Council considered approving the Minutes of the Regular Meeting and Workshop Meeting on June 24, 2002. Motion was made by Councilmember Ebow to approve the Minutes of the Regular Meeting and Workshop Meeting on June 24, 2002. Second by Councilmember Beasley. The motion carried. Council considered adopting a resolution extending the moratorium on mid to high - density residential development for an additional 60 days. Assistant City Manager John Joerns presented summary and recommendation and answered Council's questions. City Attorney Knox Askins read: RESOLUTION 2002-30 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, EXTENDING THE MORATORIUM ON THE ACCEPTANCE FOR FILING AND THE ISSUANCE OF BUILDING PERMITS AND ALL OTHER ZONING AND/OR DEVELOPMENT PERMITS FOR NEW CONSTRUCTION IN THE MID AND HIGH -DENSITY RESIDENTIAL ZONING DISTRICTS, ADOPTED FEBRUARY 11, 2002; PROVIDING THAT SUCH EXTENSION SHALL EXPIRE AFTER SIXTY (60) DAYS OR DISPOSITION OF ZONING CHANGE PROCEEDINGS WITH REGARD TO SUCH DISTRICTS, WHICHEVER COMES FIRST; PROVIDING FOR SPECIAL EXCEPTIONS IN THE EVENT OF HARDSHIP; AND PROVIDING AN EFFECTIVE DATE. Council considered approving a resolution to ratify the challenge filed on Harris County Appraisal District account number 006-117-000-0014. Director of Finance Cynthia Alexander presented summary and recommendation and answered Council's questions. City Attorney Knox Askins read: RESOLUTION-2002-31 - HCAD 006-117-000-0014 — HARRIS COUNTY APPRAISAL DISTRICT HAS GRANTED A RELIGIOUS EXEMPTION ON PROPERTY LOCATED AT 1718 ROSCOE STREET, LA PORTE, TEXAS. THIS AREA IS ZONED BY THE CITY OF LA PORTE AS 4-1 LOW DENSITY RESIDENTIAL. A CHALLENGE WAS FILED WITH HARRIS COUNTY APPRAISAL DISTRICT ON MAY 31, 2002 ON BEHALF OF THE CITY OF LA PORTE TO CHALLENGE THEM GRANTING A RELIGIOUS EXEMPTION ON PROPERTY THAT DOES NOT MEET ZONING REQUIREMENTS. THIS CHALLENGE WAS REVIEWED AND RECOMMENDED BY THE CITY OF LA PORTE' S AUDIT COMMITTEE ON JUNE 12, 2002. WE ARE NOW ASKING THAT THE CITY COUNCIL RATIFY THIS CHALLENGE BY APPROVING RESOLUTION 2002-31. Motion was made by Councilperson Beasley to approve this resolution as presented by Ms Alexander. Second by Councilperson Ebow. Consent Agenda Council considered a consent agenda as follows: Consider approval to award bid #0861 for 75 Electric Golf Cars to E-Z GO Textron for the amount of $211,050.00, less $93,750.00 trade in for a total of $117,300.00. Funds are available in the Motor Pool for this purchase. Golf Course Manager Alex Osmond presented summary and recommendation and answered Council's questions. Motion was made by Councilperson Meismer to table. There was no second. A second motion was made by Councilperson Griffiths to approve the bid as presented by Mr. Osmond. Second by Councilperson Ebow. The motion carried. Ayes: Beasley, Mosteit, Griffiths, Engelken, Ebow, Warren, Young and Malone Nays: Meismer Abstain: None Consider approval to award bid for annual contract to supply liquid chlorine in the amount of $33,496.00. Director of Public Works Steve Gillett presented summary and recommendation and answered Council's questions. A motion was made by Councilperson Ebow to approve the bid as presented by Mr. Gillett. Workshop was called to order by Mayor Norman Malone at 6:45 p.m. Director of Public Works Steve Gillett presented the Landfill Feasibility Study. Staff recommended tabling. 10. Closed Workshop and reconvened Regular Meeting at 7:18 p.m. 11. Administrative Reports Assistant City Manager John Joerns informed Council the Chamber of Commerce luncheon scheduled on July 17, 2002 has been cancelled. 12. That moratorium will expire on July 11, 2002. At present, the Planning and Zoning Commission has forwarded Zoning Ordinance recommendations to Council which have been reviewed by Council during the June 10 and 24, 2002 meetings. However, preparation of the formal Ordinance changes incorporating Council modifications will not be finalized prior to the July 8t' Council meeting. Therefore, staff is recommending extending the moratorium for an additional 60 days. This would establish a new moratorium expiration date of September 6, 2002 and provide sufficient time for staff and the City Attorney to review the formal document and for Council to conduct the required Public Hearing. Approved for City Council Agenda i rAll -" '% %�'i •�,/ 00 Date • RESOLUTION NO.2002 --,30_ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, EXTENDING THE MORATORIUM ON THE ACCEPTANCE FOR FILING AND THE ISSUANCE OF BUILDING PERMITS AND ALL OTHER ZONING AND/OR DEVELOPMENT PERMITS FOR NEW CONSTRUCTION IN THE MID AND HIGH - DENSITY RESIDENTIAL ZONING DISTRICTS, ADOPTED FEBRUARY 11, 2002; PROVIDING THAT SUCH EXTENSION SHALL EXPIRE AFTER SIXTY (60) DAYS OR DISPOSITION OF ZONING CHANGE PROCEEDINGS WITH REGARD TO SUCH DISTRICTS, WHICHEVER COMES FIRST; PROVIDING FOR SPECIAL EXCEPTIONS IN THE EVENT OF HARDSHIP; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, there continues to be undeveloped land in the City of La Porte, Texas, the development of which may significantly impact City services, such as water, sanitary sewer, traffic, sanitation, and fire and police protection; and WHEREAS, the construction of Mid and High Density Residential projects have raised concerns