and recommendation and
answered Council's questions.
Motion was made by Councilperson Clarke to approve the purchase as presented by Mr.
Sease. Second by Councilperson Young. The motion carried.
Ayes: Sutherland, Engelken, Ebow, Griffiths, Porter, Warren, Young, Clarke, and
Malone.

Building Official Debbie Wilmore presented summary and slide show on each ofthe
above referenced properties. In addition, Ms. Wilmore requested approval to move
forward with a Public Hearing to be held on September 24, 2001.
Council unanimously agreed Ms. Wilmore could move forward with the Public Hearing.
12. Council considered authorizing the place, date, and time of the Public Hearing on the
Budget.
Assistant Finance Director, Michael Dolby, presented summary and recommendation of
the date of September 10, 2001 to hold the public hearing at the Regular Council
Meeting.
Motion was made by Councilperson Porter to approve recommended Public Hearing as
presented by Mr. Dolby. Second by Councilperson Ebow. The motion carried.

13. ADMINISTRATIVE REPORTS
City Manager Robert T. Herrera reminded Council there will be a Town Meeting to
discuss the Parks and Recreation Master Plan on September 5, 2001 at the Sylvan Beach
Pavilion at 7:00 pm. He encouraged the public to attend.

Please include the following employee retirement presentation on the Agenda for the Council
Meeting scheduled for August 27. 2001:
Ruben ~enavides, 24 years
Ruben began his employment with the City in July of 1977 as a mechanic and in March of 1990
was promoted to Senior Mechanic. the advanced journey level in the Mechanic series. A major
part of Ruben's duties were driveablility diagnosis, troubleshooting hydraulic systems and diesel
systems, repair problems, including gas systems.
Over th~ last twenty-four (24) years Ruben has alwavs received an excellent evaluation.
Ruben's :Supervisor- Isabel Salinas, Equipment Services Supervisor, has noted many times that
Ruben is very good at troubleshooting mechanical problems and practiced use of good common
sense, Ruben required very little supervision, and frequently was asked to supervise during Mr.
Salinas' absence. Ruben had a thorough knowledge of assignment duties and was able to
perform them in an excellent manner. He was always willing to learn new procedures and kept
an open: mind at all times, handling a great quantity of work with quality results and ready to
take action based on the best interests of the City. Ruben was always extremely responsive to
any suggestion from co-workers or supervisor, He was a dependable employee that was relied
upon to ~et any job done correctly and is a professional in every sense of the word.
Another area was Ruben excelled, was his interpersonal skills. Many of his evaluations noted
that Ruben was superior. He maintained an outstanding relationship with virtually everyone.
He displayed a superior temperament when dealing with co-workers, supervisor, and personnel
from other departments. Ruben has a wonderful sense of humor and always treated everyone
with respect and kindness.
Everyone at the City will certainly miss your professionalism and smiling face. We wish you well
in your future endeavors. Congratulations on your retirement, Ruben.

SUMMARY & RECOMMENDATION
A workshop was conducted on the August 13,2001 Council Meeting to meet the requirements of Local Government
Code 370.002 Review of Juvenile Curfew Order or Ordinance, which requires an annual review of the Curfew
Ordinance. A Public Hearing is scheduled for this Council Meeting to receive public input regarding the Juvenile
Curfew Ordinance. There are three outcomes from this Public Hearing.
1. Continue the Ordinance as written,
2. Abolish the Ordinance, or
3. Modify the Ordinance.
The fIrst two actions will require only a vote ofthe Council. The third option will require the ordinance be re-
written and presented before the Council on September 10, 2001.

Sec. 42-36. Exceptions to article.
Sections 42-32-42-35 shall not apply to duly licensed peace officers; law enforcement officer
alias handgun licensees; and active judicial officer licensees.

Any person who violates section 42-33 or 42-34 of this article, upon conviction in the
municipal court of the city, shall be subject to a fine for each offense in an amount established
by the city and listed in appendix B of this Code.

