CALL TO ORDER The meeting was called to order by Mayor Norman Malone at 6:00 p.m. Members of City Council Present: Councilpersons Mike Mosteit, Chuck Engelken, Howard Ebow, Peter Griffiths, Barry Beasley, James Warren, Charlie Young, Bruce Meismer and Mayor Norman Malone. Members of Council Absent: None Members of City Executive Staff and City Employees Present: Assistant City Attorney John Armstrong, Acting City Manager John Joerns, City Secretary Martha Gillett, Others Present: None 2. Mayor Malone delivered the invocation. 3. Mayor Norman Malone led the pledge of allegiance. 4. PETITIONS, REMONSTRANCES, COMM[JNICATIONS, AND CITIZENS AND TAXPAYTERS WISHING TO ADDRESS CITY COUNCIL There were no citizens wishing to address City Council. 5. Council considered approval or other action regarding an ordinance appointing members to the La Porte Area Water Authority. Mayor .Norman Malone presented summary and recommendation of and answered Council's questions. Acting City Manager John Joerns recommended leaving Al Fields on the Water Authority until Mr. Joerns is able to further check the Water Authority codes. City Attorney read: ORDINANCE 2002-2595 - AN ORDINANCE APPOINTING A MEMBER TO THE LA PORTE AREA WATER AUTHORITY, FOR A TERM EXPIRING AUGUST 31, 2003; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilgerson Ebow to approve Ordinance 2002-2595 as presented by Mayor Malone. Second by Councilperson Warren. The motion carried. Ayes: Mosteit, Engelken, Ebow, Griffiths, Beasley, Wan: en, Young, Meismer and Malone Nays: None Abstain: None • City Council Minutes 10-25-02 -Page 2 6. Council Comments Councilmembers Mosteit, Engelken, Ebow, Crriffiths, Beasley, Warren, Young, Meismer and Mayor Malone all had comments. 7. EXECUTIVE SESSION -PURSUANT TO PROVISION OF THE OPEN MEETINGS LAW, CHAPTER 551.071 THROUGH 551.076, 551.086, TEXAS GOVERNMENT CODE, (CONSULATION WITH ATTORNEY, DELIVBERATION REGARDING REAL PROPERTY, DELIBERATION REGARDING PROSPECTIVE GIFT OR DONATION, PERSONNEL MATTERS, DELIBERATION REGARDING REAL PROPERTY, DELIBERATION REGARDING PROSPECTIVE GIFT OR DONATION, PERSONNEL MATTERS, DELIBERATION REGARDING SECURITY DEVICES, OR EXCLUDING A WITNESS DURING EXAMINATION OF ANOTHER WITNESS IN AN INVESTIGATION, DELIBERATION REGARDING ECONOMIC DEVELOPMENT NEGOTIATIONS). 8. There was no Executive Session. 9. There being no further business to come before Council, the Special Called Meeting was duly adjourned at 6:15 p.m. Respectfully submitted, ~l~(~CA rr~ ~~~~ Ma a Gillett City Secretary Passed and approved on this 11~' day of November 2002. ~,w ~w- ~~1~9` ~~ Orman Malone, Mayor • • ORDINANCE N0.2002-~5~ AN ORDINANCE APPOINTING A MEMBER TO THE LA PORTE AREA WATER AUTHORITY, FOR A TERM EXPIRING AUGUST 31, 2003; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Rodney J. Etchberger, Position 3 of the La Porte Area Water Authority, no longer resides within the corporate limits of the City of La Porte. The City Council of the City of La Porte hereby nominates and appoints Robert T. Herrera, a resident of the City of La Porte, as a member to the La Porte Area Water Authority, to serve the unexpired term of Rodney J. Etchberger, which expires on August 31, 2003, or until his successor shall have been duly appointed and qualified. Section 2. If any section, sentence, phrase, clause or any part of any section, sentence, phrase, or clause, of this ordinance shall, for any reasons, be held invalid, such invalidity shall not affect the remaining portions of this ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict only. Section 4. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, s >~ Ordinance No. 2002-~ Page 2 Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 5. This Ordinance shall be effective from and after its passage and approval, and it is so ordered.