regarding the impact of these projects on adjacent properties, which said concerns have been the effort of a significant and intensive effort to develop new regulations for mid and high density residential developments within the City of La Porte; and WHEREAS, the City of La Porte has not conducted a thorough review of its Mid and High Density Residential regulations since 1987; and WHEREAS, the City Council of the City of La Porte desires to avoid the adverse effects such development may have on the public health, safety, and welfare of the citizens of the City of La Porte; and WHEREAS, the City Council of the City of La Porte, in order to avoid any adverse effects, to further the goals of the Comprehensive Plan update, to provide for orderly future development and growth, desires to extend the period of time in which to complete a review of Mid and High Density Residential development regulations, since efforts to revise the zoning ordinance regulations regarding mid and high density residential development have been conducted in an orderly and timely fashion, yet have not been completed within the time period set for the original moratorium to expire, i.e. July 11, 2002; and WHEREAS, continued refinement of development standards ensures neighborhood compatibility, minimizes incompatible elements between abutting land uses and contributes to a higher quality of life; and WHEREAS, the City's Comprehensive Plan Update made the following recommendations: • 0 Provide an appropriate amount of land for various densities and types of residential uses and ensure the highest quality living environment. Seek to ensure that adjacent land uses are developed compatibly and take measures to mitigate land use transitions with differing intensities. Evaluate the appropriateness of design standards that include landscaping, screening, increased lot sizes and setbacks, and other methods to minimize negative effects among different land uses. Determine appropriate residential densities for various areas within the City on the basis of accessibility, utility availability, topography, proximity to shopping areas, and other relevant factors. Update the Zoning Ordinance and Official Zoning Map to reflect identification of various areas of particular densities. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: SECTION 1. The City Council of the City of La Porte finds and determines that the premises hereof are true and correct. SECTION 2. The City Council further finds and determines that it is in the best interests of the public health, safety and general welfare of the citizens of the City to extend the moratorium heretofore placed on February 11, 2002, on the acceptance for filing and consideration, and the issuance of building permits and all other development and zoning permits, for all properties in the Mid and High Density Residential Districts in the City for an additional period of sixty (60) days from the date hereof, and such moratorium is hereby imposed and extended. For purposes of this moratorium, the term "Mid Density and/or High Density Residential Districts", or words of similar import, shall include, but not be limited to development occurring within Zoning Districts R-2, R-3, NC, GC, LI, HI, and/or PUD. SECTION 3. That there is hereby established an extension of the moratorium on the issuance of permits for construction of any Mid Density or High Density Residential units within the City of La Porte, Texas for a period of up to sixty (60) days from the date of passage of this Resolution. SECTION 4. That during the moratorium period, and the moratorium extension period, no new Mid Density or High Density Residential building permits, or certificates of occupancy shall be issued and no letters of availability for utilities, as well as formal review or action by any City board, commission or department shall be authorized for any new Mid Density or High Density'Residential location in the jurisdiction of the City of La Porte as described in Section 2 of this Resolution. SECTION 5. This extension of the moratorium shall remain in effect for a period of sixty (60) days or until final action is taken on any proposed zoning and/or subdivision regulation changes affecting the Mid and High Density Residential Districts, or until final action is taken regarding amendment of the Comprehensive Zoning Ordinance and Map, and development regulations by the City Council, whichever comes first. SECTION 6. Any property owners subject to this moratorium and/or this extension of the moratorium may apply to the City Council for an exception in the event that a hardship results from its application, and the City Council is authorized to grant an exception to the moratorium imposed by this Resolution only when it finds that such hardship does exist. Any exception so granted shall not be a substitute for enforcement of current zoning, development or building regulations, policies and procedures of the City of La Porte. 