ARTICLE m. CURFEW FOR JUVENILES
See. 42-71. Findings and determinatioD&
(a) The city council has determined that there has been an increase in juvenile violence,
juvenile gang activity and an increase in crime by persons under the age of 18 in the city.
Persons under the age of 18 are' particularly susceptible, because of their lack of maturity and
experience, to participate in unlawful and gang-related activities and to be victims of older
perpetrators of crime.
(b) The city has an obligation to provide for:
(1) The protection of minors from each other and from other persons;
(2) The establishment of parental control of and responsibility for their children;
(3) The protection of the general public; and
{4} The reduction ofthe incidence of juvenile criminal activities.
(c) The citysouncil has determined that a curfew for those under 18 years of age will be in
the interest of the public health, safety and general welfare, and will help to attain the
objectives of this section and will diminish the undesirable impact of such conduct on the
citizens of the city,

Sec. 42-72. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Emergency means an unforeseen combination of circumstances or the resulting state that
calls for immediate action. The term shall include, but not be limited to, a fire, natural disaster,
vehicular accident or a serious medical condition of sudden onset,

LA PORTE CODE
Guardian means the person who, under a court order, is the guardian of the person of a
minor or the public or private agency with whom a minor has been placed by a court.
- Minor means any person under 18 years of age.
Parent means the natural mother or father or adoptive mother or father of a minor.
Public place means any place to which the public or a substantial group of the public has
access and includes, but is not limited to, streets, highways and the common areas of schools,
hospitals, apartments, houses, office buildings, transport facilities and shops.

Sec. 42-73. Prohibited acts; offenses.
(a) It shall be unlawful for any minor to knowingly remain, walk, run, stand, drive or ride
about, in or upon any public place in the city:
(1) Between the hours of 12:00 at night (midnight) and 6:00 a.m. on any day of the week;
or
(2) Between the hours of 9:00 a.m. and 2:30 p.m. on any day on which classes are in
session in the La Porte Independent School District.
(b) It shall be unlawful for the parent or guardian having legal custody of a minor to
knowingly allow or permit the minor to be in viol~tion of the curfew imposed i'n subsection (a)
of this section.

Sec. 42-74. Defenses to prosecution under section 42-73.
It is a defense to prosecution under section 42-73 that:
(1) The minor was accompanied by his parent or guardian;
(2) The minor was accompanied by an adult designated by his parent or guardian;
(3) The minor was on an errand made necessary by an emergency;
(4) The IIlinor was attending a school, religiov.s or government-sponsored activity or was
traveling to or from a school, religious or government-sponsored activity;
(5) The minor was engaged in a lawful employment. activity or was going directly to or
coming directly from lawful employment;
(6) The minor was on the sidewalk of the place where he resides;
(7) The minor was on an errand directed by his parent or guardian;
(8) The minor was in a motor vehicle involved in intrastate or interstate transportation;
(9) The minor was engaged in, participating in or traveling to or from any event, function
or activity for which the application of section 42-73 would contravene his rights
protected by the state or United States Constitutions;

(10) The minor was married or had been married, or had disabilities of minority removed
in accordance with V:T.C.A., Family Code ch. 31; or
-(11) With respect to the hours between 9:00 a,m. and 2:30 p.m. only, that the offense
occurred during the school summer vacation break. period of the school in which the
minor is enrolled; on a holiday observed by the closure of classes in the school in which
the minor is enrolled; or that the minor has graduated from high school or received a
high school equivalency certificate,

Sec. 42.75. Supplemental effect of article.
The provisions of this article are supplemental and shall be cumulative with all other laws
and ordinances applicable in any manner to juveniles.

Sec. 42.76. Enforcement of article.
Notwithstanding the penal effect of this article, the chief of police is encouraged to develop
alternative enforcement strategies, which may include, but need not be limited to, the return
of minors to their residences or schools, counseling with minors and their parents or guardians,
the issuances of warning citations to minors or their parents or guardians, or the referral of
instances that appear to also involve the violation of school attendance laws to those,officers
who are responsible for the enforcement of those laws. The enforcement strategies shall be
promulgated in writing to members of the police department so that this article may be
enforced in a uniform manner.

Agent shall mean any individual employed by the City of La Porte, or a volunteer for the City
of La Porte, duly designated and authorized by the city manager to act on behalf of the City of
La Porte pursuant to the terms of this article.

It has been brought to my attention the current curfew ordinance affecting our students is
up for reconsideration. While I do not have knowledge of the affect the curfew at night
has on students, I can tell you the curfew in place during school hours has had a definite
impact on student attendance. Curfew citations, along with school consequences! have
helped to put a punch in consequences for trWmcy and a reduction in those leaving
campus during the school day. The current curfew ordinance has also acted as a deterrent
to students leaving and the occurrence of truancy . On behalf ofLPISD, LPHS, and our
truant officer I would recommend keeping the current curfew ordinance.

Curfew Ordinance Public Hearing - 08/27/01
As a reminder our Curfew Ordinance must be reviewed and a Public Hearing held regarding the Ordinance.
The Ordinance was brought before City Council on August 13, 2001 as a workshop item to advise the
Council of the requirement of Local Government Code 370.002 Review of Juvenile Curfew Order or
Ordinance. The Public Hearing is scheduled for August 27, 2001 to be held in conjunction with the
Council Meeting. There are three possible actions that must be taken after the Public Hearing:
1. Continue the Ordinance as it is written.
2. Abolish the Ordinance
3. Modify the Ordinance
According to John Armstrong the first two actions will only require a vote of the Council to take that
action. In the event there are some modifications to be made, the modified ordinance will be drnwn up and
brought before the Council on September 1, 2001 for approval.
Attached is a copy of the existing Ordinance.

Notice is hereby given that the City Council of the City of La Porte will hold a
Public Hearing on the 2ib day of August, 2001, in the Council Chambers of the City
Hall, 604 West Fairmont Parkway, La Porte, Texas, beginning at 6:00 P.M. The purpose
of this hearing is to provide citizens the opportunity to comment on the Curfew
Ordinance.
The City of La Porte, musts, under the Texas Local Government Code Section
370.002 Review of Juvenile Curfew Order or Ordinance. A copy of the Ordinance will
be available for public inspection and copying at the office of the City Secretary, City
Hall, 604 West Fairmont Parkway during normal business hours.

Your taxing unit participates in selecting members of the Harris County Appraisal District's
Board of Directors, The board is composed of six members who serve two-year terms, all of
which expire December 31,2001. This memorandum sets out the process of selecting directors
for the two-year term that begins January 1,2002.
Participating Units
The current method of selecting directors was established by resolutions of the county, cities, and
school districts participating in the appraisal district in 1981 and was modified by action of the

The Harris County Appraisal District Board of Directors consists of six members, selected as