6 • SECTION 7. This moratorium shall not apply to building permits within previously platted, duly recorded and properly zoned subdivisions approved by the City of La Porte Planning and Zoning Commission. Further, this moratorium does not apply to developments for which administratively complete applications for zoning permits, building permits, special conditional use permits, or any other development permits have been completed and filed with the City of La Porte prior to the passage of this resolution. In such event, the applicant may complete the permit review process and development approval process under existing City of La Porte regulations, policies, and procedures in connection with the proposed application. SECTION 8. This extension to the moratorium on the acceptance for filing and the issuance of building permits and all other development permits for new construction in the Mid and High Density Residential Districts for shall expire on September 6, 2002, at 11:59 p.m., Central Standard Time. SECTION 8. This Resolution shall take effect immediately from and after its passage, and it is accordingly so resolved. This area is zoned by the City of La Porte as R-1 Low Density Residential. A challenge was filed with Harris County Appraisal District on May 31, 2002 on behalf of the City of La Porte to challenge them granting a religious exemption on property that does not meet zoning requirements. This challenge was reviewed and recommended by the City of La Porte's Audit Committee on June 12, 2002. We are now asking that the City Council ratify this challenge by approving Resolution 2002- . The first application was filed on June 30, 2000 and stated that 80% of the land is used of the residence. The first application for exemption was denied because of use by the appraisal district. On January 30, 2002 a second application was filed with the appraisal district. In the second application stated that approximately 10% of the land is used of the residence. The applications filed in 2000 and 2002 are in direct conflict with each other on the issue of the use of the property, and as such bring into question the actual use of the property. The Property is Zoned "Rl" for Single Family Residence The property is bay front property located in one of the most affluent subdivisions in the City of LaPorte. The property is a single-family residency with an appraised value of $189,330.00. The property is zoned "Rl" which only allows the property to be used for the purpose of residential single family occupancy. The site, permitted in 1988, has never been opened. The Permit was obtained through the recommendation of a Solid Waste Disposal Plan, dated March 1983, which recommended the permitting and acquisition of a sanitary landfill to replace landfills scheduled for closure, owned by Harris County and a privately -owned landfill in Baytown. In 1993, TNRCC and EPA requirements (Subtitle D) mandated that the City modify its permit to comply with the new regulations. Because the City did not intend to open the site until current private landfill capacity became unavailable or cost prohibitive, the City requested clarification of its need to modify the permit. The TNRCC responded that the City did not need to modify the permit to comply with Subtitle D requirements until it intended to open the facility (letter attached). The City of La Porte has relied on this response in its dealing with the landfill permit. Subsequent to this, the TNRCC established the Municipal Solid Waste Permit and Registration Modification Rules (MOD Rules) which will require permitted but unopened sites to update their permit to Subtitle D, through a modification, by May 19, 2003. Update of permits after this date would require a major amendment. A modification is an administrative update, and is approved by TNRCC staff. A major amendment is similar to the original permit process, complete with public hearings, the possibility of a contested hearing, and requires approval by the Commission. The FY 2001-02 CIP Budget includes $100,000 for this effort. In an effort to avoid unnecessary expenditure of funds, the City met with its attorney and TNRCC Chairman Huston and Commissioner Marquez to present the City's position that it was exempt from this Rule, based on the prior letter received from the TNRCC (letter attached). The Commissioners were sympathetic to the City's position, but were concerned that they could not dictate policy to future commissioners. It was apparent that the Commission would not exempt La Porte from the new MOD rules, and that the City must move forward with obtaining a modification of it's landfill permit prior to the deadline to avoid the major amendment process. On January 22, 2002, City staff met with HDR, the Engineer, to discuss a proposed scope of work to modify the Permit. After extensive discussion, it was apparent that the cost to open and operate the landfill under the new subtitle D rules and regulations adopted subsequent to Subtitle D would greatly increase costs, and reduce capacity. Rather than move forward with developing a contract to modify the Permit, the decision was made to update start-up and O&M costs to operate the landfill under current regulations, and develop a cost comparison to determine if a City -owned and operated landfill was still a viable disposal option. ASSUMPTIONS In order to fairly compare disposal options, several assumptions are required. They are listed below in no particular order. • At some point in the future (10-20 years) capacity at currently used private landfills