· In the event the county appoints someone other than the county assessor-collector to the
board, the county assessor-collector will serve ex officio in a non-voting capacity as a seventh
member of the board.
Eligibility Requirements
An individual must satisfy certain residency, employment, and conflict-of-interest requirements
to be eligible to serve on the board of directors.
Residency: The candidate must be a resident of the Harris County Appraisal District, and must
have resided in the district for at least two years immediately preceding the date he or she takes
office.
Employment: An employee of a taxing unit served by the appraisal district may not serve, with
one exception. An employee may serve if the employee is also a member of the governing body
or an elected official of a taxing unit that participates in the district. For example, a member of
the governing body of a school district who is also a city employee would be eligible to serve on
the appraisal district's board of directors. Elected officials or members of governing bodies who
are not employed by taxing units may serve on the board,
ConOict-or-interest: A candidate may not serve if the candidate is related to a person who is in
the business of appraising property or represents property owners for a fee in proceedings in the
appraisal district. Relatives barred are those within the second degree by consanguinity (blood)
or affinity (marriage). These persons include: spouse; children; brothers and sisters; parents;
grandparents; and grandchildren. The spouse's relatives in the same degree are included.
A candidate who contracts with the appraisal district for any purpose, or with a taxing unit served
by the district for a property tax related purpose, may not serve. The same rule applies to
candidates who have a substantial interest in businesses contracting with the appraisal district
(for any purpose) or with the taxing unit (for property tax purposes), A candidate has a
substantial interest if the candidate or the candidate's spouse has combined ownership of at least
ten percent (10%) of the voting stock or shares of the business. A candidate also has a
substantial interest if the candidate or the candidate's spouse is a partner, limited partner, or an
officer of the business. These prohibitions on contracting continue for the duration of the
affected director's term of office.
The appraisal district may not employ any person who is related to an appraisal district director
within the second degree by affinity or the third degree by consanguinity. The provision applies
to existing employees at the time the director takes office and to employees hired during the
director's term,
Delinquent taxes: Finally, a new provision adopted this year by the 77th Legislature makes a
person ineligible to serve as an appraisal district director if he or she has delinquent property
taxes owing to any taxing unit 60 days after the person knew or should have known of the'delinquency.

Selection Procedures
The procedures for selecting members of the board of directors for the two-year term beginning
on January 1,2002, are as follows:
For Cities and Towns Other Than the City of Houston
The cities and towns other than the city of Houston appoint one member by majority vote. The
process for these cities and towns involves two steps: nomination and election.
Nomination
Each city and town has the right to nominate a single candidate for the position, To nominate,
the governing body must adopt a resolution nominating the candidate by formal action. The
presiding officer of the governing body must submit the nominee's name to the chief appraiser of
the Harris County Appraisal District by October 15, 2001. The officer must provide a certified
copy of the resolution and may include a cover letter naming the nominee.
Election
Immediately after October 15, the chief appraiser will prepare a ballot listing the nominees in
alphabetical order, The chief appraiser will deliver a copy of the ballot to the presiding officer of
the governing body of each voting city or town,
Before December 1, 2001, each governing body must cast its vote for one of the nominees,
formally adopt a resolution naming the person for whom it votes, and submit a certified copy to
the chief appraiser, This means resolutions casting a vote must be received by the appraisal
district no later than November 30,2001.
The chief appraiser will count the votes, declare the results, and notify the winner, the nominees,
and the presiding officers of each city and town. A tie vote will be resolved by a method of
chance chosen by the chief appraiser.
For School Districts Other Than
the Houston Independent School District
Exactly the same procedure described for cities and towns above applies to the selection of the
member who represents school districts other than Houston lSD, These school districts must
nominate and elect following the deadlines and procedures described above,
For Conservation and Reclamation Districts
The procedure and timetable for selecting the member who represents the conservation and
reclamation districts are the same as that described above for small cities and school districts.

My goal is to appoint Mr. Bobby Powell to the unexpired position held by Robert Swanagan, who
has moved away from La Porte, and to appoint Barry Beasley to the third position. Both Mr.
Powell and Mr. Beasley have agreed to serve if confirmed by the City Council.

Lady of the Lake University in 1994, with an emphasis in International Business. Barry

Leadership Pasadena.
Mr. Beasley represents Southwestern Bell with several organizations including eight
Chambers of Commerce and three Economic Development Councils. He is Past-
Chairman of the La Porte - Bayshore Chamber of Commerce; Past-Chairman of the
Harris County Southeast Economic Development Council (SEED) and Past-Chairman of
the Board of the Pasadena Chamber of Commeree. Mr. Beasley served as a board
member of the Deer Park, Clear Lake and Pasadena Chambers of Commerce, is Vice-
Chairman of the Gulf Coast Workforce Development board, is on the Board of Regents
for the Texas Chiropractic College, and Advisory Board ofUHCL. Barry served as the
chairman in La Porte's successful effort to pass the 4-B economic development sales tax.