will disappear, and the City will be faced with opening its own landfill or transporting to a remote, private landfill. • All costs are calculated per cubic yard of waste. • Waste disposal rate of 2,300 cubic yards per month. Note that this rate is a large reduction from the original projection due to the elimination of Seabrook's and LP's commercial waste stream. • 20 year financing for all alternatives. • Collection costs not included and are assumed to be equal for all alternatives. • Two alternatives selected (1) operation of city -owned landfill, and (2) operation of transfer station to dispose at remote site. • Transfer distance to remote site 100 miles round trip. • Construction of transfer station on city -owned property (PW). • Increased costs for future regulations not included — assume that costs for City -owned and private landfill will rise at least equally. A more likely scenario is that costs for the city -owned site will rise faster than privately owned sites due to economies of scale. • Tipping fees at private landfill assumed to be the same as current rates. Any inflation in this rate will also be applicable to a city -owned site. DISCUSSION Attached to this report are two (2) sub -reports. One is the study prepared by HDR calculating probable costs to construct and operate a city -owned landfill. The other is a brief staff cost estimate to construct, equip and operate a transfer station, with associated labor, equipment, supplies and maintenance. Each sub -report will be discussed below. The report prepared by HDR is a result of their experience permitting and consulting for municipal and private landfills throughout the nation. The report assumes start-up construction, equipment and labor costs associated with construction and operation of the site. The basis of the report is that with changes in regulations and reductions in estimated waste streams, the cost to dispose of waste at a La Porte -operated landfill, in 2002 dollars, range from $27.86 to $29.48 per cubic yard. Note that current disposal rates under the City's contract with a private landfill are $5.80 per cubic yard. The alternative to operating a city -owned landfill when capacity at the currently contracted site is gone (estimated at 20-30 years) is to find another landfill and transport. Depending on the distance, a transfer station may need to be constructed and operated. A transfer facility is basically a staging area or building to store collected waste until a larger, transfer trailer/truck is filled. Instead of the collection truck being driven, with a three-man crew, to the landfill, several collection trucks can be accommodated by one transfer vehicle. This alternative will require the construction of a transfer station building to house the tipping floor, loading area and any compaction equipment out of the weather. Purchase of transfer trailer and truck and other minor equipment will be required for operation of the system. Finally, the addition of two (2) employees will be required to operate the system. The cost to operate the transfer system and pay disposal costs (at current rates) is estimated at $11.27 per cubic yard. At one time, it was determined that the cost of operating a city -owned landfill was the best long-term disposal alternative for La Porte. Changes in regulatory requirements have greatly increased this cost. Although the changes associated with Subtitle D were known to increase the cost of landfilling, the additional changes to design criteria, such as groundwater levels and depth of burial, have increased costs far more than anticipated. Additionally, it costs virtually the same amount to operate a small landfill as a larger one. The major difference is the amount of daily waste. Obviously, the more waste to allocate costs to, the lower the price. With the elimination of La Porte's commercial waste, virtual elimination of all yard waste due to the City's composting program and the elimination of all residential and commercial waste projected for the City of Seabrook, the projected daily waste stream is less than'/2 of that originally projected. CONCLUSIONS AND RECOMMENDATIONS Changes in regulations and reductions in projected waste have, together, driven to cost to construct and operate a sanitary landfill to almost $30.00 per cubic yard. It is estimated that the City of La Porte could construct and operate a transfer system and pay disposal costs at a rate of over 60% less than opening a city -operated landfill. The City is also facing costs exceeding $100,000 to bring the permit into compliance with Subtitle D. It is recommended that the City not move forward on updating the permit for its landfill. The costs associated with the update, construction and operation are far in excess of the costs associated with the construction and operation of a transfer station. Future solid waste disposal for La Porte will continue to be contracted landfill disposal. The City must keep informed of the remaining capacity at current disposal sites, as well as future disposal sites. Current estimated capacity is 20-30 years. When, and if necessary, the City must also begin planning for the construction of a transfer facility, or contract with an existing facility to ensure disposal options. Fisher