SUMMARY & RECOMMENDATION
The original Whelen Siren system, of nine sites, was installed in May of 1987 and several years
later when BayMud was annexed two additional sites were added to the system on the southern
area ofthe city. These sites all have Directional Speaker systems that required a motor to rotate
the Speakers, These systems are a continual maintenance problem. Last year the LEPC added
an additional site at PPG Industries to cover the growth in the area ofHwy 146 and Fairmont
Parkway. This site is the first to have an Omni-Directional Speaker system.
We have a quote from Standard Automation, who is the Whelen representative in the Southeast
Texas area, to do a total upgrade to one of the sites for $26,870.00. The first site chosen is the
location at Texas and G street. Also Standard Automation has recommended that the Siren
Control System be replaced with a system that will allow operation from the Dispatch Console.
Presently the Dispatcher must walk to the north end of the Dispatch Office to operate the system.
This upgrade will cost $4100.00.

The Dangerous Building Board of Inspection is established by Ordinance No. 97-2198; Article VIII; Section 82-472.
The Board is comprised of Debbie Wilmore, Chief Building Official; Paul Hickenbottom, Fire Marshal; and Mike
Boaze, Fire Chief. )'he Board has inspected seven (7) structures and found them, as defined by Ordinance No. 97-
2198; Article VI; Section 82-411 (Standard Housing Code, 1994 Edition) to be "dangerous".
Council is requested to review the Board's findings and then authorize a public hearing for the purpose of
condemning and ordering demolition of these seven (7) structures. A hearing date of September 24, 2001 is

In accordance with Section 4.03 of the City of La Porte's Charter, I am requesting
Publication of Notice of Public Hearing for the 2001-02 Proposed Budget. I am also
requesting that council hold a Public Hearing on the budget, as submitted, on Monday,
September 10, 2001.
Per Section 4.02, the proposed budget and all attachments are available for public
inspection in the office of the City Secretary, located at 604 W. Fairmont Parkway, in
City Hall; and at the Edith Wilson Library. .

NOTICE OF PUBLIC HEARING
Notice is hereby given that the City Council of the City of La Porte
will hold a Public Hearing on the lOth day of September, 2001, in the
Council Chambers of the City Hall, 604 West Fairmont Parkway, La Porte,
Texas, beginning at 6:00 P.M. The purpose of this hearing is to provide
citizens the opportunity to comment on the overall budget.
The City of La Porte, must, by Charter requirement, adopt its fiscal
budget by September 30,2001. Within thirty days thereafter, copies of the
adopted budget will be available for public inspection and copying at the
office of the City Secretary, City Hall, 604 West Fairmont Parkway, and the
Edith Wilson Public Library, 526 San Jacinto Street, during normal business
hours.

Town Meeting on Parks Master Plan
The City of La Porte's Parks and Recreation Department is conducting a Town Meeting on the Parks
Master Plan. We are looking for additional information from our citizens to incorporate their future
needs. Sylvan Beach Pavilion will be the location of this meeting. The program will be on Wednesday
September 5, 2001 at 7:00 PM to 9:00 PM.
The purpose of a Master Plan with the Parks and Recreation Department is to provide a vehicle to
guide and recognize our needs. There is no question that the City of La Porte will grow in the future;
the question is how should the city parks and recreation grow in order to offer the highest quality of
life for its citizens. The people of La Porte have decided to meet their future with a plan - A
Comprehensive Plan - to help guide La Porte in achieving specific, development goals. These goals
are based on an analysis and evaluation of the cities desires, opportunities and finances.
The Town Meeting is designed to encourage input from the citizens of La Porte who will directly
benefit from the results. Our intent is to utilize the responses, to direct the positive opportunities that
are in our resident's best interests. Land use is at premium and the opportunities need to be
developed today. These suggestions need to be provided to enhance La Porte's viability as a
residential community with high environmental and quality of living standards.