MA.1 Date: March 4, 2002 Subject: LaPorte landfill Subtitle D Permit Modification — Feasibility Issues The City of LaPorte is considering upgrading the permit status of its landfill to bring it in compliance with Subtitle D of .RCRA. It has come to our attention that there is a deadline for approval of a Permit Modification to accomplish this, of May 19, 2003. Therefore, it is important that the City understand'some of the implications of proceeding with permitting. One of the important issues that comes into play is the regulatory requirement, implemented since your site was originally permitted, that the landfill liner be ballasted against hydrostatic uplift due to high groundwater conditions, or that it be raised above groundwater. This requirement could reduce site capacity, depending on whether soil or waste is used as ballast material. In addition, liner requirements are substantially more stringent, further reducing capacity and increasing cost. Please note that these changes would have affected your site prior to its operation, regardless of whether you secured the Subtitle D permit modification in 1993 or any time since then. In addition, Seabrook is no longer participating in the landfill, and the LaPorte commercial waste stream is no longer under the control of the City. Therefore, cost and site capacity are feasibility factors that have changed since the last analysis of the site. This memo provides a brief discussion of these issues, as a decision -making tool. Two design scenarios are addressed: 1) Raising the bottom of the landfill to an elevation above groundwater, and 2) Holding the limit of excavation at its current permitted elevation, but ballasting the liner with additional soil at the assumed ratio of one foot of soil for each two feet of hydraulic head above the elevation of the bottom- of the liner. Ballasting with waste is another option. This approach would decrease site life less than ballasting with soil. However, it cannot be determined within the scope of this analysis whether waste can be deposited on the liner quickly enough to avoid a costly groundwater under -drain. Therefore, waste for ballast is not fully developed in this letter report. The following is a list of assumptions inherent in this analysis. . • Waste disposal rate will remain constant at 1,000 tons per month, or 2,300 cubic yards per month. This is greatly reduced from the original analysis, which included Seabrook and LaPorte's commercial waste. • Average groundwater elevation is at approximately elevation +5 ft. msl. • Average existing ground surface is at approximately elevation +14 ft. msl. • Currently permitted (Pre -Subtitle D) top of in -situ liner is at approximately elevation —6 ft. msl. • Depth of excavation prior to ballasting (Scenario 2, above), is at approximately elevation —6 ft. msl. • Waste in -place density is approximately 1200 lb/cu. yd. Initial financing is assumed to have a 20-year term. Operation & Maintenance, closure, and post -closure costs per ton are based on actual costs and financial assurance documentation for typical Subtitle D landfills. • It is assumed that there are no substantive changes in the regulations between now and the time that the site begins disposal operations. New requirements between now and then will probably have to be incorporated in the design and operations, regardless of permit status at the time of the regulatory change. Scenario 1 represents a site life reduced from approximately 130 years to approximately 62 years. Under this scenario, it is estimated that the cost per ton for disposal will be in excess of $56.51 per ton or $24.57 per cubic yard of waste disposed. With 20% contingencies including mobilization and demobilization, the estimated cost is $67.81 per ton or $29.48 per cubic yard. Scenario 2 represents a site life reduction from approximately 130 years to approximately 90 years. Under this scenario, it is estimated that the cost per ton for disposal will be in excess of $53.41 per ton or $23.22 per cubic yard'of waste disposed. With 20% contingencies including mobilization and demobilization, the estimated cost is $64.09 per ton or $27.86 per cubic yard. These costs should be compared to current disposal costs in the region, and any incremental haul or transfer costs that might be incurred. The calculations used to generate these conclusions are attached to this memo, for your reference. Documentation regarding my chronic sinus infections and my acute predisposition to infections was provided summer 2001. 4. Date set for providing drainage from the low areas that hold water that are close to the Shaws' and our fences. The low spots need to be leveled or a trench must be dug to promote water runoff, therefore eliminating the mosquito -infested habitat. Dangerous diseases result from low spots in a yard holding water, the ideal mosquito habitat. NOTE: The Pizzitolas and we addressed the poor lawn maintenance and drainage problems behind our fences in a certified return receipt letter sent August 7, 1999. No one from your administrative leadership team ever responded to that letter, nor has any improvement been made, even after the problem was addressed in both the City Council and Planning & Zoning meetings from May -August 2001.
